he predictive likelihood is of particular relevance in a Bayesian setting when the purpose is to rank models in a forecast comparison exercise. This paper discusses how the predictive likelihood can be estimated for any subset of the observable variables in linear Gaussian state-space models with Bayesian methods, and proposes to utilize a missing observations consistent Kalman filter in the process of achieving this objective. As an empirical application, we analyze euro area data and compare the density forecast performance of a DSGE model to DSGE-VARs and reduced-form linear Gaussian models.
We use data from the 2009 Internet Survey of the Health and Retirement Study to examine the consumption impact of wealth shocks and unemployment during the Great Recession in the US. We find that many households experienced large capital losses in housing and in their financial portfolios, and that a non-trivial fraction of respondents have lost their job. As a consequence of these shocks, many households reduced substantially their expenditures. We estimate that the marginal propensities to consume with respect to housing and financial wealth are 1 and 3.3 percentage points, respectively. In addition, those who became unemployed reduced spending by 10 percent. We also distinguish the effect of perceived transitory and permanent wealth shocks, splitting the sample between households who think that the stock market is likely to recover in a year’s time, and those who do not. In line with the predictions of standard models of intertemporal choice, we find that the latter group adjusted much more than the former its spending in response to financial wealth shocks.
Using data from the US Health and Retirement Study, we study the causal effect of increased health insurance coverage through Medicare and the associated reduction in health-related background risk on financial risk-taking. Given the onset of Medicare at age 65, we identify our effect of interest using a regression discontinuity approach. We find that getting Medicare coverage induces stockholding for those with at least some college education, but not for their less-educated counterparts. Hence, our results indicate that a reduction in background risk induces financial risk-taking in individuals for whom informational and pecuniary stock market participation costs are relatively low.

In the Hittite phonological system there was a labialized velar fricative /xw/ beside the plain velar fricative /x/ parallel to the opposition between the velar stops /kw/ and /k/. The frequent syllable /xwa/ was spelled either hu-(u) or hu-wa. Evidence from the frequency of words with initial hu in the lexicon, from spelling variations and from ablaut alternations is presented to demonstrate the existence of /xw/. It is suggested that Hittite /xw/ regularly corresponds to the reflexes of *w in the non-Anatolian Indo-European languages.
In der Pandemie hört die Gesundheit auf, Privatsache zu sein: Aufgrund der kollektiven Gefährdung der Bevölkerung wird sie zu einem öffentlichen Gut, das unter die Schutzverantwortung des Staates und nicht mehr allein unter die Selbstverantwortung des Individuums fällt, ja fallen darf. Pandemieereignisse können die Aufrechterhaltung der öffentlichen Sicherheit und Ordnung massiv in Frage stellen. Die jedes Mal vorhandene wissenschaftliche Unsicherheit bei neu auftretenden und unbekannten Erregern können Gesellschaften – Experten, Laien und die Politik – in Angst und Schrecken versetzen und zu heftigen Reaktionen zur Gefahrenabwehr in der Sicherheitspolitik führen. Pandemien fordern somit 'den Staat' in seinen Kernwerten heraus; es ist der klassische Konflikt zwischen Sicherheit und Freiheit. Das empirische Beispiel dieses Beitrags untersucht den politische Diskurs über den 'richtigen' Umgang mit dem HI-Virus (Human Immunodeficiency Virus oder HIV) in den 1980er Jahren in der Bundesrepublik. Dass sich dieser Diskurs letztendlich zugunsten der moderateren Position verlagert hat und eine Versicherheitlichung von AIDS (Acquired Immunodeficiency Syndrome) vermieden werden konnte, ist vor allem der institutionellen Gewaltenverschränkung sowie der demokratischen Debatte um die Krankheit geschuldet, in der die Notwendigkeit der Schutzmaßnahmen öffentlich begründet und damit deren Sinnhaftigkeit trotz der vorherrschenden gesellschaftlichen Ängste rational hinterfragt und institutionell eingehegt – also entsicherheitlicht – werden konnte.
The papers in this volume take up some aspects of the preverbal domain(s) in Bantu languages. They were originally presented at the Workshop BantuSynPhonIS: Preverbal Domain(s), held at the Center for General Linguistics (ZAS), in Berlin, on 14-15 November 2014. This workshop was coorganized by ZAS (Fatima Hamlaoui & Tonjes Veenstra) and the Humboldt University (Tom Güldemann, Yukiko Morimoto and Ines Fiedler).
Noumenal Power

In political or social philosophy, we speak about power all the time. Yet the meaning of this important concept is rarely made explicit, especially in the context of normative discussions. But as with many other concepts, once one considers it more closely, fundamental problems arise, such as whether a power relation is necessarily a relation of subordination and domination. In the following, I suggest a novel understanding of what power is and what it means to exercise it.
Die Untersuchung wurde im Lichte der aktuellen Diskussion um die Grundlagenkrise der Juristenausbildung durchgeführt. Hierbei wird der Anspruch erhoben, die Perspektive von Promotionsstudierenden ebenfalls zu berücksichtigen. Mit einer rechtsmethodologischen Herangehensweise wird nämlich nachgewiesen, dass die analoge (bzw. entsprechende) Anwendung des § 770 Abs. 1 BGB auf sonstige Gestaltungsrechte mit dem Willen des Gesetzgebers nicht übereinstimmt. Die Konsequenzen der Ablehnung der Anwendbarkeit des § 770 Abs. 1 BGB auf sonstige Gestaltungsrechte werden ebenso besprochen wie Wertungs- und Theoriefragen in diesem Zusammenhang. Aus dieser „methodenehrlichen“ Anwendung des § 770 Abs. 1 BGB und den sich hieraus ergebenden Konsequenzen werden sodann Schlussfolgerungen für die Stärkung der Grundlagenfächer gezogen.
Arzneimittelrückstände lassen sich heute in nahezu allen Gewässern nachweisen. Die Konzentrationen sind sehr gering; dennoch werden Risiken für die Umwelt und die Menschen vermutet. Daher ist zu klären, ob und wie es möglich ist, in Verfolgung des Vorsorgegedankens ihren Eintrag in die aquatische Umwelt möglichst zu verhindern oder zumindest zu reduzieren. Hierzu bieten sich umwelttechnische und gesundheitspolitische Maßnahmen sowie innovative Ansätze in der Arzneimittelentwicklung an.
Im Rahmen des BMBF-Projekts „SAUBER+ Innovative Konzepte und Technologien für die separate Behandlung von Abwasser aus Einrichtungen des Gesundheitswesens“ sind im Austausch mit Praxisakteuren zwei Zukunftsszenarien entstanden. Diese beschreiben von heute bis zum Jahr 2030 wie Maßnahmen in den genannten Handlungsfeldern umgesetzt und miteinander kombiniert werden können. Das erste Szenario ist eine Fortführung der bisherigen Entwicklungen. Im zweiten wird hingegen davon ausgegangen, dass sich die Bundesregierung einer sektor-übergreifenden Nachhaltigkeitspolitik verpflichtet und sich auf diese Weise die Einträge in die aquatische Umwelt auf ein Minimum reduzieren lassen.
Medieninhaltsanalyse zu anthropogenen Spurenstoffen im Wasser : Ergebnisse aus dem Projekt TransRisk

Im Projekt TransRisk erstellt das ISOE in Zusammenarbeit mit der Deutschen Vereinigung für Wasserwirtschaft, Abwasser und Abfall (DWA) und der TU-Dresden ein Kommunikationskonzept zur Reduzierung von anthropogenen Spurenstoffen im Wasserkreislauf für die allgemeine Bevölkerung. Hierfür hat das ISOE als Vorarbeit eine Medieninhaltsanalyse von Zeitungsartikeln durchgeführt. Es ging dabei um die Frage, wie das Thema anthropogene Spurenstoffe bisher in der Presse behandelt worden ist. In diesem Studientext werden die Ergebnisse der Medienanalyse vorgestellt. Sie zeigen, dass die Berichterstattung zu anthropogenen Spurenstoffen im Wasserkreislauf in der Regel sachlich ist und nur selten reißerisch oder verharmlosend. Von der Vielzahl an Spurenstoffen stehen Medikamentenreste und Hormone im Mittelpunkt. Konkretes Handlungswissen für Verbraucher wird eher selten vermittelt. Eine zukünftige Kommunikationsstrategie zu anthropogenen Spurenstoffen im Wasserkreislauf sollte daher auf die Vermittlung von solidem Handlungswissen zielen. Weiter lässt sich aus den Ergebnissen ableiten, dass insbesondere bei Spurenstoffen, die nicht aus Medikamenten stammen, zunächst einmal Problembewusstsein geschaffen werden muss.
Während aktuelle empirische Daten Hinweise auf einen Wandel der Mobilitätsorientierung von Jugendlichen und Heranwachsenden in Agglomerationen liefern, ist im ländlichen Raum der Trend zur individuellen Motorisierung ungebrochen. Die vorliegende Synthese des Forschungsstandes deutschsprachiger und internationaler Forschungsliteratur stellt Erkenntnisse zum Mobilitätsverhalten und zu mobilitätsbezogenen Einstellungen sowie bisher durchgeführte Maßnahmen zur Beeinflussung des Mobilitätsverhaltens von Personen in der Altersgruppe bis ca. 27 Jahre vor.
We outline a procedure for consistent estimation of marginal and joint default risk in the euro area financial system. We interpret the latter risk as the intrinsic financial system fragility and derive several systemic fragility indicators for euro area banks and sovereigns, based on CDS prices. Our analysis documents that although the fragility of the euro area banking system had started to deteriorate before Lehman Brothers' file for bankruptcy, investors did not expect the crisis to affect euro area sovereigns' solvency until September 2008. Since then, and especially after November 2009, joint sovereign default risk has outpaced the rise of systemic risk within the banking system.
Does austerity pay off?

Policy makers often implement austerity measures when the sustainability of public finances is in doubt and, hence, sovereign yield spreads are high. Is austerity successful in bringing about a reduction in yield spreads? We employ a new panel data set which contains sovereign yield spreads for 31 emerging and advanced economies and estimate the effects of cuts of government consumption on yield spreads and economic activity. The conditions under which austerity takes place are crucial. During times of fiscal stress, spreads rise in response to the spending cuts, at least in the short-run. In contrast, austerity pays off, if conditions are more benign.
One of the leading methods of estimating the structural parameters of DSGE models is the VAR-based impulse response matching estimator. The existing asympotic theory for this estimator does not cover situations in which the number of impulse response parameters exceeds the number of VAR model parameters. Situations in which this order condition is violated arise routinely in applied work. We establish the consistency of the impulse response matching estimator in this situation, we derive its asymptotic distribution, and we show how this distribution can be approximated by bootstrap methods. Our methods of inference remain asymptotically valid when the order condition is satisfied, regardless of whether the usual rank condition for the application of the delta method holds. Our analysis sheds new light on the choice of the weighting matrix and covers both weakly and strongly identified DSGE model parameters. We also show that under our assumptions special care is needed to ensure the asymptotic validity of Bayesian methods of inference. A simulation study suggests that the frequentist and Bayesian point and interval estimators we propose are reasonably accurate in finite samples. We also show that using these methods may affect the substantive conclusions in empirical work.
We examine both the degree and the structural stability of inflation persistence at different quantiles of the conditional inflation distribution. Previous research focused exclusively on persistence at the conditional mean of the inflation rate. As economic theory provides reasons for inflation persistence to differ across conditional quantiles, this is a potentially severe constraint. Conventional studies of inflation persistence cannot identify changes in persistence at selected quantiles that leave persistence at the median of the distribution unchanged. Based on post-war US data we indeed find robust evidence for a structural break in persistence at all quantiles of the inflation process in the early 1980s. While prior to the 1980s inflation was not mean reverting, quantile autoregression based unit root tests suggest that since the end of the Volcker disinflation the unit root can be rejected at every quantile of the conditional inflation distribution.
Robustness, validity, and significance of the ECB's asset quality review and stress test exercise

As we are moving toward a eurozone banking union, the European Central Bank (ECB) is going to take over the regulatory oversight of 128 banks in November 2014. To that end, the ECB conducted a comprehensive assessment of these banks, which included an asset quality review (AQR) and a stress test. The fundamental question is how accurately will the financial condition of these banks have been assessed by the ECB when it commences its regulatory oversight? And, can the comprehensive assessment lead to a full repair of banks’ balance sheets so that the ECB takes over financially sound banks and is the necessary regulation in place to facilitate this? Overall, the evidence presented in this paper based on the design of the comprehensive assessment as well as own stress test exercises suggest that the ECB’s assessment might not comprehensively deal with the problems in the financial sector and risks may remain that will pose substantial threats to financial stability in the eurozone.

Die Anpassung der EU-Richtlinie über Märkte für Finanzinstrumente (MiFID II) und die Einführung einer begleitenden Verordnung (MiFIR) im Jahr 2014 werden erhebliche Auswirkungen auf die Finanzmärkte in Europa haben und zu einer grundlegenden Neuordnung der Finanzmarktstrukturen führen. Ausgehend von einer Diskussion der Zielerreichung der ursprünglichen Richtlinie (MiFID I) aus dem Jahr 2004 werden im vorliegenden Artikel die Zielsetzungen und Maßnahmen der Neuregelung beleuchtet. Wesentliche Elemente im Hinblick auf Marktstrukturen und den Wertpapierhandel sind die Einführung einer neuen Handelsplatzkategorie, des organisierten Handelssystems („Organised Trading Facility“; OTF), sowie die Ausweitung der bislang für Aktien geltenden Transparenzvorschriften auf weitere Finanzinstrumente. Zudem werden eine Handelsverpflichtung für Aktien und Derivate sowie eine Clearingpflicht für Derivate, die auf geregelten Märkten gehandelt werden, neu eingeführt. Schließlich werden der algorithmische Handel und der Hochfrequenzhandel auf europäischer Ebene reguliert, wobei die Regelungen weitgehend dem 2013 eingeführten deutschen Hochfrequenzhandelsgesetz angelehnt sind. Im Ausblick wird zunächst der weitere Prozess der Regulierung skizziert (insbesondere die sog. Level II-Maßnahmen). Abschließend werden mögliche Auswirkungen von MiFID II und MiFIR auf die Marktstruktur und den Wertpapierhandel aufgezeigt.
n a contribution prepared for the Athens Symposium on “Banking Union, Monetary Policy and Economic Growth”, Otmar Issing describes forward guidance by central banks as the culmination of the idea of guiding expectations by pure communication. In practice, he argues, forward guidance has proved a misguided idea. What is presented as state of the art monetary policy is an example of pretence of knowledge. Forward guidance tries to give the impression of a kind of rule-based monetary policy. De facto, however, it is an overambitious discretionary approach which, to be successful, would need much more (or rather better) information than is currently available. In Issing's view, communication must be clear and honest about the limits of monetary policy in a world of uncertainty.
In the wake of the Global Financial Crisis that started in 2007, policymakers were forced to respond quickly and forcefully to a recession caused not by short-term factors, but rather by an over-accumulation of debt by sovereigns, banks, and households: a so-called “balance sheet recession.” Though the nature of the crisis was understood relatively early on, policy prescriptions for how to deal with its consequences have continued to diverge. This paper gives a short overview of the prescriptions, the remaining challenges and key lessons for monetary policy.
Marktverhalten folgt nicht allein rationalen Kosten-Nutzen-Kalkülen. Vielmehr kann mit Jens Beckert zwischen der marktermöglichenden, der marktbegleitenden und der marktbegrenzenden Sittlichkeit der Wirtschaft unterschieden werden. Der Beitrag erörtert anhand der Bedeutung der Corporate Social Responsibility (CSR) im US-Recht, inwieweit diese ethischen Normen des Wirtschaftens verrechtlicht sind, also durch Rechtsvorschriften sanktioniert werden. Im Ergebnis wird sich ein Zusammenhang zwischen der Rechtsrelevanz sittlicher Maßstäbe und ihrer Komplementarität mit dem wettbewerblichen Marktgeschehen ergeben. Die marktermöglichende Sittlichkeit genießt demnach intensiven Rechtsschutz, der jedoch immer lückenhafter wird, je stärker die marktbegrenzende Dimension ethischer Normen zu Tage tritt.
This paper studies the life cycle consumption-investment-insurance problem of a family. The wage earner faces the risk of a health shock that significantly increases his probability of dying. The family can buy term life insurance with realistic features. In particular, the available contracts are long term so that decisions are sticky and can only be revised at significant costs. Furthermore, a revision is only possible as long as the insured person is healthy. A second important and realistic feature of our model is that the labor income of
the wage earner is unspanned. We document that the combination of unspanned labor income and the stickiness of insurance decisions reduces the insurance demand significantly. This is because an income shock induces the need to reduce the insurance coverage, since premia become less affordable. Since such a reduction is costly and families anticipate these potential costs, they buy less protection at all ages. In particular, young families stay away from life insurance markets altogether.
In this paper, we propose a novel approach on how to estimate systemic risk and identify its key determinants. For all US financial companies with publicly traded equity options, we extract their option-implied value-at-risks (VaRs) and measure the spillover effects between individual company VaRs and the option-implied VaR of an US financial index. First, we study the spillover effect of increasing company risks on the financial sector. Second, we analyze which companies are most affected if the tail risk of the financial sector increases. We find that key accounting and market valuation metrics such as size, leverage, balance sheet composition, market-to-book ratio and earnings have a significant influence on the systemic risk profile of a financial institution. In contrast to earlier studies, the employed panel vector autoregression (PVAR) estimator allows for a causal interpretation of the results.
Loudness in the novel

The novel is composed entirely of voices: the most prominent among them is typically that of the narrator, which is regularly intermixed with those of the various characters. In reading through a novel, the reader "hears" these heterogeneous voices as they occur in the text. When the novel is read out loud, the voices are audibly heard. They are also heard, however, when the novel is read silently: in this la!er case, the voices are not verbalized for others to hear, but acoustically created and perceived in the mind of the reader. Simply put: sound, in the context of the novel, is fundamentally a product of the novel’s voices. This conception of sound mechanics may at first seem unintuitive—sound seems to be the product of oral reading—but it is only by starting with the voice that one can fully appreciate sound’s function in the novel. Moreover, such a conception of sound mechanics finds affirmation in the works of both Mikhail Bakhtin and Elaine Scarry: "In the novel," writes Bakhtin, "we can always hear voices (even while reading silently to ourselves)."
This paper makes a conceptual contribution to the effect of monetary policy on financial stability. We develop a microfounded network model with endogenous network formation to analyze the impact of central banks' monetary policy interventions on systemic risk. Banks choose their portfolio, including their borrowing and lending decisions on the interbank market, to maximize profit subject to regulatory constraints in an asset-liability framework. Systemic risk arises in the form of multiple bank defaults driven by common shock exposure on asset markets, direct contagion via the interbank market, and firesale spirals. The central bank injects or withdraws liquidity on the interbank markets to achieve its desired interest rate target. A tension arises between the beneficial effects of stabilized interest rates and increased loan volume and the detrimental effects of higher risk taking incentives. We find that central bank supply of liquidity quite generally increases systemic risk.
Panel Sample Selection ModelsThe empirical evidence currently available in the literature regarding the effects of a country's IMF program participation on its output growth is rather inconclusive. In this paper we propose and estimate a panel data sample selection model featuring state dependence. As in this model the output growth effects of program participation can be conditional on the realization of a state variable (conditional pooling), our framework may reconcile previous empirical evidence based on models without state-dependent effects. We find that the effects of IMF program participation on output growth vary systematically with an index reflecting a country's institutional record, and that output growth effects of program participation are significantly positive only if the program participation is coupled with sufficient improvement of the institutional record.

We explore the sources of household balance sheet adjustment following the collapse of the housing market in 2006. First, we use microdata from the Federal Reserve Board’s Senior Loan Officer Opinion Survey to document that banks cumulatively tightened consumer lending standards more in counties that experienced a house price boom in the mid-2000s than in non-boom counties. We then use the idea that renters, unlike homeowners, did not experience an adverse wealth shock when the housing market collapsed to examine the relative importance of two explanations for the observed deleveraging and the sluggish pickup in consumption after 2008. First, households may have optimally adjusted to lower wealth by reducing their demand for debt and implicitly, their demand for consumption. Alternatively, banks may have been more reluctant to lend in areas with pronounced real estate declines. Our evidence is consistent with the second explanation. Renters with low risk scores, compared to homeowners in the same markets, reduced their levels of nonmortgage debt and credit card debt more in counties where house prices fell more. The contrast suggests that the observed reductions in aggregate borrowing were more driven by cutbacks in the provision of credit than by a demand-based response to lower housing wealth.
We characterize optimal redistribution in a dynastic family model with human capital. We show how a government can improve the trade-off between equality and incentives by changing the amount of observable human capital. We provide an intuitive decomposition for the wedge between human-capital investment in the laissez faire and the social optimum. This wedge differs from the wedge for bequests because human capital carries risk: its returns depend on the non-diversi
able risk of children's ability. Thus, human capital investment is encouraged more than bequests in the social optimum if human capital is a bad hedge for consumption risk.
After the Global Financial Crisis a controversial rush to fiscal austerity followed in many countries. Yet research on the effects of austerity on macroeconomic aggregates was and still is unsettled, mired by the difficulty of identifying multipliers from observational data. This paper reconciles seemingly disparate estimates of multipliers within a unified and state-contingent framework. We achieve identification of causal effects with new propensity-score based methods for time series data. Using this novel approach, we show that austerity is always a drag on growth, and especially so in depressed economies: a one percent of GDP fiscal consolidation translates into 4 percent lower real GDP after five years when implemented in the slump rather than the boom. We illustrate our findings with a counterfactual evaluation of the impact of the U.K. government’s shift to austerity policies in 2010 on subsequent growth.
In this paper, we investigate how the introduction of complex, model-based capital regulation affected credit risk of financial institutions. Model-based regulation was meant to enhance the stability of the financial sector by making capital charges more sensitive to risk. Exploiting the staggered introduction of the model-based approach in Germany and the richness of our loan-level data set, we show that (1) internal risk estimates employed for regulatory purposes systematically underpredict actual default rates by 0.5 to 1 percentage points; (2) both default rates and loss rates are higher for loans that were originated under the model-based approach, while corresponding risk-weights are significantly lower; and (3) interest rates are higher for loans originated under the model-based approach, suggesting that banks were aware of the higher risk associated with these loans and priced them accordingly. Further, we document that large banks benefited from the reform as they experienced a reduction in capital charges and consequently expanded their lending at the expense of smaller banks that did not introduce the model-based approach. Counter to the stated objectives, the introduction of complex regulation adversely affected the credit risk of financial institutions. Overall, our results highlight the pitfalls of complex regulation and suggest that simpler rules may increase the efficacy of financial regulation.
Dieser Beitrag stellt das transnationale Rohstoffrecht und seine Entwicklung aus einer Konfliktperspektive dar und setzt es in Beziehung zu geopolitischen Transformationen und Wandlungen des Entwicklungsbegriffs. Sachlicher Gegenstand dieses Unterfangens sind erschöpfliche Vorkommen von Rohstoffen in Entwicklungsländern, ihre Ausbeutung und der Handel mit den gewonnenen Rohstoffen. Der Fokus liegt auf Mineralien, Öl und Gas. Der Text ist ein Versuch, Verantwortlichkeiten verschiedener Akteure für anhaltende Armut trotz Rohstoffreichtums greifbarer zu machen.
Riley (1979)'s reactive equilibrium concept addresses problems of equilibrium existence in competitive markets with adverse selection. The game-theoretic interpretation of the reactive equilibrium concept in Engers and Fernandez (1987) yields the Rothschild-Stiglitz (1976)/Riley (1979) allocation as an equilibrium allocation, however multiplicity of equilibrium emerges. In this note we imbed the reactive equilibrium's logic in a dynamic market context with active consumers. We show that the Riley/Rothschild-Stiglitz contracts constitute the unique equilibrium allocation in any pure strategy subgame perfect Nash equilibrium.
This paper contrasts the recent European initiatives on regulating corporate groups with alternative approaches to the phenomenon. In doing so it pays particular regard to the German codified law on corporate groups as the polar opposite to the piecemeal approach favored by E.U. legislation.
It finds that the European Commission’s proposal to submit (significant) related party transactions to enhanced transparency, outside fairness review, and ex ante shareholder approval is both flawed in its design and based on contestable assumptions on informed voting of institutional investors. In particular, the contemplated exemption for transactions with wholly owned subsidiaries allows controlling shareholders to circumvent the rule extensively. Moreover, vesting voting rights with (institutional) investors will not lead to the informed assessment that is hoped for, because these investors will rationally abstain from active monitoring and rely on proxy advisory firms instead whose competency to analyze non-routine significant related party transactions is questionable.
The paper further delineates that the proposed recognition of an overriding interest of the group requires strong counterbalances to adequately protect minority shareholders and creditors. Hence, if the Commission choses to go down this route it might end up with a comprehensive regulation that is akin to the unpopular Ninth Company Law Directive in spirit, though not in content. The latter prediction is corroborated by the pertinent parts of the proposal for a European Model Company Act.
Das Bundesverfassungsgericht ist für seine Entscheidungen, die sich in besonderer Weise auf das Demokratieprinzip des Grundgesetzes (Art. 20 Abs. 2 GG) stützen, viel kritisiert worden. Der Beitrag analysiert insbesondere die Entscheidungen zum Ausländerwahlrecht und zur Europäischen Integration im Hinblick darauf, ob sich neben dem vielfach kritisierten Demokratieverständnis, das ein monistisch verstandenes (deutsches) Volk zum Ausgangspunkt nimmt, auch offenere Demokratiemodelle zumindest zwischen den Zeilen dieser Entscheidungen entdeckt werden können. Das Ergebnis fällt allerdings ernüchternd aus. Jede Öffnung, die Alternativen neben dem monistischen Modell der Volkssouveränität andeutet, wird in den folgenden Sätzen dieser Entscheidungen sogleich wieder zurückgenommen.

Das Privatschulwesen in Deutschland wird ganz überwiegend aus öffentlichen Mitteln finanziert. Seit den 1970er Jahren wird dies vom Bundesverfassungsgericht als Ausfluss des Art. 7 Abs. 4 GG verlangt; die Finanzierung obliegt jedoch den Ländern. Der Beitrag bietet einen systematischen Überblick über die Konflikte die zwischen Privatschulträgern und Ländern über den Umfang der Finanzierung bestehen und nimmt zu den verfassungsrechtlichen Argumenten kritisch Stellung. Es wird gezeigt, dass das Grundgesetz den Ländern mehr Spielräume belässt, als oft behauptet wird.
In this paper, we study the effect of proportional transaction costs on consumption-portfolio decisions and asset prices in a dynamic general equilibrium economy with a financial market that has a single-period bond and two risky stocks, one of which incurs the transaction cost. Our model has multiple investors with stochastic labor income, heterogeneous beliefs, and heterogeneous Epstein-Zin-Weil utility functions. The transaction cost gives rise to endogenous variations in liquidity. We show how equilibrium in this incomplete-markets economy can be characterized and solved for in a recursive fashion. We have three main findings. One, costs for trading a stock lead to a substantial reduction in the trading volume of that stock, but have only a small effect on the trading volume of the other stock and the bond. Two, even in the presence of stochastic labor income and heterogeneous beliefs, transaction costs have only a small effect on the consumption decisions of investors, and hence, on equity risk premia and the liquidity premium. Three, the effects of transaction costs on quantities such as the liquidity premium are overestimated in partial equilibrium relative to general equilibrium.
Der vorliegende Artikel analysiert systematisch die Erreichung der MiFID-Ziele anhand der wissenschaftlichen Literatur. Ziel der MiFID ist es, die Rahmenbedingungen für einen effizienten und kostengünstigen Wertpapierhandel zu schaffen. Erreicht werden soll dies durch die Verschärfung des Wettbewerbs, die Integration der Märkte, die Offenlegung von Handelsintentionen und -geschäften sowie die Stärkung der rechtlichen Position der Investoren. Im Ergebnis zeigt sich, dass die Förderung des Wettbewerbes als erfolgreich bewertet wird, aber die regulatorischen Möglichkeiten der Marktintegration nicht ausgeschöpft werden. Ferner wird die Forderung nach einheitlichen Transparenzbestimmungen für alle Ordermechanismen nur teilweise umgesetzt. Der Anleger erfährt letztlich gegenüber Finanzintermediären durch die MiFID keinen höheren Schutz.
Das Paper geht der Frage nach, welche Rolle Verteilungsgerechtigkeit in Völkerrecht und Völkerrechtswissenschaft spielt. Es stellt zunächst zwei Völkerrechtsprojekte der Nachkriegszeit dar, in deren Zentrum Verteilungsfragen standen: erstens den „embedded liberalism“ Kompromiss von Bretton Woods und zweitens die von den Entwicklungsländern in den 1970er Jahren geforderte Neue Weltwirtschaftsordnung. Nach kurzer Darstellung des Scheiterns von „embedded liberalism“ und Neuer Weltwirtschaftsordnung und der Gründe für ihren Misserfolg, wendet sich das paper der Völkerrechtswissenschaft zu. Zwei zeitgenössische Projekte der Völkerrechtswissenschaft – Konstitutionalisierung des Völkerrechts und Konzeptualisierung des Völkerrechts als öffentliches Recht – werden danach befragt, welche Antworten sie auf die Krise von „welfare state and welfare world“ geben. Während sich der völkerrechtliche Konstitutionalismus nur unzureichend mit dem Verhältnis von Wirtschaft und Politik befasst, verliert die Konzeptualisierung des Völkerrechts als öffentliches Recht mit ihrem Fokus auf das Völkerrecht als Instrument der Beschränkung öffentlicher Gewalt zur Sicherung individueller Freiheit viele Verteilungsfragen gänzlich aus dem Blick. Um das Potential von Recht zur Herstellung von Verteilungsgerechtigkeit auszuloten, scheint daher eine Ausweitung der Perspektive auf transnationales Recht von Nöten. Ausgehend von Gunther Teubners gesellschaftlichem Konstitutionalismus skizziert das Paper Versuche der (transnationalen) Rechtswissenschaft, Fragen ungerechter bzw. gerechter Verteilung zu thematisieren. Das Paper schließt mit der Aufforderung, dass sich eine an Verteilungsgerechtigkeit orientierte transnationale Rechtswissenschaft folgenden Aufgaben widmen sollte: erstens der Bestimmung von Verteilungskonflikten mit Hilfe politischer Ökonomie und rechtspluralistischen Ansätzen und zweitens der Identifikation von Institutionen für einen demokratischen Experimentalismus.

Die optimale Nutzung vorhandener Potentiale von Beschäftigten sowie die bestmögliche Unterstützung von Unternehmen bei der Entwicklung ihrer Beschäftigten sind wichtige Stellschrauben
für eine gezielte und innovative Fachkräftesicherung. Allerdings bedarf solch eine Strategie zunächst einer Transparenz, die Orientierung darüber schafft, in welchem Maße sogenannte unter- und überwertige Beschäftigung stattfindet und in welchen Branchen und Berufsgruppen dies der Fall ist.
Unterwertige Beschäftigung liegt vor, wenn der formale Berufsabschluss höher als die tatsächlich ausgeführte Tätigkeit ist. In diesen Fällen wird davon ausgegangen, dass sich noch weitere Potentiale der Beschäftigten erschließen lassen. Die Umkehrung findet sich bei der überwertigen Beschäftigung. Hier liegen die formalen Qualifikationsabschlüsse deutlich unter den Anforderungen der aktuellen Beschäftigung. Entsprechend sind Qualifizierungsprozesse notwendig, um den höheren Anforderungen gerecht werden zu können. Dabei sind innerbetriebliche, auch informelle Lernprozesse von großer Bedeutung. Neben diesen beiden Formen des vertikalen (formalen) Qualifikationsmismatches können zudem horizontale Mismatches vorliegen. Dies trifft zu, wenn Kompetenzen, häufig Softskills, nicht im Arbeitsvollzug eingesetzt werden können. Auch hier kann von noch zu erschließenden Potentialen ausgegangen werden. Auf Basis von Daten sozialversicherungspflichtig Beschäftigter ist ein Abgleich zwischen dem formalen Berufsabschluss sowie dem formalen beruflichen Anforderungsniveau möglich. Anhand des Abgleichs lässt sich formale unter- und überwertige Beschäftigung ermitteln. Einschätzungen zur Art und zum Umfang horizontaler Mismatches können derzeit auf der Basis von Primärdaten stattfinden.
Theorien des Rechtspluralismus treten überwiegend mit dem Anspruch auf, eine zutreffendere Beschreibung der Wirklichkeit normativer Ordnungen, namentlich der Rechtsordnung, einer Gesellschaft zu geben. Demnach geht das Recht aus vielerlei und verschiedenartigen Quellen hervor, es gibt eine Pluralität von rechtssetzenden Akteuren, Rechtsnormen verschiedener Herkunft überlappen sich in demselben sozialen Feld. Während diese Beschreibung auf historische Gesellschaften bis zur Epoche zentralisierter Nationalstaaten schon immer zutraf, sprechen viele Indizien dafür, dass auch die Entwicklung transnationalen und globalen Rechts zu einem neuen Rechtspluralismus geführt hat. Wer dagegen die Konzeption eines zentral gesetzten, hierarchisch geordneten, universalen und einheitlichen Rechts für einen Fortschritt gegenüber dem Zustand des Rechtspluralismus hält, müsste diesen kritisieren und überwinden wollen. Gegen diese Kritik wendet sich der normative Rechtspluralismus. Dafür wird vor allem seine höhere Responsivität gegenüber verschiedenartigen Rationalitäten einer komplexen Weltgesellschaft ins Feld geführt. Der Beitrag diskutiert verschiedene Varianten des normativen Rechtspluralismus und versucht zu zeigen, dass keine von ihnen ohne die Unterstellung eines gemeinsamen rechtlichen Sinnhorizontes auskommt.
Expressivist theories of punishment, according to which a penal sanction articulates or expresses a certain meaning to the offender, to the victim and to society, become more and more prominent among the traditional theories of punishment as retribution or deterrence. What these theories have in common is the idea that the conveyance of the meaning is in need of a communicative action, and that the penal sanction is such a communicative act. This article argues that pure communicative theories of punishment face great difficulties in generating any justification for hard treatment. One challenge is that certain types of sanctions – in particularly, hard treatment – restrict the communicative opportunities of the incarcerated individual; which generates a paradox, in that it turns punishment into a communicative action of non-communication. Beyond that, moreover, all practices of hard treatment potentially become unnecessary, if expressing the moral message of censure constitutes a kind of action in itself, and as such, itself a treatment of the offender, embedded in a communicative relationship between offender, victim and society; such that we may be able to think of the history of punishment as a development where hard treatment becomes more and more unnecessary for the conveyance of the message.
This essay reviews a cornerstone of the European Banking Union project, the resolution of systemically important banks. The focus is on the inherent conflict between a possible intervention by resolution authorities, conditional on a crisis situation, and effective prevention prior to a crisis. Moreover, the paper discusses the rules for bail-in debt and conversion rules for different layers of debt. Finally, some organizational requirements to achieve effective resolution results will be analyzed.
On November 8, 2013, several members of the British House of Lords’ Subcommittee A conducted a hearing at the ECB in Frankfurt, Germany, on “Genuine Economic and Monetary Union and its Implications for the UK”. Professors Otmar Issing and Jan Pieter Krahnen were called as expert witnesses.
The testimony began with a general discussion on the elements considered necessary for a functioning internal market. Do economic union and monetary union require a fiscal union or even a political union, beyond the elements of the banking union currently being prepared? In this context, also the critique of the German current account surplus and the international expectations that Germany stimulate internal demand to support growth in crisis countries, were discussed.
With regard to the monetary union, the members of the subcommittee asked for an assessment of how European nations and the banking industry would have fared in the banking crisis that followed the Lehman collapse, had there not been a common currency. Given the important role that the ECB has played in the course of the crisis management, the members further asked for an evaluation of the OMT-program of the ECB and also if the monetary union is in need of common debt instruments, in order to provide the ECB with the possibility of buying EU liabilities, comparable to the Fed buying US Treasury bonds. Finally, the dual role of the ECB for monetary policy and banking supervision was an issue touched on by several questions.
Money is more than memory

Impersonal exchange is the hallmark of an advanced society. One key institution for impersonal exchange is money, which economic theory considers just a primitive arrangement for monitoring past conduct in society. If so, then a public record of past actions — or memory — supersedes the function performed by money. This intriguing theoretical postulate remains untested. In an experiment, we show that the suggested functional equality between money and memory does not translate into an empirical equivalence. Monetary systems perform a richer set of functions than just revealing past behaviors, which proves to be crucial in promoting large-scale cooperation.
Arzneimittelrückstände werden heute in zahlreichen Gewässern nachgewiesen. Kleinste Spuren finden sich sogar im Trinkwasser. Auch wenn die Konzentrationen in der Regel sehr gering sind, belegen Forschungsergebnisse für einzelne Wirkstoffe klare Umweltrisiken. Fische, Frösche und Kleinstlebewesen zeigen deutliche Reaktionen auf Medikamentenwirkstoffe im Wasser. Gefahren für die menschliche Gesundheit bestehen nach heutigem Kenntnisstand nicht. Aus Umweltschutz- und Vorsorgegründen ist es jedoch geboten, die Einträge von Arzneimittelwirkstoffen in die Umwelt zu reduzieren. Der aktuelle rechtliche Rahmen liefert für wirksame Maßnahmen kaum eine Handhabe. Deshalb muss auch über Handlungsmöglichkeiten nachgedacht werden, die jenseits rechtlicher Lösungsansätze durchführbar sind. Der hier vorgelegte Text umreißt den gegenwärtigen Wissensstand zum Thema „Arzneimittelwirkstoffe im Wasserkreislauf“ und zeigt praktische Handlungsoptionen auf, wie der Eintrag von Arzneimittelwirkstoffen in die Umwelt verringert werden kann. Dabei wird ein integrierter Ansatz verfolgt, der Handlungsmöglichkeiten auf drei verschiedenen Ebenen empfiehlt: bei der Arzneimittelentwicklung, der technischen Abwasserbehandlung und beim Umgang mit Arzneimitteln. Dieser Bericht ist im Rahmen des Projekts „Arznei für Mensch und Umwelt?“ im Auftrag des Umweltbundesamtes entstanden und richtet sich in erster Linie an die Zielgruppe Ärztinnen/Ärzte und Studierende der Medizin.
Although oil price shocks have long been viewed as one of the leading candidates for explaining U.S. recessions, surprisingly little is known about the extent to which oil price shocks explain recessions. We provide the first formal analysis of this question with special attention to the possible role of net oil price increases in amplifying the transmission of oil price shocks. We quantify the conditional recessionary effect of oil price shocks in the net oil price increase model for all episodes of net oil price increases since the mid-1970s. Compared to the linear model, the cumulative effect of oil price shocks over course of the next two years is much larger in the net oil price increase model. For example, oil price shocks explain a 3% cumulative reduction in U.S. real GDP in the late 1970s and early 1980s and a 5% cumulative reduction during the financial crisis. An obvious concern is that some of these estimates are an artifact of net oil price increases being correlated with other variables that explain recessions. We show that the explanatory power of oil price shocks largely persists even after augmenting the nonlinear model with a measure of credit supply conditions, of the monetary policy stance and of consumer confidence. There is evidence, however, that the conditional fit of the net oil price increase model is worse on average than the fit of the corresponding linear model, suggesting much smaller cumulative effects of oil price shocks for these episodes of at most 1%.
This paper explains why the collection of panel (reinterview) data on a comprehensive measure of household expenditures is of great value both for measuring budget shares (the core mission of a Consumer Expenditure survey) and for the most important research and public policy uses to which CE data can be applied, including construction of spending-based measures of poverty and inequality and estimating the effects of fiscal policy.
The Great Recession confirmed a bedrock principle of modern consumption theory: It is impossible to explain aggregate spending behavior without knowledge of the underlying microeconomic distribution of circumstances and choices across households. National accounting frameworks therefore need to be augmented by “bottom up” measures that both (a) capture the microeconomic heterogeneity (in expenditures, income, assets, debt, and beliefs) in the population and (b) sum up to statistics that have a recognizable relationship to the aggregate totals that are already reasonably well measured.
Austerity

We shed light on the function, properties and optimal size of austerity using the standard sovereign model augmented to include incomplete information about credit risk. Austerity is defined as the shortfall of consumption from the level desired by a country and supported by its repayment capacity. We find that austerity serves as a tool for securing a more favorable loan package; that it is associated with over-investment even when investment does not create collateral; and that low risk borrowers may favor more to less severe austerity. These findings imply that the amount of fresh funds obtained by a sovereign is not a reliable measure of austerity suffered; and that austerity may actually be associated with higher growth. Our analysis accommodates costly signalling for gaining credibility and also assigns a novel role to spending multipliers in the determination of optimal austerity.
This paper provides a systematic analysis of individual attitudes towards ambiguity, based on laboratory experiments. The design of the analysis allows to capture individual behavior across various levels of ambiguity, ranging from low to high. Attitudes towards risk and attitudes towards ambiguity are disentangled, providing pure measures of ambiguity aversion. Ambiguity aversion is captured in several ways, i.e. as a discount factor net of a risk premium, and as an estimated parameter in a generalized utility function. We find that ambiguity aversion varies across individuals, and with the level of ambiguity, being most prominent for intermediate levels. Around one third of subjects show no aversion, one third show maximum aversion, and one third show intermediate levels of ambiguity aversion, while there is almost no ambiguity seeking. While most theoretical work on ambiguity builds on maxmin expected utility, our results provide evidence that MEU does not adequately capture individual attitudes towards ambiguity for the majority of individuals. Instead, our results support models that allow for intermediate levels of ambiguity aversion. Moreover, we find risk aversion to be statistically unrelated to ambiguity aversion on average. Taken together, the results support the view that ambiguity is an important and distinct argument in decision making under uncertainty.
Europe's debt crisis casts doubt on the effectiveness of fiscal austerity in highly-integrated economies. Closed-economy models overestimate its effectiveness, because they underestimate tax-base elasticities and ignore cross-country tax externalities. In contrast, we study tax responses to debt shocks in a two-country model with endogenous utilization that captures those externalities and matches the capital-tax-base elasticity. Quantitative results show that unilateral capital tax hikes cannot restore fiscal solvency in Europe, and have large negative (positive) effects at "home" ("abroad"). Restoring solvency via either Nash competition or Cooperation reduces (increases) capital (labor) taxes significantly, and leaves countries with larger debt shocks preferring autarky.
While distribution conflicts over natural resources were central to the debates on a New International Economic Order, during the last decades the specific distribution conflicts surrounding natural resource exploitation no longer have been at the core of international law. In this paper I trace the developments in the relationship between international law and resource distribution conflicts. I first argue that the New International Economic Order favored the political resolution of distribution conflicts over natural resources and envisaged international distribution conflicts to be addressed by the political organs of international institutions within legal procedures Second, I show how the NIEO was surpassed by a different order that relied largely on the market as a distribution mechanism for raw materials and how international institutions and international law played a crucial role in the establishment of this order by promoting the privatization of natural resource exploitation and protecting foreign direct investment and trade. With reference to the copper industry in Zambia I thirdly illustrate how international investment law, and more broadly international economic law, is shaping (and affecting the resolution of) not only distribution conflicts between, but also within States. I conclude with a call for a renewed focus on an international law of resource conflicts to allow for their political resolution given the countermoves we can observe with respect to international investment law and the persistence of (violent) conflicts over natural resource exploitation within States.
Advertising arbitrage

Speculators often advertise arbitrage opportunities in order to persuade other investors and thus accelerate the correction of mispricing. We show that in order to minimize the risk and the cost of arbitrage an investor who identifies several mispriced assets optimally advertises only one of them, and overweights it in his portfolio; a risk-neutral arbitrageur invests only in this asset. The choice of the asset to be advertised depends not only on mispricing but also on its "advertisability" and accuracy of future news about it. When several arbitrageurs identify the same arbitrage opportunities, their decisions are strategic complements: they invest in the same asset and advertise it. Then, multiple equilibria may arise, some of which inefficient: arbitrageurs may correct small mispricings while failing to eliminate large ones. Finally, prices react more strongly to the ads of arbitrageurs with a successful track record, and reputation-building induces high-skill arbitrageurs to advertise more than others.
In this paper we investigate the implications of providing loan officers with a compensation structure that rewards loan volume and penalizes poor performance versus a fixed wage unrelated to performance. We study detailed transaction information for more than 45,000 loans issued by 240 loan officers of a large commercial bank in Europe. We examine the three main activities that loan officers perform: monitoring, originating, and screening. We find that when the performance of their portfolio deteriorates, loan officers increase their effort to monitor existing borrowers, reduce loan origination, and approve a higher fraction of loan applications. These loans, however, are of above-average quality. Consistent with the theoretical literature on multitasking in incomplete contracts, we show that loan officers neglect activities that are not directly rewarded under the contract, but are in the interest of the bank. In addition, while the response by loan officers constitutes a rational response to a time allocation problem, their reaction to incentives appears myopic in other dimensions.
Die Stellungnahme befasst sich mit einem wichtigen Aspekt der Offenlegung der Bezüge von Entscheidungsträgern im Bankensektor. Komplementär zu der Diskussion um die Veröffentlichung der Vergütung von Vorstandsmitgliedern börsennotierter Unternehmen ist auch auf Landeseben versucht worden, die Transparenz der Vergütung von Führungskräften kommunaler oder landeseigener Unternehmen zu erhöhen. Namentlich sind die Träger der Sparkassen durch den neuen § 19 Abs. 6 des Sparkassengesetzes von Nordrhein-Westfalen verpflichtet worden, darauf „hinzuwirken“, dass die „gewährten Bezüge jedes einzelnen Mitglieds des Vorstands, des Verwaltungsrates und ähnlicher Gremien unter Namensnennung“ veröffentlich werden. Diese Vorschrift ist jedoch weitgehend wirkungslos geblieben; nicht zuletzt weil das OLG Köln in einer einstweiligen Verfügung die Vorschrift mangels Gesetzgebungskompetenz des Landes als nichtig behandelt hat. In dieser Situation ist am 8. August 2013 der Vorschlag eines Gesetzes „zur Offenlegung der Bezüge von Sparkassenführungskräften im Internet“ durch die Fraktion der Piraten im Landtag Nordrhein-Westfalen eingebracht worden. Der Entwurf ist Gegenstand der Stellungnahme, die Helmut Siekmann für den Haushalts- und Finanzausschuss des Landtags Nordrhein-Westfalen erstellt hat. Sie stellt maßgebend darauf ab, dass die Sparkassen als Anstalten des öffentlichen Rechts einen öffentlichen Auftrag zu erfüllen haben und den Grundsätzen des Verwaltungsorganisationsrechts unterliegen. Als Teil der (leistenden) Verwaltung müssen sie Transparenz- und Kontrollansprüchen der Bürger und ihren Repräsentanten in den Parlamenten genügen.
In ‘Strafe für fremde Schuld’ Harald Maihold uncovered how a doctrine of surrogate punishment in the legal treatises of the Salamanca school gradually gave way to the principle of guilt. This meant that punishment eventually could only be inflicted upon a culprit and no longer upon an innocent. We will use René Girard’s philosophy of (the disruption of) scapegoat mechanisms and sacrifice to develop a coherent interpretation not only of how this institution of surrogate punishment functioned, how it selected its victims and the way it was legitimated, but also of the theology that formed its background. We argue that most of what surrogate punishment is about can be grasped in two words: sacrificial logic. The elimination of surrogation from criminal law would then correspond to the rejection of this logic, an evolution which could be interpreted as a desacralisation or secularisation of criminal law under the influence of the upcoming principle of guilt.
Gerichtliche und nicht gerichtliche Konfliktlösung in zivilrechtlichen Streitigkeiten – Deutschland

Das Arbeitspapier zeigt die Entwicklung des deutschen Zivilprozessrechts von der Preußischen Allgemeinen Gerichtsordnung von 1795 an bis zum aktuellen Zivilprozessrecht auf. Schwerpunkte sind die Rezeption des französischen Zivilprozessrechts von 1806, die Vereinheitlichung des deutschen Zivilprozessrechts durch die ZPO (1877/98) und die Prozessrechtsreformen der Weimarer Zeit und der NS-Zeit. Ausführlich behandelt wird die zivilprozessuale Reformdiskussion in der NS-Zeit (Akademie für Deutsches Recht; 1934-1943) und in der Frühzeit der Bundesrepublik Deutschland. Weitere Themen des Arbeitspapiers sind der (obligatorische) Güteversuch durch das Gericht, das schiedsrichterliche Verfahren, das außergerichtliche Güteverfahren vor einem Schiedsmann und die außergerichtliche Streitbeilegung durch Gütestellen und die Mediation (1980-2012).
Der Beitrag erwägt aus bibelhermeneutischer Perspektive, wie es zu unterschiedlichen Idealisierungen des alttestamentlichen Gemeinwesens im politischen Denken der Frühen Neuzeit kam. Dabei werden zunächst allgemeine Faktoren berücksichtigt, die eine biblische Orientierung im politischen Denken ausgehend von der Reformationszeit im 16. Jahrhundert erklärbar machen. Ein Überblick über betreffende Quellentitel des 16. und 17. Jahrhunderts zeigt, dass hierbei in allen größeren Konfessionen, wenn auch in unterschiedlicher Dichte, das Ideal des alttestamentlich-jüdischen Gemeinwesens eine Rolle spielte. Entlang zweier Fallbeispiele (François Ragueau, Petrus Cunaeus) werden dann konfessionelle und transkonfessionelle Aspekte unterschieden, um neue Perspektiven auf das Konfessionalisierungsparadigma und andere Modernisierungstheorien zu eröffnen.

Recent scholarship on late-scholastic thought has stressed a Jesuit discontinuity from Thomism. While Aquinas’ Aristotelian thesis located the political sphere in the state of innocence, Jesuit thought on community formation is said to have referred to ‘fallen’ and ‘pure’ nature. In this piece, I trace one particular narrative: In the hypothetical, lasting state of innocence (if original sin had not occurred), Aquinas identified the political community, but not the institution of the sacraments. Two celebrated Jesuit scholastics, Francisco Suárez and Rodrigo Arriaga, challenged the latter claim and defended the naturalness of spiritual alongside temporal power. This effectively allowed them to connect ‘nature’ to ‘utility’ and ‘necessity’ without tying their claims to the supernatural teleology. To them, the state of innocence remained relevant for politics, albeit in a way that challenged the Thomist account.
Bei altgriechischem Prozessrecht denkt man in erster Linie an das Prozessrecht des klassischen Athen, das aus den großen Gerichtsreden bestens bekannt ist; sie waren lange Zeit europäisches Bildungsgut. Zu Beginn des 19. Jahrhunderts, also vor ca. zweihundert Jahren, hat das klassische Griechenland den Anstoß gegeben, den Gemeinen Prozess zu reformieren: Die Geschworenengerichtsbarkeit und die Grundsätze des Parteienbetriebs, der Öffentlichkeit, Mündlichkeit, Unmittelbarkeit der Beweisaufnahme, der freien Beweiswürdigung sind schließlich in die heutigen Prozessordnungen eingeflossen, die nun auch schon über hundert Jahre alt und revisionsbedürftig sind. Vom heutigen Standpunkt aus wären für das klassische Athen einige historische Missverständnisse unserer wissenschaftlichen Vorgänger auszuräumen und das damalige Potential zur außergerichtlichen Konfliktlösung ins rechte Licht zu rücken. Umwälzend Neues ist den attischen Quellen nicht mehr zu entnehmen. Der Ablauf des Gerichtsverfahrens ist hinlänglich erforscht.
Beim Prozess der archaischen griechischen Polis dagegen sind die Dinge noch in Bewegung. Es ist erstaunlich, wie wenig wir über den Gang des gerichtlichen Verfahrens im archaischen Griechenland wissen und wie viel darüber geschrieben wird. Die Quellen (Homer, Hesiod, das Gesetz Drakons und weitere Inschriften, zahlreiche aus Kreta) geben nur knappe Ausschnitte aus einem uns verborgenen Gesamtbild. Insgesamt werfen die Quellen mehr Fragen auf als sie lösen. Das Gesamtbild ist nur durch kreative Phantasie, Vergleich mit anderen Rechtsordnungen oder — völlig unhistorisch und zumeist unbewusst — durch Projektion unserer heutigen Vorstellungen in das archaische Griechenland zu finden. Das Letzte suchen wir zu vermeiden…
Das Arbeitspapier zeigt Perspektiven eines Promotionsprojektes auf, das sich mit der Reform der englischen Common Law- und Equity-Gerichtsbarkeit im Viktorianischen Zeitalter befasst. Nach einem Einblick in relevante Quellen und Literatur wird inhaltlich auf Mitglieder und Aufgaben der im Jahr 1867 eingesetzten Judicature Commission eingegangen. Anschließend werden Neuerungen aufgezeigt, die für das englische Gerichtswesen aus den in den 1870er Jahren verabschiedeten Judicature Acts folgten.
Die Private Krankenversicherung ist explizit seit Einführung der Versicherungspflicht im Jahr 2008 neben der Gesetzlichen Krankenversicherung zweite Säule eines umfassenden Krankenversicherungsschutzes in Deutschland. Sie ist – auch schon traditionell – umfassend reguliert; Versichertenwettbewerb innerhalb der PKV aber auch zur GKV findet in entsprechend enger rechtlicher Strukturierung statt. In den letzten Jahren wird die PKV zudem auch immer stärker bei der Regulierung der Leistungserbringer berücksichtigt bzw. einbezogen. Der Beitrag gibt einen komprimierten Überblick über die Regulierung der PKV als Teil des Gesundheitssystems.
Emotions-at-risk: an experimental investigation into emotions, option prices and risk perception

This paper experimentally investigates how emotions are associated with option prices and risk perception. Using a binary lottery, we find evidence that the emotion ‘surprise’ plays a significant role in the negative correlation between lottery returns and estimates of the price of a put option. Our findings shed new light on various existing theories on emotions and affect. We find gratitude, admiration, and joy to be positively associated with risk perception, although the affect heuristic predicts a negative association. In contrast with the predictions of the appraisal tendency framework (ATF), we document a negative correlation between option price and surprise for lottery winners. Finally, the results show that the option price is not associated with risk perception as commonly used in psychology.
I analyze a critical illness insurance in a consumption-investment model over the life cycle. I solve a model with stochastic mortality risk and health shock risk numerically. These shocks are interpreted as critical illness and can negatively affect the expected remaining lifetime, the health expenses, and the income. In order to hedge the health expense effect of a shock, the agent has the possibility to contract a critical illness insurance. My results highlight that the critical illness insurance is strongly desired by the agents. With an insurance profit of 20%, nearly all agents contract the insurance in the working stage of the life cycle and more than 50% of the agents contract the insurance during retirement. With an insurance profit of 200%, still nearly all working agents contract the insurance, whereas there is little demand in the retirement stage.
I numerically solve realistically calibrated life cycle consumption-investment problems in continuous time featuring stochastic mortality risk driven by jumps, unspanned labor income as well as short-sale and liquidity constraints and a simple insurance. I compare models with deterministic and stochastic hazard rate of death to a model without mortality risk. Mortality risk has only minor effects on the optimal controls early in the life cycle but it becomes crucial in later years. A diffusive component in the hazard rate of death has no significant impact, whereas a jump component is desired by the agent and influences optimal controls and wealth evolution. The insurance is used to ensure optimal bequest such that there is no accidental bequest. In the absence of the insurance, the biggest part of bequest is accidental.
Efforts to control bank risk address the wrong problem in the wrong way. They presume that the financial crisis was caused by CEOs who failed to supervise risk-taking employees. The responses focus on executive pay, believing that executives will bring non-executives into line—using incentives to manage risk-taking—once their own pay is regulated. What they overlook is the effect on non-executive pay of the competition for talent. Even if executive pay is regulated, and executives act in the bank’s best interests, they will still be trapped into providing incentives that encourage risk-taking by non-executives due to the negative externality that arises from that competition. Greater risk-taking can increase short-term profits and, in turn, the amount a non-executive receives, potentially at the expense of long-term bank value. Non-executives, therefore, have an incentive to incur significant risk upfront so long as they can depart for a new employer before any losses materialize. The result is an upward spiral in compensation—reducing an executive’s ability to set non-executive pay and the ability of any one bank to adjust compensation to reflect risk-taking and long-term outcomes. New regulation must address the tension between compensation and competition. Regulators should take account of the effect of competition on market-wide levels of pay, including by non-banks who compete for talent. The ability of non-executives to jump from a bank employer to another financial firm should also be limited. In addition, banks should be required to include a long-term equity component in non-executive pay, with subsequent employers being restricted from compensating a new employee for any losses she incurs related to her prior work.
Das pragmatische Verhältnis des Lübecker Rats zum kaiserlichen Recht im Mittelalter und in der frühen Neuzeit ist das Thema des Aufsatzes. Anhand von acht Fallstudien lässt sich zeigen, wie flexibel der Rat, der zugleich das wichtigste Gericht für die rund hundert nach lübischem Recht lebenden Städte im Ostseeraum war, mit dieser eigentlich übergeordneten, da vom kaiserlichen Stadtherren der Reichsstadt gesetzten Rechtsordnung umging. Auch plakative Stellungnahmen gegen das angeblich mit dem Charakter der Stadt nicht vereinbare römische Recht sind nicht wirklich grundsätzlich gemeint. Ihre gelegentlich vorgeschlagene Interpretation im Sinne einer fundamentalen Ablehnung fremden Rechts in Norddeutschland ist deshalb verfehlt.
Wettbewerbsrecht der GKV

Seit inzwischen 20 Jahren führt der Gesetzgeber in die Binnenordnung der Gesetzlichen Krankenversicherung Wettbewerbselemente ein. Ausgangspunkt ist die Kassenwahlfreiheit der Versicherten. Die Krankenkassen agieren dadurch immer stärker als Wettbewerber um Versicherte. Seit einigen Jahren ist der Rechtsrahmen dieses Wettbewerbs in der Diskussion und auch prozessual und politisch umstritten. Inwieweit das allgemeine Kartellrecht, konkret die Fusionskontrolle, oder das allgemeine Lauterkeitsrecht Anwendung finden soll, ist noch nicht abschließend geklärt. Weniger grundsätzliche Probleme bereitet hingegen das Vergaberecht. Der Beitrag beschreibt die sich im Fluss befindliche Rechtsgrundlage des GKV-Wettbewerbsrechts in ihrer bisherigen Entwicklung und auf dem Stand von 2013.
Der Deutsche Juristentag 2012 ließ begutachten, wie der Wettbewerb in der Gesetzlichen Krankenversicherung zu regeln sei. Der vorliegende Beitrag ist als Begleitaufsatz hierzu erschienen. Er spürt den Motiven des Gesetzgebers und den theoretischen und konzeptionellen Gründen für Wettbewerb nach, um daraus Antworten auf die Frage nach der Wettbewerbsregulierung im Gesundheitswesen zu entwickeln. Sein Ergebnis ist, dass die spezifische Funktion von Wettbewerb innerhalb des sozialrechtlichen Krankenversicherungssystems ein spezifisches Regulierungsrecht erfordert. Dies ist gegenüber einer generellen Zuordnung dieses Sozialsystems zum allgemeinen Wettbewerbs- und Kartellrecht vorzugswürdig. Außerdem wird die Zuordnung zu den Sozialgerichten befürwortet.
Im Jahr 2005 entschied das Bundesverfassungsgericht, dass die bestehenden Regelungen im Versicherungsvertrags- und Versicherungsaufsichtsgesetz zur Überschussbeteiligung in der Lebensversicherung den Anforderungen des Grundgesetzes nicht genügen. Denn sie sicherten die Ansprüche der Versicherten nicht angemessen gegen einseitige Gestaltungsmöglichkeiten der Versicherer ab. Nach dem Urteil änderte der Gesetzgeber die einschlägigen Regelungen, insbesondere erließ die Bundesanstalt für Finanzdienstdienstleistungsaufsicht BAFin eine neue Mindestzuführungsverordnung. Der Beitrag untersucht die Rechtslage auf dem Stand von April 2012 daraufhin, ob nun den Anforderungen des Bundesverfassungsgerichts genüge getan wird. Er kommt zu dem Ergebnis, dass dies nicht der Fall ist.
Banks' financial distress, lending supply and consumption expenditure : [version december 2013]

The paper employs a unique identification strategy that links survey data on household consumption expenditure to bank level data in order to estimate the effects of bank financial distress on consumer credit and consumption expenditures. Specifically, we show that households whose banks were more exposed to funding shocks report significantly lower levels of non-mortgage liabilities compared to a matched sample of households. The reduced access to credit, however, does not result in lower levels of consumption. Instead, we show that households compensate by drawing down liquid assets. Only households without the ability to draw on liquid assets reduce consumption. The results are consistent with consumption smoothing in the face of a temporary adverse lending supply shock. The results contrast with recent evidence on the real effects of finance on firms' investment, where even temporary adverse credit supply shocks are associated with significant real effects.
How much additional tax revenue can the government generate by increasing labor income taxes? In this paper we provide a quantitative answer to this question, and study the importance of the progressivity of the tax schedule for the ability of the government to generate tax revenues. We develop a rich overlapping generations model featuring an explicit family structure, extensive and intensive margins of labor supply, endogenous accumulation of labor market experience as well as standard intertemporal consumption-savings choices in the presence of uninsurable idiosyncratic labor productivity risk. We calibrate the model to US macro, micro and tax data and characterize the labor income tax Laffer curve under the current choice of the progressivity of the labor income tax code as well as when varying progressivity. We find that more progressive labor income taxes significantly reduce tax revenues. For the US, converting to a flat tax code raises the peak of the Laffer curve by 6%, whereas converting to a tax system with progressivity similar to Denmark would lower the peak by 7%. We also show that, relative to a representative agent economy tax revenues are less sensitive to the progressivity of the tax code in our economy. This finding is due to the fact that labor supply of two earner households is less elastic (along the intensive margin) and the endogenous accumulation of labor market experience makes labor supply of females less elastic (around the extensive margin) to changes in tax progressivity.
This paper investigates the impact of news media sentiment on financial market returns and volatility in the long-term. We hypothesize that the way the media formulate and present news to the public produces different perceptions and, thus, incurs different investor behavior. To analyze such framing effects we distinguish between optimistic and pessimistic news frames. We construct a monthly media sentiment indicator by taking the ratio of the number of newspaper articles that contain predetermined negative words to the number of newspaper articles that contain predetermined positive words in the headline and/or the lead paragraph. Our results indicate that pessimistic news media sentiment is positively related to global market volatility and negatively related to global market returns 12 to 24 months in advance. We show that our media sentiment indicator reflects very well the financial market crises and pricing bubbles over the past 20 years.
The record-breaking prices observed in the art market over the last three years raise the question of whether we are experiencing a speculative bubble. Given the difficulty to determine the fundamental value of artworks, we apply a right-tailed unit root test with forward recursive regressions (SADF test) to detect explosive behaviors directly in the time series of four different art market segments (“Impressionist and Modern”, “Post-war and Contemporary”, “American”, and “Latin American”) for the period from 1970 to 2013. We identify two historical speculative bubbles and find an explosive movement in today’s “Post-war and Contemporary” and “American” fine art market segments.
This paper solves a dynamic model of households' mortgage decisions incorporating labor income, house price, inflation, and interest rate risk. It uses a zero-profit condition for mortgage lenders to solve for equilibrium mortgage rates given borrower characteristics and optimal decisions. The model quantifies the effects of adjustable vs. fixed mortgage rates, loan-to-value ratios, and mortgage affordability measures on mortgage premia and default. Heterogeneity in borrowers' labor income risk is important for explaining the higher default rates on adjustable-rate mortgages during the recent US housing downturn, and the variation in mortgage premia with the level of interest rates.
his paper distils three lessons for bank regulation from the experience of the 2009-12 euro-area financial crisis. First, it highlights the key role that sovereign debt exposures of banks have played in the feedback loop between bank and fiscal distress, and inquires how the regulation of banks’ sovereign exposures in the euro area should be changed to mitigate this feedback loop in the future. Second, it explores the relationship between the forbearance of non-performing loans by European banks and the tendency of EU regulators to rescue rather than resolving distressed banks, and asks to what extent the new regulatory framework of the euro-area “banking union” can be expected to mitigate excessive forbearance and facilitate resolution of insolvent banks. Finally, the paper highlights that capital requirements based on the ratio of Tier-1 capital to banks’ risk-weighted assets were massively gamed by large banks, which engaged in various forms of regulatory arbitrage to minimize their capital charges while expanding leverage. This argues in favor of relying on a set of simpler and more robust indicators to determine banks’ capital shortfall, such as book and market leverage ratios.
From the late middle ages to early modern times (ca. 1200-1600) the Lübeck City Council was the most important courthouse in the Baltic. About 100 cities and towns on its shores lived according to the law of Lübeck. The paper deals with the old theory that Imperial law, i.e. mainly the learned Ius commune, was generally rejected by the council on the grounds of its foreign nature. The paper rejects this view with the help of 8 case studies. There exist rather spectacular statements against Imperial Law, but a closer look reveals that they have to be seen in the light of a specific practical context. They must not be confounded with general statements in which the council had no interest. Its attitude towards Learned Law was flexible and purely pragmatic.
Der vorliegende Beitrag ist eine Qualifikationsschrift im Bachelor-Studiengang Japanologie und versucht mittels kulturwissenschaftlicher Methoden eine Bestandsaufnahme der Aktivitäten städtischer Gärtner sowie der Nachhaltigkeitsstrategien in Tôkyô vorzunehmen.
Anhand der empirischen Auswertung von stadtpolitischen Nachhaltigkeitspapieren, Stellungnahmen eines Guerilla-Gärtners und Blogeinträgen einer Stadtfarmerin soll verdeutlicht werden, wie die einzelnen Akteure Stadt verstehen und diese durch ihre Praktiken konstruieren. Ziel ist es zu ermitteln, inwiefern Urban Gardening als Symptom für politische und gesellschaftliche Wandlungen verstanden werden kann.
Im Mai 2013 hat das japanische Parlament den Beitritt zum Haager Übereinkommen über die zivilrechtlichen Aspekte internationaler Kindesentführungen von 1980 beschlossen.
Dieses regelt das Verfahren, mit dem ein Kind nach einer Verbringung in einen anderes Land (z.B. durch einen Elternteil) gegen den Willen des Sorgeberechtigten wieder in das Land seines gewöhnlichen Aufenthaltes zurückgeführt wird. Die bisherige Handhabung Japans von internationalen Kindesentführungen führte zu starker Kritik aus dem Ausland.
Die Verfahren dauerten zu lange, so dass Fakten geschaffen wurden. Die japanische Rechtsprechung förderte indirekt die Entführung durch einen Elternteil und die Vollstreckung einer im Ausland erwirkten Rückführungsanordnung gestaltete sich schwierig.
Diese Arbeit versucht aufzuweisen, welche Umstände zu der Zurückhaltung der japanischen Regierung führten. Ein wichtiger Punkt hierbei ist, inwieweit eine Anpassung des inländischen Rechts für den Beitritt erforderlich ist. Formal ist eine Anpassung nicht nötig, allerdings führen Unterschiede im Rechtssystem zu Problemen in der Ausführung. Das japanische Familienrecht kennt z.B. im Gegensatz zu anderen Mitgliedsländern nach der Scheidung nur die alleinige Sorge. Auch das Recht auf Umgang ist nicht konkret geregelt.
Außerdem kommen Verbringungen innerhalb einer Familie bei einer drohenden Scheidung in Japan regelmäßig vor. Diese werden jedoch von den Gerichten nicht negativ gewertet.
Die Einführung einer kritischeren Bewertung von Verbringungen auf internationaler Ebene würde zu einer Diskrepanz mit den rein nationalen Fällen führen. Weitere Problematiken sind die Frage nach der strafrechtlichen Verfolgung der Verbringer sowie die Abwägung zwischen dem Prinzip der schnellen Rückführung und der Einschätzung des Kindeswohls.
Für eine Wirkungsabschätzung der forcierten Einführung von Gewächshäusern wurde eine Potenzial- und Restriktionsanalyse aufbauend auf einer Literaturrecherche durchgeführt. Grundsätzlich gestattet der Gewächshausanbau unter den in Vorderasien häufigen ariden und semi-ariden Situationen trotz erheblicher Intensitätssteigerung eine deutliche Verringerung des Wassereinsatzes.
Es sind Lösungsansätze vorhanden, die dazu beitragen können, dort positive Entwicklungspotenziale zu entfalten und die negativen Entwicklungen zu verhindern. Dennoch ist das Gewächshaus kein Allheilmittel. Insbesondere die Vermittlung bzw. regionale Anpassung von Wissen (auch zum Pflanzenschutz), der Erhalt geeigneter Sorten und der Zugang der Landwirte zu diesen sind starke Hemmnisse. Flankierende staatliche und private Fördermaßnahmen sowie neue institutionelle Arrangements bzw. Governancestrukturen erlauben, nachteilige Entwicklungen zu vermeiden und den Erhalt von Ökosystemleistungen zu fördern.
Partizipative Szenarioverfahren werden vielfach in der Nachhaltigkeitsforschung angewendet. Zu den Vorteilen zählen: Praxiswissen macht die Zukunftsbilder robuster, strategisches Denken wird gefördert, ein kreativer Diskussionsrahmen entsteht. Nur wie werden narrative Szenarien im transdisziplinären Kontext entwickelt?
Die vorliegende Arbeit versteht sich als differenzierte methodische Beschreibung. Der Erfahrungsbericht legt am Beispiel des BMBF-Forschungsprojektes „SAUBER+: Innovative Konzepte und Technologien für die separate Behandlung von Abwasser aus Einrichtungen des Gesundheitswesens“ die einzelnen Arbeitsschritte der Szenarioentwicklung offen und diskutiert ihren Stellenwert. Inflation differentials in the euro area have been persistent since the adoption of the single currency. This paper analyzes the impact of product and labor market regulation on inflation in a sample of 11 countries. The results show that, after the adoption of the euro, product market deregulation has a relevant and significant effect on the level of inflation, while higher labor market regulation increases the responsiveness of inflation to the output gap.
This paper investigates the determinants of value and growth investing in a large administrative panel of Swedish residents over the 1999-2007 period. We document strong relationships between a household’s portfolio tilt and the household’s financial and demographic characteristics. Value investors have higher financial and real estate wealth, lower leverage, lower income risk, lower human capital, and are more likely to be female than the average growth investor. Households actively migrate to value stocks over the life-cycle and, at higher frequencies, dynamically offset the passive variations in the value tilt induced by market movements. We verify that these results are not driven by cohort effects, financial sophistication, biases toward popular or professionally close stocks, or unobserved heterogeneity in preferences. We relate these household-level results to some of the leading explanations of the value premium.
This paper empirically tests the role of bank lending tightening on non-financial corporate (NFC) bond issuance in the eurozone. By utilizing a unique data set provided by the ECB Bank Lending Survey, we capture the "pure" credit supply effect on corporate external financing. We find that tightened credit standards positively affect the NFC bond issuance: A 1pp increase in banks reporting considerable tightening on loans leads to around a 7% increase in firms' bond issuance in the eurozone. Focusing on a spectrum of aspects contributing to bank credit tightening, we document that banks' balance sheet constraints, as well as the perception of risk lead to significantly higher NFC bond issuance. In addition, we show that stricter lending conditions, such as wider margins, higher collateral requirements and covenants significantly increase NFC bond issuance volumes too. Furthermore, the impact of bank credit tightening on firms' bond issuance is particularly observable in core eurozone countries and not in peripheral countries. This is partially due to the underdeveloped of debt capital markets in the peripheral countries.
This is a chapter for a forthcoming volume Oxford Handbook of Financial Regulation (Oxford University Press 2014) (eds. Eilís Ferran, Niamh Moloney, and Jennifer Payne). It provides an overview of EU financial regulation from the first banking directive up until its most recent developments in the aftermath of the financial crisis, focusing on the multiple layers of multi-level governance and their characteristic conceptual difficulties. Therefore the paper discusses the need to accommodate cross-border capital flows following from the EU internal market and the resulting regulatory strategies. This includes a brief overview of the principle of home country control and the ensuing Financial Services Action Plan. Dealing with the accommodation of cross-border capital flows and their regulation necessarily require an orchestration of the underlying supervisory structures, which is therefore also discussed. In the aftermath of the financial crisis of 2007-09 an additional aspect of necessary orchestration has emerged, that is the need to control systemic risk. Specific attention is paid to microprudential supervision by the newly established European Supervisory Authorities and macroprudential supervision in the European Banking Union, the latter’s underlying drivers and the accompanying Single Supervisory Mechanism, including the SSM’s institutional framework as well as the consideration of its rationales and the Single Resolution Mechanism closely linked to it.
The implications of delegating fiscal decision making power to sub-national governments has become an area of significant interest over the past two decades, in the expectation that these reforms will lead to better and more efficient provision of public goods and services. The move towards decentralization has, however, not been homogeneously implemented on the revenue and expenditure side: decentralization has materialized more substantially on the latter than on the former, creating "vertical fiscal imbalances". These imbalances measure the extent to which sub-national governments’ expenditures are financed through their own revenues. This mismatch between own revenues and expenditures may have negative consequences for public finances performance, for example by softening the budget constraint of sub-national governments. Using a large sample of countries covering a long time period from the IMF’s Government Finance Statistics Yearbook, this paper is the first to examine the effects of vertical fiscal imbalances on fiscal performance through the accumulation of government debt. Our findings suggest that vertical fiscal imbalances are indeed relevant in explaining government debt accumulation, and call for a degree of caution when promoting fiscal decentralization.
We investigate the relationship between anchoring and the emergence of bubbles in experimental asset markets. We show that setting a visual anchor at the fundamental value (FV) in the first period only is sufficient to eliminate or to significantly reduce bubbles in laboratory asset markets. If no FV-anchor is set, bubble-crash patterns emerge. Our results indicate that bubbles in laboratory environments are primarily sparked in the first period. If prices are initiated around the FV, they stay close to the FV over the entire trading horizon. Our insights can be related to initial public offerings and the interaction between prices set on pre-opening markets and subsequent intra-day price dynamics.
Banks can deal with their liquidity risk by holding liquid assets (self-insurance), by participating in interbank markets (coinsurance), or by using flexible financing instruments, such as bank capital (risk-sharing). We use a simple model to show that undiversifiable liquidity risk, i.e. the liquidity risk that banks are unable to coinsure on interbank markets, represents an important risk factor affecting their capital structures. Banks facing higher undiversifiable liquidity risk hold more capital. We posit that empirically banks that are more exposed to undiversifiable liquidity risk are less active on interbank markets. Therefore, we test for the existence of a negative relationship between bank capital and interbank market activity and find support in a large sample of U.S. commercial banks.
Especially in developing countries credit constraints are often perceived as one of the most important market frictions constraining firm innovation and growth. Huge amounts of public money are being devoted to the removal of such constraints but their effectiveness is still subject to an intense policy debate. This paper contributes to this debate by analysing the effects of the Brazilian Development Bank (BNDES) loans. It finds that, before receiving BNDES support, granted firms are indeed more credit constrained than comparable non-granted firms. It also finds that BNDES support allows granted firms to achieve the same level of performance as similar non-granted firms that are not credit constrained. However, it does not allow granted firms to outperform similar non-granted ones.
This country report was prepared for the 19th World Congress of the International Academy of Comparative Law in Vienna in 2014. It is structured as a questionnaire and provides an overview of the legal framework for Free and Open Source Software (FOSS) and other alternative license models like (e.g.) Creative Commons under German law. The first set of questions addresses the applicable statutory provisions and the reported case law in this area. The second section concerns contractual issues, in particular with regard to the interpretation and validity of open content licenses. The third section deals with copyright aspects of open content models, for example regarding revocation rights and rights to equitable remuneration. The final set of questions pertains to patent, trademark and competition law issues of open content licenses.
This chapter discusses whether and how 'new quantitative trade models' (NQTMs) can be fruitfully applied to quantify the welfare effects of trade liberalization, thus shedding light on the trade-related effects of further European integration. On the one hand, it argues that NQTMs have indeed the potential of being used to supplement traditional 'computable general equilibrium' (CGE) analysis thanks to their tight connection between theory and data, appealing micro-theoretical foundations, and enhanced attention to the estimation of structural parameters. On the other hand, further work is still needed in order to fully exploit such potential.
Consumption-based asset pricing with rare disaster risk : a simulated method of moments approach

The rare disaster hypothesis suggests that the extraordinarily high postwar U.S. equity premium resulted because investors ex ante demanded compensation for unlikely but calamitous risks that they happened not to incur. Although convincing in theory, empirical tests of the rare disaster explanation are scarce. We estimate a disaster-including consumption-based asset pricing model (CBM) using a combination of the simulated method of moments and bootstrapping. We consider several methodological alternatives that differ in the moment matches and the way to account for disasters in the simulated consumption growth and return series. Whichever specification is used, the estimated preference parameters are of an economically plausible size, and the estimation precision is much higher than in previous studies that use the canonical CBM. Our results thus provide empirical support for the rare disaster hypothesis, and help reconcile the nexus between real economy and financial markets implied by the consumption-based asset pricing paradigm.
In this paper we argue that very high marginal labor income tax rates are an effective tool for social insurance even when households have preferences with high labor supply elasticity, make dynamic savings decisions, and policies have general equilibrium effects. To make this point we construct a large scale Overlapping Generations Model with uninsurable labor productivity risk, show that it has a wealth distribution that matches the data well, and then use it to characterize fiscal policies that achieve a desired degree of redistribution in society. We find that marginal tax rates on the top 1% of the earnings distribution of close to 90% are optimal. We document that this result is robust to plausible variation in the labor supply elasticity and holds regardless of whether social welfare is measured at the steady state only or includes transitional generations.
