L’arrêt Lüth – 50 ans après

Même 50 ans plus tard, l’arrêt Lüth, rendu par la Cour constitutionnelle fédérale le 15 janvier 1958, n’a rien perdu de son actualité. Il confère durablement à la liberté d’expression un rang primordial pour le débat public démocratique et marque le point de départ du développement d’une dogmatique des droits fondamentaux spécifiquement allemande, à l’origine d’un renforcement des compétences et de la puissance particulières de la Cour constitutionnelle fédérale. Les raisons qui expliquent l’approche particulière de résolution de conflits entre droits suivie dans l’arrêt Lüth ne laissent pas présager un abandon de cette jurisprudence, abandon qui ne serait d’ailleurs ni souhaitable ni réaliste.
Das Oberverwaltungsgericht für Nordrhein-Westfalen hat am 19. März eine für die rechtsstaatliche Prägung deutscher Außenpolitik sehr bedeutsame Entscheidung getroffen. Demnach muss sich die Bundesrepublik in Zukunft vergewissern, ob durch den Einsatz von US-Drohnen, die über deutsches Gebiet gesteuert werden, Völkerrecht verletzt wird. Ist dies der Fall, muss sie Maßnahmen treffen, damit eine solche Rechtsverletzung unterbleibt. Ein einfaches Wegducken der Bundesrepublik ist damit nicht mehr möglich. ...
Eine wichtige Facette des Wirkens von Ernst-Wolfgang Böckenförde ist die Entfaltung des freiheitlichen Charakters des Grundgesetzes. Sein zentrales Anliegen war es, Freiheitlichkeit nicht nur auf Angehörige des Mainstream zu beschränken, sondern auch die Freiheit der Andersdenkenden zu schützen. Gerade in den 1960er und 1970er Jahren war diese konsequente Liberalität von kaum zu unterschätzender Bedeutung, denn es gab nicht viele, die sich in diesem Sinne äußerten. Damals war die Staatsrechtslehre äußerst konservativ. Schon der SPD anzugehören, war eine große Ausnahme. Das Recht, auch das Verfassungsrecht, wurde häufig geradezu als Bollwerk gegen die Ideen der 1968er-Revolution eingesetzt.
Doch der Beitrag von Ernst-Wolfgang Böckenförde hat nicht nur historische Bedeutung. Das von ihm entwickelte liberale Fundament ist aktueller denn je: In den Debatten um den Umgang mit religiösen Minderheiten ist seine konsequent liberale Haltung von höchster Relevanz. Er selbst hat seinen Ansatz noch in die Debatten um das Kopftuch der muslimischen Lehrerin eingebracht und im Sinne der Liberalität Position bezogen.
Seit Montag hat sich der dringende Verdacht erhärtet, dass der CDU-Politiker und nordhessische Regierungspräsident Walter Lübcke durch einen neonazistischen Täter ermordet worden sein soll. Der mutmaßliche Täter war laut antifaschistischen Recherchen lange Jahre in der extrem rechten Szene rund um Kassel aktiv und eng vernetzt. Die Ermittlungen sind noch im Gange, aber schon gibt es eine Debatte darüber, ob Stephan E. als Einzeltäter gehandelt haben könnte oder es Unterstützer gegeben hat. In der jüngeren Vergangenheit wurden rechtsterroristische Attentate mitunter als "Amokläufe" von Einzelnen verharmlost, wodurch gleichsam die ideologischen Zusammenhänge solcher Taten negiert werden. Unabhängig vom Fall Lübcke ist jedoch die Frage nach einer vermeintlichen Einzeltäterschaft bereits falsch gestellt. ...
The purpose of this thesis is to examine the passage regime of the Turkish Straits against the background of the evolution of international law, and to discuss the problems of the passage of warships through them in light of the invasion of the Crimean Peninsula by Russia in 2014. With that objective in mind, the thesis reconsiders the history of the straits regime.
The Turkish Straits are regulated by the Montreux Convention of 1936 which contains restrictive and complex provisions regarding the passage of warships. The Straits took their place as “the Straits question” for centuries and today their importance is enhanced by their geostrategic location in the international arena. They have gained greater significance especially since the resolution of Soviet Russia in 1991, as they have become one of the most important and busiest energy corridors of the world. Due to the increase in the transportation of oil, natural gas and other products from the Caspian region through the Straits, the dense traffic and the regulation of the traffic in the Straits has become a key issue between Turkey and user states. Furthermore, the implementation of restrictive provisions for warships caused many debates during the Second World War, the impact of the restrictive provisions of the Convention on the South Ossetia War in August 2008, and the invasion of the Crimean Peninsula in 2014 attracted additional international attention. The Straits took their place on the global agenda of the great powers, especially those of NATO, the United States (US) and Russia. These events have resulted in ongoing and intensive discussions over the revision of the Convention.
Although no legal amendment or modification demand to the Montreux Convention has yet arisen, the new order and geopolitical interests in the Black Sea region show that the Montreux passage regime will continue to be debated by the world’s powers under any given political circumstances. For the time being, however, there will be no alternative route with a view at an adaptation to contemporary needs but methods of treaty modification below the threshold of formal revision as, most importantly, the integration of subsequent practice and subsequent agreement into treaty interpretation.
Le constitutionnalisme est un phénomène relativement récent dans l’histoire des institutions politiques. Il a émergé au cours des vingt-cinq dernières années du XVIIIe siècle, à la suite de deux révolutions menées avec succès contre le pouvoir en place, la première dans les colonies anglaises d’Amérique du Nord, la seconde en France. Immédiatement perçu comme une avancée majeure, le constitutionnalisme n’a pas tardé à exercer également son pouvoir d’attraction en dehors des pays où il est apparu. Partout en Europe, et ensuite dans d’autres parties du monde, des tentatives pour mettre en place des constitutions modernes virent le jour. Tout le XIXe siècle fut traversé par les luttes pour une constitution, et le XXe siècle fut une période de sérieux revers, avant qu’au tournant du XXIe siècle, le constitutionnalisme ne finisse par accéder à une reconnaissance mondiale. De nos jours, seule une poignée d’États, parmi les quelque deux cents que compte le monde, ne possède pas de constitution. ...
