Der Beitrag knüpft an die vergangenes Jahr intensiv geführte Debatte um die strafrechtliche Bewertung von Klima-Protesten an und lenkt die Aufmerksamkeit auf einen bislang kaum beachteten Aspekt, nämlich die Frage, ob sich Klima-Aktivistinnen und Aktivisten dem Unrecht ihres Verhaltens im Rahmen von Protestaktionen mit Blick auf die mögliche „Klimakatastrophe“ (stets) bewusst sind und entfaltet erste Überlegungen im Hinblick auf mögliche Verbotsirrtümer. In diesem Zusammenhang geht der Beitrag auch auf die Frage ein, ob eine Rechtfertigung von Protestaktionen wegen eines rechtfertigenden (Klima-)Notstands oder eines möglichen verfassungswidrigen Staatshandelns im Zusammenhang mit der Klimaschutzpolitik denkbar ist.
Die Privatautonomie ist ein zentrales Strukturmerkmal des deutschen Zivilrechts und eng mit der Vertragsfreiheit verwoben. Doch was macht die Privatautonomie konkret aus, in welchem Verhältnis steht sie zur Vertragsfreiheit und können beide losgelöst voneinander in einer Rechtsordnung verwirklicht sein? All diese Fragen, welche die grundlegenden Merkmale unseres geltenden Zivilrechts betreffen, stellen sich, wenn man sich der Frage widmet, ob es im Zivilrecht der DDR Privatautonomie gab. Der Blick zurück lohnt, auch um das geltende Zivilrecht und seine Strukturmerkmale noch besser zu verstehen.
Zwei nennenswerte Autoren des 19. und 20. Jahrhunderts sind Heinrich Brunner sowie Rudolf His. Beiden gelang es durch intensive Quellenauswertung Licht in das vielmals als düster betrachtete Mittelalter zu bringen. Der Beitrag geht der Frage nach, wie Brunner und His die mittelalterlichen Quellen am Beispiel der Strafen zu Haut und Haar deuteten und was wir anhand der gezogenen Erkenntnisse über die Zeit, in der beide lebten, lernen können. Brunner und His waren Teil der germanistischen Strömung und lebten in einem Zeitalter, in dem neue Kodifikationen wie Unkraut aus der Erde schossen. Zudem war das 19. Jahrhundert von vielen gesellschaftlichen Umbrüchen geprägt. All diese Umstände sind in die Quellenanalyse der Autoren eingeflossen und führten stellenweise zu Kategorisierungsversuchen, Verallgemeinerungen und einer Rekonstruktion eines Systems, welches es so nicht gegeben haben kann.
Die Anwendung des kartellrechtlichen Diskriminierungsverbots auf marktbeherrschende Intermediäre

Nach deutschem und europäischem Wettbewerbsrecht ist marktbeherrschenden Unternehmen eine ungerechtfertigte Diskriminierung ihrer Geschäftspartner versagt, § 19 Abs. 1, 2 Nr. 1 GWB. Dieses kartellrechtliche Diskriminierungsverbot bietet mit seiner auf die Marktoffenheit gerichteten Zielsetzung einen konzeptionellen Anknupfungspunkt fur die wettbewerblichen Gefahren konzentrationsgeneigter mehrseitiger Markte mit marktbeherrschenden Intermediaren, insbesondere in der Digitalokonomie. Der Zugang zu Vermittlungsleistungen kann hier von sachgerechten, angemessenen und diskriminierungsfrei gehandhabten Kriterien abhängig gemacht werden. Sind die Vermittler zudem vertikal integriert, kann aus § 19 Abs. 2 Nr. 1 GWB auch ein Selbstbevorzugungsverbot abgeleitet werden. Trotz neuer Instrumente behält das klassische kartellrechtliche Diskriminierungsverbot auch in solchen Fällen Bedeutung.
Mit dem am 22. September 2021 neu in Kraft getretenen § 126a StGB, der nun explizit das Anlegen von Feindeslisten unter Strafe stellt, sollen Menschen (noch) besser gegen Hass und Hetze im Internet geschützt werden. So legitim diese Intention auch ist, drängt sich gleichsam die Frage auf, ob diesem Phänomen wirkungsvoll mit dem Strafrecht entgegnet werden kann und aus rechtsstaatlicher Perspektive überhaupt werden darf. Unter dieser Prämisse wird kritisch eruiert, ob und inwiefern sich § 126a StGB in das dogmatische Gerüst des Strafrechts einordnen lässt. Dabei ist § 126a StGB dem modernen Präventionsstrafrecht zuzuordnen. Dieses verfolgt den Ansatz, durch eine Vorverlagerung der Strafbarkeit das Strafrecht als funktionales Mittel zur Erhöhung des Sicherheitsgefühls zu instrumentalisieren. Nach der Bewertung der tatsächlichen Bedrohungslage wird der Handlungsunwert der Verbreitung von Feindeslisten analysiert. Daneben werden weitere Grenzen der strafrechtlichen Vorverlagerung beleuchtet, namentlich die fundamentalen Prinzipien des Tatstrafrechts, des Bestimmtheitsgebots und des Ultima-Ratio-Grundsatzes, an denen sich § 126a StGB messen lassen muss.
Virtual currencies have gained popularity as part of the digital transformation of the financial system. In particular stablecoins are becoming increasingly popular with consumers. The tokens, which are pegged to a value and - according to their name - promise price stability, pose significant risks from which consumers need to be protected. This article focuses first on consumerspecific risks (B.) and German consumer protection law and in particular on the applicability of a right of withdrawal from the acquisition of stablecoins (C.). Subsequently, the EU legislator’s effort to minimize price stability as well as transparency and exchangeability risks, the Markets in Crypto-assets Regulation (2023/1114), is examined in terms of its consumer protection instruments (D.).
Die vorliegende Dissertation bietet eine eingehende Analyse der Entstehung und Evolution der rechtlichen Rahmenbedingungen der Arbeitnehmerüberlassung in der Volksrepublik China. Ursprünglich in den 1980er Jahren als Instrument zur Reduzierung der Arbeitslosigkeit eingeführt, hat sich die Funktion der Arbeitnehmerüberlassung im Laufe der Zeit gewandelt. Diese Entwicklung wird in der Arbeit sorgfältig nachgezeichnet.
Die Studie skizziert die legislative Entwicklung von der anfänglichen Konzeption bis zur formellen Legalisierung im Jahr 2007 und untersucht die geltenden gesetzlichen Bestimmungen zur Arbeitnehmerüberlassung. Dabei werden die spezifischen Aspekte der chinesischen Gesetzgebung herausgestellt, bei der die Arbeitnehmerüberlassung vornehmlich als komplementäre Beschäftigungsform angesehen wird. Die Arbeit beleuchtet die Rechte und Pflichten aller Akteure. Obwohl nicht umfassend rechtsvergleichend angelegt, wird doch immer wieder ein Blick auf die Rechtslage in Deutschland geworfen, sodass die unterschiedlichen regulatorischen Ansätze deutlich hervortreten. Zugleich werden die besonderen Herausforderungen behandelt, denen diese Beschäftigungsform im chinesischen Kontext begegnet.
The Russian invasion of Ukraine illustrates the increasingly judicialized nature of international relations and geopolitics. By viewing aspects of the invasion as illegal – in particular through the identification of war crimes and crimes against humanity – the international response draws attention to the political geographies of international criminal investigation. Human rights groups, academics, journalists, and open-source forensic investigations have joined forces to collect, evaluate and analyze the violent nature of war crimes. While similar shifts in evidence gathering have been observed in the case of the Bosnia-Herzegovina war and the Assad regime's violence against Syrian citizens, the use of evidence-gathering technologies and evidence-securing institutions in the case of Ukraine is distinctive. In this scholarly intervention we seek to illustrate the intimate geopolitics of evidence gathering by zooming in on two different elements that shape evidential procedures in Ukraine: i) the blurring of civilian/military boundaries; and ii) the challenges of access. By evaluating what is new and what is similar to previous war sites, we suggest that these two areas reflect a geopolitics of evidence gathering, highlighting its global-local intimacies. Both these areas are well positioned to foster new research on the (geo)legal nature of war crimes in political geography and beyond.
Im November durfte er seinen 77. Geburtstag feiern, von Ruhestand ist aber noch keine Spur. Gerade bereitet er sich in seinem Büro über der Neuen Mensa am alten Campus in Bockenheim mit großem Elan auf die nächste Seminarsitzung vor. »Die Lehre an der Universität wie an Fachhochschulen war mir nie eine Last. Ich habe versucht, die Studierenden zu motivieren oder bei Bedarf gar zu provozieren, um zu kommunizieren, weil wir alle viel mehr von gegenseitigem Austausch haben«, sagt Ludwig Salgo. Zahlreiche Studierende der Sozialen Arbeit, aus der Rechtswissenschaft, aber auch aus der Erziehungswissenschaft haben seine Veranstaltungen besucht; etliche Juristinnen und Juristen haben bei ihm promoviert, sich für die pädagogische oder juristische Laufbahn qualifiziert. Sein zentrales Thema in Forschung und Lehre: das Verhältnis Eltern-Kind-Staat. Anfang 2012 ging er in den Ruhestand, doch die Lehre blieb vorerst seine große Passion. Jetzt beendet er seine Seniorprofessur an der Goethe-Universität zum Semesterende nach zehn Jahren: »Nun ist es genug«, sagt er. In der Fortbildung für Jugendämter, Verfahrensbeistände und Juristen, auch in Stiftungen und Verbänden, hier vor allem im Kinderschutzbund in Frankfurt, möchte er weiterhin aktiv bleiben, auch um für das Thema Kindeswohl zu sensibilisieren. Dass er dann mehr Zeit für seine große Leidenschaft haben wird, freut ihn: »Ich leide an der Melomanie«, sagt der passionierte Freund klassischer Musik. »Wie Nietzsche treffenderweise einmal bemerkt hat, wäre das Leben ohne Musik ein Irrtum.«
The Åland Islands archipelago enjoys a special international status sui generis, which essentially encompasses demilitarisation, neutralisation, and autonomy. This status is guaranteed under international law by the agreements of 1921, 1940, and 1947, which are still in force. Furthermore, there are convincing reasons to assume that the Åland Islands regime has grown into European customary law. By virtue of her international (treaty) obligations, Finland cannot unilaterally change this status under the present conditions, irrespective of domestic (constitutional) decisions. While integration into NATO’s collective defence system and the EU’s Common Security and Defence Policy structures is compatible with the special status of the Åland Islands, care must be taken by Finland and her partners to ensure that the obligations arising from these developments are fulfilled in accordance with the demilitarised and neutralised status of the archipelago. This includes that the use by Finnish troops for preventive defence, beyond the exceptions laid down in the 1921 Åland Agreement, is only permitted in the case (of threat) of an immediate and clearly identifiable attack.
The autonomous character of the Åland Islands was established under a League of Nations dispute settlement and implemented, inter alia, in Finnish legislation. Its essence even grew into customary law. The arrangements of 1921, however, do not constitute a bilateral treaty between Finland and Sweden. The UN assumes that the international mechanism to protect Åland’s autonomy did not become obsolete with the demise of the League of Nations, but was only “suspended until such time as an express decision has been taken by the United Nations to put it back into force”. A corresponding proposal could be submitted, in any case, both by Finland and/or Sweden or possibly even by any other UN member state, for discussion in the Sixth Committee. However, the final decision to re-activate this special mechanism would have to be adopted by the UN General Assembly.
EU Law applies to the Åland Islands in principle; however, Finland’s Accession Treaty to the EU to which Protocol No. 2 on the Åland Islands was annexed, established a number of specific rules which are still in force today. This, most notably, results in the limited application of value added tax and excise duties in the Åland Islands. Therefore, the rules on customs procedures apply with respect to the movement of goods to and from the Åland Islands. In addition, other provisions of Union law, in particular those relating to fundamental freedoms and European state aid law, may be relevant in view of the special fiscal status of the Åland Islands. However, assessing individual cases would require further information and in-depth studies. Irrespective of the requirements set out in the said Protocol, the EU is obliged to respect the national identity of Member States pursuant to Article 4 para. 2 TEU; this obligation includes respect for the special status of the Åland Islands under both international and Finnish constitutional law.
Corporate governance is the set of rules, be they legal or self-regulatory, practices and processes pursuant to which an insurance undertaking is administrated. Good corporate governance is not only key to establishing oneself and succeeding in a competitive environment but also to safeguarding the interests of all stakeholders in an insurance undertaking. It is insofar not surprising that mandatory requirements on the administration of insurance undertakings have become rather prolific in recent years, in an attempt by regulators to protect especially policyholders against perceived risks hailing from improperly governed insurance undertakings. In Germany this has been regarded by many undertakings as an overly paternalistic approach of the legislator, especially considering that the German insurance sector has experienced for decades if not centuries a remarkably low number of insolvencies and that German insurers were neither the trigger nor the (especially) endangered actors in the financial crisis commencing in 2007. Notwithstanding the true core of this criticism, that the insurance industry was taken to a certain degree hostage by the shortcomings within the banking sector, the reform of German Insurance Supervisory Law via implementation of the Solvency II-System has brought many advances in the sense of better governance of insurance undertakings and has also brought to light many deficiencies that the administration of some insurance undertakings may have suffered from in the past, which are now more properly addressed.

Die Verfassungsgeschichte der Bundesrepublik Deutschland beginnt in Frankfurt: Am 1. Juli vor 75 Jahren haben die Militärgouverneure der drei Westmächte im Eisenhower-Saal des I.G. Farben-Haus (heute Campus Westend) drei Urkunden übergeben. Diese »Frankfurter Dokumente« enthielten den Auftrag, eine Verfassung für das künftige Deutschland zu erarbeiten.
Bibliometric analysis of research publications would be the basis of the present study which would therefore highlight the inter linkage between the already existing researches which mainly talk about the concept of taxation with respect to it in the sphere of exemption of taxes from a set of organizations. The frequency of the publication on the same would be determined. Keeping in track the frequency of publications about the said exemptions and tax regimes. The topic clearly hasn't got much attention from the researchers. The data was collected from the Scopus and Web of Science database and has been analysed using VOSviewer software. The literature review which was pursued was gathered respectively in order to understand the concept of taxation of these charitable trusts and religious institutions. The study consists of a total of 1773 documents from Scopus and 617 documents from Web of Science (English) which are classified into articles, letters, books and editorial reviews etc. The data which is collected on the same lines would be analysed by the researchers using graphs, tables and charts.
Der Beitrag führt ein in ein am Münsteraner Sonderforschungsbereich 1385 Recht und Literatur entwickeltes Dissertationsprojekt, dessen Ausgangspunkt der bisweilen auftretende Kollisionsfall zwischen allgemeinem Persönlichkeitsrecht und Kunstfreiheit darstellt. Konkret wird die Frage diskutiert, inwiefern fiktionale Texte persönlichkeitsrechtsverletzend sein können.
Women are overrepresented in informal employment in the Indian labour market. They also devote more time to unpaid care work than men do. The poor working conditions of women are attributable to this double burden of work. Due to the lack of regulatory measures to protect the interest of informal women workers along with rigid gender norms, women’s participation in paid work is drastically reduced. As far as unpaid care work is concerned, feminist economists have been striving to make such work visible for a long time now. There have been some developments in labour statistics, with time use surveys quantifying women’s paid and unpaid contributions to the economy. This article delves into the examination of unpaid care work in India with the help of the Indian government’s recent Time-use Survey. It attempts to study the connection between paid work and unpaid care work and its implications for the working conditions of women in India. Finally, it evaluates the ‘right to work’ as a possible solution by using the example of employment guarantee schemes in India.
Im Gesetzgebungsverfahren zur Umsetzung des Kohleausstiegs wurde kurz vor den abschließenden Beratungen auf Initiative des Ausschusses für Wirtschaft und Energie eine Vorschrift in das Gesetz zur Reduzierung und zur Beendigung der Kohleverstromung (KVBG) aufgenommen, die die “Notwendigkeit” des Braunkohletagebaus Garzweiler II rechtlich absichern soll (§48 KVBG; dazu 1). Unabhängig von der Frage, ob dieser Versuch durch die verschärften Jahresemissionsmengen für die Energiewirtschaft, die durch die Entscheidung des Bundesverfassungsgerichts vom 24.3.2021 veranlasst sind, bereits als überholt angesehen werden kann, und auch unabhängig von materiellen Bedenken fehlt dem Bund die Gesetzgebungskompetenz. Denn die Vorschrift ist an dem Erforderlichkeitsmaßstab des Art. 72 Abs. 2 GG zu messen (dazu 2) und die Anwendung der dazu in der Rechtsprechung entwickelten Kriterien (dazu 3) auf §48 KVBG führt zu dem Ergebnis, dass es an der Erforderlichkeit der Bedarfsfeststellung für Garzweiler II zur Wahrung der Wirtschaftseinheit im gesamtstaatlichen Interesse fehlt (dazu 4).
“Protection of the environment“ and “sustainability“ are more significant than ever. The legal system contributes an important share to the protection of the environment. However, an overview of the German private environmental liability law shows that conventional tort law is not a suitable basis for civil liability for the environmental consequences of officially approved emissions of greenhouse gases. In general, one of the main problems of private environmental liability law lies in proving the individual causality of the conduct of an emitter, as the lawsuit of a Peruvian homeowner against a German energy company pending before the Higher Regional Court of Hamm illustratively demonstrates. The outcome of this lawsuit, which may have an outstanding significance for the status and development of private environmental liability law in Germany, is awaited with great anticipation. The article also briefly examines recent developments in private environmental liability law outside Germany and the question to what extent insurance can be an instrument to protect the environment.
Regulierung im Gesundheitswesen ist einerseits spezifisch, andererseits werden zunehmend Regulierungsansätze aus anderen Sektoren übernommen. Dies wirft grundsätzliche rechtswissenschaftliche Fragestellungen auf: Was sind die Besonderheiten des Gesundheitssektors? Dürfen allgemeine Regulierungsformen auf den Gesundheitssektor übertragen werden? Wie beeinflusst die europäische Gesetzgebung diese Entwicklungen? Der Band enthält Beiträge von ausgewiesenen Expertinnen und Experten des Gesundheitsrechts, die sich anhand aktueller Fragen aus den Bereichen Bedarfsplanung, Arzneimittelregulierung, Wettbewerbsrecht sowie der EU-Patientenrichtlinie mit den Möglichkeiten rechtlicher Regulierung im Gesundheitswesen befassen. Dabei wird auch die neuste Gesetzgebung, insbesondere das Versorgungsstrukturgesetz, erörtert.
Transnational Legal History : Erforschung rechtlicher Entwicklungen jenseits nationaler Grenzen

In this article, I question the use of the notion of ‘constituent power’ as a tool for the democratization of the European Union (EU). Rather than seeing the absence of a transnational constituent power as a cause of the EU’s ‘democratic deficit’, I identify it as an opportunity for unfettered democratic participation. Against the reification of power-in-action into a power-constituted-in-law, I argue that the democratization of the EU can only be achieved through the multiplication of ‘constituent moments’. I begin by deconstructing the normative justifications surrounding the concept of constituent power. Here I analyze the structural aporia of constituent power and question the autonomous and emancipatory dimension of this notion. I then test the theoretical hypothesis of this structural aporia of the popular constituent power by comparing it with the historical experiments of a European popular constituent power. Finally, based on these theoretical and empirical observations, I propose to replace the ambivalence of the concept of popular constituent power with a more cautious approach to the bottom-up democratization of European integration: that of a multiplication of transnational constituent moments.
Justification: In Mexico, the number of unidentified bodies has been steadily rising for years. By now, more than 50,000 bodies are considered unidentified. Forensic laboratories that could perform comparative molecular genetic investigation are often overburdened and examinations can take months. Therefore, pragmatic approaches that can help to identify more unknown bodies must be sought. The increased use of distinctive physical features might be one, and the high rate of tattooed people in Mexico points towards a great potential of tattoos as a tool for identification. The prerequisite for a comparison of antemortem (missing persons) and postmortem (unknown bodies) data is an objective description of the particularities, e.g., of the tattoos. The aim of this study was to establish an objective classification for tattoo motives, taking into consideration local preferences.
Methods: In the database of the medicolegal services of the Instituto Jaliscience de Ciencias Forenses (IJCF) in Guadalajara, postmortem data of 1000 tattooed bodies from 2019 were evaluated. According to sex and age, the tattooed body localization and the tattoo motives were categorized.
Results: The 1000 tattooed deceased showed tattoos on 2342 body localizations. The motives were grouped and linked to the following 11 keywords (with decreasing frequency): letters/numbers, human, symbol (other), plant, symbol (religious), animal, object, fantasy/demon/comic, tribal/ornament/geometry, other, unrecognizable.
Conclusion: Using the proposed classification, tattoo motives can be described objectively and classified in a practical way. If used for antemortem (missing persons) and postmortem (unknown bodies) documentation, motives can be searched and compared efficiently—helping to identify unknown bodies.
Zentrales Forschungsanliegen der vorliegenden Abhandlung ist die Erörterung der Probleme, welche sich für die Corporate Governance einer Aktiengesellschaft ergeben, wenn abweichend vom gesetzlichen Optimalbild eine Divergenz zwischen dem Stimmrecht des Aktionärs und dessen wirtschaftlicher Betroffenheit vorliegt. Der von seinen Entscheidungen nicht proportional betroffene Aktionär soll als Corporate Governance Akteur in den Blick genommen werden.
Wieso aber lohnt sich eine erneute Befassung mit einem Problem, welches Easterbrook und Fischel bereits 1983 als ein solches identifiziert haben? Zum einen ist die internationale und deutsche Corporate Governance Debatte erheblich vorangeschritten. Steckte diese zum Zeitpunkt des Aufsatzes „Voting in Corporate Law“ noch in den Kinderschuhen, hat sie sich heute zu einem eigenen Forschungsfeld entwickelt, welches Juristen und Ökonomen in aller Welt beschäftigt. Der nicht proportional betroffene Aktionär wird in das durch diese Forschungsströmung entwickelte moderne Corporate Governance System eingeordnet. Zum anderen sind vor allem durch die Entwicklung vielfältiger Finanzderivate im Rahmen der sogenannten „derivatives revolution“ die Möglichkeiten durch schuldrechtliche Vereinbarungen eine entsprechende Disproportionalität zu erzeugen erheblich gestiegen. Während Easterbrook und Fischel noch feststellten „[…] it is not possible to seperate the voting right from the equity interest“, gestatten moderne Finanzprodukte es Aktionären, ihre wirtschaftliche Betroffenheit und zugleich deren Verhältnis zu ihrer Stimmrechtsmacht fast beliebig auszugestalten.
Die Zusammenschau aus einer erheblich diffizileren Corporate Governance Debatte in Verbindung mit einer neuen Vielzahl an Möglichkeiten eine Disproportionalität zwischen Stimmrecht und wirtschaftlicher Betroffenheit zu erzeugen, gibt der Thematik die notwendige Aktualität, die eine vertiefte Befassung anzeigt.
In Abgrenzung zu den bislang in diesem Themenkreis erschienenen Arbeiten, welche sich vor allem isoliert mit den Folgen für das Stimmrecht bzw. den einzelnen Anteilseigner befassen, thematisiert die vorliegende Abhandlung vor allem die Auswirkungen, welche die Trennung von Stimmrecht und wirtschaftlicher Betroffenheit für die Corporate Governance Struktur der Aktiengesellschaft nach sich ziehen kann. Auf diese Weise wird die Problematik der Ausübung disproportionaler Stimmrechte in die Erkenntnisse der Corporate Governance Theorie eingeordnet und insbesondere auch die ökonomischen Folgen selbiger herausgearbeitet. Die so gewonnenen Ergebnisse verdeutlichen den gesetzgeberischen Handlungsbedarf.
Sudden cardiac death (SCD) in adolescents and young adults may be the first manifestation of an inherited arrhythmic syndrome. Thus identification of a genetic origin in sudden death cases deemed inconclusive after a comprehensive autopsy and may help to reduce the risk of lethal episodes in the remaining family. Using next-generation sequencing (NGS), a large number of variants of unknown significance (VUS) are detected. In the majority of cases, there is insufficient evidence of pathogenicity, representing a huge dilemma in current genetic investigations. Misinterpretation of such variants may lead to inaccurate genetic diagnoses and/or the adoption of unnecessary and/or inappropriate therapeutic approaches. In our study, we applied current (ACMG) recommendations for variant classification in post-mortem genetic screening of a cohort of 56 SCD victims. We identified a total 53 rare protein-altering variants (MAF < 0.2%) classified as VUS or worse. Twelve percent of the cases exhibited a clinically actionable variant (pathogenic, likely pathogenic or VUS – potentially pathogenic) that would warrant cascade genetic screening in relatives. Most of the variants detected by means of the post-mortem genetic investigations were VUS. Thus, genetic testing by itself might be fairly meaningless without supporting background data. This data reinforces the need for an experienced multidisciplinary team for obtaining reliable and accountable interpretations of variant significance for elucidating potential causes for SCDs in the young. This enables the early identification of relatives at risk or excludes family members as genetic carriers. Also, development of adequate forensic guidelines to enable appropriate interpretation of rare genetic variants is fundamental.
Der deutsche und der europäische Gesetzgeber kodifizierten 2013 bzw. 2019 verwandte Schutzrechte zugunsten von Presseverlegern. 2021 und 2023 erließen Australien und Kanada Sondergesetze zum Schutz der Presse im Internet. In den USA und der Schweiz sind entsprechende Legislativvorhaben anhängig. Ultimatives Ziel all dieser Interventionen ist es, ein tragfähiges digitales Pressewesen zu
gewährleisten. Presseverlegern soll zu Einnahmen verholfen werden, die von Betreibern von Suchmaschinen, News-Aggregatoren, Medienbeobachtungsdiensten und sozialen Netzwerken bezahlt werden sollen. Der Beitrag unterscheidet in rechtsvergleichender Betrachtung zunächst zwei Typen der Presseförderung im Internetzeitalter, nämlich einen klassisch-eigentumsmäßigen Ansatz – paradigmatisch realisiert im deutschen Recht – und einen systemisch-marktregulativen, von medienpolitischen Erwägungen geleiteten Ansatz – paradigmatisch verwirklicht im australischen und kanadischen Recht. Anschließend werden die sich spiegelbildlich verhaltenden Vor- und Nachteile dieser beiden Regulierungstypen benannt. Der folgende Abschnitt stellt hybride Lösungen im französischen, italienischen und schweizerischen Recht vor. Schlussbemerkungen führen zurück zur international-vergleichenden Perspektive und zur Frage, was ein wie auch immer gearteter Schutz der Presse in Anbetracht der tektonischen Verschiebungen, die die Online-Kommunikation mit sich bringt, zu bewirken vermag.
Vor dem Hintergrund von Globalisierung und Migrationsbewegungen ist die Staatsbürgerschaft vermehrt der Frage nach der Rechtfertigung der Grenzen des Demos ausgesetzt. Prägend für die verfassungsrechtliche Definition dieser Grenzen war der ehemalige Bundesverfassungsrichter Ernst-Wolfgang Böckenförde, der auch die Ablehnung der ersten Anläufe des Ausländer:innenwahlrechts mitverantwortete. Der vorliegende Aufsatz vollzieht vor diesem Hintergrund Böckenfördes Bild der Staatsbürgerschaft nach. Seine Konzeption umfasst dabei in erster Linie einen legalen Status. Im Zusammenhang mit Böckenfördes Auslegung des Demokratieprinzips bleiben die historisch-spezifischen Inhalte und Grenzen der Bürgerschaft darüber hinaus stets an die Integrationsmöglichkeiten und das Selbstverständnis gegebener, notwendig homogener politischer Einheiten gekoppelt. In der Konfrontation mit der Kritik exklusiver politischer Gemeinschaften zeigt sich dennoch eine weite politische Gestaltungsfreiheit innerhalb von Böckenfördes Konzept, andererseits aber auch die Grenzen eines Dialogs zwischen Staatsrechtslehre und jenen neueren normativen Modellen demokratischer Gemeinschaft.
Der Internationale Strafgerichtshof hat den Tatbestand des Art. 8 Abs. 2 lit. b (iv) IStGH-Statut („das Umweltkriegsverbrechen“) bisher noch nicht angewandt. Zahlreiche seriöse Medien berichten seit Beginn der völkerrechtswidrigen Invasion durch russische Streitkräfte in das Staatsgebiet der Ukraine von Kämpfen rund um das größte Atomkraftwerk Europas in Saporischschja. Dies rief global Furcht darüber hervor, dass es erneut zu einer Atomkatastrophe inmitten des europäischen Kontinents kommen könnte. Dieser Sachverhalt bietet Anlass für eine Diskussion über den Tatbestand des Umweltkriegsverbrechens sowie seiner Auslegungsschwierigkeiten. Anhand eines hypothetischen Sachverhalts soll veranschaulicht werden, ob das Umweltkriegsverbrechen jemals Anwendung finden kann oder ob die Menge an politischen Kompromissen in seiner Gestaltung seine Nutzbarkeit gänzlich negieren.
Die Frage danach, ob und wie eine Zurechnung von Wissen innerhalb einer Konzernstruktur stattfinden kann, wird nach der herrschenden Meinung mit der Ausdifferenzierung von wertenden Kriterien bejaht, welche vor allem an die Zurechnungsrichtung (bottom-up bzw. top-down) anknüpfen. Ein bisher nur wenig Zustimmung findender Ansatz der voraussetzungslosen Pauschalzurechnung könnte durch ein neues theoretisches Fundament, welches nicht nur die einzelne juristische Person, sondern auch den Konzern als rechtliches System ansieht, die Zurechnungsdiskussion vereinfachen. Ein solches Systemwissen kommt ohne Zurechnungsakt aus und stärkt durch klare Risikozuweisung die Markteffizienz. Auf Grundlage dieses neueren Ansatzes werden einige sog. Dieselfälle aus der Rechtsprechung einer kritischen Überprüfung unterzogen.
In großer Regelmäßigkeit beschäftigt das Bundesverfassungsgericht die Kollision zwischen der Meinungsfreiheit und dem Ehrschutz. Nicht zuletzt dieser Umstand hat dazu geführt, dass das Gericht mittlerweile eine ganze Fülle an dogmatischen Strukturen und Abwägungstopoi für diesen Bereich entwickelt hat. Angesichts der fragmentarischen Struktur des Grundgesetzes, wirft dies die Frage auf, welche Überlegungen und Annahmen das Gericht bei diesem Vorgang angeleitet haben. Dieser Frage will der Aufsatz durch eine verfassungs- und grundrechtstheoretische Analyse der Entscheidungsstruktur nachgehen.
Dieser Beitrag setzt sich grundlegend mit den Funktionen der Planfeststellung auseinander. Dabei wird die Annäherung des Rechtsinstruments an die immissionsschutzrechtliche Genehmigung beschrieben und untersucht, ob sich diese beiden Zulassungsregime gegenwärtig noch in einer Konkurrenzsituation befinden oder ob ein flexibler Austausch derselben möglich ist. Eine funktionelle und strukturelle Gegenüberstellung der beiden Institute bestätigt das Fortwähren gewisser Unterschiede, die auf die jeweilige idealtypische Konstruktion zurückzuführen sind. Planfeststellung und immissionsschutzrechtliche Genehmigung befriedigen somit grundsätzlich verschiedene sachliche Bedürfnisse, die es bei etwaigen Regimewechseln zu berücksichtigen gilt.
Die USA setzen seit Jahrzehnten sog. Sekundärsanktionen bzw. Secondary Sanctions ein, um ihren Primärsanktionen mehr Wirkung zu verleihen. Diese Art der Sanktionen soll ausländische Personen im Ausland davon abhalten, Geschäftskontakte zu Zielobjekten von unilateralen US-Primärsanktionen einzugehen oder weiterzuführen. In diesem Beitrag wird der Frage nachgegangen, inwieweit diese Praxis nach dem Recht der Jurisdiktion völkerrechtlich zulässig ist. Dazu wird zunächst der Begriff der Sekundärsanktionen definiert. Es folgt ein Abriss der Geschichte der Sekundärsanktionen. Nach einer kurzen Einführung in das Recht der Jurisdiktion werden dessen Grundsätze auf die Sekundärsanktionen übertragen. Die Autorin kommt zu dem Ergebnis, dass Zugangsbeschränkungen nach dem Territorialitätsprinzip völkerrechtlich zulässig, alle darüber hinausgehenden Sekundärsanktionen hingegen völkerrechtswidrig sind.
Adorno führt in seinem Werk der Negativen Dialektik, anhand einer Kant-Kritik, aus, dass Freiheit nur negativ bestimmt werden kann. Dazu bedient dieser sich der Methode der bestimmten Negation. Dieser Ansatz wird auf Nauckes Konzept des negativen Strafrechts übertragen und gezeigt, dass auch Naucke dieses nur negativ bestimmt. Dabei stellt das negative Strafrecht eine Position dar, welche dem affirmativen Strafrecht kritisch gegenübersteht und dieses kontinuierlich hinterfragen und begrenzen soll.
Defenders of current restrictions on EU immigrants’ access to welfare rights in host member states often invoke a principle of reciprocity among member states to justify these policies. The argument is that membership of a system of social cooperation triggers duties of reciprocity characteristic of welfare rights. Newly arriving EU immigrants who look for work do not meet the relevant criteria of membership, the argument goes, because they have not yet contributed enough to qualify as members on the grounds of reciprocity. Therefore, current restrictions on their access to welfare rights are justified. In this article, I challenge this argument by showing how restrictions on EU immigrants’ access to welfare rights are inconsistent with duties of international reciprocity. There are different variations of this challenge, but my focus here will be on one that uses a veil of ignorance device to support this claim. What matters from a perspective concerned with international reciprocity, I will argue, is what kind of welfare policy EU member states would choose were they not to know whether those receiving EU migrants were net contributors or net beneficiaries to the relevant scheme of international cooperation made possible by the four freedoms, and freedom of movement in particular. I argue that framing the requirement of reciprocity in this way provides a more comprehensive understanding of what should count as an ‘unreasonable burden’ on the welfare systems of host member states. The paper also examines alternative accounts of ‘unreasonable burdens’. It shows when and how the current institutional structure of the EU could take steps to deal with such burdens by preventing member states from gaming a comprehensive system of welfare rights protections across member states and by recognising the achievements of those member states that best serve them.
This paper analyses, if the Intertemporal Guarantee of Freedom, that was developed by the German Federal Constitutional Court (GFCC), can be used to expand the protection of human rights against the harms of climate change. The case of the Swiss Senior Women shows that there are jurisdictions, where the Intertemporal Guarantee of Freedom could be applied to improve standing and the control standard of states’ climate change action. Within international law bodies with jurisdiction over human rights treaties there are distinctive standards of protection against the harms of climate change. A major deficit within the international human rights protection against climate change lies within the focus on the positive obligations and the corresponding wide margin of appreciation granted to the states. The Intertemporal Guarantee of Freedom could provide a protection expansion in this regard, especially in the case of the European Court of Human Rights. It could also enable and legitimise present human rights concerns focused on the future actions of states following their past inaction. One considerable hurdle that is not addressed by it are procedural hurdles like the Plaumann formula applied by the European Court of Justice. The Intertemporal Guarantee of Freedom cannot solve major problems for climate change litigation like procedural hurdles. Yet, it can provide a new approach for complaints to address unambitious mitigation legislation which will lead to future human rights infringements.
Prevenzione e repressione nel contrasto al riciclaggio : un’indagine comparata tra Italia e Germania

The doctoral thesis provides a comparative study of the Italian and the German crime of money laundering. Although the topic of the essay is double, its final purpose concerns solely the Italian criminal provision (article 648-bis of the Italian Criminal code, art. 648-bis c.p.) in the attempt to thoroughly investigate its offensiveness, underlying legal interest and legitimation as well as to propose a restrictive interpretation.
The first chapter defines the research topic and the comparative methodology which shall be used throughout the thesis. The comparison is hereby intended as a tool to not only describe, but also contextualize the German legislation and create a “dialogue” with the italian criminal provision. Also, the first chapter lays down the three fundamental questions upon whom the analysis will be built (“from where?”, “what?” and “who?”) and offers a conceptual framework of the crime of money laundering by enlightening the existing liaison between this criminal offence and the paradigm of crime-prevention; European and supranational law; and the activities of prosecution and intelligence.
The second chapter delves into the question “from where?”, that is, the question of the role and the meaning of the predicate offence in money laundering’s prevention as well as repression. Therefore, the topic of the predicate crime is examined both from the angle of the anti-money laundering obligations for private actors and from the strictly penal angle. The question of the contribution of the predicate offence to money laundering’s offensiveness is specifically investigated with regard to both supranational and national law (including the most recent reforms that took place in Italy and Germany).
The third chapter is dedicated to the question of “what” is money laundering. This topic is first of all addressed from a pre-normative point of view. To this end, the chapter begins with a survey of relevant criminological theories that have been developed in order to explain, on an empirical basis, the phenomenon of money laundering and its effects on economy and society. The chapter then moves on to the criminal law provisions by examining the shape and current interpretation of the national crimes of money laundering and interrogating their suitability in the light of the criminological suggestions.
With a view to drawing some conclusions on the Italian crime of money laundering, the fourth and last chapter explores the question of “who” launders, meaning the possibility for the author of the predicate offence to be punished as self-launderer. In this context, self-laundering is examined as a form of both rationalization and extremization of the crime of money laundering. Lastly, the doctoral thesis summarizes its findings and proposes a restrictive interpretation of art. 648-bis c.p.

This article provides an overview of the current state of the regulation of disinformation in the EU. It shows that the concept of disinformation, the purpose of anti-disinformation measures and their content and enforcement can only be understood if a holistic view is taken of private, hybrid-co-regulatory and public-law norms. The delicate field of disinformation is to a large extent dealt with outside of statutory law. The questions raised thereby are largely unresolved.
Es gab viel Kritik an der Vorgehensweise des Gesetzgebers während der Coronazeit. Um für künftige Epidemien besser vorbereitet zu sein, hat die Frankfurter Rechtswissenschaftlerin Prof. Andrea Kießling gemeinsam mit Dr. Anna-Lena Hollo (Hannover) und Johannes Gallon (Flensburg) einen Entwurf für ein Epidemiegesetz vorgelegt – als Diskussionsgrundlage für Rechtswissenschaft und Politik.
Übermäßige Gewaltanwendungen durch Polizist:innen in Deutschland sind bislang nur in Ansätzen untersucht. Das Buch liefert umfassende wissenschaftliche Befunde zu einschlägigen Situationen und ihrer strafrechtlichen Aufarbeitung. Auf Basis einer Betroffenenbefragung mit über 3.300 Teilnehmenden und über 60 qualitativen Interviews stellen sich die Fälle als komplexe Interaktionsgeschehen dar, bei deren Aufarbeitung eine besondere Definitionsmacht der Polizei sichtbar wird.
The analysis of postmortem protein degradation has become of large interest for the estimation of the postmortem interval (PMI). Although several techniques have been published in recent years, protein degradation-based techniques still largely did not exceed basic research stages. Reasons include impractical and complex sampling procedures, as well as highly variable protocols in the literature, making it difficult to compare results. Following a three-step procedure, this study aimed to establish an easily replicable standardized procedure for sampling and processing, and further investigated the reliability and limitations for routine application. Initially, sampling and processing were optimized using a rat animal model. In a second step, the possible influences of sample handling and storage on postmortem protein degradation dynamics were assessed on a specifically developed human extracorporeal degradation model. Finally, the practical application was simulated by the collection of tissue in three European forensic institutes and an international transfer to our forensic laboratory, where the samples were processed and analyzed according to the established protocol.

On 15 December 2020, the European Commission submitted a proposal for a regulation on a single market for digital services (Digital Services Act, DSA) and amending Directive 2000/31/EC. The legislative project seeks to establish a robust and durable governance structure for the effective supervision of providers of intermediary services. To this end, the DSA sets out numerous due diligence obligations of intermediaries concerning any type of illegal information, including copyright-infringing content. Empirically, copyright law accounts for most content removal from online platforms, by an order of magnitude. Thus, copyright enforcement online is a major issue in the context of the DSA, and the DSA will be of utmost importance for the future of online copyright in the EU. Against this background, the European Copyright Society takes this opportunity to share its view on the relationship between the copyright acquis and the DSA, as well as further selected aspects of the DSA from a copyright perspective.
Combining insights from the history of citizenship with contemporary legal analysis, this article both highlights and problematizes what we may call sorting strategies – restrictive closure and selective openness – which rely on ‘varieties of affluence’ (income, wealth, equity, credit, and the like) in shaping possibilities for entry, settlement, and naturalization. By emphasizing the growing significance of income barriers and thresholds on the one hand, and fast-tracked investment-based entryways on the other, this article investigates the role of wealth as both accelerator and barrier to citizenship, contributing to the varied toolbox used by governments to advance goals that may at times appear contradictory; these tools both tighten and relax the requirements of access to membership at the same time. These new developments represent different facets of the same trend. Without explicitly stating as much, programs that turn wealth into a core criterion for admission conceptually reignite an older, exclusive, and exclusionary vision according to which individuals must hold property (in land, resources, or in relation to one’s ‘dependents,’ including women, slaves, and children) in order to qualify as a citizen. While such a trajectory is no stranT8ger to ancient models, it raises profound challenges to modernist accounts of political membership that place equality at their core.
Der Ökonom Prof. Guido Friebel hat zusammen mit anderen Wissenschaftler*innen die Einführung eines sogenannten Mitarbeiterempfehlungsprogramms (ERP = Employee Referral Program) in einer Lebensmittelkette untersucht. Der größte Effekt liegt in der gestiegenen Wertschätzung der Mitarbeitenden seitens der Unternehmensleitung.
Die am 28. Oktober 2021 in Kraft getretene Änderungsverordnung zur Aarhus-Verordnung der EU modernisiert den administrativen und gerichtlichen Rechtsschutz gegen Rechtsakte der Organe und Einrichtungen der EU. Die Verordnung setzt einen Schlusspunkt unter das jahrelange Tauziehen zwischen dem Compliance-Ausschuss der Aarhus-Konvention und der EU über die Vereinbarkeit des administrativen Überprüfungsverfahrens nach der Verordnung mit den Anforderungen des Art. 9 Abs. 3 der Aarhus-Konvention. Wesentliche Regelungen sind die Ausdehnung des Kreises der anfechtbaren Entscheidungen auf alle Rechtsakte nicht-legislativer Natur und die Anerkennung von Antragsrechten Einzelner, wenngleich unter einschränkenden Voraussetzungen. Kritisch zu bewerten sind insbesondere die fehlende Unabhängigkeit des administrativen Überprüfungsverfahrens und die Bevorzugung der Umweltverbände beim Zugang zum Gericht der EU.
This research attempts to provide for an overview of the state of co-operation between the United Nations and regional organizations like the CoE, OSCE, EU and NATO during the last Yugoslav wars, considering the 1991-2008 period. In this case, the "reconstruction" of what the organisations did in each of the countries involved in the conflicts, the country-by-country approach used in writing the research and the consideration of both headquarters and field level should facilitate the understanding of the state of things at that time. The research further includes an analysis of the co-operative trends developed by the considered international organisations since the beginning of the 1990s and is concluded by a reflection on the normative relevance of the issue of "international cooperation". In this case, the intention of the author was to go beyond the general policy level approach used for the description of UN-regional organizations interaction and propose a re-consideration of the concept of "international co-operation" as a possible normative tool in guiding the so far nebulous division of tasks of international actors in conflict-related scenarios. In this case, the concise description of the general framework for co-operation under Chapter VIII of the UN Charter, already matter of wide debate by academics and practitioners, sets the frame for a more elaborate, and hopefully innovative, consideration of the notion of "international cooperation". This, of course, is to be contextualized to the lessons learned extrapolated from the case study.
The essay argues that anti-suit injunctions granted in disputes on standard-essential patents are inconsistent with the general standards governing anti-suit injunctions. The section on anti-suit injunction demonstrates that the case law on anti-suit injunctions is not comparable to disputes over standard essential patents. In contrast, anti-anti-suit injunctions are a legitimate response to an extraterritorial assertion of jurisdiction by foreign courts. Under EU law, the courts of member states might even be required to issue anti-anti-suit injunctions to protect their exclusive jurisdiction over patents.
Die digitale Revolution stellt viele traditionelle Industrien vor große Herausforderungen. Auf dem Finanzmarkt werden innovative Geschäftsmodelle geschaffen, die die Rahmenbedingungen, unter denen Finanzprodukte und -dienste angeboten werden, drastisch verändern. Infolgedessen entstehen rechtliche Unsicherheiten sowohl für die Marktakteure als auch für die Aufsicht. Diese Unsicherheiten weisen auf die Notwendigkeit hin, den Rechtsrahmen an die technologische und ökonomische Entwicklung anzupassen. Im Rahmen dieser Dissertation werden die Herausforderungen für das Aufsichts- und Wettbewerbsrecht untersucht, die die digitale Transformation des Finanzmarktes verursacht. Der Finanzmarkt wird vor allem durch die Entstehung von FinTechs, durch das Eintreten von BigTechs in den Finanzbereich und durch die Veränderung der Produkte und Dienstleistungen traditioneller Anbieter auf der Grundlage moderner Technologien transformiert. Die Arbeit gibt einen Überblick über die zentralen innovativen Geschäftsmodelle, der mit den zahlreichen praxisrelevanten Beispielen begleitet wird. Anschließend folgt eine Beurteilung des Umfanges und der Effizienz der vorhandenen und vorgeschlagenen aufsichtsrechtlichen Vorschriften. Diese Erkenntnisse dienen als Grundlage für die wettbewerbsrechtliche Analyse des Finanzmarktes mit dem Fokus auf die plattform- und algorithmenbasierten Geschäftsmodelle im zweiten Teil der Dissertation. Da werden wettbewerbsrechtliche Konstellationen betrachtet, die zwischen konkurrierenden innovativen Geschäftsmodellen entstehen. Die Verfasserin befasst sich mit der Problematik der Definition des relevanten Marktes bei den algorithmen- und plattformbasierten Geschäftsmodellen, der Beurteilung ihrer Marktmacht, den möglichen Auswirkungen der Netzwerkeffekte auf die mehrseitigen Plattformen. Ferner werden solche Aspekte wie Datenzugriff als wettbewerbsrechtlicher Faktor und die Rolle der Algorithmen für die Durchführung wettbewerbswidrigen Praktiken analysiert. Infolgedessen wird ein Überblick über mögliche kartellrechtliche Probleme gegeben, die im Rahmen der Digitalisierung im Finanzmarkt auftreten können, sowie die Vorstellungen darüber, wie sich Wettbewerbsfaktoren verändern sollten, wenn die Anwendung der traditionellen Konzepte des Wettbewerbsrechts nicht immer möglich oder sinnvoll ist. Es werden die Bereiche identifiziert, in denen das europäische und deutsche Wettbewerbsrecht derzeit nicht in der Lage ist, die von den innovativen Geschäftsmodellen stammenden Herausforderungen effektiv zu bewältigen. Im dritten Teil der Dissertation wird erörtert, wie sich das Aufsichts- und das Wettbewerbsrecht ergänzen und zusammen ein System der Ex-ante- und Ex-post-Regulierung bilden. Es wird dargestellt, wie die aufsichtsrechtlichen Anforderungen an die Finanzinstitute, FinTechs und BigTechs mit den ausgewählten Wettbewerbsergebnissen im Finanzsektor zusammenhängen. Darüber hinaus erklärt die Verfasserin, inwiefern einige aufsichtsrechtliche Vorschriften wettbewerbsnachteilig oder wettbewerbsfreundlich auswirken können und warum die Koordination zwischen den aufsichts- und wettbewerbsrechtlichen Instrumenten und Ansätzen essenziell ist. Schließlich werden die Vor- und Nachteile unterschiedlicher Optionen zur Regulierung innovativer Geschäftsmodelle auf dem Finanzmarkt auf einer abstrakteren Ebene erwogen.
This article provides an overview and critical assessment of WIPO ALERT. It locates this initiative in the broader context of transnational IP enforcement schemes on the Internet. These initiatives are classified into two categories according to their point of attachment and geographical effect. Whereas source-related measures (e.g. website takedowns) tend to have a transnational and possibly even a global effect, recipient-related measures (e.g. website and ad blockings) typically mirror the territorially fragmented IPR landscape. This fragmentation is where WIPO ALERT comes into play. It can be understood as a matching service which interconnects holders of information about copyright infringing websites (“Authorized Contributors”) and actors of the online ad industry who want to avoid these outlets (“Authorized Users”). The critical assessment of WIPO ALERT calls for more transparency and the establishment of uniform substantive and procedural standards that have to be met if a new “site of concern” is added to the global ad blacklist.
Efforts to come to terms with sexual violence against children and adolescents are predicated on a desire to achieve justice. Based on the work done by the Independent Inquiry into Child Sexual Abuse in Germany, this article attempts to identify the interfaces between the Inquiry’s undertakings and the field of transitional justice. Using an approach informed by the theory of childhood, it examines the issues that arise when survivors bear witness to past childhood events. This must adopt a perspective that is sensitive to childhood and adolescence as unique life phases. That, in turn, requires accounting for concomitant factors, such as the context presented by a child’s growth and development, the function of families, the role played by educational institutions, and the legal position accorded children by society. The article thus adopts a framework rooted in childhood theory that considers children both generally as human beings and specifically as children.
Bei Suizidformen mit mehreren Suizidenten und Opfern werden teilweise in Literatur und Rechtsprechung eine unterschiedliche Nomenklatur und Interpretation der Begrifflichkeiten vorgenommen. Der Beitrag analysiert die Begrifflichkeiten und befasst sich im Speziellen mit dem Phänomen des Doppelsuizids. Historische Fälle von Doppelsuiziden werden angeführt. Anhand von Fallkonstellationen werden rechtliche Bewertungen vorgenommen, die beim einseitig fehlgeschlagenen Doppelsuizid praxisrelevant werden können. Dabei werden die mitunter konträren Auffassungen in der einschlägigen Literatur und der Rechtsprechung dargestellt und Lösungsansätze aufgezeigt. Zudem verdeutlichen die Fallkonstellationen die Relevanz einer umfassenden Tatortarbeit und einer tatnahen Klärung der Motivationslage bei dem Überlebenden bzw. den Verstorbenen.
We contribute to the debate about the future of capital markets and corporate finance, which has ensued against the background of a significant boom in private markets and a corresponding decline in the number of firms and the amount of capital raised in public markets in the US and Europe.
Our research sheds light on the fluctuating significance of public and private markets for corporate finance over time, and challenges the conventional view of a linear progression from one market to the other. We argue instead that a more complex pattern of interaction between public and private markets emerges, after taking a long-term perspective and examining historical developments more closely.
We claim that there is a dynamic divide between these markets, and identify certain factors that determine the degree to which investors, capital, and companies gravitate more towards one market than the other. However, in response to the status quo, other factors will gain momentum and favor the respective other market, leading to a new (unstable) equilibrium. Hence, we observe the oscillating domains of public and private markets over time. While these oscillations imply ‘competition’ between these markets, we unravel the complementarities between them, which also militate against a secular trend towards one market. Finally, we examine the role of regulation in this dynamic divide as well as some policy implications arising from our findings.
Der Gesetzgeber hat sich im Personengesellschaftsrechtsmodernisierungsgesetz (MoPeG) dazu entschieden, für Personenhandelsgesellschaften ein Beschlussmängelrecht nach dem Vorbild des AktG einzuführen (sog. Anfechtungsmodell). Bei den übrigen Personengesellschaften, insbesondere bei der GbR, bleibt es hingegen bei den allgemeinen rechtsgeschäftlichen Regeln (sog. Feststellungsmodell). Der Beitrag stellt die Neuregelung vor und beurteilt die Vor- und Nachteile der beiden Modelle. Das Ergebnis der Untersuchung ist, dass die Einführung des Anfechtungsmodells für Personenhandelsgesellschaften zu loben und gut gelungen ist, beim Feststellungsmodell allerdings noch Verbesserungspotenzial besteht.
Der Aufsatz gibt einen Überblick über die vielfältigen Missbrauchsformen von DHL-Packstationen und analysiert damit verbundene Strafbarkeiten. Täter verschaffen sich rechtswidrig Zugang zu Packstationskonten von DHL-Kunden, um in fremdem Namen Pakete zu bestellen oder von Kunden bestellte Pakete abzuholen. Die strafrechtliche Beurteilung dieses Täterverhaltens im Hinblick auf Vermögens- und Eigentumsdelikte sowie speziellere Tatbestände wie die Falschverdächtigung bildet den Schwerpunkt der folgenden Ausführungen.
Der Einwand des rechtmäßigen Alternativverhaltens ist eine Maxime des allgemeinen Schadensrechts. Beruft sich der Schädiger im Rahmen eines Schadensersatzanspruches auf eben diesen Einwand, so macht er geltend, dass der Schaden auch bei rechtmäßigen Verhalten hätte verursacht werden können. Sodann wäre nämlich eine Haftung mangels haftungsausfüllender Zurechnung trotz haftungsbegründeten kausalen Verhaltens ausgeschlossen. Auch in der Organhaftung finden diese schadensrechtlichen Grundsätze Anwendung. Der Aufsatz geht vor diesem Hintergrund der Frage nach, ob der Einwand des rechtmäßigen Alternativverhaltens auch dann greift, wenn der Vorstand die Zustimmungspflicht des Aufsichtsrats nach § 111 Abs. 4 S. 2 AktG verletzt und sich später darauf beruft, die Hauptversammlung hätte (hypothetisch) anstelle des Aufsichtsrats einer Geschäftsführungsmaßnahme zugestimmt.
Journalisten leisten eine unabdingbare Informations- und Kontrollfunktion für die internationalen Kapitalmärkte. Dabei stehen ihre journalistischen Beiträge in einem Spannungsfeld zwischen Presse- und Meinungsfreiheit auf der einen sowie kapitalmarktrechtlichen Verhaltensvorschriften auf der anderen Seite. Dieser Beitrag versucht sich an der Auflösung dieser Konfliktlage. Dabei wird insbesondere die Übertragung anerkannter Grundsätze des Presserechts auf die Finanzmarktberichterstattung diskutiert. Den Journalisten kommt dabei im Ergebnis eine weitreichende Privilegierung zu, die allerdings insbesondere dort Einschränkungen erfährt, wo irreführende oder unrichtige Informationen verbreitet werden.
Die vorliegende Arbeit untersucht die Zulässigkeit von sog. anti-suit injunctions im Anwendungsbereich der EuGVVO. Dabei wird anhand der Antworten des Europäischen Gerichtshofs auf Vorlageersuchen zu den Rechtssachen Turner v. Grovit und West Tankers v. Allianz/Generali herausgearbeitet, dass der Grundsatz des gegenseitigen Vertrauens der Mitgliedstaaten in die Funktions- und Leistungsfähigkeit der Rechtssysteme und Rechtspflegeorgane zu einer Inkompatibilität von anti-suit injunctions mit der EuGVVO führt. In einem weiteren Schritt folgt ein kursorischer Überblick über die aktuellen Entwicklungen im deutschen Prozessrecht rund um die sog. anti-anti-suit injunction. Abschließend wird die Frage nach der Aktualität des Rechtsmittels näher beleuchtet und unter besonderer Berücksichtigung des Brexits bestätigt.
Im Rahmen des Tarifvertragsrechts spielen Selbstständige eine nur untergeordnete Rolle – so schien es zumindest in der Vergangenheit die Regel gewesen zu sein. Während das Tarifvertragsgesetz in seiner ursprünglichen Fassung von 1918 (TVVO) nur Arbeitnehmer im Blick hatte, wurde der persönliche Anwendungsbereich mit Einführung des § 12a TVG auf arbeitnehmerähnliche Personen ausgedehnt, wobei der restriktiv ausgelegte Anwendungsbereich und die Auswirkungen in der Praxis zeigten, dass hierdurch keine umfassende Erweiterung des Tarifvertragsrechts auf Selbstständige erreicht werden würde. Nunmehr steht das Arbeitsrecht, auch in Hinblick auf Überschneidungen mit dem Kartellrecht, vor der Herausforderung, sich auf sich ändernde Arbeitsformen und neue wirtschaftliche Gegebenheiten anzupassen, um in Zukunft auch andere Personengruppen von seinem Schutze zu erfassen. Dass es sich hierbei nicht um eine rein nationale Angelegenheit handelt, zeigt der Wandel des politischen und rechtlichen Diskurses auf Unionsebene.
This essay argues that access to water, and the right to water in India is subject to legal pluralism in India: the plurality of state law and the normative order of the caste system in India. While the Constitution of India prohibits discrimination against or exploitation of the Scheduled Castes, society is also subject to a parallel set of social rules set forth by caste hierarchies. The Dalit community has been historically subject to exploitation and limited access to resources, with the use of religious and social sanction, this essay focuses particularly on the right to water, which is an essential part of the constitutional right to the environment is subject to plural legal systems, of state law and caste-based normative orders. Ethnographic social science research, particularly in anthropology and sociology has produced extensive findings on how the caste system limits access to natural resources and particularly water, owing to ideas of purity and impurity associated with water use, and the status of water as a common public good. This essay explores how lawyers must consider legal pluralities when understanding access and management of natural resources. The essay analyses John Griffiths’ idea of legal pluralism which describes a scenario in which not all law is administered by the State or its institutions, and there exists de facto law, beyond the boundaries of the State. This paper expands Griffiths’ model of pluralism to explain how the right to water is subject to both caste order and state law and how the lived reality of Dalits when accessing water is subject to a constant pluralism.
Venture capital-backed firms, unavoidable value-destroying trade sales, and fair value protections

This paper investigates the implications of the fair value protections contemplated by the standard corporate contract (i.e., the standard contract form for which corporate law provides) for the entrepreneur–venture capitalist relationship, focusing, in particular, on unavoidable value-destroying trade sales. First, it demonstrates that the typical entrepreneur–venture capitalist contract does institutionalize the venture capitalist’s liquidity needs, allowing, under some circumstances, for counterintuitive instances of contractually-compliant value destruction. Unavoidable value-destroying trade sales are the most tangible example. Next, it argues that fair value protections can prevent the entrepreneur and venture capitalist from allocating the value that these transactions generate as they would want. Then, it shows that the reality of venture capital-backed firms calls for a process of adaptation of the standard corporate contract that has one major step in the deactivation or re-shaping of fair value protections. Finally, it argues that a standard corporate contract aiming to promote social welfare through venture capital should feature flexible fair value protections.
Lack of privacy due to surveillance of personal data, which is becoming ubiquitous around the world, induces persistent conformity to the norms prevalent under the surveillance regime. We document this channel in a unique laboratory---the widespread surveillance of private citizens in East Germany. Exploiting localized variation in the intensity of surveillance before the fall of the Berlin Wall, we show that, at the present day, individuals who lived in high-surveillance counties are more likely to recall they were spied upon, display more conformist beliefs about society and individual interactions, and are hesitant about institutional and social change. Social conformity is accompanied by conformist economic choices: individuals in high-surveillance counties save more and are less likely to take out credit, consistent with norms of frugality. The lack of differences in risk aversion and binding financial constraints by exposure to surveillance helps to support a beliefs channel.
Supranational supervision

We exploit the establishment of a supranational supervisor in Europe (the Single Supervisory Mechanism) to learn how the organizational design of supervisory institutions impacts the enforcement of financial regulation. Banks under supranational supervision are required to increase regulatory capital for exposures to the same firm compared to banks under the local supervisor. Local supervisors provide preferential treatment to larger institutes. The central supervisor removes such biases, which results in an overall standardized behavior. While the central supervisor treats banks more equally, we document a loss in information in banks’ risk models associated with central supervision. The tighter supervision of larger banks results in a shift of particularly risky lending activities to smaller banks. We document lower sales and employment for firms receiving most of their funding from banks that receive a tighter supervisory treatment. Overall, the central supervisor treats banks more equally but has less information about them than the local supervisor.
Industry concentration and markups in the US have been rising over the last 3-4 decades. However, the causes remain largely unknown. This paper uses machine learning on regulatory documents to construct a novel dataset on compliance costs to examine the effect of regulations on market power. The dataset is comprehensive and consists of all significant regulations at the 6-digit NAICS level from 1970-2018. We find that regulatory costs have increased by $1 trillion during this period. We document that an increase in regulatory costs results in lower (higher) sales, employment, markups, and profitability for small (large) firms. Regulation driven increase in concentration is associated with lower elasticity of entry with respect to Tobin's Q, lower productivity and investment after the late 1990s. We estimate that increased regulations can explain 31-37% of the rise in market power. Finally, we uncover the political economy of rulemaking. While large firms are opposed to regulations in general, they push for the passage of regulations that have an adverse impact on small firms.
Resolving financial distress where property rights are not clearly defined: the case of China

We use data on financially distressed Chinese companies in order to study a debt market where property rights are crudely defined and poorly enforced. To help with identification we use an event where a business-friendly province published new guidelines regarding the administration and enforcement of assets pledged as collateral. Although by no means a comprehensive reform of bankruptcy law or property rights, by instructing courts to enforce existing, albeit rudimentary, contractual rights the new guidelines virtually eliminated creditors runs and produced a sharp increase in the survival rate of financially-distressed companies. These changes illustrate how piecemeal reforms of property rights and their enforcement may have a significant impact on economic outcomes. Our analysis and results challenge the view that a fully fledged system of private property is a precondition for economic development.
The loan impairment rules recently introduced by IFRS 9 require banks to estimate their future credit losses by using forward-looking information. We use supervisory loan-level data from Germany to investigate how banks apply their reporting discretion and adjust their lending upon the announcement of the new rules. Our identification strategy exploits a cut-off for the level of provisions at the investment grade threshold based on banks’ internal rating of a borrower. We find that banks required to adopt the new rules assign better internal ratings to exactly the same borrowers compared to banks that do not apply IFRS 9 around this cut-off. This pattern is consistent with a strategic use of the increased reporting discretion that is inherent to rules requiring forward-looking loss estimation. At the same time, banks also reduce their lending exposure to exactly those borrowers at the highest risk of experiencing a rating downgrade below the cutoff. These loans would be associated with additional provisions in future periods, both in the intensive and extensive margin. The lending change thus mitigates some of the negative effects of increased reporting opportunism on banks’ crisis resilience. However, when these firms with internal ratings around the investment grade cut-off obtain less external funding through banks, the introduction of IFRS 9 will likely also be associated with real economic effects
Using the negotiation process of the Basel Committee on Banking Supervision (BCBS), this paper studies the way regulators form their positions on regulatory issues in the process of international standard-setting and the consequences on the resultant harmonized framework. Leveraging on leaked voting records and corroborating them using machine learning techniques on publicly available speeches, we construct a unique dataset containing the positions of banks and national regulators on the regulatory initiatives of Basel II and III. We document that the probability of a regulator opposing a specific initiative increases by 30% if their domestic national champion opposes the new rule, particularly when the proposed rule disproportionately affects them. We find the effect is driven by regulators who had prior experience of working in large banks – lending support to the private-interest theories of regulation. Meanwhile smaller banks, even when they collectively have a higher share in the domestic market, do not have any impact on regulators’ stand – providing little support to public-interest theories of regulation. Finally, we show this decision-making process manifests into significant watering down of proposed rules, thereby limiting the potential gains from harmonization of international financial regulation.
We employ a proprietary transaction-level dataset in Germany to examine how capital requirements affect the liquidity of corporate bonds. Using the 2011 European Banking Authority capital exercise that mandated certain banks to increase regulatory capital, we find that affected banks reduce their inventory holdings, pre-arrange more trades, and have smaller average trade size. While non-bank affiliated dealers increase their market-making activity, they are unable to bridge this gap - aggregate liquidity declines. Our results are stronger for banks with a higher capital shortfall, for non-investment grade bonds, and for bonds where the affected banks were the dominant market-maker.
The expansion of actors and instruments in sovereign debt markets through bond financing generated a coordination problem among bondholders during the debt restructuring process. There is a risk that an individual bondholder will be passive or act against the restructuring slowing down or even precluding the process of restructuring even though it is in the general interest of bondholders as a group, not to mention the population of the country experiencing the shortage of funds for public welfare. In particular, the disruptions to sovereign debt restructuring by frivolous litigation is considered as one of the main threats.
This dissertation is the first major study devoted to sovereign bonds structured through a trust arrangement and the promising features that such a legal structure possesses for an effective and efficient sovereign debt restructuring. It provides a comprehensive inquiry into the evolution of the mechanisms to coordinate creditors, with a focus on bondholders and institutional frameworks which facilitated this coordination. It examines intriguing primary sources from League of Nations archives and provides in-depth case studies on the functionality of the trustees in sovereign bond restructurings performed by Argentina in 2016 and Ecuador in 2008.
Assessing the utility of trust arrangements to address coordination problems, this thesis is driven by the puzzle: How to better balance (i) the need for smooth sovereign debt restructurings, which by definition entails some losses for creditors, with (ii) bondholders’ legitimate interests? What approach can be used in constructing a legal and institutional framework for trustees to promote the best interest of the bondholders in sovereign debt restructuring? As a solution, it seems that incentives for bond trustees to pursue debt sustainability will achieve both goals.
In this regard, recognition of the concept of debt sustainability, being in substance the IMF and WB debt sustainability assessment, as the best interest of bondholders in sovereign debt restructuring is beneficial from multiple aspects. It enables a bond trustee to excel in its role as a guardian of bondholders by following the best interest of bondholders in exercising its discretion. Moreover, it fosters an equilibrium between the interests of private creditors and a state taking into account its socio-political aspects.
Das Forschungsprojekt KviAPol (Körperverletzung im Amt durch Polizeibeamte und -beamtinnen) untersucht polizeiliche Gewaltanwendungen, die aus Sicht der Betroffenen rechtswidrig waren, mittels quantitativer Online-Befragung sowie die polizeiliche, justizielle und zivilgesellschaftliche Perspektive auf rechtswidrige Polizeigewalt und deren Aufarbeitung in Deutschland mittels qualitativer Interviews. Zum Team gehören die Wissenschaftlichen Mitarbeiterinnen Laila Abdul-Rahman, Hannah Espín Grau und Luise Klaus sowie Prof. Dr. Tobias Singelnstein, der die Projektleitung innehat.
Search costs for lenders when evaluating potential borrowers are driven by the quality of the underwriting model and by access to data. Both have undergone radical change over the last years, due to the advent of big data and machine learning. For some, this holds the promise of inclusion and better access to finance. Invisible prime applicants perform better under AI than under traditional metrics. Broader data and more refined models help to detect them without triggering prohibitive costs. However, not all applicants profit to the same extent. Historic training data shape algorithms, biases distort results, and data as well as model quality are not always assured. Against this background, an intense debate over algorithmic discrimination has developed. This paper takes a first step towards developing principles of fair lending in the age of AI. It submits that there are fundamental difficulties in fitting algorithmic discrimination into the traditional regime of anti-discrimination laws. Received doctrine with its focus on causation is in many cases ill-equipped to deal with algorithmic decision-making under both, disparate treatment, and disparate impact doctrine. The paper concludes with a suggestion to reorient the discussion and with the attempt to outline contours of fair lending law in the age of AI.
We investigate the impact of uneven transparency regulation across countries and industries on the location of economic activity. Using two distinct sources of regulatory variation—the varying extent of financial-reporting requirements and the staggered introduction of electronic business registers in Europe—, we consistently document that direct exposure to transparency regulation is negatively associated with the focal industry’s economic activity in terms of inputs (e.g., employment) and outputs (e.g., production). By contrast, we find that indirect exposure to supplier and customer industries’ transparency regulation is positively associated with the focal industry’s economic activity. Our evidence suggests uneven transparency regulation can reallocate economic activity from regulated toward unregulated countries and industries, distorting the location of economic activity.
Der Beitrag stellt dar, wie Online-Plattformen in den Bereichen Urheberrecht, Hassrede und Desinformation in der EU reguliert wurden. Die Analyse ergibt einen Regulierungskreislauf, der in vier Phasen ablief. Bis zum Jahrtausendwechsel war es die Legislative, die einen allgemeinen gesetzlichen Rahmen für die Online-Kommunikation in Gestalt von Äußerungsverboten und Haftungsprivilegierungen definierte. Dieser Rahmen wurde im folgenden Jahrzehnt von den Betreibern der neu entstehenden Plattformen unter Ausnutzung ihres privatautonomen Gestaltungsspielraums implementiert. In der dritten Phase ab ca. 2010 verschärften die Judikative und die Exekutive die sich aus dem allgemeinen gesetzlichen Rahmen ergebenden Mindestanforderungen an die Bekämpfung von Urheberrechtsverletzungen, Hassrede und Desinformation. In der vorläufig letzten Phase des Regulierungskreislaufs ab 2017/2018 ergriff wieder der Gesetzgeber die Initiative, indem die Standards, die in den Phasen zwei und drei entwickelt worden waren, kodifiziert und teilweise nochmals angehoben wurden. Damit ist der Kreislauf der unionalen Plattformregulierung allerdings nicht zu seinem Ende gekommen. Vielmehr ist bereits erkennbar, dass sich nun wieder eine eher experimentell-tastende Phase privatautonomer Implementierung und ko-regulativer Fortentwicklung des neuen gesetzlichen Rahmens anschließt. Der Beitrag schließt mit einer kurzen Bewertung dieser Entwicklung hin zu mehr hoheitlicher Kommunikationskontrolle.
In den letzten zwei Jahrzehnten sind Anmeldungen von Rechten des geistigen Eigentums (intellectual property, IP) bzw. Verletzungsklagen wiederholt an der unzureichenden Bestimmtheit des exklusiv beanspruchten Gegenstands gescheitert. Ihren Ausgang nahm diese Entwicklung im Markenrecht mit Entscheidungen des EuGH (Stichworte: Sieckmann, Heidelberger Bauchemie, Dyson, IP Translator, Oy Hartwall) und später auch des BGH (Stichwort: UHU). Die markenrechtlichen Grundsätze strahlten auf das Designrecht (Stichworte: Sporthelm, Mast-Jägermeister) und zuletzt auch auf das Urheberrecht (Stichwort: Levola) aus. Im Folgenden werden die maßgeblichen Urteile zur Schutzfähigkeit von Zeichen, Designs und Werken zusammengetragen und systematisiert. Dabei treten zwei Aspekte eines Bestimmtheitsgebots zu Tage, die, wie abschließend zu zeigen sein wird, auch im Patentrecht gelten
The dissertation explores to what extent the post-financial crisis EU resolution regime, based on equity/debt write-down and conversion powers and bail-in tools will be effective in maintaining the stability of bank groups. To arrive at its unique angle, it first asks why bank groups are considered complex, thereby explaining the reasons for their proliferation and instability, and how this may inform the view regarding a desired regulatory framework. The main observation the dissertation makes is that, notwithstanding of other factors already pointed out in the literature, bank groups adopt complex structures with multiple entities, as it allows them, inter alia, to use double-leverage financing structures and internal capital markets.
Double-leverage financing structures allow bank groups to optimise the combination of their debt/equity funding from external parent entity investors with a combination of debt/equity funding downstreamed internally to subsidiaries and other entities in the bank group. An important component within this structure is also that the allocation of the bank group’s resources takes place through the internal capital market (ICM). The allocation of resources via the ICM allows bank groups to manage their liquidity constraint either to undertake activities that are more profitable, or to stabilise the financial position of the group as a whole.
While both double leverage and ICMs can optimise the funding and allocation of resources of the bank group, respectively, they can also generate perils to the stability of the bank group. In particular, this is because double-leverage can result in excessive risk taking and regulatory arbitrage. Moreover, the allocation of the intra-group resources in the ICM may not maintain the financial health of all subsidiaries in the bank group, which can prove to be incompatible with the financial stability goals of the regulators in the countries where those subsidiaries conduct their business.
Within this context, the dissertation argues that the current EU resolution regime does not clearly address issues of double leverage when setting out capital and other liability requirements, i.e. the ‘Total Loss Absorbing Capacity’ (TLAC) and ‘Minimum Requirement for Eligible Liabilities’ (MREL) requirements. Moreover, the dissertation emphasis that it is equally relevant to clarify the way in which the bank group resources are available ahead of, and in financial distress. It is argued that to this end, bank groups need to be allowed to make use of the ICM as it is often uncertain what may be the cause of the financial distress and how the resources of the bank group could be used to stabilise it. To this end, the dissertation highlights that there is lack of clarity in both the ex-ante provisions on intra-group support framework and in the ex-post provisions governing the allocation of any surplus TLAC/MREL resources.
Besides the ‘intra-group’ issues within the bank group, the third point the dissertation makes relation to the bank group’s presence in multiple jurisdictions. This transnational element adds to the complexity of the intra-group issues resulting from sub-optimal cooperation between home and host authorities. In this regard, the dissertation underlines that the current framework could adopt a more balanced way in which the regulatory fora will take into account the interest of the authorities of all parts of the bank group.
Disagreement among philosophers over the proper justification for political institutions is far from a new phenomenon. Thus, it should not come as a surprise that there is substantial room for dissent on this matter within democratic theory. As is well known, instrumentalism and proceduralism represent the two primary viewpoints that democrats can adopt to vindicate democratic legitimacy. While the former notoriously derives the value of democracy from its outcomes, the latter claims that a democratic decision-making process is inherently valuable. This article has two aims. First, it introduces three variables with which we can thoroughly categorise the aforementioned approaches. Second, it argues that the more promising version of proceduralism is extrinsic, rather than intrinsic, and that extrinsically procedural accounts can appeal to other values in the justification of democracy without translating into instrumentalism. This article is organised as follows. I present what I consider to be the ‘implicit view’ in the justification of democracy. Then, I analyse each of the three variables in a different section. Finally, I raise an objection against procedural views grounded in relational equality, which cannot account for the idea that democracy is a necessary condition for political legitimacy.

'Skelettfund' im Keller

Bei der Identifizierung einer unbekannten, stark verwesten Leiche oder eines Skelettes ohne Hinweise auf die Identität durch die Auffindesituation spielt die Erstellung des sog. biologischen Profils eine entscheidende Rolle. Vorgestellt wird ein Leichenfund in einem mehr oder weniger frei zugänglichen Kellerabteil eines Mehrfamilienhauses. Der Leichnam war weitgehend skelettiert, das Skelett jedoch durch mumifizierte Weichteilreste noch nahezu vollständig zusammengehalten. Bei den Hinweisen auf die Identität ergaben sich insbesondere in der Altersschätzung scheinbare Widersprüche, die jedoch zufällig eine relativ genau zutreffende Schätzung lieferten. Die Überreste konnten mittels forensischer DNA-Analyse einer seit 4 Jahren vermissten 49-Jährigen zugeordnet werden. Als Todesursache wurde ein Kältetod diskutiert.
Der Fall wies eine außergewöhnliche Auffindesituation auf, die an Bilder von „Skelettfunden“ in Kriminalverfilmungen erinnerte. Derartige Befunde dürften jedoch in der Realität wohl nur sehr selten vorkommen. Darüber hinaus werden die Wichtigkeit und die Probleme der forensisch-osteologischen Untersuchungen bei der Identifizierung eines stark verwesten, unbekannten Leichnams demonstriert.
Background: Decedents who are repatriated to Germany from abroad are not systematically registered nationwide. In Hamburg, in addition to an epidemic hygienic examination, registration and examination of the content of the documents accompanying the corpses of German citizens has been carried out since 2007. In this way, unclear and non-natural deaths in particular are to be followed up as necessary.
Material and methods: Protocols of external and internal autopsies of German nationals who died abroad and were repatriated to Hamburg via the port or airport between 2007 and 2018 were retrospectively evaluated with respect to numbers, completeness of the autopsy abroad and correctness of manner and cause of death.
Results: Between 2007 and 2018 a total of 703 corpses were repatriated via the port or airport of Hamburg and examined by the Port Medical Service for epidemic hygiene and for anything conspicuous in the documents accompanying the corpse. Of them, 307 corpses were examined at the Institute of Legal Medicine at the University Medical Center Hamburg-Eppendorf. In total, 82.4% of the examined cases had an incorrect, unspecific or incomplete foreign death certificate. Of the deceased, 238 were subjected to a second external autopsy by a forensic pathologist and 69 deceased were autopsied again or for the first time in Hamburg. It was found that 84% of the autopsies performed abroad were not performed according to German and European standards. The most common discrepancy was incomplete preparation of the organs. In almost one quarter of the autopsies performed in Hamburg a different cause of death than abroad was determined at autopsy.
Conclusion: Since the quality of autopsies performed abroad sometimes does not meet the standards in Germany and Europe and many papers accompanying corpses are incomplete or incorrectly filled out, a systematic review procedure in the home country is recommended. Through the system established in Hamburg in 2007, at least a re-evaluation of the cases takes place.
Cryptocurrencies provide a unique opportunity to identify how derivatives impact spot markets. They are fully fungible, trade across multiple spot exchanges at different prices, and futures contracts were selectively introduced on bitcoin (BTC) exchange rates against the USD in December 2017. Following the futures introduction, we find a significantly greater increase in cross-exchange price synchronicity for BTC--USD relative to other exchange rate pairs, as demonstrated by an increase in price correlations and a reduction in arbitrage opportunities and volatility. We also find support for an increase in price efficiency, market quality, and liquidity. The evidence suggests that futures contracts allowed investors to circumvent trading frictions associated with short sale constraints, arbitrage risk associated with block confirmation time, and market segmentation. Overall, our analysis supports the view that the introduction of BTC--USD futures was beneficial to the bitcoin spot market by making the underlying prices more informative.
he ECB is independent, but it is also accountable to the European parliament (EP). Yet, how the EP has held the ECB accountable has largely been overlooked. This paper starts addressing this gap by providing descriptive statistics of three accountability modalities. The paper highlights three findings. First, topics of accountability have changed. Climate-related accountability has increased quickly and dramatically since 2017. Second, if the relationship between price stability and climate change remains an object of conflict among MEPs, a majority within the EP has emerged to put pressure for the ECB to take a more active stance against climate change, precisely on behalf of its price stability mandate. Third, MEPs engage with the climate topic in very specific ways. There is a gender divide between the climate and the price stability topics. Women engage more actively with climate-related topics. While the Greens heavily dominate the climate topic, parties from the Right dominate the topic of Price stability. Finally, MEPs adopt a more united strategy and a particularly low confrontational tone in their climate-related interventions.
Global consensus is growing on the contribution that corporations and finance must make towards the net-zero transition in line with the Paris Agreement goals. However, most efforts in legislative instruments as well as shareholder or stakeholder initiatives have ultimately focused on public companies.
This article argues that such a focus falls short of providing a comprehensive approach to the problem of climate change. In doing so, it examines the contribution of private companies to climate change, the relevance of climate risks for them, as well as the phenomenon of brown-spinning (ie, the practice of public companies selling their highly polluting assets to private companies). We show that one cannot afford to ignore private companies in the net-zero transition and climate change adaptation. Yet, private companies lack several disciplining mechanisms that are available to public companies, such as institutional investor engagement, certain corporate governance arrangements, and transparency through regular disclosure obligations. At this stage, only some generic regulatory instruments such as carbon pricing and environmental regulation apply to them.
The article closes with a discussion of the main policy implications. Primarily, we discuss and evaluate the recent push to extend climate-related disclosure requirements to private companies. These disclosures would not only help investors by addressing information asymmetry, but also serve a wide group of stakeholders and thus aim at promoting a transition to a greener economy.
We provide the first comprehensive analysis of option information for pricing the cross-section of stock returns by jointly examining extensive sets of firm and option characteristics. Using portfolio sorts and high-dimensional methods, we show that certain option measures have significant predictive power, even after controlling for firm characteristics, earning a Fama-French three-factor alpha in excess of 20% per annum. Our analysis further reveals that the strongest option characteristics are associated with information about asset mispricing and future tail return realizations. Our findings are consistent with models of informed trading and limits to arbitrage.
The transition to a sustainable economy currently involves a fundamental transformation of our capital markets. Lawmakers, in an attempt to overcome this challenge, frequently seek to prescribe and regulate how firms may address environmental, social, and governance (ESG) concerns by formulating conduct standards. Deviating from this conceptual starting point, the present paper makes the case for another path towards achieving greater sustainability in capital markets, namely through the empowerment of investors.
This trust in the market itself is grounded in various recent developments both on the supply side and the demand side of financial markets, and also in the increasing tendency of institutional investors to engage in common ownership. The need to build coalitions among different types of asset managers or institutional investors, and to convince fellow investors of a given initiative, can then act as an in-built filter helping to overcome the pursuit of idiosyncratic motives and supporting only those campaigns that are seconded by a majority of investors. In particular, institutionalized investor platforms have emerged over recent years as a force for investor empowerment, serving to coordinate investor campaigns and to share the costs of engagement.
ESG engagement has the potential to become a very powerful driver towards a more sustainability-oriented future. Indeed, I show that investor-led sustainability has many advantages compared to a more prescriptive, regulatory approach where legislatures are in the driver’s seat. For example, a focus on investor-led priorities would follow a more flexible and dynamic pattern rather than complying with inflexible pre-defined criteria. Moreover, investor-promoted assessments are not likely to impair welfare creation in the same way as ill-defined legal standards; they will also not trigger regulatory arbitrage and would avoid deadlock situations in corporate decision-making. Any regulatory activity should then be limited to a facilitative and supportive role.
This paper studies the interactions between corporate law and VC exits by acquisitions, an increasingly common source of VC-related litigation. We find that transactions by VC funds under liquidity pressure are characterized by (i) a substantially lower sale price; (ii) a greater probability of industry outsiders as acquirers; (iii) a positive abnormal return for acquirers. These features indicate the existence of fire sales, which satisfy VCs' liquidation preferences but hurt common shareholders, leaving board members with conflicting fiduciary duties and litigation risks. Exploiting an important court ruling that establishes the board’s fiduciary duties to common shareholders as a priority, we find that after the ruling maturing VCs become less likely to exit by fire sales and they distribute cash to their investors less timely. However, VCs experience more difficult fundraising ex-ante, highlighting the potential cost of a common-favoring regime. Overall the evidence has important implications for optimal fiduciary duty design in VC-backed start-ups.
