Im Gefolge der spanischen Kolonisation bildete sich ein für Hispanoamerika geltendes Normengefüge heraus, das später so genannte Derecho Indiano. Aus Europa stammende Institutionen und Normen wurden in der "Neuen Welt" (re-)produziert, doch gingen in seine Entstehung auch gewohnheitsrechtliche lokale Praktiken ein: spanische ebenso wie indigene aus vorkolonialer Zeit. Um die komplexe Genese dieses multinormativen Rechts verstehen zu können, sind neben den klassischen Quellen auch die jeweilige lokale Rechtsproduktion und der juristische Diskurs zu berücksichtigen. Cómo reaccionaba la inquisición española ante la presencia de protestantes en sus colonias americanas es una de las preguntas transversales de la investigación que nos presenta el libro de Joël Graf. A partir de un análisis comparativo de los respectivos procesos inquisitoriales, el autor analiza las lógicas históricas, geográficas, jurídicas y teológicas que estaban a la base de las formas en que los tres tribunales inquisitoriales americanos procesaron a los diversos protestantes entre los siglos XVI y XVIII. Presentado de forma cronológica, el autor va mostrando las diferentes formas de reaccionar de los tribunales, sus prácticas jurídicas y principales debates. Entre ellos, quisiéramos resaltar algunos aspectos fundamentales del libro: a) los mecanismos de inclusión del catolicismo, basados en prácticas de disimulo, reverencia y auto-denuncia; b) las particularidades americanas de los denominados "herejes nacionales"; c) el poco uso de los tratados internacionales en medio de una amplia oferta normativa. ...
It was seventeen years ago when the first same-sex marriage was celebrated in a civil ceremony in Amsterdam, right after the Dutch Parliament passed legislation that legalized same-sex marriages. Since then, same-sex marriage has become legal in over two dozen countries worldwide. Last year, the German Bundestag added Germany to the growing list of countries where same-sex couples can obtain a legal marriage license. The past decades have indeed witnessed social mobilizations around the globe for LGBTI+ rights. Whether through legislation, court rulings, or popular referenda, 25 countries grant full juridical marital recognitions only recently enjoyed by opposite-sex partners to all citizens, regardless of their gender and sexual preferences. However, this legal evolution has been uneven. Currently, in many countries, LGBTI+ relations not only contravene moral codes but are still punishable crimes with varying amounts of prison time, fines, and in a few cases, with the death penalty. ...

Häufig sind sie maßgeblich an der Schöpfung beteiligt und werden mit der Fruchtbarkeit der Pflanzen sowie dem Wohlergehen der Menschen in Verbindung gebracht. Zahlreiche Mythen berichten von den Taten der beiden Gestirne, die manchmal als Geschwister oder auch als Liebespaar gelten.
Historical scholarship on the sixteenth-century neo-scholastic debate about American Indians generally centers on the thought of Francisco de Vitoria. Focusing on Alfonso de Castro’s short treatise Utrum indigenae (1543), this paper challenges both an exclusive concentration on Vitoria as well as the received contention that the thought of the School of Salamanca rendered a single, unified view of Amerindians. In Utrum indigenae, Castro argued that American Indians should be instructed in liberal arts and theology thus constructing a strikingly different image of the peoples of the New World as compared to accounts by Vitoria or Francisco Suárez. While the historian Martin Nesvig has recently proposed an Erasmian humanist contextualization of Castro’s treatise, I argue that the image of American Indians presented in Utrum indigenae testifies to an alternative, novel way of writing about American Indians from within the framework of the School of Salamanca which has so far remained unnoticed.
This paper discusses the role of German Jesuit priests in the conquest of the lower amazon area in the 17th century. The Luxemburg missionary John Philip Bettendorff, founder of the second largest city of Pará, Santarém, was one of the most important figures while colonizing the Estate of Maranhão e Great-Pará. His chronicle is not only an important testimony of the settlements’ history but also of the Jesuit activities as handicraft workers and artists while catechizing this region. Thus, it comprehends a part of the rich cultural memory of colonial Brazil.
