On 14 September 2016, the European Commission proposed a Directive on “copyright in the Digital Single Market”. This proposal includes an Article 11 on the “protection of press publications concerning digital uses”, according to which “Member States shall provide publishers of press publications with the rights provided for in Article 2 and Article 3(2) of Directive 2001/29/EC for the digital use of their press publications.” Relying on the experiences and debates surrounding the German and Spanish laws in this area, this study presents a legal analysis of the proposal for an EU related right for press publishers (RRPP). After a brief overview over the general limits of the EU competence to introduce such a new related right, the study critically examines the purpose of an RRPP. On this basis, the next section distinguishes three versions of an RRPP with regard to its subject-matter and scope, and considers the practical and legal implications of these alternatives, in particular having regard to fundamental rights.
The ECB’s Outright Monetary Transactions (OMT) program, launched in summer 2012, indirectly recapitalized periphery country banks through its positive impact on the value of sovereign bonds. However, the regained stability of the European banking sector has not fully transferred into economic growth. We show that zombie lending behavior of banks that still remained undercapitalized after the OMT announcement is an important reason for this development. As a result, there was no positive impact on real economic activity like employment or investment. Instead, firms mainly used the newly acquired funds to build up cash reserves. Finally, we document that creditworthy firms in industries with a high prevalence of zombie firms suffered significantly from the credit misallocation, which slowed down the economic recovery.
Der Streit um das Kopftuch : vom Umgang mit religiösen Geltungsansprüchen in liberalen Ordnungen

Im Streit um das Kopftuch geht es um mehr als ein beliebiges Rechtsproblem. Welche Rolle soll die Religion im öffentlichen Leben spielen? Wie geht eine liberale Gesellschaft mit der religiösen Vielfalt um? In Deutschland – im Gegensatz zu Frankreich – orientiert sich das Verfassungsrecht am Modell einer "positiven Neutralität": Der Staat weist die Religion nicht vollständig von sich ab, sondern gibt ihr aktiv Raum zur Entfaltung. Muss dieses Modell hinterfragt werden, wenn Gruppen mit starkem religiösen Geltungsanspruch die Bühne betreten und Religion wieder für gesellschaftlichen Konfliktstoff sorgt?
The grammar of global law

Legal grammar is understood as the conceptual and linguistic foundation on which legal decisions rest – law’s meta-structure, its argumentative techniques and its systematicity. The essay distinguishes between two ways of thinking about this grammar. The first way of thinking appeals to a grammar as a stabilizing factor, maintaining the coherence of the law. The second way of thinking highlights the asymmetries of power within this structure and perceives legal grammar as the medium carrying the ideological commitments of the law. As the essay ultimately argues, both perspectives react differently to the challenges of globalization that the law is confronted with. While the debate on the grammar(s) of global law is one place where future political order is negotiated, the outcome of the debate is largely open.
Das Kapitalmarktrecht entwickelt sich in der Berliner Republik zu einem voll integrierten Kernbestandteil des unternehmensrechtlichen Diskurses in der Rechtswissenschaft, während es in den vorausgehenden Dekaden primär eine in den normativen Grundlagen wenig durchdrungene Praktikermaterie darstellte. Das vorliegende Essay versucht eine Erklärung für diese Beobachtung zu skizzieren, die auf einem breiten Jurisdiktionen und Nationalökonomien übergreifenden Kontext beruht, der mit den Schlagworten Europäisierung und Globalisierung nur platt und unscharf umschrieben ist. Dabei geht es einerseits um eine Ausweichbewegung deutscher Unternehmen, die mit einer verstärkten Kapitalmarktorientierung eine Klemme in der Unternehmensfinanzierung zu lösen, die durch den Rückzug der vom globalen Wettbewerb erfassten Finanzindustrie aus derselben ausgelöst wurde. Auf der anderen Seite findet in der Altersvorsoge eine Abkehr von Umverteilungssystemen und eine Hinwendung zur kapitalbasierten Vorsorge statt, durch die nicht nur mehr Kapital für Investitionen statt für Konsum zur Verfügung steht, sondern auch die Interessen der Mittelschicht in vielerlei Hinsicht stärker von einer anlegerorientierten Regelung im Gesellschafts- und Kapitalmarktrecht abhängen, als von einer Arbeitnehmerorientierung im Unternehmensrecht.
Mediation in der Türkei : Betrachtung ausgewählter Aspekte im Vergleich zur Mediation in Deutschland

Angesichts der vergleichsweise noch sehr jungen Entwicklung der Mediation in der Türkei mag man es auf den ersten Blickerstaunlich finden, dass in der Türkei zeitgleich mit Deutschland ein Mediationsgesetz geschaffen wurde. Die Mediation als außergerichtliches Vermittlungsverfahren gründet darauf, dass Streitparteien freiwillig und selbstbestimmt ihren Konflikt mit Unterstützung eines Mediators einer gemeinsam entwickelten Lösung zuführen. Dies sind die Grundprinzipien der Mediation, die sowohl dem deutschen als auch dem türkischen Mediationsgesetz als Basis dienen.
Trotz vieler Ähnlichkeiten haben die kulturellen Besonderheiten beider Länder Einfluss auf die rechtliche Ausgestaltung dieses Einigungsverfahrens sowie dessen Umsetzung in der Praxis .Ziel des vorliegenden Arbeitspapiers ist es, dem Leser einen Einblick in die Unterschiede und Gemeinsamkeiten der Mediation in der Türkei und Deutschland zu vermitteln und dabei vergleichend zu untersuchen , ob und inwieweit landestypischen Spezifika in der Entstehungsgeschichte, den Grundlagen und der Praxis der Mediation erkennbar und durch gesellschaftliche und kulturelle Faktoren erklärbar sind.

Imperialism is the domination of one state by another. This paper sketches a nonrepublican account of domination that buttresses this definition of imperialism. It then defends the following claims. First, there is a useful and defensible distinction between colonial and liberal imperialism, which maps on to a distinction between what I will call coercive and liberal domination. Second, the main institutions of contemporary globalization, such as the WTO, the IMF, the World Bank, etc., are largely the instruments of liberal imperialism; they are a reincarnation of what Karl Kautsky once called ‘ultraimperialism’. Third, resistance to imperialism can no longer be founded on a fundamental right to national self-determination. Such a right is conditional upon and derivative of a more general right to resist domination.
The concept of freedom as non-domination that is associated with neo-republican theory provides a guiding ideal in the global, not just the domestic arena, and does so even on the assumption that there will continue to be many distinct states. It argues for a world in which states do not dominate members of their own people and, considered as a corporate body, no people is dominated by other agencies: not by other states and not, for example, by any international agency or multi-national corporation. This ideal is not only attractive in the abstract, it also supports a concrete range of sensible, if often radical international policies.
Contemporary liberalism and republicanism present clearly distinct programs for domestic politics, but the same cannot be said when it comes to global politics: the burgeoning literature on global republicanism has reproduced the divide between cosmopolitan and associational views familiar from long-standing debates among liberal egalitarians. Should republicans be cosmopolitans? Despite presence of a range of views in the literature, there is an emerging consensus that the best answer is no. This paper aims to resist the emerging consensus, arguing that republicans should be cosmopolitans. The considerations offered against cosmopolitanism generally rest on an incomplete understanding of the relationship between economic inequality or poverty on the one hand, and domination on the other. Insofar as republicans agree that promoting freedom from domination should be our central political aim, they should regard the reduction of economic inequality and poverty at home and abroad as equally pressing.
The article aims to sharpen the neo-republican contribution to international political thought by challenging Pettit’s view that only representative states may raise a valid claim to non-domination in their external relations. The argument proceeds in two steps: First I show that, conceptually speaking, the domination of states, whether representative or not, implies dominating the collective people at least in its fundamental, constitutive power. Secondly, the domination of states – and thus of their peoples – cannot be justified normatively in the name of promoting individual non-domination because such a compensatory rationale misconceives the notion of domination in terms of a discrete exercise of power instead of as an ongoing power relation. This speaks in favour of a more inclusive law of peoples than Pettit (just as his liberal counterpart Rawls) envisages: In order to accommodate the claim of collective peoples to non-domination it has to recognize every state as a member of the international order.
