How special are they? - Targeting systemic risk by regulating shadow banking : (October 5, 2014)

This essay argues that at least some of the financial stability concerns associated with shadow banking can be addressed by an approach to financial regulation that imports its functional foundations more vigorously into the interpretation and implementation of existing rules. It shows that the general policy goals of prudential banking regulation remain constant over time despite dramatic transformations in the financial and technological landscape. Moreover, these overarching policy goals also legitimize intervention in the shadow banking sector. On these grounds, this essay encourages a more normative construction of available rules that potentially limits both the scope for regulatory arbitrage and the need for ever more rapid updates and a constant increase in the complexity of the regulatory framework. By tying the regulatory treatment of financial innovation closely to existing prudential rules and their underlying policy rationales, the proposed approach potentially ends the socially wasteful race between hare and tortoise that signifies the relation between regulators and a highly dynamic industry. In doing so it does not generally hamper market participants’ efficient discoveries where disintermediation proves socially beneficial. Instead, it only weeds-out rent-seeking circumventions of existing rules and standards.
In der Krise des individualistischen Kausalitäts- und Schuldzuordnungsdenkens reagiert das Recht zunehmend mit Kollektivierungen: Verantwortung für technische Risiken muss demnach von subjektiv-orientierten Zurechnungsfragen nach individueller Verursachung und Verschulden abstrahieren und in diesem Sinne objektiv zugerechnet werden, sei es einem Betrieb, einem Unternehmen oder sei es auch einer sonstigen Verbindung von Menschen und Dingen. Die Mechanismen der kollektivierenden Verantwortungszumutungen reichen dabei von einer Ausdehnung der Kausalhaftung als Gefährdungshaftung über eine weitere Verbindung von Haftungssubjekten zu besonderen Risikoassoziationen bis zu einer Re-Personalisierung der Haftungsverantwortlichkeit. Vor diesem Hintergrund lassen sich Verschiebungen der rechtlichen Verantwortungszuordnung nachzeichnen, die vor allem in informationstechnischen Kontexten beobachtbar sind und beispielsweise in den Exzessen von Flashmobs oder auch im Flash Trading des Hochfrequenzhandels auf weitere Herausforderungen stoßen.
Hybridhaftung im Internet

In den Informationstechnologien zeichnen sich Verschiebungen der rechtlichen Verantwortungszurechnung ab, die auf tiefgreifende Veränderungen der bisherigen, individualistisch ausgerichteten Handlungstheorie des Rechts hindeuten. Verantwortungszuschreibungen für technische Risiken müssen demnach zunehmend von subjektiv-orientierten Zurechnungsfragen nach individueller Verursachung und Verschulden abstrahieren, in diesem Sinne also objektiviert und kollektiviert werden. Diese Entwicklungen werden besonders an den für „mittelbare Rechtsverletzungen“ eingesetzten Haftungsmodellen der immaterialgüterrechtlichen Störer- und Täterhaftung erkennbar. Die vielfältigen, kaum noch systematisierbaren Einzelfälle von Schutzrechtsverletzungen im Internet zeigen dabei, dass Fragen nach technischen Verantwortlichkeiten und zumutbaren Prüfpflichten von Intermediären allenfalls durch ein technologisch informiertes Recht zu beantworten sind. Es bedarf daher einer technologisch aufgeklärten Sicht, die über rein rechtsdogmatische oder ökonomische Betrachtungen hinausweist. Die technologische Aufklärung zielt auf eine Kritik des Wissens. Sie erweitert das systemtheoretische Kritikprogramm der soziologischen Aufklärung um eine techniksoziologische Perspektive, wie sie insbesondere in den Science and Technology Studies zu finden ist.
Concepts of legal capacity and legal subjectivity have developed gradually through intermediate stages. Accordingly, there are numerous types of legal subjects and partial legal subjects, and ever-new types can develop, at the latest once the law confronts new social and technological challenges. Today such challenges seem to be making themselves felt especially in the field of information and communication technologies. Their specific communicative conditions resulting from the technological networking of social communication have a particularly pronounced influence on legal attributions of identity and action, and hence above all on issues of liability in electronic commerce. Here in particular it is becoming increasingly difficult to distinguish concrete human actors and, for example, to identify them as authors of declarations of intent or even as individually responsible agencies of legal transgressions. The communicative processes in this area appear instead as new kinds of chains of effects whose actors seem to be more socio-technical ensembles of people and things – whereby the artificial components of these hybrid human being-thing linkages can sometimes even be represented as driving forces and independent agents.
Der Bundesgerichtshof hat im vergangenen Jahr entschieden, dass es „einen ersatzfähigen Vermögensschaden darstellen [kann] , wenn dem Inhaber eines DSL-Anschlusses die Möglichkeit genommen wird, seinen Zugang zum Intern et zu nutzen, ohne dass ihm hierdurch Mehraufwendungen entstanden oder Einnahmen entgangen sind“ (BGHZ 196, 101). Eine techniksoziologische Analyse dieser Rechtsprechung zum vermögensrechtlich bestimmten, abstrakt berechneten Nutzungsausfallersatz legt demgegenüber eine andere Begründung des Anspruchs auf Nutzungsentschädigung nahe. Der alternative Leitsatz lautet: Wird dem Inhaber eines Internetanschlusses die Möglichkeit genommen, seinen Zugang zum Internet zu nutzen, so ist ihm auch wegen eines hier durch hervorgerufenen immateriellen Schadens eine billige Entschädigung in Geld zu gewähren .
Stability maintenance at the grassroots: China’s weiwen apparatus as a form of conflict resolution

This working paper explores the history and potential of “stability maintenance” (weiwen) as a form of conflict resolution in China. Its emphasis on conflict resolution is novel. Previous examinations of the weiwen apparatus have concentrated on its political function, namely to manage resistance within society and maintain the authority of the party-state. This avenue of investigation has proved fruitful as a means of characterising the political motivation and the higher-level strategies involved in stability maintenance. Nonetheless, there remain significant conceptual and empirical gaps relating to how stability maintenance offices and processes actually function, particularly out of larger cities and at local levels. The research described in this paper aims to consider the effectiveness of stability maintenance as a part of the “market” for conflict resolution in local China, and to test the hypothesis that conflict resolution as facilitated by weiwen is the most pragmatic and effective means of actually resolving conflicts in the current Chinese political context, notwithstanding the closeness of the stability maintenance discourse to state authority and its relative distance from rule of law-based methods of dispute resolution...
The paper focuses on the problems of a juridical classification and evaluation of Ancient Near Eastern treaties with regard to the question if there existed an Ancient Near Eastern International Law or not. Alternatively treaties and their content are looked at uncommitted as mechanisms of conflict and dispute resolution. Main aspects are preliminary and prophylactic conflict resolution in treaties and the procedural context and efficiency of treaties.
The German Capital Markets Model Case Act (KapMuG) and its amendment of 2012 highlight some fundamentals of collective redress in civil law countries at the example of model case procedures in the field of investor protection. That is why a survey of the ongoing activities of the European Union in the area of collective redress and of its repercussions on the member state level forms a suitable basis for the following analysis of the 2012 amendment of the KapMuG. It clearly brings into focus a shift from sector-specific regulation with an emphasis on the cross-border aspect of protecting consumers towards a “coherent approach” strengthening the enforcement of EU law. As a result, regulatory policy and collective redress are two sides of the same coin today. With respect to the KapMuG such a development brings about some tension between its aim to aggregate small individual claims as efficiently as possible and the dominant role of individual procedural rights in German civil procedure. This conflict can be illustrated by some specific rules of the KapMuG: its scope of application, the three-tier procedure of a model case procedure, the newly introduced notification of claims and the new opt-out settlement under the amended §§ 17-19.
Between the 12th and 16th centuries the Hanseatic merchants obtained extremely important privileges from the rulers of the countries with whom they traded. These secured their commercial and legal status and the autonomy of their staples in Flanders, England, Norway, Denmark and Russia. Within these privileges no other subject receives so extensive a treatment as court procedure. Here, the single most important concern of the Hanseatic merchants was their position in front of alien courts. The article analyses the great attention given to court procedure in the twenty main Hanseatic privileges: What did the merchants require? Which procedural rules were necessary to encourage them to submit their disputes to alien public court instead of taking the matter into their own hands and turning to extra-judicial methods to resolve matters, e.g. cancellation of business relations, boycotts or even trade wars? This analysis suggests that the two most important concerns reflected in the procedural rules were to avoid delay to the next trading trip and to ensure a rational law of proof. The former was addressed by pressing for short-term scheduling and swift judgment and by the dispensation from appearing before the court in person. The latter included avoidance of duels and other ordeals and the attempt to obtain parity by appointing half of the jurors from Hanseatic cities.
Gerichte können einem Täter, der wegen Straftaten verurteilt wurde, die auf seinen Suchtmittelkonsum zurückgehen, die Weisung erteilen, jeglichen Alkoholkonsum zu unterlassen und sich entsprechenden Kontrollen zu unterziehen. Die Kontrolle der Weisungen stößt jedoch bislang an enge Grenzen. Bisher kann deren Einhaltung nur stichprobenartig überprüft werden. Einen neuen Ansatz bietet eine kontinuierliche (transdermale) Alkoholüberwachung mittels eines am Fußgelenk getragenen Messgerätes. Ein Blick in die USA zeigt, dass die elektronische Überwachung des Alkoholkonsums erprobt wurde und sich durchgesetzt hat. Der Beitrag untersucht die Bedeutung einer kontinuierlichen transdermalen Alkoholüberwachung für die Abstinenzkontrolle und inwieweit diese Methode im deutschen System verankert werden kann.

Der hier zu besprechende Sammelband geht auf einen Workshop an der Justus-Liebig-Universität Gießen vom 14. Juni 2008 zurück, der im Rahmen des 2008 ausgelaufenen SFB 434 "Erinnerungskulturen" abgehalten wurde....
Der Beitrag stellt im Überblick dar, welche Bedeutung das Immaterialgüterrecht (IP) für die Entwicklung einzelner Volkswirtschaften und die globale Wissensgesellschaft hat. In einem ersten Abschnitt wird erläutert, dass in der Geschichte des Immaterialgüterrechts die Vorstellung dominierte, dass Immaterialgüterrechte technologischem und sonstigem Fortschritt zuträglich sind. Im zweiten Abschnitt wird gezeigt, dass dieses lineare Expansions-Narrativ aus ökonomischer und wirtschaftshistorischer Sicht als widerlegt gelten muss. Dazu werden die Argumente der IP-Optimisten und die Gegenargumente der IP-Pessimisten anhand empirischer Studien bewertet. Der Beitrag schließt mit sozialwissenschaftlichen und normativen Schlussfolgerungen im Hinblick auf die künftige Ausgestaltung des internationalen Immaterialgüterrechts.
Die Frage nach den Zusammenhängen zwischen Normanerkennung und ökonomischem Verhalten lassen sich anhand der Wirkung von Corporate Governance Kodizes schlaglichtartig beleuchten. Der vorliegende Beitrag liefert erste theoretische Bausteine zum Zusammenwirken von Corporate Governance Kodizes und verbindlichen gesetzlichen Normen auf der Grundlage des Comply or Explain-Grundsatzes, indem er zunächst die Wirkungsweise des Kapitalmarktes, wie sie von der ökonomisch fundierten Gesellschaftsrechtstheorie vorausgesetzt wird, dem Mechanismus des Comply or Explain gegenüberstellt. Die empirischen Studien zur Wirksamkeit des Kapitalmarktes bei der Durchsetzung des Deutschen Corporate Governance Kodex im Wege des Comply or Explain lassen Raum für weitere Normanerkennungs- und –befolgungsmechanismen, die sich in Parallele zur Diskussion im Bereich der Corporate Social Responsibility und den sogenannten „business cases“ hierfür verdeutlichen lassen. Die dabei aufscheinenden Berührungspunkte ökonomischer Motivation mit sozialen Interessen geben Gelegenheit, auf Fairnessnormen als Grenzen des traditionellen Rationalmodells einzugehen. Ein ähnliches Nebeneinander und Ineinandergreifen von Eigennutzinteresse und intrinsischer Motivation lässt sich anhand der Anreizwirkung bei der Managervergütung veranschaulichen. Ihre gesetzliche Regelung im VorstAG lässt zum Teil eine empirische Absicherung vermissen. Damit schließt sich der Kreis der Analyse der Verbindlichkeitsstrukturen im Wirtschaftsrecht, nach der sich diese einem einheitlichen theoretischen Modell entziehen und deren empirische Grundlagen noch nicht zweifelsfrei geklärt sind.
Although intellectual property law is a distinctively Western, modern, and relatively young body of law, it has spread all over the world, now encompassing all but a very few outsiders such as Afghanistan, Somalia, and Vanuatu. This article presents three legal transfers that contributed to this development: first, from real property in land and movables to intellectual property in the late 18th century in Western Europe; second, from Western Europe, in particular from the United Kingdom and France to the rest of the world during the colonial era in the 19th and early 20th century; third, from the protection of new knowledge to the protection of traditional knowledge, held by indigenous communities in developing countries, on 5 August 1963. This story illuminates how legal transfers in a broad sense – including, but not limited to legal transplants - drive the evolution of law.
Seit dem Einzug der digitalen Netzwerktechnologie ist das Urheberrecht zu einem heftig umkämpften Politikum geworden. Dies gilt auch im Hinblick auf „Wissenschaft“ als urheberrechtlichen Schutzgegenstand. Ob das Verhältnis zwischen Urheberrecht und Wissenschaft allerdings überhaupt als problematisch erscheint und welche Lösungsansätze für einen ggf. wahrgenommenen Konflikt präferiert werden, hängt maßgeblich von der Perspektive ab. Der Beitrag unterscheidet insoweit eine urheberrechtliche von einer wissenschaftstheoretisch/-soziologischen Betrachtungsweise. Es zeigt sich, dass nur Letztere geeignet ist, den gegenwärtig stattfindenden, grundlegenden Wandel des wissenschaftlichen Kommunikationssystems zu erklären und adäquate Regulierungsvorschläge zu entwickeln.
Sowohl die exklusive Vermarktung steuerfinanzierter wissenschaftlicher Werke durch Verlage als auch das Wissenschaftsurheberrecht stehen seit längerem in der Kritik. Die Open-Access-Bewegung tritt dafür ein, dass überwiegend öffentlich geförderte wissenschaftliche Ergebnisse frei im Internet verfügbar sein sollen. Die Implementierung dieses Ideals stößt aber auf erhebliche Beharrungskräfte. Deshalb gehen öffentliche Forschungsförderer vermehrt dazu über, Wissenschaftler zu Open-Access-Publikationen zu verpflichten. Der Beitrag skizziert die rechtlichen Maßnahmen, die ergriffen werden müssten, um Open Access zum Goldstandard der wissenschaftlichen Veröffentlichung zu küren. Ferner geht der Beitrag der Frage nach, ob ein solches Regelwerk Grundrechte der Verlage und der Wissenschaftler verletzen würde.
The article makes two points regarding the fundamental rights dimensions of intellectual property (IP). First, it explains why the prevailing approach to balancing the fundamental right to intellectual property with conflicting fundamental freedoms as if they were of equal rank is conceptually flawed and should be replaced by a justification paradigm. Second, it highlights the pre-eminent role of the legislature and the much more limited role of the judiciary in developing IP law. The arguments are based on an analysis of the jurisprudence of the European Court of Human Rights (ECHR), the Court of Justice of the European Union (CJEU) and last but not least the German Constitutional Court, the Bundesverfassungsgericht, regarding the respective inter-/supra-/national fundamental-rights regimes.

Das dominante Rechtfertigungsnarrativ des kontinentaleuropäischen Urheberrechts ist der Schutz des kreativen Urhebers. Das diesbezügliche Leitbild ist der romantische Genius, der fern der Welt auf Hilfe durch Verwerter und einen starken Schutz seines „geistigen Eigentums“ in ihren Händen angewiesen ist. Im digitalen Zeitalter ist jedoch ein neuer Typus des Urhebers hervorgetreten: der digitale Urheber. Ihre Inspirationsquelle und zugleich ihr unternehmerisches Verbreitungs- und Vermarktungsmedium ist das globale Netz. Der Beitrag erörtert, welche Konsequenzen sich insbesondere für das Urhebervertragsrecht ergeben, wenn das Leitbild des digitalen Urhebers an die Stelle des romantischen/analogen Urhebers tritt.
In 2003, a number of banks adopted the Equator Principles (EPs), a voluntary Code of Conduct based on the International Finance Corporation’s (IFC) performance standards, to ensure the ecological and social sustainability of project finance. These so called Equator Principles Financial Institutions (EPFI) commit to requiring their borrowers to adopt sustainable management plans of environmental and social risks associated with their projects. The Principles apply to the project finance business segment of the banks and cover projects with a total cost of US $10 million or more. While for long developing countries relied on World Bank and other public assistance to finance infrastructure projects there has occurred a shift in recent years to private funding. The NGOs have been frustrated by this shift of project finance as they had spent their resources to exercise pressure on the public financial institutions to incorporate environmental and social standards in their project finance activities. However, after a shift of NGO pressure to private financial institutions the latter adopted the EPs for fear of reputational risks. NGOs had laid down their own more ambitious ideas about sustainable finance in the Collevecchio Declaration on Financial Institutions and Sustainability. Legally speaking, the EPs are a self-regulatory soft law instrument. However, it has a hard law dimension as the Equator Banks require their borrowers to comply with the EPs through covenants in the loan contracts that may trigger a default in a case of violation. ...
Ab Donnerstag, 21. November, wollen wir mit Wissenschaftler_innen und Praktiker_innen aus Recht und Netzpolitik über die rechtlichen und gesellschaftlichen Herausforderungen des Persönlichkeitsschutzes im Internet diskutieren. In der Veranstaltungsreihe "Persönlichkeitsrecht 2.0" an der HU Berlin, sollen die Entfaltung und Verletzung der Persönlichkeitsrechte im Internet wissenschaftlich aufgearbeitet werden.
Das Urheberrecht hat einmal eine unabhängige Verlagswirtschaft ermöglicht, mit den digitalen Produktionsweisen ergeben sich jedoch immer mehr Konflikte. Alexander Peukert, Professor für Bürgerliches Recht, Wirtschaftsrecht und internationales Immaterialgüterrecht an der Uni Frankfurt, zeichnet die Entwicklung und aktuelle Probleme im Interview nach.
Recht und die Vorstellung von dem, was Recht ist, sind nicht allein an Territorien oder Herrschaften gebunden, sondern wandern mit den Menschen mit. Treffen mehrere möglicherweise anwendbare Rechte aufeinander, steht für heutige Gerichte ein Kollisionsrecht wie das Internationale Privatrecht bereit, dass über den Umgang mit diesem Konflikt entscheidet , indem es den Fall einer bestimmten nationalstaatlichen Regelung unterstellt. Andere Lösungen sind jedoch ebenfalls denkbar und wurden in der Vergangenheit auch praktiziert, was heute schwer nachzuvollziehen ist. Um die Denkstruktur und Grenzen der modernen Herangehensweise deutlich werden zu lassen, sollen in diesem Beitrag die Schwierigkeiten erläutert werden, das Konzept des Internationalen Privatrechts auf das Neben- und Miteinander verschiedener rechtlicher Traditionen im hellenistischen Ägypten zu übertragen. Ziel ist es, auch Nichtjuristen damit einen Einstieg und eine Übersicht über die Diskussion innerhalb der antiken Rechtsgeschichte zu ermöglichen.

Datenschutz ist kein national zu bewältigendes Problem mehr. Datenhandel findet weltweit statt, und viele Anbieter nehmen Datenverwendungen außerhalb Deutschlands und Europas wahr. An einem international gültigen Rechtsregime fehlt es indes, ebenso wie an Kollisionsregelungen, welche nationalen Regelungen im Konfliktfall anwendbar sein sollen. Die europäische Datenschutzrichtlinie trifft hier zwar eindeutige Regelungen und erklärt im Prinzip jede Datenverarbeitung auf europäischem Boden als gebunden an die Vorgaben des europäischen Rechts. Mit dieser Einschränkung im Rahmen des sog. "Territorialitätsprinzips" kann sie allerdings keinen Einfluss ausüben auf Datenverarbeitungen außerhalb Europas – auch wenn die verarbeiteten Daten von europäischen Bürgern stammen. ...
Um den Teufelskreis sich wechselseitig verstärkender Banken- und Staatsschuldenkrisen zu durchbrechen, haben sich die europäischen Institutionen grundsätzlich dazu bekannt, eine Bankenunion zu schaffen. Der Dreh- und Angelpunkt der verfolgten Strategie liegt dabei darin, durch die Schaffung zentraler, d.h. supranationaler Auffangmechanismen die Ausfallrisiken von Banken und Staaten nachhaltig zu entkoppeln. Dabei ist zu beachten, dass gerade auch die einzelnen Elemente des institutionellen Reformpakets in ihrer Binnenstruktur so beschaffen sein müssen, dass vorhersehbare Ineffizienzen nicht dazu führen, dass Vorteile der Supranationalisierung aufgehoben oder gar in ihr Gegenteil verkehrt werden. Der vorliegende Beitrag diskutiert den Verordnungsentwurf der EU Kommission für einen Single Resolution Mechanism (SRM) vor dem Hintergrund dieser Forderung.
Der hier erstmals veröffentlichte zweite Band der Habilitationsschrift aus dem Jahre 1991 enthält die empirischen Untersuchungen, die der Hypothesenentwicklung und –prüfung zugrundliegen. Das Titelblatt der Gesamtschrift und deren Inhaltsverzeichnis sind vor dem zweiten Band eingefügt.
Der erste Band wurde 1996 veröffentlicht unter dem Titel: Selbst-Gerechtigkeit. Zum Verhältnis von Juristenpersönlichkeit, Urteilsrichtigkeit und „effektiver Strafrechtspflege“, im Nomos Verlag, Baden-Baden, veröffentlicht. Eine zweite Auflage wird Ende 2013, Anfang 2014 ebendort publiziert. Dort finden sich zahlreiche Verweise auf den zweiten Band.
Der EGMR in Straßburg hat letzte Woche eine Entscheidung veröffentlicht, die in diesen Zeiten der Staatsschuldenkrise die Banken die Ohren spitzen lassen dürfte: Die Mitgliedsstaaten der EMRK dürfen ihre insolventen Kommunen nicht davor schützen, dass deren Gläubiger ihre rechtskräftig festgestellten Ansprüche eintreiben und in das Kommunalvermögen vollstrecken. Ein kommunales Insolvenzrecht, das vollstreckbare Titel wirkungslos macht, verstößt nach Meinung einer EGMR-Kammer gegen die Europäische Menschenrechtskonvention. Denn solche Titel gelten als Eigentum, und das setzt sich auch gegen das öffentliche Interesse durch, die kommunalen Schulen, Bibliotheken und Schwimmbäder vor dem Gerichtsvollzieher zu schützen. ...
Diese Monographie widmet sich als erstmals den Testamenten in den dalmatinischen Städten. Sie fußt auf breiter archivalischer Basis, untersucht werden zahlreiche Dokumente aus den Stadtarchiven von Zadar, Trogir, Dubrovnik (Kroatien) und Kotor (Montenegro). Ladićs Buch besteht aus drei Teilen. Im ersten führt der Autor in die methodologischen Konzepte zur Untersuchung mittelalterlicher Testamente nach Form und Inhalt ein. Die Besonderheiten der Rechts- und Sozialstruktur der dalmatinischen Städte wird hier neben den Eigenheiten der Quellen (Testamente der Stadtbürger und Statuten) in Augenschein genommen. Ladić beschließt diesen ersten Abschnitt mit der Feststellung, dass die Testamente als Quellen für die Sozial- und Religionsgeschichte des Mittelalters noch immer nicht ausreichend von Historikern in ihre Forschungen eingebettet wurden. Der zweite Teil ist der quantitativen Analyse der Verteilung der Testamente pro Jahr und pro Monat in vergleichender Perspektive gewidmet. Besondere Aufmerksamkeit gilt den Erblassern und ihrer Motivation. Der dritte Teil beschäftigt sich mit dem Motiv pro remedio animae, d.h. mit der Manifestation mittelalterlicher Frömmigkeit in den Testamenten, den Formen der Spendentätigkeit und den Empfängern der frommen Legate. Dies wird in zwei Anhängen in tabellarischer Form veranschaulicht, nämlich einer Namensliste der Testatoren aus der Stadt Zadar und einer Übersicht der religiösen Institutionen, die als Empfänger der frommen Legate in den Testamenten der Bürger in den Küstenstädten begegnen. ...
Das im Jahr 2013 begonnene und für einen Zeitraum von 18 Jahren konzipierte Forschungsvorhaben zielt auf die Erstellung eines historisch-semantischen Wörterbuchs zum Denken der Schule von Salamanca und ihrer Bedeutung für politische Theorie und Recht in der Moderne. Als Grundlage dieses Wörterbuchs wird ein digitales Corpus von zentralen Texten der Schule von Salamanca aufgebaut, das mit der elektronischen Version des Wörterbuchs verknüpft ist und der internationalen und interdisziplinären Forschergemeinschaft direkten Zugriff auf die einschlägigen Quellentexte ermöglicht. Durch die Volltexterschließung der digitalen Quellen wird zugleich ein in seiner Funktionalität neuartiges elektronisches Arbeitsinstrument geschaffen, das einen wichtigen Fortschritt gegenüber allen bisherigen Digitalisierungsprojekten in diesem Bereich darstellt. Dieses Arbeitsinstrument wird auch über seine Funktionalität für das zu erstellende Wörterbuch hinaus qualitativ neue Forschungsmöglichkeiten eröffnen.
Beides – Wörterbuch und Quellencorpus – werden in einem repository erfasst und über eine Webseite als Forschungsinstrument der internationalen scientific community zur Verfügung gestellt. Das Wörterbuch wird zum Schluss der letzten Arbeitsphase zusätzlich in Buchform publiziert. Die weltweite Forschung zur Schule von Salamanca und zu ihrer Wirkungsgeschichte wird damit zum ersten Mal Zugriff auf ein gemeinsames Textcorpus haben und über einen intellektuellen Referenzrahmen für dessen historische Unter-suchung und interdisziplinäre Diskussion verfügen.
Dieser Beitrag soll Ausgangslage und Zielsetzung des Vorhabens zusammenfassen (1.), das geplante Quellencorpus (2.), das Wörterbuch (3.) und den Arbeitsplan (4.) vorstellen.
Nietzsche unterscheidet in seiner so unzeitgemäßen wie unvergleichlichen Schrift "Vom Nutzen und Nachtheil der Historie für das Leben" bekanntlich drei Arten von Historie, die, wenn sie sich vereinigen, dem Lebendigen dienen, anstatt es zu Grunde zu richten. Zumindest zwei dieser drei Anforderungen (vielleicht auch alle drei) erfüllt Fleckners wegweisende, von Reinhard Zimmermann betreute Regensburger Dissertation: Sie ist dem Inhalt nach "kritisch", da sie die Kraft hat, "eine Vergangenheit zu zerbrechen und aufzulösen, um leben zu können", und sie ist der Form nach "antiquarisch", da sie durch Pietät gleichsam den Dank für ihr Dasein abträgt. ...
During the late Middle Ages, the subject of Berman’s focus, the West, equalled a Europe whose overseas expansion had not yet begun. This recalls the "Europe of legal historians" as their attempt, efficiently caricatured by Dieter Simon, to determine the borders of the continent on the basis of a medieval state of affairs. Such a historical justification of geopolitical concepts is risky, but nonetheless common. In the Middle East, the borders of Biblical regions legitimize present or future frontiers. Berman shared the usual ideas of legal history as regards the modern being nothing else than a protraction or renewal of the old, when he identified the papal revolution of 1075 as the factor having durably impregnated western legal culture. ...

"In diesem working paper fasse ich einige Überlegungen zur Internationalisierung und Transnationalisierung der deutschen Rechtswissenschaft zusammen. Dabei skizziere ich die Bedeutung der nationalstaatlichen Tradition und Funktion der Rechtswissenschaft (1., 2.), konzentriere mich anschließend auf die Herausbildung Transnationalen Rechts und die damit verbundene Frage nach einer Transnationalen Rechtswissenschaft (3.). Ich versuche anzudeuten, weswegen eine solche Transnationale Rechtswissenschaft in besonderer Weise auf Transdisziplinarität angewiesen ist (4.) und schließe einige Bemerkungen zu der Frage an, wie die deutsche Rechtswissenschaft sich in einer solchen Transnationalen Rechtswissenschaft verorten könnte (5.).
Die Folgerungen, die sich für das Wissenschaftssystem, also für Forschung und Lehre, aus den mit einer Transnationalen Rechtswissenschaft verbundenen Anforderungen ergeben, sind vielfältig. Es gibt aktuellen Anlass und gute Gründe, über diese intensiver nachzudenken (6.). In diesem paper sollen einige Überlegungen skizziert werden, die der Konzeption der LOEWE-Ringvorlesung „Die Justiz vor den Herausforderungen der kulturellen Diversität – rechtshistorische Annäherungen „zu Grunde liegen. Der Text kann nicht mehr als eine Diskussionsgrundlage sein und den Ort der Beiträge im Gesamtvorhaben aufzeigen – ohne die Referentinnen und Referenten damit festlegen zu wollen. Die angesprochenen Fragen sind sehr umfangreich und können sehr unterschiedlich verstanden werden – so gibt es eben z.B. keine Definition von ‚Diversität’ und keinen festen Kanon von mit diesem Terminus umschriebenen Realitäten. Für viele Aspekte bedürfte es eingehender rechtssoziologischer, -theoretischer, -anthropologischer Reflexion. Umso wichtiger schien es, einen Diskussionsvorschlag zu Perspektiven und Termini für das gemeinsame Gespräch im Semester und im LOEWE-Schwerpunkt „Außergerichtliche und gerichtliche Konfliktlösung“ zu machen. Auch die hier zitierte Literatur kann nur Schlaglichter auf ein sehr dynamisch anwachsendes Schrifttum werfen. Im Sinne einer ‚forschungsnahen Lehre‘ wird dabei bewusst auf aktuelle Forschungsvorhaben hingewiesen.
In Spanien blickte man, wie wohl in keinem anderen Land Europas, auf reiche Erfahrungen mit der Inkorporation großer Gruppen Fremdgläubiger, auf massenhafte und nicht immer von äußerem Zwang freie Erwachsenentaufen zurück. Im 15. Jahrhundert hatten die Taufen von Juden, im 16. Jahrhundert die von Muslimen zu zahlreichen politischen, rechtlichen und theologischen Problemen geführt. Weitere Dimensionen erhielten die Fragen nach Taufe, Orthodoxie und Kirchenangehörigkeit durch die Reformation in Europa einerseits und die Mission in Lateinamerika andererseits. ...
Thirty years ago, in 1983, Harold Berman’s Law and Revolution: The Formation of the Western Legal Tradition was first published. His work had an enormous impact on legal scholarship all over the world. Many aspects of his central thesis – that there was something akin to a "papal revolution" in eleventh century Europe; that this "revolution" set a pattern for future epochs of transformation; that the special relation between Religion and Law was a distinct feature of the "Western Legal Tradition" – were largely discussed by legal historians, historians and social scientists. Others, like his "Social Theory of Law", received less attention. Although there had been strong criticism by scholars, especially medievalists, on some aspects of Berman’s work, it has become a standard reference in scholarly writings, not least outside of Europe. Since its appearance in 1983, Law and Revolution has been translated into German, French, Chinese, Japanese, Russian, Polish, Portuguese, Spanish, Italian, and Lithuanian. Twenty years later, in 2003, with his project entitled Law and Revolution II: The Impact of the Protestant Reformations on the Western Legal Tradition, Berman presented the second volume of what was thought to be a trilogy. Twenty years had gone by, the political world order had changed, but Berman’s main point, the importance of analyzing the role of Religion and Law, and the specific constellation of these two modes of normative thought, had gained new currency. In 2007, Harold J. Berman passed away, but not without having opened his historical and legal thought to the challenges of a globalized world. ...
Eine erstaunliche Tatsache: Ein amerikanischer Rechtswissenschaftler, im Denken des common law geschult, dann hervorgetreten vor allem mit Studien zur Rechtsvergleichung und zum Recht der Sowjetunion, schreibt in vorgerückten Jahren ein umfassendes Werk über die mittelalterlichen Ursprünge der Rechtstradition des Westens. Diese verankert er in jenem politisch-religiösen Konflikt, den wir einmal unter dem Begriff "Investiturstreit" kennen gelernt haben. Inzwischen wird er als Vorspiel der "Renaissance des 12. Jahrhunderts" gesehen. Für Berman handelt es sich jedoch um die "päpstliche Revolution", the Papal Revolution. Diesem Band "Law and Revolution" von 1983 hatte Berman im hohen Alter 2003 noch einen zweiten mit dem gleichen Titel folgen lassen, dessen Gegenstand ebenfalls im Untertitel genauer umschrieben wird: "The impact of the protestant reformations on the Western legal tradition". ...
Alle historische Forschung basiert auf einer Selektion von Themen, die sich aus dem Kontext ergeben, in dem diese Selektion stattfindet. Historische Forschung ist selbst zeitgebunden, und das beeinflusst ihre Perspektiven und Fragestellungen, nicht aber ist die Geschichtswissenschaft in der Lage, eine zeitlose Wahrheit über die Vergangenheit zu erschließen. Eine Suche nach dem "wie es eigentlich gewesen ist" muss auch daran scheitern, dass historische Forschung immer mit Wissen und Nicht-Wissen zugleich konfrontiert wird. Auch die rechtshistorische Forschung ist stets ein Subjekt ihrer Zeit, und auch sie muss akzeptieren, dass historisches Wissen notwendigerweise unvollständig ist. Die Rechtsgeschichte kann immer nur Fragmente der Objektivität der Geschichte rekonstruieren, sie kann nur "die sichtbare Seite einer Gesellschaft – Institutionen, Denkmäler, Werke, Gegenstände" zugänglich machen, nicht aber ihre "verborgene, unsichtbare Seite: Vorstellungen, Wünsche, Ängste, Verdrängungen, Träume". Tradition, heißt es dazu bei Harold Berman auch, "ist mehr als historische Kontinuität. Eine Tradition ist eine Mischung aus bewußten und unbewußten Elementen." ...
Beim Stichwort Inquisition fällt der Blick zumeist nach Spanien, Portugal oder Italien und nicht auf das Alte Reich, denn dort wurde die Inquisition im Gegensatz zum Süden Europas nie institutionalisiert. Die Frage, warum es im Alten Reich nicht zur Einführung von Tribunalen kam und in welchen anderen Formen die Inquisition dort agierte, stand im Herbst 2009 im Zentrum einer Tagung, deren Ergebnisse nun in einem Sammelband vorliegen. Die Aktivitäten der Inquisition werden nicht nur für den deutschen Sprachraum analysiert, sondern auch mit anderen Ländern in Bezug gesetzt und verglichen. Dies erscheint sinnvoll, da die Inquisition und ihre Rezeption im Alten Reich ohne den Einbezug ihres Wirkens in den romanischen Ländern nicht beurteilt werden kann. Trotz der internationalen Bezüge stammen alle Beiträge, bis auf eine Ausnahme, aus der Feder deutschsprachiger Autoren. Es fällt dann auch auf, dass die spanische Inquisition – abgesehen von den Tribunalen in den spanischen Niederlanden – im Gegensatz zur italienischen und portugiesischen nicht thematisiert wird. Auch in der Einführung wird so gut wie keine aktuelle spanische Literatur genannt. Hier zeigt sich, dass ihre Erforschung auf deutscher Seite bisher kaum betrieben noch rezipiert wurde. Auch die zentrale Frage, ob es Pläne zur Institutionalisierung einer Inquisition in einzelnen katholischen Territorien gab, ist nach wie vor ein Forschungsdesiderat. Auszuschließen ist diese Möglichkeit laut den Herausgebern nicht. Warum es nicht dazu kam, wird mit der Durchsetzung des landesherrlichen Kirchenregiments begründet sowie mit Vorbehalten der Fürsten, für die eine institutionalisierte Inquisition eine Beschränkung ihrer Herrschaftsrechte bedeutet hätte. ...

In Germany, the termination of employment contracts is a central and often intensely debated legal issue today. This is not surprising since employment termination entails substantial risks for the person affected and threatens the very foundation of his or her economic existence. This is why both politics and legal dogmatics place the individual engaged in dependent work at the centre of concern as a subject requiring protection. In Germany, labour law ("Arbeitsrecht") emerged as an independent field of law focusing on the persona of the dependent worker ("Arbeitnehmer") and its typified normative ascriptions. This process took place in the course of the 20th century, as the concept of the principal requirement that employees be protected against unforeseen or unjustified dismissal became increasingly established, giving rise to very intricate regulations. Social security is a guiding motif of this legislation which regards contract termination primarily as a risk. It is often not considered that this constellation is a very new one. Defined conceptions of the interests of the parties to labour contracts also existed before 1900, but social security was then not a central criterion. At that time, many people perceived the termination of their employment as an opportunity rather than primarily as a risk. Employers, on the other hand, aimed to keep people in their service for as long as possible. In the late 19th century, the enforcement of labour performance by legal means and normative instruments, which no longer plays any role today, was still an important issue. This provides occasion to investigate the freedom of working people from the perspective of the history of law, whereby this article focuses on the history of the German-speaking territories. ...

Eine Verfassung garantiert mehr oder weniger verbindlich individuelle Rechte, flankiert von einer prinzipiell nach Vertragsfreiheit und Eigentumsfreiheit gestalteten Privatrechtskodifikation. Zu Beginn des 20. Jahrhunderts gerät das liberale Gleichgewicht jedoch ins Wanken. Arbeitende Menschen artikulieren ihre Interessen schärfer als zuvor, es entsteht revolutionärer Sprengstoff, die "soziale Frage" ist allgegenwärtig und das Privatrecht der alten Ordnung scheint keine Antworten darauf zu haben. This paper analyzes the evolving architecture for the prudential supervision of banks in the euro area. It is primarily concerned with the likely effectiveness of the SSM as a regime that intends to bolster financial stability in the steady state.
By using insights from the political economy of bureaucracy it finds that the SSM is overly focused on sharp tools to discipline captured national supervisors and thus under-incentives their top-level personnel to voluntarily contribute to rigid supervision. The success of the SSM in this regard will hinge on establishing a common supervisory culture that provides positive incentives for national supervisors. In this regard, the internal decision making structure of the ECB in supervisory matters provides some integrative elements. Yet, the complex procedures also impede swift decision making and do not solve the problem adequately. Ultimately, a careful design and animation of the ECB-defined supervisory framework and the development of inter-agency career opportunities will be critical.
The ECB will become a de facto standard setter that competes with the EBA. A likely standoff in the EBA’s Board of Supervisors will lead to a growing gap in regulatory integration between SSM-participants and other EU Member States.
Joining the SSM as a non-euro area Member State is unattractive because the cur-rent legal framework grants no voting rights in the ECB’s ultimate decision making body. It also does not supply a credible commitment opportunity for Member States who seek to bond to high quality supervision.

Das Banken- und Versicherungsaufsichtsrecht benennt an mehreren Stellen ausdrücklich gruppenbezogene Pflichten des übergeordneten Unternehmens. Deren Realisierbarkeit hängt von gesellschafts-, insbesondere konzernrechtlichen Schranken ab, die für die Einflussnahme auf nachgeordnete Gruppenunternehmen bestehen. Der vorliegende Beitrag betrachtet das Zusammenspiel von Aufsichts- und Gesellschaftsrecht unter besonderer Berücksichtigung der regelungstragenden Ziele des ersteren. Die Gruppenverantwortung ist in dieser Sicht ein Institut, das zur Verwirklichung eines klar umrissenen, öffentlichen Interesses an der Befolgung bestimmter Normen das übergeordnete Unternehmen als interne Kontrollinstanz in die Pflicht nimmt und mit gruppendimensionalen Handlungspflichten belegt. Zur Gewährleistung der Effektivität dieses Instituts ist ein sektoral begrenzter Vorrang der aufsichtsrechtlichen Vorgaben anzuerkennen. Dieser ist durch die angemessene Berücksichtigung des mit dem Aufsichtsrecht verfolgten, öffentlichen Interesses als normativer Determinante der Leitungstätigkeit aller gruppenangehörigen Institute zu verwirklichen.

In 2003, a number of banks adopted the Equator Principles (EPs), a voluntary Code of Conduct based on the International Finance Corporation’s (IFC) performance standards, to ensure the ecological and social sustainability of project finance. These so called Equator Principles Financial Institutions (EPFI) commit to requiring their borrowers to adopt sustainable management plans of environmental and social risks associated with their projects. The Principles apply to the project finance business segment of the banks and cover projects with a total cost of US $10 million or more. While for long developing countries relied on World Bank and other public assistance to finance infrastructure projects there has occurred a shift in recent years to private funding. The NGOs have been frustrated by this shift of project finance as they had spent their resources to exercise pressure on the public financial institutions to incorporate environmental and social standards in their project finance activities. However, after a shift of NGO pressure to private financial institutions the latter adopted the EPs for fear of reputational risks. NGOs had laid down their own more ambitious ideas about sustainable finance in the Collevecchio Declaration on Financial Institutions and Sustainability. Legally speaking, the EPs are a self-regulatory soft law instrument. However, it has a hard law dimension as the Equator Banks require their borrowers to comply with the EPs through covenants in the loan contracts that may trigger a default in a case of violation. ...

This paper outlines relatively easy to implement reforms for the supervision of transnational banking-groups in the E.U. that should not be primarily based on legal form but on the actual risk structures of the pertinent financial institutions. The proposal also aims at paying close attention to the economics of public administration and international relations in allocating competences among national and supranational supervisory bodies.
Before detailing the own proposition, this paper looks into the relationship between sovereign debt and banking crises that drive regulatory reactions to the financial turmoil in the Euro area. These initiatives inter alia affirm effective prudential supervision as a pivotal element of crisis prevention.
In order to arrive at a more informed idea, which determinants apart from a per-ceived appetite for regulatory arbitrage drive banks’ organizational choices, this paper scrutinizes the merits of either a branch or subsidiary structure for the cross-border business of financial institutions. In doing so, it also considers the policy-makers perspective. The analysis shows that no one size fits all organizational structure is available and concludes that banks’ choices should generally not be second-guessed, particularly because they are subject to (some) market discipline.
The analysis proceeds with describing and evaluating how competences in prudential supervision are currently allocated among national and supranational supervisory authorities. In order to assess the findings the appraisal adopts insights form the economics of public administration and international relations. It argues that the supervisory architecture has to be more aligned with bureaucrats’ incentives and that inefficient requirements to cooperate and share information should be reduced. The evolving Single Supervisory Mechanism for euro area banks with its rather complicated allocation of responsibilities between the ECB and the national supervisors in participating and non-participating Member States will not solve all the problems identified as it is partly in disaccord with bureaucrats’ incentives.
The last part of this paper finally sketches an alternative solution that dwells on far-reaching mutual recognition of national supervisory regimes and allocates competences in line with supervisors’ incentives and the risk inherent in cross-border banking groups.
Fazit: Im Gegensatz zu ihrem US-amerikanischen Vorbild ist die deutsche Business Judgment Rule kein „sicherer Hafen“, der Organmitgliedern das Privileg eines haftungsfreien Raums für unternehmerische Entscheidungen eröffnen würde. §§ 93 Abs. 1 Satz 2, 116 Satz 1 AktG formulieren vielmehr lediglich – mit ihrerseits ausfüllungsbedürftigen Begriffen – die Anforderungen an die Entscheidungsfindung eines ordentlichen und gewissenhaften Geschäftsleiters oder Überwachers. Dementsprechend gelten für Entscheidungen außerhalb des unmittelbaren Anwendungsbereichs der Business Judgment Rule keine grundsätzlich anderen Anforderungen. Bei der Festlegung dieser Voraussetzungen an einen ordnungsgemäße Entscheidung ist zu beachten, dass die organschaftliche Sorgfaltspflicht und die Haftungsfolgen für den Fall ihrer Verletzung sich nicht etwa das Gremium insgesamt, sondern an jedes einzelne seiner Mitglieder richten. Daher sollten insbesondere die Standards an eine angemessene Information und an die Plausibilitätskontrolle eingeholter Auskünfte und Expertisen nicht so hoch angesetzt werden, das sie realistischerweise von niemandem erfüllt werden können.Angesichts des zunehmenden Bewusstseins für die mit einer Organmitgliedschaft verbundenen Haftungsgefahren dürfte es sonst in Zukunft schwieriger werden, qualifizierte Aufsichtsratsmitglieder für deutsche Unternehmen zu gewinnen.
Die Mitteilungspflicht des Legitimationsaktionärs - zugleich Anmerkung zu OLG Köln AG 2012, 599

In seinem Urteil vom 6. Juni 2012 hat das Oberlandesgericht Köln entschieden, Legitimationsaktionäre unterlägen im Hinblick auf die Stimmrechte aus den ihnen anvertrauten Namensaktien einer Mitteilungspflicht nach § 21 Abs. 1 WpHG. Die folgende Besprechung kommt nach einer Auseinandersetzung mit den Argumenten des Oberlandesgerichts zu dem Ergebnis, dass eine Mitteilungspflicht von Legitimationsaktionären nur auf Grundlage von § 22 Abs. 1 Nr. 6 WpHG in Betracht kommt.
Vor Kurzem hat das koreanische Höchstgericht den lebensverkürzenden Behandlungsabbruch durch die Entnahme des Beatmungsgeräts als zulässig befunden. Dafür sollen zwei Voraussetzungen erfüllt sein; 1) der Eintritt des irreversiblen Todesprozesses, 2) der ernstliche mutmaßliche Wille des Patienten. Dabei sind auch die folgenden abweichenden Meinungen vertreten. Sie gehen davon aus, dass im betreffenden Fall der nahe Todesvorgang noch nicht eingetreten ist. Darüber hinaus darf die Selbstbestimmung des Patienten nur in der negativen Weise vollzogen und keinesfalls in positiver Weise, denn dies würde den Selbstmord bedeuten. Außerdem ist der mutmaßliche Wille der Patientin von ihrem hypothetischen zu unterscheiden. Allerdings könnte der Behandlungsabbruch unabhängig vom Willen des Patienten ohne Rekurs auf die Selbstbestimmung des Patienten genehmigt werden, wenn auf die immanenten Schranken des ärztlichen Auftrags abgestellt werden. In der Sterbehilfe steht die Unverfügbarkeit des Lebens im Gegensatz zu der Selbstbestimmung des Patienten. Dabei zeigt sich aber, dass der Schutz des Lebens angesichts der Tötung im Krieg oder in der Notwehrlage nur ein relativer ist. Genauso lässt sich das Recht des Patienten nicht als das auf das eigene Leben, sondern lediglich als das auf den natürlichen Tod verstehen. Im vorliegenden Fall kommt es in rechtlicher Hinsicht auf sog. Passive Sterbehilfe an. Wenn hier der in Kürze bevorstehende Todeseintritt und die mutmaßliche Einwilligung der Patienten nicht abzulehnen ist, soll der Behandlungsabbruch rechtfertigt werden. Allerdings darf der einseitige Behandlungsabbruch nicht bewilligt werden und zwar vor allem deshalb, weil das Selbstbestimmungsrecht des Patienten vernachlässigt werden kann.
Es wird eine Verbindung zwischen dem von Antiphon entwickelten infinitesimalen Berechnungsverfahren, der Theorie Verteilungsgerechtigkeit von Aristoteles, des Hebelgesetzes, der eben radialen Figuren und der Verteilung hergestellt.
Die Problemstellung stellt sich wie folgt dar: dem Kennenlernen der Gründe, die Antiphon mutmaßen ließ, die Exhaustionsmethode als ein Mittel der Bildung des Quadratur des Kreises anzusehen, Beziehungen von grundsätzlicher und historischer Art zwischen der Verteilungsgerechtigkeit und den Hebelgesetz herzustellen, ein Model der Verteilungsgerechtigkeit, basierend auf der modernen Mathematik der Verteilung, von multipler Partizipierung zu konstruieren.
Die Zielsetzungen sind:
Die These zu erstellen, dass die Exhaustionsmethode aus der Gerichtspraxis stammt; dass das Hebelgesetz und die Theorie der Proportionen von Eudoxos Modelle der Verteilungsgerechtigkeit von Aristoteles sind; weiter soll gezeigt werden, dass die ebene Verteilung der materiellen Partikel auch ein Modell der Verteilungsgerechtigkeit ist.
Das Modell der Mehrteiligkeit der Verteilung, das vorgestellt wurde, enthält zwei Arten von Freiheitsgraden, einen für den Wert der zu verteilenden Güter an jeweils einen der Beteiligten und einen zweiter Freiheitsgrad für die verschieden Ebene zwischen den Beteiligten im Falle der Ungleichheit.

The aim of this contribution is to introduce and outline a third theory of rights. Concentrating on claim-rights, it proposes to approach this aim via the concept of a directed duty. This approach is justified by the widely shared presupposition that an entity has a right if and only if a duty is owed to this entity. Unlike some prominent other proposals, this contribution does not contrast directed duties with undirected ones. It contrasts two ways a duty can be related to an entity. On the one hand, a duty can be owed to an entity. In this case it is directed to this entity. On the other hand, a duty can concern an entity. There is no reason to presuppose that they exclude each other, on the contrary. Theories of rights have to reconstruct the difference between these two ways a duty can be related to an entity. After having introduced the starting point for a theory of rights in that way, the two classic theories of rights will be rejected, the will theory and the interest theory. The main focus lies on the shortcomings of the different versions of the interest theory. This criticism helps to formulate the conditions a convincing theory of rights has to meet. In the last part, the status theory of rights will be outlined.
Es ist die Aufgabe der Wissenschaft, richtige, d.h. möglichst vernünftige Entscheidungen anzuleiten. Der wissenschaftliche Geltungsanspruch umfasst immer sowohl einen Wahrheits- wie einen Wert- und einen Gerechtigkeitsanspruch.
Vernunft lässt sich nur in einem sowohl rationalen wie interrationalen Diskurs annähern:
(1) Im rationalen Diskurs wird der Anspruch erhoben, innerhalb einer bestimmten Rationalität richtige Antworten auf ausgewählte Fragen zu finden (meist innerhalb der Grenzen bestimmter institutionalisierter Schulen oder Disziplinen).
(2) Der interrationale Diskurs setzt bei der Relation zwischen verschiedenen Fragen mit unterschiedlicher Rationalität an und versucht,
(a) zwischen diesen Fragen eine wechselseitige Verständigung herzustellen (Diskurs zur Verständlichkeit), bevor er
(b) auf den Diskurs über die Richtigkeit von Antworten verschiedener Fragestellungen im Zusammenhang eintritt (materieller interrationaler Diskurs).
Der interrationale Diskurs bedarf der Verfassung:
(1) Formelle Verfassung des Diskurses
(a) Institutionelle Strukturen und Prozesse (Gleichberechtigung aller Beteiligten, Symmetrie der Strukturen, z.B. die Tagesordnung einer Ratssitzung)
(b) Methodische Argumentationsstrukturen und -abläufe (Wahrheit, Wert und Gerechtigkeit; Fragen- und Antwortdimension).
(2) Materielle Verfassung: Inhaltliches Argumentarium guter Gründe im Diskurs (bewährte Argumente aus bisherigen Diskursen).
Der religiöse Pluralismus innerhalb der multikulturellen Gesellschaft erfordert vom Staat das Bemühen, die wechselseitige Achtung nicht nur zwischen Personen mit unterschiedlichen religiösen Glaubensüberzeugungen, sondern auch zwischen Glaubenden und Nicht-Glaubenden sicherzustellen. In diesem Kontext wird es für die vom Staat übernommene Funktion entscheidend sein, rechtzeitig zu beurteilen, ob er eine aktive und positive Rolle als eine Institution spielt, welche dafür sorgt, dass die Religionsfreiheit der Einzelnen und der Gruppen geachtet wird. Im Vorliegenden werden einige Gefahren und Bedrohungen für die Religionsfreiheit in der heutigen Gesellschaft analysiert und eine kritische Betrachtung als Antwort auf diese Krisensituation vorgelegt. Konkret werden die folgenden Punkte erörtert: 1. Der Glaube, daß die Religion nicht mit den Werten einer modernen, liberalen Gesellschaft zu vereinbaren ist. 2. Die Konfessionalisierung des Staates. 3. Der Missbrauch der staatlichen Macht, um die Präferenzen der Bürger durch absichtliche Änderungen im sozialen Kontext zu beeinflussen. 4. Die unnötigen Behinderungen und Beschränkung des Rechts auf Verweigerung aus Gewissengründen, die von einem falschen Verständnisses desselben herrühren. 5. Die Verherrlichung eines falsch verstandenen, radikalen Individualismus. 6. Ein Verständnis des Grundsatzes der Nichtdiskriminierung als ,,Gleichgültigkeit gegenüber den Unterschieden“.
Die Auffassung des Rechts in Hegels Rechtsphilosophie weicht bekanntlich von dem ab, was üblicherweise unter „Recht“ verstanden wird. Schon deshalb sind Hegels Grundlinien der Philosophie des Rechts nicht einfach neben andere Werke zur Rechtstheorie zu stellen. Aber Hegels Bestimmung des Rechts ergänzt nicht nur das Recht äußerlich, sondern lässt es auf etwas gründen, das über es selbst deutlich hinausweist: auf jener Normativität, die er als Sittlichkeit bezeichnet. So ist Hegels Rechtsphilosophie nur als eine Sozialphilosophie der Sittlichkeit zu verstehen. Sie kann als die philosophische Selbstreflexion einer Gesellschaft verstanden werden, die sich selbst primär als durch das Recht bestimmt versteht, aber auf eine andere Form von Normativität bezogen ist.
Die Hauptthese dieses Papers geht von dem Konzept der normativen Verfassung der Nachkriegzeit aus und setzt sich kritisch mit dem Konzept des 19. Jahrhunderts „Verfassungswandlung“ auseinander. Das Konzept des Verfassungswandels ist mit der Verfassungsdemokratie inkompatibel. Statt von einem Verfassungswandel zu sprechen, sollte man die Entwicklung des Sinns der Normen in der Zeit als dynamische Interpretation bezeichnen.
Die brasilianische Verfassung hat ein System detaillierter materieller und prozessualer Rechte etabliert und damit die richterliche Kontrolle hoheitlicher Akte in fast allen politisch relevanten Bereichen ermöglicht. Auf dem Gebiet der ökologischen und sozialen Rechte, wo eine intensive Positivierung individueller und kollektiver Ansprüche stattgefunden hat, ist die wachsende Judizialisierung der staatlichen Programme nicht als übertriebene Einmischung der Gerichte in politische Fragen anzusehen, sondern fördert die Ausbildung des gesellschaftlichen Bewusstseins. Die Gesetzestexte enthalten kaum konkrete materielle Anforderungen oder Richtlinien zur Gewichtung von Gütern und Werten, sondern setzen lediglich Verbote fest oder regeln die föderativen Zuständigkeiten bzw. das Verwaltungsverfahren. Deswegen kann die Genehmigung umweltgefährdender Aktivitäten kaum auf der Grundlage dogmatisch abgeklärter Rechtsbegriffe erfolgen. Die fachliche Qualifikation vieler Verwaltungsbeamter und Richter entspricht noch nicht den Herausforderungen einer korrekten Gesetzesauslegung. Die akademische Diskussion konzentriert sich derweilen auf Themen wie die philosophische Hermeneutik, Semiotik oder Systemtheorie und unterschätzt dabei die Wichtigkeit des juristischen Methodenkanons, weswegen es ihr nicht gelingt, den Praktikern gangbare Direktiven zur Herstellung richtiger und gut begründeter Entscheidungen anzubieten. Nötig ist daher eine mehr pragmatisch orientierte Debatte über den angemessenen Gebrauch der traditionellen und modernen Methoden und Techniken der Rechtsfindung, um die dogmatische Basis des Umweltrechts in Brasilien zu stärken und es an das Modell eines Umweltstaats heranzuführen.
Principles can be directly expressed by law or may be found in jurisprudence, philosophy or literature. Often the principles are contradictory, as in the case of transparency and the taboo of state information disclosure. At the individual level, transparency and taboo, the sense and purpose of privacy may compliment each other. Moreover the rise of cyberspace has blurred the distinction between privacy and public. The taboo is widening. The development of the internet and of the social networks can alter the once apparently stable legal situation, bringing a new dynamic into play in both state and individual spheres. In the context of the internet it is as though the secret workings of the state are projected on its "walls and facades", reminding us of Plato's "Myth of the Cave". As Plato described, disillusionment and reflexive defensiveness can follow.
Der zweifache Urteilsspruch des Europäischen Gerichtshofs für Menschenrechte im Fall “Lautsi gegen Italien” hat sich zum Paradigma der Schwierigkeiten entwickelt, welche Europa bei der adäquaten Ansiedlung der Religion im öffentlichen Bereich erfährt. Die Lösung kann sich ändern, wenn, anstatt dem politischen Problem (wann ist die Ausübung von Macht erlaubt) einzuräumen, die Möglichkeit einer praktischen Vernunft und ihre Verträglichkeit mit dem religiösen Glauben zum Ausgangspunkt gemacht wird. Diese würde zweifelsfrei zu einer politischen Fragestellung zu einer Präsenz der Religion im öffentlichen Bereich einladen, die auf eine positive Laizität mehr Rücksicht nimmt, dabei den Laizismus ablehnt, der darauf drängt, die Rationalität zur Macht auch einen nicht kognitivistischen Code zu reduzieren.
Making use of United Nations (U.N.) materials and documents, Anja Matwijkiw and Bronik Matwijkiw argue that the organization – in 2004 – converted to a stakeholder jurisprudence for human rights. However, references to “stakeholders” may both be made in the context of narrow stakeholder theory and broad stakeholder theory. Since the U.N. does not specify its commitment by naming the theory it credits for its conversion, the authors of the article embark on a comparative analysis, so as to be able to try the two frameworks for fit. The hypothesis is that it is the philosophy and methodology of broad stakeholder theory that best matches the norms and strategies of the U.N. While this is the case, certain challenges nevertheless present themselves. As a consequence of these, the U.N. has to – as a minimum – take things under renewed consideration.
Human rights and the law: the unbreachable gap between the ethics of justice and the efficacy of law

This paper explores the structure of justice as the condition of ethical, inter-subjective responsibility. Taking a Levinasian perspective, this is a responsibility borne by the individual subject in a pre-foundational, proto-social proximity with the other human subject, which takes precedence over the interests of the self. From this specific post-humanist perspective, human rights are not the restrictive rights of individual self-will, as expressed in our contemporary legal human rights discourse. Rights do not amount to the prioritisation of the so-called politico-legal equality of the individual citizen-subject animated by the universality of the dignity of autonomous, reasoned intentionality. Rather, rights enlivened by proximity invert this discourse and signify, first and foremost, rights for the other, with the ethical burden of responsibility towards the other.
In this article I advance an account of human rights as individual claims that can be justified within the conceptual framework of social contract theories. The contractarian approach at issue here aims, initially, at a justification of morality at large, and then at the specific domain of morality which contains human rights concepts. The contractarian approach to human rights has to deal with the problem of universality, i.e. how can human rights be ‘universal’? I deal with this problem by examining the relationship between moral dispositions and what I call ‘diffuse legal structure’.
This paper intends to discuss some contemporary issues on human rights and democracy related to the concept of justice. Is the set of individual rights that is assumed by western democracies really universal? If so, how are they supposed to be interpreted? On the other side if I take into account the “other” and pluralism in a serious way how to conciliate different concepts of justice? Taking Jacques Derrida’s approach of justice as its standpoint this paper aims to stress the difficulty to achieve a unique concept of justice as well as to think justice in the sphere of international law and the problem of ensuring human rights in the international order. Western democracies has becoming more and more multiethnic and multicultural and the set of rights that is at the center of the legal order has to be interpreted in a dialogical sense, one that assumes difference and plurality as its starting point. The plurality of conceptions of the good and the impossibility of establishing a unique concept of justice demands the re-creation of a democratic sphere where the dissent and the conflict could be experienced and, at the same time, the legal order needs to ensure individual and group rights against majority’s dictatorship. The main goal of this paper is to re-think the interpretation of law in a multicultural scenario in which it is not possible to have only one criteria of justice and difference and pluralism are envisaged are values themselves.
This paper outlines relatively easy to implement reforms for the supervision of transnational banking-groups in the E.U. that should not be primarily based on legal form but on the actual risk structures of the pertinent financial institutions. The proposal also aims at paying close attention to the economics of public administration and international relations in allocating competences among national and supranational supervisory bodies. Before detailing the own proposition, this paper looks into the relationship between sovereign debt and banking crises that drive regulatory reactions to the financial turmoil in the Euro area. These initiatives inter alia affirm effective prudential supervision as a pivotal element of crisis prevention. In order to arrive at a more informed idea, which determinants apart from a perceived appetite for regulatory arbitrage drive banks’ organizational choices, this paper scrutinizes the merits of either a branch or subsidiary structure for the cross-border business of financial institutions. In doing so, it also considers the policy-makers perspective. The analysis shows that no one size fits all organizational structure is available and concludes that banks’ choices should generally not be second-guessed, particularly because they are subject to (some) market discipline. The analysis proceeds with describing and evaluating how competences in prudential supervision are currently allocated among national and supranational supervisory authorities. In order to assess the findings the appraisal adopts insights form the economics of public administration and international relations. It argues that the supervisory architecture has to be more aligned with bureaucrats’ incentives and that inefficient requirements to cooperate and share information should be reduced. Contrary to a widespread perception, shifting responsibility to a supranational authority cannot solve all the problems identified. Resting on these foundations, the last part of this paper finally sketches an alternative solution that dwells on far-reaching mutual recognition of national supervisory regimes and allocates competences in line with supervisors’ incentives and the risk inherent in crossborder banking groups.
Technologies carry politics since they embed values. It is therefore surprising that mainstream political and legal theory have taken the issue so lightly. Compared to what has been going on over the past few decades in the other branches of practical thought, namely ethics, economics and the law, political theory lags behind. Yet the current emphasis on Internet politics that polarizes the apologists holding the web to overcome the one-to-many architecture of opinion-building in traditional representative democracy, and the critics that warn cyber-optimism entails authoritarian technocracy has acted as a wake up call. This paper sets the problem – “What is it about ICTs, as opposed to previous technical devices, that impact on politics and determine uncertainty about democratic matters?” – into the broad context of practical philosophy, by offering a conceptual map of clusters of micro-problems and concrete examples relating to “e-democracy”. The point is to highlight when and why the hyphen of e-democracy has a conjunctive or a disjunctive function, in respect to stocktaking from past experiences and settled democratic theories. My claim is that there is considerable scope to analyse how and why online politics fails or succeeds. The field needs both further empirical and theoretical work.
As is well known, the 2nd Spanish Republic (1931-1936) was toppled by a military uprising which, after a cruel Civil War, set up an autocratic regime led by General Franco which lasted until his natural death in 1975. According to the contemporary theory of the legal system, a legal order exists on the sole condition that it is efficient in general terms and this was the case for both the Republic and the Dictatorship. In turn, the validity of the legal norms of all legal orders is based on its respective rules of recognition. Thus, neither the existence of the legal order nor the validity of its respective legal norms depends on moral considerations. In this paper, we call this affirmation into question on the base of the fact that the compensatory methods adopted from the Transition to Democracy show an evident concern to repair the damage of taking away a person’s basic rights (life, health, freedom, expression, association etc) although the Spanish Constitution, with its catalogue of fundamental rights was not in force at that time. But these measures would not have much sense if, as Raz says, there was no shared content which is common to all legal systems. Like Nino, we claim that one must discriminate between a democratic legal order and an autocratic one to establish the level of validity of its respective legal norms. Thus it can be assigned a presumption of justice to democratic norms. Finally, we state that the criteria to weigh up the justice or injustice of legal norms, as that of legal orders, takes root in the level of respect they show towards human rights.
The normative position of the judiciary under the traditional conception of democracy as self-legislation by the people is too weak to protect in an effective way the rights of suspects in the global War on Terror. Drawing on arguments elaborated by Hans Kelsen and Karl Popper, we shall attempt to devise in this paper an alternative democracy conception that could serve as a much more solid foundation for the judicial branch of government in a democratic state. Through this jurisprudential strategy, we hope to be able to maintain the balance of normative power among the Trias Politica, which, in turn, may contribute to the preservation of the legal rights of every person during the struggle against terrorists.
In assessing the aftermath of the fraudulent presidential election of 2009 in Iran, one question has received less critical analysis than other complexities of this event: What can explain the remarkable non-violent character of the Green Movement in Iran? I propose that the answer, inter alia, lies with the following three learning experiences: 1) The experience of loss brought about by the Iran/Iraq war; 2) the experience of relative opening during Khatami’s presidency; and 3) the experience of modernization of faith in the work of the post-Islamist thinkers that aimed to make political Islam compatible with democracy. Together, these learning processes fostered a new mode of thinking that is civil and non-violent in character.
The revolution will be tweeted : how the internet can stimulate the public exercise of freedoms

This article discusses how new technologies of communication, especially the Internet and, more specifically, social network services, can interfere in social interactions and in political relations. The main objective is to problematize the concept of public liberty and verify how the new technologies can promote the reoccupation of public spaces and the recovery of public life, in opposition to the tendency to valorize the private sphere, observed in the second half of the twentieth century. The theoretical benchmark adopted for the investigation is Hannah Arendt's theory about the exercise of fundamental political capacities in order to establish a public space of freedom, as presented in “On Revolution”. The “Praia da Estação” (“Station Beach”) case is chosen to test the hypothesis. In 2010 in the Brazilian city of Belo Horizonte, different individuals articulated a movement through blogs, Twitter and facebook, in order to protest against the Mayor’s act that banned the assembling of cultural events in one of the main public places of the city, the “Praça da Estação” (Station Square). By applying Arendt's concepts to the selected case, it is possible to demonstrate that the Internet can assume an important role against governmental arbitrariness and abuse of power, as it can stimulate the public exercise of fundamental freedoms, such as freedom of assembly and manifestation.
This paper aims to assess the arguments that claim representative democracy may be enhanced or replaced by an updated electronic version. Focusing on the dimension of elections and electioneering as the core mechanism of representative democracy I will discuss: (1) the proximity argument used to claim the necessity of filling the gap between decision-makers and stakeholders; (2) the transparency argument, which claims to remove obstacles to the publicity of power; (3) the bottom-up argument, which calls for a new form of legitimacy that goes beyond classical mediation of parties or unions; (4) the public sphere argument, referred to the problem of hierarchical relation between voters and their representatives; (5) the disintermediation argument, used to describe the (supposed) new form of democracy following the massive use of ICTs. The first way of conceptualizing e-democracy as different from mainstream 20th century representative democracy regimes is to imagine it as a new form direct democracy: this conception is often underlying contemporary studies of e-voting. To avoid some of the ingenuousness of this conception of e-democracy, we should take a step back and consider a broader range of issues than mere gerrymandering around the electoral moment. Therefore I shall problematize the abovementioned approach by analyzing a wider range of problems connected to election and electioneering in their relation with ICTs.
This work intends to analysis the philosophy of history and to discuss the consequences of this death to the Critical Theory. The concept of reason and the devices of democracy and human rights are discussed in a revision of the historical debate about the end of history operates the life in the interior of the modern society, especially about the intellectual condition at the information society.
E-democracy as the frame of networked public discourse : information, consensus and complexity

The quest for democracy and the political reflection about its future are to be understood nowadays in the horizon of the networked information revolution. Hence, it seems difficult to speak of democracy without speaking of e-democracy, the key issue of which is the re-configuration of models of information production and concentration of attention, which are to be investigated both from a political and an epistemological standpoint. In this perspective, our paper aims at analyzing the multi-agent dimension of networked public discourse, by envisaging two competing models of structuring this discourse (those of dialogue and of claim) and by suggesting to endorse the epistemic idea of complementarity as a guidance principle for elaborating a form of partnership between traditional and electronic media.
Alexander’s theory of the civil sphere can be placed in the context of development of sociology of law. However, Alexander draws not so much on sociological theories but rather on the approaches of philosophy of law, particularly the ideas of Fuller, Dworkin and Habermas. The civil sphere is presented by Alexander as the embodiment of Dworkin’s principal integrity. Locating law within civil morality Alexander reveals the similarity of his viewpoint to Dworkin’s position. Drawing on Fuller’s works Alexander singles out the procedural foundations of the democratic order. At the same time for Alexander the source of morality of law is not the legal system itself but a certain level of civil solidarity. Like Habermas, Alexander emphasizes the culturally embedded character of the legal norms. Alexander shares Habermas’s understanding of law as a regulative mechanism affecting all spheres of social life. However, Habermas is more sensitive to the danger of colonization of law by the imperatives of the economic and political subsystems. Alexander’s approach can be contrasted with Luhmann’s sociological theory of law. Alexander concentrates on interrelation and mutual penetration of the civil sphere and law while Luhmann regards law as an autonomous system following its own logic. While Alexander claims that his theory is rooted both in sociology and philosophy of law in fact his approach is closer to normative philosophy.
Occasionally, in pursuing their adjudicative duties over the course of a legal hearing, judges are called upon to acquire new concepts – that is, concepts which they did not possess at the commencement of the hearing. In performing their judicial role they are required to learn new things and, as a result, conceptualise the world in a way which differs from the way they conceived of things before the hearing commenced. Some theorists have argued that either as a general matter or as a matter specific to judicial practice and the legal context, judges are, with some degree of necessity, incapacitated from acquiring certain kinds of concepts. Such concepts include those possessed by the members of culturally different minority groups. Drawing on contemporary trends in analytic and naturalistic philosophy of mind, this paper explores the extent to which a judge might be incapacitated from acquiring new concepts over the course of a legal hearing and identifies those factors which condition the success or failure of that process.

After the demise of the social contract theory, the argument from fair play, which employs the principle of fair play, has been widely acknowledged as one of the most promising ways of justifying political obligation. First, I articulate the most promising version of the principle of fair play. Then, I show that free riders play fair, that is, that their moral fault lies not in unfairness but in the violation of a rule by appealing to the example of three-in-a-boat. Finally, I conclude that even the most promising version is false because those who have accepted benefits from a social cooperative scheme do not owe an obligation of fair play.
When judges are authorised to invalidate legal acts for being unconstitutional, the competence of the legislator is directly concerned. The question raises, if thus judges do not usurp legislative power. In the traditional doctrine of the separation of powers the parliament is the first power, based on its direct democratic legitimacy. Yet cancelling legal acts completely or partially does evoke more irritations in the public that could be expected. The people seem to have more confidence to the assumed impartiality of the judges than to the results of the parliamentary work which seems to be dominated by the struggles of the parties. The necessity of judicial review mainly is based on the consideration that individual rights even in an authentic democratic system may be violated by a legal act of the parliament. In this case constitutional courts have the very task to defend individual rights, principles of liberty and authentic equality. Therefore it is justified to speak of the “jurisdiction of liberty”, as the Italian constitutional expert Cappelletti has said. But also without such legitimacy in many countries the Courts intervene in the field of the legislator. The courts themselves discuss the limits of judicial interventions, emphasising themselves, that they have to respect the legislative decisions principally, but do not abide always by their own proclaimed principles. In Spanish recent publications it is spoken of the principle “in dubio pro legislatore”, (in case of doubt in favour the legislator), reminding of “in dubio pro reo”, in order to treat the legislative power not worse than the defendant in a criminal process..
Germany is the focus of this paper, owing to the fact that since 1938 it has had the strictest laws on compulsory schooling worldwide. As a result, homeschooling in Germany has become virtually impossible. There are interesting divergences between policy and practice in the German setting, both in the country’s educational history and present educational problems. The Länder (federal states) have the responsibility for education, and they are taking a much stricter line against homeschoolers than a decade ago, especially by depriving parents of the custody of their homeschooled children at an early stage. The laws relied upon, however, were never intended to deal with such educational matters; they were designed to punish parents who abuse or neglect their children. The present, highly questionable legal action succeeds only because of the consent of state schools, state social welfare offices, and courts. The same laws are not used against the parents of the approximately 250,000 teens who are truant. The functioning of the legal and sociological machinery in Germany is being employed aggressively to stamp out homeschooling, while at the same time it ignores the crucial issue of parents who allow their children to skip school—thus depriving them of an adequate education at home or elsewhere. At the same time, the number of specialists in law and education, as well as politicians and governmental experts who argue in favor of homeschooling is growing, and media reports on homeschooling are much more positive than they were a decade ago.
The demarcation of authority between parents and the State regarding education of children has become an increasingly complex issue over the past three decades. During the same period the number of parents around the world choosing educational alternatives such as homeschooling has grown exponentially, causing significant legislative and jurisprudential shifts in the United States as well as other Western nations. If the State is responsible for education or has a significant interest therein, then it must have broad authority by which to prescribe the method, mechanism, and acceptable outcomes of education; it must also be able to review and enforce these desired outcomes. If parents, on the other hand, are responsible, then it is the State’s duty to defer to parents absent a compelling reason to interfere. A survey of the philosophical foundations from ancient to modern times demonstrates the tension between the State and parents in the realm of education; however, modern human rights norms contained in post-1945 international human rights documents provide explicit grounds on which the State must defer to parental choice in education.

Judicial review reflects the level of commitment between constitutionalism and democracy in contemporary States. Yet democracy as the sovereign government of the people implies a tension with constitutionalism as the rule of law. That is, people ruling themselves or the government by the people – majority government - is limited by the law of law making, the constitution. In Brazil, the improvement of judicial review is nowadays related to increase the number of decisions given by the Brazilian Supreme Court or rather to the capability of this latter in deciding a large number of constitutional lawsuits no matter the form and content of its arguments. For, the Court is nowadays driven by numbers and to accomplish its goals in terms of numbers (of decisions) it applies to technological solutions such as the digitalization of legal proceedings. It means that as many decision as Supreme Court issues -with the help of technology- the better it is. Relating the numbers of decisions issued by the Court to the improvement of Brazilian judicial review or Brazilian constitutionalism and democracy is a great mistake and a false statement as far as it does not face the main problem of the system, which is the lack of reasons of Supreme Court’s decision. The point is that, in this case, technology is just a tool –among others- in order to render legal proceedings faster yet not a qualitative sign of Supreme Court’s decisions.
There is an increasing interest in incorporating significant citizen participation into the law-making process by developing the use of the internet in the public sphere. However, no well-accepted e-participation model has prevailed. This article points out that, to be successful, we need critical reflection of legal theory and we also need further institutional construction based on the theoretical reflection.
Contemporary dominant legal theories demonstrate too strong an internal legal point of view to empower the informal, social normative development on the internet. Regardless of whether we see the law as a body of rules or principles, the social aspect is always part of people’s background and attracts little attention. In this article, it is advocated that the procedural legal paradigm advanced by Jürgen Habermas represents an important breakthrough in this regard.
Further, Habermas’s co-originality thesis reveals a neglected internal relationship between public autonomy and private autonomy. I believe the co-originality theory provides the essential basis on which a connecting infrastructure between the legal and the social could be developed. In terms of the development of the internet to include the public sphere, co-originality can also help us direct the emphasis on the formation of public opinion away from the national legislative level towards the local level; that is, the network of governance.1
This article is divided into two sections. The focus of Part One is to reconstruct the co-originality thesis (section 2, 3). This paper uses the application of discourse in the adjudication theory of Habermas as an example. It argues that Habermas would be more coherent, in terms of his insistence on real communication in his discourse theory, if he allowed his judges to initiate improved interaction with the society. This change is essential if the internal connection between public autonomy and private autonomy in the sense of court adjudication is to be truly enabled.
In order to demonstrate such improved co-original relationships, the empowering character of the state-made law is instrumental in initiating the mobilization of legal intermediaries, both individual and institutional. A mutually enhanced relationship is thus formed; between the formal, official organization and its governance counterpart aided by its associated ‘local’ public sphere. Referring to Susan Sturm, the Harris v Forklift Systems Inc. (1930) decision of the Supreme Court of the United States in the field of sexual harassment is used as an example.
Using only one institutional example to illustrate how the co-originality thesis can be improved is not sufficient to rebuild the thesis but this is as much as can be achieved in this article.
In Part Two, the paper examines, still at the institutional level, how Sturm develops an overlooked sense of impartiality, especially in the derivation of social norms; i.e. multi-partiality instead of neutral detachment (section 4). These two ideas should be combined as the criterion for impartiality to evaluate the legitimacy of the joint decision-making processes of both the formal official organization and ‘local’ public sphere.
Sturm’s emphasis on the deployment of intermediaries, both institutional and individual, can also enlighten the discourse theory. Intermediaries are essential for connecting the disassociated social networks, especially when a breakdown of communication occurs due to a lack of data, information, knowledge, or disparity of value orientation, all of which can affect social networks. If intermediaries are used, further communication will not be blocked as a result of the lack of critical data, information, knowledge or misunderstandings due to disparity of value orientation or other causes.
The institutional impact of the newly constructed co-originality thesis is also discussed in Part Two. Landwehr’s work on institutional design and assessment for deliberative interaction is first discussed. This article concludes with an indication of how the ‘local’ public sphere, through e-rulemaking or online dispute resolution, for example, can be constructed in light of the discussion of this article.
In this paper I demonstrate the utility of a Values in Design (VID) perspective for the assessment, the design and development of e-democracy tools. In the first part, I give some background information on Values in Design and Value-Sensitive Design and their relevance in the context of e-democracy. In part 2, I analyze three different e-democracy tools from a VID-perspective. The paper ends with some conclusions concerning the merits of VID for e-democracy as well as some considerations concerning the dual tasks of philosophers in assessing and promoting value-sensitive technology design.
After the absurd terrorism and violence of the totalitarianism and bureaucratic administrative and legal systems of the 20th century it does not give any meaning to rationalize harm as meaningful evil that even though it is evil may have some importance for the development of the world towards the good. Rather, evil is incomprehensible and as radical and banal evil it challenges human rationality. This is indeed the case when we are faced with instrumental and rationalized administrative and political evil. Therefore, we must analyse the banality of evil in politics and in administration in order to understand the concept of evil. Moreover, as proposed by Hannah Arendt, we need to fight this evil with political thinking and social philosophy. The only way to deal with harm and wrongdoing is to return a concept of responsibility that is closely linked to reflective thinking. In this paper, we will on the basis of a discussion of the banality of evil explore this in relation to Hannah Arendt’s analysis of the administration of evil, as expressed by the personality of Adolf Eichmann. Finally, we will place this concept of administrative evil in Hannah Arendt’s general political philosophy.
Power and law in enlightened absolutism : Carl Gottlieb Svarez' theoretical and practical approach

The term Enlightened Absolutism reflects a certain tension between its two components. This tension is in a way a continuation of the dichotomy between power on one hand and law on the other. The present paper shall provide an analysis of these two concepts from the perspective of Carl Gottlieb Svarez, who, in his position as a high-ranking Prussian civil servant and legal reformist, has had unparalleled influence on the legislative history of the
Prussian states towards the end of the 18th century. Working side-by-side with Johann Heinrich Casimir von Carmer, who held the post of Prussian minister of justice from 1779 to 1798, Svarez was able to make use of his talent for reforming and legislating. From 1780 to 1794 he was primarily responsible for the elaboration of the codification of the Prussian private law – the “Allgemeines Landrecht für die Preußischen Staaten” in 1794. In the present paper, Svarez’ approach to the relation between law and power shall be analysed on two different levels. Firstly, on a theoretical level, the reformist’s thoughts and reflections as laid down in his numerous works, papers and memorandums, shall be discussed. Secondly, on a practical level, the question of the extent to which he implemented his ideas in Prussian legal reality shall be explored.
Human rights and climate policy – toward a new concept of freedom, protection rights, and balancing

Neither the scope of “protection obligations” which are based on fundamental rights nor the theory of constitutional balancing nor the issue of “absolute” minimum standards (fundamental rights nuclei, “Grundrechtskerne”), which have to be preserved in the balancing of fundamental rights, can be considered satisfactorily resolved–in spite of intensive, long-standing debates. On closer analysis, the common case law definitions turn out to be not always consistent. This is generally true and with respect to environmental fundamental rights at the national, European, and international level. Regarding the theory of balancing, for the purpose of a clear balance of powers the usual principle of proportionality also proves specifiable. This allows a new analysis, whether fundamental rights have absolute cores. This question is does not only apply to human dignity and the German Aviation Security Act, but even if environmental policy accepts death, e.g. regarding climate change. Overall, it turns out that an interpretation of fundamental rights which is more multipolar and considers the conditions for freedom more heavily–as well as the freedom of future generations and of people in other parts of the world–develops a greater commitment to climate protection.
Race has been a term avoided in the Swedish debates, while at the same time, protections with respect to unlawful discrimination on the basis of race or ethnic origins have not been vigilantly upheld by the courts. This paper looks at the treatment of race by the Swedish legislature, as well as the treatment by the courts, specifically the Labour Court, with respect to claims of unlawful discrimination in employment on the basis of ethnic origins, against the background of Critical Race Theory. The disparities between the intent of the legislature and the outcome of the cases brought to the Swedish courts can be in least in part explained through the lens of Critical Race Theory, particularly with respect to the liberal approach taken by the courts when applying the law.
Doctrines developed by the EFTA Court have placed considerable demands on national courts in the EFTA States. The Court now considers the EEA Agreement to form an “international treaty sui generis which contains a distinct legal order of its own.” It would thus seem that EEA law has transformed into an independent legal order, and subsequently has a claim to validity which emulates the self-legitimising presentation of the EU legal order. This, however, is not an empirically verifiable fact, but a particular understanding which arises when one adopts the viewpoint of the EFTA Court. EEA law takes place in a different realm when interpreted and applied in the national order: this realm is essentially a construction of the constitutional order. Case law shows that the Icelandic Supreme Court is far from accepting all EEA judge-made principles. This study will describe a context of legal pluralism by reference to the Icelandic legal system and its relationship with the EEA legal order. To illustrate the discussion, the most important case law relative to the interaction between Icelandic laws and EEA law will be considered in the light of legal pluralism - particularly the principles of contrapunctual law designed by Miguel Maduro. The paper argues that the Supreme Court’s internal domestic approach to the application of EEA law will inevitably become a source of fragmentation unless it takes place within an institutional framework of judicial tolerance and judicial dialogue.
