The resurgence of populism and the advent of the Covid-19 pandemic have consolidated an appeal to the language of trust and distrust in the political arena, but any reference to these notions has often turned into an ideological and polarized debate. As a result, the possibility of developing an appropriate picture of the conditions for trust in politics has been undermined. To navigate the different demands for trust raised in the political arena, a notion of political trust must cover two partially unfulfilled tasks. One is to clarify what trust means when referring specifically to the political context. The other is to connect political trust to other notions that populate the debate on trustworthiness in the political arena - those of rational, moral, epistemic, and procedural trust. I will show how the political categories I use to define the scope of a political notion of trust function as normative leverages to develop politics-compatible versions of rational, moral, procedural, and epistemic trust.
En este artículo se examina la aceptabilidad de las acciones wrongful birth (WB) a partir de la teoría discursiva del derecho de Jürgen Habermas. Inicialmente, se describe el alcance que tienen hoy diversas pruebas genéticas para informar decisiones reproductivas. En un segundo momento, se delimitan reclamaciones judiciales presentadas en ordenamientos jurídicos que admiten la interrupción voluntaria del embarazo (IVE), debido a afectaciones en el embrión y el feto que no fueron conocidas por los padres por no seguirse la lex artis ad hoc en el diagnóstico preconceptivo, preimplantatorio y prenatal. En tercer lugar, se explican los puntos con base en los cuales Habermas, en debate con Thomas McCarthy, propone la evaluación de la legitimidad de normas y fallos judiciales en términos de discursos de fundamentación y aplicación. Finalmente, se plantean las consecuencias que surgen de estos argumentos para valorar la admisibilidad de este tipo de demandas.
Two decades after the predicted “end of ideology”, we are observing a re-emphasis on party ideology under Hu Jintao. The paper looks into the reasons for and the factors shaping the re-formulation of the Chinese Communist Party’s (CCP) ideology since 2002 and assesses the progress and limits of this process. Based on the analysis of recent elite debates, it is argued that the remaking of ideology has been the consequence of perceived challenges to the legitimacy of CCP rule. Contrary to many Western commentators, who see China’s successful economic performance as the most important if not the only source of regime legitimacy, Chinese party theorists and scholars have come to regard Deng Xiaoping’s formula of performance-based legitimacy as increasingly precarious. In order to tackle the perceived “performance dilemma” of party rule, the adaptation and innovation of party ideology is regarded as a crucial measure to relegitimize CCP rule.
