Background Since June 2002, revised regulations in Germany have required "Emergency Medical Care" as an interdisciplinary subject, and state that emergency treatment should be of increasing importance within the curriculum. A survey of the current status of undergraduate medical education in emergency medical care establishes the basis for further committee work. Methods Using a standardized questionnaire, all medical faculties in Germany were asked to answer questions concerning the structure of their curriculum, representation of disciplines, instructors' qualifications, teaching and assessment methods, as well as evaluation procedures. Results Data from 35 of the 38 medical schools in Germany were analysed. In 32 of 35 medical faculties, the local Department of Anaesthesiology is responsible for the teaching of emergency medical care; in two faculties, emergency medicine is taught mainly by the Department of Surgery and in another by Internal Medicine. Lectures, seminars and practical training units are scheduled in varying composition at 97% of the locations. Simulation technology is integrated at 60% (n=21); problem-based learning at 29% (n=10), e-learning at 3% (n=1), and internship in ambulance service is mandatory at 11% (n=4). In terms of assessment methods, multiple-choice exams (15 to 70 questions) are favoured (89%, n=31), partially supplemented by open questions (31%, n=11). Some faculties also perform single practical tests (43%, n=15), objective structured clinical examination (OSCE; 29%, n=10) or oral examinations (17%, n=6). Conclusion Emergency Medical Care in undergraduate medical education in Germany has a practical orientation, but is very inconsistently structured. The innovative options of simulation technology or state-of-the-art assessment methods are not consistently utilized. Therefore, an exchange of experiences and concepts between faculties and disciplines should be promoted to guarantee a standard level of education in emergency medical care.
Zu den dunkelsten Kapiteln deutscher Rechtsgeschichte zählt die zivile Besatzungsjustiz Nazideutschlands in Osteuropa. "Dunkel" ist hier in zweifacher Hinsicht zu verstehen: Zum einen war die Justiz durch die Involvierung in die Besatzungspolitik an der Unterdrückung und Ausplünderung der besetzten Gebiete und ihrer Bevölkerung beteiligt und trug durch die Verfolgung des Widerstandes und der "normalen" (Kriegs-)Kriminalität maßgeblich zur Stabilisierung der deutschen Herrschaft bei. Zum anderen ist dieser Aspekt nationalsozialistischer Rechtsund Justizgeschichte in der deutschen Forschung bislang wenig beachtet worden, was vor allem den Sprachbarrieren, den lange Zeit nur schwer zugänglichen osteuropäischen Archiven und ideologischen Hemmnissen in der Zeit des Kalten Krieges geschuldet ist. ...
Im vorliegenden Papier werden drei Ansätze zur Reform des Familienleistungsausgleichs (FLA) mit jeweils zwei Varianten dargestellt und hinsichtlich ihrer fiskalischen Effekte und Wirkungen in verschiedenen Segmenten der Einkommensverteilung systematisch verglichen. – Mit dem weitestgehenden Konzept, der Kindergrundsicherung, wird ein Existenz sicherndes und zu versteuerndes Kindergeld in Höhe von monatlich 502 Euro bzw. 454 Euro pro Kind vorgeschlagen. Die bisherigen kindbedingten Freibeträge und mehrere Sozialleis-tungen könnten entfallen bzw. reduziert werden. – Daneben werden Kindergelderhöhungen auf einheitlich 238 Euro bzw. 328 Euro pro Kind und Monat, die allen Kindern – auch denen im SGB II-Leistungsbezug – zugute kommen sollen, untersucht. Das Kindergeld wäre wie bisher nicht zu versteuern, die bisherigen kindbedingten Freibeträge würden aber entfallen. – Schließlich wird der Vorschlag einer deutlichen Erhöhung des Kinderzuschlags bei reduzierter Mindesteinkommensgrenze und Wegfall der Höchsteinkommensgrenze erörtert. Zudem ist bei diesem Ansatz ein nochmals erhöhter Kinderzuschlag bei Alleinerziehenden – analog zum Mehrbedarfszuschlag nach dem SGFB II – (erste Variante) oder eine Herabsetzung der Transferentzugsrate auf Nichterwerbseinkommen von 100% auf 70% (zweite Variante) vorgesehen. Die zu erwartenden fiskalischen Belastungen der einfachen Kindergelderhöhung (ohne Be-steuerung) können ohne Weiteres hochgerechnet werden (16 bzw. 35 Mrd. Euro p. a.), die der anderen Reformmodelle sind aber ohne mikroanalytische Fundierung unter Berücksichtigung der Einkommensverteilung kaum abschätzbar. Zwar lassen sich auch die Bruttokosten der Kindergrundsicherung auf einfachem Wege ermitteln (Multiplikation der Kindergeld-Kinder mit der Betragshöhe), die Aggregate der davon abzusetzenden zahlreichen Einsparungen bei anderen Sozialleistungen und insbesondere der Steuermehreinnahmen sind allerdings nicht offensichtlich. Eine erste Überschlagsrechnung hat ergeben, dass die Nettokosten der ersten „großzügigen“ Variante der Kindergrundsicherung (502 Euro) denen der Kindergelderhöhung auf das sächliche Existenzminimum (322 Euro) ohne Besteuerung ungefähr gleich sind (in der Größenordnung von 35 Mrd. Euro). Eine genauere Quantifizierung kann aber nur auf der Ba-sis repräsentativer Mikrodaten und eines Simulationsmodells erfolgen, da insbesondere der Besteuerungseffekt der Kindergrundsicherung von der faktischen Einkommensverteilung abhängt. Auch eine Kostenschätzung für die Kinderzuschlagsreform bedarf mikroanalytischer Verfahren; ungeachtet dessen würde diese auf einen begrenzten Einkommensbereich gerichte-te Reform aber eindeutig die geringsten Kosten verursachen. Für einen systematischen Vergleich der Verteilungswirkungen der Reformvorschläge werden in der vorliegenden Arbeit Modellrechnungen für zwei ausgewählte Haushaltstypen präsen-tiert. Dabei wird deutlich, dass mit dem vergleichsweise begrenzten Konzept der Ausweitung des Kinderzuschlags die Situation von Familien in prekären Einkommensverhältnissen bis zu Familien der unteren Mittelschicht deutlich verbessert werden könnte. Inwieweit dieser Effekt eintreten würde, hängt allerdings auch vom Inanspruchnahmeverhalten ab; bisher ist die Nicht-Inanspruchnahme von Kinderzuschlag und Wohngeld weit verbreitet. Zudem würde sich die Situation der ärmsten Familien, die auf SGB II-Leistungen angewiesen sind, nicht verbessern, und am oberen Rand würden die Entlastungseffekte des FLA als Folge der kind-bedingten Freibeträge weiterhin mit dem elterlichen Einkommen zunehmen. Demgegenüber würden sich bei den Varianten der Kindergelderhöhung (ohne Besteuerung) die deutlichen Verbesserungen gegenüber dem Status quo gleichmäßig über das Einkommensspektrum vom Niedriglohnsegment – bei unverändert problematischen Effekten des Kinderzuschlags (Ein-kommensbruchstelle bei Höchsteinkommensgrenze) – bis in obere Schichten verteilen und erst am oberen Rand mit steigendem Einkommen sinken (infolge des Wegfalls der bisherigen kindbedingten Freibeträge). Die Förderungen durch die Kindergrundsicherung schließlich würden am stärksten im unteren und unteren Mittelbereich ausfallen und – im Gegensatz zu anderen Konzepten – insbesondere verdeckte Armut systembedingt, also quasi „automatisch“, weitgehend abbauen. Im oberen Mittelbereich und hauptsächlich in höheren Schichten würden die Transfers dagegen mit zunehmendem Einkommen kontinuierlich abnehmen. Insgesamt würde dies zu einem vergleichsweise stetig steigenden Verlauf des verfügbaren Familieneinkommens führen; die wegen der hohen Transferentzugsraten des Kinderzuschlags – gegebenenfalls in Kombination mit Wohngeld – häufigen Befürchtungen negativer Arbeitsanreize im unteren Einkommensbereich wären gegenstandslos. Inwieweit die hier diskutierten Reformkonzepte zu einem Abbau von Kinder- und Familien-armut und zu weniger Ungleichheit der personellen Einkommensverteilung führen können, lässt sich allein auf der Basis von Modellrechnungen allerdings nicht absehen. Dazu bedarf es detaillierter Analysen auf der Basis von repräsentativen Mikrodaten, die die faktische Ein-kommensverteilung abbilden und Simulationsrechnungen zur Quantifizierung der Effekte der Reformvarianten – unter Einbeziehung der Finanzierung der jeweiligen Nettokosten – ermöglichen. Daran wird im Projekt „Vom Kindergeld zu einer Grundsicherung für Kinder“ auf Basis der Daten des Sozio-ökonomischen Panels (SOEP) 2007 gearbeitet; die Repräsentativität des Datensatzes hinsichtlich des Nachweises von Einkommens-, insbesondere Transferar-ten wurde bereits geprüft – mit gutem Ergebnis.
A generic drug product (World Health Organization (WHO) terminology: multisource product) is usually marketed and manufactured after the expiry date of the innovator’s patent. Generic drugs are less expensive than the innovator products because generic manufacturers do not have to amortize the investment costs of research, development, marketing, and promotion. Multisource products must contain the same active pharmaceutical ingredients (APIs) as the original formulation and have to be shown to be interchangeable with the original formulation. Multisource products have to be shown bioequivalent to the innovator counterpart with respect to pharmacokinetic and pharmacodynamic properties. Multisource products are therefore identical in dose, strength, route of administration, safety, efficacy, and intended use. Bioequivalence can be demonstrated by in vitro dissolution, pharmacokinetic, pharmacodynamic or clinical studies. Since 2000, the U.S. Food and Drug Administration (FDA) allows the approval of certain multisource products solely on the basis of in vitro studies, i.e. by waiving in vivo studies in humans (“Biowaiver”), based on the Biopharmaceutics Classification Scheme (BCS). The BCS characterizes APIs by their solubility and permeability in the gastrointestinal tract (GIT). The different BCS Classes I-IV (Class I: high solubility, high permeability; Class II: low solubility, high permeability; Class III: high solubility, low permeability and Class IV: low solubility, low permeability) result from all possible combinations of high and low solubility with high and low permeability. Since the adoption of the BCS by the FDA in 1995, the BCS criteria have been under continuous development. In 2006, the WHO has released the most recent bioequivalence guidance including relaxed criteria for bioequivalence studies based on modified BCS criteria. According to this guidance, APIs belonging to the BCS classes I – and under defined conditions - II and III – are eligible for a biowaiver-based approval. The principal objective of this work was to characterize the first-line anti tuberculosis APIs, isoniazid, pyrazinamide, ethambutol dihydrochloride and rifampicin, according to their physicochemical, biopharmaceutical, pharmacokinetic and pharmacological properties and to classify them according to the BCS. Ethambutol dihydrochloride and isoniazid were classified as borderline BCS class I/III APIs. Pyrazinamide was classified as a BCS class III and rifampicin as a BCS class II API. Based on the BCS classification and the additional criteria defined in the WHO bioequivalence guidance, the possibility of biowaiver-based approval for immediate release (immediate release) solid oral dosage forms containing the first-line antituberculosis drugs was evaluated. A biowaiver-based approval with defined constraints was recommended for immediate release solid oral dosage forms containing isoniazid (interaction with reducing sugars), pyrazinamide and ethambutol dihydrochloride (relative narrow therapeutic index). Rifampicin was classified as a BCS class II API, and it was concluded that rifampicin containing solid oral immediate release drug products as well as Scale-Up and Post-Approval Changes (SUPAC) changes should not be approved by a biowaiver on the following basis: (i) its solubility and dissolution are highly variable due to polymorphism and instability, (ii) concomitant intake of food and antacids reduces its absorption and bioavailability, (iii) no in vitro predictive dissolution test has been found which correlates to in vivo absorption and (iv) several publications reporting cases of non-bioequivalent and bioinequivalent rifampicin products have been located in the literature. Thus, it is recommended that bioequivalence of rifampicin containing solid oral immediate release drug products should be established by in vivo pharmacokinetic studies in humans. This risk-benefit benefit assessment of a biowaiver-based approval was presented as a poster at the American Association of Pharmaceutical Scientists (AAPS) 2005 and subsequently published as “Biowaiver Monographs” in the Journal of Pharmaceutical Sciences. Based on the assessment of the dissolution properties of the antituberculosis drugs for a biowaiver approval, quality control dissolution methodologies for the International Pharmacopoeia (Pharm. Int.) were developed, presented at the WHO expert meeting and adopted in the Pharm. Int. (http://www.who.int/medicines/publications/pharmprep/OMS_TRS_948.pdf). Additionally, preliminary biowaiver recommendations were also developed for four firstline antimalarial drugs listed on the WHO Essential Medicines List (EML): Quinine, as both the hydrochloride and sulphate, and proguanil hydrochloride were classified as borderline BCS class I/III APIs. Since quinine is a narrow therapeutic index drug and many cases of non-bioequivalence have been reported in the literature, a biowaiverbased approval was not recommended. For solid oral immediate release dosage forms containing proguanil a biowaiver-based approval was recommended under the condition that they dissolve very rapidly. Primaquine phosphate was classified as a BCS class I API. Therefore, a biowaiver-based approval was recommended for immediate release solid oral dosage forms containing primaquine phosphate. Mefloquine hydrochloride was classified as a basic, BCS class IV/II API, making it ineligible for the biowaiver. Additionally, reports of non-bioequivalence and a narrow therapeutic index were found in the scientific literature. Consequently, bioequivalence of solid oral immediate release dosage forms containing mefloquine hydrochloride should be established by in vivo pharmacokinetic studies. The results for quinine hydrochloride and sulphate, proguanil hydrochloride, primaquine diphosphate and mefloquine hydrochloride were presented as a poster at the Pharmaceutical Sciences World Congress (PSWC) 2007 and published as a WHO Collaborating Center Report in June 2006. The aim of this project was to collect, evaluate, generate and publish relevant information for a biowaiver-based approval of essential medicines in order to provide a summary to local regulatory authorities. This information complements the selected list of essential medicines by providing information about the biopharmaceutical properties and pharmaceutical quality of solid oral immediate release dosage forms containing these APIs. The aim of the biowaiver project, inspired by the WHO and brought in life by the International Pharmaceutical Federation (FIP), is to enable access to essential medicines in standardized quality at an affordable price. In this work, a significant contribution to this aim in the form of four biowaiver monographs for the antituberculosis drugs and several reports on the antimalarials has been achieved.
In the New-Keynesian model, optimal interest rate policy under uncertainty is formulated without reference to monetary aggregates as long as certain standard assumptions on the distributions of unobservables are satisfied. The model has been criticized for failing to explain common trends in money growth and inflation, and that therefore money should be used as a cross-check in policy formulation (see Lucas (2007)). We show that the New-Keynesian model can explain such trends if one allows for the possibility of persistent central bank misperceptions. Such misperceptions motivate the search for policies that include additional robustness checks. In earlier work, we proposed an interest rate rule that is near-optimal in normal times but includes a cross-check with monetary information. In case of unusual monetary trends, interest rates are adjusted. In this paper, we show in detail how to derive the appropriate magnitude of the interest rate adjustment following a significant cross-check with monetary information, when the New-Keynesian model is the central bank’s preferred model. The cross-check is shown to be effective in offsetting persistent deviations of inflation due to central bank misperceptions. We use a novel disaggregate sectoral euro area dataset with a regional breakdown that allows explicit estimation of the sectoral component of price changes (rather than interpreting the idiosyncratic component as sectoral as done in other papers). Employing a new method to extract factors from over-lapping data blocks, we find for our euro area data set that the sectoral component explains much less of the variation in sectoral regional inflation rates and exhibits much less volatility than previous findings for the US indicate. Country- and region-specific factors play an important role in addition to the sector-specific factors. We conclude that sectoral price changes have a “geographical” dimension, as yet unexplored in the literature, that might lead to new insights regarding the properties of sectoral price changes.
Anschleichen an Übernahmeziele mittels Cash Settled Equity Derivaten : ein Regelungsvorschlag

Noch ist das Risikobegrenzungsgesetz, das unter anderem neue Meldepflichten in das Wertpapierhandelsgesetz (WpHG) einführt, nicht vollständig in Kraft getreten. Gleichwohl wird bereits angesichts aktueller Entwicklungen auf dem internationalen und deutschen Übernahmemarkt in Artikeln der Fachpresse und im kapitalmarktrechtlichen Schrifttum die erneute Überarbeitung des wertpapierhandels- und wertpapierübernahmerechtlichen Meldesystems gefordert. Diese Forderung ist berechtigt. Denn im Risikobegrenzungsgesetz, dem zeitlich letzten Versuch des Gesetzgebers, die Transparenz des Wertpapierhandels zu erhöhen, konnte die Chance nicht genutzt werden, das wertpapierhandelsrechtliche Meldesystem an eine neuere Praxis auf den Finanzmärkten anzupassen.
