Die Untersuchung hat gezeigt, daß der Handel mit Bezugsrechten von Todkranken eine sinnvolle, weil dem Betroffenen helfende, Entwicklung darstellen kann. Gleichwohl darf nicht übersehen werden, daß dieser Möglichkeit der Kapitalanlage ein gewisser moralischer Makel anhaftet. Jedoch konnten grundsätzliche rechtliche Hindernisse nicht aufgezeigt werden. Gleichwohl wurden Beispiele dafür angeführt, wie dieser Handel zu mißbräuchlichen Verhaltensweisen führen kann. Jedenfalls verdeutlicht die Entwicklung der "Viatical Settlements", daß der Kapitalmarkt nach weiterer Vervollständigung strebt und mit diesem Instrument eine alternative Verwertung laufender Kapital-Lebensversicherungsverträge geschaffen, sowie erstmals auch für Risiko-Lebensversicherungsverträge den Zugang zum Kapitalmarkt eröffnet hat. Letztlich bleibt aber die Entscheidung, ob es sich hierbei um ein erfolgsversprechendes Beispiel der Innovationskraft des Kapitalmarktes handelt, in erster Linie den potentiellen Investoren und Anbietern von Rechten aus Lebensversicherungsverträgen vorbehalten. Abschließend sei angemerkt, daß mit Hilfe dieses Handels jedenfalls auf ein gesellschaftliches Problem aufmerksam gemacht wird. Gleichwohl muß die Lösung keineswegs zwingend in dem hier aufgezeichneten Weg einer Etablierung von "Viatical Settlements" liegen. Angesichts der dargestellten moralischen Bedenken wäre es wünschenswert, wenn durch Vertragsgestaltungen, die in dem Endstadium der tödlichen Krankheit eine finanzielle Absicherung des Versicherungsnehmer gewährleisten, Viatical Settlements in Deutschland entbehrlich würden.
Die SPD-Bundestagsfraktion hat im Januar 1995 den Entwurf eines "Transparenz- und Wettbewerbsgesetzes" vorgelegt1. In ihm wird vorgeschlagen, Kreditinstituten und Versicherungen die Beteiligung an Kapitalanlagegesellschaften zu untersagen2. Ein entsprechender Vorschlag ist auf dem 61. Deutschen Juristentag in Karlsruhe gestellt, dort aber mit großer Mehrheit abgelehnt worden3. Im folgenden sollen die Argumente für und wider eine solche Regulierung auf der Grundlage empirischer Daten erörtert werden.
Die vorstehenden Betrachtungen verfolgten das primäre Ziel, das Interesse auf einen bislang weitgehend unbeachteten Teil des Derivate-Marktes zu lenken, nämlich auf Fonds-Optionen. Auch wenn das deutsche Investmentrecht einheimischen Kapitalanlagegesellschaften sowohl für die Verwaltung des eigenen wie des Fondsvermögens die Teilhabe an diesem Marktsegment eingeschränkt, lassen die aufgezeigten Möglichkeiten (z.B. individuelle Absicherungskonzepte, limitierte Kauf-/Verkauforders sowie das Management von Investmentfondsanteil-Sondervermögen) erwarten, daß in Zukunft auch Fonds-Derivate integraler Bestandteil einer Fondsanlage werden. Soweit sich diese 12 auf Fonds-Indizes beziehen, mag der Hinweis auf komplexere Formen andeuten, daß dieser Bereich ebenfalls noch unterentwickelt ist. Auch wenn dies nicht angesprochen wurde, ist es angesichts des Volumens in Fonds investierter Mittel keineswegs abwegig, auch über den Nutzen weiterer Derivate, z.B. Fonds-Swaps, nachzudenken.
Hält man sich die Zahl der in Deutschland zum Vertrieb zugelassenen Publikumsfonds vor Augen, scheinen die in den Anfängen des Investmentsparens geäußerten Vorzüge des Investmentsparens’ ad absurdum geführt. So muß der Anleger allein im Bereich deutscher Aktien inzwischen aus mehr als 122 verschiedenen Fonds2 auswählen. Im Interesse einer Förderung der Transparenz der Fonds wären daher Schritte in Richtung einer Straffung des Fondsangebots wünschenswert. Die Notwendigkeit hierfür wird eindrucksvoll verdeutlicht, wenn man den aufgelösten Fonds die Zahl der neu aufgelegten Fonds gegenüberstellt. So kamen in den letzten Jahren in Deutschland auf jeden aufgelösten drei neue Publikumsfonds.
Background: Inflammation, angiogenesis and oxidative stress have been implicated in the pathogenesis of various vascular diseases. Recent evidence suggests that dimethylfumarate (DMF), an antiposriatic and anti-multiple sclerosis agent, possesses anti-inflammatory, anti-oxidative and anti-angiogenic properties. Here, we analyze the influence of DMF on TNF-α-induced expression of the important pro-inflammatory and pro-atherogenic chemokine MCP-1 and investigate the underlying mechanisms of this expression.
Findings: We analyzed constitutive and TNF-α-induced expression of MCP-1 in human umbilical vascular endothelial cells (HUVEC) +/− DMF treatment via enzyme-linkes immunosorbent assay (ELISA). DMF significantly inhibited the protein expression levels in a time- and concentration-dependent manner. Furthermore, MCP-1 mRNA expression was also reduced in response to DMF, as demonstrated by RT-PCR. Thus, the regulation occurs at the transcriptional level. Interestingly, DMF prolonged the TNF-α-induced p38 and JNK phosphorylation in HUVEC, as demonstrated by Western blot analysis; however, the p38 and JNK inhibitor SB203580 did not affect the DMF-conveyed suppression of TNF-α-induced MCP-1 expression. DMF suppressed the TNF-α-induced nuclear translocation and phosphorylation (Serine 536) of p65 in these cells. These results were additionally approved by p65 luciferase promoter assays. Furthermore, we found that DMF slightly inhibited the early degradation of IκBα. In addition, we verified our results using other important inflammatory cytokines such as CCL-5, PDGF-BB, GM-CSF and IL-6.
Conclusion: DMF suppresses various TNF-α-induced pro-inflammatory and pro-atherogenic cytokines/chemokines in human endothelial cells. This action is regulated by reduced p65 activity and nuclear translocation, which can be explained in part by the reduced early degradation of IκBα and more important the reduced phosphorylation of p65 at Serine 536. These effects were independent of the p38, PI3K and p42/44 signaling pathways. As a result, DMF might be suitable for treating patients with vascular diseases.
Bipolar disorder (BD) is a genetically complex mental illness characterized by severe oscillations of mood and behavior. Genome-wide association studies (GWAS) have identified several risk loci that together account for a small portion of the heritability. To identify additional risk loci, we performed a two-stage meta-analysis of >9 million genetic variants in 9,784 bipolar disorder patients and 30,471 controls, the largest GWAS of BD to date. In this study, to increase power we used ~2,000 lithium-treated cases with a long-term diagnosis of BD from the Consortium on Lithium Genetics, excess controls, and analytic methods optimized for markers on the Xchromosome. In addition to four known loci, results revealed genome-wide significant associations at two novel loci: an intergenic region on 9p21.3 (rs12553324, p = 5.87×10-9; odds ratio = 1.12) and markers within ERBB2 (rs2517959, p = 4.53×10-9; odds ratio = 1.13). No significant X-chromosome associations were detected and X-linked markers explained very little BD heritability. The results add to a growing list of common autosomal variants involved in BD and illustrate the power of comparing well-characterized cases to an excess of controls in GWAS.
Background: As a multi-targeted anti-angiogenic receptor tyrosine kinase (RTK) inhibitor sunitinib (SUN) has been established for renal cancer and gastrointestinal stromal tumors. In advanced refractory esophagogastric cancer patients, monotherapy with SUN was associated with good tolerability but limited tumor response.
Methods: This double-blind, placebo-controlled, multicenter, phase II clinical trial was conducted to evaluate the efficacy, safety and tolerability of SUN as an adjunct to second and third-line FOLFIRI (NCT01020630). Patients were randomized to receive 6-week cycles including FOLFIRI plus sodium folinate (Na-FOLFIRI) once every two weeks and SUN or placebo (PL) continuously for four weeks followed by a 2-week rest period. The primary study endpoint was progression-free survival (PFS). Preplanned serum analyses of VEGF-A, VEGF-D, VEGFR2 and SDF-1α were performed retrospectively.
Results: Overall, 91 patients were randomized, 45 in each group (one patient withdrew). The main grade ≥3 AEs were neutropenia and leucopenia, observed in 56 %/20 % and 27 %/16 % for FOLFIRI + SUN/FOLFIRI + PL, respectively. Median PFS was similar, 3.5 vs. 3.3 months (hazard ratio (HR) 1.11, 95 % CI 0.70–1.74, P = 0.66) for FOLFIRI + SUN vs. FOLFIRI + PL, respectively. For FOLFIRI + SUN, a trend towards longer median overall survival (OS) compared with placebo was observed (10.4 vs. 8.9 months, HR 0.82, 95 % CI 0.50–1.34, one-sided P = 0.21). In subgroup serum analyses, significant changes in VEGF-A (P = 0.017), VEGFR2 (P = 0.012) and VEGF-D (P < 0.001) serum levels were observed.
Conclusions: Although sunitinib combined with FOLFIRI did not improve PFS and response in chemotherapy-resistant gastric cancer, a trend towards better OS was observed. Further biomarker-driven studies with other anti-angiogenic RTK inhibitors are warranted.
Trial registration: This study was registered prospectively in the NCT Clinical Trials Registry (ClinicalTrials.gov) under NCT01020630 on November 23, 2009 after approval by the leading ethics committee of the Medical Association of Rhineland-Palatinate, Mainz, in coordination with the participating ethics committees (see Additional file 2) on September 16, 2009.
Photodynamic treatment of oral squamous cell carcinoma cells with low curcumin concentrations

Objective: Curcumin is known for its anti-oxidative, anti-inflammatory and anti-tumorigenic qualities at concentrations ranging from 3.7µg/ml to 55µg/ml. Therefore it is pre-destined for tumour therapy. Due to high oral doses that have to be administered and the low bioavailability of curcumin new therapy concepts have to be developed. One of these therapy concepts is the combination of low curcumin concentrations and UVA or visible light. Aim of our study was to investigate the influence of this treatment regime on oral squamous cell carcinoma cells.
Materials and Methods: A human oral squamous cell carcinoma cell line (HN) was pre-incubated with low curcumin concentrations (0.01µg/ml to 1µg/ml). Thereafter cell cultures were either left un-irradiated or were irradiated either with 1J/cm2 UVA or for 5min with visible light. Quantitative analysis of proliferation, membrane integrity, oxidative potential and DNA fragmentation were done.
Results: It could be shown that low curcumin concentrations neither influenced proliferation, nor cell morphology, nor cell integrity nor apoptosis. When combining these curcumin concentrations with UVA or visible light irradiation cell proliferation as well as development of reactive oxygen species was reduced whereas DNA fragmentation was increased. Concentration as well as light entity specific effects could be observed.
Conclusions: The present findings substantiate the potential of the combination of low curcumin concentrations and light as a new therapeutic concept to increase the efficacy of curcumin in the treatment of cancer of the oral mucosa.
