Die Hauptthese dieser Dissertation ist, dass Nord-Sotho keinen obligatorischen Gebrauch von grammatischen Mitteln zur Markierung von Fokus macht, weder in der Syntax noch in der Prosodie oder Morphologie. Trotzdem strukturiert diese Sprache eine Äußerung nach informationsstrukturellen Aspekten. Konstituenten, die im Diskurs gegeben sind, werden entweder getilgt, pronominalisiert oder an den rechten oder linken Satzrand versetzt. Diese (morpho-)syntaktischen Prozesse wirken so zusammen, dass die fokussierte Konstituente oft final in ihrem Teilsatz erscheint. Obwohl die finale Position keine designierte Fokusposition ist, ist das Wissen um diese Tendenz doch entscheidend für das Verständnis einer morphologischen Alternation, die in Nord-Sotho am Verb erscheint und die in der Literatur im Zusammenhang mit Fokus diskutiert wurde.
Obwohl also ein direkter grammatischer Ausdruck von formaler F(okus)-Markierung im Nord-Sotho fehlt, ist F-Markierung trotzdem entscheidend für die Grammatik dieser Sprache: Fokussierte logische Subjekte können nicht in kanonischer präverbaler Position erscheinen. Sie erscheinen stattdessen entweder postverbal oder in einem Spaltsatz, abhängig von der Valenz des Verbs. Obwohl Nord-Sotho bei Objekten im Gebrauch von Spaltsätzen eine Korrespondenz von komplexer Form mit komplexer Bedeutung zeigt, gilt diese Korrespondenz nicht für logische Subjekte.
Die vorliegende Dissertation modelliert die oben genannten Ergebnisse im theoretischen Rahmen der Optimalitätstheorie (OT). Syntaktischer in situ Fokus und die Abwesenheit von prosodischer Fokusmarkierung können mit unkontroversen Beschränkungen erfasst werden. Für die Ungrammatikaliät fokussierter logischer Subjekte in präverbaler Position schlägt die vorliegende Arbeit die Modifizierung einer in der Literatur vorhandenen Beschränkung vor, die in Nord-Sotho von entscheidener Bedeutung ist. Die Form-Bedeutungs-Korrespondenz wird, wie andere Phänomene pragmatischer Arbeitsteilung auch, innerhalb der schwach bidirektionalen Optimalitätstheorie behandelt.
One of the dangers of harmonisation and unification processes taking place within the framework of the EU is that they may result in the codification of the lowest common denominator. This is precisely what is threatening to happen in respect of assignment. Referring the transfer of receivables by way of assignment to the law of the assignor’s residence, as article 13 of the Proposal does, would be opting for the most conservative solution and would for many Member States be a step backward rather than forward. A conflict rule referring assignment to the law of the assignor's residence is too rigid to do justice to the dynamic nature of assignments in cross-border transactions and it is unjustly one-sided. It offers no real advantages when compared to other conflict rules; it even has serious disadvantages which make the conflict rule unsuitable for efficient assignment-based cross-border transactions. It is not unconceivable that this conflict rule would even be contrary to the fundamental freedoms of the ECTreaty. The Community legislators in particular should be careful not to needlessly adopt rules which create insurmountable obstacles for cross-border business where choice-of-law by the parties would perfectly do. Community legislation has a special responsibility to create a smooth legal environment for single market transactions.
We study the problem of a policymaker who seeks to set policy optimally in an economy where the true economic structure is unobserved, and policymakers optimally learn from their observations of the economy. This is a classic problem of learning and control, variants of which have been studied in the past, but little with forward-looking variables which are a key component of modern policy-relevant models. As in most Bayesian learning problems, the optimal policy typically includes an experimentation component reflecting the endogeneity of information. We develop algorithms to solve numerically for the Bayesian optimal policy (BOP). However the BOP is only feasible in relatively small models, and thus we also consider a simpler specification we term adaptive optimal policy (AOP) which allows policymakers to update their beliefs but shortcuts the experimentation motive. In our setting, the AOP is significantly easier to compute, and in many cases provides a good approximation to the BOP. We provide a simple example to illustrate the role of learning and experimentation in an MJLQ framework. JEL Classification: E42, E52, E58
It is often claimed that decentralisation is effective for the reduction of poverty due to inherent opportunities for higher popular participation and increased efficiency in public service delivery. This paper is a qualitative assessment of the potential of the Ugandan decentralisation reform for poverty alleviation. The Ugandan government initiated an ambitious decentralisation reform in 1992, which represents an example of full-fledged devolution with the transfer of far-reaching responsibilities to local governments. However, several shortcomings, such as low levels of accountability, insufficient human and financial resources, corruption, patronage, and central resistance to decentralisation, constrain the proper implementation of the reform, putting improvements in participation and efficiency at risk and ultimately jeopardising the intended impact on poverty.
In Ergänzung zu einem vorangegangenen Projekt (Schönwiese et al., 2005) ist in der vorliegenden Studie eine weitere extremwertstatistische Untersuchung durchgeführt worden. Dazu wurden auf der Basis von täglichen Klimadaten aus Hessen und Umgebung (49°N bis 52°N, 7°O bis 11°O), und zwar der Temperatur von 53 Stationen und des Niederschlages von 84 Stationen, Schwellen extremer Werte definiert, um die Anzahl der Über- bzw. Unterschreitungen dieser Schwellen auf signifikante Trends hin zu untersuchen. Bei der Temperatur findet sich dabei eine systematische Zunahme von Hitzetagen (Maximumtemperatur über 30 °C) im August, wohingegen im Juli fast keine, und im Juni nur vereinzelt signifikante Zunahmen von Hitzetagen gefunden wurden. Hierbei zeigt sich, wie auch bei anderen Temperatur-Schwellen eine Abnahme der Signifikanz mit zunehmender Schwellenhöhe, was durch selteneres Auftreten besonders extremer Ereignisse verursacht wird. Im Winter und Frühjahr hat entsprechend die Anzahl der Frost- bzw. Eistage (Minimum- bzw. Maximumtemperatur unter 0 °C) signifikant abgenommen. Besonders ausgeprägt ist dies für die Frosttage im Frühling der Fall. Beim Niederschlag hat im Sommer, wiederum vor allem im August, die Anzahl von Trockentagen zugenommen. Extrem hohe Niederschlagssummen sind dagegen in dieser Jahreszeit seltener geworden, in den anderen Jahreszeiten jedoch häufiger. Vor allem der März zeichnet sich durch verbreitet hochsignifikante Zunahmen von Tagen mit Starkniederschlägen aus. Die Erhaltungsneigung von besonders warmen bzw. kalten Witterungen hat sich in den meisten Monaten nicht signifikant verändert. Es ist jedoch eine Neigung zu kürzeren relativ einheitlichen Witterungsabschnitten im Februar und März, sowie zu längeren im Oktober und November zu beobachten. Diese Ergebnisse sind jedoch vermutlich nicht sehr robust, da sich bei einer Verkürzung des Zeitfensters der Autokorrelationsfunktion die Signifikanzen teilweise (vor allem im April) deutlich verändern. Bei den Trends der Zahl der Trockenperioden erkennt man im Sommer einen positiven Trend; sie nehmen somit zu. Dies gilt sowohl für die 7-tägigen als auch für die 11-tägigen Trockenperioden. Die übrigen Jahreszeiten zeigen bei den 7-tägigen Trockenperioden nur schwache oder negative Trends. Bei den 11-tägigen Trockenperioden gilt dies nur für das Frühjahr und den Herbst, im Winter sind die Trends im Norden überwiegend positiv, im Süden negativ. Betrachtet man die Länge der längsten Trockenperioden, so nimmt diese im Sommer zu, im Frühjahr und im Gesamtjahr jedoch ab. Im Herbst ist das Bild uneinheitlich; dies kann aber auch daran liegen, dass lange sommerliche Trockenperioden in den Herbst hineinreichen und dann dort gezählt werden. Ein weiterer Aspekt ist die Analyse der Anzahl und Länge bestimmter Witterungsabschnitte (Clusteranalyse), die durch relativ hohe oder tiefe Temperatur bzw. relativ wenig bzw. viel Niederschlag definiert sind. So können beispielsweise Tage mit weniger als 1 mm Niederschlag als Trockencluster bezeichnet werden. Dabei erkennt man im Sommer einen Trend zu mehr Trockenclustern,in Übereinstimmung mit den oben genannten Ergebnissen, in den übrigen Jahreszeiten und im Gesamtjahr jedoch einen Trend zu weniger Trockenclustern. Innerhalb des Sommers ist dieser Trend im August am stärksten, in den übrigen Jahreszeiten im März, Oktober und Dezember. Bei den Clustern von Feuchteereignissen, das heißt Tagen mit relativ viel Niederschlag, ist das Bild umgekehrt. Im Sommer nimmt deren Zahl ab, ansonsten nimmt sie zu. Die stärksten Trends sind dabei wiederum im August (Abnahme) bzw. im März, Oktober und Dezember (jeweils Zunahme) zu erkennen. Alle diese Trends werden im der Regel umso schwächer, je höher die Schranke der Niederschlagsmenge gewählt wird. Bei den Temperaturdaten sind die Trends von Frost- und Eistagen nur im November überwiegend positiv, in allen Wintermonaten (Dezember, Januar und Februar) jedoch fast ausschließlich negativ. Darin spiegelt sich somit der Trend zu höheren Temperaturen wider. Bei den Wärmeclustern ändern sich die Trends mit der Höhe der Schranke. Bei der Schranke von 25°C zeigen der Juli, insbesondere aber der August positive Trends. Bei der 30°C-Schranke bleibt der Augusttrend positiv, der Julitrend wird dagegen negativ. Bei der Schranke von 35°C werden die Augusttrends dann deutlich geringer, während die Julitrends, wenn auch schwächer ausgeprägt, negativ bleiben. Die Trends im Juni sind dagegen insgesamt schwach. Betrachtet man die Signifikanz der Trends, so sind insbesondere die Trends bei hohen Schranken weniger signifikant. Dies gilt für die hohen Niederschlagschranken (20mm, 30mm, 95%-Perzentil, 99%-Perzentil) ebenso wie für die hohen Temperaturschranken (30°C, 35°C). Weiterhin ist die Signifikanz dann niedrig, wenn die Zahl der Cluster im betrachteten Zeitraum klein ist. In Monaten und Jahreszeiten, in denen nur wenige Cluster auftreten, ist der Trend der Zahl der Cluster meist nicht signifikant. Insgesamt zeigen beim Niederschlag die untere Schranke von 1mm sowie die oberen Schranken von 10mm und 90% die signifikantesten Trends. Bei den Temperaturdaten ist das bei den Frosttagen generell, bei den Eistagen im Januar und Februar sowie bei den sommerlichen Clustern mit einer Tagesmaximumtemperatur von über 25°C der Fall (mit zum Teil über 95% bzw. 99% Signifikanz).
The paper constructs a global monetary aggregate, namely the sum of the key monetary aggregates of the G5 economies (US, Euro area, Japan, UK, and Canada), and analyses its indicator properties for global output and inflation. Using a structural VAR approach we find that after a monetary policy shock output declines temporarily, with the downward effect reaching a peak within the second year, and the global monetary aggregate drops significantly. In addition, the price level rises permanently in response to a positive shock to the global liquidity aggregate. The similarity of our results with those found in country studies might supports the use of a global monetary aggregate as a summary measure of worldwide monetary trends. JEL Classification: E52, F01
We analyse a 2-period competitive insurance market which is characterized by the simultaneous presence of standard moral hazard and adverse selection with regard to consumer time preferences. It is shown that there exists an equilibrium in which patient consumers use high effort and buy a profit-making insurance contract with high coverage, whereas impatient consumers use low effort and buy a contract with low coverage or even remain uninsured. This finding may help to explain why positive profits and the opposite of adverse selection with regard to risk types can sometimes be observed empirically. JEL Classification: D82, G22
Following the neopatrimonialism paradigm, it can be hypothesised that in African states informal politics of the rulers infringe on the collection of taxes and in turn reduce state revenues. This article tests this proposition for the case of Zambia. The main finding is that there is no linear correlation between a neopatrimonial system and the collection of taxes. Neopatrimonial continuity in the country is evidenced by three factors; the concentration of political power, the award of personal favours and the misuse of state resources. Despite this continuity, the revenue performance has increased considerably with the creation of the semi-autonomous Zambia Revenue Authority. This demonstrates that the effect of neopatrimonialism on public policy in the African state is highly context-specific and dependent on the interaction with additional variables. Donor pressure has been the most important in the Zambian case. In order to apply neopatrimonialism for further empirical work on public policy in the African state, these additional variables have to be incorporated into the analysis.
The worldwide diffusion of the good governance agenda and new public management has triggered a renewed focus on state capability and, more specifically, on the capability to raise revenue in developing countries. However, the analytical tools for a comprehensive understanding of the capability to raise revenue remain underdeveloped. This article aims at filling this gap and presents a model consisting of the three process dimensions ‘information collection and processing’, ‘merit orientation’ and ‘administrative accountability’. ‘Revenue performance’ constitutes the fourth capability dimension which assesses tax administration’s output. This model is applied to the case of the Zambia Revenue Authority. The dimensions prove to be valuable not only for assessing the how much but also the how of collecting taxes. They can be a useful tool for future comparative analyses of tax administrations’ capabilities in developing countries.
Das 2. UmwG-ÄndG bringt hinsichtlich der grenzüberschreitenden Verschmelzung einen erheblichen Gewinn an Rechtssicherheit. Weil die §§ 122a ff. UmwG-E weitgehend eine getreue Umsetzung der IntVRiL darstellen, werden künftige transnationale Verschmelzungen erleichtert; dies jedenfalls dann, wenn auch die anderen EU-Mitgliedstaaten die Richtlinie alsbald umsetzen. Anders als bei innerstaatlichen Verschmelzungen sind die für die Arbeitnehmer wesentlichen Informationen nicht im Verschmelzungsvertrag bzw. -plan, sondern im Verschmelzungsbericht enthalten. Dementsprechend ist dieser nicht verzichtbar. Sofern ein Verhandlungsverfahren über die künftige Mitbestimmung nach MgVG stattfindet, können sich die Anteilseigner die Bestätigung der dort erzielten Ergebnisse vorbehalten (§ 122g Abs. 1 UmwG-E), wenn die Verhandlungen im Zeitpunkt der Zustimmung zur Verschmelzung noch nicht beendet sind. Für die Bestätigung können andere Beschlussmodalitäten vorgesehen werden als für den Verschmelzungsbeschluss selbst. § 122c Abs. 2 Nr. 11, 12 UmwG-E ist dahingehend teleologisch zu reduzieren, dass die dort geforderten Angaben entfallen können, wenn sie für die Umsetzung und bilanzielle Abbildung der Verschmelzung nach den beteiligten Rechtsordnungen nicht erforderlich sind. Eine Zustimmung der Anteilseigner ausländischer Rechtsträger zur Durchführung eines Spruchverfahrens wird regelmäßig nicht zu erlangen sein. In diesem Fall sind die Gesellschafter des deutschen übertragenden Rechtsträgers – abweichend von § 14 Abs. 2 UmwG – auf die Anfechtungsklage verwiesen. Findet demgegenüber ein Spruchverfahren statt, insbesondere weil alle beteiligten Rechtsordnungen ein solches vorsehen, wird die vom Gesetzgeber gewünschte Zuständigkeitskonzentration kaum je zu erreichen sein. Regelmäßig werden nämlich die Gerichte in den Sitzstaaten sowohl des übertragenden als auch des übernehmenden Rechtsträgers international zuständig sein. Die Vorschrift des § 6c SpruchG-E ist dahingehend teleologisch zu reduzieren, dass ein gemeinsamer Vertreter nur für solche Anteilseigner zu bestellen ist, deren Zustimmung nach § 122h Abs. 1 UmwG-E zur Durchführung des Spruchverfahrens erforderlich ist. Auch in den vom 2. UmwG-ÄndG nicht geregelten Fälle internationaler Umwandlungen (insbesondere Verschmelzung unter Beteiligung von Personengesellschaften und Spaltung) kann weitgehend auf die in §§ 122a ff. UmwG-E enthaltenen Rechtsgedanken zurückgegriffen werden.
Zusammenfassung der Ergebnisse: 1. Das Gemeinschaftsrecht garantiert durch Art. 108 EGV umfassend die Weisungsfreiheit der Europäischen Zentralbank und der nationalen Zentralbanken als Institution.. Diese Garantie erfasst auch die natürlichen Personen, die Mitglieder der Entscheidungsgremien sind. 2. Hinzu treten weiter Regelungen des Gemeinschaftsvertrages und der Satzung von ESZB und EZB, welche diese Garantie zu einer allgemeinen Unabhängigkeitsgarantie ausbauen und verstärken. 3. Garantiert ist vor allem auch die persönlicher Unabhängigkeit der Mitglieder in den Entscheidungsgremien. 4. Von wenigen Ausnahmen abgesehen, sind diese Regelungen für das sekundäre Gemeinschaftsrecht unantastbar. Als Teil des primären Gemeinschaftsrechts können sie prinzipiell nur durch Vertragsänderung, also einstimmig verändert werden. 5. Diese europarechtlichen Garantien werden über Art. 88 Satz 2 GG für die Bundesbank als integrales Bestandteil des ESZB in das deutsche Verfassungsrecht transponiert. Daraus ergibt sich eine „gemeinschaftsrechtlich vermittelte verfassungsrechtliche Unabhängigkeitsgarantie“ für die Bundesbank. 6. Die Regelung ist mit dem Demokratieprinzip vereinbar. 7. Änderungen der umfassenden Garantie können die verfassungsrechtlichen Voraussetzungen für die Übertragung der währungs- und notenbankpolitischen Befugnisse auf das ESZB entfallen lassen. 8. Der Entwurf einer Verfassung für Europa enthält keine verfassungsrechtlich relevanten Relativierungen der Unabhängigkeitsgarantie. 9. Das Ziel der Preisstabilität hat den ihm gebührenden Rang behalten. Bei genauer Analyse zeigt sich auch, dass sein besonderer Rang für die Tätigkeit des ESZB nicht beeinträchtigt ist. 10. Ein Vergleich der verschiedenen sprachlichen Fassungen des Verfassungsvertrages zeigt auch, dass – entgegen dem deutschen Text – die EZB nicht als – möglicherweise weniger unabhängiges - Organ der EU, sondern als sonstige Einrichtung eingestuft worden ist.
Demographic change in industrialized nations has been a matter of common interest for some time. The financial implications of an ageing society are also increasingly discussed, particularly with regard to pension systems. The impact of this development on public finances is, however, only gradually being realized and the constitutional framework of public finances in Germany and the European Union just falls short of ignoring it entirely. This paper is a preliminary assessment of the burden of an ageing society under the fiscal law, specifically in respect of prospective entitlements to the public pension system. The first part analyses the provisions of the German constitution on finances (Finanzverfassungsrecht) to identify what rules, if any, exist addressing such (potential) expenditures, which lie in the immediate or very distant future. The second part of the paper analyses the fiscal requirements under European Union law. In the third and final part a few comments on the proposed national pact on stability and the recent moves to amend the German Federal Constitution are presented.
Zusammenfassung der Ergebnisse: 1. Europäische Zentralbank und Bundesbank erfüllen im Wesentlichen hoheitliche Aufgaben. 2. Die Erfüllung hoheitlicher Aufgaben darf nicht dazu dienen, den allgemeinenStaatsbedarf zu finanzieren. Akzidentiell anfallende Erlöse können jedoch imHaushalt vereinnahmt werden. 3. Die gesetzliche Anordnung, Bundesbankgewinne an den Bund abzuführen(§ 27 BBankG), ist mit den finanzverfassungsrechtlichen Maximen der Staatsfinanzierung vereinbar. Es liegt auch kein Verstoß gegen das Steuerstaatsprinzip vor. 4. Ertragsgesichtspunkte dürfen aber keinesfalls und in keiner Weise in die Entscheidungen einfließen, mit denen hoheitliche Aufgaben erfüllt werden. 5. Die Vereinnahmung von Bundesbankgewinnen durch den Bund stellt keine Kreditaufnahme dar, die im Rahmen der Verschuldungsgrenzen des Art. 115 Abs. 1 GG zu berücksichtigen wäre. 6. Weder die Bundesregierung noch der Bundestag haben die Kompetenz, auf die Komponenten einzuwirken, die zur Entstehung des Bundesbankgewinns führen. Dafür ist ausschließlich das Europäische System der Zentralbanken zuständig, soweit währungspolitische Gesichtspunkte betroffen sind. 7. Das gilt insbesondere auch für die Entscheidung über den Verkauf von Gold oder Devisenreserven. Es besteht keinerlei Anrecht des Bundes auf diese Vermögensgegenstände, solange die Bundesbank besteht. 8. Einwirkungen dieser Art sind mit der europarechtlich und verfassungsrechtlich garantierten Unabhängigkeit der Zentralbanken nicht zu vereinbaren. Schon der bloße Versuch einer Beeinflussung ist verboten, Art. 108 EGV und Art. 88 Satz 2 GG. 9. Die gesetzlichen Vorschriften über die Gewinnabführung verstoßen als solche derzeit aber noch nicht gegen höherrangiges Recht, auch wenn sie starke Anreize für die Politik schaffen, sich über die Unabhängigkeitsgarantien hinwegzusetzen. 10. Die Bundesbank darf sich nicht aus währungspolitischen Erwägungen weigern, den zur Ausschüttung bereitstehenden Gewinn auszuzahlen. 11. Der unmittelbare Einsatz des Gewinns zur Schuldentilgung würde alle Bedenken im Hinblick auf die Unabhängigkeitsgarantie beseitigen.
The Land and Water Development Division of the Food and Agriculture Organization of the United Nations and the Johann Wolfgang Goethe University, Frankfurt am Main, Germany, are cooperating in the development of a global irrigation-mapping facility. This report describes an update of the Digital Global Map of Irrigation Areas for the continents of Africa and Europe as well as for the countries Argentina, Brazil, Mexico, Peru and Uruguay in Latin America. For this update, an new inventory of subnational irrigation statistics was compiled. The reference year for the statistics is 2000. Adding up the irrigated areas per country as documented in the report gives a total of 48.8 million ha while the total area equipped for irrigation at the global scale is 278.8 million ha. The total number of subnational units in the inventory used for this update is 16 822 while the number of subnational units in the global inventory increased to 26 909. In order to distribute the irrigation statistics per subnational unit, digital spatial data layers and printed maps were used. Irrigation maps were derived from project reports, irrigation subsector studies, and books related to irrigation and drainage. These maps were digitized and compared with satellite images of many regions. In areas without spatial information on irrigated areas, additional information was used to locate areas where irrigation is likely, such as land-cover and land-use maps that indicate agricultural areas or areas with crops that are usually grown under irrigation.
Als das Programm der diesjährigen Hamburger Non-Profit-Tage konzipiert wurde, war das Thema „Vereinsrechtsreform“ aktueller denn je. Das Bundesministerium der Justiz hatte am 25. August 2004 einen „Entwurf eines Gesetzes zur Änderung des Vereinsrechts“ vorgelegt, der sich das Ziel gesetzt hatte, „das seit über 100 Jahren im Wesentlichen unveränderte Vereinsrecht des Bürgerlichen Gesetzbuchs (BGB) modern zu gestalten, zu vereinfachen und den heutigen Bedürfnissen anzupassen“. Um dieses Ziel zu erreichen, sollte u. a. das sog. Nebenzweckprivileg in § 21 BGB verankert, die Bestimmung des § 22 BGB über den wirtschaftlichen Verein aufgehoben und die bislang auf die Amtsgerichte und Verwaltungsbehörden verteilte Rechtsformaufsicht über eingetragene Vereine bei den Amtsgerichten konzentriert werden. Ferner sollte § 54 BGB mit der Rechtswirklichkeit in Einklang gebracht und den nichtrechtsfähigen Vereinen auch die aktive Parteifähigkeit zugesprochen werden, die § 50 Abs. 2 ZPO ihnen derzeit noch vorenthält. Obwohl der Referentenentwurf nur ausgewählten Verbänden zur Stellungnahme übersandt wurde, hat er in der Vereinslandschaft für erhebliche Unruhe gesorgt. Im Schrifttum hat er überwiegend ein kritisches Echo gefunden: Der Entwurf sei ein unausgereifter, handwerklich mißlungener „Schnellschuß“ mit „verheerenden Folgen für die Verbände und Vereine“. Er verfehle sein Anliegen, zu mehr Rechtsklarheit im Vereinswesen beizutragen, ignoriere die wirklichen Regelungsprobleme und wirke daher „schon jetzt antiquiert“. Unter dem Eindruck dieser Kritik, aber womöglich auch wegen der über die Jahresmitte bestehenden Ungewißheit über die künftigen politischen Kräfteverhältnisse im Lande hat das Bundesjustizministerium * Inhaber der Juniorprofessur für Zivilrecht mit Schwerpunkt deutsches und europäisches Gesellschaftsrecht an der Johann Wolfgang Goethe-Universität Frankfurt a. M. sein Reformprojekt vorerst zurückgestellt. Ob, wann und in welcher Gestalt der Entwurf weiterverfolgt wird, ist derzeit nicht abzusehen. Das Thema „Vereinsrechtsreform“ ist damit jedoch keineswegs erledigt. Wie im folgenden gezeigt werden soll, weist unser in die Jahre gekommenes Vereinsrecht nämlich in der Tat einige rechtspolitisch bedenkliche Defizite auf, die nicht ausschließlich durch Rechtsprechung und Wissenschaft behoben werden können. Diese Defizite sind freilich nicht durchweg dort zu finden, wo das Bundesjustizministerium sie ausgemacht haben will, und deswegen wird es nötig sein, den Blick auf andere Regelungsprobleme auszuweiten, die der Referentenentwurf nicht einmal andeutet. Andererseits wäre es verfrüht, den Entwurf schon jetzt vollständig aus der rechtspolitischen Debatte auszublenden, denn immerhin vermittelt er einen ersten Eindruck davon, wie man sich in Berlin-Mitte ein modernes Vereinsrecht vorstellt. Der Beitrag stellt daher die Änderungsvorschläge des Entwurfs auf den Prüfstand, um sie mit eigenen Reformvorstellungen zu kontrastieren. Er beschränkt sich auf ausgewählte Rechtsfragen rund um die wirtschaftliche Betätigung von Idealvereinen.
One of the most acute problems in the world today is provision of a respectable living for the elderly. Today the process of aging population (as a result of a declined birth rate and increased life expectancy) has touched all countries of the world - developed countries as well as countries like Russia. Consequently, reforming traditional pension systems to deal with the changing situation has become an important issue around the world. These reforms typically center on the implementation of some form of funding of future pension benefits. This also holds for Russia, where in 1995 pension reform legislation introduced the so-called “accumulation pension”. In this context, this article will deal with the issues concerning the establishment of mutual funds, legal aspects of their operating and their investing opportunities. There will be carried out a comparative analysis of mutual funds with the other forms of public investments, namely: Common Funds of Bank Management, Voucher Investment Funds and Joint-stock Investment Funds.
Both banks and open end real estate funds effectuate liquidity transformation in large amounts and high scales. Because of this similarity the latter should be analyzed using the same methodologies as usually applied for banks. We show that the work in the tradition of Diamond and Dybvig (1983), especially Allen and Gale (1998) and Diamond and Rajan (2001), provides an applicable theoretical framework. We used this as the basis for our model for open end real estate funds. We then examined the usefulness of the modeling structure in analyzing open end real estate funds. First, we could show that withdrawing of capital resulting in a run is not always inefficient. Instead, withdrawing can as well be referred to the situation where the low return of an open end fund unit in comparison to other opportunities makes, (partial) withdrawal viewed from the risk-sharing perspective optimal. Even with costly liquidation, this result will hold, though we will have deadweight losses in such a situation. Second, introducing a secondary market in our model does, not in general, resolve the problem of deadweight losses associated with foreclosure. If assets are sold during a run, we do not only have a transfer of value but it can also create an economic cost. Because funds are forced to liquidate the illiquid asset in order to fulfill their obligations, the price of the real estate asset is forced down making the crisis worse. Rather than providing insurance, such that investors receive a transfer in negative outcomes, the secondary market does the opposite. It provides a negative insurance instead. Third, our model proves that the open end structure provides a monitoring function which serves as an efficient instrument to discipline the funds management. Therefore, we argue that an open end structure can represent a more adequate solution to securitize real estate or other illiquid assets. Instead of transforming open end in closed end structures, fund runs should be accepted as a normal phenomenon to clear the market from funds with mismanagement.
Although many observers consider the Bush administration’s “faith-based initiative” a unique breach in the wall of separation between church and state, close ties between the federal government and religious agencies are no novelty in the history of American public policy. Since the end of the Second World War, billions of dollars of public funds have been made available to religiously-affiliated hospitals, nursing homes, educational institutions, and social services - institutions which were regarded as vital to Cold War preparedness. By the same token, government use of religious foreign aid agencies, the donation of surplus land and military facilities to religious charities, and the funding of the chaplaincy in the armed forces have undergirded Cold War foreign policy goals. Based on the principle of subsidiarity, post-war public policy thus integrated religious groups into the framework of the welfare and national security state in ways which underwrote both the expansion of the federal government and the growth of religious agencies. Crucially, public funding relations involved not only mainline Protestant, Jewish and Catholic organizations, but also white evangelicals, who had traditionally been the most outspoken opponents of closer ties between church and state. Cold War Anti-Communism, the fear of Catholic or secularist control of public funds, and pragmatic considerations, however, ushered in the gradual revision of their separatist views. Ironically, the programs of Lyndon Johnson’s Great Society, so vilified by the Christian Right, pioneered many of the funding streams most beneficial to evangelical providers. Considering that since 1945 the sprawling and loosely organized evangelical movement has become the largest single religious faction in the US, and that conservative Protestants now form the most strongly Republican group in the religious spectrum, these findings are of particular importance. They suggest that Cold War state-building and the resurgence of Evangelicalism mutually reinforced each other in ways which have been largely ignored by scholarship on conservatism and its focus on the “backlash” against the political and cultural upheaval of the 1960s. Based on newly accessible archival materials and a comprehensive review of secondary literature, this paper suggests that the institutional and ideological ties between evangelicals and the state, which developed in the aftermath of the Second World War, are as important in understanding the political mobilization of conservative Protestants as the more recent “culture war” sentiments.
The sovereignty of the European nation states in the realm of security politics is gradually eroding. At the same time the European integration to a large degree influences the level of direct bilateral police cooperation, since cross-border crime has come to be perceived not as only a national, but as a common problem for the European nation states. At the German-Polish border, "Europe's Rio Grande", these high expectations concerning security policy are put into practice. With Poland's EU accession, Polish and German border guards are no longer spatially separated, but jointly control travellers. Joint patrols and contact points have already existed since 1998. On the one hand, the enforced meeting of German and Polish border policemen may help dismantle mutual prejudices. On the other hand, other cleavages may appear, based on cultural, systemic and institutional factors, which hinder the development of mutual trust and reinforce the asymmetrical relationship between the Schengen member Germany and the "junior partner" Poland.
Anfang 2005 wurde die Schweizer „Capital Efficiency Group“ von den Lesern der bekannten Publikation „Structured Finance International“ mit dem Preis “Innovativster Asset Back Deal des Jahres 2004” ausgezeichnet sowie von „The Banker“ für einen der „Deals of the Year“ gewürdigt. Prämiert wurde die Entwicklung von „Preferred Pooled Shares“ (PREPS). Was verbirgt sich hinter diesem Konstrukt? Bei PREPS handelt es sich um ein Finanzprodukt der „Capital Efficiency Group“, die sich den Eigennamen „PREPS“ als Marke hat eintragen lassen. PREPS ist somit nur der Name eines speziellen Finanzinstruments. Die Bezeichnung PREPS wird aber gleichsam stellvertretend für eine Vielzahl von Finanzprodukten, durch die in eigenkapitalähnliche Finanztitel des Mittelstands investiert wird, verwendet. Zu nennen sind in diesem Zusammenhang „ge/mit“ und „equiNotes“ sowie einige weniger populäre Produkte. Jedes dieser Finanzprodukte weist im Detail eine andere Struktur auf, grundsätzlich basieren aber alle auf derselben Grundidee. Die folgenden Ausführungen stellen die Struktur und Funktionsweise dieser Finanzprodukte dar. Weitere Abschnitte erörtern sodann den wirtschaftlichen Hintergrund und die rechtlichen Rahmenbedingungen.
Various static analyses of functional programming languages that permit infinite data structures make use of set constants like Top, Inf, and Bot, denoting all terms, all lists not eventually ending in Nil, and all non-terminating programs, respectively. We use a set language that permits union, constructors and recursive definition of set constants with a greatest fixpoint semantics in the set of all, also infinite, computable trees, where all term constructors are non-strict. This internal report proves decidability, in particular DEXPTIME-completeness, of inclusion of co-inductively defined sets by using algorithms and results from tree automata and set constraints, and contains detailed proofs. The test for set inclusion is required by certain strictness analysis algorithms in lazy functional programming languages and could also be the basis for further set-based analyses.
We develop a proof method to show that in a (deterministic) lambda calculus with letrec and equipped with contextual equivalence the call-by-name and the call-by-need evaluation are equivalent, and also that the unrestricted copy-operation is correct. Given a let-binding x = t, the copy-operation replaces an occurrence of the variable x by the expression t, regardless of the form of t. This gives an answer to unresolved problems in several papers, it adds a strong method to the tool set for reasoning about contextual equivalence in higher-order calculi with letrec, and it enables a class of transformations that can be used as optimizations. The method can be used in different kind of lambda calculi with cyclic sharing. Probably it can also be used in non-deterministic lambda calculi if the variable x is "deterministic", i.e., has no interference with non-deterministic executions. The main technical idea is to use a restricted variant of the infinitary lambda-calculus, whose objects are the expressions that are unrolled w.r.t. let, to define the infinite developments as a reduction calculus on the infinite trees and showing a standardization theorem.
This paper provides an overview of conceptual issues and recent research findings concerning the structure and the role of financial systems and an introduction into the new research area of comparative financial systems. The authors start by pointing out the importance of financial systems in general and then sketch different ways of describing and analysing national financial systems. They advocate using what they call a “systemic approach”. This approach focuses on the fit between the various elements that constitute any financial system as a major determinant of how well a given financial system performs its functions. In its second part the paper discusses recent research concerning the relationships between financial sector development and general economic growth and development. The third part is dedicated to comparative financial systems. It first analyses the similarities and, more importantly, the differences of the financial systems of major industrialised countries and points out that these differences seem to remain in existence in spite of the current wave of liberalisation, deregulation and globalisation. This leads to the concluding discussion of what the systemic approach suggests with respect to the question of whether the financial systems of different countries are likely to converge to a common structure. Stakeholderorientierung, Systemhaftigkeit und Stabilität der Corporate Governance in Deutschland

Since the time of Germany’s belated industrialisation, corporate governance in Germany has been stakeholder oriented in the dual sense of attaching importance to the interests of stakeholders who are not at the same time shareholders, and of providing certain opportunities for these stakeholders to influence corporate decisions. Corporate governance is also systemic. It is a system of elements that are complementary to each other, and also consistent. In other word, it is composed of elements for which it is important that they fit together well, and in the German case these elements did fit together well until quite recently. Corporate governance as a system is itself an element of the German bank-based financial system at large and possibly even of the entire German business and economic system. Stakeholder orientation of governance is consistent with the general structure this system, and even represents one of its central elements. In retrospect, German corporate governance has also proved to be surprisingly stable. Its fundamental traits date back to the turn from the 19th to the 20th century. There are strong reasons to assume that the systemic features, that is, its complementarity and consistency, have greatly contributed to its past stability. Since about ten years now, there are growing tendencies to question the viability and stability of the German corporate governance system and even the financial system as a whole. One of the central topics in the new debate concerns the stakeholder orientation of the system, which some observers and critics consider as the main weakness of the “German model” under the increasing pressures of globalisation and European integration. As far as their development over time is concerned, systems of complementarity elements exhibit certain peculiarities: (1) They do not adjust easily to changing circumstances. (2) Changes concerning important individual elements, such as the stakeholder orientation of governance, tend to jeopardize the viability and the stability of the entire system. (3) While they appear to be stable, systems shaped by complementary may simply be rigid and tend to break under strong external pressure. “Breaking” means that a system undergoes a fundamental transformation. It seems plausible to assume that the German financial system is already in the middle of such a transformation. It is yet another consequence of its systemic character that this transformation is not likely to be a smooth and gradual process and that it will not lead to a “mixed model” but rather to the adoption of a capital market-based financial system as it prevails in the Anglo-Saxon countries. In such a system, corporate governance cannot be geared to catering to the interests of stakeholders, and an active role for them would not even make any economic sense.
The paper examines challenges in effectively implementing the lender-of-last-resort function in the EU single financial market. Briefly highlighted are features of the EU financial landscape that could increase EU systemic financial risk. Briefly described are the complexities of the EU’s financial-stability architecture for preventing and resolving financial problems, including lender-of-last-resort operations. The paper examines how the lender-of-last-resort function might materialize during a systemic financial disturbance affecting more than one EU Member State. The paper identifies challenges and possible ways of enhancing the effectiveness of the existing architecture.
The phase structure of the scalar field theory with arbitrary powers of the gradient operator and a local non-analytic potential is investigated by the help of the RG in Euclidean space. The RG equation for the generating function of the derivative part of the action is derived. Infinitely many non-trivial fixed points of the RG transformations are found. The corresponding effective actions are unbounded from below and do probably not exhibit any particle content. Therefore they do not provide physically sensible theories.
We present a higher-order call-by-need lambda calculus enriched with constructors, case-expressions, recursive letrec-expressions, a seq-operator for sequential evaluation and a non-deterministic operator amb that is locally bottom-avoiding. We use a small-step operational semantics in form of a single-step rewriting system that defines a (nondeterministic) normal order reduction. This strategy can be made fair by adding resources for bookkeeping. As equational theory we use contextual equivalence, i.e. terms are equal if plugged into any program context their termination behaviour is the same, where we use a combination of may- as well as must-convergence, which is appropriate for non-deterministic computations. We show that we can drop the fairness condition for equational reasoning, since the valid equations w.r.t. normal order reduction are the same as for fair normal order reduction. We evolve different proof tools for proving correctness of program transformations, in particular, a context lemma for may- as well as mustconvergence is proved, which restricts the number of contexts that need to be examined for proving contextual equivalence. In combination with so-called complete sets of commuting and forking diagrams we show that all the deterministic reduction rules and also some additional transformations preserve contextual equivalence.We also prove a standardisation theorem for fair normal order reduction. The structure of the ordering <=c a is also analysed: Ω is not a least element, and <=c already implies contextual equivalence w.r.t. may-convergence.

Besprechung der Entscheidungen BGH vom 10. 10. 2005 - II ZR 90/03 und II ZR 148/03, Der Konzern 2006, 269, 272 (Mangusta/Commerzbank I und II) 1. Beiden Urteilen in Sachen Mangusta/Commerzbank ist im Ergebnis zuzustimmen. Der Senat hat das Recht des genehmigten Kapitals mit Bezugsrechtsausschluss sachgerecht fortentwickelt. 2. In der ersten Entscheidung hat der Senat zutreffend die Frage nach einer Vorabberichtspflicht des Vorstands verneint und sich dabei ausdrücklich gegen namhafte Stimmen des Schrifttums gewandt. Eine solche Berichtspflicht ist abzulehnen, weil sie einen übertriebenen Formalismus bedeuten würde und voraussichtlich die durch Siemens/Nold gewonnene Flexibilisierung beim genehmigten Kapital nicht unerheblich einschränken würde. 3. Zutreffend ist auch die Ablehnung einer analogen Anwendung der aktienrechtlichen Anfechtungs- und Nichtigkeitsfeststellungsklage auf Beschlüsse der Verwaltung. Hier hätte es u.E. allerdings näher gelegen, die Analogie mangels planwidriger Regelungslücke zu verneinen. 4. Anerkennung verdient schließlich auch die Zulassung der allgemeinen Feststellungsklage als Instrument zur Kontrolle der Verwaltungsbeschlüsse über ein genehmigtes Kapital mit Bezugsrechtsausschluss. Ein Feststellungsurteil hat die Funktion, der Verwaltung direkt eine Kompetenzüberschreitung aufzuzeigen. Andere den Aktionären zur Verfügung stehende Rechtsbehelfe ermöglichen lediglich eine inzidente Kontrolle des Handelns der verantwortlichen Organe. Einen auf die Pflichtwidrigkeit fokussierten Rechtsschutz bietet nur die allgemeine Feststellungsklage. Das Feststellungsinteresse der Aktionär begründet der Senat insbesondere damit, dass die Verwaltungsorgane aus einem gegen ihr Verhalten gemünzten Feststellungsurteil die notwendigen Folgerungen ziehen werden. Dem kann letztlich gefolgt werden, wenngleich der vom Senat hier angelegte Maßstab doch sehr großzügig erscheint. Ein zusätzliches Missbrauchspotenzial, das über jenes hinausgeht, das mit einer Unterlassungsklage oder einer Unterlassungsverfügung verbunden ist, wird durch die Zulassung der allgemeinen Feststellungsklage und der zugehörigen Regelungsverfügung nicht geschaffen.
Bis zur Umsetzung der so genannten Verschmelzungsrichtlinie in nationales Recht stellt der Einsatz einer SE das einzige rechtssichere Instrumentarium zur Bewältigung von grenzüberschreitenden Unternehmenszusammenführungen in Form von Verschmelzungen in Europa dar. Derzeit gibt auch nur die SE ein rechtssicheres Verfahren zur Bewältigung von identitätswahrenden Sitzverlegungen innerhalb Europas an die Hand. Die Rechtsform der SE und ihre europäische Identität bieten daneben Vorteile, die ihre Beachtung nicht nur bei Fragen der grenzüberschreitenden Umstrukturierung, sondern auch allgemein bei Fragen der Rechtsformwahl gebieten.

This CFS Working Paper has been presented at the CFSsymposium "Market Efficiency Today" held in Frankfurt/Main on October 6, 2005. In 2004 the Center for Financial Studies (CFS) in cooperation with the Johann Wolfgang Goethe University, Frankfurt/Main established an international academic prize, which is to be known as The Deutsche Bank Prize in Financial Economics. The prize will honor an internationally renowned researcher who has excelled through influential contributions to research in the fields of finance and money and macroeconomics, and whose work has lead to practice and policy-relevant results. The Deutsche Bank Prize in Financial Economics has been awarded for the first time in October 2005. The prize, sponsored by the Stiftungsfonds Deutsche Bank im Stifterverband für die Deutsche Wissenschaft, carries a cash award of € 50,000. The prize will be awarded every two years and the prize holder will be appointed a "Distinguished Fellow" of the CFS. The role of media partner for the Deutsche Bank Prize in Financial Economics is to be filled by the internationally renowned publication, The Economist and the Handelsblatt, the leading German-language financial and business newspaper.
In this paper, we consider expected value, variance and worst-case optimization of nonlinear models. We present algorithms for computing optimal expected values, and variance, based on iterative Taylor expansions. We establish convergence and consider the relative merits of policies beaded on expected value optimization and worst-case robustness. The latter is a minimax strategy and ensures optimal cover in view of the worst-case scenario(s) while the former is optimal expected performance in a stochastic setting. Both approaches are used with a macroeconomic policy model to illustrate relative performances, robustness and trade-offs between the strategies. Klassifikation: C61, E43
Reasoning about the correctness of program transformations requires a notion of program equivalence. We present an observational semantics for the concurrent lambda calculus with futures Lambda(fut), which formalizes the operational semantics of the programming language Alice ML. We show that natural program optimizations, as well as partial evaluation with respect to deterministic rules, are correct for Lambda(fut). This relies on a number of fundamental properties that we establish for our observational semantics.
Inflation and relative price variability in the Euro area : evidence from a panel threshold model

In recent macroeconomic theory, relative price variability (RPV) generates the central distortions of inflation. This paper provides first evidence on the empirical relation between inflation and RPV in the euro area focusing on threshold effects of inflation. We ¯nd that expected inflation significantly increases RPV if inflation is either very low (below -1.38% p.a.) or very high (above 5.94% p.a.). In the intermediate regime, however, expected in°ation has no distorting effects which supports price stability as an outcome of optimal monetary policy. JEL classification: E31, C23
Although stable money demand functions are crucial for the monetary model of the exchange rate, empirical research on exchange rates and money demand is more or less disconnected. This paper tries to fill the gap for the Euro/Dollar exchange rate. We investigate whether monetary disequilibria provided by the empirical literature on U.S. and European money demand functions contain useful information about exchange rate movements. Our results suggest that the empirical performance of the monetary exchange rate model improves when insights from the money demand literature are explicitly taken into account. The dynamic relationship between the Euro overnight rate, the ECB´s policy rate and the term spread

This paper investigates how the dynamic adjustment of the European overnight rate Eonia to the term spread and the ECB’s policy rate has been affected by rate expectations and the operational framework of the ECB. In line with recent evidence found for the US and Japan, the reaction of the Eonia to the term spread is non-symmetric. Moreover, the response of the Eonia to the policy rate depends on both, the repo auction format and the position of the Eonia in the ECB’s interest rate corridor. JEL - Klassifikation: E43 , E52
When a spot market monopolist has a position in a corresponding futures market, he has an incentive to deviate from the spot market optimum to make this position more profitable. Rational futures market makers take this into account when setting prices. We show that the monopolist, by randomizing his futures market position, can strategically exploit his market power at the expense of other futures market participants. Furthermore, traders without market power can manipulate futures prices by hiding their orders behind the monopolist's strategic trades. The moral hazard problem stemming from spot market power thus provides a venue for strategic trading and manipulation that parallels the adverse selection problem stemming from inside information. Die erstmalige Übertragung der Regierungsverantwortung im Jahr 1998 an eine Koalition aus SPD und Bündnis90/Die Grünen auf der Bundesebene hat Erwartungen geweckt, dass sich die gesundheitspolitische Ausrichtung stärker an den Interessen von Patientinnen und Patienten orientierten würde als bisher üblich. Die Dominanz der Opposition im Bundesrat jedoch erforderte eine große Reformkoalition, um strukturelle Veränderungen im deutschen Gesundheitswesen durchsetzen zu können. Die Analyse politischer Dokumente und der wichtigsten Gesetzesvorhaben seit dem Beginn der rot-grünen Regierungskoalition zeigt, dass einerseits die individuellen und kollektiven Beteiligungsrechte von Patienten und Patientinnen sowie Patientenverbände gestärkt wurden, andererseits aber auch die finanziellen Belastungen von Erkrankten durch erhöhte Zuzahlungen und vermehrte Leistungsausgrenzungen gestiegen sind. Gemessen an den hohen Standards der Weltgesundheitsorganisation sind daher die Ergebnisse der rot-grünen Regierungszeit als ambivalent zu bewerten.
Football coverage in newspapers is both an arena for and a mirror of political discourse within a society. The paper argues that discourses within football coverage referring to political issues reflect dominant – and, possibly, contesting – “truths”, which themselves are linked to power relations and political struggles within a given society. The comparison of Côte d’Ivoire and Ghana, two neighbouring countries in very different conditions (particularly with regard to their historical trajectories and the degree of societal consensus), and more particularly, the comparison of dominant discourses on the topics of patriotism, peace and good governance related to the World Cup qualification of both national teams supports the hypothesis of a strong context-relatedness of a politically loaded “football language”. This paper analyzes the relation between demographic structure and real asset returns on treasury bills, bonds and stocks for the G7-countries (United States, Canada, Japan, Italy, France, the United Kingdom and Germany). A macroeconomic multifactor model is used to examine a variety of different demographic factors from 1951 to 2002. There was no robust relationship found between shocks in demographic variables and asset returns in the framework of these models, which suggests that Asset Meltdown is rather fiction than fact.
The tax codes in many countries allow for special tax advantages for investments in special retirement plans. Probably the most important advantage to these plans is that profits usually remain untaxed. This paper deals with the question, which assets are preferable in a taxdeferred account (TDA). Contrary to the conventional wisdom that one should prefer bonds in the TDA, it is shown that especially in early years, stocks can be the preferred asset to hold in the TDA for an investor maximizing final wealth, given a certain asset allocation. The higher the performance of stocks compared to bonds, the higher the tax burden put on stocks compared to bonds. Simultaneously, the longer the remaining investment horizon, the larger the relative outperformance of the optimal asset location strategy compared to the myopic strategy of locating bonds in the TDA. An algorithm is provided to determine the investment strategy that maximizes (expected) funds at the end of a given investment horizon when there is an analytical solution.
Extending the method of Howe, we establish a large class of untyped higher-order calculi, in particular such with call-by-need evaluation, where similarity, also called applicative simulation, can be used as a proof tool for showing contextual preorder. The paper also demonstrates that Mann’s approach using an intermediate “approximation” calculus scales up well from a basic call-by-need non-deterministic lambdacalculus to more expressive lambda calculi. I.e., it is demonstrated, that after transferring the contextual preorder of a non-deterministic call-byneed lambda calculus to its corresponding approximation calculus, it is possible to apply Howe’s method to show that similarity is a precongruence. The transfer is not treated in this paper. The paper also proposes an optimization of the similarity-test by cutting off redundant computations. Our results also applies to deterministic or non-deterministic call-by-value lambda-calculi, and improves upon previous work insofar as it is proved that only closed values are required as arguments for similaritytesting instead of all closed expressions.
Baby boomer retirement security: the roles of planning, financial literacy and housing wealth

We compare wealth holdings across two cohorts of the Health and Retirement Study: the early Baby Boomers in 2004, and individuals in the same age group in 1992. Levels and patterns of total net worth have changed relatively little over time, though Boomers rely more on housing equity than their predecessors. Most important, planners in both cohorts arrive close to retirement with much higher wealth levels and display higher financial literacy than non-planners. Instrumental variables estimates show that planning behavior can explain the differences in savings and why some people arrive close to retirement with very little or no wealth. Der "Kosmos" ist das letzte Buch des 1859 in seinem neunzigsten Lebensjahr in Berlin verstorbenen Gelehrten, in deutscher Sprache geschrieben und in fünf Bänden 1845 bis 1862 in Stuttgart und Tübingen veröffentlicht. Die Frankfurter Edition von 2004 präsentiert die erste vollständige Ausgabe seit dem neunzehnten Jahrhundert und die erste vollständige Neu-Edition des Humboldtschen Originaltextes überhaupt. Der Kosmos wird erstmalig ausschließlich so aufgelegt, wie er von seinem Autor geschrieben und publiziert wurde. Das bedeutet: Es werden nur die Teile aufgenommen, die tatsächlich von Humboldt selbst stammen. Korrekturen und Ergänzungen, die vom Urheber vorgenommen oder autorisiert wurden, indem sie in den zu Lebzeiten erschienenen Bänden vermerkt sind, wurden ausgeführt beziehungsweise übernommen. Im Anhang nachgereichte Korrekturen und Ergänzungen anderer Autoren aus dem posthumen fünften Band wurden dagegen nicht ein- beziehungsweise umgesetzt. Ausgangspunkt ist der Stand der allerersten Auflage, Maßstab der vom Verfasser selbst hergestellte Text. Die Edition bietet zum ersten Mal den reinen Humboldtschen Ur-Kosmos. Humboldts berühmtestes Werk ist hier tatsächlich in einem Band vereint: ”die ganze Welt in einem Buch”.
