The study deals with the large variety of judicial trials found in the records of the magistrate and judge of Sibiu of the 16th and 17th century. The topics of the magistratedocuments include heritage, the changing of the property right, guild regulations, rules for day laborers and servants and even orders regarding the number of persons that could attend to a feast and the number of dishes that should be served. The judicial papers deal with litigations, robberies, unpaid debts, frauds, adultery, crime and witchcraft trials.
Traditionally, in deciding whether some strategy or action in war is proportionate and necessary and thus permissible both international law and just war theory focus exclusively on civilian deaths and the destruction of civilian infrastructure. I argue in this paper that any argument that can explain why we should care about collateral killing and damage to infrastructure can also explain why collateral displacement matters. I argue that displacement is a foreseeable near-proximate cause of lethal harm to civilians and is relevant for proportionality and necessity calculi. Accepting my argument has significant consequences for what we are permitted to do in war and for what obligations we have towards refugees that result from our actions in war.
Moral refugee markets

States are increasingly paying other states to host refugees. For example, in 2010 the EU paid Libya €50 million to continue hosting the refugees within its borders, and five years later Australia offered Cambodia $31.16 million to accept asylum seekers living in Naru. These exchanges, which I call ‘refugees markets,’ have faced criticism by philosophers. Some philosophers claim the markets fail to ensure true protection, and are demeaning, expressing just how much refugees are unwanted. In response, some have defended refugee markets, claiming they can ensure refugees have protection and are not demeaned. I argue that many markets do demean refugees, and therefore have moral costs, but can still be all-things-considered preferable to alternative schemes if they protect refugees more than these alternative schemes.
This essay develops, within the terms of the recent New York Declaration, an account of the shared responsibility of states to refugees and of how the character of that responsibility effects the ways in which it can be fairly shared. However, it also moves beyond the question of the general obligations that states owe to refugees to consider ways in which refugee choices and refugee voice can be given appropriate standing with the global governance of refuge. It offers an argument for the normative significance of refugee’s reasons for choosing states of asylum and linked this to consideration of a refugee matching system and to refugee quota trading conceived as responsibility-trading, before turning to the issue of the inclusion of refugee voice in relation to the justification of the norms of refugee governance and in relation to the institutions and practices of refugee governance through which those norms are given practical expression.
The issue of statelessness poses problems for the statist (or nationalist) approach to the philosophy of immigration. Despite the fact that the statist approach claims to constrain the state’s right to exclude with human rights considerations, the arguments statists offer for the right of states to determine their own immigration policies would also justify citizenship rules that would render some children stateless. Insofar as rendering a child stateless is best characterized as a violation of human rights and insofar as some states have direct responsibility for causing such harm, the problem of non-refugee stateless children points to greater constraints than most statists accept on states’ right to determine their own rules for membership. While statists can ultimately account for the right not to be rendered stateless, recognizing these additional human rights constraints ultimately weakens the core of the statist position.
While global justice theorists heatedly discuss the responsibilities of the affluent and powerful, those states which can legitimately be seen as victims of global injustice have seldom, if ever, been considered as duty bearers to whom responsibilities can be attached. However, recognising agents whose options are constrained not only as victims, but also as duty bearers is necessary as a proof of respect for their agency and indispensable to mobilise the type of action required to alter global injustices. In this article, I explore what responsibilities state officials of dominated states have. I argue that they have the responsibility to resist domination in the name of the dominated states members. While under particular circumstances this responsibility gives rise to a duty to engage in acts of state civil disobedience, under other circumstances state officials of dominated states ought to resist domination in an internal, attitudinal way by recognising themselves as outcome responsible agents.
Fair Trade is under fire. Some critics argue, for instance, that there is no obligation to purchase Fair Trade certified products and that doing so may even be counter-productive. Others worry that well-justified conceptions of what makes trade fair can conflict. Yet others suggest that the common arguments for Fair Trade cannot justify purchasing Fair Trade certified goods, in particular. This paper starts by sketching one common argument for Fair Trade and defends it against this last line of criticism. In particular, it argues that we should purchase Fair Trade certified goods because doing so benefits the poor even though there are other ways to alleviate poverty. It then considers how other common arguments for Fair Trade fare in light of similar criticism and concludes that they may well succeed.
Political realists claim that international relations are in a state of anarchy, and therefore every state is allowed to disregard its moral duties towards other states and their inhabitants. Realists argue that complying with moral duties is simply too risky for a state’s national security. Political moralists convincingly show that realists exaggerate both the extent of international anarchy and the risks it poses to states who act morally. Yet moralists do not go far enough, since they do not question realism’s normative core: the claim that when national security is really at risk, states are allowed to disregard their moral duties. I contend that there is at least one moral duty that states should not disregard even if their inhabitants are at risk of death by military aggression: the duty to reduce extreme global poverty. The reason is that even granting that national security is about securing individuals’ right to life, global poverty relief is about that as well.
There are longstanding calls for international organizations (IOs) to be more inclusive of the voices and interests of people whose lives they affect. There is nevertheless widespread disagreement among practitioners and political theorists over who ought to be included in IO decision-making and by what means. This paper focuses on the inclusion of IOs’ ‘intended beneficiaries,’ both in principle and practice. It argues that IOs’ intended beneficiaries have particularly strong normative claims for inclusion because IOs can affect their vital interests and their political agency. It then examines how these claims to inclusion might be feasibly addressed. The paper proposes a model of inclusion via representation and communication, or ‘mediated inclusion.’ An examination of existing practices in global governance reveals significant opportunities for the mediated inclusion of IOs’ intended beneficiaries, as well as pervasive obstacles. The paper concludes that the inclusion of intended beneficiaries by IOs is both appropriate and feasible.
This article outlines a new approach to answering the foundational question in democratic theory of how the boundaries of democratic political units should be delineated. Whereas democratic theorists have mostly focused on identifying the appropriate population-group – or demos – for democratic decisionmaking, it is argued here that we should also take account of considerations relating to the appropriate scope of a democratic unit’s institutionalized governance capabilities – or public power. These matter because democratically legitimate governance is produced not only through the decision-making agency of a demos, but also through the institutionally distinct sources of political agency that shape the governance capabilities of public power. To develop this argument, the article traces a new theoretical account of the normative and institutional sources of collective agency, political legitimacy, and democratic boundaries, and illustrates it through a democratic reconstruction of the classical body politic metaphor. It further shows how this theoretical account lends strong prescriptive support to pluralist institutional boundaries within democratic global governance.
The democratic boundary problem raises the question of who has democratic participation rights in a given polity and why. One possible solution to this problem is the all-affected principle (AAP), according to which a polity ought to enfranchise all persons whose interests are affected by the polity’s decisions in a morally significant way. While AAP offers a plausible principle of democratic enfranchisement, its supporters have so far not paid sufficient attention to economic participation rights. I argue that if one commits oneself to AAP, one must also commit oneself to the view that political participation rights are not necessarily the only, and not necessarily the best, way to protect morally weighty interests. I also argue that economic participation rights raise important worries about democratic accountability, which is why their exercise must be constrained by a number of moral duties.
Um die Voraussetzungen für Heckers Wirken in Baden und das liberale Klima jener Zeit besser zu veranschaulichen, ist eine Betrachtung des Staats-Lexikons angebracht. Die Unterschiede zwischen den beiden ersten Auflagen, die im Deutschen Bund nicht veröffentlicht werden durften und der dritten Auflage sind geradezu umwälzend, sie veranschaulichen, warum das politische Klima des Vormärz nach der 1848er Revolution zum Erliegen kam. Das von Rotteck für die erste Auflage verfasste Vorwort (1834) sieht dessen Aufgabe darin, eine breite Menge der Bürger, Gelehrten und Gebildeten zu belehren und den gemeinen Menschenverstand zu schärfen.
Die Versammlungsfreiheit war ein gesuchtes Gut, das erst einmal zu begründen und im Blick auf mögliche Beschränkungen zu untersuchen war. Die Performativität einer Versammlung – das Beieinandersein freier Individuen zu einem Zweck, der sich nicht oder nicht immer einer reglementierenden Norm verdankte – erscheint heute als Teil jener Ethik der Kohabitation, die aus der Kantischen Notwendigkeit der Koordination der Freiheitsräume als Aneinanderstoßen von Willkürgrenzen kommt und im Blick auf Gefährdungsszenarien aktualisiert ist. Doch Aktualisierungen bedürfen der Grundlage, wollen sie nicht geschichtsvergessen sein (niedergelegt in der Geschichte finden wir die Praktiken, die für die damaligen Akteure Sinn verbürgten).
Menschenrechte und Ausnahmezustand sind zwei Weisen, durch die der moderne Staat seine rechtliche Ordnung nicht nur begründet und erhält, sondern auch immer wieder durchbricht. Zwischen ihnen besteht ein Gegensatz: Wo der Ausnahmezustand erklärt wird, werden Menschenrechte eingeschränkt.
Während die beiden Phänomene in ihrem Zweck entgegengesetzt sind, sind sie allerdings in ihren Mitteln verbunden. Darauf beruht ihr dialektisches Verhältnis, das in diesem Buch als Zusammenhang von Berechtigung und Entrechtung ausgewiesen wird. Dazu diskutiert der Autor im ersten Teil die Theorien von Souveränität und Ausnahmezustand bei Carl Schmitt und Giorgio Agamben. Im zweiten, philosophisch und historisch argumentierenden Teil zeigt er auf, dass das für die Menschenrechtsidee konstitutive Konzept der Rechtsperson staatliches (Ausnahme-)Handeln nicht nur begrenzt, sondern es auch ermöglicht.
Die Analyse zielt darauf, das positive Potential der Menschenrechte gegen ihre negativen Effekte in Stellung zu bringen und so gegenüber einer Logik der Maßnahme zu verteidigen.
Für die diesem Buch zugrunde liegende gleichnamige Dissertation wurde Jonas Heller 2018 mit dem Werner Pünder-Preis ausgezeichnet.

Kaum jemand hat sich in den 1950er und 1960er Jahre ähnlich intensiv für die strafrechtliche, aber auch die zivilgesellschaftliche Aufarbeitung der nationalsozialistischen Gewaltverbrechen eingesetzt wie Fritz Bauer. Dessen 50. Todestag am 1. Juli 2018 nahm das Fritz Bauer Institut zum Anlass, seinem Namensgeber zwei große Veranstaltungen zu widmen.
Can the democratic constitutions of Hungary and Poland survive an autocratic majority? Hardly. Hungary and Poland seem to be lost for liberal and democratic constitutionalism. At least for the time being, the next question is how democratic constitutionalism can prevent an autocratic majority. The task is to make it difficult for an autocratic parliamentary majority to capture the institutions of critique and control of government and to undermine separation of powers.
Nicht nur die Geräuschkulisse des Brexits absorbierte ein Stück weit die Aufmerksamkeit für das Urteil des Europäischen Gerichtshofs (EuGH) zur Zulässigkeit des Anleihenkaufprogramms der EZB. Denn immerhin entschied Luxemburg damit über eine der nach wie vor seltenen Vorlagen aus Karlsruhe. Dazu mag auch beigetragen haben, dass seit der Stellungnahme des Generalanwalts Wathelet nicht mehr damit gerechnet wurde, dass der EuGH der Europäischen Zentralbank (EZB) einen sprichwörtlichen Strich durch die Rechnung machen würde. Dennoch ist das Urteil aus einigen Gründen bemerkenswert.
On October 7th, general elections were held in Bosnia and Herzegovina. Its Constitution was meant to be an interim solution, setting up a complex structure of division of power between the three major ethnic groups leading to political paralysis. Constitutional reform is thus a pressing issue but the recent elections appear to reinforce the deadlock situation instead of paving the way for much needed change.
Staatliches Hacking von Computern und Smartphones hat Konjunktur. Durch das Gesetz zur effektiveren und praxistauglicheren Ausgestaltung des Strafverfahrens vom 17. August 2017 (BGBl. I S. 3202) wurden Online-Durchsuchung und Quellen-TKÜ mittels "Staatstrojanern" zu Standardmaßnahmen im strafrechtlichen Ermittlungsverfahren. Die StPO erlaubt seither den Einsatz von Staatstrojanern in mehreren zehntausend Fällen im Jahr: Sie sind nun immer dann zulässig, wenn bisher eine klassische Telekommunikationsüberwachung gem. § 100a Abs. 1 StPO unter Einbindung der jeweiligen Provider (vgl. § 100b StPO a.F.) vorgenommen wurde.
The illiberal turn in Europe has many facets. Of particular concern are Member States in which ruling majorities uproot the independence of the judiciary. For reasons well described in the Verfassungsblog, the current focus is on Poland. Since the Polish development is emblematic for a broader trend, more is at stake than the rule of law in that Member State alone (as if that were not enough). If the Polish emblematic development is not resisted, illiberal democracies might start co-defining the European constitutional order, in particular, its rule of law-value in Article 2 TEU. Accordingly, the conventional liberal self-understanding of Europe could easily erode, with tremendous implications.
Der Bundestag diskutiert heute in erster Lesung den Gesetzentwurf "zur Änderung der in das Geburtenregister einzutragenden Angaben" (19/4669). Demnach soll für die Eintragung des Geschlechts neben den bestehenden drei Varianten "weiblich", "männlich" und "ohne Angabe" nunmehr eine vierte Beurkundungsmöglichkeit geschaffen werden: "divers". Der Kabinettsentwurf ist schon als "Trauerspiel für die geschlechtliche Selbstbestimmung" (Grüne) und als "verfassungswidrig" (Aktion Standesamt 2018) kritisiert worden. Die Kritik der trans*- und inter*-Community hat Grietje Baars hier zusammengefasst. Tatsächlich wird mit der Einführung der sogenannten dritten Option der deutlich weniger radikale Weg der beiden vom Bundesverfassungsgericht aufgezeigten Alternativen beschritten. Die Entscheidung ist ausführlich hier besprochen worden.
Ob Änderungen des bisherigen Personenstandsrechts gerechtfertigt werden können, soll aber nicht Gegenstand dieses Beitrags sein. Im Folgenden soll vielmehr – umgekehrt – gefragt werden, warum Geschlecht überhaupt als rechtliche Kategorie erfasst wird – und ob die Gründe hierfür eigentlich (noch) tragen.
Mir fällt in dieser Woche, in der nicht nur im Netz darüber diskutiert wurde, was eigentlich gefährlich sei, Menschen in Schlauchbooten oder die Lifeline, und in der darüber diskutiert wurde, ob man nicht lieber ein paar absaufen lässt, damit die anderen gewarnt seien, nicht viel mehr ein, als in die Gründe und Abgründe Europas zu schauen.

Das "Gesetz zur Verbesserung der Rechtsdurchsetzung in sozialen Netzwerken" (Netzwerkdurchsetzungsgesetz, NetzDG) hatte bereits während seiner kurzen Entstehungszeit heftige Kritik ausgelöst und wird von zahlreichen Beobachtern auch in seiner in Kraft getretenen Fassung für unionsrechts- und grundgesetzwidrig gehalten. In Zweifel stehen vor allen Dingen die Gesetzgebungskompetenz des Bundes und die Vereinbarkeit des NetzDG mit der Meinungs- und Informationsfreiheit. Gegenwärtig sind drei Anträge auf vollständige bzw. teilweise Aufhebung des NetzDG im Bundestag anhängig (hier, hier und hier). Auch bei den Regierungsfraktionen steht das NetzDG unverändert auf der rechtspolitischen Agenda. Im Koalitionsvertrag heißt es, die am 1.7.2018 erstmals fälligen Berichte der Plattformbetreiber sollen zum Anlass genommen werden, "das Netzwerkdurchsetzungsgesetz insbesondere im Hinblick auf die freiwillige Selbstregulierung weiterzuentwickeln". ...
Die Transitzentren sind der neueste Clou der Unionsfraktion zur angeblichen Steuerung der Fluchtmigration und zugleich ein alter Hut. Am Montag verständigten sich CDU und CSU darauf, Transitzentren an der bayerisch-österreichischen Grenze einzurichten, um ihre größte parteipolitische Krise abzuwenden. Die Transitzentren waren bereits im Herbst 2015 Bestandteil eines Ressortentwurfs des Bundesinnenministeriums, den die SPD im letzten Moment verhinderte. Man wolle "Massenlager im Niemandsland" verhindern, wie der damalige Justizminister Heiko Maas sagte. Auf europäischer Ebene sind indes mit den "regionalen Ausschiffungsplattformen", die in außereuropäischen Drittstaaten errichtet werden sollen, sowie mit den "kontrollierten Zentren" auf europäischem Boden vergleichbare Lager geplant. Der Spiegel fasste die EU-Gipfel-Ergebnisse wie folgt zusammen: "Europa orbánisiert sich". Die Überschrift erfasst tatsächlich den Kern des Problems. Hinter dem sog. Asylstreit der letzten Wochen steckt nicht nur ein parteipolitischer Konflikt zwischen Innenminister Horst Seehofer und Bundeskanzlerin Angela Merkel. Es geht im Kern darum, eine illiberale und anti-europäische Form des Rechtsstaats in Deutschland zu implementieren, die in Ungarn schon weit vorangeschritten ist. Auf lange Sicht ist es das Ziel von nationalistischen Akteuren, dass rechtsstaatliche Garantien nur noch formell auf dem Papier bestehen. Der autoritär transformierte Rechtsstaat ist dann nur noch eine Attrappe, weil Betroffene zu ihm faktisch keinen Zugang mehr haben.
Wer am Wochenende die politische Debatte und auf Twitter den Hashtag #Ellwangen verfolgt hat, könnte den Eindruck gewinnen Deutschland stehe kurz vor einem Bürgerkrieg. Dabei hatten Flüchtlinge nur versucht, die Überstellung ihres Mitbewohners im Rahmen des Dubliner-Zuständigkeitssystems nach Italien zu verhindern, ein Akt des zivilen Ungehorsams. Weil die Polizei den ersten Überstellungsversuch abbrach – was bei Überstellungen durchaus keine Seltenheit ist -, folgte offenbar auf politischen Druck hin nicht nur die Mobilisierung einer behelmten Polizei-Hundertschaft, sondern auch eine Kaskade von politischen Vorwürfen und eilfertigen Maßnahmenvorschlägen. ...
Mit Dashcams den Verkehr aufzuzeichnen, kann nach einem Unfall in einem zivilrechtlichen Haftpflichtprozess sehr nützlich sein – obwohl man das datenschutzrechtlich eigentlich nicht darf. Der BGH hat in dieser Woche (BGH, Urt. v. 15. Mai 2018 – VI ZR 233/17) zwei rechtliche Problemlagen geklärt, die deutsche Gerichte seit geraumer Zeit beschäftigt haben: Zum einen betrifft dies die datenschutzrechtliche Zulässigkeit des Einsatzes von Dashcams im öffentlichen Verkehrsraum. Zum anderen deren zivilprozessuale Verwertbarkeit, insbesondere wenn die Aufnahmen rechtswidrig erfolgten.

Questo saggio descrive il progetto ambizioso del costituzionalismo moderno e lo distingue dalla mera giuridicizzazione del potere pubblico. Esso mostra le sfide del costituzionalismo derivanti dalla perdita di identità del potere statale e del potere pubblico. Il saggio afferma la persistenza della necessità di regolare il potere pubblico, indipendentemente dal fatto che sia esercitato dalle autorità statali o da organizzazioni internazionali. Tuttavia, esso solleva dubbi sul fatto che il potere pubblico frammentato a livello internazionale possa essere regolato in modo tale da soddisfare le richieste del costituzionalismo. È in corso una giuridicizzazione che manca delle caratteristiche fondamentali del costituzionalismo. Come realizzare una compensazione in questo senso resta una domanda aperta.
In Österreich kategorisiert ab 2019 ein Algorithmus arbeitslose Personen nach ihren Chancen auf dem Arbeitsmarkt. Die Software trennt in drei Personengruppen: Arbeitssuchende mit guten, mittleren und schlechten Perspektiven, einen Arbeitsplatz zu finden. Auf dieser Basis will der Arbeitsmarktservice Österreich (AMS) seine Ressourcen ab 2020 überwiegend auf Personen der mittleren Gruppe konzentrieren. Dort seien sie am effektivsten eingesetzt. Die "Arbeitsmarktintegrationschancen" von Frauen bewertet der Algorithmus pauschal negativ. Zudem führen betreuungspflichtige Kinder zu einer schlechten Einstufung – allerdings nur für Frauen. Bei Männern, so begründen die Entwickler, habe eine Betreuungspflicht statistisch gesehen keine negativen Auswirkungen auf die Arbeitsmarktchancen.
Legal pluralism as a pre-modern and well-known phenomenon appeared to be domesticated by the "modern state" with its sovereign position as creator of law. Today the phenomenon is back. Today's lawyers struggle not only with multiple levels of normativity (national law, European law, international law, legal networks without a state) but also with the cultural diversities of interpretation and practice.
This special issue of one of the leading German historical journals features case studies and a theoretical model to conceptualize multinormativity in the early modern period. The overarching concept that holds the contributions together is that of "normative competition" (Normenkonkurrenz), developed by Hillard von Thiessen. It offers a dynamic, interactive, and actor-centered approach to the co-existence of potentially conflicting normative orders in the early modern period. Von Thiessen draws attention to the manifold ways in which subjects consciously or unconsciously contribute to the shape and operation of norms. He offers an alternative to existing models that try to describe and explain normative change in the early modern period, such as Gerhard Oestreich’s model of "social discipline" (Sozialdisziplinierung) and Wolfgang Reinhard and Heinz Schilling’s model of"confessionalization" (Konfessionalisierung). In von Thiessen’s view, these models are inadequate. They are implicitly indebted to Max Weber’s paradigm of the gradual rationalization of Western civilization, and they assume a static opposition between norm-creating authorities and norm-receiving subjects. The models of "social discipline" and "confessionalization" start from the belief that citizens’ behavior gradually and homogeneously adapted to the norms laid down by the authorities. Recent historical scholarship has demonstrated that the top-down imposition of norms by state authorities and religious institutions often failed. A gap existed between the norms on the books and the norms in action, to the extent that daily life deviated from norms imposed by central authorities like the state or religious institutions in the first place. Von Thiessen, however, wants to avoid narratives of failure or success. Rather than starting from an antagonistic vision that pits institutional norm-producers against passive norm-receiving subjects, von Thiessen emphasizes the synergistic role played by all actors in the production and implementation of norms. ...
On February 20 at the Max Planck Institut für europäische Rechtsgeschichte, the Legal Historian and member of the Constitutional Court of Peru, Dr. Carlos Ramos Núñez, presented a crucial intervention on the problems that face the current constitutionalism in Latin America. Die Strafrechtsgeschichte hat – mit Ausnahme von Geständnis und Folter – einzelne Interaktions- und Kommunikationsmodi des Strafverfahrens eher selten untersucht. Insofern schließt die Monografie von Antje Schumann eine Forschungslücke, da sie die historische Entwicklung von Verhör, Vernehmung und Befragung in Deutschland bis zum Strafprozessänderungsgesetz von 1964 verfolgt. Letzteres sowie die aktuellen strafprozessrechtlichen Rechtsprobleme bilden den Ausgangspunkt der Untersuchung, die insofern eine teleologische Perspektive einnimmt, um "d[ie] Notwendigkeit und de[n] Wert eines Rechtsbegriffs der Vernehmung im Strafprozess" zu rekonstruieren (2). Methodisch erfolgt dies mit einem dogmen- und begriffsgeschichtlichen Ansatz, der sich auf die Analyse des Strafverfahrensrechts und der entsprechenden juristischen Literatur beschränkt. Cómo reaccionaba la inquisición española ante la presencia de protestantes en sus colonias americanas es una de las preguntas transversales de la investigación que nos presenta el libro de Joël Graf. A partir de un análisis comparativo de los respectivos procesos inquisitoriales, el autor analiza las lógicas históricas, geográficas, jurídicas y teológicas que estaban a la base de las formas en que los tres tribunales inquisitoriales americanos procesaron a los diversos protestantes entre los siglos XVI y XVIII. Presentado de forma cronológica, el autor va mostrando las diferentes formas de reaccionar de los tribunales, sus prácticas jurídicas y principales debates. Entre ellos, quisiéramos resaltar algunos aspectos fundamentales del libro: a) los mecanismos de inclusión del catolicismo, basados en prácticas de disimulo, reverencia y auto-denuncia; b) las particularidades americanas de los denominados "herejes nacionales"; c) el poco uso de los tratados internacionales en medio de una amplia oferta normativa. ...

In the past 30 years, the end of the Cold War and the breakdown of the modernist frame of politics have promoted the historical turn of international law. A non-Eurocentric narrative of international law is needed not only to help it go beyond the geographical and conceptual self-justification, but also to open itself to other normative orders. This presents an intellectual and normative challenge to legal historians, who increasingly explore the normative dialogue and competition in interstitial areas, such as South and Southeast Asia in their existence between the Islamic, Sinocentric and European orders. It is this issue and this important era of globalisation that Clara Kemme’s book examines roughly over the period from 1500 to 1900, in particular how the key concepts of tribute and treaty were understood through diplomatic ideas and practices in South and SoutheastAsia, how the treaty system as a product of international law became global and why it prevailed over other systems of order (2). ...
"In the beginning all the World was America" reads the iconic opening of § 49 in John Locke’s Second Treatise of Government. Beyond mentioning "America", Locke’s theory and the story told by Juan Pablo Scarfi in The Hidden History of International Law in the Americas share an unsettling resemblance. The expansion of international law and the deepening of legal techniques for the purposes of US hegemony in the American hemisphere, the invasion of politics by the language of science, the double standard, one of real military and monetary interventions, and another of (usually) suave diplomatic correspondence about the advantages of pan-Americanism, all are part and parcel of The Hidden History. Moreover, around the mid-20th century the pattern extended around the entire globe. Therefore, as Scarfi elegantly suggests, the interventions in Latin America by the newly established US empire in the early 20th century had the nature of laboratory experiments. In the end, all the world was America again, but with a good number more of international organizations, institutions devoted to the scientific study of international law, and international legal norms and principles. This image, of course, simplifies tremendously the complex history of the past century. However, it summarizes the message of Scarfi’s book. ...

Auf nicht ganz tausend Seiten – rund 170 davon eine inhaltlich strukturierte Literaturübersicht – verhandelt der Autor in großer Quellennähe, beeindruckender analytischer Durchdringung und präziser Diktion die drei großen Sachbereiche, welche der Untertitel nennt: die "Entwicklung der Theologie Luthers", die "Auswirkung auf das Recht", die Rahmenbedingungen Reichsreform und Territorialstaatsbildung, und die Auseinandersetzung mit "Rom und den Schwärmern". ...
We live in the age of commentaries. When I was a law student at Heidelberg University and wrote a take-home exam on private law in the mid-1990s, I had to survey eight commentaries on the German Civil Code. Today, students have to check twice as many commentaries, among them whoppers like the Historical-Critical Commentary and the Beck "Grand" Online-Commentary, the latter still in progress with more than 400 individual contributors – not paragraphs. Publishers and editors must use all kinds of incentives to lure new authors onto their juridical treadmills. Nobody needs an oracle to predict that most of the commentaries without a digital interface will soon vanish – sometimes to the relief of their authors, who are deeply frustrated by the lack of citations in textbooks and court cases. There is no need for the Club of Rome to issue a paper on the limits of legal commentaries. Despite all this intertextual Darwinism, the commentaries call to mind a kind of legal oasis with plenty of resources. The desert beyond buries the few remaining "grand" textbooks that traditionally developed legal principles and legal system. The commentaries can provide no guidance on these points. Their focus lies on practical details, not overarching structures. It is no wonder that mainstream contemporary German legal writing on private law is unable to master the overwhelming number of changes in the German Civil Code introduced over the last two decades. ...

Invincible ignorance is defined as the state in which one cannot overcome his ignorance, despite one’s utmost diligence, and hence cannot be blamed for the acts resulting from that circumstance. It is particularly relevant with regard to law and principles that one is bound to know. The main problem with the admission that such a state may occur results from the difficulty of assessing the subjective element present in such a state: How can we know that one applied his diligence to the utmost extent?
This notion emerged in the 12th century. But while medieval theologians elaborated such a notion, they nonetheless stressed that in reality no one could be guiltlessly ignorant of natural and divine law. The arrival of the Spaniards to the Americas triggered the awareness that entire nations could, in fact, be invincibly ignorant of Christianity. The Spanish theologians then started to use this notion, admitting the existence of invincible ignorance of some principles of divine and natural law. Their argumentative strategy rested on emphasising the subjective element of invincible ignorance.
In this article, I examine Vitoria’s Relectio de Indis against the medieval doctrinal background. I also analyse Vitoria’s, Domingo de Soto’s and Juan Gil de Nava’s unedited lectures on Aquinas’s Summa theologiae as well as the works by Matías de Paz, Juan López de Palacios Rubios, Juan de Celaya and Bartolomé de Las Casas.

The conquista of the Americas confronted Spanish jurists educated in the legal concepts of the European medieval tradition with a different reality, pushing them to develop modern legal concepts on the basis of the European ius commune tradition. Traditionally, the School of Salamanca, theologians and jurists centred around the Dominican Francisco de Vitoria are credited with this intellectual renovation of moral and legal thought. However, the role earlier authors played in the process is still insufficiently researched. The Castilian crown jurist Juan López de Palacios Rubios is one of the most interesting authors of the early phase in the conquest of the Americas. His treatise about the Spanish dominion in the Americas is a central text that shows how at the beginning of the 16th century the knowledge and the experiences of the European past were applied to the American present and, in the process, were shaped into modern ideas.
There is a consensus among historians that the School of Salamanca brought something new to the development of early modern European legal thinking and methodology. Francisco de Vitoria is considered, not only by modern researchers but also by his contemporaries (from Melchor Cano onward), the origin of the school and its founding figure. He is famously claimed to have introduced Thomas Aquinas’s Summa theologiae as the fundamental text for theological lectures at the University of Salamanca and so prepared the ground for the upsurge of academic activity and intellectual brilliance of late or modern scholasticism at Spanish, Portuguese, and American universities. Regardless of the differences in the assessments of the late scholastics’ political stance (whether viewed as trailblazers on the way to human rights and a modern law of nations or as conservative imperialists, whose sole intent was the perpetuation and legitimation of the Spanish rule in the Americas), Vitoria and his followers are seen as intellectual innovators, opening the restrictive traditions of medieval scholarship to the modern exigencies of a globalized world. This almost universal image has recently been called into question, with Jacob Schmutz showing that Vitoria was not quite the first to introduce Aquinas’s Summa into the teaching of Salamanca’s theological faculty, and Thomas Duve recently asking outright: Did everything actually start with Francisco de Vitoria? ...
Sammelbände sind eine zweischneidige Angelegenheit. Soll man sie als Buch ansehen, eingeteilt in verschiedene Kapitel, die von mehreren Autoren stammen? Oder hat man viel eher eine Sammlung einzelner Aufsätze vor sich, die sich mehr oder weniger passend unter ein vom Herausgeber vorgegebenes Rahmenthema scharen? Beides trifft gleichermaßen zu, und das macht es so schwer, Werke dieser Gattung zu rezensieren. Geht man von einem geschlossenen Buch aus, fällt der Blick auf die Einleitung. Hier legen die Herausgeber jeweils ihre Überlegungen offen, die zu der nunmehr im Druck vorliegenden Tagung geführt hatten. Sie selbst ordnen die einzelnen Beiträge dann auch in die übergreifenden Ideen ein. Der Leser bekommt also einen Eindruck davon, wo der rote Faden verlaufen soll. Wer mit dieser Erwartungshaltung das Buch über Popular Justice aufschlägt, wird ein wenig enttäuscht. Gerade der Dreh- und Angelpunkt des Bandes, die Popular Justice, bleibt nämlich blass. Es geht irgendwie um die Beteiligung der Bevölkerung an der Rechtsdurchsetzung, um Laien, die Gerichtsbarkeit ausüben. Aber hier ist die Bandbreite groß, und deswegen sind genauere Zuspitzungen kaum möglich. Die Einleitung bietet einen bunten Strauß von Beispielen, die schnell und schlechthin als Volksjustiz erscheinen. Jedenfalls tauchen französische Jurys aus der Revolutionszeit auf, es geht um Reformen der Gerichtsverfassung in Spanien im 19. Jahrhundert zur Einführung der Jury, um spezifische Formen der Schiedsstellen für arbeitsgerichtliche Streitigkeiten in Italien, um sog. Katzenmusik und Charivari, um öffentliche Schändungen von Kollaborateuren in Frankreich, um deutsche und österreichische Volksgerichte nach dem ersten und zweiten Weltkrieg, um Volk und Gericht im Nationalsozialismus sowie um symbolische Gewalt gegen die SED-Herrschaft in der SBZ/DDR. ...

For example, the constitutional documents of Hispanic America after 1810 simultaneously heralded the dawn of new states and the twilight of the Spanish Empire. Since constitutions and the state institutions they help to build are deeply imbued with symbolic power, they are an important element in constructing, perhaps even in "inventing", nations. They provide raw materials for our regimes of memory and divide history into a "before" and an "after", through which they also exert a stabilising effect. ...

Erfindung – national – Rechtsgeschichte: anhand dieser drei Stichworte lassen sich Fragestellung, Quellenlage und Durchführung klären.
Lassen wir dahingestellt, ob es sich eher um Erfindungen handelt, besser um Imagination, oder um allmähliche Entstehungen oder gar gesetzmäßige Evolutionen. Alle diese Bilder malen betont selektiv die Bedeutung bestimmter Entstehungsfaktoren aus. "Nationen" erscheinen so als soziale Imaginationen Europas. Das dürfte freilich für die historische Verortung des Vorgangs keine große Rolle spielen. Ob man ihn am Ende als Erfindung oder anders erzählt, ist eine eigene Frage, die hier nicht zu entscheiden ist. In jedem Fall ist das Fundament bisher sehr schmal. Die bisherigen Forschungen zur Rechtsgeschichte der Nationen sind zudem nicht leicht zu überblicken, sie bieten immerhin einiges zu einigen europäischen Ländern. Eine zusammenfassende Darstellung existiert nicht.
Das seit etwa zwanzig Jahren gesteigerte internationale Interesse an der Geschichte des Völkerrechts ist offenbar der wissenschaftliche Reflex einer geänderten Weltlage. Wo neue staatliche und nichtstaatliche Akteure auftreten und die gewohnten räumlichen Grenzen sich auflösen, wo Kriege mit neuen Mitteln geführt und nicht mehr in klassischer Weise begonnen und beendet werden, verschiebt sich auch der Normenkomplex des Völkerrechts. Seine akademischen Vertreter registrieren eine Auflösung der alten Epocheneinteilung, die dem Zug der Welt- bzw. Kolonialreiche folgte, ein Wiederaufflammen der Figur des "gerechten Kriegs" sowohl im Namen der Religion als auch der "humanitären Intervention". Das hier zu besprechende Buch des an der Yale-University lehrenden Rechtshistorikers James Q. Whitman ist in Amerika mit großer Zustimmung besprochen worden, und zwar mit Recht, besonders wegen seiner Fragestellung und der Sorgfalt ihrer Bearbeitung. Der deutsche Leser gewinnt dabei den Eindruck, dass die inneramerikanische Zustimmung den Nebensinn hat, die amerikanische Gesellschaft solle nicht nur auf das rassistische Nazi-Deutschland zeigen, sondern auch die eigene Vergangenheit und Gegenwart kritisch reflektieren. ...

The Dodd Frank Act of 2010 (DFA) was the legislative response by the US Government to the Global Financial Crisis of 2007. DFA’s rescission of Rule 436 (g) of the Securities Act of 1933 - the exemption from liability clause - was the response to the post-crisis perception that credit rating agencies were insufficiently constrained by reputational risk considerations and consistently failed to provide high quality and accurate credit ratings as a consequence of the immunity they enjoyed and the regulatory reliance placed on ratings, as well as the conflicts of interest that they faced. This paper investigates whether the market failure event that occurred in the Asset Backed Securities market immediately after DFA was signed into law on July 21, 2010 was due to real economic concerns held by rating agencies about operating under a liability regime or whether it was merely an act of brinkmanship on the part of the rating agencies. The paper also predominantly examines US case law to identify the dilution of the freedom of speech defence in state courts, the conflict of interest issues and the legal challenges faced by plaintiffs when bringing a lawsuit against credit rating agencies, and proposes a novel co-pay and capped liability model to address the concerns of both credit rating agencies and investors.
A sound and well-functioning legal system will encourage growth in investment and create opportunities for investors. Trademarks as part of intellectual property play an important role in the future development of a country. A mark or symbol is needed in order to give products and services identity and to distinguish them and their qualities from identical or similar products and services of a competitor.
This research studies, examines and analyses the degree, nature and function of trademark protection within the legal system of Afghanistan and compare them with the Paris, Madrid and TRIPs agreements. It has been divided into four chapters: Chapter one provides general information and an overview of the current legal system of Afghanistan. Chapter two studies and analyses international agreements pertaining to the legal protection of trademark. It also critically assesses the ATML compatibility with these agreements: and answers the research question of to what extent the ATML provisions are compatible with them. Chapter three provides information on the different purposes of trademarks from a development perspective and compares the purposes provided by the ATML. Finally, chapter four assesses and examines the acquisition, assignment and termination of trademarks. The conclusions and findings of the thesis are the final section of this research.
Afghanistan, as a transitioning economy, has not developed a solid legal and practical foundation for providing comprehensive protection mechanisms for trademarks as have been articulated in developed countries and international agreements. Accordingly, the Afghan government has not entirely integrated these needs into its legal system and there are some inconsistencies of the ATML with these agreements.
One more challenge is the lack of appropriate legal institutions for issuing, managing, administering and protecting of trademarks. The establishment of a well-functioning administrative institution will serve to fulfil the objectives of the laws. Therefore, the CBR office holds the administrative responsibility for processing the registration of trademarks.
However, the methods and facilities of the CBR office remain outdated, and the office does not have the capacity to provide applicants with up-to-date administrative and technical facilities.
Therefore, legal protection of trademark in Afghanistan is linked not only to the existence of a well functioning of laws, regulations, clear procedures, mechanism and guidelines but also to an efficient and well-functioning administrative office.
The purpose of this thesis is to achieve two highly interconnected yet distinct tasks. On the one hand, the thesis explains how foreign investment insurance works by focusing on the law governing the relationships between involved actors. On the other hand, it provides a critique of the operation of foreign investment insurance as an investment protection instrument by mainly drawing on critical studies of the investment protection regime.
The main question this thesis attempts to answer is how foreign investment insurance works. I construe foreign investment insurance as a typical insurance product and focus on the operation of insurance arrangements from a legal perspective. Ideas about how insurance should be deployed in any given social, political or economic context are instrumental in the development of insurers, insurance products and insurance techniques. The thesis examines investment insurers, the products they offer and their techniques to identify and deal with so-called political risks.
Another important question concerns the notion of political risk. What are considered political risks in the context of investment insurance and how are they conceptualized by investment insurance providers? Investment insurers have largely adopted a business-oriented political risk definition which denotes governmental intervention in foreign investment as political risk without regard to the objectives of government actions. Descriptive studies explain political risk by replicating investment insurers’ categorization of basic coverages that include expropriation, currency inconvertibility and remittance transfer restrictions, political violence and breach of contract. Yet recent studies have increasingly provided in-depth analyses on the notion of political risk as well as on the specific categories of political risk, particularly expropriation. The thesis draws on these studies to critically discuss the concept of political risk as it is used by investment insurance providers.
I focus on foreign investment insurance provided by OPIC and MIGA due to their mandate to promote economic development in the capital-importing countries and for their historical role as the major providers of investment insurance. While focus is on MIGA and OPIC, the thesis offers a general account of the operation of foreign investment insurance by incorporating the available information on investment insurance industry and the international governance of investment insurance. The central issues explored in this thesis such as the principle of subrogation and the notion of political risk help me generalize the study as these issues are characterized similarly with respect to each public investment insurance provider.
The case studies and most examples in this thesis are based on expropriation risk insurance.
Europe is a key normative power. Its legitimacy as a force for ensuring the reign of rule of law in international relations is unparalleled. It also packs an economic punch. In data protection and the fight against cybercrime, European norms have been successfully globalized. The time is right to take the next step: Europe must now become the international normative leader for developing a new deal on internet governance. To ensure this, European powers should commit to rules that work in security, economic development and human rights on the internet and implement them in a reinvigorated IGF.
Die Tagung rief dazu auf, die Verbindlichkeit von Versprechen als allgemeines Phänomen zu untersuchen, also zu ergründen, inwiefern man unabhängig von ihrer Ausgestaltung in konkreten Rechtsordnungen oder anderen Normensystemen von einer "vor-rechtlichen" Verbindlichkeit sprechen kann. Literarische Texte aller Zeiten bis hin zu den Mythen bezeugen die Bindung an das Wort als Urerfahrung, die von jeder gesellschaftlichen Konvention unabhängig erscheint. Ebenso kennen sie aber Verrat und offenen oder verdeckten Wortbruch, deren Folgen sie thematisieren. Strukturelle Verwandtschaften einerseits und gegenseitige Beeinflussung andererseits der literarischen und der rechtlichen Auseinandersetzung mit dem Versprechen sollten untersucht werden.
Auch im Fachbereich Rechtswissenschaft an der Goethe-Universität kam es 1968 zu heftigen Turbulenzen. Dabei zeigten die meisten jüngeren Professoren des Fachbereichs durchaus Verständnis für manche der studentischen Forderungen. Einige Reformansätze scheiterten, andere wurden erst durch feinere Nachjustierungen funktional.
The article is designed to introduce and analyze authoritarian constitutionalism as an important phenomenon in its own right, not merely a deficient or deviant version of liberal constitutionalism. Therefore it is not adequate to dismiss it as sham or window-dressing. Instead, its crucial features – participation as complicity, power as property and the cult of immediacy – are related to the basic assumption that authoritarian constitutions are texts with a purpose that warrant careful analysis of the domestic and transnational audience.

Demnach beruht das IP-Recht auf der Annahme, dass erst die Kombination aus fungiblen Ausschließlichkeitsrechten und Privatautonomie – also die juristische Form der Marktwirtschaft – einen innovationsförderlichen Effekt verspricht. Dementsprechend kombiniert das geltende Recht ein hohes materielles IP-Schutzniveau mit einer weitreichenden Anerkennung der Privatautonomie der Berechtigten. Dieser Regulierungsansatz hat den Vorteil, dass sehr anpassungsfähige Rahmenbedingungen für Innovationen geschaffen werden. Wer für seine Innovation eine umfassende Exklusivität benötigt, kann unter Geltung der beiden genannten Prinzipien ebenso operieren wie Akteure, die auf IP-Schutz teilweise oder ganz verzichten möchten, weil ihnen dies unter den gegebenen Wettbewerbsbedingungen vorzugswürdig erscheint. Und doch erläutert der Beitrag, dass die naheliegende Folgerung zu kurz greift, der Gesetzgeber könne sich darauf beschränken, möglichst umfassende und zugleich fungible IP-Rechte zu kodifizieren, da der Markt stets für eine effiziente und auch sonst sozial wünschenswerte Ressourcenallokation sorge. Denn die mit ausschließlichen IP-Rechten verbundenen Transaktionskosten stehen diesem Ziel nicht selten im Wege. Damit zeigt sich, dass keine noch so elaborierte Vertragsrechtstheorie die Frage nach dem Sinn des logisch vorrangigen Eigentums erübrigt.
Das Immaterialgüterrecht bildet eine der ältesten und inzwischen umfangreichsten Materien des Einheitsprivatrechts. Fast alle Staaten der Erde sind Mitglieder der World Intellectual Property Organization und bekennen sich als solche zur Förderung des „geistigen Eigentums“. Allerdings ist der Rechtsschutz nach dem seinerseits universell anerkannten Territorialitätsprinzip auf das Territorium des jeweiligen Gesetzgebers beschränkt. Zu dieser geografischen Fragmentierung treten fremdenrechtliche Beschränkungen des Zugangs zum lokalen Rechtsschutz hinzu. Der Beitrag erläutert, welche Akteure die Spannung zwischen globaler Kommunikation und fragmentiertem Immaterialgüterrechtsschutz auf welche Weisen regulativ bearbeiten. Dabei wird unterschieden zwischen der Rechtsangleichung bei fortdauernder Fragmentierung, der Schaffung supranational einheitlicher Verfahren, Immaterialgüterrechte und Gerichte sowie informellen Kooperationen zwischen Privaten und Patentämtern. Die Leitfrage der Bestandsaufnahme lautet, ob all diese Phänomene im Sinne von Kropholler und David als funktionales Einheitsrecht begriffen werden können, ob es sich also um Rechtssätze handelt, bei denen die Einheitlichkeit ihrer Geltung im Interesse des unverfälschten internationalen Handels zu einem besonderen Rechtszweck erhoben wurde, oder ob man lediglich objektiv-formal eine rechtlich bindende Einheitlichkeit konstatieren kann, die primär ein anderes Ziel verfolgt, nämlich: die weltweite Stärkung des Immaterialgüterrechtsschutzes. Den Abschluss bildet eine kritische Stellungnahme zur verbreiteten Annahme, die weit fortgeschrittene Vereinheitlichung des Immaterialgüterrechts sei ein großartiger Erfolg.
