Die Einschaltung einer zentralen Gegenpartei in den Handel mit Derivaten erfüllt zahlreiche wirtschaftliche Funktionen. Neben der Reduktion des Kontrahentenausfallrisikos und systemischer Risiken wird das durch das Erfordernis angemessener Eigenkapitalunterlegung gebundene Eigenkapital bestmöglich freigehalten. Letztlich kann mit ihr auch ein Frühwarnsystem zur Vorbeugung ungewollter Marktentwicklungen implementiert werden. Bei der Frage nach der rechtlichen Konstruktion des Handels mit Derivaten mittels zentraler Gegenpartei sind börslicher und außerbörslicher Handel zu trennen. Im börslichen Derivatehandel kommen die Rechtsgeschäfte zwischen CM und zentraler Gegenpartei durch Angebot und Annahme i.S. der §§ 145 ff. BGB zustande. Das Angebot des CM 1 liegt in der Eingabe der Order in das EDV-System. Das Angebot ist hinreichend bestimmt. Auch handelt CM 1 mit Rechtsbindungswillen. Allerdings besteht ein vertraglich vereinbartes Rücktrittsrecht bis zum Zeitpunkt des Matching. Das Angebot geht der zentralen Gegenpartei zu, indem CM 2 dieses als Passivvertreterin der zentralen Gegenpartei zur Kenntnis nimmt. Die Annahme durch die zentrale Gegenpartei erfolgt antizipiert durch Abschluss der Clearing-Vereinbarung. Ist ein NCM beteiligt, kommt zudem ein Parallelkontrakt zwischen CM und NCM zustande. Da die Ordereingabe des NCM zu zwei Vertragsschlüssen führt, gibt es zum einen ein eigenes Angebot gegenüber dem CM ab, welches antizipiert durch Abschluss der NCM-CM-Vereinbarung angenommen wird. Zum anderen gibt es ein Angebot im Namen des CM gegenüber der zentralen Gegenpartei ab. Der Vertragsschluss entspricht dem zwischen CM und zentraler Gegenpartei. Im OTC-Handel wird das Rechtsgeschäft zunächst zwischen den CM oder den RK geschlossen. Dann wird das Geschäft im Wege der abstrakten Novation aufgespalten. Dadurch wird die zentrale Gegenpartei jeweils Vertragspartner eines CM. Die Novation erhält ihre spezielle Ausprägung durch die CB-Eurex. Der Abschluss der neuen Schuldverhältnisse erfolgt durch Abgabe eines eigenen Angebotes der CM, das durch den anerkannten Anbieter als bloßer Bote an die zentrale Gegenpartei übermittelt wird. Die Annahme erfolgt durch Abschluss der Clearing-Vereinbarung. Ist ein RK involviert, kommt ebenfalls ein Parallelkontrakt zustande. Das Zustandekommen der beiden Rechtsgeschäfte findet auf die gleiche Weise wie im börslichen Handel statt. Das Clearing verläuft für den börslichen und außerbörslichen Derivatehandel gleich. Zunächst werden die fälligen Forderungen und Verbindlichkeiten verrechnet (Netting).208 Diesbezüglich schließen die Clearing-Stelle und das jeweilige CM durch Abschluss der Clearing-Vereinbarung einen Aufrechnungsvertrag zur Begründung einer einseitigen Aufrechnungsbefugnis zugunsten der Eurex Clearing AG. Eine Nettingvereinbarung kann auch im Verhältnis CM und NCM bzw. RK geschlossen werden. Eine Pflicht dazu besteht aber nicht. Die nicht verrechneten fälligen Forderungen und Verbindlichkeiten werden durch Barausgleich oder durch Übereignung von Wertpapieren, Wertrechten oder Wertpapieren im Treuhandgiroverkehr, erfüllt. Die Übereignung von Wertpapieren findet nach sachenrechtlichen Grundsätzen statt. Die dingliche Einigung zwischen CM 1 und CM 2 liegt in der Erstellung der Ist-Lieferliste durch die Eurex Clearing AG, die dabei als Aktiv- und Passivvertreter der beteiligten CMs handelt. Die dingliche Einigung erfolgt unter aufschiebender Bedingung. Die Übergabe der Wertpapiere findet durch Umstellung des Besitzmittlungsverhältnisses nach § 929 S. 1 BGB statt. Die Übertragung von Wertrechten oder Wertpapieren im Treuhandgiroverkehr finden nach den schuldrechtlichen Regelungen zur Aufrechnung (§§ 398 ff. BGB) statt. Dazu tritt CM 1 zunächst den Lieferanspruch gegenüber der Wertpapiersammelbank an die Eurex Clearing AG ab. Diese erwirbt den Lieferanspruch jedoch nur treuhänderisch durch Abschluss eines eigennützigen Treuhandverhältnisses. Erst in einem zweiten Schritt tritt die Eurex Clearing AG den Lieferanspruch unter aufschiebender Bedingung an CM 2 ab, was durch die Erteilung entsprechender Gutschriften nach außen erkennbar wird. Nicht fällige Derivategeschäfte werden saldiert. Ein dabei verbleibender Saldo an offenen Verbindlichkeiten ist durch Sicherheiten zu unterlegen. Im Hinblick auf die Funktionswahrung der Clearing-Stelle sind diese bei Sicherheiten in Wertpapieren und Wertrechten ausnahmslos als Pfandrechte zu qualifizieren.
Over the past few decades, changes in market conditions such as globalisation and deregulation of financial markets as well as product innovation and technical advancements have induced financial institutions to expand their business activities beyond their traditional boundaries and to engage in cross-sectoral operations. As combining different sectoral businesses offers opportunities for operational synergies and diversification benefits, financial groups comprising banks, insurance undertakings and/or investment firms, usually referred to as financial conglomerates, have rapidly emerged, providing a wide range of services and products in distinct financial sectors and oftentimes in different geographic locations. In the European Union (EU), financial conglomerates have become part of the biggest and most active financial market participants in recent years. Financial conglomerates generally pose new problems for financial authorities as they can raise new risks and exacerbate existing ones. In particular, their cross-sectoral business activities can involve prudentially substantial risks such as the risk of regulatory arbitrage and contagion risk arising from intra-group transactions. Moreover, the generally large size of financial conglomerates as well as the high complexity and interconnectedness of their corporate structures and risk exposures can entail substantial systemic risk and can therefore threaten the stability of the financial system as a whole. Until a few years ago, there was no supervisory framework in place which addressed a financial conglomerate in its entirety as a group. Instead, each group entity within a financial conglomerate was subject to the supervisory rules of its pertinent sector only. Such silo supervisory approach had the drawback of not taking account of risks which arise or aggravate at the group level. It also failed to consider how the risks from different business lines within the group interrelate with each other and affect the group as a whole. In order to address this lack of group-wide prudential supervision of financial conglomerates, the European legislator adopted the Financial Conglomerates Directive 2002/87/EC8 (‘FCD’) on 16 December 2002. The FCD was transposed into national law in the member states of the EU (‘Member States’) by 11 August 2004 for application to financial years beginning on 1 January 2005 and after. The FCD primarily aims at supplementing the existing sectoral directives to address the additional risks of concentration, contagion and complexity presented by financial conglomerates. It therefore provides for a supervisory framework which is applicable in addition to the sectoral supervision. Most importantly, the FCD has introduced additional capital requirements at the conglomerate level so as to prevent the multiple use of the same capital by different group entities. This paper seeks to examine to what extent the FCD provides for an adequate capital regulation of financial conglomerates in the EU while taking into account the underlying sectoral capital requirements and the inherent risks associated with financial conglomerates. In Part 1, the definition and the basic corporate models of financial conglomerates will be presented (I), followed by an illustration of the core motives behind the phenomenon of financial conglomeration (II) and an overview of the development of the supervision over financial conglomerates in the EU (III). Part 2 begins with a brief elaboration on the role of regulatory capital (I) and gives a general overview of the EU capital requirements applicable to banks and insurance undertakings respectively. A delineation of the commonalities and differences of the banking and the insurance capital requirements will be provided (II). It continues to further examine the need for a group-wide capital regulation of financial conglomerates and analyses the adequacy of the FCD capital requirements. In this context, the technical advice rendered by the Joint Committee on Financial Conglomerates (JCFC) as well as the currently ongoing legislative reforms at the EU level will be discussed (III). The paper finally closes with a conclusion and an outlook on remaining open issues (IV).
Capturing the zero: a new class of zero-augmented distributions and multiplicative error processes

We propose a novel approach to model serially dependent positive-valued variables which realize a non-trivial proportion of zero outcomes. This is a typical phenomenon in financial time series observed on high frequencies, such as cumulated trading volumes or the time between potentially simultaneously occurring market events. We introduce a flexible pointmass mixture distribution and develop a semiparametric specification test explicitly tailored for such distributions. Moreover, we propose a new type of multiplicative error model (MEM) based on a zero-augmented distribution, which incorporates an autoregressive binary choice component and thus captures the (potentially different) dynamics of both zero occurrences and of strictly positive realizations. Applying the proposed model to high-frequency cumulated trading volumes of liquid NYSE stocks, we show that the model captures both the dynamic and distribution properties of the data very well and is able to correctly predict future distributions. We test whether asymmetric preferences for losses versus gains as in Ang, Chen, and Xing (2006) also affect the pricing of cash flow versus discount rate news as in Campbell and Vuolteenaho (2004). We construct a new four-fold beta decomposition, distinguishing cash flow and discount rate betas in up and down markets. Using CRSP data over 1963–2008, we find that the downside cash flow beta and downside discount rate beta carry the largest premia. We subject our result to an extensive number of robustness checks. Overall, downside cash flow risk is priced most consistently across different samples, periods, and return decomposition methods, and is the only component of beta that has significant out-of-sample predictive ability. The downside cash flow risk premium is mainly attributable to small stocks. The risk premium for large stocks appears much more driven by a compensation for symmetric, cash flow related risk. Finally, we multiply our premia estimates by average betas to compute the contribution of the different risk components to realized average returns. We find that up and down discount rate components dominate the contribution to average returns of downside cash flow risk. The recent financial crisis has highlighted the limits of the “originate to distribute” model of banking, but its nexus with the macroeconomy and monetary policy remains unexplored. I build a DSGE model with banks (along the lines of Holmström and Tirole [28] and Parlour and Plantin [39] and examine its properties with and without active secondary markets for credit risk transfer. The possibility of transferring credit reduces the impact of liquidity shocks on bank balance sheets, but also reduces the bank incentive to monitor. As a result, secondary markets allow to release bank capital and exacerbate the effect of productivity and other macroeconomic shocks on output and inflation. By offering a possibility of capital recycling and by reducing bank monitoring, secondary credit markets in general equilibrium allow banks to take on more risk. SUMMARY RECOMMENDATIONS 1. One of the major lessons from the current financial crisis refers to the systemic dimension of financial risk which had been almost completely neglected by bankers and supervisors in the pre-2007 years. 2. Accordingly, the most needed change in financial regulation, in order to avoid a repetition of such a crisis in the future, consists of influencing individual bank behaviour such that systemic risk is decreased. This objective is new and distinct from what Basle II was intended to achieve. 3. It is important, therefore, to evaluate proposed new regulatory instruments on the ground of whether or not they contribute to a reduction, or containment of systemic risk. We see two new regulatory measures of paramount importance: the introduction of a Systemic Risk Charge (SRC), and the implementation of a transparent bank resolution regime. Both measures complement each other, thus both have to be realized to be effective. 4. We propose a Systemic Risk Charge (SRC), a levy capturing the contribution of any individual bank to the overall systemic risk which is distinct from the institution’s own default risk. The SRC is set up such that the more systemic risk a bank contributes, the higher is the cost it has to bear. Therefore, the SRC serves to internalize the cost of systemic risk which, up to now, was borne by the taxpayer. 5. Major details of our SRC refer to the use of debt that may be converted into equity when systemic risk threatens the stability of the banking system. Also, the SRC raises some revenues for government. 6. The SRC has to be compared to several bank levies currently debated. The Financial Transaction Tax (FTT) does not directly address systemic risk and is therefore inferior to a SRC. Nevertheless, a FTT may offer the opportunity to subsidize on-exchange trading at the expense of off-exchange (over-the-counter, OTC) transactions, thereby enhancing financial market stability. The Financial Activity Tax (FAT) is similar to a VAT on financial services. It is the least adequate instrument among all instruments discussed above to limit systemic risk. 7. Bank resolution regime: No instrument to contain systemic risk can be effective unless the restructuring of bank debt, and the ensuing loss given default to creditors, is a real possibility. As the crisis has taught, bank restructuring is very difficult in light of contagion risk between major banks. We therefore need a regulatory procedure that allows winding down banks, even large banks, on short notice. Among other things, the procedure will require to distinguish systemically relevant exposures from those that are irrelevant. Only the former will be saved with government money, and it will then be the task of the supervisor to ensure a sufficient amount of nonsystemically relevant debt on the balance sheet of all banks. 8. Further issues discussed in this policy paper and its appendices refer to the necessity of a global level playing field, or the lack thereof, for these new regulatory measures; the convergence of our SRC proposal with what is expected to be long-term outcome of Basle III discussions; as well as the role of global imbalances.

(2) Es ist nicht sicher, dass die Errichtung der neuen Europäischen Aufsichtbehörden ohne entsprechende Änderung des Primärrechts zulässig ist. (3) Es kommt entscheidend darauf an, welche rechtsverbindlichen Einzelweisungsbefugnisse tatsächlich den Behörden verliehen werden. (4) Die nach dem Kompromiss vom 2. Dezember 2009 noch verbliebenen Einzelweisungsbefugnisse der Behörden gegenüber Privaten und gegenüber nationalen Aufsichtsbehörden sind rechtlich kaum abgesichert. (5) Wenn die hoheitlichen Befugnisse weitgehend oder vollständig beseitigt werden, bestehen Bedenken im Hinblick auf die Geeignetheit und Erforderlichkeit der Einrichtungen. (6) Die weitreichenden Unabhängigkeitsgarantien sind nicht mit den Anforderungen demokratischer Aufsicht und Kontrolle zu vereinbaren. (7) Für die Einräumung von Unabhängigkeit ist nach deutschem Verfassungsrecht eine ausdrückliche Regelung in der Verfassung, wie in Art. 88 Satz 2 GG, erforderlich. (8) Die transnationale Kooperation von Verwaltungsbehörden bedarf zumindest dann einer gesetzlichen Ermächtigung, wenn faktisch verbindliche Entscheidungen getroffen werden.
Das vergangene Jahr hat uns ein neues Schuldverschreibungsgesetz beschert. Dadurch wurde das alte „Gesetz betreffend die gemeinsamen Rechte der Besitzer von Schuldverschreibungen“ vom 14. 12. 1899 abgelöst, dem praktisch keine große Bedeutung zukam. Einen Vorläufer haben diese Gesetze im preußischen Schuldverschreibungsgesetz, das Friedrich Wilhelm III. am 17. 6. 1833 für die preußische Monarchie in Kraft gesetzt hat. Dieses Gesetz, das bisher selbst in historischen Darstellungen des Schuldverschreibungsrechts kaum gewürdigt wird, ist aus mehreren Gründen von Interesse. Zum einen hatte die zeitgenössische Geldtheorie die Bedeutung des Papiergeldes und die angemessene Rolle des Staates bei der Schöpfung von Papiergeld und der Kontrolle der Geldmenge noch nicht erfaßt. Verschiedene Konzepte wurden erörtert und waren auch in der Praxis der Staaten anzutreffen. Noten privater Zettelbanken waren ebenso im Umlauf wie staatliche Schatzanweisungen und Schuldverschreibungen ohne und mit Gold- oder Silberdeckung. Mit dem Schuldverschreibungsgesetz von 1833 unterwarf Preußen die Emission von Schuldverschreibungen einschließlich der Noten privater Banken einer Genehmigungspflicht. Parallel hierzu findet sich eine auf wenige Einzelfälle beschränkte Bewilligung an „staatsnahe“ Banken, Banknoten auszugeben, die von staatlichen Stellen als Zahlungsmittel angenommen werden oder mit denen Steuerschulden beglichen werden mußten. Mit diesen parallelen Maßnahmen hat die Staatsführung Preußens im Vormärz den in der Literatur debattierten und politisch vielfach befürworteten Weg eines Wettbewerbs privater Papiergeldemittenten („Zettelbanken“) verworfen. Letzten Endes hat sie sich damit das Emissionsmonopol nicht nur für Metallgeld, sondern auch für Papiergeld und die Steuerung der Geldmenge aus papiergeldähnlichen privaten Banknoten gesichert. Ein weiterer leitender Gesichtspunkt bei der Abfassung des Schuldverschreibungsgesetzes war die Lenkung des privaten Anlagekapitals. Preußen wollte im Wettbewerb mit ausländischen Staaten um anlagesuchendes Kapital nicht ins Hintertreffen geraten und unterstellte deshalb auch die Emission und den Umlauf ausländischer Schuldverschreibungen im Inland der Genehmigungspflicht. Schließlich enthält das Schuldverschreibungsgesetz von 1833 auch privatrechtliche Vorschriften zum Schutz der Investoren. Obwohl seit langem Inhaberpapiere im Umlauf waren und sich auch das preußische ALR von 1794 mit Einzelfragen der Übertragung solcher Papiere, ihrer Vindikation, Amortisation und Funktion als Zahlungsmittel befaßt hatte,5 war bis dahin kein konsistentes Konzept entwickelt worden, das eine überzeugende und bruchfreie Lösung der praktisch auftretenden Fragen zur Rechtsstellung der Beteiligten – Aussteller, erster Nehmer und spätere Investoren – gestattet hätte. Auch das Schuldverschreibungsgesetz von 1833 stellt insoweit nur eine weitere Zwischenetappe dar, die in der Entwicklung dieser Finanzierungsinstrumente erreicht wurde. Die vorliegende Studie versucht, die angedeuteten Linien nachzuzeichnen.
In den Jahren 2006-2007 wurde die epiphytische Flechtenflora im Nordbezirk Moskaus erneut untersucht, um sie mit den Ergebnissen aus den Untersuchungen der Jahre 1988-1991 zu vergleichen. Statt 18 konnten nun 55 Flechtenarten nachgewiesen werden. Als Hauptursache für diese Zunahme wird die erhöhte Eutrophierung der Standorte angenommen.
ZUSAMMENFASSUNG UND ERGEBNISSE (1) Die Schaffung des Europäischen Ausschusses für Systemrisiken stößt nicht auf durchgreifende rechtliche Bedenken. (7) Für die Einräumung von Unabhängigkeit ist nach deutschem Verfassungsrecht eine ausdrückliche Regelung in der Verfassung, wie in Art. 88 Satz 2 GG, erforderlich. (8) Die transnationale Kooperation von Verwaltungsbehörden bedarf zumindest dann einer gesetzlichen Ermächtigung, wenn faktisch verbindliche Entscheidungen getroffen werden.
Zusammenfassung und Ergebnisse Es ist noch zu früh, eine abschließende Bewertung der Entwicklung auf den Finanzmärkten während der letzten zwei Jahre vorzunehmen. In jedem Fall sind aber alle Regelungen auf den Prüfstand zu stellen. Das Aufsichtsrecht hat insgesamt seine Aufgabe, Finanzstabilität zu gewährleisten, nicht erfüllt. Wesentliche Schritte für eine grundlegende Reform sind: - ein striktes Verständnis des Aufsichtsrechts als Sonderordnungsrecht - eine drastische Reduktion der Komplexität der Rechtsvorschriften - die Internationalisierung und Europäisierung der Aufsicht - die Steigerung der Transparenz der Verbriefung einschließlich eines möglichen Zulassungsverfahrens und des Verbots bestimmter gefährlicher „Produkte“ - die vollständige Neuausrichtung der Bewertung von Finanzunternehmen und ihrer „Produkte“ („ratings“) - Die Schaffung geeigneter Regeln und Verfahren, um auch systemisch relevante Institutionen der Marktdisziplin, also ihrem Untergang, auszusetzen - Die Grundlage für kurzfristige Entscheidung über Fortführung, Zerlegung oder Abwicklung eines Instituts als Maßnahme der Gefahrenabwehr muss geschaffen werden. Ein Sonderinsolvenzrecht für Banken ist nicht angezeigt - Die Einbeziehung des menschlichen Verhaltens und der Persönlichkeitsstruktur der maßgebenden Personen in den Finanzinstitutionen
Die Herausbildung normativer Ordnungen : zur Idee eines interdisziplinären Forschungsprogramms

Ein geistes- und sozialwissenschaftliches Forschungsprogramm betritt mit der These, dass wir in einer Zeit tiefgreifender sozialer Veränderungen leben, kein Neuland. Ein thematischer Fokus auf die Frage der Herausbildung normativer Ordnungen mit Bezug auf die entsprechenden Verschiebungen, Umbrüche und Konflikte in verschiedenen Gesellschaften und auf transnationaler Ebene bringt dagegen etwas Neues und Wichtiges ans Licht. Das ist jedenfalls unsere Überzeugung.
Der Deutsche Corporate Governance – Kodex empfiehlt seit seiner jüngsten Änderung im Juni 2009, dass der Aufsichtsrat auf die „Unabhängigkeit“ eines von ihm herangezogenen externen Vergütungsberaters achten soll. Dieses Unabhängigkeitserfordernis wirft mehrere Fragen auf, denen im Folgenden nachgegangen werden soll. Außerdem entwickelt der Beitrag Vorschläge, wie Aufsichtsrat und Vergütungsberater verfahren sollten, um der Empfehlung des Corporate Governance-Kodex zu genügen.
This paper presents a model to analyze the consequences of competition in order-flow between a profit maximizing stock exchange and an alternative trading platform on the decisions concerning trading fees and listing requirements. Listing requirements, set by the exchange, provide public information on listed firms and contribute to a better liquidity on all trading venues. It is sometimes asserted that competition induces the exchange to lower its level of listing standards compared to a situation in which it is a monopolist, because the trading platform can free-ride on this regulatory activity and compete more aggressively on trading fees. The present analysis shows that this is not always true and depends on the existence and size of gains related to multi market trading. These gains relax competition on trading fees. The higher these gains are, the more the exchange can increase its revenue from listing and trading when it raises its listing standards. For large enough gains from multi-market trading, the exchange is not induced to lower the level of listing standards when a competing trading platform appears. As a second result, this analysis also reveals a cross - subsidization effect between the listing and the trading activity when listing is not competitive. Many studies show that most people are not financially literate and are unfamiliar with even the most basic economic concepts. However, the evidence on the determinants of economic literacy is scant. This paper uses international panel data on 55 countries from 1995 to 2008, merging indicators of economic literacy with a large set of macroeconomic and institutional variables. Results show that there is substantial heterogeneity of financial and economic competence across countries, and that human capital indicators (PISA test scores and college attendance) are positively correlated with economic literacy. Furthermore, inhabitants of countries with more generous social security systems are generally less literate, lending support to the hypothesis that the incentives to acquire economic literacy are related to the amount of resources available for private accumulation. Die vorliegende Arbeit wurde im Rahmen des Forschungsprojekts „Integrierte Analyse von mobilen, organischen Fremdstoffen in Fließgewässern“ (INTAFERE) am Institut für Physische Geographie an der Goethe-Universität Frankfurt erstellt. In INTAFERE wurde das Gefährdungspotenzial von mobilen, organischen Fremdstoffen (MOF) für aquatische Ökosysteme und die natürlichen Wasserressourcen in integrierter und partizipativer Art und Weise untersucht. MOF sind chemische Substanzen, die in Alltagsprodukten enthalten sind und durch unterschiedliche Eintragsfade in unbekannten Mengen in Oberflächengewässer eingetragen werden. Problematisch sind aus Umweltgesichtspunkten ihre Eigenschaften: sie besitzen im Wasser eine hohe Mobilität und sind schwer abbaubar. Dies führt zu einer Persistenz über lange Zeiträume. Für einige dieser Substanzen wurde zudem gezeigt, dass sie in sehr geringen Konzentrationen biologisch aktiv sind und für aquatische Ökosysteme eine Gefahr darstellen. In INTAFERE wurden drei zentrale Ziele verfolgt: Charakterisierung des Problemfeldes MOF, Erzeugung von praxisrelevantem Wissen für das Management von MOF und Entwicklung einer Softwareanwendung, die gesellschaftliche Aushandlungsprozesse durch eine transparente Darstellung der Wirkungszusammenhänge im Problemfeld unterstützt. Um einen Beitrag für die Erfüllung der Ziele zu leisten, war es die Aufgabe der Verfasserin, eine Akteursanalyse und -modellierung durchzuführen sowie Zukunftsszenarien im Bereich der MOF zu entwickeln. Dafür existierte keine adäquate Methodik, daher verfolgt die Dissertation zum einen die Entwicklung einer Methodik und zum anderen deren Anwendung im Kontext des Projektes INTAFERE. Da im Forschungsprozess die Durchführung von Analysen, die wissenschaftliche und gesellschaftliche Sichtweise der Problematik sowie die Erarbeitung von praktischen Lösungen im Mittelpunkt standen, wurde eine transdisziplinäre Herangehensweise gewählt. Ziel war es, eine Methodik zu entwerfen, die sowohl eine Entwicklung von Szenarien als auch eine Modellierung von Handlungsentscheidungen umfasst. Eine Modellierung und Visualisierung von Handlungsentscheidungen ist notwendig, um Strategien für ein Umweltproblem für verschiedene Szenarien zu ermitteln, und damit einen Lernprozess der Stakeholder zu initiieren. Dies wurde mit der transdisziplinären Methode „Akteursbasierte Modellierung“ umgesetzt. Hierbei wurden insbesondere Aspekte der Problemwahrnehmung von Akteuren und deren Darstellung, der partizipativen Szenarienentwicklung sowie der semi-quantitativen Modellierung von Handlungsentscheidungen berücksichtigt. Die Verfasserin hat mit der semi-quantitativen akteursbasierten Modellierung eine Methode erarbeitet und getestet, die bisher unverbundene Komponenten (wie die Software Dynamic Actor Network Analysis (DANA) und die Szenarienentwicklung) zusammenführt. Um Handlungsentscheidungen unter verschiedenen Szenarien zu modellieren hat die Autorin eine sequentielle Modellierung entwickelt, die mit der Software DANA durchgeführt werden kann. Die dafür notwendige Weiterentwicklung von DANA wurde von Dr. Pieter Bots (TU Delft) umgesetzt. Die akteursbasierte Modellierung läuft in drei methodischen Schritten ab: 1. Modellierung von Akteurs-Sichtweisen in Form von Wahrnehmungsgraphen und deren Analyse, aufbauend auf Ergebnissen von qualitativen, leitfaden-gestützten Expertengesprächen (= Akteursmodellierung), 2. partizipative Szenarienentwicklung mit den Akteuren und 3. Zusammenführung der Ergebnisse der Akteursmodellierung und der Szenarienentwicklung und darauf aufbauend eine sequentielle Modellierung von Handlungsentscheidungen und deren Auswirkungen auf Schlüsselfaktoren. Im Zuge der Anwendung auf das Problemfeld der MOF wurde für folgende Akteure jeweils ein Wahrnehmungsgraph modelliert: Obere Wasserbehörde, Umweltbundesamt, Umwelt- und Verbraucherschutzorganisationen, Wasserversorger sowie für die Hersteller von verschiedenen MOF, weiterhin für die European Flame Retardants Association und die Weiterverarbeitende Industrie. Das Ergebnis der Szenarienentwicklung waren vier Szenarien: ein Gesundheitsszenario, unter der Annahme von hohen lokalen Umweltstandards durch nachhaltigkeitsorientierte KonsumentInnen, ein Umweltszenario, in dem eine starke Regulierung und nachhaltigkeitsorientierter Konsum Hand in Hand gehen, ein Globalisierungsszenario, in dem Wirtschaftsmacht und preisbewusste KonsumentInnen statt staatliche Regulierung vorherrschen und ein Technikszenario, unter der Annahme, dass Kläranlagen, bedingt durch eine starke Regulierung, aufgerüstet werden. Bei der Modellierung von Handlungsentscheidungen wurden die Wahrnehmungsgraphen und die vier Szenarien miteinander verknüpft. Pro Substanz wurde ein Modell entwickelt, welches die wichtigsten Systemkomponenten in einer angemessenen Komplexität umfasst und die von den Akteuren gemeinsam getragene Einschätzung der Wirkungsbeziehungen darstellt. Insgesamt wurden 16 Modelle entwickelt. Basierend auf den simulierten Akteurshandlungen wurden relativen Veränderungen der Schlüsselfaktoren Produktion, Import und Leistungsfähigkeit der Kläranlagen für die vier genannten Szenarien berechnet. In Zusammenarbeit mit Pieter Bots konnten algorithmische Beiträge zur Analyse- und Modellierungssoftware DANA getestet und verbessert werden. Da keine vollständige und zugleich leicht verständliche Einführung zu DANA vorlag, wurde für Nutzer im Rahmen dieser Dissertation eine Anleitung verfasst, die die Modellierung von Wahrnehmungsgraphen und deren Analyse sowie alle Schritte der akteursbasierten Modellierung mit DANA erläutert.

We study alternative scenarios for exiting the post-crisis fiscal and monetary accommodation using the model of Angeloni and Faia (2010), that combines a standard DSGE framework with a fragile banking sector, suitably modified and calibrated for the euro area. Credibly announced and fast fiscal consolidations dominate – based on simple criteria – alternative strategies incorporating various degrees of gradualism and surprise. The fiscal adjustment should be based on spending cuts or else be relatively skewed towards consumption taxes. The phasing out of monetary accommodation should be simultaneous or slightly delayed. We also find that, contrary to widespread belief, Basel III may well have an expansionary macroeconomic effect. We examined financial literacy among the young using the most recent wave of the 1997 National Longitudinal Survey of Youth. We showed that financial literacy is low; fewer than one-third of young adults possess basic knowledge of interest rates, inflation, and risk diversification. Financial literacy was strongly related to sociodemographic characteristics and family financial sophistication. Specifically, a college-educated male whose parents had stocks and retirement savings was about 45 percentage points more likely to know about risk diversification than a female with less than a high school education whose parents were not wealthy. This paper analyzes loan pricing when there is multiple banking and borrower distress. Using a unique data set on SME lending collected from major German banks, we can instrument for effective coordination between lenders, carrying out a panel estimation. The analysis allows to distinguish between rents that accrue due to single bank lending, rents that accrue due to relationship lending, and rents that accrue due to the elimination of competition among multiple lenders. We find the relationship lending to have no discernible impact on loan spreads, while both single lending and coordinated multiple lending significantly increase the spread. Thus, contrary to predictions in the literature, multiple lending does not insure the borrower against hold-up. JEL Classification: D74, G21, G33, G34
How ordinary consumers make complex economic decisions: financial literacy and retirement readiness

This paper explores who is financially literate, whether people accurately perceive their own economic decision-making skills, and where these skills come from. Self-assessed and objective measures of financial literacy can be linked to consumers’ efforts to plan for retirement in the American Life Panel, and causal relationships with retirement planning examined by exploiting information about respondent financial knowledge acquired in school. Results show that those with more advanced financial knowledge are those more likely to be retirement-ready.

Der vorliegende Medienkoffer "Judentum" verdankt sich der Einsicht, dass auch und gerade in einer Informationsgesellschaft sich die Wirklichkeit von sozialen, gesellschaftlichen oder religiösen Gegebenheiten nicht in der audiovisuellen Information über sie erschöpft. Anders gesagt: keine noch so ausgefeilte und beeindruckende Form elektronischer "Virtualität" kann die sinnliche Erfahrung von Dingen, Situationen und Menschen ersetzen; denn in "echt" ist alles noch einmal anders, manchmal sogar ganz anders.
Markt- und wettbewerbsorientierte Reformstrategien in den Krankenhaussystemen zahlreicher Industrieländer haben Befürchtungen vor einer kommerzialisierten Krankenhausversorgung hervorgebracht. Dieser Beitrag unterbreitet einen analytischen Interpretationsrahmen zur Erklärung der internationalen Verbreitung dieser Reformstrategien und versucht die behaupteten negativen Effekte von Kommerzialisierungsprozessen auf Versorgungsqualität und Zugänglichkeit zu untersuchen. Gestützt auf einen Vergleich eines idealtypischen Kommerzialisierungsmodells mit dem institutionellen und organisatorischen Wandel im deutschen Krankenhaussystem kommt der Beitrag zu dem Schluss, dass Kommerzialisierungsprozesse in der Krankenhausversorgung bislang noch begrenzt sind. Obwohl ein markt- und wettbewerbsbasierter Umbau der Governancestrukturen zu beobachten ist und Krankenhäuser zu einer Kommerzialisierungsstrategie gedrängt werden, lässt sich aufgrund einer unzureichenden Daten- und Forschungslage bislang nicht empirisch feststellen, ob die Kommerzialisierungsprozesse zu einer Verschlechterung der Qualität und Zugänglichkeit der Krankenhausversorgung geführt haben.
Das Diskussionspapier versucht Dimensionen und Ausmaße von Ökonomisierungs- und Kommerzialisierungsprozessen in OECD-Gesundheitssystemen explorativ zu erörtern. Hierzu wird zunächst die Hypothese entwickelt, dass sich in den (meisten) OECD-Staaten eine hegemoniale gesundheitspolitische Strategie herausbildet, die als wettbewerbsbasierte Kostendämpfungspolitik bezeichnet wird. In der Folge werden die (mutmaßlichen) Auswirkungen von Ökonomisierungs- und Kommerzialisierungsprozessen diskutiert. Erstens wird beschrieben, wie die Monetarisierung der Arzt-Patienten-Beziehung zu einer Privatisierung des Gesundheitssystems führt. Zweitens wird die sich transformierende Arzt-Patienten-Beziehung als Dialektik von Demokratisierungs- und Ökonomisierungsprozessen dargestellt. Drittens beschäftigt sich der Beitrag mit Entwicklung einer neuen Gesundheitskultur, die die gesundheitliche Eigenverantwortung des Einzelnen betont, zugleich jedoch neuen Ausgrenzungs- und Stigmatisierungsprozessen den Weg zu ebnen droht. Abschließend wird ein in groben Zügen ein Forschungsprogramm umschrieben, welches Ökonomisierungs- und Kommerzialisierungsprozesse auf diesen drei Forschungsfeldern analytisch und bewertend unter die Lupe zu nehmen versucht.

On the backdrop of the 2008 financial crisis this paper introduces an understanding of societal crises as a reduction in the meaning production of social entities, which can either be internally or externally provoked. The emergence of constitutions and, more generally, constitutional structures, can be understood as responses to both forms of crisis. This is the case because they are double-edged structures which are simultaneously oriented towards the maintenance of internal order and stability within a given social entity at the same time as they frame the transfer of the meaning components between the social entities and their environments. Thus, the 2008 financial crisis indicates a failure of constitutional bonding. When observed from an overall structural perspective, the reasons for this failure can be traced back to an increased discrepancy between the structural composition of world society and the constitutional structures in place. The crisis reflects a failure to respond to two simultaneous, inter-related and mutually re-inforcing structural transformations. First, there is the increased globalisation, which has led to massive dis-locations in the relative centrality of the different national configurations for the reproductive processes of functional systems. Second, there is a structural transformation of the transnational layer of world society through a reduced reliance on the centre/periphery differentiation and an increased reliance on functional differentiation. One of the many consequences of this development is the emergence of new forms of transnational law and politics. A new constitutional architecture which reflects these transformations is needed in order to ensure an adequate constitutional bonding of economic processes, as well as of other social processes.

Measuring confidence and uncertainty during the financial crisis : evidence from the CFS survey

The CFS survey covers individual situations of banks and other companies of the financial sector during the financial crisis. This provides a rare possibility to analyze appraisals, expectations and forecast errors of the core sector of the recent turmoil. Following standard ways of aggregating individual survey data, we first present and introduce the CFS survey by comparing CFS indicators of confidence and predicted confidence to ifo and ZEW indicators. The major contribution is the analysis of several indicators of uncertainty. In addition to well established concepts, we introduce innovative measures based on the skewness of forecast errors and on the share of ‘no response’ replies. Results show that uncertainty indicators fit quite well with pattern of real and financial time series of the time period 2007 to 2010. We assess, through VAR evidence, the effects of monetary policy on banks’ risk exposure and find the presence of a risk-taking channel. A model combining fragile banks prone to risk mis-incentives and credit constrained firms, whose collateral fluctuations generate a balance sheet channel, is used to rationalize the evidence. A monetary expansion increases bank leverage. With two consequences: on the one side this exacerbates risk exposure; on the other, the risk spiral depresses output, therefore dampening the conventional amplification effect of the financial accelerator.
During the last decades households in the U.S. have experienced that residential house prices move in a persistent manner, i.e. that returns are positively serially correlated. Since an owner-occupied home is usually the largest investment of a household it is important to understand how households act when they base their consumption and investment decisions on this experience. We show in a setting with housing market cycles and households who can decide whether they rent or own the home, that - besides the consumption and the precautionary savings motive - serial correlation in house prices generates a new speculative motive for homeownership. In particular, we show how good and bad housing market cycles affect homeownership rates, leverage, stock investments and consumption and can explain empirically observed household behavior during housing market boom and bust periods. The first part of the following paper deals with varying points of criticism forwarded against Ordoliberalism. Here, it is not the aim to directly falsify each argument on its own; rather, the author tries to give a precise overview of the spectrum of critique. The second section picks out one argument of critical review – namely that the ordoliberal concept of the state is somewhat elitist and grounded on intellectual experts. Based on the previous sections, the final part differentiates two kinds of genesis of norms: an evolutionary and an elitist one – both (latently) present within Ordoliberalism. In combination with the two-level differentiation between individual and regulatory ethics, the essay allows for a distinction between individual-ethical norms based on an evolutionary genesis of norms and regulatory-ethical norms based on an elitist understanding of norms. A by-product of the author’s argument is a (further) demarcation within neoliberalism.
All of the papers in the volume except one (Kaji) take up some aspect of relative clause construction in some Bantu language. Kaji’s paper aims to account for how Tooro (J12; western Uganda) lost phonological tone through a comparative study of the tone systems of other western Uganda Bantu languages. The other papers examine a range of ways of forming relative clauses, often including non-restrictive relatives and clefts, in a wide range of languages representing a variety of prosodic systems.
Improvements in water infrastructure in developing countries are of major importance for achieving access to clean water. CuveWaters, a research based IWRM project, currently underway in Namibia, is testing different technical options to de-centralise water supply and upgrade sanitation. The Cuvelai Basin is affected by highly variable precipitation, mostly saline groundwater and a lack of perennial rivers. Water management is characterised by strong dependency on a water pipeline. Finding ways to improve the situation calls for a good grasp of the local situation regarding water utilisation patterns. Technologically sophisticated concepts can easily clash with users’ socio-cultural needs and everyday behaviour as well as their understanding of planning and maintenance. A demand-responsive approach has therefore been developed. It combines a qualitative socio-empirical perspective with participatory planning. This paper discusses method development, empirical application and results. The approaches aim is to support mutual learning as a basis for a sustainable change process.
Die fragmentierte Verrechtlichung des internationalen Raums, die Proliferation von Regelungsarrangements jenseits des Staates und die Diffusion globaler Normen sowie die daraus resultierenden Geltungs-, Kompetenz- und Autoritätskonflikte sind seit geraumer Zeit ein in der sozialwissenschaftlichen Literatur viel diskutiertes Phänomen. Überlappungen von nationalen Regierungssystemen und von im Völkerrecht verankerten klassischen internationalen Regimen existieren seit der Schaffung des Westfälischen Staatensystems.In jüngerer Zeit verstärkte sich der Pluralismus normativer Ordnungen jedoch global durch neuartige Typen von Regelungsarrangements jenseits des Staates. Auch unter den zwischenstaatlich geschaffenen internationalen Institutionen finden sich solche, die autonome Handlungs- und Entscheidungskompetenzen zugesprochen bekommen haben und diese als Akteure mit eigener Subjektivität ausüben. Hinzu kommt eine immer stärkere Aufnahme von „behind the border issues“ in den Aufgabenkatalog dieser Regime und Organisationen (Zürn 2004). Diese Entwicklungen führen zu einem neuen Grad an Kontestation und Umstrittenheit globaler normativer Ordnungen. Weder die Herstellung einer einheitlichen globalen normativen Ordnung noch eine Re-Nationalisierung des Rechts erscheinen heute als realistische Zukunftsprognosen. Umso wichtiger ist es daher, sich mit den Auswirkungen dieses Pluralismus’ normativer Ordnungen zu beschäftigen.
Die fragmentierte Verrechtlichung des internationalen Raums, die Proliferation von Regelungsarrangements jenseits des Staates und die Diffusion globaler Normen sowie die daraus resultierenden Geltungs-, Kompetenz- und Autoritätskonflikte sind seit geraumer Zeit ein in der sozialwissenschaftlichen Literatur viel diskutiertes Phänomen. Überlappungen von nationalen Regierungssystemen und von im Völkerrecht verankerten klassischen internationalen Regimen existieren seit der Schaffung des Westfälischen Staatensystems.In jüngerer Zeit verstärkte sich der Pluralismus normativer Ordnungen jedoch global durch neuartige Typen von Regelungsarrangements jenseits des Staates. Auch unter den zwischenstaatlich geschaffenen internationalen Institutionen finden sich solche, die autonome Handlungs- und Entscheidungskompetenzen zugesprochen bekommen haben und diese als Akteure mit eigener Subjektivität ausüben. Hinzu kommt eine immer stärkere Aufnahme von „behind the border issues“ in den Aufgabenkatalog dieser Regime und Organisationen (Zürn 2004). Diese Entwicklungen führen zu einem neuen Grad an Kontestation und Umstrittenheit globaler normativer Ordnungen. Weder die Herstellung einer einheitlichen globalen normativen Ordnung noch eine Re-Nationalisierung des Rechts erscheinen heute als realistische Zukunftsprognosen. Umso wichtiger ist es daher, sich mit den Auswirkungen dieses Pluralismus’ normativer Ordnungen zu beschäftigen.
This paper provides theory as well as empirical results for pre-averaging estimators of the daily quadratic variation of asset prices. We derive jump robust inference for pre-averaging estimators, corresponding feasible central limit theorems and an explicit test on serial dependence in microstructure noise. Using transaction data of different stocks traded at the NYSE, we analyze the estimators’ sensitivity to the choice of the pre-averaging bandwidth and suggest an optimal interval length. Moreover, we investigate the dependence of pre-averaging based inference on the sampling scheme, the sampling frequency, microstructure noise properties as well as the occurrence of jumps. As a result of a detailed empirical study we provide guidance for optimal implementation of pre-averaging estimators and discuss potential pitfalls in practice. We study price pressures in stock prices—price deviations from fundamental value due to a risk-averse intermediary supplying liquidity to asynchronously arriving investors. Empirically, twelve years of daily New York Stock Exchange intermediary data reveal economically large price pressures. A $100,000 inventory shock causes an average price pressure of 0.28% with a half-life of 0.92 days. Price pressure causes average transitory volatility in daily stock returns of 0.49%. Price pressure effects are substantially larger with longer durations in smaller stocks. Theoretically, in a simple dynamic inventory model the ‘representative’ intermediary uses price pressure to control risk through inventory mean reversion. She trades off the revenue loss due to price pressure against the price risk associated with remaining in a nonzero inventory state. The model’s closed-form solution identifies the intermediary’s relative risk aversion and the distribution of investors’ private values for trading from the observed time series patterns. These allow us to estimate the social costs—deviations from constrained Pareto efficiency—due to price pressure which average 0.35 basis points of the value traded. A logical framework consisting of a polymorphic call-by-value functional language and a first-order logic on the values is presented, which is a reconstruction of the logic of the verification system VeriFun. The reconstruction uses contextual semantics to define the logical value of equations. It equates undefinedness and non-termination, which is a standard semantical approach. The main results of this paper are: Meta-theorems about the globality of several classes of theorems in the logic, and proofs of global correctness of transformations and deduction rules. The deduction rules of VeriFun are globally correct if rules depending on termination are appropriately formulated. The reconstruction also gives hints on generalizations of the VeriFun framework: reasoning on nonterminating expressions and functions, mutual recursive functions and abstractions in the data values, and formulas with arbitrary quantifier prefix could be allowed.
The interactive verification system VeriFun is based on a polymorphic call-by-value functional language and on a first-order logic with initial model semantics w.r.t. constructors. It is designed to perform automatic induction proofs and can also deal with partial functions. This paper provides a reconstruction of the corresponding logic and semantics using the standard treatment of undefinedness which adapts and improves the VeriFun-logic by allowing reasoning on nonterminating expressions and functions. Equality of expressions is defined as contextual equivalence based on observing termination in all closing contexts. The reconstruction shows that several restrictions of the VeriFun framework can easily be removed, by natural generalizations: mutual recursive functions, abstractions in the data values, and formulas with arbitrary quantifier prefix can be formulated. The main results of this paper are: an extended set of deduction rules usable in VeriFun under the adapted semantics is proved to be correct, i.e. they respect the observational equivalence in all extensions of a program. We also show that certain classes of theorems are conservative under extensions, like universally quantified equations. Also other special classes of theorems are analyzed for conservativity.

We also proved that universally quantified equations are conservative, i.e. if a universally quantified equation is valid w.r.t. a program P, then it remains valid if the program is extended by new functions and/or new data types.
