El testamento representa uno de los géneros de fuente archivística más ricos para el desarrollo de diversos temas de investigación en la época colonial hispanoamericana. Durante mucho tiempo la historia política, legal y social de las Indias solía tener en cuenta testamentos de individuos o grupos particulares, pero por lo general se trataba de españoles. Salvo algunas excepciones, como en el caso de ciertos miembros de la nobleza indígena, no había estudios etnohistóricos sobre los documentos de última voluntad referidos a la población autóctona. Sólo a partir de la década de 1980, comenzaron a ser trabajadas de una manera más sistemática este tipo de fuentes por parte de algunos investigadores mesoamericanistas. Gracias, en particular, al interés lingüístico de la »New Philology« en este tipo de textos, a menudo redactados en náhuatl u otros idiomas prehispánicos (maya, mixteco), se han venido preparando ediciones críticas de un gran número de testamentos procedentes del México central. En los Andes coloniales, por el contrario, los escribanos registraron testamentos en castellano y no en idiomas indígenas (como quechua, aymara o guaraní). Aunque historiadores del virreinato peruano también analizaron y transcribieron testamentos indígenas en algunos de sus estudios, durante el siglo XX no se publicaron ediciones similares. ...
Die Gegenwart ist heimlicher Komplize der Geschichtsschreibung. Also war nach seinem Standardwerk "A History of American Law" (1973) vom Nestor der amerikanischen Rechtsgeschichte, Lawrence M. Friedman, eine autoritative Fortsetzung zu erwarten. Mit "American Law in the Twentieth Century" liegt sie vor. Fesselnd geschrieben, in die Hand eines jeden Studierenden gehörend, wie es heißt, wirft das umfangreiche Werk – Komplizenschaft hin oder her – eine Reihe von Fragen auf. Warum gerade das 20. Jahrhundert? Waren 1900 und 2000 Schwellenjahre, die den Beginn und das Ende einer diskreten Entwicklungsphase des amerikanischen Rechts markieren? Vielleicht dessen Moderne oder gar Postmoderne? Geprägt von normativen Leitprinzipien oder gesellschaftlichen Umbrüchen? – Der Reihe nach. ...
"In the beginning all the World was America" reads the iconic opening of § 49 in John Locke’s Second Treatise of Government. Beyond mentioning "America", Locke’s theory and the story told by Juan Pablo Scarfi in The Hidden History of International Law in the Americas share an unsettling resemblance. The expansion of international law and the deepening of legal techniques for the purposes of US hegemony in the American hemisphere, the invasion of politics by the language of science, the double standard, one of real military and monetary interventions, and another of (usually) suave diplomatic correspondence about the advantages of pan-Americanism, all are part and parcel of The Hidden History. Moreover, around the mid-20th century the pattern extended around the entire globe. Therefore, as Scarfi elegantly suggests, the interventions in Latin America by the newly established US empire in the early 20th century had the nature of laboratory experiments. In the end, all the world was America again, but with a good number more of international organizations, institutions devoted to the scientific study of international law, and international legal norms and principles. This image, of course, simplifies tremendously the complex history of the past century. However, it summarizes the message of Scarfi’s book. ...
Das hier zu besprechende Buch des an der Yale-University lehrenden Rechtshistorikers James Q. Whitman ist in Amerika mit großer Zustimmung besprochen worden, und zwar mit Recht, besonders wegen seiner Fragestellung und der Sorgfalt ihrer Bearbeitung. Der deutsche Leser gewinnt dabei den Eindruck, dass die inneramerikanische Zustimmung den Nebensinn hat, die amerikanische Gesellschaft solle nicht nur auf das rassistische Nazi-Deutschland zeigen, sondern auch die eigene Vergangenheit und Gegenwart kritisch reflektieren. ...
As the numbers of people moving internationally increased in the nineteenth and early twentieth centuries, states tried more rigorously to regulate borders and counteract the problem of fugitives crossing international borders to evade arrest. This presented a legal challenge to domestic state power that increasingly defined its sovereignty on jurisdiction within borders. It is this issue and within this important era of globalization and law formation that Bradley Miller’s book examines how British North American colonies and post-Confederation Canada reacted to the problems posed by international fugitives through ideas and practices of extradition. His work goes beyond the traditional perspective of examining extradition treaties to view the practices of extradition in action, the everyday challenges states faced, and how the key concepts of sovereignty and international law were understood in relation to extradition. ...
Die Frage nach Konflikten zwischen den Rechtskulturen der USA und Deutschlands wirft ein kürzlich erschienener zweisprachiger Sammelband auf. Wer aber so fragt, der fragt nach mehr als Differenz. Er sucht nach Differenz in Interaktion, in der unterschiedliche Geltungsansprüche gleichzeitig erhoben werden. Sonst ginge es um das weniger abenteuerliche Vergleichen eines Nebeneinander. Leider bleibt die Publikation der Bayerischen Amerika-Akademie aber hierbei stehen und streift die emphatische Frage ihres deutschen Titels nur in Einzelbeobachtungen. Der Einfluss des amerikanischen Rechts in vielen internationalen Verträgen – Ausdruck der politischen Hegemonialstellung der USA – und die Dominanz amerikanischer Juristen in der internationalen Schiedsgerichtsbarkeit – Ausdruck der wirtschaftlichen Bedeutung der USA – hätten jedoch Anlass gegeben, immunologische Reaktionen an lebenden Rechtskörpern zu studieren. So aber bleibt es bei der In-vitro-Insemination des deutschen Lesers mit Hinweisen darauf, dass und warum die anderen es anders machen (etwa in Beiträgen zur Kriminalprävention von Streng und Kelling oder zum Jugendstrafrecht von Silverman). In letzterem, in kulturhistorischen Erklärungsversuchen des Warum, findet der Band freilich seinen gedanklichen Schwerpunkt und einige interessante Einsichten.
