Der Deutsche Juristentag 2012 ließ begutachten, wie der Wettbewerb in der Gesetzlichen Krankenversicherung zu regeln sei. Der vorliegende Beitrag ist als Begleitaufsatz hierzu erschienen. Er spürt den Motiven des Gesetzgebers und den theoretischen und konzeptionellen Gründen für Wettbewerb nach, um daraus Antworten auf die Frage nach der Wettbewerbsregulierung im Gesundheitswesen zu entwickeln. Sein Ergebnis ist, dass die spezifische Funktion von Wettbewerb innerhalb des sozialrechtlichen Krankenversicherungssystems ein spezifisches Regulierungsrecht erfordert. Dies ist gegenüber einer generellen Zuordnung dieses Sozialsystems zum allgemeinen Wettbewerbs- und Kartellrecht vorzugswürdig. Außerdem wird die Zuordnung zu den Sozialgerichten befürwortet.
Im Jahr 2005 entschied das Bundesverfassungsgericht, dass die bestehenden Regelungen im Versicherungsvertrags- und Versicherungsaufsichtsgesetz zur Überschussbeteiligung in der Lebensversicherung den Anforderungen des Grundgesetzes nicht genügen. Denn sie sicherten die Ansprüche der Versicherten nicht angemessen gegen einseitige Gestaltungsmöglichkeiten der Versicherer ab. Nach dem Urteil änderte der Gesetzgeber die einschlägigen Regelungen, insbesondere erließ die Bundesanstalt für Finanzdienstdienstleistungsaufsicht BAFin eine neue Mindestzuführungsverordnung. Der Beitrag untersucht die Rechtslage auf dem Stand von April 2012 daraufhin, ob nun den Anforderungen des Bundesverfassungsgerichts genüge getan wird. Er kommt zu dem Ergebnis, dass dies nicht der Fall ist.
From the late middle ages to early modern times (ca. 1200-1600) the Lübeck City Council was the most important courthouse in the Baltic. About 100 cities and towns on its shores lived according to the law of Lübeck. The paper deals with the old theory that Imperial law, i.e. mainly the learned Ius commune, was generally rejected by the council on the grounds of its foreign nature. The paper rejects this view with the help of 8 case studies. There exist rather spectacular statements against Imperial Law, but a closer look reveals that they have to be seen in the light of a specific practical context. They must not be confounded with general statements in which the council had no interest. Its attitude towards Learned Law was flexible and purely pragmatic.
This country report was prepared for the 19th World Congress of the International Academy of Comparative Law in Vienna in 2014. It is structured as a questionnaire and provides an overview of the legal framework for Free and Open Source Software (FOSS) and other alternative license models like (e.g.) Creative Commons under German law. The first set of questions addresses the applicable statutory provisions and the reported case law in this area. The second section concerns contractual issues, in particular with regard to the interpretation and validity of open content licenses. The third section deals with copyright aspects of open content models, for example regarding revocation rights and rights to equitable remuneration. The final set of questions pertains to patent, trademark and competition law issues of open content licenses.
Even though fiscal sovereignty still counts as a fundamental principle of government, global and regional economic integration as well as increasing levels of sovereign debt severely limit governments’ tax policy choices. In particular the redistributive function of taxation has suffered in the pursuit of economic competitiveness. As inequality rises and attention is directed again at taxation as a means for redistribution, international cooperation appears as an avenue to enable redistribution through taxation. Yet, one of the predominant international institutions dealing with tax matters – the OECD – with its focus on economic growth and competitiveness and resulting tax policy advice prevents rather than promotes national and international debates on taxation as a question of social justice. The paper argues that questions of taxation need to be perceived as questions of social justice and thus as questions of politics, and not merely of economics. Only if taxation is not considered a mere economic instrument can a ‘political economy’ be maintained. The paper addresses the three objectives of taxation – revenue generation, redistribution and regulation -- and how they are affected as governments aim for fiscal consolidation to conclude that governments’ power to freely pursue and calibrate these objectives has come to appear rather as a myth than the core of sovereignty. It then demonstrates how the OECD’s tax policy advice and cooperation in tax matters react to the constraints on governmental taxation powers; how they aim at economic growth and competitiveness to the detriment of (other) ideas of social justice. The paper concludes with a call for (re)integrating social and global justice concerns into debates on taxation.
How special are they? - Targeting systemic risk by regulating shadow banking : (October 5, 2014)

This essay argues that at least some of the financial stability concerns associated with shadow banking can be addressed by an approach to financial regulation that imports its functional foundations more vigorously into the interpretation and implementation of existing rules. It shows that the general policy goals of prudential banking regulation remain constant over time despite dramatic transformations in the financial and technological landscape. Moreover, these overarching policy goals also legitimize intervention in the shadow banking sector. On these grounds, this essay encourages a more normative construction of available rules that potentially limits both the scope for regulatory arbitrage and the need for ever more rapid updates and a constant increase in the complexity of the regulatory framework. By tying the regulatory treatment of financial innovation closely to existing prudential rules and their underlying policy rationales, the proposed approach potentially ends the socially wasteful race between hare and tortoise that signifies the relation between regulators and a highly dynamic industry. In doing so it does not generally hamper market participants’ efficient discoveries where disintermediation proves socially beneficial. Instead, it only weeds-out rent-seeking circumventions of existing rules and standards.
Altered microRNA (miRNA) expression is a hallmark of many cancer types. The combined analysis of miRNA and messenger RNA (mRNA) expression profiles is crucial to identifying links between deregulated miRNAs and oncogenic pathways. Therefore, we investigated the small non-coding (snc) transcriptomes of nine clear cell renal cell carcinomas (ccRCCs) and adjacent normal tissues for alterations in miRNA expression using a publicly available small RNA-Sequencing (sRNA-Seq) raw-dataset. We constructed a network of deregulated miRNAs and a set of differentially expressed genes publicly available from an independent study to in silico determine miRNAs that contribute to clear cell renal cell carcinogenesis. From a total of 1,672 sncRNAs, 61 were differentially expressed across all ccRCC tissue samples. Several with known implications in ccRCC development, like the upregulated miR-21-5p, miR-142-5p, as well as the downregulated miR-106a-5p, miR-135a-5p, or miR-206. Additionally, novel promising candidates like miR-3065, which i.a. targets NRP2 and FLT1, were detected in this study. Interaction network analysis revealed pivotal roles for miR-106a-5p, whose loss might contribute to the upregulation of 49 target mRNAs, miR-135a-5p (32 targets), miR-206 (28 targets), miR-363-3p (22 targets), and miR-216b (13 targets). Among these targets are the angiogenesis, metastasis, and motility promoting oncogenes c-MET, VEGFA, NRP2, and FLT1, the latter two coding for VEGFA receptors.
Aktuell wird darüber diskutiert, ob das Sexualstrafrecht noch zeitgemäß ist. Unterschiedliche Bemühungen, die Vorschrift § 177 StGB (sexuelle Nötigung; Vergewaltigung) zu reformieren, stoßen auf heftigen Widerstand. Insbesondere geht es um die Frage, ob für die Erfüllung des Tatbestandes ein fehlendes Einverständnis ausreichend sein kann und darf. Erstaunlich ist, dass bei dieser Debatte europäische und internationale Ansätze völlig ignoriert werden. Dabei ist für Deutschland nicht nur seit dem 1. August 2014 das Übereinkommen des Europarats zur Verhütung und Bekämpfung von Gewalt gegen Frauen und häuslicher Gewalt (Istanbuler Konvention) in Kraft getreten, sondern auch der Ausschuss der Frauenrechtskonvention der Vereinten Nationen (Convention on the Elimination of All Forms of Discrimination against Women – CEDAW) hat zum wiederholten Mal in der Sache R.P.B v. the Philippines zum Ausdruck gebracht, dass nicht einverständliche sexuelle Handlungen unter Strafe zu stellen sind.
The article introduces a research project financed by the Academy of Sciences and Literature Mainz began in 2013 and will extend over an 18-year period. It aims at producing a historical-semantic dictionary elucidating central terms of the School of Salamanca's discourses and their significance for modern political theory and jurisprudence. The project's fundament will be a digital corpus of important texts from the School of Salamanca which will be linked up with the dictionary's online version. By making the source corpus accessible in searchable full text (as well as in high quality digital images), the project is creating a new research tool with exciting possibilities for further investigations. The dictionary will be a valuable source of information for the interdisciplinary research carried out in this field.
Die Welt des Rechts lässt sich heute nicht mehr so leicht in nationale oder internationale Sphären ordnen. Wo Lawmaker als private Akteure in einer globalisierten Ökonomie die Normen häufig nachhaltiger bestimmen als staatliches Recht, da ändern sich auch die Anforderungen an die Rechtswissenschaft.

In this article, I review select institutional and analytical traditions of Legal History in 20th century Germany, in order to put forth some recommendations for the future development of our discipline. A careful examination of the evolution of Legal History in Germany in the last twenty-five years, in particular, reveals radical transformations in the research framework: Within the study of law, there has been a shift in the internal reference points for Legal History. While the discipline is opening up to new understandings of law and to its neighboring disciplines, its institutional position at the law departments has become precarious. Research funding is being allocated in new ways and the German academic system is witnessing ever more internal differentiation. Internationally, German contributions and analytic traditions are receiving less attention and are being marginalized as new regions enter into a global dialogue on law and its history. The German tradition of research in Legal History had for long been setting benchmarks internationally; now it has to reflect upon and react to new global knowledge systems that have emerged in light of the digital revolution and the transnationalization of legal and academic systems. If legal historians in Germany accept the challenge these changing conditions pose, thrilling new intellectual and also institutional opportunities emerge. Especially the transnationalization of law and the need for a transnational legal scholarship offers fascinating perspectives for Legal History.
Protagonist des Buches des nigerianisch-kanadischen Historikers Bonny Ibhawoh (Hamilton, Ontario) ist das Judicial Committee of the Privy Council (JCPC), das 1833 formal als letzte Appellationsinstanz für die koloniale Gerichtsbarkeit im Britischen Empire installiert wurde. Das JCPC fungierte zugleich als Beratergremium der Krone und als letztinstanzliches Gericht mit einem unklaren Status: Die Richter des JCPC sprachen keine bindenden Urteile, sondern gaben Entscheidungsempfehlungen an die Krone, welche diese in Form von Orders in Council verbindlich erließ. Bislang hatte sich die historische Forschung auf die Rolle des JCPC bei der Entwicklung des Case Law in Regionen des sog. Old Empire, d. h. Kanadas, Australiens, Neuseelands und Irlands, konzentriert. Die vorliegende Monografie rekonstruiert zum ersten Mal seine Bedeutung für die Rechtsentwicklung in den afrikanischen Kolonien, allerdings ohne die Befunde in Bezug zu den Ergebnissen der Old Empire-Forschungen zu setzen. Dagegen erhält die Analyse besondere Tiefe durch die Auswertung der reichen archivalischen Quellen des JCPC, die Ibhawoh noch in einem »staubigen Keller in der Downing Street« konsultierte (22) und die inzwischen in die National Archives in Kew überführt wurden. For centuries, it may have seemed as if standards of normative thinking now valid across the globe had first been instituted in Europe. These normative orders form the foundations of our verdicts that define and distinguish right and wrong, good and bad or even beautiful and ugly. But in order to better understand the global presence of such normative orders that evolved from within the European horizon, the history and implications of European expansion in the early modern era cannot be swept under the rug. ...
Der Begriff von den "Verfassungsvoraussetzungen" wurde von Herbert Krüger geprägt. Sie liegen in der "geistigen Grundlage" und einer "adäquaten Gestimmtheit, damit das [verfassungsrechtliche] Programm sich verwirklicht". Hier bricht sich eine pathetische Sprechweise Bahn: In diesem Sinne geht es um die Grundlagen der Verfassung und in gewisser Weise um mehr als nur das, was Recht ist. Auf dieser rhetorischen Wellenlänge sendet das sog. Böckenförde-Diktum und mit dieser Konnotation hat sich die Vereinigung der Staatsrechtslehrer im Jahr 2008 einer "Erosion von Verfassungsvoraussetzungen" angenommen. Daneben gibt es auch eine nüchtern-rechtsdogmatische Sprechweise, die zum Ausdruck bringt, dass eine Aussage keine verfassungsrechtliche Verbindlichkeit erreicht und insofern weniger ist als Recht. Unklar an der Begriffsbildung Verfassungsvoraussetzung ist bereits, ob es sich um dasjenige handelt, was von der Verfassung respektive dem Verfassungsgeber normativ vorausgesetzt wird (etwa die teloi von Normen), oder um dasjenige, was der Verfassung de facto vorausgesetzt wird. Letzteres wird bisweilen auch als "Verfassungserwartung" bezeichnet. In die pathetische Bedeutung könnte nahezu alles eingelesen werden, auf dem die Verfassung aufruht: der status quo zur Zeit der Verfassungsgebung, Wertesystem, kulturelle Wurzeln, anthropologische Grundkonstanten. Schon in diesem semantischen Spannungsfeld läuft der Begriff der Verfassungsvoraussetzung Gefahr, an Unterscheidungskraft zu verlieren. Darüber hinaus büßt er ungemein an Trennschärfe ein, wenn sogar die Akzeptanz des Rechts und der Regelungsgrund bzw. -gegenstand der Verfassung in den Begriff einbezogen werden. ...
The article aims to investigate, under the aspect of translation, the process of legal appropriation and reproduction of international law during the course of the 19th century. An occidental understanding of translation played an important role in the so-called process of universalization in the 19th century, as it made the complexity of global circulation of ideas invisible. Approaches proposed by scholars of Postcolonial, Cultural and Translation Studies are useful for re-reading histories of the circulation of European ideas, particularly the international law doctrines, from a different perspective. The great strides made in Translation and Cultural Studies in the last decades, as well as the discernment practiced in the scholarship of Postcolonial Studies, are important for a broader and more differentiated understanding of the processes of appropriation and reproduction of the doctrines of international law during the 19th century. The present article begins by tracing the connection between translation and universalization of concepts in 19th century international law; after a short excursus on the Western idea of translation, the attention is focused on the translation of international law textbooks. The conclusive section is dedicated to a comparison between Emer de Vattel’s Droit des gens and Andrés Bello’s Principios de Derecho de Jentes.
Von Inter- und Transdisziplinarität wurde und wird viel gesprochen. Die oft karikierte "Antragslyrik" zur Gewinnung von Drittmitteln lebt davon. Eine wirkliche Durchdringung verschiedener Fächer findet dagegen nur selten statt, und zwar nicht nur aus Trägheit oder mangelnder Kompetenz. Spezialisierung und entsprechende Blickverengung, Fachsprachen, unterschiedliche Arbeitsziele und -bedingungen machen den Blick über den Tellerrand tatsächlich schwer. Aber gelegentlich gelingt doch etwas. Der Öffentlichrechtler Erk Volkmar Heyen, Emeritus der Universität Greifswald, hatte sich vorgenommen, die europäische Malerei daraufhin zu mustern, ob sich in ihr Motive finden, die sich auf gute und schlechte Politik, weltlichen und religiösen Staat, Verwaltung, Städte, Freiheit und Zwang, Wohlfahrt und Fürsorge, Juristen und anderes Staatspersonal beziehen, kurzum auf alles, was ein Gemeinwesen oder einen Staat ausmacht. Er hat dies, wenn auch mit vielen dankbar genannten Helfern, im Alleingang realisiert und auf diese Weise Interdisziplinarität wirklich praktiziert. ...
Post 9/11 haben Forschungen zur Geschichte des "Terrorismus" weltweit Konjunktur. Kaum eine neuere Überblicksdarstellung zur Geschichte der politischen Gewalt und der Staatsverbrechen kommt ohne "Terrorismus" und den Referenzpunkt "9/11" aus, darunter die auf einer älteren Monographie basierende, 2012 publizierte und auf den universitären Unterricht bzw. ein breiteres Lesepublikum zielende Introduction to Political Crime von Jeffrey Ian Ross, der 2011 erschienene historische Überblick über die Geschichte der Crimes Against the State. From Treason to Terrorism von Michael Head oder die von mehreren französischen Autoren 2010 verfasste Darstellung historischer Terrorismusphänomene Terrorismes: Histoire et Droit. Im Gegensatz zu älteren Darstellungen erscheint "Terrorismus" inzwischen als zentraler Zugang zur Geschichte politischer Gewalt, auch im Hinblick auf die grenzübergreifenden und internationalen Dimensionen sowie die rechtlichen und polizeilichen Gegenmaßnahmen des counter-terrorism. Allerdings konzentrieren sich die historische Forschung wie die Politik- und Rechtswissenschaft auf den modernen zeitgenössischen "Terrorismus" seit dem Ersten Weltkrieg und diskutieren Erscheinungsformen, Ursachen sowie Strategien zu dessen Bekämpfung und Bewältigung. Nur wenige der in den letzten Jahren erschienenen, teils auch neu aufgelegten Gesamtdarstellungen gehen zeitlich weiter zurück und beziehen die Zeit nach der Etablierung des "Terrorismusbegriffs" durch die Französische Revolution mit ein oder greifen gar bis zur Antike aus. So beginnt Randall D. Law seine 2009 publizierte Geschichte des Terrorismus mit dem Kapitel Terror and Tyrannicide in the Ancient World, gefolgt von Abschnitten über das Mittelalter und die Frühe Neuzeit. Antike und Mittelalter nur kurz streifend, sucht Martin A. Miller dagegen die Foundations of Modern Terrorism in der politischen Gewalt des frühneuzeitlichen Europa, deren Ursprünge er insbesondere in den konfessionellen Konflikten verortet. ...
