Bitcoin stands like no other cryptocurrency for the profound transformation of financial markets in the digital economy. While the last few months saw the free trade in goods struggle against trends towards protectionism, cryptocurrencies seemed to tear down one border after the other – physical, geographic, and legal ones alike. A libertarian’s wet dream. Blockchain presents itself as a fortress against state intervention, for whatever purpose. Finally, a technological, market-based solution would put an end to the problem of monetary policy, payment transactions, and make whole chunks of government regulation superfluous. ...
Nicht nur die Geräuschkulisse des Brexits absorbierte ein Stück weit die Aufmerksamkeit für das Urteil des Europäischen Gerichtshofs (EuGH) zur Zulässigkeit des Anleihenkaufprogramms der EZB. Denn immerhin entschied Luxemburg damit über eine der nach wie vor seltenen Vorlagen aus Karlsruhe. Dazu mag auch beigetragen haben, dass seit der Stellungnahme des Generalanwalts Wathelet nicht mehr damit gerechnet wurde, dass der EuGH der Europäischen Zentralbank (EZB) einen sprichwörtlichen Strich durch die Rechnung machen würde. Dennoch ist das Urteil aus einigen Gründen bemerkenswert.
It seems that the BVerfG has learned a lesson. Yesterday’s referral about the the European Central Bank’s policy of Quantitative Easing (QE) sets a completely different tone. It reads like a modest and balanced plea for judicial dialogue, rather than an indictment. Fifty years after the original event, a new Summer of Love seems to thrive between the highest judicial bodies. It shows no traces of the aplomb with which Karlsruhe presented its stance to Luxembourg three years ago.

Die hochproblematische Verfassungsreform in der Türkei führt innerhalb der EU zu ungewöhnlichen Allianzen: In seltener Einmütigkeit wird länderübergreifend von ganz rechts bis weit ins linke politische Spektrum hinein ein Auftrittsverbot für türkische Politiker gefordert. Das gefühlt häufigste Argument bemüht dabei die Souveränität: Man möchte die Kampagne der türkischen Regierung für ihre die Gewaltenteilung gefährdende Verfassungsreform nicht auch noch im eigenen Land haben. In einer pluralistischen Gesellschaft weckt solche Einmütigkeit Zweifel, die sich bei näherem Hinschauen verfestigen – und zwar in juristischer wie politischer Hinsicht.
This article reports the results of a replication of Bobbitt-Zeher’s 2007 article "The Gender Income Gap and the Role of Education". Models that emulate the original specifications (by and large) reproduce the original results. However, models that adhere to Bobbitt-Zeher’s theory concerning the gendered effect of family formation call into question her finding that "values appear to matter only modestly, while family formation has virtually no effect on the income gap".
Wallonien lässt die westliche Welt zappeln – und wird dafür je nach politischem Standpunkt des Betrachters als einzig aufrechtes gallisches Dorf besungen oder als eigennützige Erpresserbande geschmäht. Stutzig macht jedoch die prompte Reaktion, man hätte CETA besser doch nicht als "gemischtes Abkommen" einstufen sollen, sondern als Abkommen zwischen der EU und Kanada ohne direkte Beteiligung der Mitgliedstaaten. Diese Reaktion zeugt von Demokratieverachtung.
Spätestens seit die Europäische Zentralbank (EZB) ihr Ankaufprogramm für Wertpapiere bekannt gegeben hat, ist die Diskussion über die Wirksamkeit dieser Maßnahmen auch in Europa angekommen. Wegen der besonderen institutionellen Umstände des Euroraums – Kauf von Anleihen der einzelnen Nationalstaaten und des Verbots der monetären Finanzierung – reichen die möglichen Nebenwirkungen hierzulande über den rein geldpolitischen Horizont hinaus.
In a political and economic perspective, the recent ECJ judgment on the OMT program is not more than a footnote, a short sideshow in a seemingly never-ending sequel of another dimension. Legally, however, I find the case quite remarkable. Unlike its Advocate General, the ECJ did not yield to the temptation to respond in kind to the FCC’s provocations. In particular, it avoids the issue of domestic vs. European constitutional identity that juxtaposed the FCC and the Advocate General. Instead, the ECJ has shown political responsibility and legal foresight in framing what could become a masterpiece of truly cooperative, other-regarding constitutional pluralism.

ESM restrukturieren, beruht auf einem Denkfehler, wenn nicht gar auf einem Taschenspielertrick. Die Pringle-Rechtsprechung des EuGH zeigt: Das Europarecht schaufelt sich nicht sein eigenes Grab. Man muss es nicht erst umgehen, um die Ziele der Union wahrhaft zu verwirklichen.
Two alternative hypotheses – referred to as opportunity- and stigma-based behavior – suggest that the magnitude of the link between unemployment and crime also depends on preexisting local crime levels. In order to analyze conjectured nonlinearities between both variables, we use quantile regressions applied to German district panel data. While both conventional OLS and quantile regressions confirm the positive link between unemployment and crime for property crimes, results for assault differ with respect to the method of estimation. Whereas conventional mean regressions do not show any significant effect (which would confirm the usual result found for violent crimes in the literature), quantile regression reveals that size and importance of the relationship are conditional on the crime rate. The partial effect is significantly positive for moderately low and median quantiles of local assault rates.
We highlight the implications of combining underwriting services and lending for the choice of underwriters and for competition in the underwriting business. We show that cross-selling can increase underwriters’ incentives, and we explain three phenomena: first, that cross-selling is important for universal banks to enter the investment banking business; second, that cross-selling is particularly attractive for highly leveraged borrowers; third, that less-than-market rates are no prerequisite for cross-selling to benefit a bank’s clients. In our model, cross-selling reduces rents in the underwriting business.
