The Frankfurt University Library possesses one of the outstanding Africana Collections in continental Europe; its regional anddisciplinary scope is unique in Germany. Today about 5,000 new acquisitions a year have accumulated over 200,000 items on Africa south of the Sahara. Some 50,000 historical and rare photographs are fully digitized and freely accessible. Together with a collection of around 18,000 books stemming from the collections of the German Colonial Society at the end of the 19th and the beginning of the 20th century they constitute the historical foundations of the collection. Recently the University Library Frankfurt and the library of the GIGA Institute of African Affairs, Hamburg, started the project ilissAfrica (internet library sub-Saharan Africa), a central subject gateway for online resources and a powerful tool for bibliographic research. These new services will be indispensable for researchers and librarians of African Studies and will promote African studies worldwide.

Public employee pension systems throughout the developed world have traditionally been of the pay-as-you-go (PAYGO) defined benefit (DB) variety, where pensioner payments are financed by taxes (contributions) levied on the working generation. But as the number of retirees rises relative to the working-age group, such systems have begun to face financial distress. This trend has been exacerbated in many countries, among them Germany, by high unemployment rates producing further deterioration of the contribution base. In the long run, public sector pension benefits will have to be cut or contributions increased, if the systems are to be maintained. An alternative path sometimes offered to ease the crunch of paying for public employee pensions is to move toward funding: here, plan assets are gradually built up, invested, and enhanced returns devoted to partly defray civil servants’ pension costs. In this study, we evaluate the impact of introducing partial prefunding, paired with a strategic investment policy for the German federal state of Hesse. The analysis assesses the impact of introducing a supplementary tax-sponsored pension fund whose contributions are invested in the capital market and used to relieve the state budget from (some) pension payments. Our model determines the expectation and the Conditional Value-at-Risk of economic pension costs using a stochastic simulation process for pension plan assets. This approach simultaneously determines the optimal contribution rate and asset allocation that controls the expected economic costs of providing the promised pensions, while at the same time controlling investment risk. Specifically, we offer answers to the following questions: 1. How can the plan be designed to control cash-flow shortfall risk, so as to mitigate the potential burden borne by future generations of taxpayers? 2. What is the optimal asset allocation for this fund as it is built up, to generate a maximum return while simultaneously restricting capital market and liability risk? 3. What are reasonable combinations of annual contribution rates and asset allocation to a state-managed pension fund, which will limit costs of providing promised public sector pensions? We anticipate that this research will interest several sorts of policymaker groups. First, focusing on the German case, the state and Federal governments should find it relevant, as these entities face considerable public sector pension liabilities. Second, our findings will also be of interest to other European countries, as most have substantial underfunded defined benefit plans for civil servants. In what follows, we first offer a brief description of the structure of civil servant pensions in Germany, focusing on their benefit formulas, their financing, and the resulting current as well as future plan obligations for taxpayers. Next, we turn to an analysis of the actuarial status of the Hesse civil servants’ pension plan and evaluate how much would have to be contributed to fund this plan in a nonstochastic context. Subsequently we evaluate the asset-liability and decision-making process from the viewpoint of the plan sponsor, to determine sensible plan asset allocation behavior. A final section summarizes findings and implications.
Die vorliegende Arbeit verdeutlicht für das Handlungsfeld „Ethnomarketing in Deutschland“, wie ethnische Grenzen gezogen werden. Sein Ausgangspunkt ist der gesellschaftliche Diskurs über das Deutschsein und seine Gegenstücke: das Türkische, Russische, Orientalische, Südländische usw.. Im Niemandsland zwischen Fremdem und Eigenem führen die Akteure des Ethnomarketings ihr eigenes Spiel mit der Ethnizität auf, indem sie sich die kursierenden ethnischen Zuschreibungen zu nutze machen. Sie übernehmen selektiv die im Diskurs vorgefundenen ethnischen Konstruktionen eines „kollektiven Gedächtnisses“ in der Gesellschaft über sich selbst und „die Anderen“, modifizieren diese Konstruktionen in ihrem Marketing entsprechend eigener Vorstellungen und Interessen, verstärken ihre Wirkung durch Ausstrahlung in den Medien und greifen so selbst ein in den machtbasierten gesellschaftlichen Prozess ethnischer Rollenzuweisung und Anerkennung. Die Gestaltung des eigenen Marketings zwingt die Akteure, sich auf eindeutige Werbebilder festzulegen, und ihre Präsenz in der Öffentlichkeit nötigt sie, sich und ihr ethnisches Marketing zu erklären. Sie offenbaren dadurch ihre Persönlichkeiten, Interessen, Vorstellungen, Fähigkeiten, Rollenverständnisse und Strategien – nicht jedoch das vermeintliche „Wesen“ ethnischer Zielgruppen, die sie adäquat zu bewerben glauben. Wie aus einleitender Definition hervorgeht, ist für Ethnomarketing ein Umfeld ethnischer Divergenz notwendig, um bestehen und funktionieren zu können. Es sind die fortwährenden Debatten in Deutschland über Ausländer, Asylanten, deutsche Werte, Einbürgerung, Fundamentalismus usw., in welchen entlang vermeintlich realer Kriterien wie Herkunft, Mentalität, Religion, Aussehen, Sprache usw. die soziale Realität ethnischer Gruppen (re-)konstruiert und ihnen stigmatisierend Eigenschaften zugeschrieben werden. Am vorläufigen Ende dieses Prozesses stehen Einbürgerungstests, mit welchen das „Deutsche“ vom „Undeutschen“ getrennt und bewahrt werden soll, die jedoch lediglich den Glauben ihrer Urheber demonstrieren, dies sei möglich. Als Gegenpol zum „guten“ Deutschen hat der Diskurs eine Chimäre aus zahlreichen, zumeist abwertenden Zuschreibungen für das Östliche, Südländische, Orientalische, Islamische usw. hervorgebracht, die im Türkischen oft einen Platzhalter findet: „Der Türke“ ist für viele Menschen zum Bild vom „unliebsamen“ Ausländer generell geworden. Vor diesem gesellschaftlichen Hintergrund ist Ethnomarketing erfolgreich, wenn es gelingt, den „verletzten Seelen“ die ethnische Wertschätzung zu geben, die sie sich von der „deutschen“ Gesellschaft vergeblich wünschen. Ethnomarketing kompensiert jedoch nicht nur das Gefühl mangelnder ethnischer Akzeptanz, das viele ethnisch stigmatisierte Rezipienten empfinden, sondern ist auch ein Mikrokosmos, in welchem die gleichen Prozesse der Konstruktion und Instrumentalisierung von Ethnizität wirksam sind wie in der umschließenden Gesellschaft. ....
Die Kernidee der kommunalen Kriminalprävention – die Sicherheitsgewährleistung auf der örtlichen Ebene – ist in den letzten Jahren in den Mittelpunkt sicherheitspolitischer Debatten gerückt. Schlüsselkonzepte wie Gemeinschaftlichkeit, Vernetzung und Bürgernähe gewinnen in den Kommunen zunehmend an Relevanz und münden in die Etablierung lokaler ressortübergreifender Zusammenschlüsse zur Kriminalitätsverhütung. Unter der Bezeichnung „Kriminalpräventionsräte“ versammeln sich allerdings sehr unterschiedliche inhaltliche und strategische Konzepte sowie eine Vielzahl lokaler Institutionalisierungsformen. Eine systematische Bestandaufnahme und Gegenüberstellung hat bislang nicht stattgefunden. Hinzu kommt, dass die Verbreitung lokaler Präventionsgremien in Deutschland von anhaltender Kritik begleitet wird: Auf Tagungen zur kommunalen Kriminalprävention werden z. B. immer wieder unzureichende Handlungsbefugnis, mangelnde Einbindung der Bürger/innen oder die große Bandbreite an Maßnahmen der Präventionsarbeit bemängelt, die letztlich zu einer Aushöhlung des Konzepts führten. Die Beobachtungen waren Anlass für die vorliegende Studie. In den zahlreichen Gesprächen mit Akteuren aus dem Bereich der kommunalen Kriminalprävention hat sich abgezeichnet, dass das Feld lokaler Präventionsarbeit nicht systematisch erfasst ist. Es gibt bislang keine Studie, die einen deutschlandweiten Überblick über die Verteilung der Gremien, die unterschiedlichen Organisationsformen, die beteiligten Akteure und die Projektarbeit liefert. Vor diesem Hintergrund erschien es notwendig, die Gremien deutschlandweit zu erheben und das Feld lokaler Präventionsarbeit zu strukturieren. Zu diesem Zweck werden im Folgenden die lokalen Netzwerke in vier thematischen Blöcken untersucht: • Präventionslandschaft: Wie verteilen sich die Gremien in Deutschland und in welchen Bundesländern sind lokale Präventionsnetzwerke besonders verbreitet? • Organisation: Wie sind die Präventionsgremien intern strukturiert und lokal ausgerichtet? • Vernetzung: Welche lokalen Institutionen arbeiten in den Gremien zusammen? Inwieweit sind die Bürger in die Präventionsarbeit einbezogen? • Projektarbeit: In welchen Bereichen sind die Gremien aktiv und welche Projekte werden durchgeführt? An welchen Zielen orientiert sich die Projektarbeit? Die vorliegende Studie ist die erste deutschlandweite Online-Befragung unter lokalen Präventionsgremien. An ihr haben sich über 250 Gremien beteiligt. Ihnen gilt besonderer Dank, sowie dem Deutschen Forum Kriminalprävention (DFK), dem Europäischen Zentrum für Kriminalprävention (EZK) und dem Leibniz-Institut für Länderkunde (IfL) für die Unterstützung bei der Umfrage.
This paper traces the location of foreign banks in Germany from 1949 to 2006. As suggested by new economic geography models we find a ‘u’-shaped concentration of foreign banks in Germany. Only after a competition between several cities, Frankfurt has emerged as the pre-eminent financial centre, triggered by the ‘historical event’ of setting up the German central bank in Frankfurt. After a strong increase, Frankfurt’s share in the location of foreign banks in Germany decreases slowly but significantly since the mid 1980’s. We conclude that there will be a lesser role in Europe for secondtier financial centres in the future.

In dieser Arbeit wurde die Mediennutzung Jugendlicher anhand von 18 unterschiedlichen Medien unter Berücksichtigung herkunfts-, geschlechts- und altersspezifischer Gesichtspunkte untersucht. Es wurden nicht alle tatsächlich verfügbaren Medien untersucht, da dies den Rahmen der Untersuchung gesprengt hätte. So finden sich weder DVD-Player, MP3-Player, Kino sowie weitere, teilweise selbst medienvemittelte Medien Newsgroups, World Wide Web-Seiten im Internet und Chat, nicht unter den untersuchten Medien. Bei den untersuchten Medien finden sich große Unterschiede, was den jeweiligen Besitz bzw. die Nutzung angeht. So ist beispielsweise das Radio mit 89,2% das am meisten besessene Medium bei den Jugendlichen, während nur 11,9% über einen eigenen Plattenspieler verfügen. Das von den meisten Jugendlichen täglich benutzte Medium ist der Fernseher (92%), noch vor den Medien Festnetztelefon (87%) und Handy (82%). Strikt unterschieden werden muss bei den Betrachtungen stets der Besitz von der tatsächlichen Nutzung des Mediums. Der Besitz eines Mediums zieht nicht zwangsläufig eine häufige Nutzung nach sich. So verfugen beispielsweise relativ viele Jugendliche über einen Gameboy (56% Medienbesitz), nutzen diesen allerdings meist nur seltenerl/ie (66% Nutzung "seltener/nie") und empfinden ihn als "Out", während beim Medium Handy häufiger Besitz (82% Medienbesitz) und häufige Mediennutzung (82% Nutzung ,,täglich/fast täglich") korrespondieren. Detailliertere Betrachtungen der einzelnen Medien mit den jeweiligen Besitz- und Nutzungshäufigkeiten befinden sich in den Kapiteln ab Seite 53....
Wir untersuchen, in welchem Ausmaß die Aktien deutscher Unternehmen im Zeitverlauf an ausländischen Börsen gehandelt werden. Es zeigt sich – nach anfänglich bedeutsamer Handelsaktivität im Ausland – ein ausgeprägter Rückfluss-Effekt nach Deutschland. Zweitnotierungen an ausländischen Börsen dienen der Verbreiterung der Aktionärsbasis und somit der Senkung der Kapitalkosten und letztendlich der Steigerung des Unternehmenswertes. Dazu ist ein ausreichendes Handelsvolumen an der ausländischen Börse unabdinglich. Daran gemessen sind die Auslandsnotierungen deutscher Unternehmen nicht erfolgreich. Dies ist jedoch nicht im gleichen Ausmaß für alle Unternehmen der Fall. Kleinere, wachsende Unternehmen und Unternehmen mit höherem Anteil des Auslandsumsatzes am Gesamtumsatz werden relativ stärker im Ausland gehandelt.
The present article explores perceptions and cultural constructions of the terms capitalism or capitalistic West among ex-Soviet, highly qualified Jewish migrants from Russia and Ukraine after their emigration to Germany between 1990 and 1996. It seems that migration offers a unique opportunity to migrants to realise knowledge that is normally taken for granted, behaviour schemes and values, and to reflect on them. How do they acquire such presumed capitalist knowledge of the new society and new social world, how do they create it, and with what concrete contents do they connect the illusion about monolithic cultural, economic and political capital, the illusion which contributes to group formation and which serves as action orientation? As my research shows, immigrants try to disparage much of what appeared to them in the Soviet Union as normative, right and appropriate; now they often act by way of categories, which were defined in the previous context as "capitalist" and were interpreted as immoral. Without exact ideas or knowledge about behaviour codes, unspoken norms and silent values from the new society, many immigrants orient themselves towards the opposite of what was counted as morally proper in the origin society. Simultaneously they revive old system through the establishing and development of a Russian language enclave. Nevertheless this enclave is not located in a vacuum of "dusty" memories from the past, but build transnational cross-border space connected and corresponding to the processes of to-day's CIS and with the life of those relatives and friends who still live there, und with whom the emigrants share intensive social networks.
The paper presents an overview about some of the international relevant projects of digital resources in Germany. Online presentations of primary sources, e.g. photographic material, and bibliographic tools supporting research, such as cross searching, will be presented as potential partners of resource sharing with North America. Not only the possibility of cooperation will be sketched, but also necessary preliminary work and some obstacles will be outlined. This report is accompanied by a short characterization of African studies in Germany and the status quo of Open Access-initiatives.
Die Literaturversorgung und Informationsvermittlung hat in unserer Gesellschaft eine große Bedeutung, vornehmlich in den Bereichen Forschung, Bildung und Lehre. Dabei spielen die Bibliotheken eine wichtige Rolle. Ein Verzeichnis mit Angaben zu den Bibliotheken, die über wirtschaftsrelevante Bestände verfügen, entspricht daher sicherlich einem dringenden Informationsbedarf in diesem, in besonderem Maße auf Fachliteratur angewiesenen Gebiet. Was den Umfang des Bibliotheksführers anbelangt, muss Folgendes festgestellt werden. Zum einen hat er nicht den Ehrgeiz, möglichst viele Bibliotheken nachzuweisen, sondern nur jene, die der Öffentlichkeit zugänglich sind. Leider sind aus diesem Grunde zahlreiche gut ausgestattete Bibliotheken (wie beispielsweise bestimmte Firmenbibliotheken) nicht in dem Verzeichnis erfasst. Zum anderen habe ich mich auf die Meldungen beschränkt, die ich aufgrund meiner Aufrufe erhalten habe. Diese umfassen 61 Bibliotheken, die im Hauptteil alphabetisch nachgewiesen werden. Erschlossen wird dieser Teil durch zwei Register, die den unterschiedlichen Bedürfnissen entsprechen sollen: Das Stichwortregister listet die Fachgebiete auf, die die Bibliotheken in ihren Meldungen als Beschreibung ihrer Bestände angegeben haben. Das Ortsregister soll jenen helfen, die feststellen wollen, ob in ihrem Wohnort oder der näheren Umgebung eine Bibliothek vorhanden ist, die Literatur speziell zu einem von ihnen gesuchten Gebiet hat.

Multiple lenders and corporate distress: evidence on debt restructuring : [Version Juni 2006]

In the recent theoretical literature on lending risk, the coordination problem in multi-creditor relationships have been analyzed extensively. We address this topic empirically, relying on a unique panel data set that includes detailed credit-file information on distressed lending relationships in Germany. In particular, it includes information on creditor pools, a legal institution aiming at coordinating lender interests in borrower distress. We report three major findings. First, the existence of creditor pools increases the probability of workout success. Second, the results are consistent with coordination costs being positively related to pool size. Third, major determinants of pool formation are found to be the number of banks, the distribution of lending shares, and the severity of the distress shock.

Statt eines Wandels deutscher Außenpolitik aufgrund der veränderten Rahmenbedingungen herrschte ein weitverbreiteter Konsens darüber, Deutschland habe sich abgesehen von einer Erhöhung der Einwohnerzahl von 63 auf 82 Millionen und eines Flächenzuwachses von 248 000 auf 375 000 Quadratkilometer nicht gravierend im internationalen System gewandelt. ...
The European Strategy on Invasive Alien Species T-PWS(2002) 8 mandates intensified research by member nations on invasive species. This research will not be restricted solely to the biology and remediation of invasive species, but will also evaluate their adverse health effects and economic impact. Previous studies of these issues have only been carried out in the Unites States of America, or in a limited, regional manner. Consequently, 20 plant and animal species from various problem areas (species which pose a threat to public health; losses to agriculture, fisheries, and forestry; damage to public roads and waterways; costs associated with the protection of native species threatened by non-native species as mandated by Recommendation 77 of the Bern Convention were assessed in Germany nation-wide. The accruing costs were sorted into 3 categories: a) direct economic losses, such as those caused by destructive pest species; b) ecological costs, in the form of extra care and protection of native taxa, biotopes, or ecosystems threatened by invasive species; c) costs of measures to combat invasive species. Because of the nature of available data, as well as the different biology and ecology of the invasive species, each had to be treated individually, and the associated costs vary greatly from species to species. Moreover, not all of the species investigated cause economic losses. Accordingly, a nuanced approach to alien species is essential. Cost assessment of losses deriving from ecological damage was only possible in a few cases. Ongoing, multi-year studies incorporating cost/benefit analysis will be necessary to resolve remaining issues.
In dem Entwurf einer European Strategy on Invasive Alien Species T-PVS (2002) 8 werden verstärkte Forschungsaktivitäten der Mitgliedstaaten angeregt, die nicht nur auf den biologischen Bereich oder Bekämpfung invasiver Arten beschränkt bleiben, sondern auch die Bewertung der Auswirkungen auf Gesundheitswesen und Volkswirtschaft untersuchen sollen. Derartige Studien wurden bisher nur für die Vereinigten Staaten von Amerika oder mit eher regionalen Charakter durchgeführt. Aus diesem Grunde wurden 20 Tiere und Pflanzen aus verschiedenen Problemgebieten (Gesundheitsgefährdende Arten, Schäden in Forst-, Land-, und Fischereiwirtschaft, im kommunalen Bereich, an aquatischen und terrestrischen Verkehrswegen sowie Kosten von Arten, die einheimische Spezies gefährden oder in der Empfehlung 77 der Berner Konvention aufgeführt sind) ausgewählt und beispielhaft für das Gebiet Deutschlands bearbeitet. Die entstehenden Kosten wurden in drei Kategorien aufgeschlüsselt: a) direkte ökonomische Schäden, beispielsweise durch Vorratsschädlinge, b) ökologische Schäden, verursacht durch Pflege und Schutz gefährdeter heimischer Arten, Biozönosen oder Ökosysteme und c) Kosten für Maßnahmen zur Bekämpfung invasiver Arten. Es zeigte sich, dass auf Grund der Datenlage sowie der unterschiedlichen Biologie und Ökologie der invasiven Arten jeweils individuelle Ansätze notwendig waren. Die hier ermittelten Kosten unterscheiden sich stark von Art zu Art. Nicht alle untersuchten Arten verursachen ökonomische Schäden. Eine differenzierte Betrachtung von Neobiota ist nach dem Prinzip der Einzelfallbewertung erforderlich. Die Monetisierung von ökologischen Schäden gelang hierbei nur in wenigen Fällen. Weitergehende, mehrjährige Studien sollten willingness to pay-Analysen einbeziehen, um offen gebliebene Fragen zu beantworten.
Während sich das deutsche Erziehungs-, Bildungs- und Sozialsystem durch Achtung und Expansion „institutioneller Vielfalt“ auszeichnet, wird in Spanien spätestens seit 1990 mit unterschiedlicher Intensität, je nach Regierung, ausgehend von der LOGSE Reform an einer „Schule für alle“ gearbeitet. Es werden vergleichsweise wenige Kinder in Sondereinrichtungen beschult. Die Strategien und die dahinter liegenden Vorstellungen, wie Partizipation zu realisieren sei, waren Ende letzten Jahrhunderts in beiden Ländern deutlich verschieden. Die in der Dissertation vorgestellten Daten zeigen jedoch, dass zu wenige Kinder die Kompetenzen für eine gegenwärtige und zukünftige persönlich und wirtschaftlich erfolgreiche Lebensführung erwerben. Zentral für die Arbeit ist die von Urie Bronfenbrenner entwickelte systemökologische Theorie der menschlichen Entwicklung. Im Kern geht es bei dieser Theorie immer um die Suche, das Finden und Gestalten optimaler Bedingungen für menschliche Entwicklung. Die Fragestellung der Arbeit ist, wie in Deutschland und Spanien, aber auch wie Professionelle, interdisziplinär die Aufgabe der Integration und Partizipation im Rahmen ihrer Vorgaben bewältigen. Die Arbeit ist in zwei große Teile unterteilt. Die ersten Kapitel sind eine Sammlung von Daten, Theorien, Praxen, Diskussionen und geschichtlichen Entwicklungen, die die schulische Integration von Kindern mit Behinderungen bzw. mit schwierigen Lebenslagen, darstellt. Ab Kapitel sieben wird dann mit Methoden der qualitativen Sozialforschung nach Ressourcen und Kompetenzen, die in Spanien wie in Deutschland vorliegen bzw. entwickelt werden müssen gesucht, um auch Kindern mit Schwierigkeiten eine für sie persönlich erfolgreiche Bildung zur ermöglichen. Nach einem Einführungskapitel werden im zweiten Kapitel Theorien und Modelle der Integrationspädagogik und der an ihr beteiligten Disziplinen diskutiert. Das folgende Kapitel stellt ausgewählte Studien vor, die sich mit Lern- und Lebenslagen von Kindern befassen, denn der gesellschaftliche wie der wissenschaftliche Blick auf die Kindheit hat sich gewandelt. Ein integratives bzw. inklusives Erziehungs- und Bildungssystem wäre eine passende Antwort auf den Wandel. Das vierte Kapitel gibt einen Einblick in das bundesdeutsche Bildungssystem und stellt statistische Daten zur integrativen Beschulung in den Bundesländern vor. Das fünfte Kapitel befasst sich mit dem spanischen Bildungssystem. Das starke Engagement der Katholischen Kirche im 19. und auch noch im 20. Jahrhundert, die Francozeit und die Transición sind die Basis, auf der in den 90 ziger Jahren des letzten Jahrhunderts die, auf 10 Jahre angelegte LOGSE Reform geplant und teilweise umgesetzt wurde. Diese als top-down zu bezeichnende systemische Reform, wird mit ihren Elementen der integrativen und der kompensatorischen Erziehung dargestellt. Die Beschreibung der spanischen Reformentwicklungen endet im Jahr 2004. Der empirische Teil der Arbeit beginnt im Kapitel sechs mit Gedanken zur Qualitativen Sozialforschung. Im Kaptitel sieben wird die Gegenstandsnahe Theoriebildung vorgestellt. Das achte Kapitel befasst sich mit dem Zirkulären Dekonstruieren. Im neunten Kapitel werden die deutschen und die spanischen Interviewpartner in ihrer professionellen Expertenrolle als Grundschullehrerin, Sozialarbeiterin, Erziehungswissenschaftler, Psychologe, Unterstützungslehrerin, Physiotherapeut und Förderschullehrerin vorgestellt. Sechs Interviews fanden Ende 1999, also zu einer Zeit in der die LOGSE Reform bereits fast abgeschlossen sein sollte, statt. Das siebte Interview mit der Förderschullehrerin wurde 2001 geführt. Verständigung und Bewertung konnten aus den Kategorien der Interviews als wichtige Ressourcen für integrative schulische Arbeit erkannt werden. Im Kaptitel zehn wird der ökosystemische Ansatz vertieft dargestellt. Im elften Kapitel werden dann systematisch die Definitionen der Ökosystemischen Theorie auf die Lebensbereiche, die ein Kind betreffen, bzw. die herausgearbeiteten Kategorien angewendet. In diesen Lebensbereichen werden interdisziplinär und über die Ländergrenzen hinweg, die Kategorien diskutiert, um zu Aussagen über gute Entwicklungsbedingungen zu kommen. Die Kapitel zwölf bis vierzehn verbinden die Ergebnisse der Auswertung mit den zusammengetragenen Daten und Fakten zur Situation in Deutschland und Spanien. Als förderlich für die Integration, die auf allen Systemebenen angelegt sein sollte, werden beispielhaft folgende Kriterien beschrieben: eine integrative Grundhaltung, ein moderat konstruktivistischer Unterricht, die Anerkennung und Förderung aller Kompetenzen der Kinder, die Arbeit mit dem entwicklungsfördernden Potential, Kontinuität in den Beziehungen, Strukturen und Räumen, Bestreben nach müheloser Kommunikation. Stakeholderorientierung, Systemhaftigkeit und Stabilität der Corporate Governance in Deutschland

Since the time of Germany’s belated industrialisation, corporate governance in Germany has been stakeholder oriented in the dual sense of attaching importance to the interests of stakeholders who are not at the same time shareholders, and of providing certain opportunities for these stakeholders to influence corporate decisions. Corporate governance is also systemic. It is a system of elements that are complementary to each other, and also consistent. In other word, it is composed of elements for which it is important that they fit together well, and in the German case these elements did fit together well until quite recently. Corporate governance as a system is itself an element of the German bank-based financial system at large and possibly even of the entire German business and economic system. Stakeholder orientation of governance is consistent with the general structure this system, and even represents one of its central elements. In retrospect, German corporate governance has also proved to be surprisingly stable. Its fundamental traits date back to the turn from the 19th to the 20th century. There are strong reasons to assume that the systemic features, that is, its complementarity and consistency, have greatly contributed to its past stability. Since about ten years now, there are growing tendencies to question the viability and stability of the German corporate governance system and even the financial system as a whole. One of the central topics in the new debate concerns the stakeholder orientation of the system, which some observers and critics consider as the main weakness of the “German model” under the increasing pressures of globalisation and European integration. As far as their development over time is concerned, systems of complementarity elements exhibit certain peculiarities: (1) They do not adjust easily to changing circumstances. (2) Changes concerning important individual elements, such as the stakeholder orientation of governance, tend to jeopardize the viability and the stability of the entire system. (3) While they appear to be stable, systems shaped by complementary may simply be rigid and tend to break under strong external pressure. “Breaking” means that a system undergoes a fundamental transformation. It seems plausible to assume that the German financial system is already in the middle of such a transformation. It is yet another consequence of its systemic character that this transformation is not likely to be a smooth and gradual process and that it will not lead to a “mixed model” but rather to the adoption of a capital market-based financial system as it prevails in the Anglo-Saxon countries. In such a system, corporate governance cannot be geared to catering to the interests of stakeholders, and an active role for them would not even make any economic sense.
We study a set of German open-end mutual funds for a time period during which this industry emerged from its infancy. In those years, the distribution channel for mutual funds was dominated by the brick-and-mortar retail networks of the large universal banks. Using monthly observations from 12/1986 through 12/1998, we investigate if cross-sectional return differences across mutual funds affect their market shares. Although such a causal relation has been established in highly competitive markets, such as the United States, the rigid distribution system in place in Germany at the time may have caused retail performance and investment performance to uncouple. In fact, although we observe stark differences in investment performance across mutual funds (and over time), we find no evidence that cross-sectional performance differences affect the market shares of these funds. Zu Beginn des 21. Jahrhunderts scheint auch in Deutschland politische Bewegung in die Arbeitsmarktpolitik gekommen zu sein. Angesichts von in der Spitze über 5 Millionen offiziellen Arbeitslosen und immer deutlicher zu Tage tretender Defizite bei der (damaligen) Bundesanstalt für Arbeit war ein „weiter so“ nicht mehr vermittelbar. Es bestand die Hoffnung, dass die über 5-jährige Tradition aktionistischer, erfolgloser, ja sogar problemverschärfender bundesdeutscher Arbeitsmarktpolitik endlich zu Ende gehen würde. Prinzipien wie „Fördern und Fordern“ wurden erstmals von beiden großen Volksparteien nicht nur ablehnend diskutiert, sondern als Grundvoraussetzung für eine zukunftsfähige Beschäftigungspolitik erkannt. Mit ihrer „Agenda 2010“ und den „Hartz-Reformen“ versuchte die rot-grüne Bundesregierung, das Bild eines tiefgreifenden Umbaus der deutschen Arbeitsmarktpolitik hin zu mehr Effizienz und weniger Arbeitslosigkeit zu vermitteln. Doch hat eine grundlegende Reform der Arbeitsmarktpolitik wirklich stattgefunden? Dieser Frage gehen die beiden Autoren der vorliegenden Studie, Norbert Berthold und Sascha von Berchem, nach. Sie zeigen auf, wie über Jahrzehnte hinweg von den jeweiligen Regierungen und den sie tragenden Parteien eine völlig verfehlte Arbeitsmarktpolitik verfolgt wurde. Das Ergebnis der Analyse, ob bei den jüngsten Reformen diesbezüglich Lernerfolge zu erkennen sind, ernüchtert: Nach wie vor kann die deutsche Arbeitsmarktpolitik keinen echten Beitrag zum Abbau der Arbeitslosigkeit leisten. In vielen Bereichen blieben die Reformschritte ein bloßes Kratzen an der Oberfläche. Hinzu kommt, dass vormals bestehende institutionelle Defizite durch neue ersetzt wurden, z.B. bei der Zusammenlegung von Arbeitslosenhilfe und Sozialhilfe. All dem stellen die Autoren ein Reformkonzept entgegen, das konsequent versucht, Marktkräfte und Wettbewerb zum Abbau der Arbeitslosigkeit zu nutzen. Kernpunkt ist ein dezentraler Ansatz, der die Erprobung und Realisierung unterschiedlicher, an die jeweiligen Gegebenheiten angepassten Strategien zulässt. Es bleibt zu hoffen, dass die Politik die Zeichen der Zeit erkennt. Ohne mutige Schritte bleiben die begonnenen Reformen ein Torso. Deutschland braucht nicht die Verwaltung des Elends auf immer höherem administrativen Niveau. Unserem Land helfen genauso wenig immer neue „Pilotprojekte“ und Wortgeklingel wie „Job-Floater“, „Ich- AG“, „Job-Aqtiv“ und „Equal Pay“. Was wir brauchen, sind ein ordnungspolitisch fundiertes Konzept, mehr Freiheit und mehr Wettbewerb. Die Präsenz in den Hauptversammlungen der großen deutschen Aktiengesellschaften ist seit Jahren rückläufig. Die durchschnittliche Hauptversammlungspräsenz bei den 30 DAXnotierten Unternehmen lag 2005 nur noch bei 45,87 %, gegenüber immerhin 60,95 % im Jahr 1998. Im Zusammenhang mit den Initiativen institutioneller Anleger bei der Deutschen Börse AG im Sommer diesen Jahres hat die Besorgnis zugenommen, Minderheiten könnten die Abwesenheit von mehr als der Hälfte der Stimmberechtigten dazu nutzen, in den Hauptversammlungen verstärkt Einfluss auf weitreichende Unternehmensentscheidungen auszuüben, um Sondervorteile zu erzielen. Unabhängig davon ist jedenfalls zu berücksichtigen, dass bei geringer Hauptversammlungspräsenz unter Umständen eine kleine Kapitalminderheit Entscheidungen trifft, bei denen sie nicht von denjenigen, die diese Entscheidungen gleichfalls betrifft, kontrolliert und, falls erforderlich, korrigiert wird. Um dem Problem sinkender Hauptversammlungspräsenzen zu begegnen, werden auf nationaler wie internationaler Ebene verschiedene Maßnahmen erwogen. Im Zusammenhang mit der Vereinfachung der Vertretung der Aktionäre in der Hauptversammlung wird vorgeschlagen, über den in § 134 III S. 3 AktG bereits vorgesehenen Stimmrechtsvertreter der Gesellschaft (sog. Proxy-Stimmrecht) hinaus einen von der Gesellschaft unabhängigen Stimmrechtsvertreter gesetzlich vorzusehen. Im Übrigen gehen die Empfehlungen von der verstärkten Nutzung neuer technischer Kommunikationsmittel bei der Stimmabgabe (Stichwort „virtuelle Hauptversammlung“) bis zur verstärkten Einführung von Namensaktien, um die Kommunikation mit den Aktionären zu erleichtern. Als Antwort auf den zunehmenden Einfluss internationaler Investoren, die derzeit aus Zeit- und Kostengründen, wegen sprachlicher Probleme, zu knapp bemessener Einladungsfristen oder Störungen des Informationsflusses zwischen ihnen und der Gesellschaft regelmäßig nicht an den Hauptversammlungen europäischer Aktiengesellschaften teilnehmen, arbeitet die Europäische Kommission zudem an einem Richtlinienentwurf, der die grenzüberschreitende Stimmrechtsausübung fördern soll. Im Zusammenhang hiermit sind auch auf die Bemühungen der Europäischen Kommission zu sehen, mittelfristig eine verstärkte Offenlegung der Anlage- und Abstimmungsstrategien institutioneller Investoren zu erreichen. Hierdurch soll eine intensivere Mitwirkung dieser Aktionärsgruppe in den Angelegenheiten der Gesellschaft gewährleistet werden. Die verstärkte Teilnahme bzw. die Offenlegung des Abstimmungsverhaltens von Investmentfonds, Versicherungen und Pensionskassen ist auch Inhalt von Empfehlungen nationaler sowie internationaler Organisationen. Bereits in der letzten Legislaturperiode hat die Arbeitsgruppe Finanzmarktgesetzgebung des Justiz- und Finanzministeriums den Vorschlag eines sog. Dividendenbonus für diejenigen Aktionäre erwogen, die ihr Stimmrecht in der Hauptversammlung ausüben. Im Anschluss daran entwickelte sich eine lebhafte Diskussion, in der sich sowohl Stimmen in der Literatur als auch Interessenverbände für die Einführung eines finanziellen Anreizsystems für Aktionäre in Form eines Dividendenbonus aussprachen. Vorbildfunktion für eine entsprechende Regelung in Deutschland wird dabei der spanischen Hauptversammlungspraxis zugesprochen. Dort geben die meisten großen Unternehmen des spanischen Standardwerteindex Ibex 35 einen finanziellen Anreiz für die Hauptversammlungspräsenz. Die Zahlungen liegen zwischen zwei und zehn Cent pro Aktie. Hierdurch konnte das Interesse am Besuch der Hauptversammlung generell gesteigert werden. Der Energiekonzern Endesa schaffte es mit einem Bonus von zwei Cent, die Präsenz von 37 % auf 66 % nahezu zu verdoppeln. Diese Erfolge in Spanien sind darauf zurückzuführen, dass die dortigen Depotbanken durch die Auszahlung der sog. prima de asistencia dazu veranlasst wurden, sich im Dienste einer bestmöglichen Wahrnehmung der Interessen ihrer Kunden auch ohne ausdrückliche Aufforderung um eine entsprechende Stimmrechtsvollmacht zu bemühen. Im Folgenden wird versucht darzulegen, wie die Regelung eines finanziellen Anreizes zur Stärkung der Hauptversammlungspräsenzen sinnvoll gestaltet werden könnte und welche gesetzgeberischen Schritte notwendig sind, um die Zahlung eines Bonus für die Präsenz in der Hauptversammlung zu ermöglichen.

Previous empirical studies of job creation schemes in Germany have shown that the average effects for the participating individuals are negative. However, we find that this is not true for all strata of the population. Identifying individual characteristics that are responsible for the effect heterogeneity and using this information for a better allocation of individuals therefore bears some scope for improving programme efficiency. We present several stratification strategies and discuss the occurring effect heterogeneity. Our findings show that job creation schemes do neither harm nor improve the labour market chances for most of the groups. Exceptions are long-term unemployed men in West and long-term unemployed women in East and West Germany who benefit from participation in terms of higher employment rates. JEL: C13 , J68 , H43
Innovations are a key factor to ensure the competitiveness of establishments as well as to enhance the growth and wealth of nations. But more than any other economic activity, decisions about innovations are plagued by failures of the market mechanism. As a response, public instruments have been implemented to stimulate private innovation activities. The effectiveness of these measures, however, is ambiguous and calls for an empirical evaluation. In this paper we make use of the IAB Establishment Panel and apply various microeconometric methods to estimate the effect of public measures on innovation activities of German establishments. We find that neglecting sample selection due to observable as well as to unobservable characteristics leads to an overestimation of the treatment effect and that there are considerable differences with regard to size class and betweenWest and East German establishments.
Persistently high unemployment, tight government budgets and the growing scepticism regarding the effects of active labour market policies (ALMP) are the basis for a growing interest in evaluating these measures. This paper intends to explain the need for evaluation on the micro- and macroeconomic level, introduce the fundamental evaluation problem and solutions to it, give an overview of the newer developments in evaluation literature and finally take a look on empirical estimations of ALMP effects. Wir verwenden eine neue, auf der Burr-Verteilung basierende Spezifikation aus der Familie der Autoregressive Conditional Duration (ACD) Modelle zur ökonometrischen Analyse der Transaktionsintensitäten während der Börseneinführung (IPO) der Deutsche Telekom Aktie. In diesem Fallbeispiel wird die Leistungsfähigkeit des neu entwickelten Burr-ACD-Modells mit den Standardmodellen von Engle und Russell verglichen, die im Burr-ACD Modell als Spezialfälle enthalten sind. Wir diskutieren außerdem alternative Möglichkeiten, Intra- Tagessaisonalitäten der Handelsintensität in ACD Modellen zu berücksichtigen.
Auch sechs Jahre nach Einführung der Vorschriften zur Ad-hoc-Publizität nach § 15 WpHG besteht bei den Unternehmen weiterhin große Unsicherheit bezüglich ihrer ordnungsmäßigen Umsetzung. Dies gilt insbesondere für die Behandlung von ad-hoc-meldepflichtigen Sachverhalten, die sich aus der Regelberichterstattung ergeben. Der vorliegende Beitrag entwickelt hierzu Lösungsansätze im Sinne einer kapitalmarktorientierten Unternehmenspublizität.
Vorgestellt wird eine empirische Studie, welche den Zusammenhang zwischen Rendite und Risiko für ein Sample deutscher Versicherungsaktien im Zeitraum 1975-1998 untersucht. Als Methode wurde ein Multifaktorenmodell mit makroökonomischen Faktoren verwendet. Je nach Untersuchungszeitraum beläuft sich der Anteil der erklärten Varianz auf 9,29% bis 13,62%. Es konnte eine signifikanter negativer Einfluß zwischen der Veränderung des allgemeinen Zinsniveaus und den Risikoprämien von Versicherungsaktien identifiziert werden. Weiterhin ist Wechselkurses der DM zum US-Dollar signifikant.
Our study provides evidence on the share price reactions to the announcement of equity issues in Germany, where capital market is characterized by institutional features distinct from the U.S. market. German seasoned equity issues yield a positive market reaction which contrasts to the significant negative abnormal returns reported for the U.S. We provide evidence that these results are due to differences in both issuing characteristics and floatation methods, and in the corporate governance and ownership structures of the two countries. Our study explains much of the empirical puzzle of different market reactions to seemingly similar events across financial markets.
Ja, der Ablauf der Lock-up-Frist ist ein kursrelevantes Ereignis. Wir untersuchen Kursreaktionen auf das Ende der Lock-up-Frist bei 142 Unternehmen des Neuen Marktes. Da der Ablauf der Sperrfrist bereits zum Zeitpunkt des Börsengangs bekannt ist, erwarten wir bei einem (semi-)informationseffizienten Kapitalmarkt durchschnittlich keine Kursreaktion. Im Rahmen einer Ereignisstudie zeigen wir aber, dass sich am Ende der Sperrfrist signifikant negative Überrenditen ergeben. Finanzmarktförderungsgesetzes. This paper explores the materiality of expirations of lock-up provisions that prevent insiders from selling their shares after the initial public offering (IPO). We examine 172 lock-up agreements of 142 IPOs floated on Germany’s New Market. Since the date of the lock-up expiration is common knowledge at the IPO, we would not expect to find abnormal returns surrounding the event day, assuming that markets are informationally efficient. However, using an event-study methodology we detect statistically significant negative abnormal returns and a twenty-five percent increase in trading volume surrounding lock-up expiration. The negative abnormal returns are larger for firms with high volatility, superior performance after the IPO, and low free float. The results of our study raise important regulatory issues with respect to disclosure rules of firms going public. We argue that insiders should be legally required to disclose their sell transactions in order to protect new and less informed shareholders.

Neben einer strukturierten Darstellung der zahlreichen Regulierungstatbestände werden aus Sicht der Finanzierungstheorie sowie den empirischen Verhältnissen an den Kapitalmärkten die im VAG enthaltenen Rahmenbedingungen einer kritischen Bewertung unterzogen.

Untersuchungsgegenstand ist der empirische Gehalt der ökonomischen Theorie eines Hedgings auf Unternehmensebene. In den USA wurde die Hedging-Theorie in einer Reihe von empirischen Studien aufgegriffen. Die Befunde sind zumeist konsistent mit dem Erklärungsansatz von Froot/Scharfstein/Stein (1993), wonach eine Verringerung der Cashflow-Volatilität – unter der Annahme steigender Außenfinanzierungskosten – zu einer Reduzierung von Unterinvestitionskosten führt. Bei deutschen Unternehmen besitzt dieser Ansatz bemerkenswerterweise jedoch nur einen geringen Erklärungsgehalt. Die Ergebnisunterschiede können auf unterschiedliche Kapitalmarktverhältnisse zurückgeführt werden: Die unterstellten steigenden Kosten der Außenfinanzierung besitzen für deutsche Unternehmen aufgrund der Dominanz des Bezugsrechtsverfahrens sowie der Rolle der Hausbank als Mechanismus zur Überwindung von Informationsproblemen eine vergleichsweise geringere Bedeutung. Die Managerinteressen erweisen sich bei deutschen Unternehmen als eine wesentliche Hedging-Determinante. Zwischen der Höhe des gebundenen Managervermögens und der Hedging-Wahrscheinlichkeit besteht entsprechend der Hedging-Theorie ein signifikanter positiver Zusammenhang. Entgegen den amerikanischen Befunden kann jedoch eine disziplinierende Wirkung von Großaktionären auf die Hedging-Entscheidung nicht beobachtet werden. Zur Berücksichtigung der spezifischen deutschen Kapitalmarktverhältnisse wird der Einfluss von Bankenbeteiligungen und Familienunternehmen auf die Hedging-Entscheidung untersucht. Ein Bankeneinfluss auf die Derivateeinsatz-Entscheidung kann jedoch nicht festgestellt werden. Entgegen Diversifikations- und Kapitalmarktüberlegungen besteht bei Familienunternehmen interessanterweise eine signifikant geringere Hedging-Wahrscheinlichkeit.
Since the beginning of the 1990s, it has been widely expected that the implementation of the European Single Market would lead to a rapid convergence of Europe’s financial systems. In the present paper we will show that at least in the period prior to the introduction of the common currency this expected convergence did not materialise. Our empirical studies on the significance of various institutions within the financial sectors, on the financing patterns of firms in various countries and on the predominant mechanisms of corporate governance, which are summarised and placed in a broader context in this paper, point to few, if any, signs of a convergence at a fundamental or structural level between the German, British and French financial systems. The German financial system continues to appear to be bank-dominated, while the British system still appears to be capital market-dominated. During the period covered by the research, i.e. 1980 – 1998, the French system underwent the most far-reaching changes, and today it is difficult to classify. In our opinion, these findings can be attributed to the effects of strong path dependencies, which are in turn an outgrowth of relationships of complementarity between the individual system components. Projecting what we have observed into the future, the results of our research indicate that one of two alternative paths of development is most likely to materialise: either the differences between the national financial systems will persist, or – possibly as a result of systemic crises – one financial system type will become the dominant model internationally. And if this second path emerges, the Anglo-American, capital market-dominated system could turn out to be the “winner”, because it is better able to withstand and weather crises, but not necessarily because it is more efficient.
In this paper we study the benefits derived from international diversification of stock portfolios from German and Hungarian point of view. In contrast to the German capital market, which is one of the largest in the world, the Hungarian Stock Exchange is an emerging market. The Hungarian stock market is highly volatile, high returns are often accompanied by extremely large risk. Therefore, there is a good potential for Hungarian investors to realize substantial benefits in terms of risk reduction by creating multi-currency portfolios. The paper gives evidence on the above me ntioned benefits for both countries by examining the performance of several ex ante portfolio strategies. In order to control the currency risk, different types of hedging approaches are implemented.
Wenn man untersuchen möchte, ob sich die Finanzsysteme verschiedener Länder im Verlauf der letzten Jahre aneinander angeglichen haben oder demnächst angleichen werden, braucht man ein Konzept zur Beschreibung von Finanzsystemen, durch das wesentliche Strukturen, deren Unterschiede und Veränderungen erkennbar werden, ohne dabei in "Systemgeschwafel" (D. Schneider) abzugleiten. Wir haben dafür das Konzept der Komplementarität als nützlich identifiziert. Der Beitrag stellt dieses Konzept vor und soll und seine Eignung belegen. Letztlich geht es dabei auch um die Frage, ob reale Finanzsysteme konsistente Systeme mit komplementären Elementen darstellen. Nach der Vorstellung der formalen Konzepte der Komplementarität und der Konsistenz wird "das Finanzsystem" auf seine Komple mentarität untersucht. Dazu wird ein Finanzsystem aus der Sicht von Unternehmen des nichtfinanziellen Sektors als ein System gekennzeichnet, das aus drei Teilsystemen besteht. Das erste Teilsystem ist das Finanzierungssystem einschließlich Finanzsektor und Mustern der Unternehmensfinanzierung, das zweite das Corporate Governance-System und das dritte das Unternehmens-Strategie-System. Für alle drei Teilsysteme wird – allgemein und mit Bezug auf die Finanzsysteme Deutschlands, Japans und der USA - gezeigt, inwieweit die Elemente der betreffenden Teilsysteme untereinander komplementär sind, und geprüft, ob sie in ihren Ausprägungen auch konsistent sind, d.h. wirklich "zueinander passen". Untersucht wird auch die Komplementarität und Konsistenz zwischen den Teilsystemen selbst. Der Beitrag endet mit Überlegungen über die Anwendung des Komplementaritätskonzepts. Dass ein Finanzsystem die Eigenschaft der Komplementarität aufweist, hat nicht nur weitreichende Implikationen für die Methodik der Analyse von Finanzsystemen, sondern auch für die Vorhersehbarkeit der Entwicklung von Finanzsystemen und damit für die Wahrscheinlichkeit einer Konvergenz von Finanzsystemen, für deren Effizienzeigenschaften und für die Möglichkeiten, Finanzsysteme durch gestaltende Eingriffe zu verbessern.
The paper presents an empirical analysis of the alledged transformation of the financial systems in the three major European economies, France, Germany and the UK. Based on a unified data set developed on the basis of national accounts statistics, and employing a new and consistent method of measurement, the following questions are addressed: Is there a common pattern of structural change; do banks lose importance in the process of change; and are the three financial systems becoming more similar? We find that there is neither a general trend towards disintermediation, nor towards a transformation from bank-based to capital market-based financial systems, nor for a loss of importance of banks. Only in the case of France strong signs of transformation as well as signs of a general decline in the role of banks could be found. Thus the three financial systems also do not seem to become more similar. However, there is also a common pattern of change: the intermediation chains are lengthening in all three countries. Nonbank financial intermediaries are taking over a more important role as mobilizers of capital from the non-financial sectors. In combination with the trend towards securitization of bank liabilites, this change increases the funding costs of banks and may put banks under pressure. In the case of France, this change is so pronounced that it might even threaten the stability of the financial system.
This chapter focuses on institutional investors in the German financial markets. Institutional investors are specialized financial intermediaries who collect and manage funds on behalf of small investors toward specific objectives in terms of risk, return and maturity. The major types of institutional investors in Germany are insurance companies and investment funds. We will examine the nature of their businesses, their size and role in the financial sector, the size and the composition of the assets under their management, aspects of financ ial regulation, and features of their asset-liability-management.
What constitutes a financial system in general and the German financial system in particular?

This paper is one of the two introductory chapters of the book "The German Financial System". It first discusses two issues that have a general bearing on the entire book, and then provides a broad overview of the German financial system. The first general issue is that of clarifying what we mean by the key term "financial system" and, based on this definition, of showing why the financial system of a country is important and what it might be important for. Obviously, a definition of its subject matter and an explanation of its importance are required at the outset of any book. As we will explain in Section II, we use the term "financial system" in a broad sense which sets it clearly apart from the narrower concept of the "financial sector". The second general issue is that of how financial systems are described and analysed. Obviously, the definition of the object of analysis and the method by which the object is to be analysed are closely related to one another. The remainder of the paper provides a general overview of the German financial system. In addition, it is intended to provide a first indication of how the elements of the German financial system are related to each other, and thus to support our claim from Section II that there is indeed some merit in emphasising the systemic features of financial systems in general and of the German financial system in particular. The chapter concludes by briefly comparing the general characteristics of the German financial system with those of the financial systems of other advanced industrial countries, and taking a brief look at recent developments which might undermine the "systemic" character of the German financial system.
The purpose of this paper is to compare three different index construction methodologies of commercial property investments. We examine for different European countries (i) appraisal-based indices and methods of „unsmoothing“ the corresponding return series, (ii) indices that trace average ex-post transaction prices over time, and (iii) indices based on Real Estate Investment Trust share prices.
Under a new Basel capital accord, bank regulators might use quantitative measures when evaluating the eligibility of internal credit rating systems for the internal ratings based approach. Based on data from Deutsche Bundesbank and using a simulation approach, we find that it is possible to identify strongly inferior rating systems out-of time based on statistics that measure either the quality of ranking borrowers from good to bad, or the quality of individual default probability forecasts. Banks do not significantly improve system quality if they use credit scores instead of ratings, or logistic regression default probability estimates instead of historical data. Banks that are not able to discriminate between high- and low-risk borrowers increase their average capital requirements due to the concavity of the capital requirements function.

Open-end real estate funds (so called “Offene Immobilienfonds”) play a major role in the German market for securitised real estate investments. Such funds are pools of money from many investors, which are invested in real estate by special investment management companies. This study seeks to identify the risk and return profile of this investment vehicle (before and after income taxes), to compare them with those of other major asset classes, and to provide implications for their appropriate role in a mixed-asset portfolio. Addition-ally, an overview of the institutional architecture and role of German open-end real estate funds is given. Empirical evidence suggests that the financial characteristics of open-end real estate funds are in many respects similar to those reported for direct real estate invest-ments. Accordingly, German open-end real estate funds qualify for medium and long-term investment horizons, rather than for shorter holding periods.
This paper investigates the magnitude and the main determinants of share price reactions to buy-back announcements of German corporations. Based on a sample of 224 announcements from the period May 1998 to April 2003 we find average cumulative abnormal returns around -7.5% for the thirty days preceding the announcement and around +7.0 % for the ten days following the announcement. We regress postannouncement abnormal returns with multiple firm characteristics and provide evidence which supports the undervaluation signaling hypothesis but not the excess cash hypothesis. In extending prior empirical work, we also analyze price effects from an initial statement by management that it intends to seek shareholder approval for a buy-back plan. Observed cumulative abnormal returns on this initial date are in excess of 5% implying a total average price effect between 12% and 15% from implementing a buy-back plan. We conjecture that the German regulatory environment is the main reason why market variations to buy-back announcements are much stronger in Germany than in other countries and conclude that initial statements by managers to seek shareholders’ approval for a buy-back plan should also be subject to legal ad-hoc disclosure requirements. A widely recognized paper by Colin Mayer (1988) has led to a profound revision of academic thinking about financing patterns of corporations in different countries. Using flow-of-funds data instead of balance sheet data, Mayer and others who followed his lead found that internal financing is the dominant mode of financing in all countries, that therefore financial patterns do not differ very much between countries and that those differences which still seem to exist are not at all consistent with the common conviction that financial systems can be classified as being either bank-based or capital market-based. This leads to a puzzle insofar as it calls into question the empirical foundation of the widely held belief that there is a correspondence between the financing patterns of corporations on the one side, and the structure of the financial sector and the prevailing corporate governance system in a given country on the other side. The present paper addresses this puzzle on a methodological and an empirical basis. It starts by demonstrating that the surprising empirical results found by Mayer et al. are due to a hidden assumption underlying their methodology. It then derives an alternative method of measuring financing patterns, which also uses flow-of-funds data, but avoids the questionable assumption. This measurement concept is then applied to patterns of corporate financing in Germany, Japan and the United States. The empirical results are very much in line with the commonly held belief prior to Mayer’s influential contribution and indicate that the financial systems of the three countries do indeed differ from one another in a substantial way.
This paper suggests a motive for bank mergers that goes beyond alleged and typically unverifiable scale economies: preemtive resolution of banks´ financial distress. Such "distress mergers" can be a significant motivation for mergers because they can foster reorganizations, realize diversification gains, and avoid public attention. However, since none of these potential benefits comes without a cost, the overall assessment of distress mergers is unclear. We conduct an empirical analysis to provide evidence on consequences of distress mergers. The analysis is based on comprehensive data from Germany´s savings and cooperatives banks sectors over the period 1993 to 2001. During this period both sectors faced significant structural problems and superordinate institutions (associations) presumably have engaged in coordinated actions to manage distress mergers. The data comprise 3640 banks and 1484 mergers. Our results suggest that bank mergers as a means of preemtive distress resolution have moderate costs in terms of the economic impact on performance. We do find strong evidence consistent with diversification gains. Thus, distress mergers seem to have benefits without affecting systematic stability adversely.
In this study, we develop a technique for estimating a firm’s expected cost of equity capital derived from analyst consensus forecasts and stock prices. Building on the work of Gebhardt/Lee/-Swaminathan (2001) and Easton/Taylor/Shroff/Sougiannis (2002), our approach allows daily estimation, using only publicly available information at that date. We then estimate the expected cost of equity capital at the market, industry and individual firm level using historical German data from 1989-2002 and examine firm characteristics which are systematically related to these estimates. Finally, we demonstrate the applicability of the concept in a contemporary case study for DaimlerChrysler and the European automobile industry.
The German corporate governance system has long been cited as the standard example of an insider-controlled and stakeholder-oriented system. We argue that despite important reforms and substantial changes of individual elements of the German corporate governance system the main characteristics of the traditional German system as a whole are still in place. However, in our opinion the changing role of the big universal banks in the governance undermines the stability of the corporate governance system in Germany. Therefore a breakdown of the traditional system leading to a control vacuum or a fundamental change to a capital market-based system could be in the offing.
This article presents an overview of the contemporary German insurance market, its structure, players, and development trends. First, brief information about the history of the insurance industry in Germany is provided. Second, the contemporary market is analyzed in terms of its legal and economic structure, with statistics on the number of companies, insurance density and penetration, the role of insurers in the capital markets, premiums split, and main market players and their market shares. Furthermore, the three biggest insurance lines—life, health, and property and casualty—are considered in more detail, such as product range, country specifics, and insurance and investment results. A section on regulation outlines its implementation in the insurance sector, offering information on the underlying legislative basis, supervisory body, technical procedures, expected developments, and sources of more detailed information.
Mängel bei der Abschlußprüfung : Tatsachenberichte und Analysen aus betriebswirtschaftlicher Sicht

Unternehmenskrisen, „überraschende“ zumal, standen am Anfang der gesetzlichen Normierung der Abschlußprüfung in Deutschland. Es entspricht daher einem legitimen Anliegen von Öffentlichkeit und Fachwelt, die herrschende Maßstäblichkeit der Qualität von Abschlußprüfungen und die Glaubwürdigkeit4 von Abschlußprüfern insbesondere dann in gesteigertem Maße als Problem zu begreifen, wenn den gesetzlichen Schutzzwecken und Schutznormen der etablierten Abschlußprüfung zum Trotz Unternehmen in eine Krise geraten: Denn innerhalb der institutionellen Mechanismen ihrer Früherkennung – eines funktionalen Teils des deutschen Systems von corporate governance – gilt die Pflichtprüfung mit Recht als pivotales Element. Vieles an festzustellender Kritik mag hierbei einem der Komplexität der zu verhandelnden Sachzusammenhänge unüberbrückbaren Laienverständnis geschuldet sein; manches aber ist sicherlich erklärlich durch verbesserbare gesetzliche Vorschriften, zu lösende theoretische (ökonomische und rechtswissenschaftliche) Problemstellungen und eine zu fördernde gute Berufspraxis. Jüngste fragliche Mängel der Abschlußprüfung geben den Anlaß zu vorliegenden Tatsachenberichten und betriebswirtschaftlichen Analysen. Die getroffene Auswahl der Unternehmen ist hierbei ebenso willkürlich wie die der betroffenen Wirtschaftsprüfungsgesellschaften – nicht zufällig ist indes die Auswahl der betriebswirtschaftlichen Grundprobleme: Betreffen diese doch wesentliche Erwartungen an die Abschlußprüfung, die offenbar so regelmäßig enttäuscht wurden, daß selbst in Regierungsbegründungen von Gesetzesvorlagen nunmehr eine „sog. Erwartungslücke“5 bemüht wird. Die Erwartungslücken ergeben sich hierbei insbesondere aus der Vorstellung, daß (a) der gesetzliche Pflichtprüfer bei einer ordnungsmäßigen Prüfung zwingend doloses Handeln aufzudecken habe, daß (b) bilanzielle Wertansätze hinreichend zuverlässige Größen bilden, die über die Vermögenslage des Unternehmens berichten und schließlich (c) die Prüfung der tatsächlichen wirtschaftlichen Lage des Unternehmens und die Unterrichtung hiervon in Prüfungsbericht und Bestätigungsvermerk eine Selbstverständlichkeit der Pflichtprüfung sei. Diesen Erwartungen folgt der Gang der Untersuchung.
Intangible assets as goodwill, licenses, research and development or customer relations become in high technology and service orientated economies more and more important. But comparing the book values of listed companies and their market capitalization the financial reports seems to fail the information needs of market participants regarding the estimate of the proper firm value. Moreover, with the introduction of Anglo-American accounting systems in Europe and Asia we can observe even in the accounts of companies sited in the same jurisdiction diverging accounting practices for intangible assets caused by different accounting standards. To assess the relevance of intangible assets in Japanese and German accounts of listed companies we therefore measure certain balance sheet and profit and loss relations according to goodwill and self-developed software. We compare and analyze valuation rules for goodwill and software costs according to German GAAP, Japanese GAAP, US GAAP and IAS to determine the possible impact of diverging rules in the comparability of the accounts. Our results show that the comparability of the accounts is impaired because of different accounting practices. The recognition and valuation of goodwill and self-developed software varies significantly according to the accounting regime applied. However, for the recognition of self-developed software, the effect on the average impact on asset coefficients or profit is not that high. Moreover, an industry bias can only be found for the financial industry. In contrast, for goodwill accounting we found major differences especially between German and Japanese Blue Chips. The introduction of the new goodwill impairment only approach and the prohibition of the pooling method may have a major impact especially for Japanese companies’ accounts.

The empirical results, which use an estimation technique for determining gross flows of funds in those cases in which empirical data are not available, are very much in line with the commonly held belief prior to Mayer’s influential contribution and indicate that the financial systems of the three countries do indeed differ from one another in a substantial way, and moreover in a way which is largely in line with the general view of the differences between the financial systems of the countries covered in the present paper.
A financial system can only perform its function of channelling funds from savers to investors if it offers sufficient assurance to the providers of the funds that they will reap the rewards which have been promised to them. To the extent that this assurance is not provided by contracts alone, potential financiers will want to monitor and influence managerial decisions. This is why corporate governance is an essential part of any financial system. It is almost obvious that providers of equity have a genuine interest in the functioning of corporate governance. However, corporate governance encompasses more than investor protection. Similar considerations also apply to other stakeholders who invest their resources in a firm and whose expectations of later receiving an appropriate return on their investment also depend on decisions at the level of the individual firm which would be extremely difficult to anticipate and prescribe in a set of complete contingent contracts. Lenders, especially long-term lenders, are one such group of stakeholders who may also want to play a role in corporate governance; employees, especially those with high skill levels and firm-specific knowledge, are another. The German corporate governance system is different from that of the Anglo-Saxon countries because it foresees the possibility, and even the necessity, to integrate lenders and employees in the governance of large corporations. The German corporate governance system is generally regarded as the standard example of an insider-controlled and stakeholder-oriented system. Moreover, only a few years ago it was a consistent system in the sense of being composed of complementary elements which fit together well. The first objective of this paper is to show why and in which respect these characterisations were once appropriate. However, the past decade has seen a wave of developments in the German corporate governance system, which make it worthwhile and indeed necessary to investigate whether German corporate governance has recently changed in a fundamental way. More specifically one can ask which elements and features of German corporate governance have in fact changed, why they have changed and whether those changes which did occur constitute a structural change which would have converted the old insider-controlled system into an outsider-controlled and shareholder-oriented system and/or would have deprived it of its former consistency. It is the second purpose of this paper to answer these questions.
Die Verbriefung des Cash Flows eines Unternehmens ist eine in Großbritannien bekannte und etablierte Form der Unternehmensfinanzierung. In Deutschland hat es bisher erst zwei Transaktionen dieser Art gegeben. Die Gründe hierfür liegen in den unterschiedlichen rechtlichen Systemen und den unterschiedlichen Möglichkeiten der Darlehensbesicherung. Dieser Aufsatz beschreibt die diesbezüglichen wesentlichen Unterschiede und stellt Strukturen vor, mit denen auch im deutschen Rechtskreis entsprechende Transaktionen umgesetzt werden können.
Die Frage nach den Formen und Bestimmungsfaktoren der Eingliederung der ausländischen Bevölkerung gewinnt mit der dauerhaften Niederlassung der ehemals als „Gastarbeiter“ zugewanderten Gruppen und ihrer Nachkommen zunehmend an Bedeutung. Häufig mangelt es aber an geeigneten Daten, um empirisch fundierte Antworten auf gesellschaftlich vieldiskutierte Fragen zu geben: Wie weit ist die Integration von Personen mit Migrationshintergrund (Migranten) im schulischen und beruflichen Bereich fortgeschritten, und wie lässt sich die Distanz zu den Deutschen gegebenenfalls erklären? Wie ist es um das Interesse und die Partizipation von Migranten im politischen und sozialen Bereich bestellt? Nehmen inter-ethnische Eheschließungen und Freundschaftsbeziehungen zu, und gibt es diesbezüglich Unterschiede zwischen den Nationalitätengruppen? Diese Fragen stellen sich besonders dringlich, wenn es um die „zweite“ oder „dritte Generation“ von Migranten geht, wird doch die Integration oder Segregation dieser Gruppe die Gesellschaft in Deutschland in den nächsten Jahrzehnten entscheidend prägen. Aus diesen Gründen wurde im Juli 2000 der Auftrag zu einer breit angelegten Befragung italienisch-und türkischstämmiger Migranten im Alter von 18 bis 30 Jahre sowie einer deutschen Kontrollgruppe (je ca. 1.200 Befragte) an das Markt- und Meinungsforschungsinstitut BIK Aschpurwis und Behrens, Hamburg, vergeben. Die Erhebungsdaten wurden Ende März 2001 an das Bundesinstitut für Bevölkerungsforschung (BiB) geliefert. Bei der Befragung wurden Items über die Lebensverhältnisse, das Verhalten und die Einstellungen erhoben. Im Mittelpunkt standen thematisch die schulische, berufliche, soziale, sprachliche und identifikative Integration; Art und Ausmaß der Kontakte zur ethnischen Community und ihren Einrichtungen; Einstellungen zum Leben in Deutschland und zur politischen Partizipation sowie familiale Lebensbedingungen und Einstellungen. Aufgrund der thematischen Breite des Surveys und der hohen Anzahl an Befragten lassen sich anhand der Daten fundierte Aussagen über die Eingliederungsmuster der untersuchten Gruppen machen. We use consumer price data for 81 European cities (in Germany, Austria, Switzerland, Italy, Spain and Portugal) to study deviations from the law-of-one-price before and during the European Economic and Monetary Union (EMU) by analysing both aggregate and disaggregate CPI data for 7 categories of goods we find that the distance between cities explains a significant amount of the variation in the prices of similar goods in different locations. We also find that the variation of the relative price is much higher for two cities located in different countries than for two equidistant cities in the same country. Under EMU, the elimination of nominal exchange rate volatility has largely reduced these border effects, but distance and border still matter for intra-European relative price volatility. This paper analyzes a comprehensive data set of 108 non venture-backed, 58 venture-backed and 33 bridge financed companies going public at Germany s Neuer Markt between March 1997 and March 2000. I examine whether these three types of issues differ with regard to issuer characteristics, balance sheet data or offering characteristics. Moreover, this empirical study contributes to the underpricing literature by focusing on the complementary or rather competing role of venture capitalists and underwriters in certifying the quality of a company when going public. Companies backed by a prestigious venture capitalist and/or underwritten by a top bank are expected to show less underpricing at the initial public offering (IPO) due to a reduced ex-ante uncertainty. This study provides evidence to the contrary: VC-backed IPOs appear to be more underpriced than non VCbacked IPOs.
We characterize the response of U.S., German and British stock, bond and foreign exchange markets to real-time U.S. macroeconomic news. Our analysis is based on a unique data set of high-frequency futures returns for each of the markets. We find that news surprises produce conditional mean jumps; hence high-frequency stock, bond and exchange rate dynamics are linked to fundamentals. The details of the linkages are particularly intriguing as regards equity markets. We show that equity markets react differently to the same news depending on the state of the economy, with bad news having a positive impact during expansions and the traditionally-expected negative impact during recessions. We rationalize this by temporal variation in the competing "cash flow" and "discount rate" effects for equity valuation. This finding helps explain the time-varying correlation between stock and bond returns, and the relatively small equity market news effect when averaged across expansions and recessions. Lastly, relying on the pronounced heteroskedasticity in the high-frequency data, we document important contemporaneous linkages across all markets and countries over-and-above the direct news announcement effects. Financial theory creates a puzzle. Some authors argue that high-risk entrepreneurs choose debt contracts instead of equity contracts since risky but high returns are of relatively more value for a loan-financed firm. On the contrary, authors who focus explicitly on start-up finance predict that entrepreneurs are the more likely to seek equity-like venture capital contracts, the more risky their projects are. Our paper makes a first step to resolve this puzzle empirically. We present microeconometric evidence on the determinants of debt and equity financing in young and innovative SMEs. We pay special attention to the role of risk for the choice of the financing method. Since risk is not directly observable we use different indicators for financial and project risk. It turns out that our data generally confirms the hypothesis that the probability that a young high-tech firm receives equity financing is an increasing function of the financial risk. With regard to the intrinsic project risk, our results are less conclusive, as some of our indicators of a risky project are found to have a negative effect on the likelihood to be financed by private equity.
This paper aims to analyze the impact of different types of venture capitalists on the performance of their portfolio firms around and after the IPO. We thereby investigate the hypothesis that different governance structures, objectives and track record of different types of VCs have a significant impact on their respective IPOs. We explore this hypothesis by using a data set embracing all IPOs which occurred on Germany's Neuer Markt. Our main finding is that significant differences among the different VCs exist. Firms backed by independent VCs perform significantly better two years after the IPO compared to all other IPOs and their share prices fluctuate less than those of their counterparts in this period of time. Obviously, independent VCs, which concentrated mainly on growth stocks (low book-to-market ratio) and large firms (high market value), were able to add value by leading to less post-IPO idiosyncratic risk and more return (after controlling for all other effects). We present an analysis of VaR forecasts and P&L-series of all 13 German banks that used internal models for regulatory purposes in the year 2001. To this end, we introduce the notion of well-behaved forecast systems. Furthermore, we provide a series of statistical tools to perform our analyses. The results shed light on the forecast quality of VaR models of the individual banks, the regulator's portfolio as a whole, and the main ingredients of the computation of the regulatory capital required by the Basel rules.
The paper describes the legal and economic environment of mergers and acquisitions in Germany and explores barriers to obtaining and executing corporate control. Various cases are used to demonstrate that resistance by different stakeholders including minority shareholders, organized labour and the government may present powerful obstacles to takeovers in Germany. In spite of the overall convergence of European takeover and securities trading laws, Germany still shows many peculiarities that make its market for corporate control distinct from other countries. Concentrated share ownership, cross shareholdings and pyramidal ownership structures are frequent barriers to acquiring majority stakes. Codetermination laws, the supervisory board structure and supermajority requirements for important corporate decisions limit the execution of control by majority shareholders. Bidders that disregard the German preference for consensual solutions and the specific balance of powers will risk their takeover attempt be frustrated by opposing influence groups. This paper is a draft for the chapter "German banks and banking structure" of the forthcoming book "The German financial system" edited by J.P. Krahnen and R.H. Schmidt (Oxford University Press). As such, the paper starts out with a description of past and present structural features of the German banking industry. Given the presented empirical evidence it then argues that great care has to be taken when generalising structural trends from one financial system to another. Whilst conventional commercial banking is clearly in decline in the US, it is far from clear whether the dominance of banks in the German financial system has been significantly eroded over the last decades. We interpret the immense stability in intermediation ratios and financing patterns of firms between 1970 and 2000 as strong evidence for our view that the way in which and the extent to which German banks fulfil the central functions for the financial system are still consistent with the overall logic of the German financial system. In spite of the current dire business environment for financial intermediaries we do not expect the German financial system and its banking industry as an integral part of this system to converge to the institutional arrangements typical for a market-oriented financial system.
We present a survey on the role of initial public offerings (Epos) and venture capital (VC) in Germany after the Second World War. Between 1945 and 1983 IPOs hardly played a role at all and only a minor role thereafter. In addition, companies that chose an IPO were much older and larger than the average companies going public for the first time in the US or the UK. The level of IPO underpricing in Germany, in contrast, has not been fundamentally different from that in other countries. The picture for venture capital financing is not much different from that provided by IPOs in Germany. For a long time venture capital financing was hardly significant, particularly as a source of early stage financing. The unprecedented boom on the Neuer Markt between 1997 and 2000, when many small venture capital financed firms entered the market, provides a striking contrast to the preceding era. However, by US standards, the levels of both IPO and venture capital activities remained rather low even in this boom phase. The extent to which recent developments will have a lasting impact on the financing of German firms, the level of IPO activity, and venture capital financing, remains to be seen. At the time of writing, activity has come to a near stand still and the Neuer Markt has just been dissolved. The low number of IPOs and the fairly low volume of VC financing in Germany before the introduction of the Neuer Markt are a striking and much debated phenomenon. Understanding the reasons for these apparent peculiarities is vital to understanding the German financial system. The potential explanations that have been put forward range from differentces in mentality to legal and institutional impediments and the availability of alternative sources of financing. Moreover the recent literature discusses how interest groups may have benefited and influenced the situation. Using a unique, hand-collected database of all venture-backed firms listed on Germany´s Neuer Markt, we analyze the history of venture capital financing of these firms before the IPO and the behavior of venture capitalists at the IPO. We can detect significant differences in the behavior and characteristics of German vs. foreign venture capital firms. The discrepancy in the investment and divestment strategies may be explained by the grandstanding phenomenon, the value-added hypothesis and certification issues. German venture capitalists are typically younger and smaller than their counterparts from abroad. They syndicate less. The sectoral structure of their portfolios differs from that of foreign venture capital firms. We also find that German venture capitalists typically take companies with lower offering volumes on the market. They usually finance firms in a later stage, carry through fewer investment rounds and take their portfolio firms public earlier. In companies where a German firm is the lead venture capitalist, the fraction of equity held by the group of venture capitalists is lower, their selling intensity at the IPO is higher and the committed lock-up period is longer.
Some of the most widely expressed myths about the German financial system are concerned with the close ties and intensive interaction between banks and firms, often described as Hausbank relationships. Links between banks and firms include direct shareholdings, board representation, and proxy voting and are particularly significant for corporate governance. Allegedly, these relationships promote investment and improve the performance of firms. Furthermore, German universal banks are believed to play a special role as large and informed monitoring investors (shareholders). However, for the very same reasons, German universal banks are frequently accused of abusing their influence on firms by exploiting rents and sustaining the entrenchment of firms against efficient transfers of firm control. In this paper, we review recent empirical evidence regarding the special role of banks for the corporate governance of German firms. We differentiate between large exchangelisted firms and small and medium sized companies throughout. With respect to the role of banks as monitoring investors, the evidence does not unanimously support a special role of banks for large firms. Only one study finds that banks´ control of management goes beyond what nonbank shareholders achieve. Proxyvoting rights apparently do not provide a significant means for banks to exert management control. Most of the recent evidence regarding small firms suggests that a Hausbank relationship can indeed be beneficial. Hausbanks are more willing to sustain financing when borrower quality deteriorates, and they invest more often than arm´s length banks in workouts if borrowers face financial distress.
In Germany a public discussion on the "power of banks" has been going on for decades now with power having at least two meanings. On the one hand it is the power of banks to control public corporations through direct shareholdings or the exercise of proxy votes - this is the power of banks in corporate control. On the other hand it is market power - due to imperfect competition in markets for financial services - that banks exercise vis-à-vis their loan and deposit customers. In the past, bank regulation has often been blamed to undermine competition and the working of market forces in the financial industry for the sake of soundness and stability of financial services firms. This chapter tries to shed some light on the historical development and current state of bank regulation in Germany. In so doing it tries to embed the analysis of bank regulation into a more general industrial organisation framework. For every regulated industry, competition and regulation are deeply interrelated as most regulatory institutions - even if they do not explicitly address the competitiveness of the market - either affect market structure or conduct. This paper tries to uncover some of the specific relationships between monetary policy, government interference and bank regulation on the one hand and bank market structure and economic performance on the other. In so doing we hope to point to several areas for fruitful research in the future. While our focus is on Germany, some of the questions that we raise and some of our insights might also be applicable to banking systems elsewhere. The German financial system is the archetype of a bank-dominated system. This implies that organized equity markets are, in some sense, underdeveloped. The purpose of this paper is, first, to describe the German equity markets and, second, to analyze whether it is underdeveloped in any meaningful sense. In the descriptive part we provide a detailed account of the microstructure of the German equity markets, putting special emphasis on recent developments. When comparing the German market with its peers, we find that it is indeed underdeveloped with respect to market capitalization. In terms of liquidity, on the other hand, the German equity market is not generally underdeveloped. It does, however, lack a liquid market for block trading. Klassifikation: G 51 . This chapter analyzes the role of financial accounting in the German financial system. It starts from the common perception that German accounting is rather "uninformative". This characterization is appropriate from the perspective of an arm´s length or outside investor and when confined to the financial statements per se. But it is no longer accurate when a broader perspective is adopted. The German accounting system exhibits several arrangements that privately communicate information to insiders, notably the supervisory board. Due to these features, the key financing and contracting parties seem reasonably well informed. The same cannot be said about outside investors relying primarily on public disclosure. A descriptive analysis of the main elements of the Germany system and a survey of extant empirical accounting research generally support these arguments.
Over-allotment arrangements are nowadays part of almost any initial public offering. The underwriting banks borrow stocks from the previous shareholders to issue more than the initially announced number of shares. This is combined with the option to cover this short position at the issue price. We present empirical evidence on the value of these arrangements to the underwriters of initial public offerings on the Neuer Markt. The over-allotment arrangement is regarded as a portfolio of a long call option and a short position in a forward contract on the stock, which is different from other approaches presented in the literature. Given the economically substantial values for these option-like claims we try to identify benefits to previous shareholders or new investors when the company is using this instrument in the process of going public. Although we carefully control for potential endogeneity problems, we find virtually no evidence for a reduction in underpricing for firms using over-allotment arrangements. Furthermore, we do not find evidence for more pronounced price stabilization activities or better aftermarket performance for firms granting an over-allotment arrangement to the underwriting banks.
This paper investigates the financial contracting behavior of German venture capitalists against the results of recent theoretical work on the design of venture capital contracts, especially with regard to the use of convertible securities. First, we identify a special feature of the German market, namely that public-private partnership agencies require significantly lower returns than private and young venture capitalists. The latter are most likely to follow their North-American counterpart by refinancing themselves with closed-end funds. Second, with regard to financing practices it is shown that the use of convertibles, relative to other instruments, is influenced by the anticipated severity of agency problems. Deutsche Börse AG plans to introduce a system (Xetra Best) allowing brokers and broker-dealers to internalize the orders of retail customers. Further, Xetra Best supports payment for order flow arrangements. Both internalization and payment for order flow may be detrimental to market quality. This paper discusses advantages and disadvantages of these arrangements. It draws on experiences made in the US. We derive policy implications that aim at a more stringent interpretation of "best execution", and at higher transparency. Klassifikation: G10, G14
Forecasting stock market volatility and the informational efficiency of the DAX-index options market

Alternative strategies for predicting stock market volatility are examined. In out-of-sample forecasting experiments implied-volatility information, derived from contemporaneously observed option prices or history-based volatility predictors, such as GARCH models, are investigated, to determine if they are more appropriate for predicting future return volatility. Employing German DAX-index return data it is found that past returns do not contain useful information beyond the volatility expectations already reflected in option prices. This supports the efficient market hypothesis for the DAX-index options market.
Money-back guarantees in individual pension accounts : evidence from the German pension reform

The German Retirement Saving Act instituted a new funded system of supplementary pensions coupled with a general reduction in the level of state pay-as-you-go old-age pensions. In order to qualify for tax relief, the providers of supplementary savings products must offer a guarantee of the nominal value at retirement of contributions paid into these saving accounts. This paper explores how this "money-back" guarantee works and evaluates alternative designs for guarantee structures, including a life cycle model (dynamic asset allocation), a plan with a pre-specified blend of equity and bond investments (static asset allocation), and some type of portfolio insurance. We use a simulation methodology to compare hedging effectiveness and hedging costs associated with the provision of the money-back guarantee. This paper uses a unique data set from credit files of six leading German banks to provide some empirical insights into their rating systems used to classify corporate borrowers. On the basis of the New Basle Capital Accord, which allows banks to use their internal rating systems to compute their minimum capital requirements, the relations between potential risk factors, rating decisions and the default probabilities are analysed to answer the question whether German banks are ready for the internal ratings-based approach. The results suggests that the answer is not affirmative at this stage. We find internal rating systems not comparable over banks and furthermore we reveal differences between credit rating determining and default probability determining factors respectively. In the recent theoretical literature on lending risk, the coordination problem in multi-creditor relationships have been analyzed extensively. We address this topic empirically, relying on a unique panel data set that includes detailed credit-file information on distressed lending relationships in Germany. In particular, it includes information on creditor pools, a legal institution aiming at coordinating lender interests in borrower distress. We report three major findings. First, the existence of creditor pools increases the probability of workout success. Second, the results are consistent with coordination costs being positively related to pool size. Third, major determinants of pool formation are found to be the number of banks, the distribution of lending shares, and the severity of the distress shock.
In recent years new methods and models have been developed to quantify credit risk on a portfolio basis. CreditMetrics (tm), CreditRisk+, CreditPortfolio (tm) are among the best known and many others are similar to them. At first glance they are quite different in their approaches and methodologies. A comparison of these models especially with regard to their applicability on typical middle market loan portfolios is in the focus of this study. The analysis shows that differences in the results of an application of the models on a certain loan portfolio is mainly due to different approaches in approximating default correlations. That is especially true for typically non-rated medium-sized counterparties. On the other hand distributional assumptions or different solution techniques in the models are more or less compatible.
