Em Das Recht der Freiheit, Honneth trabalha mais uma vez os três momentos da esfera do direito objetivo hegeliano com o intuito de mostrar que a liberdade dos indivíduos só é possível nas instituições cujas práticas normativas garantem um reconhecimento recíproco. Essas instituições são a realidade do mundo moderno onde a estrutura da liberdade subjetiva se encontra refletida de maneira objetiva.
Tras presentar una somera panorámicade la evolución experimentada por la noción de «comunidad» desde Aristóteles hasta Hegel, este trabajo se detiene a analizar la célebre distinción acuñada por Ferdinand Tónnies entre sociedad y comunidad. Mientrasen Europa se tergiversaron enfoques teóricos como el de Tónnies hasta propiciar el surgimiento de auténticas aberraciones políticas, al contribuir involuntariamente a la creación del mito de la «comunidad del pueblo», en los Estados Unidos el debate sobre la «comunidad» siempre representó un ingrediente indispensable para una mejor comprensión de la sociedad liberal. Aun cuando, a partir de la Segunda Guerra Mundial, el concepto de «comunidad» brillópor su ausencia en las reflexiones de la teoría política, durante los últimos años la discusión en torno al «comunitarismo» ha estimulado una inesperada revitalización del mismo y su presencia en toda suerte de consideraciones morales, políticas o sociológicas.
Neste artigo, que é originalmente um discurso de posse no Instituto Otto Suhr na Universidade Livre de Berlin, Axel Honneth esboça o programa de uma teoria intersubjetiva do reconhecimento, utilizando esta última categoria como o núcleo conceitual de uma Teoria Crítica da sociedade na qual a experiência pré-cientifica de desrespeito às expectativas sociais se conecta à formação de demandas emancipatórias.
L’autor sosté que el que caracteritza les societats liberals democràtiques és un cert grau d’intersubjectivitati cohesió. Segons ells, els liberals coincideixen amb els comunitaristes aconsiderar que aquestes característiques només poden aparèixer en la forma de «comunitat».Partint d’aquesta coincidència, argumenta, primer, presentant un concepte mínim de comunitaten el qual tots els comunitaristes estarien d’acord i que conté, com a nucli, el supòsitque l’autorealització humana va unida a una praxi vital comunitària. Aquesta autorealitzaciórau en l’estimació mútua entre els qui viuen en societat. La qüestió és establir relacionsde solidaritat de manera que les capacitats de l’altre puguin fer possible l’enriquimentde la pròpia vida. El concepte mínim de comunitat postradicional es definirà finalmentcom aquesta forma de solidaritat que implica estimació mútua i que, alhora, uneix amb elsupòsit de valors compartits.
Neste texto, analisam-se o conceito de grupo e suas manifestações, buscando contrapor às perspectivas categoriais da psicanálise e da teoria sociológica, consideradas incompletas em razão de estilizações unilaterais que impedem uma conexão conceitual básica entre as duas disciplinas, uma terminologia que, de partida, seja neutra frente às alternativas positiva e negativa de inserção do eu no grupo. Para tanto, o grupo, independentemente de seu tamanho e tipo, inicialmente deve ser compreendido como um mecanismo social fundado na necessidade ou no interesse psíquico do indivíduo, porque o auxilia na estabilidade e ampliação pessoais. O artigo descreve, em linhas gerais, o arcabouço categorial unificado, recorrendo ao conceito do reconhecimento. Num primeiro passo, apresenta-se brevemente a premissa de que a dependência individual de experiências de reconhecimento social explica por que o sujeito individualmente aspira a ser membro em diferentes modelos de agrupamentos sociais. Num segundo passo, tenta-se corrigir a imagem idealizada de grupo anteriormente introduzida, ao tematizar as tendências regressivas que frequentemente codeterminam a vivência no grupo. Por fim, segue-se a ideia de retirar gradativamente aquelas idealizações que estavam na base da premissa inicial de uma diluição harmônica do eu no nós do grupo.
La educación y el espacio público democrático. Un capítulo descuidado en la filosofía política

En este trabajo se examina la relación interna entre educación y democracia, así como la razón por la cual, pese a su papel crucial en la formación de culturas democráticas, esta relación se ha hecho problemática. Con el fin de mostrar, en primer lugar, qué consecuencias negativas tiene para la vida política contemporánea esta ruptura entre pedagogía y filosofía política y, en segundo lugar, cómo superarlas, este artículo explora algunos malentendidos básicos en torno a las condiciones culturales para la democracia y el papel neutral del Estado, finalizando con la propuesta de un programa renovado de educación democrática.
Contrariamente à percepção cotidiana de que os atores estatais têm como objetivo de suas ações o respeito e o reconhecimento da comunidade por eles representada, prevalece na moderna teoria predominante das relações internacionais a noção de que os governos nacionais orientam seu agir essencialmente a fins e não com base em princípios morais. O texto destaca as razões que falam a favor de uma maior consideração da dimensão do reconhecimento na explicação das relações internacionais e explora as implicações normativas que surgem a partir de tal mudança de paradigma para a compreensão e o tratamento das relações internacionais. O texto se ocupa com a questão da interpretação da obra de Jean-Jacques Rousseau, em particular com suas referências sobre a dependência constitutiva em relação aos outros. Vista negativamente na crítica da cultura, mas positivamente nos esboços de um contrato social, o lugar dessa dependência constitutiva da confirmação e estima por parte dos outros está vinculada ao significado dado ao “amor próprio” nos diferentes textos; mas ela abre a possibilidade de interpretar Rousseau como um teórico do reconhecimento. O autor acompanha Rousseau em seu desenvolvimento teórico até o ponto em que ele se tornou consciente das exigências de uma forma sociocontratual, igualitária do reconhecimento mútuo, para depois expor a enorme influência que a ideia bipolar de Rousseau a respeito do reconhecimento social exerceu sobre a teoria social da modernidade: em sua variante negativa, a profunda necessidade dos seres humanos de sobrepujar os respectivos cossujeitos no grau de estima social, reinterpretada por Kant como sendo a força motriz do progresso cultural e social, e em sua variante positiva, o respeito mútuo entre iguais, desenvolvido por Fichte e Hegel na direção de uma teoria do reconhecimento relacionada ao direito e à moralidade. No final, Honneth discute o ceticismo com que Rousseau sempre viu a dependência de outros contida no “amor próprio”, deixando sem solução definitiva a tensão entre a ideia estoica de uma independência pessoal de toda avaliação alheia e a ideia intersubjetivista de uma profunda dependência do outro. O texto tenta, num primeiro passo, mostrar que a textura intrínseca da justiça não consiste em bens distribuíveis, mas em relações sociais comumente aceitas que são constituídas por práticas perpassadas de conteúdo moral. Nessas práticas podem ser encontradas aquelas que definem o que significa tratar uma outra pessoa de forma razoável ou justa. Se este ponto de partida é convincente, então algumas consequências metodológicas sobre o conceito de justiça tem que ser tiradas e que são apresentados na segunda etapa: ao invés de construir um procedimento normativo que nos permite deduzir o conteúdo de justiça, temos de começar pela reconstrução das práticas sociais que nos informam sobre o respeito à justiça. O resultado será, tal como indicado em uma terceira etapa, a pluralização do nosso conceito de justiça, que inclui tanto princípios relevantes da justiça como há formas de relações sociais geralmente aceitas e apreciadas.
A pergunta que move o presente artigo é: como a categoria trabalho social deveria ser incluída no marco de uma teoria social para que, dentro dela, abra uma perspectiva de melhoria qualitativa que não seja utópica? Para dar conta desse problema complexo, o autor sugere num primeiro passo, mais metodológico, o emprego da distinção entre crítica externa e imanente para o propósito de uma crítica das relações de trabalho existentes. Num segundo passo, o autor procura mostrar que o trabalho social só poderá assumir legitimamente este papel de uma norma imanente se ele for conectado às condições de reconhecimento na moderna troca de realizações (Leistungen). São reconstruídas duas condições a partir de Hegel e de Durkheim: uma organização justa do trabalho social necessita remunerar suficientemente o trabalhador para prover-lhe condições socialmente dignas de sobrevivência e precisa estar estruturado de modo a que suas tarefas permitam ao indivíduo trabalhador perceber nelas uma contribuição para a coletividade e relacioná-la com o restante dos trabalhos socialmente necessários.
O texto discute a relação entre a educação e a organização democrática do governo republicano. Para o autor, pelo menos desde Kant os teóricos clássicos da filosofia política estavam convencidos de que uma boa educação e uma ordem estatal republicana dependem uma da outra: formar cidadãos para a liberdade para que, como cidadãos autônomos institucionalizem uma educação pública que possibilite a seus filhos o caminho para a maioridade política. Mas ele constata hoje um divórcio entre as gêmeas teorias da democracia e da educação. Razões que podem ter levado a essa cisão ele localiza na combinação, por afinidades eletivas, entre uma concepção truncada de democracia, que dependeria de comunidades tradicionais e mesmo religiosas para reproduzir suas bases ético-culturais, e uma falsa concepção normativa de neutralidade do estado, que culmina concebendo os professores não mais como servidores públicos a serviço do estado democrático de direito, mas como servidores dos pais. Em contraposição ao desacoplamento entre a formação do cidadão autônomo e do governo autônomo dos cidadãos, entre pedagogia e teoria política, ele reconstrói, a partir dos clássicos da teoria social, a concepção sobre um nexo fundamental entre educação e liberdade política, entre formação e democracia. Longe de advogar por uma volta à escola tradicional, o autor chama a atenção para dois grandes desafios que juntas, pedagogia e teoria democrática precisam enfrentar: o impacto da revolução digital sobre a esfera pública e a crescente heterogeneidade cultural dos cidadãos, em especial nas democracias ocidentais, para que a educação torne a ser o lugar do aprendizado da cultura democrática.
O texto responde a críticas feitas ao pequeno livro publicado sob o título Reitifiação no qual o autor pretendia recuperar na herança da teoria de Marx o conceito reificação á luz da teoria do reconhecimento. O texto primeiro busca precisar o marco de referência dentro do qual foi feita originalmente a tentativa de recuperar o conceito reificação, enfatizando sua interpretação literal. Em seguida, o texto trata de problemas específicos que resultam da sugestão de entender reificação como uma forma de esquecimento do reconhecimento. Tomando como premissa que o próximo (Mitmensch) é reconhecido pré-cognitivamente, o autor defende que a rotinização e habitualização de práticas sociais com objetivos desumanizantes automatizados pode levar ao esquecimento do reconhecimento original da outra pessoa
Em alguns de seus trabalhos Talcott Parsons descreveu o estabelecimento das sociedades modernas como um processo de diferenciação de diversas esferas de reconhecimento recíproco. Neste texto eu uso a teoria social do reconhecimento de Parsons para examinar características de conflitos sociais recentes. Começo expondo a descrição que Parsons fez das lutas por reconhecimento ocorridas nas sociedades altamente industrializadas de sua época. Depois tomo a concepção de Parsons sobre conflitos por reconhecimento normativamente orientados para indicar tendências que levaram a uma gradual erosão das estruturas de pacificação social postuladas por Parsons nas últimas décadas do século 20. Descrevo as consequências iniciais dessa desintegração como uma “barbarização” dos conflitos sociais. Por barbarizado entendo um estágio da sociedade em que as lutas por reconhecimento social escalaram e se tornaram anômicas, uma vez que não podem mais ser resolvidas nas esferas sistêmicas estabelecidas de negociação. Este texto revela a importância do conceito de reconhecimento para a teoria social ao acompanhar Parsons na análise de transformações estruturais que atualmente emergem em resposta a conflitos sociais. Embora a ideia de “patologias sociais” ou “enfermidades” de uma sociedade inteira tenha sido bastante comum desde o Segundo Discurso de Rousseau, e especialmente proeminente dentro da tradição da teoria crítica, não está claro a quem exatamente se referea proposição de ter adoecido. Será apenas um número suficiente de pessoas individuais, será o coletivo entendido como um macro-sujeito, ou é a “sociedade” em si que foi acometida por uma desorganização específica de suas instituições sociais, afetando sua eficiência funcional de tal forma que se pode falar de uma “doença” especificamente social? Para todas as três atribuições, ou seja, as pessoas individualmente com suas doenças, a coletividade com a sua síndrome clínica particular, ou a própria sociedade como adoecida, podem ser encontrados casos na literatura correspondente. A fim de encontrar uma saída para essas perplexidades conceituais que estão no cerne dessa maneira de falar, abordo as propostas teóricas de Alexander Mitscherlich e Sigmund Freud, ambos defensores de um conceito específico de “patologias sociais” ou “enfermidades” baseado em ideias psicanalíticas. O resultado da minha reconstrução crítica será que somente uma compreensão da sociedade como uma entidade orgânica permite um uso não redutor da ideia de “patologias sociais”.
Partiendo de una breve descripción de las características del modelo comunitarista de integración social con el propósito de marcar distancia y aclarar algunos malentendidos en lo relativo a sus vínculos con la Sittlichkeit hegeliana, en el presente trabajo se analizan algunos de los textos claves de Hegel en los cuales se aprecia su comprensión de la unidad política. Ligado a ello, se intenta reconstruir la noción de integración que se desprende de dichos textos para, finalmente, concluir con algunas reflexiones en torno al potencial de una teoría de inspiración hegeliana para analizar determinados fenómenos vinculados, en la actualidad, con los conceptos de desintegración y exclusión social.
Sobre la libertad política

Este artículo presenta un argumento en favor de un concepción intersubjetivista de la libertad política constituida por cinco diferentes nociones de autonomía: moral, ética, legal, política y social. Más allá de las nociones estrictamente liberales o comunitarias, negativas o positivas, el concepto de libertad política incluye todas aquellas libertades que los ciudadanos, en tanto continentes y usuarios autónomos de la libertad, pueden conceder y garantizar de forma recíproca y general. Así, en la base de este concepto reposa un principio de justiticación moral y política.
Este artículo propone la reconstrucción del punto de vista moral sobre la base de una compleja teoría del reconocimiento mutuo. Su punto de partida consiste en la comprensión del Hegel temprano de la lucha por el reconocimiento como el proceso dinámico de establecer distintas formas de afirmación mutua de la propia identidad en las relaciones de amor, respeto legal y moral, y estima social. Su punto de llegada es la afirmación de diferentes tipos de obligaciones en los diferentes contextos sociales, a saber, deberes asimétricos de cuidar de los demás en sus necesidades y deseos individuales, deberes recíprocos de tratar igualitariamente a cada persona, y deberes de demostrar solidaridad y estimar a los demás en su particularidad.
Con la finalidad de responder positivamente a la pregunta planteada en el título de este trabajo, el autor presenta y cuestiona, en primer Jugar, el supuesto filosófico tradicional, por el que se hace depender al lenguaje unilateralmente de la intenciones moralmente relevantes de los individuos. Expone luego las estaciones del fracaso de los intentos de fundamentación moral sobre la base del solipsismo metódico de la filosofía moderna antes del giro pragmático-lingüístico. Y defiende finalmente la posición de la fundamentación pragmático-trascendental última frente a las interpretaciones relativistas del mencionado giro de la filosofía contemporánea.

¿Debería gobernar la justicia en las relaciones personales cercanas, como por ejemplo en el dar y recibir entre hombres y mujeres? ¿O es que estas relaciones se hallan más allá de la justicia? El presente artículo defiende, basándose en Aristóteles, el llamado feminista por la justicia sexual, (aun) en las relaciones personales cercanas, en oposición, entre otras, a la objeción de perversión de Hugh LaFollette planteada en 1996. De acuerdo a esta objeción, el llamado por la justicia en relaciones personales cercanas socava o pervierte el amor y la amistad, dando Jugar a relaciones de intercambio interesadas.

El artículo somete a discusión la concepción de la ética discursiva, tanto desde una perspectiva inmanente como desde una perspectiva feminista. En cuanto a lo primero, critica el uso equívoco que dicha concepción hace de la noción de "acuerdo" (Zustimmung) pues transfiere ilegítimamente un momento consensual al ámbito cognitivo e intelectivo de la moral. En cuanto a lo segundo, muestra que la ética discursiva se guía por una visión masculina unilateral, que atiende sólo a las relaciones simétricas entre seres personales, sin prestar atención al fenómeno moral, tradicionalmente femenino, del cuidado de los seres humanos sin integridad personal.
Herbert Marcuse es considerado, sin lugar a dudas, como el máximo exponente y punto culminante de la Teoría Crítica, la teoría empleada por la llamada Escuela de Frankfurt.1La Escuela de Frankfurt es el término con el que se conoce a un grupo de hombres interesados en teoría social y formados en escuelas diferentes, pero que comparten la idea de retomar el marxismo con el propósito de elaborar una crítica de la sociedad existente, a partir de distintas disciplinas. A la Escuela de Frankfurt, conocida inicialmente como Instituto de Investigación Social, pertenecen pensadores como Herbert Marcuse, Erich Fromm, Max Horkheimer, Theodor Adorno, Leo 54Rosendo Bolívar Meza Lowenthal, Friedrich Pollok, Franz Newmann, Jurgen Habermas, Walter Ben-jamin, Karl August Wittfogel, Sorge,Grossmann, Félix J. Weil y otros.
The Frankfurt School has often been associated to the project of “marrying” Freud’s psychoanalysis with a Marxian critique of capitalist societies. This article offers however another version of the link between Critical Theory and psychoanalysis. After having briefly sketched the notion of a “critical theory of society”, the Author shows how a critique of modern capitalist societies and Freudian psychoanalysis actually meet at a “methodological” level for which the marriage between Hegel and Freud seems to be the relevant one. As a conclusion, the Author contrasts two kinds of social critique that can be found in the Frankfurt School, which are deeply linked with the first and the latest generation of the Frankfurt School considered in their relation to
psychoanalysis.
The paper discusses the problem of the possible relation between psychoanalytic concepts and social critique in the perspective of Adorno's social thought. The title refers to Adorno's idea that psyche as individual spontaneity has now lost the weight it used to have in the liberal era. As a brief introductory remark, I clarify the status of theory for Adorno, i.e., the circularity between interpretation and description as grounded by the nature of the social object itself. Then I analyse his core idea of “social objectivity” as an impersonal mechanism which is at the same time produced by men and reified, heteronomous for them, and I argue that, for Adorno, the discontinuity existing between individual and society prevents an immediate shift of psychoanalytic concepts to the social world: the example of fascism clearly proves that the determining social forces today, while instrumentally exploiting deep psychical materials, are not themselves psychological. In the final part, I show how, for Adorno, psychology and sociology nevertheless need to be mediated with each other, while avoiding the superficial synthesis the so-called “revised psychoanalysis” aims to, and I point out some similarities between psychoanalytic practice and social critique as conceived by him.
Um leitor de Walter Benjamin: dialética, interpretação e materialismo em Theodor W. Adorno, 1931-2

O objetivo do artigo édiscutir a influência do livro Origem do drama trágico alemão(1928) de Walter Benjamin sobre duas preleções de Theodor W. Adorno na Universidade de Frankfurt, a saber: “A atualidade da filosofia” (1931) e “A ideia de história natural” (1932). Com isso, procurou-se, por um lado, indicar especificamente a influência benjaminiana sobre a ideia de constelação e, por outro, esclarecer as fundações histórico-filosóficas da ideia de história natural, que se encontram no centro das reflexões epistemológicas deAdorno. Dessa maneira, é possível compreender as concepções de dialética, interpretação e materialismo trabalhadas por Adorno com o propósito de caracterizar sua própria tarefa filosófica no início da década de 1930.
O artigo toma as críticas ao entrelaçamento entre direito e violência como um ponto de partida para explorar a possibilidade de um "tertiumdo direito". Desse modo, busca superar a suposição dicotômica básica que enxerga o direito sempre oscilando entre uma apologia à violência, de um lado, e uma utopia da razão, de outro. O texto analisa a possibilidade dessetertium, uma "força legal" além da violência legal e da razão legal, em quatro passos, recorrendo ao trabalho de Jacques Derrida e de autores da primeira geração da Escola de Frankfurt, em particular, de Theodor Adorno e Walter Benjamin. Argumenta que, em um primeiro passo, o direito precisa ser dissociado do Estado. A violência jurídica, entretanto, não se origina apenas do laço entre direito e poder de Estado. O direito é em si mesmo violento, mesmo quando não é direito de Estado. O segundo passo da crítica legal consiste, portanto, na recordação da violência do direito, seguido por um terceiro, que pede a transformação da violência em força. Essas três instâncias da crítica são as precondições para um passo último e essencial, de acordo com o qual a crítica do direito deve facilitar a transcendência da violência jurídica, tomando o direito e a sua promessa de justiça ao pé da letra com a finalidade de voltar essa promessa contra o próprio direito.
Promove-se uma recuperação do debate endógeno estabelecido entre alguns pensadores da Escola de Frankfurt, sobretudo no que se refere às diferentes perspectivas de análise sobre as relações entre ação e estrutura social, bem como as distintas percepções acerca das racionalidades (prática ou comunicativa) que organizam a conexão entre os indivíduos e a sociedade. Verifica-se o modo como os autores ligados à teoria crítica compreenderam as relações entre esferas subjetivas e estruturais em termos de possibilidades de emancipação social e de exercício de práticas deliberativas. Nessa perspectiva, considera-se uma cisão teórica estabelecida no interior da própria escola, cuja expressão se dá a partir das diferenças epistemológicas existentes entre o núcleo central do pensamento frankfurtiano e um conjunto de autores periféricos. Os trabalhos produzidos por esse núcleo “marginal”, bem como seu posterior refinamento na obra de Habermas, apresentam alternativas teóricas de caráter relacional que contrapõem a visão estrutural e cética presente nos trabalhos de Horkheimer, Adorno e Marcuse. É justamente na recuperação dessas fronteiras endógenas que se pretende ponderar as possíveis contribuições do pensamento frankfurtiano para uma perspectiva crítica da sociedade contemporânea.
Axel Honneth associates his reading of Hegel with Winnicott's maturational development theory, in order to defend theses on intersubjectivity and recognition. That connection between philosophy and psychoanalysis is a target of criticism from two Hegelians: Joel Whitebook, a reader of Freud, and Judith Butler, a critical reader of Freud and Lacan. At the core of the controversy is Honneth's rejection of the work of the negative that is performed by Freud's death drive. We intend on following in the wake of that debate, and thus investigate the reasons and consequences for social criticism of Honneth's rejection of Freud's death drive.
Axel Honneth associa sua leitura de Hegel à psicologia da maturação de Winnicott de modo a defender teses sobre intersubjetividade e reconhecimento. Esta articulação entre filosofia e psicanálise é objeto da crítica de dois hegelianos: Joel Whitebook, leitor de Freud, e Judith Butler, leitora crítica de Freud e Lacan. No centro da polêmica está a rejeição honnethiana ao trabalho do negativo realizado pela pulsão de morte freudiana. Pretendemos seguir o rastro deste debate e investigar as razões e consequências para a crítica social da recusa do frankfurtiano à pulsão.

The language of hope is a ubiquitous part of political life, but its value is increasingly contested. While there is an emerging debate about hope in political philosophy, an assessment of the prevalent scepticism about its role in political practice is still outstanding. The aim of this article is to provide an overview of historical and recent treatments of hope in political philosophy and to indicate lines of further research. We argue that even though political philosophy can draw on recent analyses of hope in analytic philosophy, there are distinct challenges for an account of hope in political contexts. Examples such as racial injustice or climate change show the need for a systematic normative account that is sensitive to the unavoidability of hope in politics as much as its characteristic dangers.
This article aims to shed light on some core challenges of liberating social criticism. Its centerpiece is an intuitively attractive account of the nature and difficulty of critical social thought that nevertheless goes missing in many philosophical conversations about critique. This omission at bottom reflects the fact that the account presupposes a philosophically contentious conception of rationality. Yet the relevant conception of rationality does in fact inform influential philosophical treatments of social criticism, including, very prominently, a left Hegelian strand of thinking within contemporary Critical Theory. Moreover, it is possible to mount a defense of the conception by reconstructing, if with various qualifications and additions, an argument from classic—i.e., mid twentieth-century—Anglo-American philosophy of the social sciences, in particular, the argument that forms the backbone of Peter Winch’s The Idea of a Social Science. Winch draws his guiding insights from the later philosophy of Wittgenstein, and one of the payoffs of considering Winch’s Wittgenstein-inspired work against the backdrop of Hegel-inspired work in Critical Theory is to contest the artificial professional strictures that are sometimes taken to speak against reaching across the so-called ‘Continental Divide’ in philosophy. The larger payoff is advancing, by means of this philosophically ecumenical approach, the enterprise of liberating social thought.

El siguiente documento rastrea la idea de la industria cultural desde su origen como un concepto filosófico en el trabajo de dos autores de la Escuela de Frankfurt, Adorno y Horkheimer. Debido a que el estado lo usa instrumentalmente, la definición de este concepto ha cambiado. El artículo ahonda en la perspectiva de los autores de la Escuela de Frankfurt, agregando las contribuciones y críticas de Walter Benjamin sobre la obra de arte en la era de la reproducción mecánica, con el fin de establecer una relación entre ambas perspectivas.
O Instituto de Pesquisas Sociais (Institut für Sozialforschung) foi fundado em 1923, como um anexo da Universidade de Frankfurt, hoje intitulada Johann Wolfgang Goethe-Universität Frankfurt am Main. A Escola de Frankfurt, desde 1930, foi dirigida por Max Horkheimer, e reunia pensadores como Theodor W. Adorno, Erich Fromm, Herbert Marcuse, e, contou também como membro do "círculo de fora" do Instituto, Walter Benjamin. Estes intelectuais formularam, como sabemos, o que conhecemos como "Teoria Crítica". Nos anos sessenta, temos a "segunda geração", marcado pela obra de Jürgen Habermas. Aquele que foi seu assistente entre 1984 e 1990, Axel Honneth, veio a ser o Diretor do Instituto frankfurtiano desde 2001. Com ele inaugura-se a "terceira geração" da Escola, cuja proposta consiste em relançar a "Teoria Crítica", sobretudo a partir do livro Kampf um Anerkennung. Zur moralischen Grammatik sozialer Konflikte, de 1992 (publicado no Brasil como Luta por reconhecimento - A Gramática Moral dos Conflitos Sociais. Trad. Luiz Repa. São Paulo: Ed. 34, 2003), tendo como ponto de partida a Fenomenologia do Espírito de Hegel. Honneth centra sua reflexão na "teoria do reconhecimento" e, através dela, são apresentados os limites da obra das gerações de frankfurtianos anteriores. A falta de reconhecimento passa a ser vista como base dos conflitos interpessoais, sociais e políticos na atualidade. Mais recentemente, Honneth publicou Das Recht der Freiheit (Berlin, Suhrkamp, 2011 - O direito à liberdade) e Die Idee des Sozialismus (Berlin, Suhrkamp, 2015 - A ideia do socialismo), sustentando que o socialismo está vivo como ideia, e tem como cerne a liberdade social. Foi em 2014, no Instituto de Pesquisas Sociais de Frankfurt, que aconteceu o encontro e a entrevista com o Diretor do Instituto, Axel Honneth. O foco da breve entrevista, aqui apresentada no original alemão e em tradução portuguesa.
El ensayo contrasta dos grandes posturas ante el fenómeno omnipresente de la técnica, en estricta relación con las concepciones profundas de lo racional y lo natural que le subyacen. Ortega por un lado, y Adorno, Horkheimer y Marcuse por otro, son excelentes ejemplos de visiones muy diferentes pero complementarias, que además conjugan aspectos antropológicos, históricos y políticos de gran importancia para ofrecer una panorámica global en este campo, sin reduccionismo alguno, y ayudar así a repensar nuestro presente.
The following article attempts to clarify the ambivalent relationship that Max Horkheimer and Herbert Marcuse developed with the vitalist and phenomenological tendencies that permeated philosophy and the social sciences during the Weimar Republic. More precisely, it traces how both thinkers, in spite of acknowledging the “truth moment” contained in the criticism that the philosophical exponents of both movements (Husserl, Bergson, Dilthey) developed of 19th century positivism, also recognized in its shallow popularization the advancement of a dangerous philosophical irrationalism, suspicious of science and Enlightenment values, that would soon become an accomplice to the rise of fascism.
O ensaio traz como base a crítica ao capitalismo, no que se refere aos efeitos negativos que ele impõe aos indivíduos, a partir dos estudos da primeira geração da Escola de Frankfurt. Analisar-se-á a história das ideias a partir de Walter Benjamin, Herbert Marcuse, Theodor Adorno e Max Horkheimer. Benjamin afirma que vive-se a perda da aura das obras de arte, já que a sua comercialização faz com que se perca a essência daquelas obras. Ademais, a imposição da novidade às obras e aos produtos consumidos representa uma ferramenta de manipulação do capitalismo, culminando na pobreza da experiência humana. Marcuse afirma que a sociedade vive o princípio do desempenho, que provoca modos de vida uniformizados, baseados numa concepção de trabalho e diversão homogêneos. Adorno propôs que o tempo livre provocava uma sensação de liberdade nos indivíduos, mas, na realidade, tratava-se do exercício de uma não liberdade, já que as formas de diversão seguiam à risca os padrões exigidos pelo capital. A partir do método adotado pela própria Teoria Crítica, afirma-se que a presente discussão teórica só se torna efetiva quando aplicada à prática, à sociedade atual.
Este estudo tem como finalidade analisar a perspectiva da arte como parte do aparato de dominação social, desenvolvida na obra A ideologia da sociedade industrial, de Herbert Marcuse. According to the theory of language of the young Benjamin, the primary task of language isn't the communication of contents, but to express itself as a "spiritual essence" in which also men take part. That conception according to which language would be a medium to signification of something outside it leads to a necessary decrease of its original strength and is thus denominated by Benjamin bürgerlich. The names of human language are remainders of an archaic state, in which things weren't yet mute and had their own language. Benjamin suggests also that all the arts remind the original language of things, as they make objects "speak" in form of sounds, colors, shapes etc. That relationship between arts as reminders of the "language of things" and the possible reconciliation of mankind with itself and with nature has been developed by Theodor Adorno in several of his writings, specially in the Aesthetic Theory, where the artwork is ultimately conceived as a construct pervaded by "language" in the widest meaning - not in the "bourgeois" sense.
This paper intends to present some considerations on a possible epistemology of noise as a response to theory of recognition and its bases on theory of communicative action. The principal movement will be to recover some aspects of Marcuse’s and Foucault’s perspective on the disturbances narratives in social sphere. The interest for them becomes stronger from Habermas’ perspective on their “performative contradicions”. Both of them would appeal to social aspects that escapes from critical normativities. Foucault’s structures of power as well as Marcuse’s psychoanalytical drives would represent aspects of the same Habermasian problem: the absence of auto-critical rationality. However, we can question: what would offer to the two authors the limits of communicative action?
The papers here collected are divided in an English and an Italian section, to facilitate the reader who is confident, or prefers, only one of these languages. In both sections, Critical Theory is addressed in a twofold way: as regards its origins in the so-called School of Frankfurt and as concerns its further and contemporary developments, from an interdisciplinary perspective.
Critical Theory offers a new way to understand not only the society, but also the individual. In particular, I will focus on the thought of Adorno and his conception of society.
First, I want to investigate the Adornian description of society in its totalitarian face and in its paradoxical relationship with the individual. The individual, first element of society, without which any society cannot be imaged, paradoxically finds – in the society – its liquidation and destruction.
Secondly, I want to consider the Adornian revolutionary statement in a conversation with Horkheimer of a need of a “New Manifesto”. Do we need it even today? Would be really possible a new Marxian society in our world? The attempt to answer to those questions will conclude my paper.
In this article the author highlights some issues about Adorno’s thought that are fundamental to be acquired in the present age. It focuses on the questions most criticized in the postwar period: cultural industry, managed world, presumed snobbery about mass society, decline of aura, end of individuality, post-individual or pseudo-individuality, ticket mentality. Therefore, the author suggests to explain contemporary age starting from the Adornian model, an important interpretive antecedent to understand new media and the world that they produce. So this article underscores the similarity about many causes for reflection in Theodor W. Adorno and also H. Marcuse: in spite of oustanding differences, both theorists persist on the “power of negative thinking” and on the “feeling of the contrary”. This persistence lays the foundations of critical thought in Adorno, who shows parodying art such as the critical model par excellence. Finally, last pages are directed to remark the importance of Adorno’s thought such as metacritical philosophy, surely more fruitful than the paradigm of the “second generation” in the following decades.
In this paper I intend to discuss the relation of Marcuse’s theory of technology to its grounding in the possibilities he believed lay inherent, but as yet untapped in nature. Marcuse was an early critic of what he considered to be the exploitative, predatory approach to nature brought about through the direction of technology, industry and science under consumer capitalism, however his alternative; a “new science” and “new technology” which would treat nature as an “ally” in the general struggle for liberation and emancipation, was not without its problems.
The evolution of Critical Theory in the thought of Jürgen Habermas has important consequences for political questions, influencing the actual intellectual debate. This paper examines the main works and studies of Habermas about the epistemology of social sciences, the critique of late capitalist society, the public sphere and democracy, and proposes a comparison with the positions of Jacques Derrida, to have a better comprehension of this evolution.
Critical Theory is the key-word representing all the universe of thought commonly known as „Frankfurt School”. Within it, Theodor Wiesengrund Adorno and Herbert Marcuse are not so far each other, as instead are Max Horkheimer and Marcuse – considering what I in this paper define as the conservative turn of the director of the Institut für Sozialforschung. Whereas Adorno refuses any engagement in the political and lives as an obsession the theory-praxis relation, Marcuse is closer to a certain critical Marxism and to the student movements of Sixities and Seventhies. The crucial issue of the theory-praxis relation comes back clearly in the distance between Marcuse and the other two maîtres à penser, about their judgment on the ’68 movement.
The one-dimensionality of econometric data: the Frankfurt School and the critique of quantification

Econometric data are used to produce authoritative facts about the world. Yet, as numbers enjoy a central place in modern reasoning (particularly in government as their presumed objectivity and neutrality assist impartial decision-making), it is important that they receive scrutiny. Using methodological techniques from Western Marxism, with special reference to the work of Lukács, Horkheimer and Adorno, and Marcuse to inform a critique of Acemoglu and Robinson, I argue that the historical emergence of econometrics as a mode of mediated knowledge is a reified practice within the broader technical administration of social life, a practice that is not a transparent representation of social phenomena. This is because when econometrics transforms the thing being measured into a statistical indicator it eclipses political disputes with technical disputes, sidestepping good faith democratic deliberation about what goods are worth pursuing. Effectively, one-dimensional thought cannot perceive the origins of items put into circulation and so ideology is produced – what seems value-free is value-laden.
Este artigo pretende analisar o efeito da operação de enquadramento editorial levada a cabo pela Editora Sur, vinculada à Revista Sur, na circulação do repertório frankfurtiano na Argentina da década de 1960. Ao traduzirem e divulgarem autores como Adorno, Horkheimer e Benjamin, a partir de sua posição específica no campo cultural argentino, a coleção Estudios Alemanes contribui para que seus autores sejam desvinculados da tradição marxista e alocados em uma categoria mais ampla de “pensamento alemão”. Com isso, a circulação desses autores fica restritra a certo público, já cativo da perspectiva teórica e política da Revista Sur. Neste artigo, descrevo a coleção nos marcos da difusão mais ampla da tradição alemã no campo letrado argentino, atentando para os deslocamentos de prestígio que ela mobiliza e, sobretudo, para a composição de uma “atitude intelectual” que, a despeito do conteúdo dos textos em circulação, condiciona a recepção e ressignificação dos textos frankfurtianos.
Over three decades the works of Frankfurt School member Theodor W. Adorno played an important role in the didactic conceptualization of popular music in Germany. This resulted in a predominantly analytical, ethic-centred and, in the end, pejorative agenda. Educationalists who advocated an affirmative approach to popular music needed to formulate “new” objectives that would serve as a true alternative to the highly elaborated Adornian framework. Though affirmative approaches finally became prevalent, the didactic situation remained delicate, since the teaching of popular music was also subject to general debates on how school education shall be constituted. Subsequently, the subject “popular music” became more and more tied to overall educational goals, whereas the objective dimension was increasingly ignored. The paper aims to reconstruct the complex path from critical to post-critical didactic efforts, finally addressing current issues, especially the notion of popular music as cultural practice. The “paradigm shift” towards affirmation is demonstrated on the basis of both theoretical works and curricular sources.
The essay focuses on the impact of Marcuse’s Eros and Civilization in Germany in 1968. First, the essay discusses how Freud’s theory was used in the late twenties at the Institute for Social Research in Frankfurt. Then, it focuses on how certain of Adorno and Horkheimer’s ideas were developed in Eros and Civilization. Finally, it shows how Marcuse’s work became relevant for the intellectual development of the student movement in Germany.
Historiadora do cinema, Miriam Hansen examinou e sistematizou as contribuições de Siegfried Kracauer, Walter Benjamin e Theodor Adorno para a teorização do cinema. Nesta pesquisa bibliográfica, buscamos sintetizar e apresentar aos leitores de língua portuguesa o desenvolvimento de sua investigação sobre o tema. Mostramos como Hansen foi capaz de identificar as principais diferenças entre os teóricos frankfurtianos, bem como evidenciar que eles, em comum, pensaram este fenômeno cultural contemporâneo em relação às condições sociais e econômicas de produção. Em suas reflexões, o cinema aparece como expressão da sociedade urbano-industrial, como um elemento sintomático da cultura de massa.
Dialéctica del Iluminismo, de T.W. Adorno y Max Horkheimer, puede llevar a la confusión de entender pensamiento y razón como términos indiferenciados. Este vínculo tiende a establecerse a través de un mecanismo de metonimia que remite uno al otro como si ambos fueran semejantes. Sin embargo, la primera dificultad al confundir ambos términos y la misma dificultad de Horkheimer en su Crítica de la razón instrumental es la de establecer la diferencia entre razón objetiva y metafísica, así como ubicar valorativamente al mito en esta segunda categoría. El presente trabajo explora las claves que permiten operar la igualación del mito a Iluminismo y la reducción de ambos a metafísica en el pensamiento de la Escuela de Frankfurt.
A publicação deste polêmico artigo é uma homenagem de Lua Nova aos oitenta anos de História e Consciência de Classe, de Georg Lukács. Seu autor faz um resgate do jovem Lukács, identificando os pressupostos e idéias que tornam esse livro de 1923 não tanto filosoficamente, mas politicamente, um feito revolucionário, em sintonia com o ''Evento de 1917'' na Rússia. Zizek entende que é justamente seu teor político, o qual aponta para uma crítica radical dos regimes liberal-democráticos predominantes no Ocidente, que o mantém atual, nesse sentido ultrapassando os limites auto-impostos dos autores da Dialética do esclarecimento.
O presente trabalho tem por objetivo apresentar algumas idéias sobre o tema do treinamento corporal e sua relação com o domínio da natureza. Para isso apresenta-se a teoria da formação do sujeito e da civilização desenvolvida por Theodor W. Adorno e Max Horkheimer, sobretudo na Dialética do esclarecimento. A ênfase recai sobre o papel do sacrifício nesse processo, e a relação deste com o corpo. A partir daí procura-se entender o esporte, e dentro dele o treinamento corporal, com vistas a desenvolver uma análise daquele baseada na lógica sacrificial e na correspondente redução do corpo a uma naturalidade desqualificada e fungível.
Plato's allegory of the cave set a fashion for philosophy, i.e. to distinguish between appearance and reality. This fashion is still distinguishable in the work of two philosophers whose social critiques, at a first glance, are worlds apart: Herman Dooyeweerd of the Free University in Amsterdam, and Theodor Adorno o f the Johann Wolfgang Goethe University in Frankfurt. Upon a closer look, however, many similarities appear. Their diagnoses of Western society probes beneath the beguiling surface of scientific and technological progress to reveal serious tensions deeply embedded in Western culture. The question arises: how conscious are they of their own embeddedness in this cultural crisis? Dooyeweerd and Adorno are analysed on this issue, and the conclusion shows Dooyeweerd’s philosophy to suffer from an intellectual hybris, whereas Adorno’s is portrayed as burdened with a paralysing aestheticism. The result of this critical analysis of Dooyeweerd and Adorno is a suggestion to rehabilitate the tradition of Christian thinking as an ongoing debate between rival interpretations of the biblical message, which offers creative opportunities to respond to cultural crises and the suffering they entail.
During the last thirty years or so, there has been a veritable renaissance of the classical ethical idea of the "art of living". Far from being restricted to philosophical discourse, it has also successfully entered the arena of popular culture. This renaissance is closely linked to the late work of Foucault, in which he attempts to restore this classical idea, which he thinks is lacking in modern Western societies. The author aims to assess the Foucaultdian idea of the art of living, and argues that Foucault greatly transformed the Graeco-Roman idea by radicalizing the dimension of artistic activity. In the second part of the paper the author asks whether this radicalized idea can live up to Foucault’s own emancipatory expectations. Lastly, the author argues that the radicalization of the aesthetic dimension has a contradictory effect.
This paper analyses economic power, state power and ideological power in the age of Donald Trump with the help of critical theory. It applies the critical theory approaches of thinkers such as Franz Neumann, Theodor W. Adorno and Erich Fromm. It analyses changes of US capitalism that have together with political anxiety and demagoguery brought about the rise of Donald Trump. This article draws attention to the importance of state theory for understanding Trump and the changes of politics that his rule may bring about. It is in this context important to see the complexity of the state, including the dynamic relationship between the state and the economy, the state and citizens, intra-state relations, inter-state relations, semiotic representations of and by the state, and ideology. Trumpism and its potential impacts are theorised along these dimensions. The ideology of Trump (Trumpology) has played an important role not just in his business and brand strategies, but also in his political rise. The (pseudo-)critical mainstream media have helped making Trump and Trumpology by providing platforms for populist spectacles that sell as news and attract audiences. By Trump making news in the media, the media make Trump. An empirical analysis of Trump’s rhetoric and the elimination discourses in his NBC show The Apprentice underpins the analysis of Trumpology. The combination of Trump’s actual power and Trump as spectacle, showman and brand makes his government’s concrete policies fairly unpredictable. An important question that arises is what social scientists’ role should be in the conjuncture that the world is experiencing.
Wenn die Bedrohung, wie im Fall des Virus, als natürliche Gegebenheit auftritt, kommen leicht auch die Maßnahmen, um ihn zu beseitigen, als natürliche, d.h. fraglos vorgegebene Maßnahmen in Betracht. Eine Gefahr liegt hier darin, von einer Natürlichkeit des Zwecks auf die Natürlichkeit der Mittel zu schließen. Dass die Maßnahmen aber nicht natürlich gegeben, sondern politisch entschieden sind, muss demgegenüber im Blick bleiben.
There has been a burgeoning interest in the sociology of the Frankfurt School as well as the oeuvre of Theodor W. Adorno since the 2016 presidential campaign of Donald J. Trump. The objectives of this study are to both illustrate the enduring importance of Adorno and to provide an important theoretical outline in making sense of Trump’s 2016 United States presidential campaign. Using Adorno’s understudied textual analysis of the radio addresses of Martin Luther Thomas and data from Trump’s 2016 US presidential campaign, we find that Trump’s own discourse can be condensed into three of Adorno’s rhetorical devices: (1) the lone wolf device or anti-statism/pseudo-conservatism, reflecting his criticism of "special interests" and his appraisal of business and (self-)finance; (2) the movement device, which amounted to glorification of action; and (3) the exactitude of error device which amounted to xenophobic, ethnonationalist hyperbole.

In dieser Arbeit analysiert Diehl den Zusammenhang zwischen den normativen Strukturen und der symbolischen Praxis eines demokratisch verfassten politischen Gemeinwesens. Beide bedingen sich gegenseitig. Die normative Struktur einer Gesellschaft findet den Grund ihrer Geltung und der Stabilität in der symbolischen Praxis; diese wiederum muss begriffen werden als Ausdruck der Prinzipien und Regeln der normativen Grundstruktur. Eine Krise des Politischen ist zu verstehen als Resultat und Ausdruck einer Störung in diesem wechselseitigen Bedingungsverhältnis von normativer Struktur und symbolischer Praxis der politischen Gemeinschaft. ...
Die normative Assoziierung von Technikfolgenabschätzung (TA) mit der Habermas‘schen deliberativen Demokratietheorie ist weit verbreitet; eine tiefere Auseinandersetzung mit alternativen Demokratieverständnissen bleibt allerdings weitestgehend aus. Daher regt dieser Beitrag eine grundsätzliche Debatte über die demokratietheoretische Einbettung der TA und ihr Verhältnis zum Politischen an. Aufbauend auf der u. a. in dieser Zeitschrift geführten Diskussion über die (Un)Möglichkeit normativer Neutralität in der TA wird eine weiterführende Kritik am Anspruch der TA auf normative Fundierung hergeleitet. Depictive pictures may be promising in at least three different senses, which are examined in this essay. The first concerns genuine acts of promising that involve pictorial representations, like gift cards displaying a present the promisor commits herself to give. In a second sense, advertising strategists use pictures to promise to consumers perfect pasta or empty beaches. A third sense amounts to pictures as promising if they are instructive. Such pictures can be used to learn some type of action, like the performance of a military salute or the crafting of some artifact. All three promissory uses of pictures exhibit normative forces related to commitments and entitlements regarding justified expectations.
Die Frage nach Konflikten zwischen den Rechtskulturen der USA und Deutschlands wirft ein kürzlich erschienener zweisprachiger Sammelband auf. Wer aber so fragt, der fragt nach mehr als Differenz. Er sucht nach Differenz in Interaktion, in der unterschiedliche Geltungsansprüche gleichzeitig erhoben werden. Sonst ginge es um das weniger abenteuerliche Vergleichen eines Nebeneinander. Leider bleibt die Publikation der Bayerischen Amerika-Akademie aber hierbei stehen und streift die emphatische Frage ihres deutschen Titels nur in Einzelbeobachtungen. Der Einfluss des amerikanischen Rechts in vielen internationalen Verträgen – Ausdruck der politischen Hegemonialstellung der USA – und die Dominanz amerikanischer Juristen in der internationalen Schiedsgerichtsbarkeit – Ausdruck der wirtschaftlichen Bedeutung der USA – hätten jedoch Anlass gegeben, immunologische Reaktionen an lebenden Rechtskörpern zu studieren. So aber bleibt es bei der In-vitro-Insemination des deutschen Lesers mit Hinweisen darauf, dass und warum die anderen es anders machen (etwa in Beiträgen zur Kriminalprävention von Streng und Kelling oder zum Jugendstrafrecht von Silverman). In letzterem, in kulturhistorischen Erklärungsversuchen des Warum, findet der Band freilich seinen gedanklichen Schwerpunkt und einige interessante Einsichten. Am anderen Ende derWelt, in einem argentinischen Städtchen im Bundesstaat Buenos Aires, versetzten die epochalen Ereignisse in Europa nach dem Fall des Eisernen Vorhangs den Bürger Dinko Šakić in Entzücken. Fünfzig Jahre nachdem er aus seiner Heimat geflüchtet war, führten die tektonischen Umwälzungen nach dem Ende des Kommunismus und der europäischen Teilung sogar zur staatlichen Verselbständigung seiner einstigen Heimat Kroatien – zu einer jahrzehntelang nicht einmal im Traum denkbaren Entwicklung. Dinko Šakić setzte sich daraufhin öffentlich für seine frühere Heimat ein. Es fiel ihm gar nicht ein, dass ihn seine Vergangenheit einholen könnte. Wahrscheinlich weil er "ein gutes Gewissen" hatte, ein von ihm gern benutzter Ausdruck, oder weil er in der jungen Republik Kroatien eine Art Fortsetzung jenes Staatsgebildes sah, dem er in seiner Jugend "gedient" hatte (auch ein beliebter Ausdruck Šakićs). In der größten lateinamerikanischen Kroatengemeinde in Argentinien gab es wahrscheinlich nichts, was ihn zur Vorsicht hätte mahnen können. Er schien die Öffentlichkeit geradezu gesucht, womöglich sogar eine Anerkennung erwartet zu haben. Bei einem Empfang zu Ehren des kroatischen Präsidenten während dessen Staatsbesuchs in Argentinien wurde Šakić von Journalisten beobachtet, wie er Tudjman nicht von der Seite weichen wollte, was diesen sichtlich irritierte und zu Hause für Empörung sorgte. Šakić, der sich selbst bei mehreren Gelegenheiten als glühenden kroatischen Nationalisten schilderte, weshalb er schon als Jugendlicher Anhänger der Ustascha-Organisation geworden sei, ahnte offensichtlich nicht, dass seine Art der Heimatliebe dort Entsetzen hervorrufen würde. ...
Einmal zu einer Zeit, als der Krieg sich in Bosnien-Herzegowina fortzusetzen begann, bekam ich von einer deutschenWochenzeitung den Auftrag, einen Beitrag über das Profil des Krieg führenden jugoslawischen Personals zu schreiben. Was sind das für Offiziere, die auf Zivilbevölkerung, Städte, Kirchen, Moscheen schießen lassen, ganze Dörfer platt machen und Gegenden entvölkern – muss man sich gefragt haben. Während meiner Jugend war ich vielen Kindern und Jugendlichen begegnet, die aus Offiziersfamilien kamen, und kannte so auch eine Menge Geschichten mit Elementen, die mir als charakteristisch für diese besondere Mentalität erschienen. Aber die Idee, aus solchen erinnerten Erfahrungen so etwas wie ein Täterprofil zu skizzieren, gab ich bald auf. Obwohl es dabei eindeutige Hinweise gab – so war ich mit der Leidenserfahrung einer Schulkameradin vertraut, deren brutaler Vater nach dem Kasernenregiment zu Hause herrschte –, stand keine brauchbare Mentalitätsforschung zusätzlich zur Verfügung, die die eigene Beobachtung hätte untermauern können. Das andere unüberwindbare Problem war, dass es sich bei dieser Gruppe fast ausnahmslos um Serben handelte und eine Generalisierung Gefahr gelaufen wäre, als ethnizistisch einseitig missverstanden zu werden. ...

Die übergroßen Augen sehnsuchtsvoll ins Weltall gerichtet, jammert jenes kleine, auf der Erde vergessene, unglückliche Wesen nach seiner Heimat, die fern und den Erdenbewohnern fremd und unbekannt ist – ein Nichtort, der gleichwohl der Ort des Ursprungs, des Zuhauseseins und aller Wehmut ist. ...
Die Welt im Sandkorn zu entdecken gehört seit jeher zu den Sehnsüchten der Historiker. Mit Blick auf das Ganze, das Allgemeine, wird oft das Typische, das Exemplarische bemüht, das man in Einzel- oder Fallstudien einzufangen glaubt. Hinge die Relevanz lokaler Studien von der Prämisse ab, die große Welt im Kleinen finden zu müssen, hätten sie schlechterdings keinerlei Relevanz. So zumindest urteilt Clifford Geertz über entsprechende Studien in der Ethnologie nach dem Modell "Jonesville-ist-die-USA". Der Versuchung eines solchen Modells ist Francisca Loetz in ihrer Heidelberger Habilitationsschrift über frühneuzeitliche Blasphemie am Beispiel Zürcher Gotteslästerer erlegen. In einer Langzeitstudie vom späten 15. bis zum frühen 18. Jahrhundert untersucht Loetz rund 900 dokumentierte Fälle der Wortsünde des Fluchens, Schwörens und Schmähens bei "Gotz schedel", "Gotz bart" oder "Gotz nasa". Delikte, bezüglich derer man im 16. Jahrhundert empfahl, den Angeklagten ein Schloss für ihre Zungen zu schlagen. Die Ergebnisse dieser Studie erfüllen jedoch nicht den erhobenen Anspruch der Repräsentativität für das Westeuropa der frühen Neuzeit. Und sie müssen es auch nicht, denn die Arbeit hat auch ohne diesen Anspruch genug zu bieten. ...

Wohl kaum wird der amerikanische "Imperator" den gefangenen "Barbaren von Bagdad" im Triumphwagen durch die Straßen von Washington ziehen lassen, auch wenn sich die publizistische Rhetorik seit den Kriegen gegen Afghanistan und den Irak mit Vergleichen zwischen dem antiken Rom und dem neuen Amerika förmlich überschlägt. "Sind die Amerikaner die Römer unserer Zeit?", fragt sich als einer unter vielen der Publizist und Althistoriker Peter Bender. Expansionen der alten wie der neuen Imperatoren werden miteinander verglichen, Parallelen und Unterschiede in der geographischen Lage, in den Interessen und Willen der Akteure ausgemacht. So habe bei den Amerikanern der Sendungsglaube als universale Macht schon am Anfang des Imperiums und nicht erst an dessen Ende wie bei den Römern gestanden. Roms Ostkriege und der kalteOst-West-Krieg hingegen zeitigten dasselbe historische Ergebnis: "Davor waren Rom und Amerika die ersten Weltmächte ihrer Zeit, danach waren sie die einzigen." Von "Aufstiegen" ist die Rede, nicht aber von "Untergängen", wie es die zyklischen Zivilisationsgeschichten der Kulturmorphologen verkünden. Das hat seinen Grund. Hinter der Analyse kommt Normatives zum Vorschein, wenn es um den Schutz der "Zivilisation des Abendlandes" in "einer künftigen Welt" geht, "in der andere Kulturen sich gegen den 'Westen' behaupten, stärken und vordringen …" Bender lässt das imperium romanum nicht untergehen, weil er das amerikanische Imperium als Bollwerk westlicher Kultur braucht. ...

Wir wissen nicht, was König Adolf von Schweden in seiner Satteltasche trug, als er im 30jährigen Krieg hoch zu Ross in die Schlacht zog. Angeblich soll es ein Exemplar des Buches "De iure belli ac pacis" gewesen sein, des völkerrechtlichen Hauptwerks von Hugo Grotius. Spätestens seit Louis Aubéry du Mauriers "Memoires pour servir a l’histoire de Hollande et des autres Provinces-unies" (1688) gehört diese Anekdote zum festen Bestandteil des Grotius- Mythos. Erzählt wird sie meist dann, wenn es um die Frage nach dem Verhältnis von Theorie und Praxis im Völkerrecht und ihrer Geschichte geht. Umdiese Frage dreht es sich auch in dermit Spannung erwarteten Arbeit von Martine Julia van Ittersum über die Verstrickungen des jungen Grotius in die Überseepolitik des ebenfalls noch jungen niederländischen Staates. ...
Zeit ist einer jener Begriffe, für die man die Augustinische Charakterisierung gelten lassen wollte, es sei klar, was sie bedeuten, solange nicht danach gefragt werde (Augustinus Confessiones Lib. XI, 17). Die Frage aber nach dem, was "Zeit" eigentlich ist, erscheint umso berechtigter, als es insbesondere die Naturwissenschaften sind, die für sich in Anspruch nehmen, hier Antworten geben zu können. Die zu erwartenden Antworten wären danach wesentlich empirischer Natur – also direkt oder indirekt experimentell gestützt und mithin Ergebnis dieser Forschung. ...
Jon Elster hat sich in der rational choice-Theorie durch Studien zu Selbstbindungstechniken als Absicherung gegen Irrationalitäten im Entscheidungsprozess einen Namen gemacht. Passend zu diesem Theoriehintergrund untersucht Elster in seinem Buch "Die Akten schließen" Entscheidungsmöglichkeiten nationaler Gesellschaften, mit dem Irrationalen umzugehen und gesellschaftliche Umbrüche zu bearbeiten. Elster geht es darum zu zeigen, dass die Art und Weise, wie Gesellschaften ihre offenen Rechnungen nach Regimewechseln begleichen, höchst unterschiedlich ist. Darum trägt er unterschiedliche Formen der "Vergangenheitsbewältigung" zusammen und setzt sie miteinander in Bezug. ...
Sowohl in den 1920er als auch in den 1960er und 70er Jahren waren materialistische bzw. marxistische Ansätze Bestandteil des Rechtsdiskurses. Diese Orientierung ist seitdem etwas aus dem Blick geraten. Man kann vielleicht sogar sagen, dass die materialistischen Ansätze auf dem Terrain der Rechtstheorie eher marginalisiert sind. Im Laufe der letzten Jahre hat Sonja Buckel in einer Reihe von Artikeln1 und in ihrem vor kurzem erschienenen Buch Subjektivierung und Kohäsion. Zur Rekonstruktion einer materialistischen Theorie des Rechts diese Fehlentwicklung in der Rechtstheorie zu korrigieren versucht. Die theoretische Originalität und soziologische Umsicht, mit der Sonja Buckel auf diesem Weg die weitreichenden Ansprüche einer materialistischen Rechtstheorie zu erneuern versucht, wären sicherlich schon Grund genug, sich mit ihrer materialistischen Theorie des Rechts gründlich auseinander zu setzen. Immerhin gelingt es ihr, im Gang ihrer Argumentation auch den Stellenwert einer Reihe von zeitgenössischen Ansätzen der politischen und rechtlichen Theorie im Rahmen der sozialen Auseinandersetzungen zu klären, von denen zumindest die europäischen Länder heute geprägt sind. Aber ein weiterer und für mich wesentlicher Grund, ihre Überlegungen mit großer Sorgfalt zu prüfen, ergibt sich aus der speziellen These, die sie als einen Leitfaden ihrem Erneuerungsversuch zugrunde legt: Es ist ihre Überzeugung, dass das Recht sich in kapitalistischen Gesellschaften seine "gespenstige Eigenwelt" (9) erzeugt. Die Faszination ihrer Theorie besteht gerade im Versuch, diese "phantasmagorischen" bzw. verdinglicht-verdinglichenden Prozesse des Rechts, seine Verselbständigung also, einer sowohl theoretischen als empirischen Analyse zu unterziehen. ...

Der notorische Dissens zwischen Philosophen und Juristinnen und sogar Theologen steht in einem seltsamen Missverhältnis zur Selbstverständlichkeit, mit der politische Akteure die Notwendigkeit dieser oder jener außenpolitischen Handlung durch Bezug auf die Menschenrechte rechtfertigen. ...
In this article, we hypothesize, and then demonstrate, that experiences of embarrassment have significantly increased in the United States, due in part, to the current situation in American politics under President Donald Trump. We provide support for our hypothesis by conducting both qualitative and quantitative analyses of Twitter posts in the U.S. obtained from the Crimson Hexagon database. Next, based on literature from social psychology, social neuroscience, and political theory, we propose a two-step process explaining why Trump's behavior has caused people in the U.S. to feel more embarrassment. First, compared to former representatives, Trump violates social norms in a manner that seems intentional, and second, these intentional norm violations specifically threaten the social integrity of in-group members—in this case, U.S. citizens. We discuss how these norm violations relate to the behavior of currently represented citizens and contextualize our rationale in recent changes of political representation and the public sphere. We conclude by proposing that more frequent, nation-wide experiences of embarrassment on behalf of the representative may motivate political actions to prevent further harm to individuals' self-concepts and protect social integrity.
This paper focuses on the life and work of three of the most important men who arrived in the Philippines during the 16th century: the Augustinian Martín de Rada (1533–1578) studied at the universities of Paris and Salamanca. He was one of the best European scientists of his time in East Asia. The Dominican Domingo de Salazar (1512–1594), first bishop of Manila, studied the legitimacy of the conquest of the Philippines and wrote against the Spanish plan to conquest China. The Dominican Juan Cobo (? –1592) was the first Spanish to master the Chinese language and, through his book Shilu, the first European who introduced Christianity to the Chinese from a rational point of view and the first one to introduce European science into Chinese context. All of them were very influenced by the School of Salamanca and, from Manila, they always had their eyes on China. These three men of the late 16th century are paradigmatic examples of the influence of the University of Salamanca in the production of global knowledge in the early modernity.
For reasons of curiosity, we perused the two recent Oxford handbooks on legal history looking for discussions of digital methods in legal history. One of the fundamental decisions to be made when organizing such a handbook is defining which methodological approaches deserve an article of their own and which ones are to be understood rather as cross-cutting themes to be discussed in the context of many articles dedicated to other things. In the case of digital methods in legal history, this decision seems to have been a tough one – at one point, you can find a curious reference to a "chapter on 'Legal History and Digital Humanities'" (OHBLH 354), but in the final publication there is no such text.
However, discussing digital methods in the context of other subjects has, in our opinion, the disadvantage that more systematic, methodological arguments cannot really be developed. Put more concretely, the most "substantial" contributions regarding digital methods are, for whatever reason, those on "The Intellectual History of Law" by Assaf Likhovski, on "Taking the Long View" by Paul D. Halliday, on "Quantitative Legal History" by Daniel Klerman, and on "Indian Law" by Mitra Sharafi, all of which are in the Oxford Handbook on Legal History. (Equally surprising, there is no mention of digital methods at all in Angela Fernandez’s "Legal History as The History of Legal Texts".) However, even these articles do not really "discuss" digital methods, rather they merely refer to them (and to some projects) as contributions of sorts to their respective fields of interest.
Thus, if you are looking for digital methods in those handbooks, you can hardly find more than some namedropping passages where things like "digital mapping […], network analysis […], text analysis" (OHBLH 845f.) are mentioned, together with references to example projects where they have been employed but without any explanation as to:
–why these methods are mentioned and not others,
–what they are doing, to which end and under what circumstances,
–what, possibly transformative, impact these methods have on the (respective sub-) field of legal history, and
–what a scholar considering to apply these methods should be aware of.
While the space for this is limited, the present Forum contribution tries to mitigate the scarcity of such discussions by presenting and discussing a few textual analyses that make use – for demonstration purposes – of digital methods. Some other methods of analysis, network analysis, and geo-mapping (among others), cannot be covered here, but we provide a link to an online bibliography where you can find them applied to legal history or a related domain, and discussed critically. A general discussion of digital perspectives beyond concrete methods of analysis concludes this contribution.
The presence of moral theology and scholasticism in the recently published Oxford Handbook of Legal History and Oxford Handbook of European Legal History is very limited. The first volume aims to be iconoclastic. It explicitly does not seek to provide a kind of global historical account but instead presents some of the innovative methodological perspectives guiding current legal historical research. Thomas Duve, writing about the contribution of the School of Salamanca to the theorization of a certain framework of "indigenous rights" during the period of colonial domination, is thus the only contributor to this volume who mentions moral theology. In the Handbook of European Legal History, there are two articles on important scholastic contributions to legal history that also deal with the influence of Salamanca and related scholastic authors to equally wide fields of legal thinking. Wim Decock discusses authors of the second scholasticism in the context of the law of property and obligations (611–632), and David Ibbetson writes on natural law (566–582). In the following, I will focus on Ibbetson’s chapter, which only partially matches the ambitious intended aims of the volume editors (Pihlajamäki, Dubber, Godfrey): to "chart the landscape of contemporary research" and to show the global impact that European legal systems had "from the fifteenth century onwards". ...

Matías De Paz and the introduction of thomism in the Asuntos De Indias: a conceptual revolution

Most of the writings dedicated to assessing the contribution of the Spanish Second Scholasticism to the controversial issue of infidels’ dominion began their analyses with the well-known Francisco de Vitoria’s Relectiones (1532). This article offers a reconstruction of the history of the theological and juridical debates on this key issue on the Iberian Peninsula since the late 13th century. Special attention is paid to friar Matías de Paz, who was asked to offer his advice on the early patterns of rule and domination imposed on the Native Americans at the Junta de Burgos (1512), introduced to the discussions about asuntos de Indias the Thomist conceptual framework later employed by Vitoria, Soto, Suárez and many other prominent members of the so-called School of Salamanca. The article shows that it was, in fact, De Paz who first considered the Amerindians infidels affected by an "invincible ignorance", and he tried to curb some of the many abuses committed against them by applying the distinctions between different types of dominium and principatus.
The four tomes included in La herencia de Cristóbal Colón. Estudio y colección documental de los mal llamados pleitos colombinos (1492–1541) are a scholarly contribution intended to settle the decades-long debate around the lawsuits that were (erroneously) designated in the historiography as the pleitos colombinos (Columbian lawsuits). The archival discoveries made by Consuelo Varela, Bibiano Torres, Antonio López Gutiérrez, Isabel Velázquez Soriano and Anunciada Colón de Carvajal (researcher and descendant, as it turns out, of Christopher Columbus) have led to a substantial revision of some preliminary and tentative arguments outlined earlier in partial editions of these documents. This article examines the reflections on legal translation set out in two Relaciones written by the 16th century Spanish jurist Alonso de Zorita. These serve as excellent illustrations for the creative dimension motivating several of the proposals for the adaptation of Castilian law to native legal custom in the Americas. My analysis focuses on some of the linguistic issues implied by Zorita’s proposal for the restoration of an idealized pre-Hispanic polity: the use of the native pictorial legal sources, and it considers some of the issues and dilemmas related to their proper interpretation and translation.
Canada’s geographic centre lies in the Territory Nunavut. From here the distance to the geographic North Pole is as far as to the US border. Nunavut takes up about 1/5 of the Canadian land mass but has by far the smallest population with currently about 38,000 residents. 85% of its population are Inuit whose culture dramatically changed within the last 70 years.
As a result, the territory is dealing with several generations of Inuit that are traumatized or at least severely affected by cultural and economic changes that started after World War 2 with the resettlement from the land into permanent communities. No matter if we are talking about the actual elders, mid-age adults or pre-teenagers, each of this generation experienced and still experiences various personal and cultural challenges of identity, financial and housing insecurity, food insecurity, substance abuse education, change of social values ranging from inter-generational and gender relationships to the introduction of a foreign political and legal system.
On the other side, a lot of the traditional societal values are still being practiced in Inuit families. Despite all the tragedies that several generations of Inuit have experienced by now, the society keeps generating the strength and cultural pride that allows many Inuit both, as individuals and as a collective under the umbrella of either Inuit Land Claims or not for profit organizations to advocate on behalf of Inuit culture, to fight for more acknowledgement of Inuit culture and to enhance pride in the historic and present day cultural achievements of Nunavut’s indigenous population.
The social issues, inter- and intra-cultural processes described in my thesis are not exclusive to the situation in Nunavut or to Inuit. Studies from other regions, in Canada or from around the world (LaPrairie 1987; Jensen 1986; Nunatsiaq News 6/30/2010) reveal similar challenges.
Though many structural similarities can be identified by comparing these studies with each other, e.g. marginalization of the indigenous local population, colonization, paternalism and resulting issues like personal and cultural identity loss, it is important to have a more in depth look into the single cases to determine which individual events and developments causes and maybe still cause such a devastating social situation as it is found among many indigenous peoples across the world. From my perspective effective improvements of the situation of a group, a respective community or region can only happen when particularities of socialization, communication and philosophy in the single cultural entities are being considered.
That is why my thesis will exclusively focus on developments in Nunavut and use various case studies of communities. The case studies shall help to identify local differences in historic and recent developments and thus provide starting points for explanations of different developments in different Nunavut communities.
The thesis is looking at both, historic and recent root causes for the many issues in Nunavut.
The data that my my thesis is based on are a combination of literature and about 60 formal and informal interviews that I conducted in three Nunavut communities (Iqaluit, Whale Cove, Kugluktuk) during my 18 months of field work between October 2008 and March 2010. Many more spontaneous unstructured conversations between me and community members added to the pool of first-hand information that I gathered.
Since my field work is limited to those three communities it has a very strong qualitative character. The quantitative side, which allows me to confidently apply my research analyses to entire Nunavut, comes from literature research as well as many informal conversations and a few formal interviews that I conducted with people who had some experience in other communities than Iqaluit, Kugluktuk and Whale Cove.
Furthermore, while I was living at the old residence of the Nunavut Arctic College in Iqaluit, I spend time with college students from across Nunavut. Through them, I obtained „case studies “from following communities: Iqaluit, Qikiqtarjuaq, Kimmirut, Pangnirtung, Clyde River, Pond Inlet, Igloolik, Repulse Bay, Cape Dorset, Chesterfield Inlet, Baker Lake, Rankin Inlet, Whale Cove, Arviat, Taloyoak, Kugluktuk.
My general categorization of “early contact period”, “contact”, “1st generation” and “2nd generation” is very similar to Damas’ terms of “early contact phase”, “contact – traditional”, “resettlement” that he uses to create a timeline that describes the major phases of impact for Inuit society (Damas 2002: 7, 17).
Chapters 2 is meant to provide an inventory of the key aspects of current social issues in Nunavut. In this context I am looking at the four major aspects that in my opinion shape Nunavut’s society:
1) violence and other forms of social dysfunctions
2) the associated services and delivering agencies that try to address those matters
3) Education
4) Inuit cultural particularities in communication and socialization
Those four areas are forming the foundation for the rest of my work. The following chapters will guide the reader through the historic transformation process of Inuit pre-colonial semi-nomadic society to a society that is living in permanent settlements, strongly influenced if not in many ways dominated by Euro-Canadian culture. Each of those chapters will be referring to the social and cultural changes that happened in the different time periods that I labeled with “Pre-settlement, First, Second, and Third Generation”. The relevance of violence and other social dysfunctions, their context and strategies how each generation dealt with those matters will be analyzed while I will be also referring to the impacts that non-Inuit, primarily Euro-Canadians and Euro-Americans had and have on Inuit society.
