Rechtssoziologie am Institut für Sozialforschung Im Mittelpunkt des aktuellen Forschungsprogramms des Frankfurter Instituts für Sozialforschung stehen die Paradoxien und Ambivalenzen der kapitalistischen Modernisierung. Grund legend hierfür ist die Beobachtung, dass sich fortschrittliche soziale Prozesse im Nachhinein unter den Bedingungen einer gewandelten Moderne in ihr Gegenteil verkehren können. Mit dieser These beschäftigt sich auch der Forschungsschwerpunkt »Politische Öffentlichkeit und Recht«. Mit Bezugnahme auf die gegenwärtige Rechtsentwicklung interessiert vor allem die Frage, ob und wie das Recht auf Veränderungen im Verhältnis von Individuum und Gesellschaft und auf die fortschreitende Individualisierung reagiert. Auch interessiert, wie die Rechtsentwicklung im Alltagsverständnis wahrgenommen wird. Antworten auf diese Fragestellungen werden derzeit aus den Ergebnissen des DFG-Projekts »Die Zuschreibung von Verantwortung in den Rechtsmeinungen von Bürgerinnen und Bürgern« wie auch aus der fortlaufenden Diskussion über »Verantwortung und Gerechtigkeit« im Arbeitskreis Rechtssoziologie gewonnen. Im Rahmen des Forschungsprojektes unter der Projektleitung von Prof. Dr. Klaus Günther und Prof. Dr. Axel Honneth wurden in 45 qualitativen, Leitfaden-gestützten Einzelinterviews Befragte um ihre Urteile zu drei vorgegebenen Rechtsfällen gebeten. Der Arbeitskreis Rechtssoziologie beschäftigt sich vor allem mit den in vielen gesellschaftlichen Lebensbereichen häufig aufgestellten Postulaten der Eigen- oder Selbstverantwortung; dabei soll untersucht werden, welche Konzepte einer verantwortlich handelnden Person damit einhergehen und in welchem Verhältnis sie zu den gesellschaftlichen Bedingungen verantwortlichen Handelns stehen. Die Ergebnisse der Diskussionen und des empirischen Projektes sollen ein Fundament für eine normative Theorie liefern, die Kriterien für eine gerechtfertigte Verteilung von Verantwortung in der Gesellschaft begründen soll.
Wikipedia, die größte Online-Enzyklopädie, gibt Rätsel auf: Was treibt so viele Menschen an, in ihrer Freizeit an einem virtuellen Lexikon mitzuarbeiten? Wie kommt es, dass das Niveau der meisten Beiträge so hoch ist und Fehler so schnell korrigiert werden, zumal der Zugang für jeden ohne Ausweis seiner Qualifikation frei ist? Mithilfe der Netzwerkanalyse lässt sich nachweisen, dass schon die Einbindung in ein solches Netzwerk wie Wikipedia das Handeln bestimmt und auch die Motivation beeinflusst.

Als Staatsangehörigkeit wird ein wechselseitiges Verhältnis zwischen Bürgern und Staatsverband bezeichnet, das durch besondere Pflichten und Rechte gekennzeichnet ist: so das Recht zu politischer Mitentscheidung und Partizipation, dem die Pflicht zu loyalem Verhalten gegenüber der Gemeinschaft entspricht. Zur Staatsangehörigkeit gehört auch der Anspruch auf staatlichen Schutz, etwa diplomatischen Beistand im Ausland oder Mindest-Alimentierung im Inland. Staatsangehörige unterscheiden sich insofern von allen anderen Personen, die auf dem Gebiet des Staates wohnen, als gewisse Rechte und Pflichten nur sie betreffen, etwa das Recht des Hochschulzugangs, aber auch die Pflicht zur Ableistung des Wehrdienstes. Die Staatsangehörigkeit ist auch von Bedeutung bezüglich des Rechts, ein Gewerbe auszuuben oder ein Grundstück zu kaufen oder bestimmte Leistungen des Staates, etwa BAFÖG, in Anspruch zu nehmen. Die Bemerkungen zu der Staatsangehörigkeit verdeutlichen die Bedeutung, die dem Einbürgerungsverfahren, also dem Erwerb der Staatsangehörigkeit, beigemessen werden müssen. Ausländer sind für die kulturelle Entwicklung der Bundesrepublik von großer Bedeutung. Auch sie müssen deshalb das Recht haben, sich umfassend politisch zu betätigen, fordert Seyed Shahram Iranbomy. Doch das bundesdeutsche Recht trennt nicht nur bei der Möglichkeit zu wählen scharf zwischen Deutschen und Ausländern, sondern auch in vielen anderen Bereichen. Wo dies der Fall ist und zu welchen Konsequenzen dies führt und noch führen kann, schildert Iranbomy einem Aufsatz, den wir im Wortlaut, aber ohne Fußnoten, dokumentieren. Der Autor ist Wissenschaftlicher Mitarbeiter an der Johann Wolfgang Goethe-Universität in Frankfurt am Main.
Immer wieder sieht man sich – einer Zeitreise gleich – heutzutage rückversetzt in die trüben Zeiten religiöser Konfrontationen, denkt man an die Diskussionen über Pläne zum Bau von Moscheen, die Regensburger Rede des Papstes, Karikaturen in dänischen Zeitungen oder Kopftücher von Lehrerinnen. Und so ist es ganz folgerichtig, dass der ehrwürdige Begriff der Toleranz allerorten bemüht wird, um konfliktentschärfend zu wirken. Gleichwohl fällt auf, dass häufig jede der streitenden Parteien ihn für sich reklamiert. Was also heißt »Toleranz« genau?

Wenn öffentlich über Arbeit und Gesundheit diskutiert wird, geht es meist um Fehlzeiten und Krankenstände. Inzwischen hat der Krankenstand mit 3,3 Prozent einen historischen Tiefststand erreicht. Hierfür werden unterschiedliche Erklärungen angeführt: Neben medizinischen Fortschritten und Verbesserungen im Bereich von Ergonomie, Gesundheitsschutz und Prävention wird darauf hingewiesen, dass ältere Beschäftigte vor Erreichen der Altersruhegrenze ausscheiden und sich Deutschland auf dem Übergang von einer Produktions-zu einer Dienstleistungsökonomie befindet. Inzwischen wächst zwar zögerlich, aber doch in einigen Unternehmen die Erkenntnis, dass eine forcierte Senkung des nominellen Krankenstands zu steigenden Grenzkosten führt: Für jeden weiteren Rückgang auch nur um einen Zehntel-Prozent-Punkt fallen einerseits steigende Kontrollund Sanktionskosten an, während sich andererseits ein belastetes Betriebsklima negativ auf die Motivation der Mitarbeiter auswirkt. Wenn ein Arbeitnehmer zwar physisch präsent, krankheitsbedingt aber nicht voll einsatzfähig ist und möglicherweise auch noch Kollegen ansteckt, dann erweist sich die einseitige Ausrichtung an den Fehlzeiten nicht nur gesundheitspolitisch, sondern auch betriebswirtschaftlich als verkürzt. ...
Wie wird aus fünf ungeklärten Huren-Morden im Londoner Armenmilieu die »wahre Geschichte« eines Serienmörders? Wären da nicht die kollektiven Ängste und Phantasien, aber auch das »schmutzige Unterbewusste« der viktorianischen Gesellschaft sowie die morbide Faszination der aufstrebenden Gerichtsmedizin, hätte »Jack the Ripper« nicht zur Projektionsfigur des Bösen werden können. Die Geschichte des Ripper kann als beispielhaft für kulturelles Erzählen gelten und zeigt, wie sich in den Vorstellungen der Menschen einer Epoche wissenschaftliche mit literarischen Erzählmustern verweben.
Der Arbeitsmarkt sucht sie – die teamfähigen, kreativen, eigenverantwortlichen Mitarbeiter, denen Leistung Spaß macht, die sich leidenschaftlich engagieren. Unsere Gesellschaft hat ein neues Verständnis von Arbeit entwickelt, deren oberstes Ziel längst nicht mehr die klassische Pflichterfüllung ist. Selbstverwirklichung im Beruf, einst als wirklichkeitsfremde Utopie belächelt, ist heute offizielle Doktrin. Gleichzeitig werden jedoch Leistungen immer mehr nach Output und ökonomischen Erfolgskriterien bewertet. Nur was zählbar ist, zählt, und nur was sich ökonomisch rechnet, wird auch wertgeschätzt. Wissenschaftler des Instituts für Sozialforschung sind bei ihren Studien auf einen spannenden Zusammenhang dieser widersprüchlichen Entwicklungen gestoßen: Die »weichen« Faktoren machen es offenbar immer schwerer, individuelle Leistungen noch sinnvoll miteinander zu vergleichen und gerecht zu bewerten. Das hat bei Unternehmen wie Beschäftigten den Glauben an die Unfehlbarkeit objektiver Zahlen und ökonomischer Kennziffern nur weiter untermauert.
Das deutsche Rentensystem und der Generationenvertrag sind unter Druck geraten. Demografische Verschiebungen, anhaltende Massenarbeitslosigkeit sowie die Übertragung des westdeutschen Systems der Altersvorsorge auf die neuen Bundesländer führten zu einem Paradigmenwechsel in der Alterssicherungspolitik. Durch die mit der Riester-Förderung eingeführte private Altersvorsorge, das Alterseinkünftegesetz und die 2006 beschlossene sukzessive Erhöhung des Renteneintrittsalters auf 67 Jahre im Jahre 2029 sind die rentenpolitischen Konsolidierungsmaßnahmen vorerst zu einem Abschluss gekommen. Der Generationenvertrag, nach dem »der Anspruch der Rentner auf Sicherung ihres Lebensstandards und der Anspruch der Beitragszahler auf Berücksichtigung ihrer Leistungsfähigkeit gleichermaßen beachtet werden müssen«/1/, wurde somit durch die Stärkung der privaten und betrieblichen Vorsorge und eine Verlängerung der Lebensarbeitszeit ergänzt. ...
Ob das Alter ein Segen oder ein Fluch ist, darüber gehen seit der Antike die Meinungen auseinander, und es hat nicht an Versuchen gefehlt, für die doch unleugbaren Gebrechen und Gebresten die Gegenrechnung aufzumachen. Auf der einen Seite also Verfall des Körpers, Krankheit, Nachlassen oder Absterben der Sinnesvermögen und des fleischlichen Begehrens, auf der anderen Seite dafür aber Weisheit, Gelassenheit, Gemütsruhe, Abgeklärtheit, Milde, vielleicht Heiterkeit, da nichts mehr erreicht werden will. Prudentia – Klugheit – und Sophrosyne – Beherrschung der Begierden durch Vernunft und Besonnenheit – heißen die altersgemäßen Stichwörter, die vielleicht sogar Handlungsspielräume eröffnen, die den früheren Lebensaltern fehlten.

Simmels Projekt einer "formalen Soziologie" wird der von Max Weber vertretenen Variante einer "verstehenden Soziologie" gegenübergestellt, um den Nachweis zu erbringen, daß Webers Kritik und Ablehnung von Simmels "soziologischer Methode" auf einigen grundlegenden Fehlinterpretationen von Simmels Werk beruhen. Zunächst wird Simmels Gebrauch des Begriffs der Wechselwirkung als eines „regulativen Weltprinzips" erläutert und dem von Weber vertretenen Prinzip der „kausalen Zurechnung" gegenübergestellt. Anschließend wird Simmels eigene Theorie des Verstehens im Rahmen seiner methodologischen Dreiteilung der Kulturwissenschaften in eine Erkenntnistheorie der Geschichts- und Sozialwissenschaft, in die entsprechenden empirisch verfahrenden Einzelwissenschaften bzw. "Wirklichkeitswissenschaften" im engeren Sinne sowie seine umfassende Theorie der kulturellen Moderne rekonstruiert. Schließlich wird Webers Vorwurf, daß Simmel den Anspruch auf kausale Erklärung zugunsten des Gebrauchs von quasi-ästhetischen Kategorien und Analogiebildungen aufgegeben habe, mit dem spezifischen kognitiven Status von Simmels "Philosophie des Geldes" verglichen und vor dem Hintergrund von Webers eigenem häufigen Gebrauch der Metapher der "Wahlverwandtschaft" diskutiert, welche ihrerseits eine kausaltheoretisch nicht weiter auflösbare logische Form eines gegenseitigen Beziehungsverhältnisses zum Ausdruck bringen soll, das eine nicht zu übersehende Ähnlichkeit mit dem von Simmel gebrauchten Begriff der Wechselwirkung besitzt.
Warum ist die Entwicklung des Hochhausbaus in Deutschland anders verlaufen als in den USA? Warum hat Frankfurt im Gegensatz zu den übrigen deutschen Großstädten eine Skyline ausgebildet? In den USA waren Hochhäuser schon in den 1920er Jahren Symbole für den prosperierenden Kapitalismus. In Deutschland versuchte man einen anderen Weg: Hochhäuser ja, aber keine Zusammenballung in den Innenstädten. Was Städten wie München und Hamburg gelang, Hochhäuser nur ausnahmsweise zu genehmigen, führte in Frankfurt zu einer gegenläufigen Entwicklung – durch eine Politik, die unter dem Druck wirtschaftsstarker Unternehmen und Spekulanten immer wieder die Ausnahme von der Ausnahme genehmigte.

Max Webers Beitrag zum "Grundriß der Sozialökonomik" ist uns in zwei verschiedenen Fassungen überliefert worden. Ihnen entsprechen zugleich zwei unterschiedliche Fassungen seiner soziologischen Grundbegriffe, die beide auf Ferdinand Tönnies' Hauptwerk "Gemeinschaft und Gesellschaft" Bezug nehmen. Ausgehend von dem bei Tönnies beschriebenen Gegensatz von Gemeinschaft und Gesellschaft wird zum einen Webers Gebrauch der Begriffe "Vergemeinschaftung" und "Vergesellschaftung" rekonstruiert, wie er sich in seinem Aufsatz "Über einige Kategorien der verstehenden Soziologie" von 1913 und im älteren Teil von "Wirtschaft und Gesellschaft" niedergeschlagen hat. Zum anderen werden die Veränderungen aufgezeigt, die Weber an diesen Kategorien im Rahmen der Neufassung seiner soziologischen Grundbegriffe 1920 vorgenommen hat. Es wird dabei der Nachweis erbracht, daß es Weber erst mit der endgültigen Fassung seiner Grundbegriffe gelungen ist, die Marktvergesellschaftung und die anstaltsmäßige Vergesellschaftung im Rahmen einer einheitlichen Terminologie zu beschreiben.

Der Begriff der "Weltgesellschaft" hat in den letzten Jahren im Zusammenhang mit der Globalisierungsdebatte eine bemerkenswerte Renaissance erfahren. Mit ihm kommen wieder unterschiedliche nationale Traditionen des Gesellschaftsbegriffs in den Blick, wie sie seit Beginn des 19. Jahrhunderts die Geschichte der Soziologie prägen. In dem vorliegenden Aufsatz wird der Versuch unternommen, die deutsche Tradition des Gesellschaftsbegriffs ausgehend von der Aufklärungsphilosophie Immanuel Kants und der ihr zugrunde liegenden Vision einer "Weltbürgergesellschaft" bis hin zu den soziologischen Klassikern Ferdinand Tönnies, Georg Simmel und Max Weber zu rekonstruieren. Es wird dabei zum einen der Versuch gemacht, die weltgesellschaftlichen Implikationen zu verdeutlichen, die innerhalb dieser Tradition des Gesellschaftsbegriffs zum Ausdruck kommen. Zum anderen werden die Gründe benannt, die Simmel und Weber dazu veranlaßt haben, den Begriff der "Gesellschaft" durch den der "Vergesellschaftung" zu ersetzen und das mit diesem ursprünglich verbundene Konstrukt einer autonomen Gesellschaftsgeschichte schließlich ganz zugunsten einer höchst anspruchsvollen Version von Universalgeschichte aufzugeben.
