The two papers included in this volume have developed from work with the CHILDES tools and the Media Editor in the two research projects, "Second language acquisition of German by Russian learners", sponsored by the Max Planck Institute for Psycholinguistics, Nijmegen, from 1998 to 1999 (directed by Ursula Stephany, University of Cologne, and Wolfgang Klein, Max Planck Institute for Psycholinguistics, Nijmegen) and "The age factor in the acquisition of German as a second language", sponsored by the German Science Foundation (DFG), Bonn, since 2000 (directed by Ursula Stephany, University of Cologne, and Christine Dimroth, Max Planck Institute for Psycholinguistics, Nijmegen). The CHILDES Project has been developed and is being continuously improved at Carnegie Mellon University, Pittsburgh, under the supervision of Brian MacWhinney. Having used the CHILDES tools for more than ten years for transcribing and analyzing Greek child data there it was no question that I would also use them for research into the acquisition of German as a second language and analyze the big amount of spontaneous speech gathered from two Russian girls with the help of the CLAN programs. When in the spring of 1997, Steven Gillis from the University of Antwerp (in collaboration with Gert Durieux) developed a lexicon-based automatic coding system based on the CLAN program MOR and suitable for coding languages with richer morphologies than English, such as Modern Greek. Coding huge amounts of data then became much quicker and more comfortable so that I decided to adopt this system for German as well. The paper "Working with the CHILDES Tools" is based on two earlier manuscripts which have grown out of my research on Greek child language and the many CHILDES workshops taught in Germany, Greece, Portugal, and Brazil over the years. Its contents have now been adapted to the requirements of research into the acquisition of German as a second language and for use on Windows.
Children […] growing up with highly inflected languages such as Modern Greek will frequently hear different grammatical forms of a given lexeme used in different grammatical and semantic-pragmatic contexts. In spite of the fact that the Greek noun is not as highly inflected as the verb, acquisition of nominal inflection of this inflecting-fusional language is quite complex, comprising the three categories of case, number, and gender. As is usual in this type of language, the formation of case-number forms obeys different patterns that apply to largely arbitrary classes of nominal lexemes partially based on gender. Further, frequency of the occurrence of the three gender classes and case-number forms of nouns greatly differs in spoken Greek, regarding both the types and tokens. […] [A] child learning an inflecting-fusional language like Greek must construct different inflectional patterns depending not only on parts of speech but also on subclasses within a given part of speech, such as gender classes of nouns and inflectional classes within or (exceptionally) across genders. It is therefore to be expected that the early development of case and number distinctions will apply to specific nouns and subclasses of nouns rather than the totality of Greek nouns. The two main theoretical approaches of morphological development that will be discussed in the present paper are the usage-based approach and the pre- and protomorphology approach.
The early acquisition of Greek compounds by two monolingual Greek girls aged between 1;8 and 3;0 years is studied in a usage-based theoretical framework. Special importance is attached to the morphological structure of Greek compound types occurring in child speech and child-directed speech. Greek nominal compound formation does not consist in the mere juxtaposition of words or roots, but involves stems as well as a compound marker. Major questions addressed are the transparency of compounds and productive nominal compound formation. Evidence for productivity of nominal compound formation has been found with only one of the two girls. In contrast to other languages, neoclassical nominal compounds by far exceed endocentric subordinative ones tokenwise in Greek child speech and child-directed speech providing evidence of entrenchment rather than productivity.
In a cross-linguistic comparison it is shown that, in spite of the fact that both Standard Modern Greek and German are rich in nominal compounds, their number is much more limited in Greek than in German child speech. An explanation for this apparent paradox is provided by an onomasiological approach to lexical typology based on a sample list of nominal compounds occurring in German child language and their Greek translational equivalents. It has been found that while use of nominal compounds is common in colloquial German including child-centered situations, it is more typical of Greek formal than colloquial registers.
Die Lincoln-Siedlung in der Wissenschaftsstadt Darmstadt ist sowohl bundesweites Modellprojekt in Sachen nachhaltiger Mobilität als auch Gegenstand verschiedener Forschungsprojekte. Im Projekt NaMoLi II wird die Zufriedenheit der Bewohnenden in der Lincoln-Siedlung mit dem Mobilitätskonzept und seiner Umsetzung analysiert. Des Weiteren wird geprüft, ob und in welcher Form die vorhandenen Rahmenbedingungen eine nachhaltige Mobilität fördern und wie sich die im Quartier bzw. im Umfeld vorhandenen Angebote der Versorgung und sozialen Infrastruktur auf das Mobilitätsverhalten insbesondere neu Zugezogener auswirken. Hierzu hat eine ausgewählte Bevölkerungsgruppe aus der Lincoln-Siedlung über einen Zeitraum von einer Woche Tagebuchprotokolle ihrer täglichen Mobilität geführt. Teilgenommen haben 14 Haushalte mit insgesamt 28 Personen, die zum Zeitpunkt der Erhebung maximal 15 Monate im Quartier gelebt haben. Die Protokolle wurden von allen Haushaltsangehörigen ab dem Grundschulalter geführt, jüngere Kinder sind in den Tagebüchern der Eltern erfasst. Notiert wurden Wegezwecke und Wegeziele, das genutzte Verkehrsmittel, Start- und Ankunftszeit sowie die (geschätzte) Entfernung. Des Weiteren wurden Kennwerte zur Haushaltsstruktur erhoben, zu geänderten Gewohnheiten nach dem Umzug in die Lincoln-Siedlung sowie nach Problemen in der Alltagsmobilität gefragt. Die Ergebnisse der Mobilitätstagebücher bieten einen interessanten Einblick in den Mobilitätsalltag einer spezifischen Teilnahmegruppe, die ein besonderes Interesse an Mobilitätsthemen gezeigt hat und die sich weitgehend nachhaltig in ihrem Alltag bewegt. Das Fahrrad ist das wichtigste Verkehrsmittel, gefolgt von den eigenen Füßen. Die Mehrzahl der Wegeziele liegt innerhalb eines Radius von bis zu zwei Kilometer. Die multimodalen Angebote im Quartier werden gut genutzt. Es hat sich gezeigt, dass die Methode der Tagebuchprotokolle über einen längeren Zeitraum zielführend ist, um Hinweise für die Alltagstauglichkeit des Mobilitätskonzeptes sowie zu dessen Weiterentwicklung bzw. Nachsteuerung zu erlangen.
Common ownership and the (non-)transparency of institutional shareholdings: an EU-US comparison

This paper compares the extent of common ownership in the US and the EU stock markets, with a particular focus on differences in the ap- plicable ownership transparency requirements. Most empirical research on common ownership to date has focused on US issuers, largely relying on ownership data obtained from institutional investors’ 13F filings. This type of data is generally not available for EU issuers. Absent 13F filings, researchers have to use ownership records sourced from mutual funds’ periodic reports and blockholder disclosures. Constructing a “reduced dataset” that seeks to capture only ownership information available for both EU and US issuers, I demonstrate that the “extra” ownership information introduced by 13F filings is substantial. However, even when taking differences in the transparency situation into due account, common ownership among listed EU firms is much less pronounced than among listed US firms by any measure. This is true even if the analysis is limited to non-controlled firms.
Die BaFin hat im August 2021 eine Richtlinie für nachhaltige Investmentvermögen vorgelegt. Diese soll regeln, unter welchen Voraussetzungen ein Fonds als „nachhaltig“, „grün“ o.ä. bezeichnet und vermarktet werden darf. Zwar sind aufsichtsrechtliche Maßnahmen, die darauf abzielen, die Qualität von Informationen zu Nachhaltigkeitscharakteristika von Finanzprodukten zu erhöhen, grundsätzlich zu begrüßen. Der Erlass der konsultierten Richtlinie ist jedoch nicht zu befürworten. Im Lichte der einschlägigen unionsrechtlichen Regelwerke und Initiativen ist unklar, welchen informationellen Mehrwert diese rein nationale Maßnahme schaffen soll. Ferner bleibt auf Grundlage des Entwurfs unklar, anhand welcher Maßstäbe die „Nachhaltigkeit“ eines Investmentvermögens beurteilt werden soll, sodass das primäre Regelungsziel einer verbesserten Anlegerinformation nicht erreicht würde.
Die Natur unterliegt vielfältigen durch den Menschen hervorgerufenen Umweltbelastungen. Neben Veränderungen der Landnutzung oder Konsummuster stellt der anthropogen verursachte Klimawandel einen entscheidenden Einflussfaktor dar. Nicht nur der Temperaturanstieg an sich ist Auslöser für Ökosystemveränderungen, sondern auch die Folgen des Temperaturanstiegs führen zu massiven Änderungen der Biodiversität. Ökosysteme können so aus dem Gleichgewicht geraten und aufgrund starker Umweltbelastungen schließlich zusammenbrechen. Werden keine Maßnahmen zum Schutz der Biodiversität getroffen, wird es langfristig zu folgenschweren Auswirkungen kommen, die auch die Lebensgrundlage der Menschen stark gefährden. In Deutschland liegt die Verantwortung für den Erhalt der Biodiversität bei verschiedenen Ministerien und Ämtern, die eng miteinander vernetzt sind. Die zentrale Referenz der Bundesregierung stellt dabei die nationale Strategie zur biologischen Vielfalt dar.
Der vorliegende Band analysiert die Biodiversitätsstrategie und ihre Umsetzung als wichtige Diskursarena im Diskursfeld „Klimabedingte Biodiversitätsveränderungen“. Ausgehend von einer Analyse der Akteure auf Bundes- und Länderebene sowie aus Wissenschaft und Zivilgesellschaft werden wichtige gesellschaftliche Handlungsfelder und Forschungslücken ebenso aufgezeigt wie die darin erkennbaren Wissenskonflikte.
Seit über 30 Jahren steht der Blaue Engel für besonders umweltfreundliche Produkte und Dienstleistungen. Damit ist er das älteste Umweltschutzzeichen in Deutschland. In den vergangenen Jahren wurden das Produktportfolio des Blauen Engel neu ausgerichtet und die Darstellung des Zeichens modernisiert. Seit 2008 ist der Blaue Engel auch das offizielle Klimaschutzzeichen der Bundesregierung. Regelmäßige empirische Umfragen zeigen, dass der Blaue Engel eine hohe Bekanntheit in der Bevölkerung besitzt. Über ein Drittel der Konsumentinnen und Konsumenten nutzen das Umweltzeichen als Orientierung beim Einkauf. Anders als vor 30 Jahren, muss sich der Blaue Engel heute in der öffentlichen Wahrnehmung in einer Flut von Umwelt- und Nachhaltigkeitszeichen behaupten.
Dieser Studientext präsentiert die Ergebnisse einer empirischen Befragung von Verbraucherinnen und Verbrauchern zu Wahrnehmung und Akzeptanz des Blauen Engel, die das ISOE für das Umweltbundesamt durchgeführt hat. In einer bundesweiten Online-Erhebung wurden 2.034 Personen befragt. Ergänzend erfolgte eine vertiefende qualitative Befragung mit Hilfe von Fokusgruppen. Die Befunde liefern wichtige Erkenntnisse darüber, wofür der Blaue Engel in den Augen der KonsumentInnen steht und wie er im Kontext anderer Label wahrgenommen wird. Darüberhinaus wird deutlich, welche Erwartungen aus Verbrauchersicht mit diesem Zeichen verbunden sind und welche Produkte und Produktgruppen mit ihm assoziiert werden.
In contrast to the US and recently Europe, Japan appears to be unsuccessful in establishing new industries. An oft-cited example is Japan's practical invisibility in the global business software sector. Literature has ascribed Japan's weakness – or conversely, America's strength – to the specific institutional settings and competences of actors within the respective national innovation system. It has additionally been argued that unlike the American innovation system, with its proven ability to give birth to new industries, the inherent path dependency of the Japanese innovation system makes innovation and establishment of new industries quite difficult. However, there are two notable weaknesses underlying current propositions postulating that only certain innovation systems enable the creation of new industries: first, they mistakenly confound context specific with general empirical observations. And second, they grossly underestimate – or altogether fail to examine – the dynamics within innovation systems. This paper will show that it is precisely the dynamics within innovation systems – dynamics founded on the concept of path plasticity – which have enabled Japan to charge forward as a global leader in a highly innovative field: the game software sector as well as the biotechnology industry.
It has often been asked whether today´s Japan will be able to move into new and promising industries, or whether it is locked into an innovation system with an inherent inability to give birth to new industries. One argument reasons that the thick institutional complementarities among labour, innovation, and finance among its enterprises and the public sector favour industrial development in sectors of intermediate uncertainty, while it is difficult to move into areas of major uncertainty. In this paper, we present the case of the silver industry or, somewhat more prosaically, the 60+ or even 50+ industry, for which most would agree that Japan has indeed become a lead market and lead producer on the global market. For an institutional economist, the case of the silver industry is particularly interesting, because Japan´s success is based on the cooperation of existing actors, the enterprise and public sector in particular, which helped overcome the information uncertainties and asymmetries involved in the new market by relying on several established mechanisms developed well before. In that sense, Japan´s silver industry presents a case of of what we propose to call successful institutional path activation with the effect of an innovative market creation, instead of the problematic lockin effects that are usually associated with the term path dependence.

This paper aims to provide a descriptive analysis of the changing patterns of labour market participation, non-participation and unemployment in Great Britain, Sweden and Germany. Since the mid 1970s, most European countries have experienced two parallel developments: on the one hand they have witnessed a huge growth in the proportion of women participating on the labour market. On the other however, they have experienced the return of mass unemployment and a growing insecurity of employment for those in work. In this paper, a typology of work histories is constructed using decade periods. Retrospective and panel data from Germany, Britain and Sweden are then used to compare the effects of different employment and welfare regimes on the proportions of respondents with different types of work histories and how these are combined with unemployment.
The paper explains the absence of resultative secondary predication in Russian as arising from a conflict of inferential interpretations. It formalises the framework necessary to express this proposal in terms of abductive reasoning with Poole systems in Gricean contexts. The conflict is shown to arise for default rules regulating alternative realisation of verb-internally specified consequent states. The paper thus indicates that typological variation may be due not only to different parameter values but to general inferential properties of the syntax-semantics mapping. The proposed theory also contradicts some widespread proposals that the absence of resultative secondary predication is due to the absence of some particular language feature.
The paper makes two contributions to semantic typology of secondary predicates. It provides an explanation of the fact that Russian has no resultative secondary predicates, relating this explanation to the interpretation of secondary predicates in English. And it relates depictive secondary predicates in Russian, which usually occur in the instrumental case, to other uses of the instrumental case in Russian, establishing here, too, a difference to English concerning the scope of the secondary predication phenomenon.
The recent sovereign debt crisis in the Eurozone was characterized by a monetary policy, which has been constrained by the zero lower bound (ZLB) on nominal interest rates, and several countries, which faced high risk spreads on their sovereign bonds. How is the government spending multiplier affected by such an economic environment?While prominent results in the academic literature point to high government spending multipliers at the ZLB, higher public indebtedness is often associated with small government spending multipliers. I develop a DSGE model with leverage constrained banks that captures both features of this economic environment, the ZLB and fiscal stress. In this model, I analyze the effects of government spending shocks. I find that not only are multipliers large at the ZLB, the presence of fiscal stress can even increase their size. For longer durations of the ZLB,multipliers in this model can be considerably larger than one.

Unquestionably (or: undoubtedly), every competent speaker has already come to doubt with respect to the question of which form is correct or appropriate and should be used (in the standard language) when faced with two or more almost identical competing variants of words, word forms or sentence and phrase structure (e.g. German "Pizzas/Pizzen/Pizze" 'pizzas', Dutch "de drie mooiste/mooiste drie stranden" 'the three most beautiful/most beautiful three beaches', Swedish "större än jag/mig" 'taller than I/me'). Such linguistic uncertainties or "cases of doubt" (cf. i.a. Klein 2003, 2009, 2018; Müller & Szczepaniak 2017; Schmitt, Szczepaniak & Vieregge 2019; Stark 2019 as well as the useful collections of data of Duden vol. 9, Taaladvies.net, Språkriktighetsboken etc.) systematically occur also in native speakers and they do not necessarily coincide with the difficulties of second language learners. In present-day German, most grammatical uncertainties occur in the domains of inflection (nominal plural formation, genitive singular allomorphy of strong masc./neut. nouns, inflectional variation of weak masc. nouns, strong/weak adjectival inflection and comparison forms, strong/weak verb forms, perfect auxiliary selection) and word-formation (linking elements in compounds, separability of complex verbs). As for syntax, there are often doubts in connection with case choice (pseudo-partitive constructions, prepositional case government) and agreement (especially due to coordination or appositional structures). This contribution aims to present a contrastive approach to morphological and syntactic uncertainties in contemporary Germanic languages (mostly German, Dutch, and Swedish) in order to obtain a broader and more fine-grained typology of grammatical instabilities and their causes. As will be discussed, most doubts of competent speakers - a problem also for general linguistic theory - can be attributed to processes of language change in progress, to language or variety contact, to gaps and rule conflicts in the grammar of every language or to psycholinguistic conditions of language processing. Our main concerns will be the issues of which (kinds of) common or different critical areas there are within Germanic (and, on the other hand, in which areas there are no doubts), which of the established (cross-linguistically valid) explanatory approaches apply to which phenomena and, ultimately, the question whether the new data reveals further lines of explanation for the empirically observable (standard) variation.
Scholars of institutional design attribute large importance to the choice of new institutions. The comparative analysis of how Rwanda and Zambia crafted their new electoral systems and the systems of government regards procedural, structural and rational choice variables which may influence the option for particular solutions. External influences and the type of transition are determinants that can decide which actors make their interests prevail. The degree of innovation or conservatism of new institutions is mainly a result of the speed of the process and the kind of actors involved. However, rational reflections on how to produce legitimacy and minimize personal risks which take into consideration the state of conflict in the country decide on the speed and on innovative outcomes. The structured analysis of only two cases uncovers already that it is rather difficult to realise the transfer of design recommendations into reality.
Die vorliegende Studie wählt […] einen kleinen Ausschnitt in Gestalt eines einzelnen Textes aus: Es geht um den „Schwanenritter“ Konrads von Würzburg, weil sich hier jene historisch-anthropologischen und mediengeschichtlichen Prozesse nicht nur beobachten lassen, sondern weil diese Erzählung sie selbst schon beobachtet. In Konrads kleinem, aber komplexem Text, so (...) [hofft Peter Strohschneider] im weiteren zeigen zu können, wird das Erzählen vom Körper, von seinen Darstellungssystemen und von der Schrift im Medium schriftliterarischen Erzählens in charakteristischer Weise reflexiv.
1. Die Vorschrift des § 18 Abs. 2 WpÜG ist gegen den zu weit geratenen Wortlaut unter Berücksichtigung des Regelungszwecks einschränkend dahin auszulegen, dass ein Angebot mit einem Widerrufs- oder Rücktrittsvorbehalt versehen werden kann, sofern der Bieter oder ihm nach § 18 Abs. 1 WpÜG zuzurechnende Personen oder Unternehmen den Eintritt des Widerrufs- oder Rücktrittsgrunds nicht ausschließlich selbst herbeiführen können. 2. Eine Entscheidung zur Abgabe eines Angebots i.S. des § 10 Abs. 1 Satz 1 WpÜG ist gegeben, wenn die Entscheidung nur noch von Umständen abhängt, deren Eintritt der Bieter oder ihm nach § 18 Abs. 1 WpÜG zuzurechnende Personen oder Unternehmen nicht ausschließlich selbst herbeiführen können, die also nicht aus dem Herrschaftsbereich des Bieters stammen. 3. Der Bieter kann die Entscheidung zur Abgabe eines Angebots analog § 18 Abs. 2 WpÜG ebenso wie ein Angebot unter einen Widerrufs- oder Rücktrittsvorbehalt stellen, sofern der Bieter oder ihm nach § 18 Abs. 1 WpÜG zuzurechnende Personen oder Unternehmen den Eintritt des Widerrufs- oder Rücktrittsgrunds nicht ausschließlich selbst herbeiführen können. Zulässig ist analog §§ 18 Abs. 1, 25 WpÜG zudem ein auf die Zustimmung der Gesellschafterversammlung des Bieters bezogener Vorbehalt. Darüber hinaus darf der Bieter eine Angebotsankündigung mit einem Finanzierungsvorbehalt für den Fall versehen, dass die Gesellschafterversammlung nicht vor Veröffentlichung der Angebotsunterlage einer für die Finanzierung des Angebots erforderlichen Kapitalmaßnahme zustimmt. 4. Der Widerruf der Entscheidung zur Abgabe eines Angebots ist als actus contrarius zu der Angebotsankündigung erst mit Veröffentlichung analog § 10 Abs. 3 Satz 1 WpÜG beachtlich. 5. Mit ordnungsgemäß veröffentlichtem Widerruf der Entscheidung wird der Bieter von der Pflicht zur Übermittlung einer Angebotsunterlage an die BaFin (§ 14 Abs. 1 Satz 1 WpÜG) sowie zur Veröffentlichung einer Angebotsunterlage (§ 14 Abs. 2 Satz 1 WpÜG) frei. Eine Untersagung des Angebots gemäß § 15 Abs. 1 Nr. 3 oder 4 WpÜG kommt damit nicht mehr in Betracht. Darüber hinaus stellt die Nichtübermittlung oder Nichtveröffentlichung der Angebotsunterlage in diesem 15 Fall keine Ordnungswidrigkeit gemäß § 60 Abs. 1 Nr. 1 a) oder Nr. 2 a) WpÜG dar.
We examine the effects of credit default swaps (CDS), a major type of over-the-counter derivative, on the corporate liquidity management of the reference firms. CDS help firms to access the credit market since the lenders can hedge their credit risk more easily using these contracts. However, CDS-protected creditors can be tougher in debt renegotiations and less willing to support distressed borrowers, causing some firms to become more cautious. Consequently, we find that firms hold significantly more cash after the inception of CDS trading on their debt. The increase in cash holdings by CDS firms is more pronounced for financially constrained firms and firms facing higher refinancing risk. Moreover, bank relationships and outstanding credit facilities intensify the CDS effect on cash holding. Finally, firms with greater financial expertise hold more cash when their debt is referenced by CDS. These findings suggest that CDS, which are primarily a risk management tool for lenders, induce firms to adopt more conservative liquidity policies.
Medieninhaltsanalyse zu anthropogenen Spurenstoffen im Wasser : Ergebnisse aus dem Projekt TransRisk

Im Projekt TransRisk erstellt das ISOE in Zusammenarbeit mit der Deutschen Vereinigung für Wasserwirtschaft, Abwasser und Abfall (DWA) und der TU-Dresden ein Kommunikationskonzept zur Reduzierung von anthropogenen Spurenstoffen im Wasserkreislauf für die allgemeine Bevölkerung. Hierfür hat das ISOE als Vorarbeit eine Medieninhaltsanalyse von Zeitungsartikeln durchgeführt. Es ging dabei um die Frage, wie das Thema anthropogene Spurenstoffe bisher in der Presse behandelt worden ist. In diesem Studientext werden die Ergebnisse der Medienanalyse vorgestellt. Sie zeigen, dass die Berichterstattung zu anthropogenen Spurenstoffen im Wasserkreislauf in der Regel sachlich ist und nur selten reißerisch oder verharmlosend. Von der Vielzahl an Spurenstoffen stehen Medikamentenreste und Hormone im Mittelpunkt. Konkretes Handlungswissen für Verbraucher wird eher selten vermittelt. Eine zukünftige Kommunikationsstrategie zu anthropogenen Spurenstoffen im Wasserkreislauf sollte daher auf die Vermittlung von solidem Handlungswissen zielen. Weiter lässt sich aus den Ergebnissen ableiten, dass insbesondere bei Spurenstoffen, die nicht aus Medikamenten stammen, zunächst einmal Problembewusstsein geschaffen werden muss.
In diesem Arbeitspapier1 soll die statistische Erfassungstechnologie – im Foucaultschen Sinne einer gouvernementalen Technologie – in zwei ihrer zentralen Bestandteile, die Teilpraxen Zählen und Ordnen zerlegt werden, die gerade in ihrer Kombination einen Reifizierungseffekt von statistischem Wissen bewirken, der, wie hier gezeigt werden soll, wenn es um die Produktion von Wissen über „Rasse“/Ethnizität geht, als solcher gleichzeitig ein rassistischer Effekt ist. Die Macht der Zahlen einerseits und die zumeist stillschweigend im Hintergrund erfolgende taxonomische Arbeit andererseits wirken dabei als Teilpraxen der statistischen Erfassungstechnologie zusammen und bewirken gemeinsam deren Blackboxing-Effekt. Im ersten Abschnitt über das Zählen soll der Unterschied zwischen Zahlen und Worten aufgespürt werden, und damit der Unterschied zwischen Zahlenwissen und anderen Formen des Wissens. Im zweiten Abschnitt über das Ordnen wird ausführlicher die taxonomische Arbeit im Zusammenhang von Regierungswissen einschließlich ihrer Subjektivierungseffekte betrachtet und im Fortgang zunehmend auf die Anlage von Taxonomien der „Rasse“/Ethnizität für amtliche Statistiken fokussiert.
Die folgenden konzeptuellen Überlegungen dienen im Rahmen meiner Studie über das Dilemma der Erhebung von Ethnizitätsdaten zur Diskriminierungsmessung dazu, statistische Taxonomien als Instrument des Regierens und der Wissensproduktion in einer machtanalytischen Perspektive zu fassen.

In the Hittite phonological system there was a labialized velar fricative /xw/ beside the plain velar fricative /x/ parallel to the opposition between the velar stops /kw/ and /k/. The frequent syllable /xwa/ was spelled either hu-(u) or hu-wa. Evidence from the frequency of words with initial hu in the lexicon, from spelling variations and from ablaut alternations is presented to demonstrate the existence of /xw/. It is suggested that Hittite /xw/ regularly corresponds to the reflexes of *w in the non-Anatolian Indo-European languages.
Der bevorstehende Beitritt Sloweniens in die OECD1 (Organisation for Economic Cooperation and Development), die jüngste Bewertung des BTI-Status-Index 2008 (Bertelsmann-Transformation-Index) auf dem 2. Platz, der Ratsvorsitz der EU (Europäische Union) im 1. Halbjahr 2008, die Mitgliedschaft zum Schengen-Raum und die Einführung des Euro, sind nur die jüngsten Meilensteine der erfolgreichen und nachhaltigen Transformation in ein demokratisches System und die Festlegung auf eine marktwirtschaftliche Ordnung. Die Geschichte Sloweniens stand lange Zeit im Schatten der Geschichte Österreichs und Jugoslawiens. Als eine Nation in einem eigenen Staat sieht sich Slowenien seit dem Zerfall Jugoslawiens in einer gänzlich neuen Rolle. Das Erbe der früheren Abhängigkeiten ist einem neuen Selbstbewusstsein gewichen. Die graduelle Transformation Sloweniens während der 1990er Jahre in einen völkerrechtlich unabhängigen Staat, eine politische Demokratie und eine freie Marktwirtschaft erscheint im europäischen Kontext „…only [as] a chapter in the larger tale of the democratic wave that rather unexpectedly swept across Central, Eastern, and Southeastern Europe during the last years of the twentieth century.“ In Reflexion der historischen Ereignisse beurteilt Kornai die Transformation am Ende des letzten Jahrhunderts in Europa „…in spite of serious problems and anomalies …[as] a success story.“ Im Rahmen des Transformationsprozesses konnte sich Slowenien als „politischer und ökonomischer Zwerg“ als unabhängiger Staat in das demokratische Europa und die Europäische Union integrieren und fest verankern. Um Gründe und Faktoren dieses Prozesses zu identifizieren, ist eine Betrachtung der Entwicklungen in den 1980er Jahren, die zur Auflösung des blockfreien sozialistischen Jugoslawiens und zur Selbstständigkeit Sloweniens geführt haben, notwendig. Jede der konstituierenden Teilrepubliken und Regionen Jugoslawiens blickt zurück auf eine eigene historische, religiöse und sprachliche Tradition mit individuellen Erfahrungen und spezifischen Spannungen innerhalb und außerhalb der gemeinsamen Föderation. Sloweniens Weg in die politische, ökonomische und demokratische Unabhängigkeit war ein individueller nationaler Differenzierungs- und Umgestaltungsprozess und Ergebnis vielfältiger mehrdimensionaler Konflikte. Unerwartet und plötzlich war der Bruch und die Herauslösung aus dem Staatenbund Jugoslawiens am 25. Juni 1991 nicht. Die Gründung und der Niedergang eines Staates sind schwierig zu erklärende und komplexe Phänomene. Die Triebkräfte der auflösenden gesellschaftlichen Prozesse im Jugoslawien der 1980er Jahre ausschließlich auf die Nationalitätenfrage zu reduzieren, bewertet Weißenbacher als eine zu enge Fokussierung der Darstellung und Begründung auf die ethnischen Spannungen innerhalb des Vielvölkerstaates. Er argumentiert: „Die Wurzeln der Desintegration des sozialistischen Jugoslawiens in alten ethnischen Feindseligkeiten zu suchen, hieße die ökonomischen, sozialen und politischen Prozesse zu ignorieren….“ Die zunehmenden regionalen Inkompatibilitäten Jugoslawiens in den 1980er Jahren verdeutlichen in Betrachtung des spezifischen Entwicklungspfads der Teilrepublik Slowenien, dass die politisch-gesellschaftlichen, kulturellen und die sozioökonomischen Strukturen letztendlich nicht dauerhaft mit den Strukturen anderer jugoslawischer Teilrepubliken vereinbar waren. Die politische und wirtschaftliche Instabilität Jugoslawiens und der frühzeitige Wandel innerhalb der slowenischen Gesellschaft und der Kommunistischen Partei in den 1980er Jahren führten durch politischen Reformdruck und makroökonomische Ungleichgewichte zum Kollaps des jugoslawischen Staatenbundes. Mencinger betont, dass die tiefe Krise Jugoslawiens letzten Endes ohne einen radikalen Systembruch und Sturkurwandel von politischer und ökonomischer Machtverteilung nicht zu überwinden gewesen wäre. Der vorliegende Beitrag greift die Rahmenbedingungen, Entwicklungen, Konflikte und Ziele auf und zeichnet die wesentlichen politischen und wirtschaftlichen Geschehnisse nach, denen sich die slowenische Bevölkerung und Politik in den Jahren vor der Loslösung gegenübersahen und die zur Gründung des unabhängigen Staates geführt haben.
The purpose of the paper is to survey and discuss inflation targeting in the context of monetary policy rules. The paper provides a general conceptual discussion of monetary policy rules, attempts to clarify the essential characteristics of inflation targeting, compares inflation targeting to the other monetary policy rules, and draws some conclusions for the monetary policy of the European system of Central Banks.
We study the problem of a policymaker who seeks to set policy optimally in an economy where the true economic structure is unobserved, and policymakers optimally learn from their observations of the economy. This is a classic problem of learning and control, variants of which have been studied in the past, but little with forward-looking variables which are a key component of modern policy-relevant models. As in most Bayesian learning problems, the optimal policy typically includes an experimentation component reflecting the endogeneity of information. We develop algorithms to solve numerically for the Bayesian optimal policy (BOP). However the BOP is only feasible in relatively small models, and thus we also consider a simpler specification we term adaptive optimal policy (AOP) which allows policymakers to update their beliefs but shortcuts the experimentation motive. In our setting, the AOP is significantly easier to compute, and in many cases provides a good approximation to the BOP. We provide a simple example to illustrate the role of learning and experimentation in an MJLQ framework. JEL Classification: E42, E52, E58
Der Beitrag arbeitet die moralische Subjektivierungsform ökonomischer Verschuldung heraus. In Auseinandersetzung mit Friedrich Nietzsche, Max Weber und Pierre Bourdieu wird argumentiert, dass die Form der Verschuldung durch eine spezifische Zeitlichkeit geprägt ist. Die zentrale These lautet, dass sich das Zeitregime von Schuld und Schulden als paradox erweist: Einerseits ermöglicht die moderne "Entzauberung der Welt" (Max Weber) eine Öffnung auf gesellschaftliche Zukünfte hin und diese temporale Öffnung bildet auch eine notwendige Bedingung kapitalistischer Investitionstätigkeiten. Andererseits verstellt das gegenwärtige rigide Zeitregime der Schuld(en) jedoch die Möglichkeit subjektiver und politischer neuer Anfänge in der Zeit, da die Verschuldung eine Dynamik der ökonomischen Determinierung gegenwärtiger Handlungsoptionen durch den Zwang zur Rückzahlung ins Werk setzt.
Obstetrical care as a matter of time: ultrasound screening in anticipatory regimes of pregnancy

This article explores the ways in which ultrasound screening influences the temporal dimensions of prevention in the obstetrical management of pregnancy. Drawing on praxeographic perspectives and empirically based on participant observation of ultrasound examinations in obstetricians’ offices, it asks how ultrasound scanning facilitates anticipatory modes of pregnancy management, and investigates the entanglement of different notions of time and temporality in the highly risk-oriented modes of prenatal care in Germany. Arguing that the paradoxical temporality of prevention – acting now in the name of the future – is intensified by ultrasound screening, I show how the attribution of risk regarding foetal growth in prenatal check-ups is based on the fragmentation of procreative time and ask how time standards come into play, how pregnancy is located in calendrical time, and how notions of foetal time and the everyday life times of pregnant women clash during negotiations between obstetricians and pregnant women about the determination of the due date. By analysing temporality as a practical accomplishment via technological devices such as ultrasound, the paper contributes to debates in feminist STS studies on the role of time in reproduction technologies and the management of pregnancy and birth in contemporary societies.
This paper gives an account of the unmaking of Soviet workers at the Vernissage in Armenia. I argue that the unmaking of Soviet workers, first, is the irrelevance of Soviet workers as workers once they lost their jobs after the collapse of the Soviet Union and came to the Vernissage to trade. During the Soviet period, private trade was forbidden, and the Soviet government persecuted people who dared to engage in it. Consequently, many people grew up thinking of trade as a criminal activity that was non-productive and parasitic, as opposed to productive work that facilitated the modernization of the USSR. After the dissolution of the USSR, when trade was liberalized and many former Soviet workers were pushed into trade as they lost their jobs, it still retained its quality of not being “real” work, to borrow Roberman’s (2013) wording. Even 25 years after the dissolution of the USSR, former Soviet workers at the Vernissage still want to be identified with their former Soviet occupations and not with trade. However, now engaged in trade, former Soviet workers came up with a “new” way of establishing identity and hierarchy—through production. I describe this “new” way as “the identification game”; employing it, I demonstrate how former Soviet workers at the Vernissage identify and represent themselves as masters, whose work is productive and intellectual. In doing so, they single out resellers, people who resell the work of other masters, by implying that their work is parasitic and selfish. However, this “identification game” is reified only by the older generation of traders, former Soviet workers. The younger generation of traders at the Vernissage, which does not have any experience of being Soviet workers, is disengaged from it, thus undermining the Soviet view of trade as not “real” work and making it irrelevant in the postsocialist era. Thus, I contend that the unmaking of Soviet workers consists in, first, their irrelevance as workers in a postsocialist period, and second, the irrelevance of their ideas about trade as not “real” work. Furthermore, to support my depiction of a master who engages in “the identification game” and a younger-generation trader who is disengaged from it, I give two ethnographic portraits of traders at the Vernissage. I assert that the disengagement of a younger generation of traders at the Vernissage signals a change in the perception of trade as “real” work and runs parallel to the unmaking of Soviet workers.
Testing frequency and severity risk under various information regimes and implications in insurance

We build on Peter et al. (2017) who examined the benefit of testing frequency risk under various information regimes. We first consider testing only severity risk, and whether the principle of indemnity, i.e. the usual contract term that excludes claims payments above the resulting insured loss, affects the insurance contracts offered and purchased. Under information regimes which are less restrictive (in terms of obtaining and using customer information), it is possible for the insurer to offer different contracts for tested and untested individuals. In the absence of the principle of indemnity, individuals will test their severity risk and a separating equilibrium ensues. With the principle of indemnity, given an actuarially fair pooled contract, individuals will not test for severity under less restrictive information regimes; a pooling equilibrium thus ensues. Under more restrictive information regimes, the insurer offers separating contracts. Individuals will test for severity and purchase appropriate contracts. We also consider testing for both frequency and severity risk. The results here are more varied. The highest gain in efficiency from testing results from one of the more restrictive information regimes. Generally under all information regimes, there is a greater gain in efficiency without the principle of indemnity than with the principle of indemnity.
I have assessed changes in the monetary policy stance in the euro area since its inception by applying a Bayesian time-varying parameter framework in conjunction with the Hamiltonian Monte Carlo algorithm. I find that the estimated policy response has varied considerably over time. Most of the results suggest that the response weakened after the onset of the financial crisis and while quantitative measures were still in place, although there are also indications that the weakening of the response to the expected inflation gap may have been less pronounced. I also find that the policy response has become more forceful over the course of the recent sharp rise in inflation. Furthermore, it is essential to model the stochastic volatility relating to deviations from the policy rule as it materially influences the results.
The Federal Reserve has been publishing federal funds rate prescriptions from Taylor rules in its Monetary Policy Report since 2017. The signals from the rules aligned with Fed action on many occasions, but in some cases the Fed opted for a different route. This paper reviews the implications of the rules during the coronavirus pandemic and the subsequent inflation surge and derives projections for the future.
In 2020, the Fed took the negative prescribed rates, which were far below the effective lower bound on the nominal interest rate, as support for extensive and long-lasting quantitative easing. Yet, the calculations overstate the extent of the constraint, because they neglect the supply side effects of the pandemic.
The paper proposes a simple model-based adjustment to the resource gap used by the rules for 2020. In 2021, the rules clearly signaled the need for tightening because of the rise of inflation, yet the Fed waited until spring 2022 to raise the federal funds rate. With the decline of inflation over the course of 2023, the rules’ prescriptions have also come down. They fall below the actual federal funds rate target range in 2024. Several caveats concerning the projections of the interest rate prescriptions are discussed.
In this paper we investigate the comparative properties of empirically-estimated monetary models of the U.S. economy. We make use of a new data base of models designed for such investigations. We focus on three representative models: the Christiano, Eichenbaum, Evans (2005) model, the Smets and Wouters (2007) model, and the Taylor (1993a) model. Although the three models differ in terms of structure, estimation method, sample period, and data vintage, we find surprisingly similar economic impacts of unanticipated changes in the federal funds rate. However, the optimal monetary policy responses to other sources of economic fluctuations are widely different in the different models. We show that simple optimal policy rules that respond to the growth rate of output and smooth the interest rate are not robust. In contrast, policy rules with no interest rate smoothing and no response to the growth rate, as distinct from the level, of output are more robust. Robustness can be improved further by optimizing rules with respect to the average loss across the three models.

Recently there has been an explosion of research on whether the equilibrium real interest rate has declined, an issue with significant implications for monetary policy. A common finding is that the rate has declined. In this paper we provide evidence that contradicts this finding. We show that the perceived decline may well be due to shifts in regulatory policy and monetary policy that have been omitted from the research. In developing the monetary policy implications, it is promising that much of the research approaches the policy problem through the framework of monetary policy rules, as uncertainty in the equilibrium real rate is not a reason to abandon rules in favor of discretion. But the results are still inconclusive and too uncertain to incorporate into policy rules in the ways that have been suggested.
We examine how U.S. monetary policy affects the international activities of U.S. Banks. We access a rarely studied US bank‐level dataset to assess at a quarterly frequency how changes in the U.S. Federal funds rate (before the crisis) and quantitative easing (after the onset of the crisis) affects changes in cross‐border claims by U.S. banks across countries, maturities and sectors, and also affects changes in claims by their foreign affiliates. We find robust evidence consistent with the existence of a potent global bank lending channel. In response to changes in U.S. monetary conditions, U.S. banks strongly adjust their cross‐border claims in both the pre and post‐crisis period. However, we also find that U.S. bank affiliate claims respond mainly to host country monetary conditions.

Er will sich wieder ausschließlich der Forschung und Lehre widmen und kehrt auf seinen Lehrstuhl am Economics Department der Stanford University zurück. Stiglitzs Rückzug aus der aktiven Entwicklungspolitik erfolgt nicht ganz freiwillig. Er selbst kommentiert seinen Entschluß: „It has become obvious to me that it would be difficult to continue to speak out as forcefully and publicly as I have on a variety of issues and still remain as chief economist. Rather than muzzle myself, or be muzzled, I decided to leave.“ (New York Times, 1.12.1999). During the 1970s, industrial countries, including the US and continental Europa, experienced a combination of slow productivity growth and high unemplyoment. Subsequent research has shown that the standard model of unemployment actually gives counterfactual predictions. Motivated by the observation that the 1970s were also characterized by high and rising inflation, Tesfaselassie and Wolters examine the effect of growth on unemployment in the presence of nominal price rigidity.
The authors demonstrate that the effect of growth on unemployment may be positive or negative. Faster growth leads to lower unemployment if the rate of inflation is high enough. There is a threshold level of inflation below which faster growth leads to higher unemployment and above which faster growth leads to lower unemployment. The threshold level in turn depends on labor market characteristics, such as hiring efficiency, the job destruction rate, workers' relative bargaining power and the opportunity cost of work.
Die Globalisierung hat nicht, wie es sowohl ordoliberale als auch kritische Theorien einer globalen „economic constitution“ erwarten, eine einheitliche Weltwirtschaftsverfassung hervorgebracht, sondern eine fragmentierte Kollisionsverfassung, d.h. eine Metaverfassung von Verfassungskonflikten. Als deren kollidierende Einheiten fungieren nicht mehr die Nationalstaaten, sondern transnationale Produktionsregimes. Die von Böhm und Sinzheimer für den Nationalstaat formulierte Alternative von ordoliberaler Wirtschaftsverfassung und sozialdemokratischer Wirtschaftsdemokratie ist in der transnationalen Wirtschaftsverfassung vom Gegensatz zwischen den neokorporatistisch organisierten Produktionsregimes Kontinentaleuropas und den finanzkapitalistisch geprägten Produktionsregimes anglo-amerikanischer Prägung, abgelöst worden. Entgegen allen Voraussagen haben die neo-korporatistischen Wirtschaftsverfassungen Kontinentaleuropas trotz Globalisierung und Wirtschaftskrise eine erstaunliche Resilienz bewiesen. Einer wirtschaftsdemokratischen Konstitutionalisierung eröffnen sich hier neue Chancen dadurch, dass, wie am Beispiel der Corporate Codes gezeigt wird, unternehmensexterne gesellschaftliche Kräfte, also neben staatlichen Interventionen rechtliche Normierungen und „zivilgesellschaftliche“ Gegenmacht aus anderen Kontexten so massiven Druck auf die Unternehmen ausüben, dass sie gezwungen sind, gemeinwohlbezogene Selbstbeschränkungen aufzubauen.
Prozesse der Konstitutionalisierung jenseits des Nationalstaates ver-laufen in zwei unterschiedlichen Richtungen: in transnationalen Politikprozessen jenseits der Nationalstaatsverfassungen, gleichzeitig außerhalb der internationalen Politik in den “privaten” Sektoren der Weltgesellschaft. Die Verfassungssoziologie, die solche Prozesse analysiert, distanziert sich damit von den Verengungen des traditionellen Konstitutionalismus auf den Nationalstaat und fokussiert gesellschaftliche Verfassungen im nationalen und transnationalen Raum. Doch was ist das Gesellschaftliche im gesellschaftlichen Konstitutionalismus? Dies ist aktuell Gegenstand einer vielstimmigen Kontroverse über die Subjekte nichtstaatlicher Verfassungen, ihren Ursprung, ihre Legitimation, ihre Reichweite und ihre inneren Strukturen. Der Beitrag versteht die Kontroverse als „Thema mit Variationen“ und stellt folgende Leitfragen an die zahlreichen Variationen: Was ist in der einzelnen Variation das jeweilige „Kompositionsprinzip“? Welche Schwierigkeiten zeigen sich in dessen Durchführung? Welches sind seine aufhebenswerten Motive? In diesem Sinn wird zunächst das von David Sciulli vorgegebene Thema des gesellschaftlichen Konstitutionalismus kurz vorgestellt. Dann werden sechs Variationen in zwei unterschiedlichen Variationsreihen vorgeführt, einer ersten, die Konstitutionalisierung als Expansion einer einzigen Rationalität in alle gesellschaftlichen Bereiche versteht, einer zweiten, welche trotz der Pluralität des gesellschaftlichen Konstitutionalismus auf der Einheit der Verfassung besteht. Im Schlussteil nehmen drei weitere Variationen schließlich die Motive, die sich als aufhebenswert herausgestellt haben – Meta-Verfassung, Nomos und Narrativ, mediale Reflexivität - wieder auf und entwickeln sie weiter.
Constitutionalization beyond the nation state can be observed as an evolutionary process that leads in two quite different directions: (1) constitutions evolve in transnational political processes outside the nation state; (2) simulta-neously, constitutions evolve outside international politics in global society’s ‘private’ sectors. What, however, is the specifically societal element in societal constitutionalism? This is currently the object of a controversy regarding the subjects of non-state constitutions, their origin, their legitimization, their scope, and their internal structures. This article interprets the controversy as a theme with a number of variations. What is the distinctive ‘compositional principle’ in each particular variation? Which problems become evident in its ‘development’? What are its most valuable ‘motifs’? The article starts with David Sciulli’s theme of societal constitutionalism. Then it presents six variations on Sciulli. In a first group, constitutionalization is perceived as the expansion of a single rationality into all spheres of society. In a second group, the motif of the unity of the consti-tution can still be heard, despite the essential pluralism of societal constitution-alism. In the final movement, three further variations will then reprise and devel-op further the most important motifs, in a resumption of the original theme.
We reconsider the issue of price discovery in spot and futures markets. We use a threshold error correction model to allow for arbitrage operations to have an impact on the return dynamics. We estimate the model using quote midpoints, and we modify the model to account for time-varying transaction costs. We find that the futures market leads in the process of price discovery. The lead of the futures market is more pronounced in the presence of arbitrage signals. Thus, when the deviation between the spot and the futures market is large, the spot market tends to adjust to the futures market.
The German financial system is the archetype of a bank-dominated system. This implies that organized equity markets are, in some sense, underdeveloped. The purpose of this paper is, first, to describe the German equity markets and, second, to analyze whether it is underdeveloped in any meaningful sense. In the descriptive part we provide a detailed account of the microstructure of the German equity markets, putting special emphasis on recent developments. When comparing the German market with its peers, we find that it is indeed underdeveloped with respect to market capitalization. In terms of liquidity, on the other hand, the German equity market is not generally underdeveloped. It does, however, lack a liquid market for block trading. Klassifikation: G 51 . Deutsche Börse AG plans to introduce a system (Xetra Best) allowing brokers and broker-dealers to internalize the orders of retail customers. Further, Xetra Best supports payment for order flow arrangements. Both internalization and payment for order flow may be detrimental to market quality. This paper discusses advantages and disadvantages of these arrangements. It draws on experiences made in the US. We derive policy implications that aim at a more stringent interpretation of "best execution", and at higher transparency. Klassifikation: G10, G14
Die mit unterschiedlichen Organisationsformen des Wertpapierhandels einhergehende Liquidität und ihre Messung ist eine der zentralen Fragen im Zusammenhang mit der Gestaltung von Wertpapiermärkten. Zunächst wird die Eignung verschiedener in der Literatur vorgeschlagener Liquiditätsmaße diskutiert. Anhand einer Serie von Marktexperimenten wird dann die Liquidität der grundsätzlichen Ausgestaltungsformen des Wertpapierhandels - Gesamtkursermittlung, kontinuierliche Auktion und Market-Maker-System - miteinander verglichen.
Sowohl das Handelsvolumen als auch das von ROLL (1984) vorgeschlagene Maß sind offenbar für den Vergleich der Liquidität unterschiedlich organisierter Wertpapiermärkte nicht geeignet. Eine aufgrund theoretischer Überlegungen prognostizierte Überschätzung der Transaktionskosten bei der Gesamtkursermittlung kann empirisch bestätigt werden.
Die explizite Geld-Brief-Spanne ist dagegen grundsätzlich ein geeignetes Liquiditätsmaß. Mit den Daten der experimentellen Märkte läßt sich auch für die Gesamtkursermittlung eine solche Spanne ermitteln. Sie erweist sich als niedriger als die Spanne in der kontinuierlichen Auktion und dem Market-Maker-Markt. Jedoch ist auch die Geld-Brief-Spanne mit Vorsicht zu interpretieren. Es wird gezeigt, daß unter bestimmten Umständen systematische Verzerrungen existieren können. In den hier untersuchten experimentellen Märkten ließen sich diese identifizieren. Bei Untersuchungen anhand von Felddaten ist dies jedoch nicht ohne weiteres möglich, so daß hier die Gefahr von Verzerrungen durchaus real ist.
Der Neue Markt soll wachstumsorientierten Unternehmen den Zugang zur Börse eröffnen. Die für dieses Marktsegment neu geschaffene Institution des Betreuers soll Vorbildcharakter für andere Marktsegmente haben. In der vorliegenden Arbeit werden Vor- und Nachteile des Betreuer-Konzeptes erarbeitet. Die daraus abgeleiteten Fragen werden empirisch untersucht. Dabei zeigt sich, daß der Neue Markt eine hohe Handelsintensität und niedrige Geld-BriefSpannen aufweist. Auch eine schriftliche Befragung der notierten Unternehmen ergab eine positive Einschätzung des neuen Marktsegments.
Überlegungen zur Profitabilität der Betreuer-Funktion deuten darauf hin, daß diese nicht an sich profitabel ist. Es findet offenbar eine Quersubventionierung aus Erträgen des Emissionsgeschäftes statt. Diese Abhängigkeit sollte berücksichtigt werden, wenn die Übertragung des Betreuerkonzepts auf andere Marktsegmente diskutiert wird.
Die externe Performance-Messung beurteilt auf Basis öffentlich verfügbarer Daten die Leistung des Fondsmanagements. Es wird zunächst geprüft, inwieweit die für die Beurteilung von Aktienfonds entwickelten Maße auf Rentenfonds anwendbar sind. Anschließend wird die Performance einer Stichprobe deutscher Rentenfonds untersucht. Es zeigt sich, daß die risikoadjustierte Rendite in den meisten Fällen nicht über der eines geeigneten Marktindex liegt. Einige Fonds weisen ein signifikantes Aktien-Exposure auf. Ein systematischer Zusammenhang zwischen der Nettorendite und der Gebührenhöhe kann nicht nachgewiesen werden.
Many equity markets combine continuous trading and call auctions. Oftentimes designated market makers (DMMs) supply additional liquidity. Whereas prior research has focused on their role in continuous trading, we provide a detailed analysis of their activity in call auctions. Using data from Germany’s Xetra system, we find that DMMs are most active when they can provide the greatest benefits to the market, i.e., in relatively illiquid stocks and at times of elevated volatility. Their trades stabilize prices and they trade profitably.
The US Tax Cuts and Jobs Act (TCJA) led to a drastic reduction in the corporate tax and improved the treatment of C corporations compared to S corporations. We study the differential effect of the TCJA on these types of corporations using key economic variables of US banks, such as the number of employees, average salaries and benefits, profit/loss before taxes, and net income. Our analysis suggests that the TCJA increased the net-of-tax profits of C corporation banks compared to S corporations and, to a lesser extent, their pre-tax profits. At the same time, the reform triggered no significantly differential effect on the employment and average wages.
Regulatory failures, which came to the fore after the financial crisis of 2007-2009, lead to the question of why some activities by financial institutions were not regulated prior to the crisis of 2007, even though regulators knew about certain dangers to financial stability? The repo-market, although centrally involved in the last crisis, still awaits stringent regulation. At the same time, the regulatory cycle seems to come to an end, boding ill for future crises which will be amplified by this market. In this situation, NGOs are needed to make regulators act upon their knowledge and to tighten their regulations.
Understanding the shift from micro to macro-prudential thinking: a discursive network analysis

While some economists argued for macro-prudential regulation pre-crisis, the macro-prudential approach and its emphasis on endogenously created systemic risk have only gained prominence post-crisis. Employing discourse and network analysis on samples of the most cited scholarly works on banking regulation as well as on systemic risk (60 sources each) from 1985 to 2014, we analyze the shift from micro to macro-prudential thinking in the shift to the post crisis period. Our analysis demonstrates that the predominance of formalism, particularly, partial equilibrium analysis along with the exclusion of historical and practitioners’ styles of reasoning from banking regulatory studies impeded economists from engaging seriously with the endogenous sources of systemic risk prior to the crisis. Post-crisis, these topics became important in this discourse, but the epistemological failures of banking regulatory studies pre-crisis were not sufficiently recognized. Recent attempts to conceptualize and price systemic risk as a negative externality point to the persistence of formalism and equilibrium thinking, with its attending dangers of incremental innovation due to epistemological barriers constrains theoretical progress, by excluding observed phenomena, which cannot yet be accommodated in mathematical models.
This paper contributes to the debate on the adequate regulatory treatment of non-bank financial intermediation (NBFI). It proposes an avenue for regulators to keep regulatory arbitrage under control and preserve sufficient space for efficient financial innovation at the same time. We argue for a normative approach to supervision that can overcome the proverbial race between hare and hedgehog in financial regulation and demonstrate how such an approach can be implemented in practice. We first show that regulators should primarily analyse the allocation of tail risk inherent in NBFI. Our paper proposes to apply regulatory burdens equivalent to prudential banking regulation if the respective transactional structures become only viable through indirect or direct access to (ad hoc) public backstops. Second, we use insights from the scholarship on regulatory networks as communities of interpretation to demonstrate how regulators can retrieve the information on transactional innovations and their risk-allocating characteristics that they need to make the pivotal determination. We suggest in particular how supervisors should structure their relationships with semi-public gatekeepers such as lawyers, auditors and consultants to keep abreast of the risk-allocating features of evolving transactional structures. Finally, this paper uses the example of credit funds as non-bank entities economically engaged in credit intermediation to illustrate the merits of the proposed normative framework and to highlight that multipolar regulatory dialogues are needed to shed light on the specific risk-allocating characteristics of recent contractual innovations.

Seit dem 1. Oktober 1995 ist der neue Übernahmekodex der Börsensachverständigenkommission in Kraft . Er löst die Leitsätze von 1979 ab, die in der Praxis kaum Bedeutung erlangt hatten*. Mit der Publikation einer ersten Positivliste der den Kodex anerkennenden Unternehmen ist dieser Tage zu rechnen. Der Bedarf einer Regulierung öffentlicher Übernahmeangebote in Deutschland, sei es in Form einer gesetzlichen Regelung3, sei es in der hier gewählten Form eines Instruments der Selbstregulierung, wird nach wie vor kontrovers beurteilt. So wird etwa betont, daß in Deutschland bislang Übernahmen von Gesellschaften aufgrund öffentlicher Kaufangebote selten vorgekommen seien4. Demgegenüber stehen Vertreter von Kleinaktionären und Fondsgesellschaften auf dem Standpunkt, daß die bisherige Rechtslage in Deutschland in der jüngeren Vergangenheit große Kapitalmarktteilnehmer darin begünstigt habe, Mehrheiten von börsennotierten Unternehmen ohne angemessene Beteiligung der Minderheitsaktionäre zu erwerben . Ungeachtet dieser Kontroverse lassen sich jedoch Transaktionen, die das Vorhandensein einer Übernahmeangebotsregelung wünschenswert erscheinen lassen, jedenfalls für die Zukunft nicht ausschließen. Des weiteren verlangt die Sicherung der Reputation des Finanzplatzes Deutschland die Einhaltung gewisser, dem internationalen Standard entsprechender Regeln. Hierin, in der Förderung des im weltweiten Wettbewerb stehenden Finanzplatzes Deutschland, in der Gewinnung von Vertrauen im Ausland, dürfte der Hauptzweck der Regelungen des Übernahmekodex zu sehen sein. Ob der Übernahmekodex allerdings tatsächlich internationalen Standards entspricht, ist eine andere Frage, der im folgenden noch nachzugehen sein wird. Wie das Zweite Finanzmarktförderungsgesetz soll der Übernahmekodex Fairness und Transparenz des Kapitalmarktgeschehens fördern. Im engeren Sinne ist Ziel des Kodex der Schutz namentlich von Kleinanlegern vor Übervorteilung bei Konzerneingliederungen durch Erwerb einer kontrollierenden Beteiligung. Benachteiligungen von Anlegern bei öffentlichen Übernahmen sollen ausgeschaltet werden. Im Vordergrund standen bei der Formulierung des Kodex daher die Gleichbehandlung aller am Übernahmevorgang beteiligten Aktionäre (Art. 1 des Kodex) sowie die Sicherstellung der Transparenz aller Transaktionen während der Dauer eines Angebots. Dem Vorbild des Londoner City-Code6 folgend sind die Regeln des Übernahmekodex nicht auf parlamentarischem Wege in Gesetzesform erlassen worden. Vielmehr entfaltet er verbindliche Wirkung nur kraft Vertrages, nämlich durch ausdrückliche Anerkennung seitens potentieller Bieter und Zielgesellschaften gegenüber der Übernahmekommission, die durch den Kodex eingerichtet wurde und ihre Stellung und Befugnisse von der Börsensachverständigenkommission ableitet. Durch die Anerkennung, die öffentlich bekannt gemacht wird, dürfte nach dem Willen der Verfasser ein mehr als moralischer Druck zur Einhaltung des Kodex - quasi als Rechtsnorm - verbunden sein. Obwohl der Übernahmekodex im Grundsatz als wesentlicher Fortschritt gegenüber den Übernahmeleitsätzen von 1979 positiv aufgenommen wurde, fehlt es nicht an teilweise vehementer inhaltlicher Kritik*. Gegenstand der Auseinandersetzung mit dem Kodex ist dabei ausschließlich die Reichweite seiner Bestimmungen. Namentlich im Vergleich mit den sehr viel schärferen Regeln des derzeit geltenden britischen Takeover-Code erscheint der Übernahmekodex seinen Kritikern als unzureichend, um einen wirksamen Minderheitenschutz von Kleinaktionären bei öffentlichen Übernahmen zu gewahrleisten. Kaum Beachtung fand dagegen bisher die Frage der Vereinbarkeit der einzelnen im Kodex enthaltenen Regeln mit dem geltenden Aktienrecht. Bisher ebenfalls nicht erörtert wurden die verfassungsrechtlichen Fragen, die mit der Durchsetzung der als Empfehlungen formulierten Finanzplatzregeln verknüpft sind. Nach einem kurzen Überblick über die Regeln des Kodex (11.) sowie einer zusammenfassenden Darstellung der inhaltlichen Kritik (111.) soll daher im folgenden (IV.) der Frage nachgegangen werden, ob der Vorstand einer Aktiengesellschaft, der sich den Regeln des Kodex unterwirft, hierdurch gegen zwingende Vorschriften des Aktienrechts verstößt, sei es bereits durch die Anerkennung selbst, sei es durch die Befolgung einzelner Bestimmungen im konkreten Fall. Im Anschluß daran (V.) sollen etwaige verfassungsrechtliche Bedenken naher betrachtet werden. Solche Bedenken ergeben sich in verschiedener Hinsicht, namentlich zum einen hinsichtlich der angestrebten Veröffentlichungspraxis und der Übernahmepflicht, zum anderen aber auch hinsichtlich der Frage, wie Sanktionen und die spätere Entscheidungspraxis der durch den Kodex etablierten Kommission zu den ausfüllungsbedürftigen Begriffen des Kodex zu beurteilen sind.
Neugriechische Wortbildung

Ziel dieser Arbeit ist es, einen Überblick über das ngr. Wortbildungssystem zu geben. und zugleich die wichtigsten Probleme, die mit der Abgrenzung der ,verschiedenen Wortbildungsverfahren voneinander im NGR. zusammenhängen, so weit wie möglich zu behandeln. Die Arbeit ist in drei Hauptteile gegliedert: der erste Teil (Kap. 2 und 3) ist allgemeinen Problemen gewidmet; die sich auf die Abgrenzung des Bereichs der Wortbildung von der Flexion sowie auf die wichtigsten Aspekte der Wortstruktur im NGR. beziehen. In den beiden .anderen Teilen (Kap. 4 und 5) werden die Wortbildungsverfahren der Ableitung und der Komposition im Bereich des Nomens und im Bereich des Verbs diskutiert. Eine ausführliche Darstellung der Präfixbildung im NGR. ist im Rahmen dieser Arbeit nicht möglich; jedoch werden die Probleme, die mit der Abgrenzung von Präfixbildungen und Komposita zusammenhängen, in Kap. 5.1 kurz besprochen. Besondere Arten der Wortbildung wie z.B. Akronymie, (Wort)Kürzung, "blending" werden nicht behandelt.
Die Coronakrise und die Eindämmungspolitik der Nationalstaaten hat gravierende wirtschaftliche Folgen. Nicht alle EU-Mitgliedsstaaten sind in gleicher Weise gewappnet und manche werden derzeit heftiger von der Coronakrise getroffen als andere. Eine Möglichkeit, europäische Solidarität zu organisieren, ist die Ausgabe von Gemeinschaftsanleihen, so genannter Corona-Bonds. Dieser Beitrag diskutiert das Für und Wider der Corona-Bonds und ihrer Alternativen: Weder Gemeinschaftsanleihen noch eine Ausweitung des EZB-Engagements sollten das Mittel der Wahl sein. Wir plädieren vielmehr für direkte, auf europäischer Ebene koordinierte Transferzahlungen an bedürftige Mitgliedsstaaten.
Bei altgriechischem Prozessrecht denkt man in erster Linie an das Prozessrecht des klassischen Athen, das aus den großen Gerichtsreden bestens bekannt ist; sie waren lange Zeit europäisches Bildungsgut. Zu Beginn des 19. Jahrhunderts, also vor ca. zweihundert Jahren, hat das klassische Griechenland den Anstoß gegeben, den Gemeinen Prozess zu reformieren: Die Geschworenengerichtsbarkeit und die Grundsätze des Parteienbetriebs, der Öffentlichkeit, Mündlichkeit, Unmittelbarkeit der Beweisaufnahme, der freien Beweiswürdigung sind schließlich in die heutigen Prozessordnungen eingeflossen, die nun auch schon über hundert Jahre alt und revisionsbedürftig sind. Vom heutigen Standpunkt aus wären für das klassische Athen einige historische Missverständnisse unserer wissenschaftlichen Vorgänger auszuräumen und das damalige Potential zur außergerichtlichen Konfliktlösung ins rechte Licht zu rücken. Umwälzend Neues ist den attischen Quellen nicht mehr zu entnehmen. Der Ablauf des Gerichtsverfahrens ist hinlänglich erforscht.
Beim Prozess der archaischen griechischen Polis dagegen sind die Dinge noch in Bewegung. Es ist erstaunlich, wie wenig wir über den Gang des gerichtlichen Verfahrens im archaischen Griechenland wissen und wie viel darüber geschrieben wird. Die Quellen (Homer, Hesiod, das Gesetz Drakons und weitere Inschriften, zahlreiche aus Kreta) geben nur knappe Ausschnitte aus einem uns verborgenen Gesamtbild. Insgesamt werfen die Quellen mehr Fragen auf als sie lösen. Das Gesamtbild ist nur durch kreative Phantasie, Vergleich mit anderen Rechtsordnungen oder — völlig unhistorisch und zumeist unbewusst — durch Projektion unserer heutigen Vorstellungen in das archaische Griechenland zu finden. The withdrawal of foreign capital from emerging countries at the height of the recent financial crisis and its quick return sparked a debate about the impact of capital flow surges on asset markets. This paper addresses the response of property prices to an inflow of foreign capital. For that purpose we estimate a panel VAR on a set of Asian emerging market economies, for which the waves of inflows were particularly pronounced, and identify capital inflow shocks based on sign restrictions. Our results suggest that capital inflow shocks have a significant effect on the appreciation of house prices and equity prices. Capital inflow shocks account for - roughly - twice the portion of overall house price changes they explain in OECD countries. We also address crosscountry differences in the house price responses to shocks, which are most likely due to differences in the monetary policy response to capital inflows.
We examine both the degree and the structural stability of inflation persis tence at different quantiles of the conditional inflation distribution. Previous research focused exclusively on persistence at the conditional mean of the inflation rate. Economic theory, however, provides various reasons -for example downward wage rigidities or menu costs- to expect higher inflation persistence at the upper than at the lower tail of the conditional inflation distribution.
Based on post-war US data we indeed find slower mean reversion in response to positive than to negative shocks. We find robust evidence for a structural break in persistence at all quantiles of the inflation process in the early 1980s. Inflation persistence has decreased and become more homogeneous across quantiles. Persistence at the conditional mean became more informative about the degree of persistence across the entire conditional inflation distribution. While prior to the 1980s inflation was not mean reverting in response to large positive shocks, our evidence strongly suggests that since the end of the Volcker disinflation the unit root can be rejected at every quantile including the upper tail of the conditional inflation distribution.

Highly-skilled labour migration in Switzerland: household strategies and professional careers

The article investigates household strategies in the context of highly-skilled labour migration. It focuses on the ways highly-skilled migrants are taking up residence in Switzerland. The analysis shows different household strategies based on the perception of a further professional move. The perceived likeliness of a further move implies household strategies characterized by a high motility: the household remains ready to move and mobilises dedicated organisations (like outplacement agencies or international schools). When a further move is neither perceived nor wanted, the household develops more anchored strategies which are often cheaper. In order to cope with frequent mobilities, the analysis shows that household strategies are deeply gendered.
This paper investigates whether a fiscal stimulus implies a different impact for flexible and rigid labour markets. The analysis is done for 11 advanced OECD economies. Using quarterly data from 1999 to 2013, I estimate a panel threshold structural VAR model in which regime switches are determined by OECD’s employment protection legislation index. My empirical results indicate significant differences between rigid and flexible labour markets regarding the impact of the fiscal stimulus on output and unemployment. While the impulse response of real GDP to a government spending shock is positive and more effective in flexible labour markets, it has less impact in the rigid ones. Moreover, it is found that a fiscal stimulus leads to higher overall unemployment in highly regulated countries.
German Expressionist cinema is a movement that began in 1919. Expressionist film is marked by distinct visual features and performance styles that rebel against prior realist art movements. More than 20 years prior to the Expressionist movement, Sigmund Frued published "The Interpretation of Dreams" in 1899, a ground breaking study that links dreams to unconcious impulses. This thesis argues that the unexplained dream - like imagery found in two Expressionist films, The Cabinet of Dr. Caligari (Robert Wiene, 1920) and Dr. Mabus, the Gambler (Fritz Lang, 1922) - can be seen in terms of Freud's model of dreaming.
Der Beitrag erwägt aus bibelhermeneutischer Perspektive, wie es zu unterschiedlichen Idealisierungen des alttestamentlichen Gemeinwesens im politischen Denken der Frühen Neuzeit kam. Dabei werden zunächst allgemeine Faktoren berücksichtigt, die eine biblische Orientierung im politischen Denken ausgehend von der Reformationszeit im 16. Jahrhundert erklärbar machen. Ein Überblick über betreffende Quellentitel des 16. und 17. Jahrhunderts zeigt, dass hierbei in allen größeren Konfessionen, wenn auch in unterschiedlicher Dichte, das Ideal des alttestamentlich-jüdischen Gemeinwesens eine Rolle spielte. Entlang zweier Fallbeispiele (François Ragueau, Petrus Cunaeus) werden dann konfessionelle und transkonfessionelle Aspekte unterschieden, um neue Perspektiven auf das Konfessionalisierungsparadigma und andere Modernisierungstheorien zu eröffnen.
Bei der Realisierung der dringend nötigen Verkehrs- und Mobilitätswende sind Möglichkeiten der Befriedung menschlicher Mobilitätsbedürfnisse unabhängig von privater Autonutzung ein wichtiger Baustein. Im Rahmen dieser Arbeit werden darum instrumentelle, affektive und symbolische Motive der privaten Lastenradnutzung qualitativ erforscht. Das Lastenrad hat in den vergangenen Jahren insbesondere in urbanen Räumen an Popularität gewonnen und ermöglicht für den Transport von weiteren Personen, insbesondere Kindern, Tieren oder größeren Lasten eine emissionsarme oder -freie Fortbewegung. Die Untersuchungsergebnisse zeigen, dass bei den instrumentellen Motive die häufig nach Gender verteilte Sorgearbeit eine entscheidende Rolle einnimmt. Dabei erfüllt das Lastenrad das von den Ansprüchen Transportoptionen, Zeitsouveränität, Geschwindigkeit, Erreichbarkeit und Multifunktionalität geprägte Mobilitätsbedürfnis von Personen, die neben Sorge- auch Lohnarbeit im Alltag leisten, im urbanen Raum auf einzigartige Weise. Auch für Personen, deren Alltag nicht maßgeblich durch diese Doppelbelastung geprägt ist, stellt die mit dem Lastenrad mögliche optimierte Überwindung von Raum- und Zeitwiderständen ein relevantes instrumentelles Motiv dar. In this paper, we investigate a primary potential impact of leveraged buyout (LBOs) transactions: the effects of LBOs on the peers of the LBO target in the same industry. Using a data sample based on US LBO transactions between 1985 and 2016, we investigate the impact of the peer firms in the aftermath of the transaction, relative to non-peer firms. To account for potential endogeneity concerns, we employ a network-based instrumental variable approach. Based on this analysis, we find support for the proposition that LBOs do indeed matter for peer firms’ performance and corporate strategy relative to non-peer firms. Our study supports a learning factor hypothesis: peers gain by learning from the LBO target to improve their operational performance. Conversely, we find no evidence to support the conjecture that peers lose due to the increased competitiveness of the LBO target firm.
This paper outlines relatively easy to implement reforms for the supervision of transnational banking-groups in the E.U. that should not be primarily based on legal form but on the actual risk structures of the pertinent financial institutions. The proposal also aims at paying close attention to the economics of public administration and international relations in allocating competences among national and supranational supervisory bodies. Before detailing the own proposition, this paper looks into the relationship between sovereign debt and banking crises that drive regulatory reactions to the financial turmoil in the Euro area. These initiatives inter alia affirm effective prudential supervision as a pivotal element of crisis prevention. In order to arrive at a more informed idea, which determinants apart from a perceived appetite for regulatory arbitrage drive banks’ organizational choices, this paper scrutinizes the merits of either a branch or subsidiary structure for the cross-border business of financial institutions. In doing so, it also considers the policy-makers perspective. The analysis shows that no one size fits all organizational structure is available and concludes that banks’ choices should generally not be second-guessed, particularly because they are subject to (some) market discipline. The analysis proceeds with describing and evaluating how competences in prudential supervision are currently allocated among national and supranational supervisory authorities. In order to assess the findings the appraisal adopts insights form the economics of public administration and international relations. It argues that the supervisory architecture has to be more aligned with bureaucrats’ incentives and that inefficient requirements to cooperate and share information should be reduced. Contrary to a widespread perception, shifting responsibility to a supranational authority cannot solve all the problems identified. Resting on these foundations, the last part of this paper finally sketches an alternative solution that dwells on far-reaching mutual recognition of national supervisory regimes and allocates competences in line with supervisors’ incentives and the risk inherent in crossborder banking groups.
This paper contrasts the recent European initiatives on regulating corporate groups with alternative approaches to the phenomenon. In doing so it pays particular regard to the German codified law on corporate groups as the polar opposite to the piecemeal approach favored by E.U. legislation.
It finds that the European Commission’s proposal to submit (significant) related party transactions to enhanced transparency, outside fairness review, and ex ante shareholder approval is both flawed in its design and based on contestable assumptions on informed voting of institutional investors. In particular, the contemplated exemption for transactions with wholly owned subsidiaries allows controlling shareholders to circumvent the rule extensively. Moreover, vesting voting rights with (institutional) investors will not lead to the informed assessment that is hoped for, because these investors will rationally abstain from active monitoring and rely on proxy advisory firms instead whose competency to analyze non-routine significant related party transactions is questionable.
The paper further delineates that the proposed recognition of an overriding interest of the group requires strong counterbalances to adequately protect minority shareholders and creditors. Hence, if the Commission choses to go down this route it might end up with a comprehensive regulation that is akin to the unpopular Ninth Company Law Directive in spirit, though not in content. The latter prediction is corroborated by the pertinent parts of the proposal for a European Model Company Act.
Germany Inc. was an idiosyncratic form of industrial organization that put financial institutions at the center. This paper argues that the consumption of private benefits in related party transactions by these key agents can be understood as a compensation for their coordinating and monitoring function in Germany Inc. As a consequence, legal tools apt to curb tunneling remained weak in Germany from the perspective of outside shareholders. While banks were in a position to use their firm-level knowledge and influence to limit rent-seeking by other related parties, their own behavior was not subject to meaningful controls. With the dismantling of Germany Inc. banks seized their monitoring function and left an unprecedented void with regard to related party transactions. Hence, a “traditionalist” stance which opposes law reform for related party transactions in Germany negatively affects capital market development, growth opportunities and ultimately social welfare.

This paper is the national report for Germany prepared for the to the 20th General Congress of the International Academy of Comparative Law 2018 and gives an overview of the regulation of crowdfunding in Germany and the typical design of crowdfunding campaigns under this legal framework. After a brief survey of market data, it delineates the classification of crowdfunding transactions in German contract law and their treatment under the applicable conflict of laws regime. It then turns to the relevant rules in prudential banking regulation and capital market law. It highlights disclosure requirements that flow from both contractual obligations of the initiators of campaigns vis-à-vis contributors and securities regulation (prospectus regime). After sketching the most important duties of the parties involved in crowdfunding, the report also looks at the key features of the respective transactions’ tax treatment.

To make this argument, this paper first describes the policy rationale that calls for mandatory private sector involvement (PSI). From this analysis, the key features for an effective bail-in tool can be derived.
These insights serve as the background to make the case that the European resolution framework is likely ineffective in establishing adequate market discipline through risk-reflecting prices for bank capital. The main reason for this lies in the avoidable embeddedness of the BRRD’s bail-in tool in the much broader resolution process, which entails ample discretion of the authorities also in forcing private sector involvement. Moreover, the idea that nearly all positions on the liability side of a bank’s balance sheet should be subjected to bail-in is misguided. Instead, a concentration of PSI in instruments that fall under the minimum requirements for own funds and eligible liabilities (MREL) is preferable.
Finally, this paper synthesized the prior analysis by putting forward an alternative regulatory approach that seeks to disentangle private sector involvement as a precondition for effective bank-resolution as much as possible form the resolution process as such.

To some extent, the regulatory framework can remedy the impediments to the desirable incentive effect of private sector involvement (PSI) that emanate from a lack of predictability of outcomes, if it compels banks to issue a sufficiently sized minimum of high-quality, easy to bail-in (subordinated) liabilities. Yet, even the limited improvements any prescription of bail-in capital can offer for PSI’s operational effectiveness seem compromised in important respects.
The main problem, echoing the general concerns voiced against the European bail-in regime, is that the specifications for minimum requirements for own funds and eligible liabilities (MREL) are also highly detailed and discretionary and thus alleviate the predicament of investors in bail-in debt, at best, only insufficiently. Quite importantly, given the character of typical MREL instruments as non-runnable long-term debt, even if investors are able to gauge the relevant risk of PSI in a bank’s failure correctly at the time of purchase, subsequent adjustment of MREL-prescriptions by competent or resolution authorities potentially change the risk profile of the pertinent instruments. Therefore, original pricing decisions may prove inadequate and so may market discipline that follows from them.
The pending European legislation aims at an implementation of the already complex specifications of the Financial Stability Board (FSB) for Total Loss Absorbing Capacity (TLAC) by very detailed and case specific amendments to both the regulatory capital and the resolution regime with an exorbitant emphasis on proportionality and technical fine-tuning. What gets lost in this approach, however, is the key policy objective of enhanced market discipline through predictable PSI: it is hardly conceivable that the pricing of MREL-instruments reflects an accurate risk-assessment of investors because of the many discretionary choices a multitude of agencies are supposed to make and revisit in the administration of the new regime. To prove this conclusion, this chapter looks in more detail at the regulatory objectives of the BRRD’s prescriptions for MREL and their implementation in the prospectively amended European supervisory and resolution framework.
Crowdfunding is a buzzword that signifies a sub-set in the new forms of finance facilitated by advances in information technology usually categorized as fintech. Concerns for financial stability, investor and consumer protection, or the prevention of money laundering or funding of terrorism hinge incrementally on including the new techniques to initiate financing relationships adequately in the regulatory framework.
This paper analyzes the German regulation of crowdinvesting and finds that it does not fully live up to the regulatory challenges posed by this novel form of digitized matching of supply and demand on capital markets. It should better reflect the key importance of crowdinvesting platforms, which may become critical providers of market infrastructure in the not too distant future. Moreover, platforms can play an important role in investor protection that cannot be performed by traditional disclosure regimes geared towards more seasoned issuers. Against this background, the creation of an exemption from the traditional prospectus regime seems to be a plausible policy choice. However, it needs to be complemented by an adequate regulatory stimulation of platforms’ role as gatekeepers.

Das Kapitalmarktrecht entwickelt sich in der Berliner Republik zu einem voll integrierten Kernbestandteil des unternehmensrechtlichen Diskurses in der Rechtswissenschaft, während es in den vorausgehenden Dekaden primär eine in den normativen Grundlagen wenig durchdrungene Praktikermaterie darstellte. Das vorliegende Essay versucht eine Erklärung für diese Beobachtung zu skizzieren, die auf einem breiten Jurisdiktionen und Nationalökonomien übergreifenden Kontext beruht, der mit den Schlagworten Europäisierung und Globalisierung nur platt und unscharf umschrieben ist. Dabei geht es einerseits um eine Ausweichbewegung deutscher Unternehmen, die mit einer verstärkten Kapitalmarktorientierung eine Klemme in der Unternehmensfinanzierung zu lösen, die durch den Rückzug der vom globalen Wettbewerb erfassten Finanzindustrie aus derselben ausgelöst wurde. Auf der anderen Seite findet in der Altersvorsoge eine Abkehr von Umverteilungssystemen und eine Hinwendung zur kapitalbasierten Vorsorge statt, durch die nicht nur mehr Kapital für Investitionen statt für Konsum zur Verfügung steht, sondern auch die Interessen der Mittelschicht in vielerlei Hinsicht stärker von einer anlegerorientierten Regelung im Gesellschafts- und Kapitalmarktrecht abhängen, als von einer Arbeitnehmerorientierung im Unternehmensrecht.

This essay argues that at least some of the financial stability concerns associated with shadow banking can be addressed by an approach to financial regulation that imports its functional foundations more vigorously into the interpretation and implementation of existing rules. It shows that the general policy goals of prudential banking regulation remain constant over time despite dramatic transformations in the financial and technological landscape. Moreover, these overarching policy goals also legitimize intervention in the shadow banking sector. On these grounds, this essay encourages a more normative construction of available rules that potentially limits both the scope for regulatory arbitrage and the need for ever more rapid updates and a constant increase in the complexity of the regulatory framework. By tying the regulatory treatment of financial innovation closely to existing prudential rules and their underlying policy rationales, the proposed approach potentially ends the socially wasteful race between hare and tortoise that signifies the relation between regulators and a highly dynamic industry. In doing so it does not generally hamper market participants’ efficient discoveries where disintermediation proves socially beneficial. Instead, it only weeds-out rent-seeking circumventions of existing rules and standards.
Um den Teufelskreis sich wechselseitig verstärkender Banken- und Staatsschuldenkrisen zu durchbrechen, haben sich die europäischen Institutionen grundsätzlich dazu bekannt, eine Bankenunion zu schaffen. Der Dreh- und Angelpunkt der verfolgten Strategie liegt dabei darin, durch die Schaffung zentraler, d.h. supranationaler Auffangmechanismen die Ausfallrisiken von Banken und Staaten nachhaltig zu entkoppeln. Dabei ist zu beachten, dass gerade auch die einzelnen Elemente des institutionellen Reformpakets in ihrer Binnenstruktur so beschaffen sein müssen, dass vorhersehbare Ineffizienzen nicht dazu führen, dass Vorteile der Supranationalisierung aufgehoben oder gar in ihr Gegenteil verkehrt werden. Der vorliegende Beitrag diskutiert den Verordnungsentwurf der EU Kommission für einen Single Resolution Mechanism (SRM) vor dem Hintergrund dieser Forderung.
The Judgement of the EGC in the Case T-122/15 – Landeskreditbank Baden-Württemberg - Förderbank v European Central Bank is the first statement of the European judiciary on the sub-stantive law of the Banking Union. Beyond its specific holding, the decision is of great importance, because it hints at the methodological approach the EGC will take in interpreting prudential banking regulation in the appeals against supervisory measures that fall in its jurisdiction under TFEU, arts. 256(1) subpara 1 and 263(4). Specifically, the case pertained to the scope of direct ECB oversight of significant banks in the euro area and the reassignment of this competence to national competent authorities (NCAs) in individual circumstances (Single Supervisory Mechanism (SSM) Regulation, art. 6(4) subpara 2; SSM Framework Regulation, arts. 70, 71).

Im anhaltenden Niedrigzinsumfeld tun Banken sich schwer damit, die ihnen zur Verfügung gestellte Liquidität einer renditeträchtigen Nachfrage zuzuführen. Darüberhinaus müssen sie auf Liquiditätsüberschüsse, die im Rahmen der Einlagenfazilität des Eurosystems über Nacht bei den nationalen Zentralbanken der Eurozone deponiert werden, Strafzinsen entrichtet. Vor diesem Hintergrund könnten Banken durch negative Einlagenzinsen das Anliegen verfolgen, die Nachfrage nach Aufbewahrung von (Sicht)Einlagen zu verringern. Einer solchen Strategie stehen aber aus juristischer Sicht Hindernisse entgegen, soweit der beschriebene Paradigmenwechsel auch im Rahmen existierender Kundenbeziehungen einseitig vorgenommen werden soll. Die rechtlichen Hürden sind weder Ausdruck einer realitätsfernen Haarspalterei, noch eines verbraucherschützenden Furors. Vielmehr ermöglichen sie privaten und gewerblichen Bankkunden, im Zeitpunkt der angestrebten Zinsanpassung bewusst über die Verwendung ihrer liquiden Mittel zu entscheiden.
Der Beitrag zeigt, dass zivilrechtliche (Sanktions-)Normen verhaltenssteuernd wirken und Marktstrukturen beeinflussen, i.e. sie haben regulierende Wirkung. Die angemahnte Konsequenz dieser Beobachtung liegt darin, dass sich eine zeitgenössische Zivilrechtswissenschaft für eine methodisch abgesicherte Folgenbeurteilung bei der Rechtsanwendung öffnet, d.h. diese bereits bei der Interpretation der lex lata berücksichtigt. Wie dieses Desiderat umgesetzt werden kann, wird anhand von drei einschlägigen Beispielen illustriert. Dabei zeigt sich, dass nicht verkannt werden darf, dass die funktionale Betrachtung jenseits des Wirtschafts- und bürgerlichen Vermögensrechts an Grenzen stoßen kann. Dies kann aber nicht abstrakt behauptet, sondern muss stets konkret begründet werden, um den dann angezeigten Methodenwechsel zu rechtfertigen.

By using insights from the political economy of bureaucracy it finds that the SSM is overly focused on sharp tools to discipline captured national supervisors and thus under-incentives their top-level personnel to voluntarily contribute to rigid supervision. The success of the SSM in this regard will hinge on establishing a common supervisory culture that provides positive incentives for national supervisors. In this regard, the internal decision making structure of the ECB in supervisory matters provides some integrative elements. Yet, the complex procedures also impede swift decision making and do not solve the problem adequately. Ultimately, a careful design and animation of the ECB-defined supervisory framework and the development of inter-agency career opportunities will be critical.
The ECB will become a de facto standard setter that competes with the EBA. A likely standoff in the EBA’s Board of Supervisors will lead to a growing gap in regulatory integration between SSM-participants and other EU Member States.
Joining the SSM as a non-euro area Member State is unattractive because the cur-rent legal framework grants no voting rights in the ECB’s ultimate decision making body. It also does not supply a credible commitment opportunity for Member States who seek to bond to high quality supervision.

Das Banken- und Versicherungsaufsichtsrecht benennt an mehreren Stellen ausdrücklich gruppenbezogene Pflichten des übergeordneten Unternehmens. Deren Realisierbarkeit hängt von gesellschafts-, insbesondere konzernrechtlichen Schranken ab, die für die Einflussnahme auf nachgeordnete Gruppenunternehmen bestehen. Der vorliegende Beitrag betrachtet das Zusammenspiel von Aufsichts- und Gesellschaftsrecht unter besonderer Berücksichtigung der regelungstragenden Ziele des ersteren. Die Gruppenverantwortung ist in dieser Sicht ein Institut, das zur Verwirklichung eines klar umrissenen, öffentlichen Interesses an der Befolgung bestimmter Normen das übergeordnete Unternehmen als interne Kontrollinstanz in die Pflicht nimmt und mit gruppendimensionalen Handlungspflichten belegt. Zur Gewährleistung der Effektivität dieses Instituts ist ein sektoral begrenzter Vorrang der aufsichtsrechtlichen Vorgaben anzuerkennen. Dieser ist durch die angemessene Berücksichtigung des mit dem Aufsichtsrecht verfolgten, öffentlichen Interesses als normativer Determinante der Leitungstätigkeit aller gruppenangehörigen Institute zu verwirklichen.

We investigate whether the bank crisis management framework of the European banking union can effectively bar the detrimental influence of national interests in cross-border bank failures. We find that both the internal governance structure and decision making procedure of the Single Resolution Board (SRB) and the interplay between the SRB and national resolution authorities in the implementation of supranationally devised resolution schemes provide inroads that allow opposing national interests to obstruct supranational resolution. We also show that the Single Resolution Fund (SRG), even after the ratification of the reform of the European Stability Mechanism (ESM) and the introduction of the SRF backstop facility, is inapt to overcome these frictions. We propose a full supranationalization of resolution decision making. This would allow European authorities in charge of bank crisis management to operate autonomously and achieve socially optimal outcomes beyond national borders.
We study the design features of disclosure regulations that seek to trigger the green transition of the global economy and ask whether such regulatory interventions are likely to bring about sufficient market discipline to achieve socially optimal climate targets.
We categorize the transparency obligations stipulated in green finance regulation as either compelling the standardized disclosure of raw data, or providing quality labels that signal desirable green characteristics of investment products based on a uniform methodology. Both categories of transparency requirements can be imposed at activity, issuer, and portfolio level.
Finance theory and empirical evidence suggest that investors may prefer “green” over “dirty” assets for both financial and non-financial reasons and may thus demand higher returns from environmentally-harmful investment opportunities. However, the market discipline that this negative cost of capital effect exerts on “dirty” issuers is potentially attenuated by countervailing investor interests and does not automatically lead to socially optimal outcomes.
Mandatory disclosure obligations and their (public) enforcement can play an important role in green finance strategies. They prevent an underproduction of the standardized high-quality information that investors need in order to allocate capital according to their preferences. However, the rationale behind regulatory intervention is not equally strong for all categories and all levels of “green” disclosure obligations. Corporate governance problems and other agency conflicts in intermediated investment chains do not represent a categorical impediment for green finance strategies.
However, the many forces that may prevent markets from achieving socially optimal equilibria render disclosure-centered green finance legislation a second best to more direct forms of regulatory intervention like global carbon taxation and emissions trading schemes. Inherently transnational market-based green finance concepts can play a supporting role in sustainable transition, which is particularly important as long as first-best solutions remain politically unavailable.
This paper investigates the potential implications of say on pay on management remuneration in Germany. We try to shed light on some key aspects by presenting quantitative data that allows us to gauge the pertinent effects of the German natural experiment that originates with the 2009 amendments to the Stock Corporation Act of 1965. In order to do this, we deploy a hand-collected data set for Germany's major firms (i.e. DAX 30), for the years 2006-2012. Rather than focusing exclusively on CEO remuneration we collected data for all members of the management board for the whole period under investigation. We observe that the compensation packages of management board members of Germany's DAX30-firms are quite closely linked to key performance measures. In addition, we find that salaries increase with the size of the company and that ownership concentration has no significant effect on compensation. Also, our findings suggest that the two-tier system seems to matter a lot when it comes to compensation. However, it would be misleading to state that we see no significant impact of the introduction of the German say on pay-regime. Our findings suggest that supervisory boards anticipate shareholder-behavior.
Für eine möglichst vollständige analytische Beschreibung werden in der statistischen Klimatologie beobachtete Klimazeitreihen als Realisation eines stochastischen Prozesses, das heißt als eine Folge von Zufallsvariablen verstanden. Die Zeitreihe soll im wesentlichen durch eine analytische Funktion der Zeit beschrieben werden können und die Beobachtung nur durch Zufallseinflüsse von dieser Funktion abweichen. Diese analytische Funktion setzt sich aus der Summe zeitlich strukturierter Komponenten zusammen, welche aus klimatologischem Blickwinkel interpretierbar erscheinen. Es werden Funktionen zugelassen, die den Jahresgang, Trends, episodische Komponenten und deren Änderung beschreiben. Die Extremereignisse sind als eine besondere weitere Komponente in die Zeitreihenanalyse aufgenommen und als von Änderungen in den Parametern der Verteilung unabhängige, extreme Werte definiert. Die Zufallseinflüsse sollen zunächst als Realisierungen unabhängiger normalverteilter Zufallsvariablen mit dem Erwartungswert Null und im Zeitablauf konstanter Varianz interpretiert werden können. In diesem Fall beschreibt die analytische Funktion der Zeit, die Summe detektierter strukturierter Komponenten, den zeitlichen Verlauf des Mittels. Ein zu einem bestimmten Zeitpunkt tatsächlich beobachteter Wert kann dann als eine mögliche Realisation einer Zufallsvariablen interpretiert werden, die der Gaußverteilung mit dem Mittelwert µ(t) zur Zeit t und konstanter Varianz genügt. Da die zugrundeliegenden Annahmen, unter Verwendung klimatologisch interpretierbarer Basisfunktionen, in der Analyse von Klimazeitreihen, die nicht die Temperatur betreffen, zumeist nicht erfüllt sind, wird in eine Verallgemeinerung des Konzepts der Zeitreihenzerlegung in einen deterministischen und einen statistischen Anteil eingeführt. Zeitlich strukturierte Änderungen werden nun in verschiedenen Verteilungsparametern frei wählbarer Wahrscheinlichkeitsdichtefunktionen gesucht. Die gängige Beschränkung auf die Schätzung einer zeitlich veränderlichen Lokation wird aufgehoben. Skalenschätzer sowie Schätzer fär den Formparameter spielen ebenso relevante Rollen fär die Beschreibung beobachteter Klimavariabilität. Die Klimazeitreihen werden wieder als Realisation eines Zufallprozesses verstanden, jedoch genügen die Zufallsvariablen nun einer frei wählbaren Wahrscheinlichkeitsdichtefunktion. Die zeitlich strukturierten Änderungen in den Verteilungsparametern werden auf Basis der gesamten Zeitreihe für jeden Zeitpunkt geschätzt. Die aus der Analyse resultierende analytische Beschreibung in Form einer zeitabhängigen Wahrscheinlichkeitsdichtefunktion ermöglicht weiterhin die Schätzung von Über- und Unterschreitungswahrscheinlichkeiten beliebig wählbarer Schwellenwerte für jeden Zeitpunkt des Beobachtungszeitraums. Diese Methode erlaubt insbesondere eine statistische Modellierung monatlicher Niederschlagsreihen durch die Zerlegung in einen deterministischen und einen statistischen Anteil. In dem speziellen Fall von 132 Reihen monatlicher Niederschlagssummen deutscher Stationen 1901-2000 gelingt eine vollständige analytische Beschreibung der Reihen durch ihre Interpretation als Realisation einer Gumbel-verteilten Zufallsvariablen mit variablem Lage- und Streuparameter. Auf Basis der gewonnenen analytischen Beschreibung der Reihen kann beispielsweise im Westen Deutschlands auf Verschiebungen der jährlichen Überschreitungsmaxima des 95%-Perzentils von den Sommer- in die Wintermonate geschlossen werden. Sie werden durch relativ starke Anstiege in der Überschreitungswahrscheinlichkeit (bis 10%) in den Wintermonaten und nur geringe Zunahmen oder aber Abnahmen in den Sommermonaten hervorgerufen. Dies geht mit einer Zunahme der Unterschreitungswahrscheinlichkeit in den Winter- und einer Abnahme in den Sommermonaten einher. Monte-Carlo-Simulationen zeigen, daß jahreszeitlich differenzierte Schätzungen von Änderungen im Erwartungswert, also gebräuchliche Trends, auf Basis der Kleinst-Quadrate-Methode systematischen Bias und hohe Varianz aufweisen. Eine Schätzung der Trends im Mittel auf Basis der statistischen Modellierung ist somit ebenso den Kleinst-Quadrate-Schätzern vorzuziehen. Hinsichtlich der Niederschlagsanalysen stellen jedoch aride Gebiete, mit sehr seltenen Niederschlägen zu bestimmten Jahreszeiten, die Grenze der Methode dar, denn zu diesen Zeitpunkten ist eine vertrauenswürdige Schätzung einer Wahrscheinlichkeitsdichtefunktion nicht möglich. In solchen Fällen ist eine grundsätzlich andere Herangehensweise zur Modellierung der Reihen erforderlich.
This paper analyses the long-term effects of improved small-scale lending, often provided by microfinance institutions set up with the support of development aid. The analysis shows that some common assumptions about microfinance are not true at all: First, it shows that the impact on income will accrue not to the microenterprises themselves, but rather to the consumers of their products. Second, microfinance will have a significant positive effect on the wage levels of employees in the informal sector. Third, microfinance will cause high growth rates in the informal production sector, whereas the trade sector will either contract or at best grow very little.

Information asymmetries make it difficult for banks to assess accurately whether specific entrepreneurs are able and/or willing to repay their loans. This leads to implicit interest rate ceilings, i.e. banks "refuse" to increase their interest rates beyond this ceiling as this would lower their net returns. Although the maximum interest rate increases as the size of enterprises decreases, such ceilings nonetheless constrain the banks’ ability to set interest rates at a level that would enable them to cover costs. If transaction costs are high, the total costs associated with granting small and medium-sized loans will exceed the maximum average return which the banks can earn by issuing such loans. For this reason, banks do not lend to small and medium-sized enterprises, and, as a consequence, these businesses have no access to formal sector loans. Because micro and small enterprises have a very high RoI, it is worthwhile for them to rely on expensive informal loans to finance their operations, at least until they reach a certain size. Once they have reached this size, however, it does not make economic sense for them to continue taking out informal credits, and thus they face a growth constraint imposed by the credit market. Medium-sized enterprises earn a lower RoI than small ones, which is why borrowing in the informal credit market is not a worthwhile option for them. Moreover, they do not have access to credit from formal financial institutions, and are thus excluded from obtaining any kind of financing in either of the two credit markets. As the result of free, unregulated market forces we get a stable equilibrium in which the credit market is segmented into an informal (small loan) segment, a formal (large loan) segment and, in between, a "non-market" (medium loan) segment.
The extension of long-term loans, e.g. to finance housing, is adversely affected by inflation. For one thing, the higher nominal interest rates charged by the banks in response to inflation mean that borrowers have to make (nominally) higher interest payments, which unnecessarily reduces their borrowing capacity. For another, long-term loans with variable interest rates increase the probability that borrowers will become unable to meet their payment obligations. The present paper examines these two assertions in detail. At the same time, it presents a concept for substantially reducing the weaknesses of conventional lending methodologies. We start by investigating the consequences of a stable inflation rate on the borrowing capacity of credit clients, then go on to analyze the impact of fluctuating inflation rates on the risk of default.
Mehr als 18 Milliarden Euro hat die Commerzbank im Zuge der Finanzkrise in Form von staatlichen Garantien, Kapitalspritzen oder Einlagen erhalten. Auch die Hypo Real Estate, die WestLB, die SachsenLB und die IKB profitierten von Stützungsmaßnahmen. Die EU genehmigte diese und andere staatlichen Hilfsmaßnahmen. Grundsätzlich sind staatliche Stützungsmaßnahmen jedoch als wirtschaftlicher Vorteil zu werten und damit zunächst eine verbotene Beihilfe. In seinem Working Paper betrachtet Tuschl die rechtlichen Grundlagen des EU-Beihilferechts und zeigt die teilweise differierende Praxis der EU-Kommission auf.
