This paper provides theory as well as empirical results for pre-averaging estimators of the daily quadratic variation of asset prices. We derive jump robust inference for pre-averaging estimators, corresponding feasible central limit theorems and an explicit test on serial dependence in microstructure noise. Using transaction data of different stocks traded at the NYSE, we analyze the estimators’ sensitivity to the choice of the pre-averaging bandwidth and suggest an optimal interval length. Moreover, we investigate the dependence of pre-averaging based inference on the sampling scheme, the sampling frequency, microstructure noise properties as well as the occurrence of jumps. As a result of a detailed empirical study we provide guidance for optimal implementation of pre-averaging estimators and discuss potential pitfalls in practice. Price pressures

We study price pressures in stock prices—price deviations from fundamental value due to a risk-averse intermediary supplying liquidity to asynchronously arriving investors. Empirically, twelve years of daily New York Stock Exchange intermediary data reveal economically large price pressures. A $100,000 inventory shock causes an average price pressure of 0.28% with a half-life of 0.92 days. Price pressure causes average transitory volatility in daily stock returns of 0.49%. Price pressure effects are substantially larger with longer durations in smaller stocks. Theoretically, in a simple dynamic inventory model the ‘representative’ intermediary uses price pressure to control risk through inventory mean reversion. She trades off the revenue loss due to price pressure against the price risk associated with remaining in a nonzero inventory state. The model’s closed-form solution identifies the intermediary’s relative risk aversion and the distribution of investors’ private values for trading from the observed time series patterns. These allow us to estimate the social costs—deviations from constrained Pareto efficiency—due to price pressure which average 0.35 basis points of the value traded. SUMMARY RECOMMENDATIONS 1. One of the major lessons from the current financial crisis refers to the systemic dimension of financial risk which had been almost completely neglected by bankers and supervisors in the pre-2007 years. 2. Accordingly, the most needed change in financial regulation, in order to avoid a repetition of such a crisis in the future, consists of influencing individual bank behaviour such that systemic risk is decreased. This objective is new and distinct from what Basle II was intended to achieve. 3. It is important, therefore, to evaluate proposed new regulatory instruments on the ground of whether or not they contribute to a reduction, or containment of systemic risk. We see two new regulatory measures of paramount importance: the introduction of a Systemic Risk Charge (SRC), and the implementation of a transparent bank resolution regime. Both measures complement each other, thus both have to be realized to be effective. 4. We propose a Systemic Risk Charge (SRC), a levy capturing the contribution of any individual bank to the overall systemic risk which is distinct from the institution’s own default risk. The SRC is set up such that the more systemic risk a bank contributes, the higher is the cost it has to bear. Therefore, the SRC serves to internalize the cost of systemic risk which, up to now, was borne by the taxpayer. 5. Major details of our SRC refer to the use of debt that may be converted into equity when systemic risk threatens the stability of the banking system. Also, the SRC raises some revenues for government. 6. The SRC has to be compared to several bank levies currently debated. The Financial Transaction Tax (FTT) does not directly address systemic risk and is therefore inferior to a SRC. Nevertheless, a FTT may offer the opportunity to subsidize on-exchange trading at the expense of off-exchange (over-the-counter, OTC) transactions, thereby enhancing financial market stability. The Financial Activity Tax (FAT) is similar to a VAT on financial services. It is the least adequate instrument among all instruments discussed above to limit systemic risk. 7. Bank resolution regime: No instrument to contain systemic risk can be effective unless the restructuring of bank debt, and the ensuing loss given default to creditors, is a real possibility. As the crisis has taught, bank restructuring is very difficult in light of contagion risk between major banks. We therefore need a regulatory procedure that allows winding down banks, even large banks, on short notice. Among other things, the procedure will require to distinguish systemically relevant exposures from those that are irrelevant. Only the former will be saved with government money, and it will then be the task of the supervisor to ensure a sufficient amount of nonsystemically relevant debt on the balance sheet of all banks. 8. Further issues discussed in this policy paper and its appendices refer to the necessity of a global level playing field, or the lack thereof, for these new regulatory measures; the convergence of our SRC proposal with what is expected to be long-term outcome of Basle III discussions; as well as the role of global imbalances.
Many studies show that most people are not financially literate and are unfamiliar with even the most basic economic concepts. However, the evidence on the determinants of economic literacy is scant. This paper uses international panel data on 55 countries from 1995 to 2008, merging indicators of economic literacy with a large set of macroeconomic and institutional variables. Results show that there is substantial heterogeneity of financial and economic competence across countries, and that human capital indicators (PISA test scores and college attendance) are positively correlated with economic literacy. Furthermore, inhabitants of countries with more generous social security systems are generally less literate, lending support to the hypothesis that the incentives to acquire economic literacy are related to the amount of resources available for private accumulation. We estimate the risk and expected returns of private equity investments based on the market prices of exchange traded funds of funds that invest in unlisted private equity funds. Our results indicate that the market expects unlisted private equity funds to earn abnormal returns of about one to two percent. We also find that the market expects listed private equity funds to earn zero to marginally negative abnormal returns net of fees. Both listed and unlisted private equity funds have market betas close to one and positive factor loadings on the Fama-French SMB factor. Private equity fund returns are positively correlated with GDP growth and negatively correlated with the credit spread. Finally, we find that market returns of exchange traded funds of funds and listed private equity funds predict changes in self-reported book values of unlisted private equity funds.
Die Einschaltung einer zentralen Gegenpartei in den Handel mit Derivaten erfüllt zahlreiche wirtschaftliche Funktionen. Neben der Reduktion des Kontrahentenausfallrisikos und systemischer Risiken wird das durch das Erfordernis angemessener Eigenkapitalunterlegung gebundene Eigenkapital bestmöglich freigehalten. Letztlich kann mit ihr auch ein Frühwarnsystem zur Vorbeugung ungewollter Marktentwicklungen implementiert werden. Bei der Frage nach der rechtlichen Konstruktion des Handels mit Derivaten mittels zentraler Gegenpartei sind börslicher und außerbörslicher Handel zu trennen. Im börslichen Derivatehandel kommen die Rechtsgeschäfte zwischen CM und zentraler Gegenpartei durch Angebot und Annahme i.S. der §§ 145 ff. BGB zustande. Das Angebot des CM 1 liegt in der Eingabe der Order in das EDV-System. Das Angebot ist hinreichend bestimmt. Auch handelt CM 1 mit Rechtsbindungswillen. Allerdings besteht ein vertraglich vereinbartes Rücktrittsrecht bis zum Zeitpunkt des Matching. Das Angebot geht der zentralen Gegenpartei zu, indem CM 2 dieses als Passivvertreterin der zentralen Gegenpartei zur Kenntnis nimmt. Die Annahme durch die zentrale Gegenpartei erfolgt antizipiert durch Abschluss der Clearing-Vereinbarung. Ist ein NCM beteiligt, kommt zudem ein Parallelkontrakt zwischen CM und NCM zustande. Da die Ordereingabe des NCM zu zwei Vertragsschlüssen führt, gibt es zum einen ein eigenes Angebot gegenüber dem CM ab, welches antizipiert durch Abschluss der NCM-CM-Vereinbarung angenommen wird. Zum anderen gibt es ein Angebot im Namen des CM gegenüber der zentralen Gegenpartei ab. Der Vertragsschluss entspricht dem zwischen CM und zentraler Gegenpartei. Im OTC-Handel wird das Rechtsgeschäft zunächst zwischen den CM oder den RK geschlossen. Dann wird das Geschäft im Wege der abstrakten Novation aufgespalten. Dadurch wird die zentrale Gegenpartei jeweils Vertragspartner eines CM. Die Novation erhält ihre spezielle Ausprägung durch die CB-Eurex. Der Abschluss der neuen Schuldverhältnisse erfolgt durch Abgabe eines eigenen Angebotes der CM, das durch den anerkannten Anbieter als bloßer Bote an die zentrale Gegenpartei übermittelt wird. Die Annahme erfolgt durch Abschluss der Clearing-Vereinbarung. Ist ein RK involviert, kommt ebenfalls ein Parallelkontrakt zustande. Das Zustandekommen der beiden Rechtsgeschäfte findet auf die gleiche Weise wie im börslichen Handel statt. Das Clearing verläuft für den börslichen und außerbörslichen Derivatehandel gleich. Zunächst werden die fälligen Forderungen und Verbindlichkeiten verrechnet (Netting).208 Diesbezüglich schließen die Clearing-Stelle und das jeweilige CM durch Abschluss der Clearing-Vereinbarung einen Aufrechnungsvertrag zur Begründung einer einseitigen Aufrechnungsbefugnis zugunsten der Eurex Clearing AG. Eine Nettingvereinbarung kann auch im Verhältnis CM und NCM bzw. RK geschlossen werden. Eine Pflicht dazu besteht aber nicht. Die nicht verrechneten fälligen Forderungen und Verbindlichkeiten werden durch Barausgleich oder durch Übereignung von Wertpapieren, Wertrechten oder Wertpapieren im Treuhandgiroverkehr, erfüllt. Die Übereignung von Wertpapieren findet nach sachenrechtlichen Grundsätzen statt. Die dingliche Einigung zwischen CM 1 und CM 2 liegt in der Erstellung der Ist-Lieferliste durch die Eurex Clearing AG, die dabei als Aktiv- und Passivvertreter der beteiligten CMs handelt. Die dingliche Einigung erfolgt unter aufschiebender Bedingung. Die Übergabe der Wertpapiere findet durch Umstellung des Besitzmittlungsverhältnisses nach § 929 S. 1 BGB statt. Die Übertragung von Wertrechten oder Wertpapieren im Treuhandgiroverkehr finden nach den schuldrechtlichen Regelungen zur Aufrechnung (§§ 398 ff. BGB) statt. Dazu tritt CM 1 zunächst den Lieferanspruch gegenüber der Wertpapiersammelbank an die Eurex Clearing AG ab. Diese erwirbt den Lieferanspruch jedoch nur treuhänderisch durch Abschluss eines eigennützigen Treuhandverhältnisses. Erst in einem zweiten Schritt tritt die Eurex Clearing AG den Lieferanspruch unter aufschiebender Bedingung an CM 2 ab, was durch die Erteilung entsprechender Gutschriften nach außen erkennbar wird. Nicht fällige Derivategeschäfte werden saldiert. Ein dabei verbleibender Saldo an offenen Verbindlichkeiten ist durch Sicherheiten zu unterlegen. Im Hinblick auf die Funktionswahrung der Clearing-Stelle sind diese bei Sicherheiten in Wertpapieren und Wertrechten ausnahmslos als Pfandrechte zu qualifizieren.
We investigate the incentives for vertical or horizontal integration in the financial security service industry, consisting of trading, clearing and settlement. We thereby focus on firms’ decisions but also look on the implications of these decisions on competition and welfare. Our analysis shows that the incentives for vertical integration crucially depend on industry as well as market characteristics. A more pronounced demand for liquidity clearly favors vertical integration whereas deeper financial integration increases the incentives to undertake vertical integration only if the efficiency gains associated with vertical integration are sufficiently large. Furthermore, we show that market forces can suffer from a coordination problem that end in vertically integrated structures that are not in the best interest of the firms. We believe this problem can be addressed by policy measures such as the TARGET2-Securities program. Furthermore, we use our framework to discuss major industry trends and policy initiatives. On the backdrop of the 2008 financial crisis this paper introduces an understanding of societal crises as a reduction in the meaning production of social entities, which can either be internally or externally provoked. The emergence of constitutions and, more generally, constitutional structures, can be understood as responses to both forms of crisis. This is the case because they are double-edged structures which are simultaneously oriented towards the maintenance of internal order and stability within a given social entity at the same time as they frame the transfer of the meaning components between the social entities and their environments. Thus, the 2008 financial crisis indicates a failure of constitutional bonding. When observed from an overall structural perspective, the reasons for this failure can be traced back to an increased discrepancy between the structural composition of world society and the constitutional structures in place. The crisis reflects a failure to respond to two simultaneous, inter-related and mutually re-inforcing structural transformations. First, there is the increased globalisation, which has led to massive dis-locations in the relative centrality of the different national configurations for the reproductive processes of functional systems. Second, there is a structural transformation of the transnational layer of world society through a reduced reliance on the centre/periphery differentiation and an increased reliance on functional differentiation. One of the many consequences of this development is the emergence of new forms of transnational law and politics. A new constitutional architecture which reflects these transformations is needed in order to ensure an adequate constitutional bonding of economic processes, as well as of other social processes.

The concept of embeddedness plays a central role in the segment of economic sociology and social theory which is inspired by the works of Karl Polanyi. But to the extent that embeddedness is understood in a substantialist manner, implying the existence of a unitary lifeworld, the desire for embeddedness is an impossible aspiration under modern conditions. Throughout the modern era it is however possible to observe the emergence of complex societal stabilization mechanisms, which serve as substitutes to traditional forms of embeddedness. The emergence of function specific cultures, in the form of, for example, legal, political and scientific cultures, establishing a ‘second nature’ in the Hegelian sense, is one example of this. Other examples are (neo-)corporatist institutions which fulfilled a central stabilising role in classical modernity and the kind of network based governance arrangements which fulfil a similar position in today’s radicalised modernity.

This paper analyzes the impact of blockownership dispersion on firm value. Blockholdings by multiple blockholders is a widespread phenomenon in the U.S. market. It is not clear, however, whether dispersion among blockholder is preferable to having a more concentrated ownership structure. To test for the direction of the effect, we use a large dataset of U.S. firms that combines blockholder information, shareholder rights information, debt ratings, accounting information, and financial markets information. We find that a large fraction of aggregated block ownership negatively affects Tobin’s Q. The negative impact is larger if blockowners are more dispersed, suggesting that a concentrated ownership structure is to be preferred on average. Results are robust to controlling for blockholder type as well as proxies for shareholder rights. Our empirical findings are also confirmed if we study the impact of ownership dispersion on firm debt ratings rather than Tobin’s Q. JEL Classification: G3, G32
Zusammenfassung - Das Kernanliegen des KredReorgG –die Internalisierung des systemischen Risikos in den Entscheidungsprozess und die Verantwortlichkeit von Bankeignern und –gläubigern – wird im Wesentlichen erreicht. - Die Wirksamkeit des Gesetzes steht und fällt mit der Möglichkeit, jede Bank in systemisch relevante (zu rettende) und systemisch nicht-relevante (abzuwickelnde) Teile zu zerlegen. Dieser Ansatz ist Ziel führend und international „state of the art“ (Bsp. UK). - Unsere Hauptkritik: Um die o.g. Wirksamkeit des Gesetzes überhaupt zu ermöglichen (und eine Unterlaufung der Gesetzesintention zu verhindern), bedarf es einer zusätzlichen und zwingenden Vorgabe, dass jede Bank eine Mindestmenge an Anleihen außerhalb des Kern-Finanzsektors dauerhaft platzieren muss, und dass diese Anleihen zu keinem Zeitpunkt von Banken erworben werden dürfen. - Um dies zu erreichen sind die Anlagevorschriften für Kapitalsammelstellen (Lebensversicherer, Pensionsfonds) und für Banken entsprechend zu ändern bzw. zu verschärfen. - Weitere Kritikpunkte betreffen die vermutete geringe Bedeutung der freiwilligen Verfahren (Sanierung und Reorganisation) und die Gestaltung der Sonderabgabe und der Restrukturierungsfonds.
The objective of this study is to determine whether specific industries across countries or within countries are more likely to reach a stage of profitability and make a successful exit. In particular, we assess whether firms in certain industries are more prone to exit via IPO, be acquired, or exit through a leveraged buy-out. We are also interested in analyzing whether substantial differences across industries and countries arise when looking separately at the success’ rate of firms which have received venture funding at the early seed and start-up stages, vis-à-vis firms that received funding at later stages. Our results suggest that, inasmuch as some of the differences in performance can be explained by country-specific factors, there are also important idiosyncratic differences across industries: In particular, firms in the biotech and the medical / health / life science sectors tend to be significantly more likely to have a successful exit via IPO, while firms in the computer industry and communications and media are more prone to exit via merger or acquisition. We show that average excess returns during the last two years of the presidential cycle are significantly higher than during the first two years: 9.8 percent over the period 1948 – 2008. This pattern in returns cannot be explained by business-cycle variables capturing time-varying risk premia, differences in risk levels, or by consumer and investor sentiment. In this paper, we formally test the presidential election cycle (PEC) hypothesis as the alternative explanation found in the literature for explaining the presidential cycle anomaly. PEC states that incumbent parties and presidents have an incentive to manipulate the economy (via budget expansions and taxes) to remain in power. We formulate eight empirically testable propositions relating to the fiscal, monetary, tax, unexpected inflation and political implications of the PEC hypothesis. We do not find statistically significant evidence confirming the PEC hypothesis as a plausible explanation for the presidential cycle effect. The existence of the presidential cycle effect in U.S. financial markets thus remains a puzzle that cannot be easily explained by politicians employing their economic influence to remain in power. We show that if an agent is uncertain about the precise form of his utility function, his actual relative risk aversion may depend on wealth even if he knows his utility function lies in the class of constant relative risk aversion (CRRA) utility functions. We illustrate the consequences of this result for asset allocation: poor agents that are uncertain about their risk aversion parameter invest less in risky assets than wealthy investors with identical risk aversion uncertainty. A call on art investments

The art market has seen boom and bust during the last years and, despite the downturn, has received more attention from investors given the low interest environment following the financial crisis. However, participation has been reserved for a few investors and the hedging of exposures remains dificult. This paper proposes to overcome these problems by introducing a call option on an art index, derived from one of the most comprehensive data sets of art market transactions. The option allows investors to optimize their exposure to art. For pricing purposes, non-tradability of the art index is acknowledged and option prices are derived in an equilibrium setting as well as by replication arguments. In the former, option prices depend on the attractiveness of gaining exposure to a previously non-traded risk. This setting further overcomes the problem of art market exposures being dificult to hedge. Results in the replication case are primarily driven by the ability to reduce residual hedging risk. Even if this is not entirely possible, the replication approach serves as pricing benchmark for investors who are significantly exposed to art and try to hedge their art exposure by selling a derivative. According to disposition effect theory, people hold losing investments too long. However, many investors eventually sell at a loss, and little is known about which psychological factors contribute to these capitulation decisions. This study integrates prospect theory, utility maximization theory, and theory on reference point adaptation to argue that the combination of a negative expectation about an investment’s future performance and a low level of adaptation to previous losses leads to a greater capitulation probability. The test of this hypothesis in a dynamic experimental setting reveals that a larger total loss and longer time spent in a losing position lead to downward adaptations of the reference point. Negative expectations about future investment performance lead to a greater capitulation probability. Consistent with the theoretical framework, empirical evidence supports the relevance of the interaction between adaptation and expectation as a determinant of capitulation decisions. How ordinary consumers make complex economic decisions: financial literacy and retirement readiness

This paper explores who is financially literate, whether people accurately perceive their own economic decision-making skills, and where these skills come from. Self-assessed and objective measures of financial literacy can be linked to consumers’ efforts to plan for retirement in the American Life Panel, and causal relationships with retirement planning examined by exploiting information about respondent financial knowledge acquired in school. Results show that those with more advanced financial knowledge are those more likely to be retirement-ready.
We examined financial literacy among the young using the most recent wave of the 1997 National Longitudinal Survey of Youth. We showed that financial literacy is low; fewer than one-third of young adults possess basic knowledge of interest rates, inflation, and risk diversification. Financial literacy was strongly related to sociodemographic characteristics and family financial sophistication. Specifically, a college-educated male whose parents had stocks and retirement savings was about 45 percentage points more likely to know about risk diversification than a female with less than a high school education whose parents were not wealthy. These findings have implications for consumer policy. JEL Classification: D91
We use a unique, nationally representative cross-national dataset to document the reduction in individuals’ usage of routine non-emergency medical care in the midst of the economic crisis. A substantially larger fraction of Americans have reduced medical care than have individuals in Great Britain, Canada, France, and Germany, all countries with universal health care systems. At the national level, reductions in medical care are related to the degree to which individuals must pay for it, and within countries are strongly associated with exogenous shocks to wealth and employment.
During the last decades households in the U.S. have experienced that residential house prices move in a persistent manner, i.e. that returns are positively serially correlated. Since an owner-occupied home is usually the largest investment of a household it is important to understand how households act when they base their consumption and investment decisions on this experience. We show in a setting with housing market cycles and households who can decide whether they rent or own the home, that - besides the consumption and the precautionary savings motive - serial correlation in house prices generates a new speculative motive for homeownership. In particular, we show how good and bad housing market cycles affect homeownership rates, leverage, stock investments and consumption and can explain empirically observed household behavior during housing market boom and bust periods. This paper proposes the Shannon entropy as an appropriate one-dimensional measure of behavioural trading patterns in financial markets. The concept is applied to the illustrative example of algorithmic vs. non-algorithmic trading and empirical data from Deutsche Börse's electronic cash equity trading system, Xetra. The results reveal pronounced differences between algorithmic and non-algorithmic traders. In particular, trading patterns of algorithmic traders exhibit a medium degree of regularity while non-algorithmic trading tends towards either very regular or very irregular trading patterns. Dieser Beitrag unterbreitet einen analytischen Interpretationsrahmen zur Erklärung der internationalen Verbreitung dieser Reformstrategien und versucht die behaupteten negativen Effekte von Kommerzialisierungsprozessen auf Versorgungsqualität und Zugänglichkeit zu untersuchen. Gestützt auf einen Vergleich eines idealtypischen Kommerzialisierungsmodells mit dem institutionellen und organisatorischen Wandel im deutschen Krankenhaussystem kommt der Beitrag zu dem Schluss, dass Kommerzialisierungsprozesse in der Krankenhausversorgung bislang noch begrenzt sind. Obwohl ein markt- und wettbewerbsbasierter Umbau der Governancestrukturen zu beobachten ist und Krankenhäuser zu einer Kommerzialisierungsstrategie gedrängt werden, lässt sich aufgrund einer unzureichenden Daten- und Forschungslage bislang nicht empirisch feststellen, ob die Kommerzialisierungsprozesse zu einer Verschlechterung der Qualität und Zugänglichkeit der Krankenhausversorgung geführt haben.
Das Diskussionspapier versucht Dimensionen und Ausmaße von Ökonomisierungs- und Kommerzialisierungsprozessen in OECD-Gesundheitssystemen explorativ zu erörtern. Hierzu wird zunächst die Hypothese entwickelt, dass sich in den (meisten) OECD-Staaten eine hegemoniale gesundheitspolitische Strategie herausbildet, die als wettbewerbsbasierte Kostendämpfungspolitik bezeichnet wird. In der Folge werden die (mutmaßlichen) Auswirkungen von Ökonomisierungs- und Kommerzialisierungsprozessen diskutiert. Erstens wird beschrieben, wie die Monetarisierung der Arzt-Patienten-Beziehung zu einer Privatisierung des Gesundheitssystems führt. Zweitens wird die sich transformierende Arzt-Patienten-Beziehung als Dialektik von Demokratisierungs- und Ökonomisierungsprozessen dargestellt. Drittens beschäftigt sich der Beitrag mit Entwicklung einer neuen Gesundheitskultur, die die gesundheitliche Eigenverantwortung des Einzelnen betont, zugleich jedoch neuen Ausgrenzungs- und Stigmatisierungsprozessen den Weg zu ebnen droht. Abschließend wird ein in groben Zügen ein Forschungsprogramm umschrieben, welches Ökonomisierungs- und Kommerzialisierungsprozesse auf diesen drei Forschungsfeldern analytisch und bewertend unter die Lupe zu nehmen versucht.
This study examines the legal environment of netting agreements covering financial contracts. It concludes that an international instrument should be developed capable of improving the effectiveness of netting agreements in mitigating systemic risk. To this end, two different aspects of the enforceability of netting agreements are considered: (i) the general enforceability of netting, and (ii) the possibility of precluding the operation of netting a mechanism by way of a regulatory moratorium for considerations of systemic stability. The first part of the study presents the use of netting and the various forms it may take before going on to explain the benefits and drawbacks of enforceable netting agreements. Benefits for individual firms consist in lower counterparty risk and more favourable capital requirements. Benefits for the financial market as a whole flow from greater financial market stability since the contagion of systemically relevant institutions by the default or insolvency of another institution is limited, thus helping to avoid systemic effects. Additionally, the use of netting arrangements can improve overall market liquidity. A potential drawback of enforceability of netting, in certain situations, is that the operation of a netting mechanism could actually work against the purpose of systemic stability where the transfer of parts of the business of an insolvent financial institution to a solvent bridge entity would enhance or maintain value to a greater extent than the operation of a netting agreement would. Regulatory authorities are considering under which conditions a moratorium to halt the netting mechanism until the situation is solved could avoid this threat to systemic stability. The second part of the study examines whether there is the potential to support the purpose of enhanced systemic stability by way of international harmonisation of private and insolvency law. As regards the issue of general enforceability, the global picture of netting legislation is heterogeneous. Given the great practical relevance of the matter, an international instrument could be very useful. As to the issue of private law consequences of regulatory moratoria, the absence of a harmonised framework appears to lead to actual cross-border inconsistency and legal uncertainty as regards financial contracts that are governed by a foreign law. Taking these to aspects into account, this paper recommends that work on developing an international instrument be undertaken. The final part of the study suggests a set of preliminary guidelines for the development of suchan instrument. In the light of the findings of the previous sections, a mixed, two-step approach is recommended. First, a non-binding instrument could be developed, serving as a benchmark and reservoir of legal solutions in respect of the relevant issues. Secondly, isolated aspects relating to both the general enforceability of netting and the accommodation of a regulatory moratorium in foreign private and insolvency law could be dealt with in an international Convention, in particular where cross-border situations involving netting require uniformity of applicable legal rules.

Towards correctness of program transformations through unification and critical pair computation

Correctness of program transformations in extended lambda-calculi with a contextual semantics is usually based on reasoning about the operational semantics which is a rewrite semantics. A successful approach is the combination of a context lemma with the computation of overlaps between program transformations and the reduction rules, which results in so-called complete sets of diagrams. The method is similar to the computation of critical pairs for the completion of term rewriting systems. We explore cases where the computation of these overlaps can be done in a first order way by variants of critical pair computation that use unification algorithms. As a case study of an application we describe a finitary and decidable unification algorithm for the combination of the equational theory of left-commutativity modelling multi-sets, context variables and many-sorted unification. Sets of equations are restricted to be almost linear, i.e. every variable and context variable occurs at most once, where we allow one exception: variables of a sort without ground terms may occur several times. Every context variable must have an argument-sort in the free part of the signature. We also extend the unification algorithm by the treatment of binding-chains in let- and letrec-environments and by context-classes. This results in a unification algorithm that can be applied to all overlaps of normal-order reductions and transformations in an extended lambda calculus with letrec that we use as a case study.
Der vorliegende Beitrag versucht in Grundzügen zwei große thematische und theoretische Stränge zu bearbeiten, die im Begriff der Positiven Generalprävention miteinander verwoben sind. Der eine Strang kann dabei nicht mehr leisten, als erst einmal eine Ahnung von den Herausforderungen zu vermitteln, die das Völkerstrafrecht und seine Kriminologie an die im nationalen Strafrecht geläufigen Strafzwecke stellt; der andere Strang arbeitet dann ausführlicher kriminologisch, rechts- und normentheoretisch heraus, was das Völkerstrafrecht mit seinem Verfahren und seinen Sanktionen - immer gemessen an seinen eigenen immanenten und teilweise noch impliziten Ansprüchen - an expliziten Rechtswirkungen jedenfalls dann anstreben muss, wenn es, wie das nationalstaatliche Strafrecht auch, ein dezidiert präventiv ausgerichtetes Schuldstrafrecht sein und bleiben möchte. Beide Stränge treffen sich schließlich in der Überlegung, dass das Völkerstrafecht in vielfacher, hier dann auch näher erläuterter Weise eine „neue Form“ von Strafrecht ist, dessen Zweckbestimmung sich zwar der teleologischen Semantik des nationalen Strafrechts bedienen darf, die aber aus der Natur seines Gegenstandes heraus etwas ganz anderes und auch Neues bedeuten muss.
A logical framework consisting of a polymorphic call-by-value functional language and a first-order logic on the values is presented, which is a reconstruction of the logic of the verification system VeriFun. The reconstruction uses contextual semantics to define the logical value of equations. It equates undefinedness and non-termination, which is a standard semantical approach. The main results of this paper are: Meta-theorems about the globality of several classes of theorems in the logic, and proofs of global correctness of transformations and deduction rules. The deduction rules of VeriFun are globally correct if rules depending on termination are appropriately formulated. The reconstruction also gives hints on generalizations of the VeriFun framework: reasoning on nonterminating expressions and functions, mutual recursive functions and abstractions in the data values, and formulas with arbitrary quantifier prefix could be allowed.
The interactive verification system VeriFun is based on a polymorphic call-by-value functional language and on a first-order logic with initial model semantics w.r.t. constructors. It is designed to perform automatic induction proofs and can also deal with partial functions. This paper provides a reconstruction of the corresponding logic and semantics using the standard treatment of undefinedness which adapts and improves the VeriFun-logic by allowing reasoning on nonterminating expressions and functions. Equality of expressions is defined as contextual equivalence based on observing termination in all closing contexts. The reconstruction shows that several restrictions of the VeriFun framework can easily be removed, by natural generalizations: mutual recursive functions, abstractions in the data values, and formulas with arbitrary quantifier prefix can be formulated. The main results of this paper are: an extended set of deduction rules usable in VeriFun under the adapted semantics is proved to be correct, i.e. they respect the observational equivalence in all extensions of a program. We also show that certain classes of theorems are conservative under extensions, like universally quantified equations. Also other special classes of theorems are analyzed for conservativity.

The reconstruction also allows several generalizations of the functional language like mutual recursive functions and abstractions in the data values. The main results are: Correctness of several program transformations for all extensions of a program, which have a potential usage in a deduction system. We also proved that universally quantified equations are conservative, i.e. if a universally quantified equation is valid w.r.t. a program P, then it remains valid if the program is extended by new functions and/or new data types.
The well-known proof of termination of reduction in simply typed calculi is adapted to a monomorphically typed lambda-calculus with case and constructors and recursive data types. The proof differs at several places from the standard proof. Perhaps it is useful and can be extended also to more complex calculi.
This paper shows the equivalence of applicative similarity and contextual approximation, and hence also of bisimilarity and contextual equivalence, in the deterministic call-by-need lambda calculus with letrec. Bisimilarity simplifies equivalence proofs in the calculus and opens a way for more convenient correctness proofs for program transformations. Although this property may be a natural one to expect, to the best of our knowledge, this paper is the first one providing a proof. The proof technique is to transfer the contextual approximation into Abramsky's lazy lambda calculus by a fully abstract and surjective translation. This also shows that the natural embedding of Abramsky's lazy lambda calculus into the call-by-need lambda calculus with letrec is an isomorphism between the respective term-models.We show that the equivalence property proven in this paper transfers to a call-by-need letrec calculus developed by Ariola and Felleisen.
Zusammenfassung und Ergebnisse Es ist noch zu früh, eine abschließende Bewertung der Entwicklung auf den Finanzmärkten während der letzten zwei Jahre vorzunehmen. In jedem Fall sind aber alle Regelungen auf den Prüfstand zu stellen. Das Aufsichtsrecht hat insgesamt seine Aufgabe, Finanzstabilität zu gewährleisten, nicht erfüllt. Wesentliche Schritte für eine grundlegende Reform sind: - ein striktes Verständnis des Aufsichtsrechts als Sonderordnungsrecht - eine drastische Reduktion der Komplexität der Rechtsvorschriften - die Internationalisierung und Europäisierung der Aufsicht - die Steigerung der Transparenz der Verbriefung einschließlich eines möglichen Zulassungsverfahrens und des Verbots bestimmter gefährlicher „Produkte“ - die vollständige Neuausrichtung der Bewertung von Finanzunternehmen und ihrer „Produkte“ („ratings“) - Die Schaffung geeigneter Regeln und Verfahren, um auch systemisch relevante Institutionen der Marktdisziplin, also ihrem Untergang, auszusetzen - Die Grundlage für kurzfristige Entscheidung über Fortführung, Zerlegung oder Abwicklung eines Instituts als Maßnahme der Gefahrenabwehr muss geschaffen werden. Ein Sonderinsolvenzrecht für Banken ist nicht angezeigt - Die Einbeziehung des menschlichen Verhaltens und der Persönlichkeitsstruktur der maßgebenden Personen in den Finanzinstitutionen

Somit ist dieser Begriff einer der Grundprämissen, die in der Vorstellung eines „internationalen Systems“ zum Ausdruck kommt, in dem „souveräne“ Akteure in Beziehungen zu anderen „souveränen“ Akteuren treten – also „Außenpolitik“ betreiben. This paper investigates the accuracy and heterogeneity of output growth and inflation forecasts during the current and the four preceding NBER-dated U.S. recessions. We generate forecasts from six different models of the U.S. economy and compare them to professional forecasts from the Federal Reserve’s Greenbook and the Survey of Professional Forecasters (SPF). The model parameters and model forecasts are derived from historical data vintages so as to ensure comparability to historical forecasts by professionals. The mean model forecast comes surprisingly close to the mean SPF and Greenbook forecasts in terms of accuracy even though the models only make use of a small number of data series. Model forecasts compare particularly well to professional forecasts at a horizon of three to four quarters and during recoveries. The extent of forecast heterogeneity is similar for model and professional forecasts but varies substantially over time. Thus, forecast heterogeneity constitutes a potentially important source of economic fluctuations. While the particular reasons for diversity in professional forecasts are not observable, the diversity in model forecasts can be traced to different modeling assumptions, information sets and parameter estimates. The first part of the following paper deals with varying points of criticism forwarded against Ordoliberalism. Here, it is not the aim to directly falsify each argument on its own; rather, the author tries to give a precise overview of the spectrum of critique. The second section picks out one argument of critical review – namely that the ordoliberal concept of the state is somewhat elitist and grounded on intellectual experts. Based on the previous sections, the final part differentiates two kinds of genesis of norms: an evolutionary and an elitist one – both (latently) present within Ordoliberalism. In combination with the two-level differentiation between individual and regulatory ethics, the essay allows for a distinction between individual-ethical norms based on an evolutionary genesis of norms and regulatory-ethical norms based on an elitist understanding of norms. A by-product of the author’s argument is a (further) demarcation within neoliberalism.

Over the past few decades, changes in market conditions such as globalisation and deregulation of financial markets as well as product innovation and technical advancements have induced financial institutions to expand their business activities beyond their traditional boundaries and to engage in cross-sectoral operations. As combining different sectoral businesses offers opportunities for operational synergies and diversification benefits, financial groups comprising banks, insurance undertakings and/or investment firms, usually referred to as financial conglomerates, have rapidly emerged, providing a wide range of services and products in distinct financial sectors and oftentimes in different geographic locations. In the European Union (EU), financial conglomerates have become part of the biggest and most active financial market participants in recent years. Financial conglomerates generally pose new problems for financial authorities as they can raise new risks and exacerbate existing ones. In particular, their cross-sectoral business activities can involve prudentially substantial risks such as the risk of regulatory arbitrage and contagion risk arising from intra-group transactions. Moreover, the generally large size of financial conglomerates as well as the high complexity and interconnectedness of their corporate structures and risk exposures can entail substantial systemic risk and can therefore threaten the stability of the financial system as a whole. Until a few years ago, there was no supervisory framework in place which addressed a financial conglomerate in its entirety as a group. Instead, each group entity within a financial conglomerate was subject to the supervisory rules of its pertinent sector only. Such silo supervisory approach had the drawback of not taking account of risks which arise or aggravate at the group level. It also failed to consider how the risks from different business lines within the group interrelate with each other and affect the group as a whole. In order to address this lack of group-wide prudential supervision of financial conglomerates, the European legislator adopted the Financial Conglomerates Directive 2002/87/EC8 (‘FCD’) on 16 December 2002. The FCD was transposed into national law in the member states of the EU (‘Member States’) by 11 August 2004 for application to financial years beginning on 1 January 2005 and after. The FCD primarily aims at supplementing the existing sectoral directives to address the additional risks of concentration, contagion and complexity presented by financial conglomerates. It therefore provides for a supervisory framework which is applicable in addition to the sectoral supervision. Most importantly, the FCD has introduced additional capital requirements at the conglomerate level so as to prevent the multiple use of the same capital by different group entities. This paper seeks to examine to what extent the FCD provides for an adequate capital regulation of financial conglomerates in the EU while taking into account the underlying sectoral capital requirements and the inherent risks associated with financial conglomerates. In Part 1, the definition and the basic corporate models of financial conglomerates will be presented (I), followed by an illustration of the core motives behind the phenomenon of financial conglomeration (II) and an overview of the development of the supervision over financial conglomerates in the EU (III). Part 2 begins with a brief elaboration on the role of regulatory capital (I) and gives a general overview of the EU capital requirements applicable to banks and insurance undertakings respectively. A delineation of the commonalities and differences of the banking and the insurance capital requirements will be provided (II). It continues to further examine the need for a group-wide capital regulation of financial conglomerates and analyses the adequacy of the FCD capital requirements. In this context, the technical advice rendered by the Joint Committee on Financial Conglomerates (JCFC) as well as the currently ongoing legislative reforms at the EU level will be discussed (III). The paper finally closes with a conclusion and an outlook on remaining open issues (IV).
Die fragmentierte Verrechtlichung des internationalen Raums, die Proliferation von Regelungsarrangements jenseits des Staates und die Diffusion globaler Normen sowie die daraus resultierenden Geltungs-, Kompetenz- und Autoritätskonflikte sind seit geraumer Zeit ein in der sozialwissenschaftlichen Literatur viel diskutiertes Phänomen. Überlappungen von nationalen Regierungssystemen und von im Völkerrecht verankerten klassischen internationalen Regimen existieren seit der Schaffung des Westfälischen Staatensystems.In jüngerer Zeit verstärkte sich der Pluralismus normativer Ordnungen jedoch global durch neuartige Typen von Regelungsarrangements jenseits des Staates. Auch unter den zwischenstaatlich geschaffenen internationalen Institutionen finden sich solche, die autonome Handlungs- und Entscheidungskompetenzen zugesprochen bekommen haben und diese als Akteure mit eigener Subjektivität ausüben. Hinzu kommt eine immer stärkere Aufnahme von „behind the border issues“ in den Aufgabenkatalog dieser Regime und Organisationen (Zürn 2004). Diese Entwicklungen führen zu einem neuen Grad an Kontestation und Umstrittenheit globaler normativer Ordnungen. Weder die Herstellung einer einheitlichen globalen normativen Ordnung noch eine Re-Nationalisierung des Rechts erscheinen heute als realistische Zukunftsprognosen. Umso wichtiger ist es daher, sich mit den Auswirkungen dieses Pluralismus’ normativer Ordnungen zu beschäftigen.
Mit umfassenden rechtlichen Regelungen zur Zulassung und Anwendung von chemischen Pflanzenschutzmitteln wurde in Deutschland schon früh versucht, diesen Risiken zu begegnen. Nicht zuletzt in den aktuellen Debatten um Pestizidrückstände in Obst und Gemüse wurde aber auch immer wieder deutlich, dass sich der Zielkonflikt zwischen Anwendungsinteressen und Schutzanforderungen rechtlich nicht vollständig lösen lässt. Im Zentrum des vom Bundesministerium für Bildung und Forschung geförderten, transdisziplinären Projekts start2 stand daher die Frage: Wie können ergänzend zu rechtlichen Maßnahmen bei der Zulassung Risiken als Folge der bestimmungsgemäßen Anwendung von Pflanzenschutzmitteln weiter und nachhaltig vermindert werden?
Die vorliegende Handreichung gibt konkrete Antworten auf diese Frage. Im Zentrum steht dabei der Ansatz, Risikominderung mehr als bisher in gemeinsamer Verantwortung aller beteiligten gesellschaftlichen Akteure zu betreiben. Damit dies gelingt, muss den einzelnen Akteuren nicht nur aufgezeigt werden, welche Möglichkeiten sie haben, durch ihr Handeln einen wirksamen Beitrag zu dieser Aufgabe zu leisten. Die Handlungsmöglichkeiten der verschiedenen Akteure sollten sich überdies zu einer wirksamen Gesamtstrategie verbinden lassen. start2 hat zu diesem Zweck drei Handlungsfelder untersucht, deren Zuschnitt sich am Lebenszyklus eines Pflanzenschutzmittels ausrichtet: „Entwicklung von Pflanzenschutzmittelwirkstoffen“, "Landwirtschaftliche Pflanzenschutzpraxis“ und „Gewässer und Trinkwasserschutz“.
Die Handreichung richtet sich an Entscheidungsträgerinnen und Entscheidungsträger in Betrieben, Organisationen, Verwaltung und Politik (siehe auch den Lesehinweis auf der folgenden Seite). Sie gibt Informationen und konkrete Empfehlungen, wo neue Handlungsmöglichkeiten ansetzen und wo in der Praxis bereits umgesetzte Maßnahmen weiterentwickelt werden können. In einzelnen Fällen sind die vorgeschlagenen Handlungsmöglichkeiten zur Risikominderung auf den besseren Umgang mit besonders gefährlichen Stoffen zugeschnitten. All of the papers in the volume except one (Kaji) take up some aspect of relative clause construction in some Bantu language. Kaji’s paper aims to account for how Tooro (J12; western Uganda) lost phonological tone through a comparative study of the tone systems of other western Uganda Bantu languages. The other papers examine a range of ways of forming relative clauses, often including non-restrictive relatives and clefts, in a wide range of languages representing a variety of prosodic systems.
