The present paper is a contribution to the ongoing discussion on the various relationships between language and law. It is impossible to deal with all these relationships in the present study. Therefore the relationship between language and law will be dealt with in this paper as far as it points out the relationships between linguistics and jurisprudence. Considering the diverse relationships between the fields of linguistics and jurisprudence, the interdisciplinary collaboration between these two disciplines could be improved by establishing a branch of study dealing with legal linguistics.
Mit den sogenannten "Hartz‐Reformen" ab 2002 begann die Umorganisation der öffentlichen Arbeitsverwaltung zu einem – dem Selbstverständnis nach – „modernen Dienstleister“. Die explizit als „Dienstleistungs“-Reform angelegten Neuerungen sollten sich mit verbessertem Service sowohl an die Arbeitnehmer als auch die Arbeitgeber richten (Hielscher/Ochs 2009, 18). Da es, wie Habscheid (2003, 8) feststellt, in Organisationen "längst üblich [ist], über "Sprache" nachzudenken und den Versuch zu unternehmen, sprachliche Mittel gezielt auf organisationale Zwecke hin zu funktionalisieren", hat sich – wenn auch erst wesentlich später, im Jahr 2009 – auch die Bundeszentrale der Agentur für Arbeit in Nürnberg mit sprachlichen Verbesserungen im Feld der "Kundenkommunikation" beschäftigt. Überarbeitet werden sollen die (standardisierten) Schreiben an die Arbeitslosen, die hier auch Gegenstand der Untersuchung sein werden. Bei dieser Überarbeitung stand – dem Verständnis als Dienstleister entsprechend – der Aspekt "Kundenfreundlichkeit" im Mittelpunkt. In der folgenden Analyse soll nun untersucht werden, wie dies in den Texten umgesetzt wird. Wie "freundlich" sind die Schreiben, was wurde verbessert, was bleibt eventuell kritisch zu sehen? Wie verständlich, wie klar sind die Schreiben formuliert, tritt eher ein "Amts‐" oder "Dienstleistercharakter" hervor?
This article discusses the communicative and the intercultural approaches to language teaching and learning. Firstly, it describes the core theoretical principles, goals, and the roles of teachers and learners in both approaches, as well as the way they are treated in different German textbooks. Secondly, it discusses a set of core principles and concepts (‘activity’, ‘interaction’, ‘motivation’ and ‘communicative posture’), as well as the didactic-pedagogical implications of implementing a communicative approach to language teaching and learning. Finally, it includes a reflection about the necessity for the language teacher to develop an intercultural background, as well as the eclectic use of different linguistic theories and language teaching approaches to make the acquisition of communicative and intercultural competence viable.
In dyadic communication, both interlocutors adapt to each other linguistically, that is, they align interpersonally. In this article, we develop a framework for modeling interpersonal alignment in terms of the structural similarity of the interlocutors’ dialog lexica. This is done by means of so-called two-layer time-aligned network series, that is, a time-adjusted graph model. The graph model is partitioned into two layers, so that the interlocutors’ lexica are captured as subgraphs of an encompassing dialog graph. Each constituent network of the series is updated utterance-wise. Thus, both the inherent bipartition of dyadic conversations and their gradual development are modeled. The notion of alignment is then operationalized within a quantitative model of structure formation based on the mutual information of the subgraphs that represent the interlocutor’s dialog lexica. By adapting and further developing several models of complex network theory, we show that dialog lexica evolve as a novel class of graphs that have not been considered before in the area of complex (linguistic) networks. Additionally, we show that our framework allows for classifying dialogs according to their alignment status. To the best of our knowledge, this is the first approach to measuring alignment in communication that explores the similarities of graph-like cognitive representations. Im Rahmen einer Projektarbeit zum Thema Argumentationstheorie im WS 2008/09 haben sich die teilnehmenden Studentinnen und Studenten der Universität zu Köln das Ziel gesetzt, ca. 600 Kommentare zur Frage „Do smoking bans mean a cultural shift for Paris and Berlin?“ des „Have your say“-Forums der BBC auf ihre Argumentationsmuster hin zu analysieren. Die Ausgangsfrage im BBC-Forum richtete sich also nach dem „cultural shift“, also der kulturellen Veränderung, die das Rauchverbot in Kneipen und Cafés für die beiden Metropolen bedeuten könnte. Sehr bald ergab unsere Analyse jedoch, dass dies nicht die Frage war, die innerhalb der Kommentare im Zentrum der Aufmerksamkeit stand: Stattdessen wurde in erster Linie darüber diskutiert, wie das Rauchverbot generell – und zwar nicht nur in den beiden genannten Städten – bewertet werden sollte. Gut zwei Drittel der Beiträge bezogen klar Stellung für oder gegen ein Rauchverbot in der Gastronomie. Für unsere Analyse der Argumentationsmuster haben wir zum einen die klassischen argumentationstheoretisch relevanten Faktoren berücksichtigt wie Fallacies und verdeckte Prämissen. Hinzu kamen dann zwei weitere Arten von Parametern: erstens Faktoren, die in argumentationstheoretischen Abhandlungen eher nur am Rande berücksichtigt werden wie z.B. Evidenztyp und Überzeugungskraft, und zweitens Informationen, die speziell mit der Art des Diskussionsforums bzw. dem Inhalt der Diskussion zu tun haben, wie etwa Selbstauskünfte über das eigene Raucherverhalten.
