Sammlung zwischenstaatlicher Vereinbarungen, landesrechtlicher Ausführungsverordnungen und sonstiger wichtiger Urkunden über die Rheinschiffahrt seit 1803, veranstaltet von der Zentralkommissionfür die Rheinschiffahrt mit Zustimmung der Regierungen von Baden, Bayern, Elsass-Lothringen, Hessen, Niederland und Preußen. I. Teil (1803-1860) Nr. 1-300, II. Teil (1860-1918) Nr. 301-670. s'Gravenhaage, Martinus Nijhoff, München, Dunker u. Humblot, 1918 (in zwei Sprachen: deutsch und holländisch).
Der jeweilige Betrugsbegriff kristallisiert sich in der Interpretation des § 263 StGB. Obwohl die Vorschrift seit 1875 existiert, hat sich ihre Interpretation von Epoche zu Epoche und in einer Reihe von Aspekten geändert. Die sich so entwickelten Betrugsbegriffe sind nicht frei von Vagheit und Widersprüchen.
Mittels einer Analyse der Rechtsprechung des Reichsgerichts und des Bundesgerichtshofs zwischen 1879 und 1979 arbeite ich heraus, welche ökonomischen und gesellschaftlichen Entwicklungen und Tendenzen die sich verändernden Betrugsbegriffe bestimmen. Dabei werden nicht nur juristische Argumente analysiert, die Urteilsgründe, sondern auch die Sachverhaltsdarstellungen mit Blick auf die gesellschaftlichen und ökonomischen Positionen der Beteiligten und Betroffenen und ihrer Beziehungen. So können auch latente Aspekte der Begriffe aufgefunden und explizit gemacht werden. Es wird gezeigt, dass einige Formen von Täuschung und Manipulation, im wesentlichen durch Werbung, aus dem Betrugsbegriff ausgenommen werden ebenso wie einige Formen von Vermögensbeschädigung, während auf der anderen Seite Schäden einbezogen werden, die nicht wirklich Vermögensschäden sind
Es wird auch gezeigt, dass der Wandel des politischen Regimes die Rechtsprechung und ihren Betrugsbegriff beeinflusst.
Die Analyse wird mittels qualitativer und quantitativer Inhaltsanalyse vorgenommen. Außerdem entwickle ich einen Betrugsbegriff der mit einer konstitutionellen Demokratie eher vereinbar ist. Die Untersuchung wurde zwischen 1981 und 1983 vorgenommen, das Buch 1985 veröffentlicht, was hier unverändert herausgegeben wird.

Anders als das Grundgesetz enthält der EWG-Vertrag Bestimmungen zum Schutz der Umwelt und ermächtigt die Gemeinschaft zum Erlaß eigenen Umweltrechts. Der Jurist Thomas Schräer erläutert, daß aber aufgrund der Rechtsprechung des Europäischen Gerichtshofs die Gefahr besteht, daß die Umweltpolitik das Nachsehen gegenüber der Rechtsangleichung hat, die notwendig ist, um bis Ende 1992 den EG-Binnenmarkt zu verwirklichen. Es wird auch die Möglichkeit eingeschränkt, im Alleingang strengeres nationales Umweltrecht anzuwenden. Schröer entwickelt ein Modell zur Abgrenzung der vertraglichen Gesetzgebungsermächtigungen, das beiden Anliegen Rechnung zu tragen versucht.

Ich setze voraus, dass Erfordernisse auf Wissenschaft beinhalten: (1) nicht-physische Ursachen für physische Wirkungen auszuschließen; (2) auch unbewiesene Annahmen und ungeprüfte Dogmen auszuschließen; (3) politisch autonom zu sein; (4) sich auf eine methodische Grundlage zu stützen und (5) im Rahmen der sog. vertikalen Konzeptintegration' zu arbeiten. Ich zeige, dass Strafrechtsdogmatik und Kriminologie, wenn sie Gesellschaft, Recht und die Verbindungen zwischen ihnen beschreiben, Subjekte behaupten, die es nicht gibt. Sie entkleiden Objekte ihrer natürlichen Qualitäten und schreiben ihnen außernatürliche Qualitäten zu. Außerdem behaupten sie Mittel im Kontext dieser Subjekt-Objekt-Beziehungen, die magisch sind, weil ihnen nachvollziehbare natürliche Wirkungen fehlen.
Fragen der Aneignung und Effektivität von Normen haben sich zu wesentlichen erkenntnisleitenden Perspektiven der rechtshistorischen Forschung zur Frühen Neuzeit entwickelt. Es ist dabei deutlich geworden, dass sich die Diskrepanz von zentraler Normsetzung und deren lokaler Umsetzung nicht als bloßes Vollzugsdefizit, sondern vor allem als Folge einer besonderen kulturellen Praxis begreifen lässt, die unserem an Gesetzesvollzug und Kodifikation geschultem Denken fremd ist. Im Zusammenhang damit kommt den Rechtsgewohnheiten eine besondere Bedeutung zu. Sie lassen sich nicht einfach als »Gewohnheitsrecht« in das moderne Rechtsquellensystem einpassen, sondern stellen ein anderes Prinzip der Rechtsfindung dar, mit dem Umstände des Einzelfalls erfasst und die neben der juristischen liegende soziale Normebene einbezogen werden konnte. ...
Die deutsche Debatte um die Geschworenengerichte mit ihren Höhepunkten im Vormärz sowie nach der Reichsgründung von 1871 gehört zu den besonders interessanten wissenschaftlichen und politischen Auseinandersetzungen. Sie ist ein Fenster zur Rechts- und Verfassungsgeschichte des 19. Jahrhunderts, aber auch wissenschaftsgeschichtlich eine Fundgrube für die Vermengung rechtshistorischer Erkenntnisinteressen mit politischen Nebenabsichten. ...

In seiner Münchener Habilitationsschrift untersucht der Historiker Johannes Merz die Herrschaftskonflikte zwischen den Würzburger Fürstbischöfen und ihren Nachbarn, den Markgrafen von Brandenburg-Ansbach, den Fürstäbten von Fulda und den Kurfürsten von Mainz. Er untersucht die knapp fünfzig Jahre Regierungszeit der beiden Würzburger Bischöfe Rudolf von Scherenberg (1466–1495) und Lorenz von Bibra (1495–1519). Merz charakterisiert diesen Zeitraum als eine Zwischenepoche zwischen den militärischen Auseinandersetzungen vor 1470, in denen ein "offene[r] Kampf um die politische Vorherrschaft" geführt wird (46), und den Auswirkungen der Reformation auf das politische Gefüge Frankens. Nach jahrzehntelangem fruchtlosen Ringen in "Grundsatzopposition" (48) hätten die Konfliktparteien sich um friedliche und pragmatische Konfliktlösungen bemüht; lange und geduldige Verhandlungen über Einzelfragen seien für die untersuchte Epoche prägend gewesen. Solche Verhandlungen haben vor allem in Würzburg reichen archivalischen Niederschlag gefunden. In erster Linie stützt Merz seine Arbeit auf die sogenannten Gebrechenbücher der Würzburger Kanzlei, Kopialbücher, in denen seit dem 14. Jahrhundert Verhandlungsprotokolle, Briefe und Verträge der Würzburger Fürstbischöfe mit ihren Nachbarn in seltener Dichte zusammengestellt sind. Allein schon die Präsentation dieser äußerst umfangreichen und inhaltsreichen, bislang in der Forschung vernachlässigten Quellengruppe ist dankenswert ...
