Sobre la libertad política

Este artículo presenta un argumento en favor de un concepción intersubjetivista de la libertad política constituida por cinco diferentes nociones de autonomía: moral, ética, legal, política y social. Más allá de las nociones estrictamente liberales o comunitarias, negativas o positivas, el concepto de libertad política incluye todas aquellas libertades que los ciudadanos, en tanto continentes y usuarios autónomos de la libertad, pueden conceder y garantizar de forma recíproca y general. Así, en la base de este concepto reposa un principio de justiticación moral y política.

In their study on "The modern anthropology of Southeast Asia", Victor King and William Wilder raise the question in how far the region can be taken as a field of anthropological enquiry. After their initial discussion of cultural and social trends as well as anthropological studies, they conclude that the common issue of the region is its diversity. They come to the rather pragmatic solution that "South-East Asia constitutes a convenient unit of study, ... but ... we should not think of it in terms of a bounded, unified and homogenous socio-cultural area" (King/Wilder 2003: 24). We doubt that there are homogenous socio-cultural areas anywhere else. These are usually constructed through the invention of traditions and ideological simulations. The interesting case with regards to Southeast Asia is, why no such homogeneity has been constructed, not even by anthropologists or sociologists. ...
Im Jahre 1837 erschien Andersens Märchen von des Kaisers neuen Kleidern. Dramaturgischer Höhepunkt ist ein Tabubruch. Der eitle Kaiser, der sich prachtvoll gewandet glaubt, ist nackt, und jetzt plötzlich wird es gesagt. In der Folge finden sich alle irgendwie befreit. Ein Jahrzehnt später – kein Märchen, sondern Rechtsgeschichte – spricht Julius Herrmann Kirchmann über die Wertlosigkeit der Jurisprudenz als Wissenschaft und über die drei berichtigenden Worte des Gesetzgebers, die ganze Bibliotheken zur Makulatur werden lassen. Eine berühmte Rede, ein berühmter Tabubruch, wer wollte das bezweifeln, aber ob sich alle befreit fühlten, wird man bezweifeln dürfen. Seither steht die Wissenschaftlichkeit der Jurisprudenz in Rede, und bis in die Jetztzeit hinein stellt Kirchmanns Offenbarung eine gute Anschlussmöglichkeit für entsprechende wissenschaftstheoretische Bilanzen dar. ...
Os limites da tolerância

Este artigo apresenta os elementos constitutivos do conceito de tolerância e discute duas concepções diferentes do termo, como permissão e como respeito moral, que expressam modos diversos de demarcar os limites da tolerância. A tolerância é apresentada como um conceito que, para ganhar algum conteúdo, depende normativamente de um direito à justificação baseado na idéia de um uso público da razão segundo o qual as práticas e as instituições político-jurídicas que determinam a vida social dos cidadãos devem ser justificáveis à luz de normas que eles não podem recíproca e genericamente rejeitar.
The concept of embeddedness plays a central role in the segment of economic sociology and social theory which is inspired by the works of Karl Polanyi. But to the extent that embeddedness is understood in a substantialist manner, implying the existence of a unitary lifeworld, the desire for embeddedness is an impossible aspiration under modern conditions. Throughout the modern era it is however possible to observe the emergence of complex societal stabilization mechanisms, which serve as substitutes to traditional forms of embeddedness. The emergence of function specific cultures, in the form of, for example, legal, political and scientific cultures, establishing a ‘second nature’ in the Hegelian sense, is one example of this. Other examples are (neo-)corporatist institutions which fulfilled a central stabilising role in classical modernity and the kind of network based governance arrangements which fulfil a similar position in today’s radicalised modernity.
The aim of the following paper is to examine the complementarities (and divergences) between the paleoliberal Adam Smith and the ordoliberal Walter Eucken. Following the hypothesis that Smith is among the forerunners and predecessors of Ordoliberalism and Social Market Economy, we try to provide the reader with an insight into the socio-political philosophy of Smith and Eucken pointing at similarities and differences alike. Therefore, we base our examination on a systematic primary source text analysis comparing the books and essays written by Eucken and Smith. The paper tackles these questions in two main steps: The first part highlights Smith's and Eucken's complex and interdependent system of natural liberty. The second section reviews Smith's and Eucken's philosophy of the state.
