Ursprünglich sollte das vorliegende Buch nur eine Studie über die von der Kanzlei des Führers bzw. ihrem Umfeld nach Kriegsbeginn initiierten Entwürfe zu einem NS-„Euthanasie“-Gesetz werden. Dabei sollte vor allem der wichtige, allerdings mit zahlreichen Fehlern behaftete Beitrag von Roth/Aly(1984) revidiert werden. Da diese Fehler auch den Beginn der Debatte über die „Euthanasie“ im NS-Staat und den Beginn der Planung und Durchführung der „NS-Euthanasie“ (1939/1940) betrafen, musste weiter ausgeholt werden. Die Gesetzentwürfe aus der Zeit nach Kriegsbeginn machen unzweifelhaft deutlich, dass die am Krankenmord Beteiligten wussten, dass der auf den 1.9.1939 datierte „Euthanasie“-Erlass Hitlers in legaler Hinsicht nicht „ausreichte“.
Nicolas Berg wirft einen Blick auf die intensive und facettenreiche Goethe-Verehrung deutsch-jüdischer Milieus um 1900. Mit Goethe habe sich im deutschen Judentum grundsätzlich die Hoffnung auf eine Anverwandlung "universeller Werte der Kultur" verbunden, und die Beschäftigung mit Goethes Leben und Werk sei aus diesem Grund weder mit bloßer "Klassikerbeflissenheit" noch mit gängigem "Kulturnationalismus" zu verwechseln. Dies erkenne man nicht zuletzt daran, dass jüdische Spielarten der Goethe-Aneignung eine wissenschaftliche Beschäftigung mit Goethe keineswegs ausgeschlossen hätten. Berg erinnert an die Fülle philologischer, philosophischer wie populärwissenschaftlicher Goethe-Arbeiten von jüdischen Autoren. Von besonderer Attraktivität sei dabei oft der Goethe'sche Bildungsgedanke gewesen, da dieser die Überwindung "beruflicher Barrieren" wenigstens im Imaginären zugelassen habe. Das Bedürfnis nach einem Ausweis deutsch-jüdischer Affinitäten zeige sich darüber hinaus an der Behauptung einer inneren Verwandtschaft v. a. zwischen Spinoza und Goethe, die spätestens um 1900 zum Topos aufsteige. Der Blick auf die gesellschaftspolitischen Realitäten der Zeit drohe freilich, die gesamte Konstellation als traurige "Phantasmagorie" offenzulegen.
The Frankfurt University Library possesses one of the outstanding Africana Collections in continental Europe; its regional anddisciplinary scope is unique in Germany. Today about 5,000 new acquisitions a year have accumulated over 200,000 items on Africa south of the Sahara. Some 50,000 historical and rare photographs are fully digitized and freely accessible. Together with a collection of around 18,000 books stemming from the collections of the German Colonial Society at the end of the 19th and the beginning of the 20th century they constitute the historical foundations of the collection. Recently the University Library Frankfurt and the library of the GIGA Institute of African Affairs, Hamburg, started the project ilissAfrica (internet library sub-Saharan Africa), a central subject gateway for online resources and a powerful tool for bibliographic research. These new services will be indispensable for researchers and librarians of African Studies and will promote African studies worldwide.
The paper presents an overview about some of the international relevant projects of digital resources in Germany. Online presentations of primary sources, e.g. photographic material, and bibliographic tools supporting research, such as cross searching, will be presented as potential partners of resource sharing with North America. Not only the possibility of cooperation will be sketched, but also necessary preliminary work and some obstacles will be outlined. This report is accompanied by a short characterization of African studies in Germany and the status quo of Open Access-initiatives.
New projects, services and collaborations have recently brought the infrastructural services for African Studies a big step forward. This report gives an account of new subject gateways and digitisation projects. It discusses recent European cooperation ventures in the field of librarianship. Additionally, new developments and services of the Africa Collection at Frankfurt University Library are presented, which help to address the changing needs of researchers and to handle information overload, while keeping up with the latest developments. Nevertheless, the fragmentation and compartmentalisation of the different services still hinder more integrated information services.
Regulierung von Hedge Fonds in Deutschland : Bestandsaufnahme, praktische Erkenntnisse und Ausblick

Die alternative Kapitalanlage über Hedge Fonds gewinnt in Deutschland zunehmend an Bedeutung. In der jüngsten Vergangenheit wurde dieses Thema daher auch in der rechtswissenschaftlichen Literatur aufgegriffen, was zu mehr Transparenz geführt hat. Allerdings ist das deutsche Investmentrecht und insbesondere der Spezialbereich "Hedge Fonds" nach wie vor eine Praktikerdomäne. Deshalb soll im Folgenden zunächst eine Bestandaufnahme erfolgen. Darüber hinaus werden aktuelle Entwicklungen beschrieben. Dabei lassen die Verfasser ihre praktischen Erkenntnisse einfließen. Vor diesem Hintergrund wird anschließend die vom Gesetzgeber für Anfang 2004 geplante Hedge Fonds-Regulierung gewürdigt.
The present article explores perceptions and cultural constructions of the terms capitalism or capitalistic West among ex-Soviet, highly qualified Jewish migrants from Russia and Ukraine after their emigration to Germany between 1990 and 1996. It seems that migration offers a unique opportunity to migrants to realise knowledge that is normally taken for granted, behaviour schemes and values, and to reflect on them. How do they acquire such presumed capitalist knowledge of the new society and new social world, how do they create it, and with what concrete contents do they connect the illusion about monolithic cultural, economic and political capital, the illusion which contributes to group formation and which serves as action orientation? As my research shows, immigrants try to disparage much of what appeared to them in the Soviet Union as normative, right and appropriate; now they often act by way of categories, which were defined in the previous context as "capitalist" and were interpreted as immoral. Without exact ideas or knowledge about behaviour codes, unspoken norms and silent values from the new society, many immigrants orient themselves towards the opposite of what was counted as morally proper in the origin society. Simultaneously they revive old system through the establishing and development of a Russian language enclave. Nevertheless this enclave is not located in a vacuum of "dusty" memories from the past, but build transnational cross-border space connected and corresponding to the processes of to-day's CIS and with the life of those relatives and friends who still live there, und with whom the emigrants share intensive social networks.
Zu Beginn des 21. Jahrhunderts scheint auch in Deutschland politische Bewegung in die Arbeitsmarktpolitik gekommen zu sein. Angesichts von in der Spitze über 5 Millionen offiziellen Arbeitslosen und immer deutlicher zu Tage tretender Defizite bei der (damaligen) Bundesanstalt für Arbeit war ein „weiter so“ nicht mehr vermittelbar. Es bestand die Hoffnung, dass die über 5-jährige Tradition aktionistischer, erfolgloser, ja sogar problemverschärfender bundesdeutscher Arbeitsmarktpolitik endlich zu Ende gehen würde. Prinzipien wie „Fördern und Fordern“ wurden erstmals von beiden großen Volksparteien nicht nur ablehnend diskutiert, sondern als Grundvoraussetzung für eine zukunftsfähige Beschäftigungspolitik erkannt. Mit ihrer „Agenda 2010“ und den „Hartz-Reformen“ versuchte die rot-grüne Bundesregierung, das Bild eines tiefgreifenden Umbaus der deutschen Arbeitsmarktpolitik hin zu mehr Effizienz und weniger Arbeitslosigkeit zu vermitteln. Doch hat eine grundlegende Reform der Arbeitsmarktpolitik wirklich stattgefunden? Dieser Frage gehen die beiden Autoren der vorliegenden Studie, Norbert Berthold und Sascha von Berchem, nach. Sie zeigen auf, wie über Jahrzehnte hinweg von den jeweiligen Regierungen und den sie tragenden Parteien eine völlig verfehlte Arbeitsmarktpolitik verfolgt wurde. Das Ergebnis der Analyse, ob bei den jüngsten Reformen diesbezüglich Lernerfolge zu erkennen sind, ernüchtert: Nach wie vor kann die deutsche Arbeitsmarktpolitik keinen echten Beitrag zum Abbau der Arbeitslosigkeit leisten. In vielen Bereichen blieben die Reformschritte ein bloßes Kratzen an der Oberfläche. Hinzu kommt, dass vormals bestehende institutionelle Defizite durch neue ersetzt wurden, z.B. bei der Zusammenlegung von Arbeitslosenhilfe und Sozialhilfe. All dem stellen die Autoren ein Reformkonzept entgegen, das konsequent versucht, Marktkräfte und Wettbewerb zum Abbau der Arbeitslosigkeit zu nutzen. Kernpunkt ist ein dezentraler Ansatz, der die Erprobung und Realisierung unterschiedlicher, an die jeweiligen Gegebenheiten angepassten Strategien zulässt. Es bleibt zu hoffen, dass die Politik die Zeichen der Zeit erkennt. Ohne mutige Schritte bleiben die begonnenen Reformen ein Torso. Deutschland braucht nicht die Verwaltung des Elends auf immer höherem administrativen Niveau. Unserem Land helfen genauso wenig immer neue „Pilotprojekte“ und Wortgeklingel wie „Job-Floater“, „Ich- AG“, „Job-Aqtiv“ und „Equal Pay“. Was wir brauchen, sind ein ordnungspolitisch fundiertes Konzept, mehr Freiheit und mehr Wettbewerb. Opting out of the great inflation: German monetary policy after the break down of Bretton Woods

During the turbulent 1970s and 1980s the Bundesbank established an outstanding reputation in the world of central banking. Germany achieved a high degree of domestic stability and provided safe haven for investors in times of turmoil in the international financial system. Eventually the Bundesbank provided the role model for the European Central Bank. Hence, we examine an episode of lasting importance in European monetary history. The purpose of this paper is to highlight how the Bundesbank monetary policy strategy contributed to this success. We analyze the strategy as it was conceived, communicated and refined by the Bundesbank itself. We propose a theoretical framework (following Söderström, 2005) where monetary targeting is interpreted, first and foremost, as a commitment device. In our setting, a monetary target helps anchoring inflation and inflation expectations. We derive an interest rate rule and show empirically that it approximates the way the Bundesbank conducted monetary policy over the period 1975-1998. We compare the Bundesbank´s monetary policy rule with those of the FED and of the Bank of England. We find that the Bundesbank´s policy reaction function was characterized by strong persistence of policy rates as well as a strong response to deviations of inflation from target and to the activity growth gap. In contrast, the response to the level of the output gap was not significant. In our empirical analysis we use real-time data, as available to policy-makers at the time. Der dritte Advent ist geschafft, wie biegen auf die Zielgerade gen Weihnachten, Jahreswechsel und Bretterblogpause ein. In der letzten, diesmal recht bunten Netzschau diesen Jahres drehen wir uns um Islamophobie und Rassismus, Folter, Cyberpeace, die “resistance” und soziale Bewegungen und schließlich “IS(IS)”.
Dies ist der erste Artikel unseres Blogfokus „Salafismus in Deutschland“.
„Der Salafismus“ oder „die Salafisten“ sind seit wenigen Jahren in aller Munde. Obgleich oftmals nicht klar ist, was oder wer auf diese Weise bezeichnet wird, dient das Label zunehmend als Projektionsfläche für sicherheits- und gesellschaftspolitische Ängste vor „islamistischem Terrorismus“ und der Verbreitung von anti-demokratischem und anti-emanzipatorischen Gedankengut. Begrifflich löst „Salafismus“ im öffentlichen Diskurs den zuvor gebräuchlicheren (aber etwas anders gelagerten) Terminus des „Islamismus“ ab und rückt in die Nähe von Extremismus, Gewalt und Terrorismus. Obgleich die salafistische Ideologie und Bewegung in den genannten Hinsichten als problematisch angesehen werden können, ist diese Begriffsverwendung für die Analyse und den Umgang mit dem Phänomen umstritten: Sie kann sowohl das Verständnis des Phänomens als auch die Handlungsoptionen staatlicher und zivilgesellschaftlicher Akteure verengen....
Governance und Vertragsstrukturen in der deutschen VC Industrie: eine empirische Einschätzung

Diese Arbeit analysiert die wesentlichen Elemente der Vertragsstrukturen in der Venture Capital-Industrie. Aufbauend auf einem sehr umfangreichen und detaillierten Datensatz, der die Verträge zwischen Venture Capital-Investoren und deren Portfoliounternehmen abbildet, werden die Kontroll-, Entscheidungs- und Vetorechte einer detaillierten Analyse unterzogen. Dabei zeigt sich eine klare Tendenz in der Entwicklung der Vertragsstrukturen in Deutschland hin zu angelsächsisch strukturierten Verträgen. Dies beinhaltet unter anderem eine verstärkte Verwendung von Kontroll- und Entscheidungsrechten aber auch ein breiteres Spektrum dieser Rechte. Außerdem finden wir eine klare Interaktionen zwischen Kontrollrechten, Cash-Flow Rechten und Liquidationsrechten. Insbesondere ist zu betonen, dass Cash-Flow und Kontrollrechte einerseits und Stimmrechte und Aufsichtsratsanteile andererseits separat alloziiert werden und viele Kontrollrechte als Komplemente und nicht als Substitute zueinander aufgefasst werden müssen. Venture capital exit rights

Theorists argue that exit rights can mitigate hold-up problems in venture capital. Using a hand-collected data-set of venture capital contracts from Germany we show that exit rights are included more frequently in venture capital contracts when a hold-up problem associated with the venture capitalist's exit decision is likely. Examples include drag-along and tag-along rights. Additionally, we find that almost all exit rights are allocated to the venture capitalist rather than to the entrepreneur. In addition, we show that besides the basic hold-up mechanism there are other mechanisms such as ex-ante bargaining power and the degree of pledgeable income that drive the allocation of exit rights. In this paper, we examine the impact of mergers among German savings banks on the extent to which these savings banks engage in small business lending. The ongoing consolidation in the banking industry has sparked concerns about the continuous availability of credit to small businesses which has been further fueled by empirical studies that partly confirm a reduction in small business lending in the aftermath of mergers. However, using a proprietary data set of German savings banks we find strong evidence that in Germany merging savings banks do not significantly change the extent to which they lend to small businesses compared to prior to the merger or compared to the contemporaneous lending by non-merging banks. We investigate the merger related effects on small business lending in Germany from a bank-level perspective. Furthermore, we estimate small business lending and its continuous adjustment process simultaneously using recent General Method of Moments (GMM) techniques for panel data as proposed by Arellano and Bond (1991).
"Germany is back" (Schöllgen 1994: 35), so beschreibt Schöllgen prägnant Deutschlands internationale Position nach dem Ende des Ost-West-Konfliktes und dem Fall der Mauer. Was Schöllgen so schlicht zusammenfasst wurde von der deutschen Öffentlichkeit, aber auch von der Mehrheit der Wissenschaftler, lange Zeit keinesfalls so gesehen. Statt eines Wandels deutscher Außenpolitik aufgrund der veränderten Rahmenbedingungen herrschte ein weitverbreiteter Konsens darüber, Deutschland habe sich abgesehen von einer Erhöhung der Einwohnerzahl von 63 auf 82 Millionen und eines Flächenzuwachses von 248 000 auf 375 000 Quadratkilometer nicht gravierend im internationalen System gewandelt. ...
Derivatives usage in risk management by U.S. and German non-financial firms : a comparative survey

This paper is a comparative study of the responses to the 1995 Wharton School survey of derivative usage among US non-financial firms and a 1997 companion survey on German non-financial firms. It is not a mere comparison of the results of both studies but a comparative study, drawing a comparable subsample of firms from the US study to match the sample of German firms on both size and industry composition. We find that German firms are more likely to use derivatives than US firms, with 78% of German firms using derivatives compared to 57% of US firms. Aside from this higher overall usage, the general pattern of usage across industry and size groupings is comparable across the two countries. In both countries, foreign currency derivative usage is most common, followed closely by interest rate derivatives, with commodity derivatives a distant third. Usage rates across all three classes of derivatives are higher for German firms than US firms. In contrast to the similarities, firms in the two countries differ notably on issues such as the primary goal of hedging, their choice of instruments, and the influence of their market view when taking derivative positions. These differences appear to be driven by the greater importance of financial accounting statements in Germany than the US and stricter German corporate policies of control over derivative activities within the firm. German firms also indicate significantly less concern about derivative related issues than US firms, which appears to arise from a more basic and simple strategy for using derivatives. Finally, among the derivative non-users, German firms tend to cite reasons suggesting derivatives were not needed whereas US firms tend to cite reasons suggesting a possible role for derivatives, but a hesitation to use them for some reason.
Corporate governance is currently a topic of great worldwide interest to academics, legislators, and practitioners. In addition to several academic articles, it has prompted active involvement of the OECD, the EU, the German Monopolkommission, the Bundestag, and several other institutions. Especially in comparison to the Anglo-American system, German corporate governance is characterized by lesser reliance on capital markets and outside investors, but a stronger reliance on large inside investors and financial institutions to achieve efficiency in the corporate sector. Since data on German corporations have become more easily available in recent years, the discussion has lately become more scientific and started to focus on studying the benefits and costs of the German system. The empirical results presented in this survey focus on the relation between ownership structure and firm performance in Germany. I summarize several empirical studies on this topic and put them into context to the institutional and legal environment in Germany. Due to data restrictions on unlisted firms, most results are based on corporations trading in official markets, representing the first-tier stock market in Germany. These firms have to publish large blockholdings exceeding 25% in their annual report. While this type of ownership data has been accessible for several years, information on voting control has only become available with the 1995 transposition of the European Union’s Transparency Directive into national law (Wertpapierhandelsgesetz, WpHG).
I analyze the most powerful shareholders in Germany to illustrate the concentration of control over listed corporations. Compared to other developed economies, the German stock market is dominated by large shareholders. I show that 77% of the median firm’s voting rights arecontrolled by large blockholders. This corresponds to 47% of the market value of all firms listed in Germany’s official markets. About two thirds of this amount is controlled by banks, industrial firms, holdings, and insurance companies. I show that due to current legislation it is clear for neither group who ultimate exerts control over the shareholding firm itself. For the remaining blockholders, only blocks controlled by voting pools and individuals can be traced back to the highest level of ownership. In the aggregate, both groups control only 5.6% of all reported blocks. The German government controls 8%, and it is not clear who ultimately is responsible for the consequences of decisions.
Die vorliegende Arbeit hat das Ziel, eine Kulturgeschichte des türkischen Theaters und Kabaretts in der Bundesrepublik vorzustellen, deren Protagonisten (Organisatoren, Schriftsteller, Schauspieler und Regisseure) nunmehr bereits in die dritte Generation gehen, ohne dass die Geschichte der ersten Generation, der Initiatoren und bis heute treibenden Kraft dieses Theaters, je kohärent aufgezeichnet worden wäre. Darüber hinaus steht ein Generationswechsel an: das wird deutlich, sobald man sich in die 'Szene' begibt, in der es, wie meine Ausführungen zeigen werden, derzeit rumort, kreativ und destruktiv zugleich: Junge Künstler mit neuen Ideen drängen nach und fühlen sich nicht selten behindert von den 'Alten', die immer noch die Schalthebel besetzen und sich nicht davon abbringen lassen wollen, ihre Projekte nach altbewährten Methoden fortzuführen.
