How to write (international) legal histories that would be true to their protagonists while simultaneously relevant to present audiences? Most of us would also want to write "critically" – that is to say, at least by aiming to avoid Eurocentrism, hagiography and commitment to an altogether old-fashioned view of international law as an instrument of progress. Hence we write today our histories "in context". But this cannot be all. Framing the relevant "context" is only possible by drawing upon more or less conscious jurisprudential and political preferences. Should attention be focused on academic debates, military power, class structures or assumptions about the longue durée? Such choices determine for us what we think of as relevant "contexts", and engage us as participants in large conversations about law and power that are not only about what once "was" but also what there will be in the future.
Die Frage, die der Fall Böhmermann aufwirft, ist nicht, ob Böhmermann sich strafbar gemacht hat oder nicht und die Bundesregierung ihre Ermächtigung zur Strafverfolgung erteilen durfte oder nicht. Sondern die Frage ist, ob es Sinn macht, in diesem Fall mit dem Recht zu kommen. Das hängt auf einer ersten und vordergründigen Ebene davon ab, ob das Recht auf diesen Fall überhaupt eine Antwort oder jedenfalls eine einigermaßen klare Antwort hat. Hat es eine Antwort?
Political theology’s recent rise to academic prominence has, no doubt, been inspired by the sense of a certain staleness of standard (read: Anglo-American) analytical political and legal theory. Especially postcolonial and postmodern philosophy has resuscitated debates about the reality of secularization in Europe, pointing out that much of our shared political metaphysic is indeed that – a metaphysic – with close historical links to debates in theology. That should be no surprise. For almost half a millennium theology stood as the primus inter pares among the three "higher faculties" at European universities. The best minds at work in Europe explained the social and political changes to European audiences within a fully God-centric intellectual universe. Awareness of that fact, as Wim Decock points out in this massive and brilliant work, not only assists us in understanding the development of our political and legal vocabularies. It also enables us to grasp the contingency of our present debates, the way opposite standpoints on political and legal obligation refer back to assumptions about human nature, the roles of individual and society and the nature of "law" that are hard to detach from religious speculation. ...
In pursuit of food, hungry animals mobilize significant energy resources and overcome exhaustion and fear. How need and motivation control the decision to continue or change behavior is not understood. Using a single fly treadmill, we show that hungry flies persistently track a food odor and increase their effort over repeated trials in the absence of reward suggesting that need dominates negative experience. We further show that odor tracking is regulated by two mushroom body output neurons (MBONs) connecting the MB to the lateral horn. These MBONs, together with dopaminergic neurons and Dop1R2 signaling, control behavioral persistence. Conversely, an octopaminergic neuron, VPM4, which directly innervates one of the MBONs, acts as a brake on odor tracking by connecting feeding and olfaction. Together, our data suggest a function for the MB in internal state-dependent expression of behavior that can be suppressed by external inputs conveying a competing behavioral drive.
Ferlins are multiple-C2-domain proteins involved in Ca2+-triggered membrane dynamics within the secretory, endocytic and lysosomal pathways. In bony vertebrates there are six ferlin genes encoding, in humans, dysferlin, otoferlin, myoferlin, Fer1L5 and 6 and the long noncoding RNA Fer1L4. Mutations in DYSF (dysferlin) can cause a range of muscle diseases with various clinical manifestations collectively known as dysferlinopathies, including limb-girdle muscular dystrophy type 2B (LGMD2B) and Miyoshi myopathy. A mutation in MYOF (myoferlin) was linked to a muscular dystrophy accompanied by cardiomyopathy. Mutations in OTOF (otoferlin) can be the cause of nonsyndromic deafness DFNB9. Dysregulated expression of any human ferlin may be associated with development of cancer. This review provides a detailed description of functions of the vertebrate ferlins with a focus on muscle ferlins and discusses the mechanisms leading to disease development.
Knowledge on the postmortem interval (PMI) of wild boar (Sus scrofa) carcasses is crucial in the event of an outbreak of African swine fever in a wild boar population. Therefore, a thorough understanding of the decomposition process of this species in different microhabitats is necessary. We describe the decomposition process of carcasses exposed in cages. Trial 1 compared a wild boar and a domestic pig (Sus scrofa domesticus) under similar conditions; Trial 2 was performed with three wild boar piglets in the sunlight, shade, or in a wallow, and Trial 3 with two adult wild boar in the sun or shade. The wild boar decomposed more slowly than the domestic pig, which shows that standards derived from forensic studies on domestic pigs are not directly applicable to wild boar. The carcasses exposed to the sun decomposed faster than those in the shade did, and the decomposition of the carcass in the wallow took longest. To assess the state of decomposition, we adapted an existing total body scoring system originally developed for humans. Based on our studies, we propose a checklist tailored to wild boar carcasses found in the field that includes the most important information for a reliable PMI estimation.
Seit der Studie Otto Brunners ist der Fehde führende Adlige rechtshistorisch rehabilitiert. Anders steht es umdas Bild des seiner Herrschaft unterworfenen Bauern: Ihm als dem unter grundherrlichem "Schutz und Schirm" Stehenden war – wie auch dem Bürger – das "subsidiäre Rechtsmittel" angeblich nur in der Ausnahmeform von Blutrache und Totschlagsfehde erlaubt. Der "neutralere" Kontext einer regulären Interessenkollision zwischen Parteien, den die Konfliktforschung nahe legt, wird für bäuerliches Handeln nicht in Erwägung gezogen; einen aktiven Part bei der Durchsetzung eigener Ansprüche erkennt man dabei höchstens im kollektiven "Widerstand". Eindimensionale soziale Rollenzuschreibungen bestimmen den Forschungshorizont. Nie ist z. B. die Frage gestellt worden, ob ein mittelalterlicher oder frühneuzeitlicher Mensch tatsächlich der Waffenfähigkeit oder Waffen bedurfte, um eine Fehde zu führen. So weckt der "gemeine Mann" in der viel besprochenen Untersuchung von Gadi Algazi zwar erstmals überhaupt das nähere Interesse einer Untersuchung zum Fehdewesen, tritt jedoch auch da nur als Objekt einer sich sozial reproduzierenden "Herrengewalt" in Erscheinung. Algazis Ansatz hat allerdings Denkanstöße gegeben, ohne welche wohl gerade Christine Reinles Habilitationsschrift nicht jene konzeptionelle Konturschärfe gewonnen hätte, die sie kennzeichnet. Selbstredend setzt sich die Autorin darin nicht nur mit Algazi auseinander – auch wenn dieser mit Abstand ihrHauptgegner bleibt. Die zugegeben nicht sehr quellengesättigte These des Historikers steht auf einer Beobachtungslinie mit den Studien von Joseph Morsel und Hillay Zmora. Allen dreien geht es, grob gesagt, um die soziale statt die seit Brunner oft strapazierte rechtliche Funktion der Fehden – um die Beobachtung einer engen Verknüpfung dieser Konfliktpraxis mit sozialer Stratifikation und adliger Herrschaftsbildung. ...
Cryptochromes are a ubiquitous group of blue-light absorbing flavoproteins that in the mammalian retina have an important role in the circadian clock. In birds, cryptochrome 1a (Cry1a), localized in the UV/violet-sensitive S1 cone photoreceptors, is proposed to be the retinal receptor molecule of the light-dependent magnetic compass. The retinal localization of mammalian Cry1, homologue to avian Cry1a, is unknown and it is open whether mammalian Cry1 is also involved in magnetic field sensing. To constrain the possible role of retinal Cry1, we immunohistochemically analysed 90 mammalian species across 48 families in 16 orders, using an antiserum against the Cry1 C-terminus that in birds labels only the photo-activated conformation. In the Carnivora families Canidae, Mustelidae and Ursidae and in some Primates, Cry1 was consistently labeled in the outer segment of the shortwave-sensitive S1 cones. This finding would be compatible with a magnetoreceptive function of Cry1 in these taxa. In all other taxa, Cry1 was not detected by the antiserum that likely also in mammals labels the photo-activated conformation, although Western blots showed Cry1 in mouse retinal cell nuclei. We speculate that in the mouse and the other negative-tested mammals Cry1 is involved in circadian functions as a non-light-responsive protein.

Matthias Beltz hat beiläufig mit Lebensweisheiten und assoziativ aufgetürmtem Scharfsinn nicht nur seine Fragen bewaffnet, in denen gewagte Antworten ihren vitalen Keim austreiben, sondern auch das Misstrauen gesät gegenüber politisch korrekten, nachgeplapperten und smarten Antworten. ...
