Grégoire Bigot, Rechtshistoriker an der Universität Nantes, ist wie Pierre-Laurent Frier und François Burdeau, denen er beiden verbunden ist, Spezialist für die Geschichte der französischen Verwaltung und des Verwaltungsrechts vor allem des 19. und 20. Jahrhunderts. Seine beiden Bände "L’Administration française" sind heute das maßgebende Handbuch für die Zeit bis 1944 – ein dritter Band wird erwartet. Im vorliegenden Sammelband vereint er nun acht große Artikel aus den Jahren 2000 bis 2012, die sich mit Verwaltung, Verwaltungsrecht und Verwaltungsgerichtsbarkeit von der Französischen Revolution bis zur Gegenwart befassen. In einer sehr informativen Einleitung von fast 50 Seiten werden das Forschungsfeld selbst sowie dessen Wissenschaftsgeschichte entfaltet. Die Studien sind nicht europäisch vergleichend angelegt, sondern – von kurzen Seitenblicken auf Italien und Deutschland abgesehen – ganz auf Frankreich konzentriert. ...
Circulation of legal knowledge, ideas, norms and practices has taken place throughout legal history, shaping legal experiences in different corners of the world. Over the past couple of years, approaches to the study of such circulations have changed radically. Legal historians have adopted approaches from cultural studies and transnational history in order to gain a deeper understanding of the complexities inherent in these processes. ...
Mónica García-Salmones Rovira hat ihr – mittlerweile preisgekröntes – Buch als "The Project of Positivism in International Law" betitelt. Das klingt etwas schmissig und zugleich verlockend rätselhaft. Wessen Projekt war es, wann gab es das und was ist davon zu halten? Die Verfasserin setzt keinen Untertitel dazu, der dem Leser einen erläuternden Hinweis geben könnte. Die eigentliche Überraschung ist, dass sich nach Lektüre der rund 400 Seiten beide Eindrücke sogar verstärkt haben: Das Buch-Ende wartet im Anschluss an die völkerrechtshistorische Darstellung mit einer persönlichen Positionierung der Autorin gegenüber ihrem Gegenstand auf, die eine akzentuiert kritische Haltung offenlegt und den Leser nochmals zum Nachdenken bringt. ...
The grammar of global law

Legal grammar is understood as the conceptual and linguistic foundation on which legal decisions rest – law’s meta-structure, its argumentative techniques and its systematicity. The essay distinguishes between two ways of thinking about this grammar. The first way of thinking appeals to a grammar as a stabilizing factor, maintaining the coherence of the law. The second way of thinking highlights the asymmetries of power within this structure and perceives legal grammar as the medium carrying the ideological commitments of the law. As the essay ultimately argues, both perspectives react differently to the challenges of globalization that the law is confronted with. While the debate on the grammar(s) of global law is one place where future political order is negotiated, the outcome of the debate is largely open.
The concept of freedom as non-domination that is associated with neo-republican theory provides a guiding ideal in the global, not just the domestic arena, and does so even on the assumption that there will continue to be many distinct states. It argues for a world in which states do not dominate members of their own people and, considered as a corporate body, no people is dominated by other agencies: not by other states and not, for example, by any international agency or multi-national corporation. This ideal is not only attractive in the abstract, it also supports a concrete range of sensible, if often radical international policies.
The essay, originally written in German as an introduction to a volume of collected papers, shows the influence of the Historical School of Law on legal, historical and social sciences in Germany throughout the 19th and even 20th centuries – a time span running contrary to the dominate view that sees the end of the School in the middle of the 19th century. In my view the School constitutes not only a method for developing norms of private law out of the historical materials of Roman and German-Germanic laws, but is based on a wider conception of culture, law and history that is also connected to the political positions of that time. In Savigny’s founding pamphlet, "The vocation of our time ...", two major theoretical topics for this long-lasting influence can be found: The Romantic one, which views law as a part of culture and parallel to language and custom, based on the "spirit of the people", and, on the other side, the rationality of the European tradition of Roman law, which was developed and administered by jurists. These two basic points, in part standing in contradiction to one another, form a fertile tension that provides an impulse to the intellectual discussions and new movements in jurisprudence and history analysed in the text. Realism, founded in the connection of both sciences to political and social life, builds a kind of "basso continuo" and acts as a counterbalance to the former two. And it is in this context that the works of Jacob Grimm, Puchta and Beseler, Heinrich Brunner, Georg von Below and others are analysed, in particular the works of Otto von Gierke and Max Weber. Finally, evidence is furnished that a new image of the medieval period, and its impact on law, as a centre of Western identity was outlined in the 20th century by authors like Ernst Kantorowicz, Fritz Kern, Otto Brunner and, last but not least, by Harold J. Berman (walking in the footsteps of Eugen Rosenstock- Huessy), all of whom were situated in different ways within the tradition of the broader, cultural-based Romantic view.
The article aims to sharpen the neo-republican contribution to international political thought by challenging Pettit’s view that only representative states may raise a valid claim to non-domination in their external relations. The argument proceeds in two steps: First I show that, conceptually speaking, the domination of states, whether representative or not, implies dominating the collective people at least in its fundamental, constitutive power. Secondly, the domination of states – and thus of their peoples – cannot be justified normatively in the name of promoting individual non-domination because such a compensatory rationale misconceives the notion of domination in terms of a discrete exercise of power instead of as an ongoing power relation. This speaks in favour of a more inclusive law of peoples than Pettit (just as his liberal counterpart Rawls) envisages: In order to accommodate the claim of collective peoples to non-domination it has to recognize every state as a member of the international order.
Since 1963, when the African integration project was born, regional Economic Communities (RECs) have been an indispensable part of the continent's deeper socioeconomic and political integration. More than half a century later, such regional institutions continue to evolve, keeping pace with an Africa that is transforming itself amid challenges and opportunities. RECs represent a huge potential to be the engines that drive the continent's economic growth and development as well as being vehicles through which a sense of a continental community is fostered. It is critical therefore that citizens understand the multi-faceted and bureaucratic operations of regional institutions in order to use them to advance their collective interests.
Die Inauguraldissertation „Strafrechtsdogmatische und strafprozessuale Probleme bei der Einführung und Umsetzung einer Verbandsstrafbarkeit. Untersuchung des Entwurfs eines Ge-setzes zur Einführung der strafrechtlichen Verantwortlichkeit von Unternehmen und sonstigen Verbänden“ verfasst von Frau Franziska Osterloh, LL.M., befasst sich mit der Einführung einer Verbandsstrafbarkeit. Betreut wurde die Arbeit an der Johann Wolfgang von Goethe – Universität, Frankfurt am Main, von Herrn Prof. Dr. Matthias Jahn. Anlass des aktuellen Auflebens der wissenschaftlichen Diskussion und Anknüpfungspunkt dieser Arbeit war der Entwurf eines Gesetzes zur Einführung der strafrechtlichen Verantwortlichkeit von Unter-nehmen und sonstigen Verbänden, der auf Vorschlag des nordrhein-westfälischen Justiz-ministeriums der Justizministerkonferenz der Länder im November 2013 vorgelegt wurde.
Zu Beginn wird anhand einer kurzen historischen Einführung und einer Darstellung der rechtlichen Grundlagen von Verbandstätigkeit außerhalb des (Kern-)Strafrechts aufgezeigt, dass der Verband als Rechtssubjekt weitestgehend anerkannt und verselbstständigt ist. An-schließend werden die kriminalpolitischen Argumente zur Begründung einer Verbandsstraf-barkeit in ihren wesentlichen Zügen wiedergegeben.
In dem folgenden der Arbeit untersucht die Verfasserin die strafrechtsdogmatischen Probleme der Einführung einer Verbandsstrafbarkeit. Dabei konzentrieren sich die Ausführungen auf die „klassischen“ Eckpunkte des wissenschaftlichen Diskurses, die Handlungs-, Schuld- und Straffähigkeit von Verbänden. Hierbei liegt ein Schwerpunkt auf der Auseinandersetzung mit der Frage der möglichen Schuldfähigkeit eines Verbandes. Als Ergebnis dieses Kapitels wird festgehalten, dass die bloße Zurechnung ebenso wie die selbstständige Verbandsschuld, nicht den Anforderungen des Schuldprinzips genügen kann. Der Bezug zu der natürlichen Hand-lung, die nach außen in Erscheinung tritt, ist mit Hilfe einer Zurechnung erforderlich und dann ausreichend, wenn für den Verband die Möglichkeit bestanden hätte, durch Organi-sationsstrukturen die Ausführung der Handlung zu verhindern.
Anhand dieser Ergebnisse werden die materiell-rechtlichen Aspekte des untersuchten Gesetzesentwurfs näher beleuchtet und insbesondere die in § 2 des Entwurfs enthaltenen Tatbestände, die sich stark an §§ 30, 130 OWiG anlehnen, untersucht. Die Verfasserin kommt zu dem Ergebnis, dass die Tatbestände unter Berücksichtigung einer teleologischen Aus-legung und restriktiven Handhabung nicht gegen Verfassungsrecht verstoßen.
Die Untersuchung der strafprozessualen Aspekte des Gesetzesentwurfs bezieht sich zum einen auf die übergeordneten Verfahrensprinzipien und deren im Ergebnis weitgehende An-wendbarkeit auf Verbände und zum anderen auf die konkreten Normierungen des Entwurfs. Ein Schwerpunkt wird hierbei auf die Beschuldigtenrechte gelegt, die nach Ansicht der Verfasserin noch nicht hinreichend klar normiert sind. Abschließend werden einige strafprozessuale Besonderheiten untersucht, die nicht ausdrücklich oder lediglich beiläufig von dem Gesetzesentwurf aufgefasst werden.
Als Gesamtergebnis der Arbeit wird der untersuchte Gesetzesentwurf zwar als begrüßens-werte Präzisierung und Bereicherung der Diskussion um eine Verbandsstrafbarkeit, jedoch nicht als dessen Schlusspunkt eingeordnet.
Social law is an important cornerstone of the normative constitution of the modern state, if not one the most important. The stability of market-based societies in the current era primarily resulted from both the existence of legally guaranteed provisions against the risks of life and the legal mechanisms that make the social inequalities bearable – or, at the very least, that ensure a minimum standard of living and prevent those affected from being completely excluded from social participation. Social law is, however, not just a stabilizing element for democratically constituted market societies in a normal situation. Over the course of the 20th century, it was also used to great effect by dictatorial and authoritarian regimes as a means of securing power, and it was employed more often in times of war and crisis in order to keep peace within the state, to attenuate or pacify fragile social situations, not to mention to generate social consensus. Throughout all the ups and downs of recent history, social law has remained a key element involved in the shaping of society. ...
If a report on state and perspectives of the history of social law is to be written, two problems involving demarcation have to be dealt with in advance. 1. What is social law? 2. What kind of literature has to be considered as a part of the history of social law? In both cases the boundaries can definitely be drawn in a subjective manner and can be oriented towards the interests and competences of the author insofar as the criteria are plausible. ...
Constitutionalization beyond the nation state can be observed as an evolutionary process that leads in two quite different directions: (1) constitutions evolve in transnational political processes outside the nation state; (2) simulta-neously, constitutions evolve outside international politics in global society’s ‘private’ sectors. What, however, is the specifically societal element in societal constitutionalism? This is currently the object of a controversy regarding the subjects of non-state constitutions, their origin, their legitimization, their scope, and their internal structures. This article interprets the controversy as a theme with a number of variations. What is the distinctive ‘compositional principle’ in each particular variation? Which problems become evident in its ‘development’? What are its most valuable ‘motifs’? The article starts with David Sciulli’s theme of societal constitutionalism. Then it presents six variations on Sciulli. In a first group, constitutionalization is perceived as the expansion of a single rationality into all spheres of society. In a second group, the motif of the unity of the consti-tution can still be heard, despite the essential pluralism of societal constitution-alism. In the final movement, three further variations will then reprise and devel-op further the most important motifs, in a resumption of the original theme.
Erinnern wir uns zurück: Am 11.11.2011, nur wenige Tage nach Bekanntwerden der zehnfachen Mordserie des sog. Nationalsozialistischen Untergrunds (NSU), erfolgte im Bundesamt für Verfassungsschutz (BfV) eine umfangreiche Vernichtung von Akten. Geschreddert wurden Akten zu sieben V-Leuten des Verfassungsschutzes, die ihm Rahmen der "Operation Rennsteig" angeworben worden waren. Diese Geheimdienstoperation unter Beteiligung des BfV, verschiedenen Landesverfassungsschutzämtern sowie dem Militärischen Abschirmdienst hatte zwischen 1997 und 2003 zum Ziel, die rechtsextremistische Szene in Thüringen zu untersuchen. Angeworben wurden dabei auch V-Leute, die im Thüringischen Heimatschutz aktiv gewesen sind, gerade jener rechtsextremistischen Gruppierung, in der das NSU-Trio politisch sozialisiert wurde. Auch nach diesem Tag ging die Aktenvernichtung im BfV weiter. Die unter dem Namen "Operation Konfetti" bekanntgewordene Vernichtungsaktion schlug hohe Wellen und führte zumindest kurzzeitig zu einer schweren Legitimationskrise des Verfassungsschutzes. Infolge der Krise trat der damalige BfV-Präsident Heinz Fromm zurück. ...
Contemporary liberalism and republicanism present clearly distinct programs for domestic politics, but the same cannot be said when it comes to global politics: the burgeoning literature on global republicanism has reproduced the divide between cosmopolitan and associational views familiar from long-standing debates among liberal egalitarians. Should republicans be cosmopolitans? Despite presence of a range of views in the literature, there is an emerging consensus that the best answer is no. This paper aims to resist the emerging consensus, arguing that republicans should be cosmopolitans. The considerations offered against cosmopolitanism generally rest on an incomplete understanding of the relationship between economic inequality or poverty on the one hand, and domination on the other. Insofar as republicans agree that promoting freedom from domination should be our central political aim, they should regard the reduction of economic inequality and poverty at home and abroad as equally pressing.
Scholarship and practice

How can I as an international lawyer, conscious that international law is deeply implicated in today’s global injustices and that the course of history will not be changed by any grand legal design, practice law responsibly? Taking as a point of departure my own desire not to seek comfort in the formulation of a critique of law, but to aspire to a responsible practice, I consult two quite different bodies of work: first, critical theory of law and second, recent scholarship on international law that argues a practice guided by ethics may enhance the legitimacy of international law. I turn then to my own practice of international economic law focusing on my occasional role as legal expert on the so-called megaregionals the EU aims to conclude with Canada and the United States. I propose that the debate on international economic law lacks an investigation into the role of law in shaping political economy; that this lack can be explained by the compartmentalization of expertise which leads to justification gaps with respect to projects such as the megaregionals. One way how lawyers can assume responsibility is to work on closing these gaps even if it means leaving the ‘inside’ of the legal discipline. Finally, I suggest that a responsible legal practice of social change might follow Roberto Unger’s call for institutional imagination. Maybe I can satisfy my wish for a transformative practice by joining forces with friends in experimenting with institutions, hoping to build an alternative political economy.
Der Islam stellt in Deutschland derzeit die größte religiöse Minderheit dar. Für ein friedliches Zusammenleben und einen Ausgleich zwischen verschiedenen Interessen, stellt das Recht wegen der Möglichkeit der Durchsetzbarkeit einen besonders wichtigen Faktor dar. Gegenstand des Aufsatzes ist die Frage, wie die deutsche Rechtsordnung mit religiösen Konflikten umgeht, inwieweit also die Interessen von Muslimen rechtlich geschützt werden. Dazu werden zunächst die verfassungsrechtlichen Maßstäbe zur Religionsfreiheit darge-stellt und die zentralen Kritikpunkte an der bisher ausgesprochen religionsfreundlichen Rechtsprechung analysiert. Sodann wird die Bedeutung dieser Maßstäbe für drei Einzelfragen näher betrachtet. Behandelt werden zum einen Konfliktfelder durch Religionsausübung in der Schule: das freiwillige Gebet von Schülern in Unterrichtspausen, die Befreiung vom Schwimmunterricht sowie die Kopftuchdebatte. Zum anderen werden die Fragestellungen erörtert, ob und inwieweit Scharia vor deutschen Gerichten Anwendung findet und ob und inwieweit sich innerhalb Deutschlands eine Paralleljustiz entwickelt. Abschließend befasst sich der Aufsatz mit der Beschneidung minderjähriger Jungen aus religiösen Gründen. Dieses Thema hat durch ein Urteil des LG Köln aus dem Jahre 2012 politische Aufmerksamkeit erlangt und schnelle Reaktionen des Gesetzgebers ausgelöst.
Die 18 Beiträge des Sammelbands behandeln das auch rechtshistorisch interessierende Thema der "religiösen Devianz", die zwischen schweren Delikten wie Gottlosigkeit, Hexerei oder Blasphemie und nonkonformistischen Glaubenspraktiken, Dissimulation und Eigensinn verortet wird. Dieses breite Spektrum, zu dessen einzelnen Erscheinungsformen bereits ergiebige Forschungen existieren, soll mit neueren sozialwissenschaftlichen und kriminalitätshistorischen Ansätzen, Methoden und Fragestellungen durchleuchtet werden: Nicht mehr Kirche und Staat, sondern der Herstellungsprozess religiöser Abweichung, deren Zuschreibung und die Sanktionierung/Stigmatisierung und damit die Praxis des Umgangs mit religiöser Devianz stehen im Mittelpunkt des Forschungsfeldes. Dessen Dimensionen legen die Herausgeber in der Einleitung systematisch und überzeugend dar und betonen als zentrale Forschungsleitlinien die stärkere Berücksichtigung von religiöser Pluralität, gruppenbezogener und konfessionsübergreifender Devianzen bzw. übergreifender Deliktfelder sowie das Zusammenwirken von religiösen, sozialen und rechtlichen Normen und Praktiken. Vollständigkeit kann freilich nicht erzielt werden und daher beschränkt sich der Band auf exemplarische Fallstudien zum konfessionellen Zeitalter, welche die variantenreiche religiös-konfessionelle Landschaft Europas ausreichend abdecken. ...
