Anlass zu beschreiben, was Rechtstransfer bedeutet, sieht nicht nur die gegenwärtige juristische Gesellschaft. Erheblicher Bedarf an Erklärungsmodellen bestand auch im 19. Jahrhundert. Eine der größten Migrationswellen, die so genannte Rezeption des römischen Rechts, hatte Europa während mehrerer Jahrhunderte überflutet. Aus dieser Flut, kaum hatte sie ihren Höchststand erreicht, reckten sich nun allerorts nationale Gesetzgebungsprogramme und ganze Kodifikationen hervor. Das Verhältnis von rezipiertem, römischem Recht – das längst ganz "eigen" und "heutig" geworden war – zu den das ius commune störenden oder sogar zerstörenden Eingriffen nationaler Gesetzgeber galt es zu klären und zu erklären. Nur wenn es für den einstigen Transfer des römischen Rechts in germanische Gefilde plausible und irreversible Gründe gab, gab es auch Gründe, die kecken Vorstöße des nationalen Gesetzgebers zurückzuweisen und der Positivität des Rechts Einhalt zu gebieten. Das war die Position eines Savigny und seiner Gesinnungsgenossen. ...
